VIEWPOINT Loose gun laws mean more kids killed BY MARIAN WRIGHT EDELMAN I'm deeply disturbed that after a decade of decline, the number of firearm deaths among children and youths has increased for the second year in a row. A report released in September reveals that almost nine children and teens die from gunfire every day-one child death every two hours and 45 minutes. The report, based on the most recent data from the Centers for Disease Control and Prevention (CDC), states that 3,184 children and teens died from gunfire in 2006, a six percent increase over 2005. Another 17,451 were victims of non-fatal firearms injuries, a seven percent increase from the previous year. When people from other industrialized democracies learn of America's child gunshot death rates, they're equally troubled. A major reason for these tragic young deaths is the proliferation of guns. Americans own more than 270 million private firearms-the equivalent of nine guns for every 10 men, women and children. The United States is one of the few industrialized countries without common sense controls on gun sales. We regulate toy guns, but not the real ones that snuff out tens of thousands of human lives every year. Among the young people killed by firearms, 2,225 were homicide victims, 763 committed suicide and 196 died in accidental or undetermined circumstances. The overwhelming majority, nearly 90 percent, were boys. More preschoolers-63-were killed by firearms than law enforcement officers killed in the line of duty-48. The death toll among black children is growing at an alarming rate. Black males between the ages of 15 and 19 are almost five times as likely as their white peers and more than twice as likely as their Latino peers to be killed by a firearm. The destructive impact of firearms affects all of us by increasing health care costs, overtaxing social services and decreasing national productivity. Gun violence is so pervasive in some black communities that it constitutes a serious health risk. It's come to the point where many of the cases of post-traumatic stress disorder in black neighborhoods are not only of veterans returning from war zones, but of children walking up to the corner store. Too many of them speak of the future in terms
of "If I grow up" instead of "When I grow up." Regrettably, in many of the states and at the national level it's an uphill fight to control firearm trafficking. Thirty-two states have no laws requiring firearms sellers at gun shows to first conduct background checks on all buyers. This gunshow loophole has been used to evade laws designed to make it harder for guns to get into the hands of children, criminals, and the mentally unbalanced. Gun shows are a huge market for vendors with or without federal firearms licenses. Ten years ago, the two teenaged shooters who killed 12 fellow students and a teacher at Columbine High School near Littleton, Colorado got part of their arsenal illegally through a gun show. Congress must pass legislation to close the gun show loophole and strengthen provisions of the Brady Handgun Violence Prevention Act requiring a national instant criminal background check system. There's strong evidence that background checks can be effective. Between 1994 and 2007, background checks performed by federal firearms licensees resulted in more than 1.6 million illegal buyers being denied guns. It is also imperative that the federal assault weapons ban be reinstituted. According to the Brady Center to Prevent Gun Violence, the ban reduced the use of assault weapons in crimes by 66 percent between 1995 and 2001. But the responsibility to keep our children safe cannot rest solely with our political leaders. There are things individuals and families can do: remove guns from homes, mobilize community support to protect children from gun violence, stress nonviolent values and conflict resolution, refuse to buy or use products for children and teens that glamorize violence, and provide children and teens positive alternatives to the streets. We must hold our legislators accountable to implement these common-sense gun safety measures. The safety of our children and communities is at stake. --

Hyatt boycotted for blindsiding housekeepers BY JIM HIGHTOWER If ignorance is bliss, the corporate chieftains of the Hyatt Hotel chain must be ecstatic. They pulled a lowdown, sneaky trick on 98 of Hyatt's housekeeping staff in three Boston hotels-thinking that no one would notice, care, or do anything. They badly underestimated Bostonians. In August, housekeepers at the three hotels were asked to train some new workers to fill in when regulars were sick or on vacation. On August 31, however, the experienced staff-many of whom worked for Hyatt for more than 20 years-were blindsided by a rude truth: They'd been duped. Management told them they were fired as of that day. It turns out that the workers they'd been training would replace them. These replacements are employees of an outsourcing corporation called Hospitality Staffing Solutions of Georgia, whose honcho asserts that his workers are paid "competitive wages." Yeah, competitive with poverty. Indeed, Hyatt's longtime housekeepers were earning $14 to $16 an hour, plus health care and pension benefits. The
Staffing Solutions workers, however, get a miserly $8 an hour, with zero benefits. Bostonians are in an uproar. There've been mass demonstrations in front of Hyatt's hotels, the governor has directed state agencies to stop doing business with Hyatt, even the Chamber of Commerce has moved a scheduled meeting from the Hyatt, and the Boston Taxi Drivers Association intends to boycott the three hotels if the company doesn't fully back off. It may. Meanwhile, Hyatt executives are essentially in hiding, claiming that replacing the workers was an essential "cost-cutting move." Really? Where's Mark Hoplamazian, Hyatt's CEO, who took $6.7 million in pay last year? If he cut his pay by about $1.5 million, that'd cover the $7-anhour difference in pay between the experienced housekeepers and the replacements. Come on, Mark-step up to your leadership responsibilities! --

Since 2005, Levinson has been teaching a high school level Business Practice course for students as part of a special curriculum developed by the Junior Achievement of Greater Miami. "The JA's Business Practice Course is designed to give students hands-on experience in the world of business," says Levinson. "Through this program, students are given the opportunity to learn how to open and operate a real business from the conceptual phase on up. This includes identifying a product or service, raising capital to start the business, taking charge of the accounting, finances, marketing, advertising and public relations all the way through quality control to ensure their business is profitable." And 'yes', you guessed it, this business even sells shares of stock to investors to gain the necessary capital in order to get the business off the ground. Once a week, Levinson steps in to teach Jacob Goldberg's 2nd and 3rd period Career and Entrepreneur Ship classes. With an outlined curriculum, Levinson leads students through the process of ensuring their business grows and flourishes. Each class takes on a different facet of the business with a valuable lesson to be learned. For a recent class, Levinson recruited Tropical Smoothie Café Aventura Franchise Owner Michael Erber who spoke about the effort required to run a business including the long hours, necessary capital, inventory, hiring and even firing. But the class was even more ecstatic to learn that Erber arrived with cooler in tow filled with signature Tropical Smoothies - enough for everyone! "These students were amazingly interested and asked really important questions," said Erber. This year, the classes are selling stress balls that include the ACES logo and elastic headbands naming the school's values. And, as you must know, the word is already out---both are must-have items among peers. At the end of the year, if the business is profitable, the profits are distributed back to the shareholders and the remains are distributed to a charity the class selects. Past beneficiaries have included Children's Cancer Caring Center and The Florida Marlins Community Foundation. "This teaches the students the rewarding act of charitable giving and helps them to understand the importance of giving back to the community," says Levinson. When asked "How do you know the business will be profitable?" Levinson is quick to respond, "I'm teaching the class… The business is always profitable and we're always prepared to share the wealth with our beneficiary!" Levinson has taught Junior Achievement since 1991, making this year his 20th class through the program. He's taught second graders on up through high school seniors from South Miami to Aventura. Still, his greatest reward is when he is approached by prior students who have successfully opened their own businesses as adults and attribute their success and hunger to lead in the business world to a class he taught as a volunteer. Filene's Basement's first anniversary in Florida also marks 100th anniversary of the retail icon If you're the kind of shopper who loves the thrill of hunting for bargains, you can thank Filene's Basement. In the early 1900's the Filene family pioneered the retail category we now call "off-price." In 1909 the owner of Filene's department store in Boston put this question to his son: "how can we get rid of unwanted merchandise to make room for new goods without losing our shirts?" The younger Filene proposed this solution: he would haul all the unsold goods down to the basement (space that was not in use anyway), price everything to sell quickly, and spread the word with an ad in the local newspaper. If the goods failed to sell within a short time, he would lower the price as many times as it took to find a buyer. Is unemployment rate improving? There are reasons to be upbeat

When the doors of a South Florida job fair opened recently, employers got more than they bargained for. There’s no doubt about it — it’s tough out there and many people are discouraged. It’s almost the year 2010 and it’s still difficult to find a job. Everyday people are hoping that they’ll find a new job and be able to go back to work. The process of hand-typing resumes and going out on job interviews is frustrating, but if you do what you have to do to find work and proceed with an optimistic outlook, your next job might be closer than you think. For the first time this year, unemployment in certain areas of South Florida is dropping. Miami-Dade had about 140,000 jobless workers in September, which is about 7,000 less than in August. Still, Broward’s unemployment rate is climbing with about 1,600 more jobless workers than in August. However, local job fairs are slowly starting to see businesses adding new workers. The question is, “Who is hiring and who is still firing?” While companies like Sun Micro systems, which has slashed over 3,000 jobs, deter applicants from moving forward, there are still alternatives. Governmental jobs, for instance, are gold right now. There currently are 31,000 job openings posted on the government’s official jobs website, USAJOBS.com. According to Dave Herman from the Office of Personnel Management, “Government actually plans to hire about a quarter million people in the next year. Because of the Stimulus Act and federal requirements, there will be a large number of people hired by the Federal Government.” Other sectors that have seen a positive growth between September 2008 and September 2009 include ambulatory healthcare services, wholesale trade, air transportation, hospitals, finance and insurance, and manufacturing. For example, ambulatory healthcare services have
created over 400 jobs, a 0.8 percent increase. Wholesale Trade has an increase of 0.3 percent with over 200 jobs created. Air Transportation has created 100 jobs, a 0.7 percent increase. Hospitals created over 300 jobs, a 0.8 percent increase. Jobs in finance and insurance have grown 0.4 percent, with 200 jobs created. Manufacturing has increased 0.2 percent through 100 jobs created. Reports from Florida’s Agency for Workforce Innovation say that while new home building stalled, construction and trade businesses are laying off workers. Although the rate of decline has slowed down, the construction sector still holds major concern. Between September 2008 and September 2009, it experienced a decrease in employment of 6,600 jobs, or 14.4 percent. The still-growing education and healthcare fields are up by 6.5 percent and the job market for professional and business services are up by almost 6 percent. With an overall 11.3 percent unemployment rate, Miami-Dade is back to about the same job levels as June. However, it is still a long way from January’s 6.8 percent rate. Florida’s jobless rate currently stands at 11 percent with 1,012,000 former workers needing unemployment benefits to survive. That’s up by just 0.2 percent since August. Not surprisingly, this is still the worst unemployment level in 34 years. To find jobless figures as bad as they are now one would have to go back to 1975. Unemployment statewide has climbed by 4.3 percent since last year. For jobseekers, this means you have to work a lot harder when looking for your next job. Still, you shouldn’t get discouraged because you aren’t getting hired. There are jobs out there for everyone. The trick is you just have to go find it. Overall the United States unemployment stands at 9.8 percent. Labor analysts expect it to peak next year over 10 percent. If South Florida’s unemployment numbers keep improving, the worst of our “Pink Slip Epidemic” may be over. Let’s hope so.

Overthrowing the wicked BY REV. WILL KEYSER There are numerous groups of people around the world that we would consider to be “wicked,” that is one who is considered to be vicious and likely to cause harm. Some have identifiable names: AlQueda/Taliban, etc. others may be acting on their own as rogues. Some may just be the guy down the street! No matter what they are called they are still wicked and must be dealt with. There are also numerous ways to deal with the wicked; military attack, national or state police action or other processes that are within the limits of the law of the land. However there are times when those agencies are not available to the individual then what? History tells us that the wicked have been around for a long time. Moses wrote in the book of Genesis that the men of Sodom were wicked; Samuel wrote that the sons of Eli, the high priest, were wicked; Jeremiah wrote that the men in his time were wicked; Luke’s gospel refers to some of those living in the time of Christ who were known as the “wicked generation.” We can conclude that the wicked have always been and always will be with us. As righteous individuals living among the wicked we cannot simply take out a gun or a nuclear bomb and rid ourselves of them. But there is a sure and certain way the wicked can be overthrown. David, the Psalmist, recorded in Psalm 10 the proven method to overthrow the wicked among us. He was apparently having a good day praising God for His acts of justice. “When my enemies are turned back, they stumble and perish before you; you have maintained justice, judged righteously and rebuked and destroyed the wicked. You have blotted out their names forever.” The
enemy has come to an end and even the memory of them has been erased. Wouldn’t that be great if we experienced that today? David realized that not all of our enemies are people. There were some circumstances that he felt separated him from God. “Why do you stand afar off? Why do you hide in times of trouble? He felt as if God was not paying attention to his everyday life. We all have days that when we let our feelings take over in place of the facts. God is never far off. He has promised “never to leave us or forsake us.” (Deuteronomy 31:6) Some misinformed folks say, “If you trust God you will never have a bad day.” If that was true then Moses, Joshua, David, Solomon, Nehemiah, Jeremiah, Daniel, Job and Jonah never truly trusted God. Nor did Jesus. They all had bad days but God was never far off. When it seems like the wicked or the bad situations are prospering and nothing can help David reminds us, “But you, O God, do see trouble and greed; You consider it and take it in hand.” When we consider the facts of who God is and how He works in the defense of the helpless and comes to the aid of those who call on Him we are no longer terrified by the enemy. Our confidence is in God and “He will break the arm of the wicked and evil man and call him into account.” The Psalm ends with these encouraging words: “The Lord is King forever and ever. You hear the desire of the afflicted, you encourage them and listen to their cry defending the fatherless and oppressed in order that man, who is of the earth, may terrify no more. City of Aventura forms Complete Count Committee for Census 2010 In an effort to encourage everyone to be counted in the 2010 Census, the City has created a special Complete Count Committee consisting of City residents. The Aventura Complete Count Committee for U.S. Census 2010 held its first meeting on October 14, 2009, and they are planning an intensive promotion campaign to inform all residents about the importance of responding to the census. "The success of the 2010 U.S. Census count in Aventura is vitally important," said City Manager, Eric M. Soroka. "Federal and state funds that the City is eligible for each year are based on census statistics.
If everyone is not counted, our community may not receive our fair share of these funds." Census questionnaires will be delivered to each household by March 2010. Members of the Aventura Complete Count Committee for Census 2010 will be making speeches on behalf of the census to community organizations, distributing census flyers to residents and groups and generally promoting public participation with the census at every opportunity. Members of the committee represent a broad cross section of the community. The committee will remain active until June 2010.
Jewish Community Services of South Florida receives grant to help older adults Jewish Community Services of South Florida, Inc. (JCS) has been awarded an $83,700 grant from Health Foundation of South Florida for Year 2 of its Enhance Fitness program. The funding helps JCS with its goal of improving the overall functional fitness and well-being of older adults participating in its EnhanceFitness program currently operated through JCS' Senior Adult Services Division. Through the Health Foundation/Healthy Aging Regional Collaborative grant, JCS will continue to operate JCS' Enhance Fitness program in the community, encouraging seniors to increase their social involvement and take an active role in promoting healthy aging. EnhanceFitness is designed for community-based organizations, and intended to promote physical activity among older adults. As Fred, Stock, President/CEO of JCS, says, "This program has been a natural fit within JCS' senior programming, allowing us to take individual older adult wellness goals to the next level." Enhance Fitness is a best practices model wherein instructors receive training and the workout program they follow has been designed and refined by
researchers who are experts in older adult health and exercise. It is one of the few fitness programs for older adults which is multi-component, including elements such as balance, strength, endurance, and flexibility exercises. Health Foundation of South Florida, a nonprofit grant making organization, is dedicated to improving health in Broward, Miami-Dade and Monroe counties. By funding providers and supporting programs to promote health and prevent disease, the Foundation makes a measurable and sustainable impact on the health of individuals and families. For its nationally recognized Healthy Aging Regional Collaborative, the Foundation has allocated $7.5 million over five years to community partners for programs designed to improve the health of older adults. "We are proud to be working in partnership with Jewish Community Services of South Florida to achieve our shared objective of enhancing the lives of seniors in our community," said Peter N. The ‘bar scene’ Just how nutritious are energy bars?
BY BARI AUERBACH Power Bars, Balance Bars, Luna Bars, Zone Bars...Once only found at gyms and health food stores, energy bars are now at most grocery and convenience stores – but are they really raising the bar when it comes to optimal nutrition? Most nutrition experts agree there is no reason (other than pure convenience) to eat a “quick fix” bar when it’s relatively easy to get the same carbohydrate or protein from real, healthful food choices. Many people assume since athletes eat energy bars, they’ll get fit if they eat them too – but remember, athletes don’t get fit by eating energy bars alone - they get fit by working out. “Most energy bars are little different from a traditional candy bar,” says nutritionist Barbara Rolls of Pennsylvania State University. “If you really have no alternative but to eat these bars, look for ones with whole grains and fiber, moderate sugar and fat, and some protein.” You should also take careful note of the caloric content of each bar, as they tend to vary widely. “For a between-meals snack, 100 calories is about right. But as a meal replacement, 200 to 250 is a very small meal which could leave you hungry and tempted to lose control later,” Rolls says “[Ideally], energy bars should not be used for meal replacement because food contains numerous micronutrients and phytochemicals that have proven health benefits,” notes Priscilla Clarkson, an
exercise physiologist at the University of Massachusetts at Amherst. “I also caution people not to replace wholesome food with energy bars,” says Elizabeth Applegate, a nutritionist and exercise expert at the University of California. “But if you’re going to grab a candy bar or a box of cookies or two bags of M&Ms from a vending machine for lunch, it’s better to have an energy bar...If you’re using bars in place of a meal, look for at least 10 to 15 grams of protein. “I recommend eating at least one real food - like a piece of fresh fruit or some carrots or low-fat cheese sticks with the bar...In fruits and vegetables, there are substances called phytochemicals - like beta-carotene, lycopene and flavinols that reduce the risk of Alzheimer’s disease, cancer and heart disease. But the manufacturers don’t put those in bars because the ingredients they use are so refined. They’re using food components but not the whole food.” It is true that energy bars are one of the most convenient snacks - bar none...After all, no one really wants to throw chicken and brown rice in their bag! Fast, easy, no mess, no preparation, no refrigeration... plus most bars have a long shelf life, so you can stock them in your desk drawer or cupboard for a steady supply. Ultimately, nutritionists agree it’s OK to have energy bars sometimes - but it’s even better to make a “no holds barred” effort to eat more healthful whole foods and exercise more frequently.

BY PATRICIA C. FRANK Bonfires are for roasting things. You can roast things like hot dogs and marshmallows which are good. Roasting other things is not always good. You can be roasted yourself, if you are not careful. A partner, parent, boss or friend can roast you psychologically and emotionally. Bonfires are not limited to the great outdoors or your yard. They can also occur in your life and in your relationships. They are an expression of a certain individual’s anger. They often flare up unexpectedly in response to a spark of some kind. The individual is easily combustible and has a low burning point. What turns it into a bonfire for them is the addition of the other person’s faults. They also add past grievances and hurts, to their current list of annoyances. They usually carry around a list of your mistakes in their pocket so that they can just toss them on the fire. They throw anything on it whether or not it is appropriate or pertinent. The angry person will keep adding things to the fire increasing the heat and intensity until the fire is a raging inferno. They usu-
ally talk out loud in a running monologue. They work themselves up as they talk to themselves. This self talk fuels the fire even more. There are small explosions that occur within the bonfire that send sparks beyond the fire itself. If these sparks land on you they will burn you and hurt you. So, it is wise to keep your distance from the blaze caused by their anger. If you can keep a psychological fire extinguisher with you then you could douse the flame while it is still small. That would prevent things from escalating. Unfortunately, the person feeding the fire doesn’t want to have the flame peter out or be put out. They actually want to roast you for their own reasons. It is usually not something you did or failed to do. It is their own unhappiness, disappointments and anger that fuels their bonfire. They need the fire to discharge the toxic energy that builds up inside of them. Just as the real fire destroys things, the fire they create can destroy you and your spirit. LET’S TALK CARS The 2009 Nissan cube is another vehicle in the seemingly endless progression of “boxes on wheels” that the automakers are rolling out in the wake of the success of Scion Xb. Nissan says the cube — they don’t capitalize the letter “c” and the word “cube” is a Nissan registered trademark — is designed “to meet the practical needs of today’s active, environmentally aware drivers, and provides a small footprint with a large interior space.” Well, the “cube” is a relatively small vehicle, but there is a plenty of room on the inside, with seating for five adults and lots of headroom. It’s also very maneuverable, has a very tight U-turn radius, is easy to park, and gets 22 mpg around town and 30 mpg on the highway. However, the A pillars are positioned so far forward that front-seat passengers get the sensation of riding in a box. The front-wheel-drive cube is built on
Nissan’s successful B-platform and comes with a 1.8-liter DOHC four-cylinder engine (the same engine that powers the Versa), with a choice of Xtronic CVT (Continuously Variable Transmission) or a six-speed manual transmission. Four models are offered and more than 40 individual accessories are available, ranging from a 20-color interior lighting kit and a “shag rug dash topper” to aerodynamic body kits and custom 16-inch aluminum-alloy wheels. The numerous options allow the owners to personalize their cube to reflect their own tastes and personalities. The four models are: Nissan cube — base model with a starting price of $13,990; comes with a 1.8 liter four-cylinder engine mated to a six-speed manual transmission. Nissan cube 1.8 S — Priced at $14,690 with the six-speed manual gearbox or $15,690 with the Xtronic CVT. Comes standard with body-colored outside mirrors, premium-grade fabric interior, cruise control and cargo area cover. Nissan cube 1.8 SL — Priced at $16,790 and adds Xtronic CVT, 16-inch aluminumalloy wheels, auto on/off headlights, Automatic Temperature Control, Interface System for iPod, and six-speaker audio system.

Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.
If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments. Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive. Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
