Former Aventura Marketing Council Chairmen meet Deborah Flowers and son Paul, now living in California, recently visited with Bob Hollander of Brown & Brown Agency and Elaine Adler, Aventura Marketing Council president, to share fond memories. Flowers and Hollander served consecutive terms as Chairman of the Board for the Aventura Marketing Council (AMC) in the 1990's. Deborah and her husband John, a retired Regimental Sergeant Major with the British Army, owned and operated an elite private security firm servicing Aventura, called Airborne Security. Their security officers were held to the highest standards of the British Army, ensuring that their firm was in great demand by all the commercial and residential properties. Bob Hollander and his family owned and operated Dade Underwriters, the premier insurance agency that served South Florida businesses and residents for 47 years before being acquired by Brown & Brown Insurance. Flowers served as Chairman of the Board for three years before moving to California and Hollander followed her as Chairman, serving four years in that position. Changes in rules helping pull plug on ‘RoboCalls’

Al Sunshine 4 YOUR MONEY One of my frequent pet peeves is getting those annoying commercial telephone calls and hearing a robotic, pre-recorded voice on the other end of the telephone. It usually happens when I’m in the middle of doing something else, or sleeping in late over an eagerly anticipated weekend. In the past, these kinds of calls were generally prohibited unless they came from a business you had a prior relationship with — and offered a way to immediately tell them we don’t want to hear from them anymore. But I never could find an easy way to let them know I’d like them to stop calling and without calling back “during normal business hours,” the darn things kept coming. They could call me whenever they pleased, but I had to wait for “normal business hours” to tell them to knock it off. Fortunately, starting in September, the rules

regulating “RoboCalls” are changing. Companies will be required to have signed approval to legally have their machines call our machines. If they don’t have that formal approval, they’ll be violating federal regulations, making them subject to up to $16,000 in fines per call. That means if you still get any RoboCalls, you may have a valid complaint to file with the Federal Trade Commission. Even so, there still will be some groups allowed to use RoboCalls to reach out and touch you, including banks, healthcare providers and “Informational Recorded Messages.” That also means you should double check all your service contracts and other agreements to make sure there’s no hidden fine print authorizing companies to contact you, without really letting you know you may be setting yourself up for even more RoboCalls in the future. In the past, telemarketers have found too many hidden loopholes in the law to stay in business. It almost seems as if so many laws are intentionally watered-down to allow the scammers to stay in business. And if you ask me, there are still too many exceptions to the RoboCall rules. Aventura Heart Center recommends: Get your seasonal flu shot ASAP Flu is a serious contagious disease. Each year, more than 200,000 people are hospitalized and 36,000 people die from seasonal flu complications. The center for disease control (CDC) recommends a yearly seasonal flu vaccine as the first and most important step in protecting against seasonal influenza. The flu is a contagious respiratory illness caused by influenza viruses. Complications of flu can include bacterial pneumonia, ear infections, sinus infections, dehydration, and worsening of chronic medical conditions, such as congestive heart failure, asthma, or diabetes. It can cause mild to severe illness, and at times can lead to death. The best way to prevent the flu is by getting a flu vaccination each year. In general, anyone who wants to reduce their chances of getting the flu can get vaccinated. The next

step is hand washing and staying away from people with upper repiratory illnesses. The flu vaccine protects against the most common strains of influenza A and B. It is not for H1N1 (Swine flu). That vaccine is being developed and hopefully will be available soon. Life in the City BY BARI AUERBACH ‘Back to School Boot Camp’ August 24…a day that will live in infamy as kids go back to school - still recovering from sunburns, mosquito bites and brain cell vegetation. Ready or not it’s time to bravely face those flashing school zone lights as moms launch operation boot camp to “Move! Move! Move!” kids up and out of bed bright and early – even though it’s still dark outside. By this time, most strategic back to school plans have already been meticulously mapped out. Given the complex nature of busy lifestyles, it’s not uncommon to find war boards posted on living room walls more regimented than the tightest military timetables. Weekday mornings, the convoy of yellow school buses and carpool warriors in SUV’s will once again start commandeering the roads headed to area schools. After the morning scramble and triumphant victory of avoiding the need for a late pass comes the quiet before the after school storm for the city’s parental

brigade. Some will head straight for the gym to get strong enough to haul and load all the paraphernalia needed for the kids’ extracurricular sports activities into already jammed-packed trunks. Others will opt to go into the office, where the stress of impending deadlines pales in comparison to the prospect of hearing, “Can you help me with my geometry homework?” One of the most popular detours is Starbucks - but sometimes, even massive infusions of caffeine aren’t enough to prevent exhausted parents from falling asleep behind the wheel while waiting in those long, winding school pickup lines. Of course, when the school day ends, it’s time to put “war board” strategies into action as soccer league and karate kick back in; dance classes start spinning; and too expensive tutoring sessions resume along with heated battles over who wants what for dinner. And so, a sincerely reverent salute goes out to all families currently immersed in back to school boot camp. The good news is teacher conferences and science fair projects are still far off; and there’s only about 330 days ‘til next summer!

Looking for Hale-Bopp Q: After 31 years of marriage (most of them happy), can you suggest something to put an extra sparkle in a relationship that is aurora borealis but wants to be Hale-Bopp. A: Hold it!While I am all in favor of adding sparkle to a relationship, remember one thing: The aurora borealis is always with us, while Hale Bopp was only visible for a few months and won’t be back for 200 or so years. So, yes, do something to add some luster to that 31-year-old marriage of yours, but most important, make sure that your relationship keeps shining, even if at a lower wattage, every day. To answer your specific question, most people find that going out of their normal environment adds that spark you are seeking. If you can afford to take a vacation, go someplace you would both find sexy – a tropical island, a ski slope, a cabin in the

woods, a night in a big city. If your budget is tight, then just rent a motel room for a night that has a waterbed or those magic fingers. And if you’re really on a shoestring, a few candles and some whipped cream can make any bedroom sexier. The other thing is to plan this night out at least a week in advance. Anticipation is a wonderful aphrodisiac, and the more you think about it and fantasize about it in the days before you actually do whatever it is you are going to do, the more excited you will be at the time. Q: Why do you think certain celebrities (i.e., Dennis Rodman, Ellen DeGeneres) are drawn to making such public presentations of their sexuality? Along the same lines, why are people so fascinated with the public displays of these celebrities? The Council for Disability Awareness offers great information for the disabled as well as educational information on the realities of a long-term disability and helpful ideas on how to reduce your chances of suffering from a long-term disability. As for protecting your income by way of long-term disability income insurance (LTD), I recommend the following: Do not assume your existing insurance will cover your expenses. Review your plan and know your benefits. Most employer/group plans have a

maximum benefit which is taxable. Very often the net benefit is as low as 40% of income. In most cases, this may be supplemented. Depending on your income and business structure, it may make sense to have a higher limit disability policy and tax deduct the premium. WHOLE BODY SCAN Whole Body Scans are used for “screening” of heart disease and cancer. In medicine, “screening” means looking for a medical condition in a person showing no symptoms in the hope of identifying problems early; when treatment can be most effective. CARDIAC CALCIUM SCORE Coronary artery calcium (CAC) has been shown to be highly specific for atherosclerosis, demonstrating that if there is coronary calcium present, there is plaque building up in the coronary arteries. There is ample evidence to now show that elevated coronary calcium scores (CCS) are predictive of future cardiovascular events, both independently of and incrementally to conventional cardiovascular risk factors. Based on current available data, patients with increased plaque burdens (increased CCS) are approximately ten times more likely to suffer a cardiac event over the next 3-5 years. Coronary calcium scores have outperformed conventional risk factors, highly sensitive C-reactive proteins (CRP) and carotid intima media thickness (IMT) as a predictor of cardiovascular events.

There are over 76 million baby boomers in the United States. Do we understand what a retirement plan consists of? Retirement plans are for our parents, not us–we are too young to think of retiring! The best time to start your retirement plan is in your twenties. Although, many people implement a retirement plan many years later. According to "Everyone’s Money Book–On Retirement Planning," by Jordan E. Goodman, "The largest sources of income are from Social Security (42%), employer-sponsored plans (23%), personal savings (21%), other government income (5%), sale of home or business (3%) and employment (1%)." Inflation must be taken into consideration when planning for your retirement. Early investing into different alternate sources of income such as an Individual Retirement Account (IRA), 401K Plan, Certificate of Deposit (CD), Money Market Account, 403 (b) Plan and 457 Plan are low risk and will help defray the inevitable rise of the cost of living. Let’s consider long-term care. What is long-term care? "Long term care can be inhome care, skilled nursing care in an extended care facility, assisted living in an apartment setting with nursing care available-- if needed, or a patient can live in a garden apartment which is like a condo type of setting–when the patient needs the security of an adult retirement community," according to Leah Jones, Admissions Coordinator of Noblesville Healthcare Center in Noblesville, Indiana. Let’s consider the cost of long-term care. Would you have enough resources to maintain your standard of living and pay for the cost of in-home care? If you had to go into a nursing home would you have enough financial resources to cover the costs of your care? If married, would your spouse be able to live the same standard of living they are accustomed to? AARP (American Association of Retired Persons) conducted a study in 2001. "The Costs of Long-Term Care: Public Perceptions Versus Reality" study that showed many people between the ages of 45 to 54 have no idea how much medical and nursing care will cost them. Many baby boomers assume Medicare will cover their medical costs when they retire from the work force. Some believe if

they qualify for Medicaid, their medical costs will be paid. "The national average for the cost of one month in a nursing home is $4,654 or $55,848 annually (costs vary widely depending on geographic location). Medicare does not cover extended nursing-home stays, and you must meet strict medical criteria to qualify for any coverage. Medigap- a private insurance supplement to Medicare–covers more costs, but its nursing-home benefit ends after 100 days in a benefit period, as does Medicare’s shortterm-stay coverage. Medicaid will help with the cost of nursing-home care in some cases, but only people who meet specific financial and medical criteria qualify for those benefits," according to AARP. Have you considered long term insurance? There are "long term care" insurance policies that can be purchased from an independent insurance agent. For long term insurance you pick the amount of daily benefit you want–approximately from $75-$400 per day. The premium increases according to the amount of benefit you choose. The higher the daily benefit is–the higher the premium will be. Long term insurance policies are more expensive the older a person gets. Inflation can cause the premiums to skyrocket without prior notice. After you submit a claim, a board will determine if the insured is deemed chronically ill–meaning the insured is unable to independently perform several daily living skills, such as; walking, bathing themselves, feeding themselves, using the toilet and the ability to transport themselves. Once the insured’s claim is granted, the policy goes into effect. Specific criteria must be met for the insurance to cover the medical services the patient receives. For example–if a patient submits a claim for in-home care, the health care provider must be licensed. "Aunt Nellie" won’t be paid to take care of

them. There are various local organizations that can refer you to licensed health care providers and if need be, licensed healthcare facilities. Long-term care insurance enables the insured person and their loved ones to keep more of their assets. A large monthly premium may be a burden, but in the long run–is it less expensive than having to pay for long term care by liquidating your estate to pay for medical care–possibly leaving your spouse homeless? Tips for investing in long term care insurance: • Before buying long term insurance read "all" of the fine print. If you are unsure of the terms of a policy you are considering or don’t understand the policy, have your lawyer go over it with you. • Don’t be in a hurry. Shop around for a policy that will meet your needs and fit within your budget. • Are the premiums guaranteed to stay the same as the cost of living increases? Is it stated in the fine print? • What are the exclusions? • What are the renewal terms? Is it guaranteed renewable? Underestimating costs is one of the most common mistakes when planning for your

retirement. The $100,000 you have in the bank may not be sufficient to cover your future long-term care costs. Invest in your future. You will be glad you did. Tips on Creating a Will SENIORGUIDECITIZEN BY CURT HAGEDORN Though everyone needs to make one, the word “Will” is very often one which people feel they need to whisper as though it were some dark secret, and the act of making a Will seems somehow an acceptance of the fact that we all have to go someday far too real for many people. However, like death and taxes, there’s really no way of avoiding making a Will if you have any wishes at all that you would like to see carried out after your death, or have any property which you wish to be disposed of in a specific way. Here are a few tips. • First and foremost, make one. In most cases, you may not need a lawyer to make a will, and there are even a variety of free or inexpensive computer programs out there that can take you step by step through the process. If your financial and family arrangements seem too complicated for do-it-yourself, or if you’re just uncomfortable, ask friends, family and business associates to recommend a reliable and trustworthy lawyer to help you through the process – remember that it’s up to you how much of the lawyer’s time you use, you don’t need to turn over your entire legal life, but may merely want to schedule an hour’s question and answer period for questions which may have arisen in preparing your own will. If you feel pressured or feel that charges are exorbitant, shop around – if there’s one thing there’s an abundant supply of these days, it’s lawyers. • Take a class. Your local college or university, adult education or community center may provide classes in will making and estate planning. If you’re uncomfortable about the process, there’s no better way to demystify it than by learning something about it. If you can’t find a class, try organizing one at work or at your church or other community group – you’re going to find that there are a lot of people out there just like you, current statistics show that about 70 percent of Americans don’t have wills.

• There are rules concerning the validity of wills, which vary from state to state, which your lawyer should know and you can check with your state and local government. For example, some states will accept a handwritten will, others require the will to be typewritten or in a certain form, witness requirements are different and so on. • Keep it simple. Part of the reason that people shy away from making a will is that it is, in some ways, your final statement of the “value” of your relationships, at least as far as distribution of your assets is concerned, and so preparing a will seems like a task on the order of organizing a family reunion – huge and fraught with the potential for drama. Your will does not have to be all things to all people – merely to dispose of your assets in a manner which makes sense to you. And, all of the scenes you’ve seen in movies and on TV notwithstanding, a will is not an opportunity to settle old scores or cause hurt. Decide on the people and institutions you would naturally like to see receiving some of your assets after death, and let those left out worry about it on their own. • Wills are not final. Remember to update your will, once you’ve written it, should there be any significant change in your life. For example, if you have another child, if you purchase additional property or a country house, if you get divorced and so on. • Though few wills are ever challenged, if you die without one, the state will decide upon the distribution of your property and, if you have any, custody of your children. Why would you ever want that? • In addition to a will, remember you might also want to create documents called “Durable Powers of Attorney” which deal with asset management in the event you’re incapacitated for a period of time, and a what is often called a “Living Will” which contains directions from you concern healthcare issues like the use of extraordinary means of resuscitation and continuation of life support.

Why you should consider long-term care insurance BY BRUCE DAVIS The majority of us will require assistance with health and personal needs. Long-term care, whether provided at home or in a nursing home, can be very expensive. The average cost of one year in a nursing home is nearly $74,000;1 round-the-clock home care can be much more.2 Unfortunately, many people are not prepared for these expenses, partly due to increasing life expectancies. Half of couples age 65 and over can expect one spouse to live past 90.3 And living longer does not always mean living healthy. When you cannot perform two of the six Activities of Daily Living (bathing, eating, dressing, toileting, continence, transferring), long-term care insurance can provide for paid assistance. Neither the government nor your health insurance will cover your long-term care needs. Medicare provides little, if any custodial care. Medicaid, which is a government welfare program, will not provide long-term care for you until you have impoverished yourself down to $2,000 worth of assets in most states.1 Furthermore, Medicaid no longer excludes the value of your personal residence from your net worth. In addition, it will “look back” five years for possible asset shifting among relatives. In addition, we are a generation that overspends and undersaves. Many people do not invest enough for retirement, much less plan how to protect those assets from being consumed by long-term care needs. No one wants to labor a lifetime to accumulate assets only to see them depleted by health care expenses. Whether you want to preserve your estate for your heirs or simply have enough to pay these expenses without exhausting your assets, you should consider long-term care insurance. “We insure our homes against the slight risk of losing them in a fire, and our autos against the somewhat higher risk of damaging them in an accident. These risks pale beside the magnitude of risk of needing

care as we age, which is greater than 1 in 3,” according to one major insurer.2 “Unless you have made provision for long-term care, your financial program could be thrown into chaos by large, unanticipated costs.”1 If life insurance is your protection against dying too soon, then long-term care insurance is your protection against living too long. What should you look for in a policy? • Be sure the policy covers in-home care; most of us would prefer to stay in the comfort of our own home. For every person in a nursing home, there are four more being cared for in their homes.2 In-home care may include home health aides and personal care attendants for help with hygiene, dressing and managing medications. Homemaker services may be available for help with meal preparation, laundry and light house cleaning. • Adult day care programs are usually covered, as is hospice care in the event of terminal illness where special care at home or in a facility is required. • Substantial discounts may be available for shared policies that couples buy together. • Check the policy to determine if care providers can be independent, rather than affiliated with a home care agency. That way, even friends and neighbors may be able to provide unskilled services. • Be sure that assisted care facilities for Alzheimer’s are not excluded, and that you can have private duty nursing care in a nursing home if desired. • A good policy will have built-in inflation protection, providing annual benefit increases. Once coverage begins, some policies waive premiums. You must select several required options: • What do you want the monthly benefit to be? Most people choose between $3,000 and $5,000. In a good policy, the amount you do not use one month stays in the pool of available funds, thereby extending the life of the policy. • For how many years do you want coverage? The average stay in a nursing home is 2.4 years and home health care is longer. Therefore, many people choose 5 to 7 years. 4

• How long will your elimination period be before benefits kick in? All policies have an elimination period — the amount of time you must pay expenses yourself before your coverage begins (e.g., 30, 90 or 180 days), which is like a deductible. The longer the elimination period, then the lower the premium will be. Considering long-term care needs requires us to look far ahead. Since premiums are based on age, the younger you are, the less expensive the premiums can be. Premiums are also flat — but rate increases have been made on some policies. Consumers should examine the history of rate increases made by companies they are interested in for long-term care. A financial advisor can help you select the coverage you need and determine a financially strong insurance company with a good track record. Long-term care insurance provides a financial “safety net” to help preserve financial independence, choice and dignity in advance of any unforeseen circumstances or crises. It can be a thoughtful way to protect rather than strain family relationships when the time comes for you to need care.

Computer Programs BY PATRICIA C. FRANK You may not own a computer or know anything about them but you can still benefit from their systems and take advantage of how they operate. After all, computers were invented by human beings to offer individuals increased options in their lives. If you compute something you find out a definite fact. Then you figure it out and you work it out. It is not necessary to have the actual equipment. You already have an inner computer. It was installed at birth. You can use this inner computer to do all kinds of amazing things. When things go wrong in your life and when you feel depressed or sad or angry you can use your inner computer to reprogram yourself. For instance if you are in an unhappy relationship and you cannot think of anything good or positive about the other person there are specific things that you can do to change your feelings. You can use your inner computer to reprogram yourself. You can download a program and install it in your heart. It will require you to write down one thing that is good and positive about that person. You will need to run this program everyday. At the end of a month your previous

thoughts and feelings will be erased and a new program of positive and loving thoughts and feelings will be installed. If you are depressed you have several programs running simultaneously. These files are labeled; Hurt, Resentment, Guilt and Anger. These files must be turned off to allow you to continue to operate. If they remain in your memory they must be disenabled so that they do not disrupt your other positive programs. They have to be deleted. You have to start over. You have to click on forgiveness. Forgiveness is a basic program. You will have to upgrade it to include self-forgiveness. You will also have to install; self-acceptance, self-esteem, and selflove. It is necessary to run these programs everyday until they override the other negative modules. It is also a good idea to have anti-virus protection. This is a code you can install to protect yourself and your system from becoming infected with negative, self-defeating programs. Without protection and vigilance everything that you worked so hard to install in the hard drive of your life can be obliterated in a second. Be careful and be aware. HOA and Condominium Associations in Cash Crisis BY: BEN SOLOMON, ESQ.

Many homeowners and condominium associations throughout South Florida are experiencing a cash crisis as a result of owners failing to pay their required maintenance assessments. Without this necessary income, the associations bills pile up quickly leaving important services such as insurance, lawn care, management, and maintenance unpaid for, with some vendors unwilling to provide further services. Severe cases can leave associations without enough money to maintain basic necessities such as fire and safety equipment, security gates, and even water and garbage services. To make matters worse, some lenders are refusing to issue loans on the units within these communities and condominiums due to the severe delinquency rates of the associations, essentially putting a freeze on the marketability of such units. Much of the problem can be attributed to investors, many of whom own multiple units in the same community or condominium, not paying their assessments (some of whom receive income from tenants living in their units but still refuse to pay their assessments). An association’s best course of action is to find a competent, diligent and aggressive attorney. Legal incompetence (including not utilizing effective legal strategies for the current market), an attorney’s inability to communicate with the board and manager of the association, and/or the failure of an attorney to proceed aggressively and diligently on behalf of the association, can cause unnecessary delays and additional financial suffering. For instance, some attorneys advise their clients to follow the passive approach of not filing liens against delinquent units and not proceeding with association foreclosures, thinking that lenders will eventually foreclose their defaulted borrowers and pay the association its money. The reality is that in today’s market, lenders are stalling their foreclosures until they find buyers first, so the process can take an unreasonably long period of time. Meanwhile, if the first mortgage holder does finally take title to the unit through its foreclosure, it is then entitled by law to a sizeable write off of the prior owner's past due amounts, resulting in significant bad debt to the association. This bad debt is then absorbed by the association and eventually paid for by the responsible owners who are paying their assessments.

To succeed in the current market, associations need an aggressive attorney who files liens against the delinquent unit owners quickly and, in applicable cases, files foreclosure complaints (lawsuits) against the delinquent unit owners to collect the amounts due to the association. There is also a new blanket receivership approach where, by law, associations can petition the court to appoint a single receiver to collect the rents from all tenants living in units that are under foreclosure by the association or which come under foreclosure in the future (which prohibits investors from collecting income from tenants while failing to pay their assessments). Aggressively applied legal pressure against the owner and/or their lender is especially necessary in this type of depressed real estate market and will undoubtedly bring in a lot more money to the association in a much faster time than simply waiting for the lender to come through.
