Pro Bowl and Super Bowl take center stage at Aventura Marketing Council Board Meeting hosted by Wells Fargo Advisors When Aventura Marketing Council Board members met recently with Mike Zimmer, president of the South Florida Super Bowl Host Committee, there was good news to be shared. Zimmer explained that the Pro Bowl, to be played at Dolphin Stadium on Sunday, January 31st, the week before Super Bowl on Sunday, February 7th, is nearly half sold out. With approximately 70,000 tickets available in Dolphin Stadium, over 30,000 had already been ordered—and the ‘buzz’ on Pro Bowl was just beginning. “Pro Bowl has been played in Hawaii for over 30 years, and this is the first time it’s on the mainland in 35 years, giving South Florida an incredible opportunity to garner worldwide exposure while creating an economic boon,” said Zimmer. For the first time, four counties are participating in the football activities: Broward, Miami-Dade, Palm Beach and Monroe, and activities are being planned in all four counties. From rallys featuring NFL alumni and cheerleaders to mall activities and beachfront parties to the exciting Fan Plaza at Dolphin Stadium, fans will be able to partake of the excitement and fun surrounding both games. Edward Jones grand opening set for Aventura officeparty BY LYNN CARROLL The Aventura area now has its own Edward Jones office - and everybody is invited to a Grand Opening on Nov. 5th from 6 to 8:30 p.m. at 3091 NE 163rd Street, North Miami Beach. The popular financial services firm requests RSVPs by Oct 27th, so Financial Advisor Jonathan D'Oleo can prepare in the responsible fashion that's been the hallmark of the firm since it was founded in 1922. "We plan complimentary cocktails, some live entertainment and great networking opportunities," he says. "This should really be a great opportunity for local business owners to meet each other." Edward Jones is the biggest financial services company in the U.S. in terms of the number of offices, D'Oleo says, with more Jonathan D’Oleo, Edward Jones than 10,000 offices nationwide and through its affiliates in Canada and the UK - each staffed by one financial advisor and one assistant. The firm specializes in boutique-style, personalized service. "We cater to individual investors in a way that's hard to match," D'Oleo says, "We're very community-oriented. Clients don't have to go downtown to the 25th floor of a skyscraper. If need be, we go to them." "Also, Edward Jones is privately held. That takes us out of the media and Wall Street mayhem. We're aloof from the conflicts of interest you find elsewhere. We have no shareholders to report to." And since there are no proprietary products, it also means clients can expect Edward Jones to conduct a thorough analysis and find answers that are solutionsbased, not products-based, says D'Oleo, a native of the Dominican Republic with a degree in economics and business from Brandeis University. He says he joined Edward Jones because he's a people person, not just a numbers cruncher. "I learned the profession as an analyst in Boston," he says, "but Edward Jones gave me the opportunity to develop a people-oriented business from scratch." For more information about Edward Jones and to RSVP for the Nov. 5th Grand Opening, call Tina at 305-945-5175.

The latest in Women's Imaging at The Memorial Healthcare System October is Breast Cancer Awareness month. Women, aged 40 and older are encouraged to get their annual digital screening mammograms. New research shows that women with very dense breast tissue carry a four-fold increased risk for breast cancer. While mammography is the gold standard for screening for breast cancer, breast ultrasound plays a significant complementary role in women with dense tissue or those who have other risk factors. "Annually, approximately 30,000 women are screened with digital mammography at Memorial Healthcare System," says Mary K. Hayes, MD, Medical Director, Women's Imaging Services. "We offer women access to digital mammography, breast ultrasound, breast MRI, digital tomosynthesis mammography, and breast PET Mammography (PEM). These are the newest available technologies that Breast Imaging radiologists use to screen, diagnose, and follow women for breast disease." "Each breast imaging patient at Memorial Healthcare System gets a "risk assessment profile, says Hayes. "This allows the physicians, who are board certified, sub-specialist breast imaging radiologists, to care for the individual patient based on her personal risk profile." A new tool, called Digital Tomosynthesis Mammography (TOMO) is a next-generation, low-dose digital mammogram that allows physicians to literally page through the breast tissue mil-

limeter by millimeter. It's analogous to looking at just the cover of a book versus reading each page of the book. TOMO will trial in July and will open a new FDA screening TOMO trial of up to 450 patients starting in October - November, 2009. This trial is performed in conjunction with Massachusetts General Hospital researchers. Finally, Breast PET Mammography (PEM) is an FDAapproved breast imaging tool that is used in patients who either previously or currently have breast cancer as well as women who have a difficult mammogram and are at high risk. PEM is a new, advanced application of PET scanning. PEM scans image of only the breast tissue and look for abnormalities that are 1.5-2mm size. The abnormalities that are identified on PEM can be mapped for biopsy and imaging can be used to follow patients being treated for breast cancer. This trial is performed in conjunction with the University of Chicago researchers. For more information on Digital Tomosynthesis Mammography (TOMO) or Breast PET Mammography (PEM) as well as other Breast research trials at Memorial Healthcare System, contact 954-265-3344. Life in the City ‘Fairytales can come true’

BY BARI AUERBACH Since Disney released the newly restored fairytale Snow White on DVD and Blu-Ray combo packs, there has been a spike in dwarf-like behavior around town… Bashful: Batting long eyelashes, this kind of girl just appears bashful – but if you’re an affluent “prince” of a guy – beware! Her true aggressive nature will appear as she casts a shopping spell and you find yourself maxing out your credit card at Aventura Mall! Doc: Wearing glasses and scrubs, Doc was recently spotted at Aventura Hospital diagnosing some bad stomach aches that weren’t caused by poisonous apples – just a few too many famous apple pancakes from the Original Pancake House. Dopey: Just like this endearing dwarf, neighborhood guys without beards who

like long hair to cover big ears don’t think it’s dopey to go to Aventura salons, where really pretty stylists make everyone look ready for a royal ball. Grumpy: Motorists magically getting caught by cameras for running red lights may be grumpy but they’d be scowling even more if they lived in Parkland, where now you can get a fine for texting while driving. Sleepy: Wishing they could be sleeping beauties, all the Aventura moms who stayed up late with crying babies help keep the coffee business booming and Starbucks very busy! Sneezy: With so many people lining up for flu shots, it’s probably wise not to go around kissing any frogs – unless you fall for an Aventura professional who’s nothing to sneeze at! Happy: If there ever was a dwarf who could be the city’s mascot it would be Happy – the one who best represents why everyone lucky enough to call Aventura home will surely live “happily ever after!”

Hampton Inn hosts Marcia Slow Sandler, “So You Want to be an Author?” Speaking from the heart, long-time friend and member of Aventura Marketing Council, Marcia Slow Sandler delivered a powerful message at a recent Business Development Committee meeting hosted by Hampton Inn Hallandale Beach Aventura. “Just do it”, she says passionately. “If there’s something you want to do, don’t let anything keep you from it.” Introducing herself, Marcia reflected on the many titles she’s acquired and the significance they have had throughout her life from daughter, granddaughter, sister, niece, cousin, friend, girlfriend, fiancé, wife, mother and grandmother. She found herself relocated to Florida where she took her first job at the Pembroke Pines Police Dept. where she acquired a new title, Crime Watch Coordinator, then at the Hallandale Beach Police Dept. as Public Information Officer. After retiring, she returned to work as the public relations person for Hollywood Greyhound Track and currently as Director of Community Relations for Mardi Gras Casino & Racing. But there was something more Marcia wanted, more than anything. A passionate writer, Marcia found herself with spare time on her hands after the passing of her late husband and she decided to put her sleepless nights to work with pen and ink and began writing murder mystery novels using the knowledge she gained professionally combined with her own personal life experience and active imagination. The result – one published book and two on the way: “A Murder 2 Die 4” is available in stores now; “A Campaign 2 Die 4” will hit shelves in late November; and without a moment to spare, Marcia is fast at work completing book number three which is expected to be available as early as Spring of 2010. Now touting her latest title as “author”, Marcia exclaims “This accomplishment is the most unbelievable experience in my life.” Her message, loud and clear, “Everyone has a story to tell,” she says. “The only thing you need to do is sit down and write it. The hardest thing about writing is ‘stopping!’” “At first start, I always know who, when, where and how the victim in my books get murdered, I just haven’t figured out who murdered them. So, when I get to the end of the book, sometimes I am just as surprised as the reader!” “A Murder 2 Die 4” is on shelves now and can be purchased at Barnes&Noble.com

ASK DR. RUTH BY DR. RUTH WESTHEIMER

DON’T GIVE UP Q: My husband and I have been married for 10 years and we have been happy. My problem is not his fault. Not once in my life have I ever had an orgasm. I don’t even know if I have ever come close. I hear my friends saying how great sex is, and I have tried everything with my husband that we’re comfortable with, going as long as two hours, and still nothing. I believe I know what part of my problem could be, but my husband does not agree with me. I was sexually abused from the time I was 8 years old until I was 16. (I’m 27 now). I know sex can be beautiful between two people who

Page 9

love each other, but sometimes I feel like what we do together is “dirty,” though I know it’s natural. A: The first thing I want to say to you is don’t give up. While what happened to you as a young girl is very sad and you will never be able to forget it, you shouldn’t make it worse by allowing it to ruin sex for you for the rest of your life. Having sex with your husband for two hours is not the answer. What you have to do is learn to give yourself an orgasm first, and then teach your husband what to do. Don’t worry if it doesn’t happen the first time you try, but I’m willing to bet that if you give yourself a fair chance, you will be able to enjoy orgasms. So learn how to have one, then you can transfer that knowledge to your husband, maybe with him manipulating the vibrator at first. You have to learn not to let those sad memories flood your brain, because as long as they do, it will be impossible for you to have an orgasm. But once you learn what it takes, you should be able to have a satisfying sex life.

Wish Upon A Star Gala to culminate The Marian Center’s 2009 Fundraising Season BY TONI LYNN ACOCELLA The auxiliary of the Marian Center School and Services will culminate this year’s fundraising season Saturday, Dec. 5 in the Wish Upon A Star Gala. Proceeds of the gala will be used to advance the Center’s commitment to the educational, vocational, emotional and spiritual development of its students ranging from birth through adulthood. The gala will be held in the elegant setting of the Surf Club, with dining, dancing and an eagerly anticipated silent auction. Located on a secluded, lushly landscaped 50-acre campus in Miami Gardens, this landmark institution, often described as the “hidden jewel of South Florida,” was established in 1963 upon the recommendation of the Archdiocese of Miami to educate, train and serve students of all faiths with developmental disabilities. To achieve this goal, Archbishop Coleman F. Carroll recruited the Sisters of St. Joseph Benedict Cottolengo, renowned within Italy for their work with and advocacy of the disabled. Eleven Sisters, under the

leadership of Sr. Lucia Ceccotti, traveled to Miami from Italy on October 21, 1963 and began work to develop their first center outside of Europe. The following year they admitted a charter class of 40 pupils. From these humble beginnings in a convent, the sisters developed a high-quality and loving learning environment that today serves approximately 150 students from birth to middle age within a modern facility that comprises seven classroom, rehabilitation and residential buildings. Available services provided by the Marian Center, now under the management oversight of Catholic Health Services and the Archdiocese of Miami, include speech, occupational and physical therapy, life skills, basic academics and self-care. The dignity and self-worth of the individual is the common thread running through the Marian Center’s core. The 2010 fundraising season will kick off Feb. 25 with the Marian Center Auxiliary’s Fashion Show & Luncheon, also to be held at the Surf Club. Strategy for success BY PATRICIA C. FRANK MSuccess is defined as achieving a good and happy result. It is usually thought of as the attainment of wealth, fame, position, inner peace and happiness. Everyone has their own specific definition of what success means to them. There is also general agreement that success is a desirable goal. While everyone may want success, everyone may not know how to achieve it. In order to be successful, you have to have a strategy. A strategy is a plan of action. It is a deliberate tactical maneuver designed to bring about your goals. You need to have a stratagem. It needs to be smart, calculated, shrewd and wise. You can customize it to suit your needs and fulfill your desires. Part of the strategy you develop must contain certain characteristics. Success begins with a dream. Once you have your dream, you can begin. Discipline must be a vital part of any plan. Discipline establishes order and gives you control over the variables involved. You have to do the appropriate and necessary things whether you feel like doing them or not. Discipline is a mental process.

BWFG

It is a decision you make to follow through no matter what. Faith in yourself is another vital part of a plan for success. You have to believe that you are worthy of achieving it. You have to believe that you deserve success. You can reinforce these beliefs with “I am” and “I have” statements. For example; “I am; talented, strong, creative, inspired, honest, and the power and ability to achieve my goals. You also have to believe that it is emotionally and psychologically safe for you to be successful. There may be several reasons why it is not safe for you to succeed. Your success may upset the equilibrium in your relationships. It may hurt family members in some way. If you do not make any progress or see any changes, try to discover what thoughts and feelings or fears might be holding you back. What messages did you receive as a child? What messages are you receiving now? What do you believe about yourself? What needs and whose needs are being met if you succeed or if you fail to achieve success? Don’t just wish that you will be successful, take action. Create and follow your strategy. Patricia Frank is a Licensed Psychotherapist. She can be reached at 305-788-4864, 212-308-0309.

Eat this...drink that... BY SHARI LYNN ROTHSTEIN-KRAMER Caterers Should Provide More than Just Food Name the three most important elements in any event. Do you have them in your head? (If not, you have another minute, think!) Okay, for me, they are entertainment (the music), décor (what does the room look like) and food. Be it a wedding, Bar Mitzvah, charity event, award gala, or a soiree in my own home, I expect the food to be abundant and amazing, not to mention, visually stunning. I look to caterers not only for the food, but for presentation. I am not talking about restaurants that can provide platters. Everybody love Mo’s (who can resist a platter of Nova lox, whitefish, baked salmon, sable, herring, and so on), but I am talking about a full-service caterer who cones to your event, creates a gorgeous spread, with beautiful displays created to match the theme of your party or various courses plated so perfectly that each and every guest’s mouth falls open with delight. I know they exist—I have been to enough South Beach based events to know this for a fact—but where are the good ones up here? I know of a few caterers per se, but so far, I’ve been blown away by very few. I found a company based in North Miami Beach called 2Taste Catering. The owner, John Rossetti, is a former New Yorker who performed his way around the world and would up falling in love with food. He combines delicious cuisine with dramatic presentation (think about three-story high acrylic pedestals lit in the color of your event and adorned with striking floral arrangements that coordinate with the

food) for every event he caters. From private interactive dinner parties to the Orange Bowl committees’ events, 2Taste is responsible. There’s never an “off” day for this guy. He is reliable, jovial, and serious about his craft. When you think it’s perfect, he goes the extra mile to make it that much better. That’s what I call service. And he makes a mean gazpacho, espresso rubbed rib eye, and mac-n-cheese (among other things). Another caterer I like is is Eggwhites Special Event Catering. Also in North Miami Beach, they offer stylish presentation and the food tastes good, too. Lots of pretty passed hors d’oeuvres, for big and small groups. I recently learned about a cool “fitness facility” called CrossFit. Also based in North Miami (on 164th Street), they’re a no-nonsense “gym” dedicated to health and training. So, why am I telling you this? Well, they’re having a Grand Opening on Saturday (October 3rd) and it’s from 10 a.m. to 1 p.m. and they’re serving a healthy brunch to attendees. After chatting with the event planner, she told me she went to Downtown Events in Broward County to execute a reasonably priced menu with an egg white omelet station, fruit platters, soy and coconut milk for coffee, and more (okay, there are waffles in that mix too, but again, not everyone is a totally healthy) — there’s got to be something for everyone. Now here’s the thing—I kept looking for Aventura-based caterers, and I really could not find any. I Googled, looked on the City of Aventura Blog (www.cityofaventurablog.com), which has tons of info on local businesses, drove around, and asked, but everyone told me about restaurants, which defeats the purpose of this article! So, I continue my search for excellence. Any thoughts? You know where to find me. Let me know.

Wise investment strategies to earn money with safety Al Sunshine 4 YOUR MONEY Doral retiree Dan Cappi knows times are tight. Like so many other South Florida residents, he has trouble saving money. “I have to skimp,” he told me. “I can’t save anything. I can’t go out much. I sit at home and watch the news and my blood pressure goes up.” Financial planners know Dan Cappi is not alone. So to avoid letting our tough financial times raise your blood pressure, now’s a perfect time to refocus your endof-the year financial planning. Ask yourself some key questions: How much money can you afford to save or invest? How much cash do you need for monthly bills like rent, mortgage payments, gas, food, telephone and electricity? Cut spending to maximize and grow your available cash. And then ask yourself some tough questions. Do you really need all those extra channels on cable or satellite TV you may never really watch? Do you need more than one cell phone and do you really need a wired telephone at home if you also have a cell phone? Also, check out your time horizon. Calculate how much time you have before you’ll need any of your retirement income. Consider rebalancing portfolios between stocks with less volatile investments like bonds and cash. The closer you get to retirement, the more you need to consider trimming back investment

blends. Stocks may offer potentially higher returns, but they also can lose value. However, “Safer” bonds may not grow like a good stock blend might, but may offer a “safer harbor” for your money. Coral Gables Financial Planner Lane Jones recommends, “For the long run, it’s a decision we all have to make for our own risk levels, balancing between stocks and bonds. You have to check out your own circumstances for the answer that question.” Younger investors should consider an 80 percent stock/20 percent bonds mix, balancing possible long term growth and volatility of stocks with the slower-butsafer growth of bonds. If you’re in the middle of your investment cycle, consider reducing the risk to a 70/30 percent mix. And as you approach the middle of the cycle, you may want to look for an even safer 60/40 percent blend. Remember, you’ve got to figure out what is the best for you. You have to decide your own risk tolerance. And as we get closer to December, consider doing even more to improve your money’s bottom-line for 2010. As a general rule, try to increase savings, pay down credit card debt and avoid any unnecessary spending. Some financial advisors say now is a great time to diversify your portfolios as a hedge against Wall Streets’ ups and downs. And don’t forget about foreign stocks and the weakening dollar. Over the coming months, some foreign markets and their currencies could end up with better yields than Wall Street.

COMPILED BY BARI AUERBACH According to Health.MSN.com, choosing the best way to workout for your body, personality and lifestyle is “no sweat” if you know the pros and cons of popular exercise modalities like these: Stability Balls: Pros: “Anyone can use the ball to increase strength and stability and decrease back pain,” says lifestyle specialist Sara Hauber. “People who use stability balls correctly can build strong core muscles and have fun doing it.” Cons: According to Aventura area personal trainer David Landau, “The stability ball, in its use in games and sports for developmental skills in children is very fitting. But for adults in a personal training setting, all we have is essentially a formal developmental skill portrayed as exercise that was initially realized in our youth. There are certain adaptations such as the balance that you accrue while you are on the ball, but once off the ball you are back to square one. “True objective of exercise is progressive muscular strengthening. The exercise systems associated with this purpose involve the controlled lifting of weights such as barbells or the utilization of strength training machines in an advancing manner to provide a meaningful localized training effect for the human muscular system. Again, once you ‘get off the ball,’ there is no transfer of meaningful effect whatsoever. You simply become better and more skillful at ‘exercising’ on a ball. “Simply stated, skill training is one thing, and that is clearly what the ball provides unto itself. Superior strength and

conditioning is another story all together…progressive physical training still remains the most productive way to address your exercise needs.” Interval training: This well-researched exercise technique alternates bouts of high and low-intensity exercise, such as intervals of sprinting and jogging. Pros: “Intervals increase calorie expenditure and afterburn, so calories are burned [even] after the exercise is over,” says Brad Schoenfeld, a certified strength and conditioning specialist. Resarch from the University of Guelph shows that interval workouts burn more fat and improve fitness faster than moderate constant exercise. Cons: Schoenfeld says that high-intensity intervals can be difficult or even harmful for people with certain injuries and disorders. Active gaming: “Exergaming” is video game technology that gets participants leaping, swinging and sweating—and they’re moving beyond Wii or Dance Dance Revolution. Video game-enabled bikes, boards, pads and other equipment are popping up in schools, health clubs and even doctors’ offices. Pros: “Active gaming makes exercise fun,” says Lisa Hansen, M.S., co-director of XRKade Research Labs at the University of South Florida. “Participants enjoy themselves, which motivates them to go to the gym more and work out longer.” Cons: Research from the University of Michigan Health System shows that actual sports burn three to four times more calories than virtual exercise—so exergaming shouldn’t replace “real” activities. Plus no one is checking your form or correcting poor posture, so the chance of injury is increased for inexperienced gamers.

Aventura Hospital and Aventura Comprehensive In recognition of the 25-year anniversary of Breast Cancer Awareness Month and the ten-year anniversary celebration of the dedication of the Aventura Comprehensive Cancer Center, Aventura Hospital initiated the month of October with two special commemorative programs bringing together colorful groups of volunteers, survivors, and community leaders in support of Breast Cancer Awareness Month. On October 7th, Aventura Hospital and the Aventura Comprehensive Cancer Center hosted a special reception in the hospital's main lobby and mezzanine. The reception began with a special volunteer performance by students in the Krop Sr. High Jazz Band. As the students played an uplifting jazz set, guests signed a special commemorative banner and enjoyed pink refreshments, including pink ice cream generously donated by Blue Bell Ice Cream. Aventura Hospital CEO Heather Rohan commenced the program by welcoming guests and stressing the importance of early detection. "The American Cancer Society predicts that in 2009, some 192,370 American women will be diagnosed with breast cancer," she stated. "The good news is that if breast cancer is caught early, the five-year survival rate is 98 percent. The death rate continues to decrease in the U.S. because of improved treatments, preventive measures, and increased mammography screenings rates." Two brave survivors shared testimonials of their own personal triumphs in overcoming their cancer. "In my work, I know cancer," said Annette Watt, Director of Radiology Services at Aventura Hospital. "But it became very personal for me five years ago when I was diagnosed with breast cancer. I am now blessed with an ability to empathize with patients, and I hope my story will encourage more women to get their mammography screenings early as I did." "The most important advice I can give to others is not to give up," said Vlasta Jarolim, a breast cancer survivor of almost two years. "Get educated and get involved! By focusing on the future and helping others, you learn to appreciate life more. I am not afraid anymore!" Patient care involves comforting the mind and spirit as well as treating the disease. For that reason, Tootsie, Ribbon, Mr. Big, and Pinky, therapy dogs from the International Delta Society and the Humane Center, made a special appearance during the evening, sporting their own pink outfits in support of Breast Cancer Awareness Month. Aventura Hospital's therapy dogs are specially trained volunteers who visit with patients with their handlers. These caring animals have undergone special evaluations to be eligible to visit and spread joy to patients and their families. Aventura Commissioners Billy Joel and Bob Diamond, Miami Gardens Mayor Shirley Gibson and North Miami Beach Mayor Myron Rosner each attended the special program and presented

proclamations on behalf of their municipalities urging women everywhere to get the facts about breast cancer and to take proactive measures to reduce their risks of developing breast cancer. At the conclusion to the evening, Heather Rohan, Annette Watt and Vlasta Jarolim were joined by, Alice Meltzer and Bonnie Lotterman, two other breast cancer survivors, for a special ribbon cutting ceremony in front of the hospital's main fountain. As the Krop Sr. High Jazz Band played another set and the women cut the pink ribbons, the Aventura Hospital lights up pink for Breast Cancer Awareness Month fountain sprang to life with pink water. Guests were then invited out to the front of the hospital where they witnessed that the entire and the Florida Breast Cancer Foundation were building was bathed in pink lights. Aventura also in attendance to provide information on Hospital will remain pink for the entire month of resources and support. WEEKLY HOROSCOPES

MORTGAG E UPSIDE DOWN? NEED HELP?

Aries - You could soon be making investments together with a friend or associate, but if you do some quiet investigation, you may find that there are secrets being kept. This may not be a bad thing, it may turn out that you find a source of income someone else overlooked. Taurus - You may be looking at a promotion or a job offer that will significantly improve your social status and overall happiness. You will want to spend a lot of money to celebrate your good fortune but it is a good idea to put some aside for your future first.

Gemini - You will find yourself in the middle

Call Walter at 305-606-5929

of a busy and exciting social-chat-fun week when the phone rings and someone from the office threatens to spoil everything. Turn the tables on them and invite them to join you instead. A little social bonding may make you more effective in the workplace.

Cancer - If you want your partner to be more sexy, indulge their desire to talk this week. You could find yourself drifting into some pretty sexy conversations. You may also be talking about the possibility of bringing more children into your family. You'll be highly creative this week.

Leo - You could stumble across an ideal solution to a loved one's home or residency problems this week. The money that you need will free up, an offer will be made to help, or a solution will be found in some kind of shared accommodations that brings down the costs.

Virgo - You may be spending a lot of time on the phone sharing good news and juicy gossip this week. A sibling or close friend has some interesting news about their love life that they want to share, and may come to you for your advice. "You only live once" is all you need to say.

Libra - You and your significant other and or business partners or associates will be discussing the potential availability of extra money. You will need to plan and discuss the best way to make use of the extra money that will soon be coming your way.

Scorpio - You will be the centre of attention this week, particularly if you are single and looking for love - it seems everyone is suddenly noticing you and they find you highly attractive. This is a good time to tell a special someone what you are feeling. Sagittarius - A brilliant flash of insight is possible this week. You may be talking to a relative or thinking about an old family issue when an absolutely stunning solution to an old problem hits you like a lightning bolt out of the blue. Don't wait to act on it. Capricorn - Friends and companions will be calling and emailing you with exciting news this week. You may be getting news of someone's good grades, acceptance into college, or a change of housing or residence that sets them up for much more secure living conditions.

Aquarius - You have gotten over a recent bout of "foot in mouth" disease, and suddenly things are looking up dramatically. You are hearing of a raise, bonus, or new position that will bring you into better conditions, more money and extra responsibilities. Pisces - You are likely to be spending some more time in the bookstore this week, this time to find a "How to" book for a creative hobby, or an over-the-top wild and passionate romance to read on your time off. You need reading material that is a little lighter than your normal choices.

SOLOMON’S LAW

Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.

If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments.

Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

AT TO R N E Y S

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose. Ben Solomon, Esq. is a partner and co-founder of Association Law Group, P.L. (ALG) and practices in the areas of developer representation and association representation. www.AssociationLawGroup.com / ben@algpl.com
