Mount Sinai gains designation as a comprehensive stroke center Mount Sinai Medical Center has earned designation as a comprehensive stroke center, giving Aventura residents even more reason to choose the hospital's freestanding ER for their emergency care. Mount Sinai is the second hospital in Miami Dade County and one of only 16 in Florida to receive the designation, assuring that it follows national standards that can significantly improve the outcomes of the most complex stroke cases. "Because our freestanding ER is backed by the technology and medical expertise found only in a comprehensive stroke center, Aventura residents have access to the most advanced care available," said Dr. David Lang, Mount Sinai's chief of Emergency Medicine. Awarded by the Florida Agency for Health Care Administration (AHCA), the designation assures that Mount Sinai has system-wide initiatives on stroke prevention, treatment, rehabilitation, education, community awareness, and research. "This designation represents the culmination of two years of efforts to develop the staffing and technological infrastructure necessary to diagnose and treat stroke patients within minutes of their admission," said Steven D. Wanda and Bill had been married 50 years and they felt that it was time to find a nice retirement village where things could be done for them and settled for a very nice village where they bought a home on the property. Everything was within walking distance, had a shuttle running around every half hour. They were there about seven months when Wanda began to feel a little ache here, another there; she decided to get a checkup. The checkup turned out to be a very Dan fast moving cancer and within three months she was gone. The funeral was held in the village church/synagogue and it was noticed, just about every widow in the village was there. When the funeral was over he was met by the brisket brigade of widows bearing food for Bill to eat for the next few days. There were invitations galore suggesting Bill eat at this house or the next house. Made Bill feel that all these lovely women were being so kind to him and he felt wanted.

Didn’t take more than a month to realize that he was now the #1 most available man in the area. He still felt like a desirable sharp single slightly over middle aged Romeo. Didn’t take more than a few months and his phone was also calling him for a drink, home cooked meal invite to join the singles events at the clubhouse weekend events, all coed of course. He was amazed at his popularity because he didn’t think he was better than other widowers around that seemed to enjoy watching the “biscuit bearing women� who always tried to make sure he ate and ate because it Palmer was so good for him. He even got to a point where he would take the widow of the day to a movie some weekend nights. A few of his old buddies from the neighbor hood came to visit from a nearby village and he showed off with all the widows showing up at his door offering to go out for an early bird and a movie - Dutch. Finally, one of these friends said to Bill, “Of course you’re highly desired, don’t you know that you’re the only widower in the village that still has a license that allows you to drive at night?�

Aventura Hospital and Aventura Comprehensive Cancer Center conclude Breast Cancer Awareness Month with a Celebration of Survivors Aventura Hospital and the Aventura Comprehensive Cancer Center concluded Breast Cancer Awareness Month with two strong programs to raise awareness and to inspire survivors. Aventura Hospital recently partnered with the City of Hollywood to present a special seminar for the community at the Broward Public Library in Hollywood. Dr. Alanna Harris, Medical Director for Aventura Hospital's Breast Diagnostics Center, advised women of ways to detect the signs and symptoms of Breast Cancer early, including regular self-breast exams and annual digital mammograms. "Breast Cancer can be detected through mammograms before they can be felt," she explained, "Not all lumps in the breast will turn out to be can- Breast Cancer Survivors gather to celebrate survival cerous, but it is very important if you sense anything to consult with an expert and get your screening. The American Cancer Society predicts that in 2009, some 192,370 American women will be diagnosed with breast cancer, accounting for more than one in four cancers diagnosed. Fortunately, if breast cancer is caught early, the five-year survival rate is 98 percent. The breast cancer death rate continues to decrease since the 1990s in U.S. women because of improved treatments, preventive measures, and increased mammography screening rates. "I am so lucky to be alive," said Maritza Lewin, a survivor who attended Friday's luncheon. "It is so important to stay positive and appreciate what you have. VIEWPOINT Cuban embargo: Nothing succeeds like failure BY SAUL LANDAU Once again, Cuba has asked the United Nations to help end the U.S. economic, financial and trade embargo. Havana says this blockade cost it more than $242 million last year. The embargo also stymies Cuban access to foreign capital from other nations, because investors face possible U.S. sanctions for doing business with Cuba. Polls show that most Americans favor dropping the U.S. embargo and our ban on travel to Cuba. Instead of scrapping it, however, President Barack Obama and Secretary of State Hillary Clinton are clinging to the policies they inherited. In policy terms, it's the equivalent of scientists insisting the world is flat. Nothing succeeds like failure in imperial Washington. So while Washington's failed Cuba policy has endured for half a century, its proponents ask us to “give it time.” This policy has flopped since its inception. In July 1960, President Dwight D. Eisenhower cut Cuba's sugar quota to punish Cuba for expropriating U.S. companies. The Soviet Union formally entered the U.S.-Cuban dispute to buy Cuban sugar. In October, Ike imposed a partial embargo that President John F. Kennedy completed in February 1962, by which time Cuba had expropriated all U.S. companies. Early U.S. pressure on Cuba's revolutionary government wasn't just economic. Responding to Fidel Castro's disobedience in early 1959, Eisenhower authorized Cuban exiles to launch terrorist attacks on Cuba. He ordered the CIA to overthrow the regime in early 1960, but withheld the order to unleash 1,500 Cuban exiles the CIA had trained to invade the island. In April 1961, Kennedy succumbed to pressure and sent the exiles to their defeat at the Bay of Pigs, staining the young president's reputation. Instead of trying to move on from that fiasco by coming to terms with Cuba, Kennedy sought revenge. The United States sponsored assassination attempts and thousands of armed attacks against Cuba. Ironically, before Kennedy signed his tightened embargo order, he ordered an ample supply of his favorite Cuban cigars. Fidel has handed off the reins of government to his brother, Raul Castro. They have survived the Eisenhower, Kennedy, Johnson, Nixon, Ford, Carter, Reagan, George H.W. Bush, Clinton, and George W. Bush administrations. Obama administration officials know

better than to ask the obvious question: What exactly did Cuba do to the United States to merit terrorism and economic strangulation? The answer then and now: by being disobedient, refusing to abide by Washington's interpretation of the 19th-century Monroe Doctrine. In August 1961, Fidel offered an olive branch in response to the armed assaults. Che Guevara met with Richard Goodwin, JFK's Latin America adviser. If Cuba cut military ties with the Soviets, stopped exporting revolution, and compensated expropriated U.S. companies, would Kennedy cease his violence? According to Goodwin, in an account he relayed during a Bay of Pigs seminar in Havana in 2001, Kennedy-puffing on a cigar from Che-responded: “Weakness. Turnup the heat.” One month later, Fidel went to his last deterrent. Soviet Premier Nikita Khrushchev stationed nuclear missiles on the island. In October 1962 came the Cuban Missile Crisis. Gerald Ford and Jimmy Carter relaxed the embargo and travel ban. Ronald Reagan tightened them again. Succeeding presidents (including Obama) responding to various interests-but not the national interestdiddled with the screws as well. Reagan privatized Cuba policy, transferring it from Washington to the Cuban American National Foundation in Miami. Cuba survived. Cubans needing certain medicine or medical equipment urgently from the United States suffered-as did the Cuban economy and thus all Cubans. In the 1990s, I tried unsuccessfully to convincethen-Representative Robert Torricelli (D-NJ) to not pursue his “Torricelli Bill.” I said the embargo hurt most Cubans materially. He said Cubans could buy supposedly banned equipment elsewhere, claiming Cuban propaganda promoted “the pain argument.” Logically, if the embargo didn't hurt Cuba, why maintain it? To punish Fidel-symbolically. Does Washington define success by gloating over decades of consistent failure? Will Obama remain stuck in this incongruous Cuba policy legacy or exhibit some spine?

Free trade is suicide for the U.S. BY WILLIAM A. COLLINS Only moguls Can applaud; As they send Our jobs abroad. The United States long enjoyed one of the world's highest standards of living. This has now ended. The chief tool for ending it has been “free trade.” The purpose of that policy is to allow American corporations to acquire products and services in foreign lands where labor rates, benefits, and taxes are dirt cheap. These products are then imported freely here and sold at full U.S. prices for hefty profits. There's also an export side to these trade laws, aimed largely at Mexico and Central America. Under the North American Free Trade Agreement (NAFTA) and the Central American Free Trade Agreement (CAFTA), subsidized U.S. grain enjoys cheap access to Latin markets, driving down agricultural prices there and thus forcing farmers off their land. Hungry, many join the flood of illegal migrants heading north by risking death in the Sonoran Desert. Thus U.S. agribusiness is making a killing by selling subsidized grain down there and hiring desperate migrants up here. In NAFTA'S early days, the promised job-creating sweatshops did indeed sprout throughout Mexico, especially near the U.S. border, siphoning off many American jobs. No more. As corporations got sophisticated and the U.S. worked out further trade deals worldwide, many of those sweatshops closed down, replaced by new ones in Asia. Labor there is even cheaper and the brutal working conditions are even more remote from the clouded eyes of American journalists. The results of this trade policy are plain enough. The U.S. is awash in shuttered factories and unemployed workers. The Labor Department reported in July that the nation currently lists 2.4 million available full-time jobs for14.5 million unemployed citizens. Much of this gap is presently due to the Great Recession, but the recession also masks the basic problem that many of those jobs simply don't exist anymore. That's how Wall Street can report profits while average families experience losses.

To make matters worse, even some of our newly trumpeted savior industries are false prophets. Take green energy and those long-awaited green jobs. The guy who comes to insulate your attic is surely local, but the guys who make the windmills are likely Danish. And it probably won't be long now until the Danes similarly lose out to China or Thailand. Likewise with organic food. Our image is of local farmers just out past the suburbs. That probably remains true for rhubarb, but organic soy has already gone off to China, with other crops soon to follow. Another potentially mortal result of our economic race to the bottom is the trade deficit. Naturally it's smaller now since we can no longer afford to buy much from abroad, or anyplace else. But it persists. Luckily, China still continuesto buy our government's bonds with the cash we send them to buy their products, but that can't go on forever. When they slow their purchase of our treasury bonds, inflation will set in. Less publicized, but similarly damaging, are certain rules we agreed to in establishing NAFTA and joining the World Trade Organization. These allow arbitration to overrule U.S. and state laws. Obscure arbitration bodies have already let foreign multinational corporations kill state environmental laws and set aside professional licensing rules, plus they have allowed foreign truckers to undercut our domestic haulers. Among the leading opponents of any proposed cures for these suicidal trade practices is The New York Times. It has railed steadily against the dangers of “protectionism,” as it in turn protects its own multinational investors, advertisers, and Wall Street readers. Meanwhile, U.S. median family income was already shrinking and the rich-poor disparity growing even before the recession began. So as American families slip beneath the economic waves on the lower decks, there's still quite a party rollicking up on the bridge. --

Historically Yours BY BOB DIAMOND ZENGER, HAMILTON AND FREEDOM OF THE PRESS The trial of newspaper printer John Peter Zenger in 1735 stands out as the greatest landmark in American history for freedom of the press. The controversy that lead to the Zenger affair involved a greedy William Cosby, Governor of New York Province, who demanded half the money that Provincial Council member Rip Van Dam earned “while serving as acting Governor prior to Cosby’s appointment and arrival in New York.” Van Dam refused payment and Cosby filed suit. To avoid a jury, Cosby assigned the case to the threemember Provincial Supreme Court. Van Dam appealed, however, the Supreme Court voted 2-1 to uphold Cosby. Cosby then wrote to Chief Justice Morris demanding an explanation for his dissenting vote. Morris responded not to Cosby but in a critical letter printed by Zenger. Cosby removed Morris from the bench and replaced him with his crony James Delancey. Zenger then published letters questioning Cosby’s ability to govern.

Cosby had Zenger arrested and directed his criminal trial be held before his two handpicked judges, Delancey and Philipse. Andrew Hamilton, from Philadelphia, became Zenger’s trial attorney (without fee) after Delancey disbarred Zenger’s first two attorneys for objecting to Cosby’s handpicked court. Most lawyers said Zenger’s case was “unwinnable;” not just because of the handpicked judges but because the colonies followed British law that truth was not a defense to a seditious libel. Hamilton shocked everyone with his strategy. He admitted that Zenger published the libel and the established law was that truth was no defense to a libel, however, he challenged the law rather than the innocence of his client, arguing that the libel law of England ought not to be the libel law of New York, stating: “Every man in America who prefers freedom will bless you for allowing the right of liberty to expose and oppose arbitrary power by writing the truth.” Delancey all but ordered the jury to return a verdict of “Guilty.” The jury returned their verdict: “Not Guilty.” It has been said that the Zenger case was the “Germ of American freedom, the morning star of that liberty which subsequently revolutionized America.”

LC: How did Racks Italian Bistro & Market come about? SL: Racks Italian Bistro & Market is the second restaurant of Gary Rack's GR Restaurant Management Group. Gary started this company from scratch, after a very successful career as founder of two of the country's largest manufacturers and marketers of pre-fabricated steel buildings. The concept is family restaurants premised on a culture of excellence - excellent food, service, wine and prices - and we don't settle for anything less. We are really strict on service. We pass out comment cards, and we read every one of them. Our first location was Coal Mine Pizza in Boca Raton, which is now four years old. We're soon going to change the name to Table 42 Italian Kitchen &Wine Bar, and we're bringing out a more adventurous menu. When we signed the lease at the North Miami Beach location, because it's a waterfront location on the Intracoastal people immediately thought it was going to be upscale. We never wanted that. We don't think that's what everyday Italian food is about. We believe Italian food is supposed to be rustic, at reasonable prices. LC: Why did you add a market to the North Miami Beach location? SL: Customers of Coal Mine Pizza were always calling me for recipes or to find out where they could find the

products we use. We wanted to make them accessible to them. Then we started selling our own cheeses, bruschetti, and so on. It's like a little Italian deli that sells produce, cheese and meat.

LC: What's your background in the business? SL: I was trained as a chemist, but I was born in Brooklyn, and I like to say I have pizza in my blood. Going to school, I always worked in hotels and restaurants in the Catskills. Later I worked for The Cheesecake Factory. They taught me a lot about corporate structure and food handling. When I started, they had five stores; when I left they had 74, and I was involved in opening 11 of them. I attended the International School of Pizza in San Francisco, run by nine-time world champion pizza master Tony Gemignani, where I became a Certified Pizza Maker. It's the premier U.S. institution for learning about pizza. I'm also a member of the World Pizza Champions Pizza Team and the U.S. Pizza team. LC: After five months, how is Racks Italian Bistro & Market faring? SL: On a recent Saturday, we served 229 people with only one plate returned. That's great for any restaurant. And our Black Truffle Pizza was named Best Pizza in America in a national contest sponsored by PMQ, a leading pizza industry magazine. Snap or Snap Back BY PATRICIA C. FRANK mIt is very important to be resilient in life. The ability to snap back from a set back is the key to a healthier and happier life. Studies show that resilient people have increased activity in their prefrontal cortex. This is the part of the brain that processes positive emotions. These same studies also show that the areas of the brain that control anxiety respond by dispersing and decreasing the anxiety. Their bodies and immune systems are less affected by stress and negative events. There are many situations that can make you feel defeated. The key is to be determined to bounce back. Some people seem to have a head start genetically. Some people are blessed with supportive relationships as they grow that help them develop a strong belief in themselves. As a result they develop self-confidence and strength. Resilience is something you can learn and make a part of your personality. Learn to focus on your strengths and value them. Appreciate and be proud of those things that you do well. Accept yourself and your flaws, if you have any. Be determined and tenacious. Make a

resolution that you will persevere regardless of the obstacles. Be constant and consistent in your efforts. Always do your best. Keep things in perspective. Refuse to let them be blown out of proportion. You can do this by limiting the size of the problem in your mind. To do this you may have to step out of your comfort zone. Stretch yourself, change your thoughts and opinions and take some calculated risks. Ask for help. You do not have to handle the problem alone. It is not a sign of weakness. Keep learning. Knowledge is a powerful asset. . New ideas create new solutions. Find meaning in your work. Feel enthusiastic. If you are not passionate about what you do, find something to do that does make your feel passionate. Reach out to others. Keep expanding your circle. Add people to your life. Engage in social activities. Volunteer if you can. You will receive as much as you give. Your self-esteem will soar because you are making a difference in other people’s lives and your own. Recession appears over as October trading ends

Al Sunshine 4 YOUR MONEY Wall Street wrapped up October trading with the markets coming off triple-digit gains for the Dow following the latest reports the U.S. economy grew during the third quarter much better than expected. That is being seen as a sign the worst recession since the 1930s is ending. The U.S. Commerce Department reports the nations’ gross domestic product, known as the GDP, grew by 3.5 percent earlier in the fall. Why the sudden growth? It follows billions of dollars in federal stimulus funds, increased spending fol-

lowing the “Cash for Clunkers” program and a residential real estate boom fueled by bottom-line low prices, cheap mortgages and tax incentives for first time home buyers. But some analysts still worry it is artificially stimulating the economy by using billions of public tax dollars. Even President Barrack Obama warns we’ve still got a long way to go before we start feeling much better. The latest unemployment numbers show another 531,000 people applying for unemployment benefits in a recent week leaving more than 5.9 million former workers needing long-term benefits to survive. But the rate of new unemployment claims looks like it’s finally slowing down.

Eat this... Drink that BY SHARI LYNN ROTHSTEIN-KRAMER Bar Rosso “Brings It” for Season When Bar Rosso Restaurant & Vinoteca, the Modern Italian eatery and wine bar first opened this May in the space that was the old Ivy, people were curious. Granted, it was the summer and town was quiet, but those who were around came in to see what the “new place” had to offer. It was distinctly different from its former incarnation. It felt homier, less clublike. So far, so good. The food was solid. Granted, brand new restaurants always have kinks?imperfect service, menu experimentation and change, and on and on, but after a while, those things should go away and leave in their place, a professional and inviting place to eat. Fast forward five months. I read a review, which I couldn’t believe could be true. So naturally, I went in to check it out. What I found was similar, but with subtle

changes. For instance, the new general manager, Ray Reeves, greeted me at the door (I like that); the wooden tables were dressed in crisp white cloths adding warmth to the space (I like that); there were salt and pepper shakers on the tables (I use salt and do not want to have to ask for it. Like it); and even the presentation of the bread was more thoughtful. Now made on premise, slices were crisp and toasty, served in a lined basket. Instead of butter, an amoebashaped serving dish adorned with a cherry tomato and herbs was placed center table and our waiter ceremoniously poured EVOO into the dish for all to share. Bravo. Well done. Again, I like that (especially since I knew the people I was eating with). The concept has also been tweaked. “Refined Italian-American with a focus on the grill” is what new Head Chef, Ross Stern, says his concept is. Bar Rosso is being reborn. With Courtney Stern at the helm, Bar Rosso’s event business is taking off. What’s new? Wine dinners, Indulge Wednesdays (Aventura’s 30 and 40 somethings come in to socialize), they opened “The Red

Lounge”, a space that is bedecked with red leather lounge groupings, communal high top tables as well as regular four-tops, which is ideal for the live music they now offer from Thursday through Saturday night. But what about the food? Well, I started with the Organic eggplant. It came out and was big enough for my girlfriend and I to share. It was more heavily breaded (but not so much that I couldn’t taste the eggplant). The tomato sauce was light and not overdone, and the addition of basil oil doubled as a decorative and flavor-enhancing element on the plate. Next I ordered the wood-grilled octopus. Anyone who eats octopus knows if you cook it incorrectly (too long or too little) it is like bands of rubber. Not this one. The generously sized tentacle was cooked to perfection. It was so tender I forgot to use a knife and literally cut it with my fork. It sat atop small cubes of chorizo and spicy peppers. Definitely a wake up call for the palate. The New York Strip came out a perfect medium rare. The color and aroma were so fragrant I couldn’t wait to put it in

my mouth. I was not disappointed. The texture was right. Enough chew to know it was meat, but soft enough to not make me work for it. I also was fortunate enough to sample the veal tortellini special – large vealdilled pasta rings in a light creamy garlic sauce. Now, let me preface – I am not a fan of heavy garlic (yes, sacrilegious but true), nor am I a fan of cream sauce. But the pasta was al dente, the sauce light and flavorful without overpowering. I also hear the menu is changing still. There are new desserts including a chocolate Marquise cake and tiramisu (from New York). The chef is working on a special signature dessert that will be out in the near future (He wouldn’t let me put it in writing as this time, but it did sound promising). If you’ve not been to Bar Rosso in a while – give it another chance. The new management, better service and good food make it a truly great addition to the Aventura neighborhood. Understanding Life Insurance Settlements BY NICHOLAS GNAD A life insurance settlement is the process in which an owner of a life insurance policy sells their interest in the contract in the secondary market, otherwise wise know as the life insurance settlement market. The purchasers of these contracts are typically large institutional investors and hedge funds. The advantage to the policy owner is that it provides an option to cash out of an unwanted life insurance policy. This is a tremendous opportunity to someone who no longer needs an existing policy or who can no longer afford the policy. The policy owner may receive a cash offer for the policy as an alternative paying ongoing premiums for an unwanted policy or simply letting a policy cancel for no value at all. Very often the life insurance settlement can even exceed any policy cash-value that may exist. As with many new concepts, the earlier days of the life insurance settlement industry bred quite a bit of fraud and abuse. These abuses let to significant complaints and law suits. As a result, financial institutions placed significant restrictions on

their representatives’ involvement in these transactions. Fortunately, the life settlement industry has done a tremendous amount of house cleaning and self regulation leading toward greater consumer protection. As a consumer, it is important to know that life insurance settlements are a negotiated market. It is wise to obtain several competing bids for a policy; however, it is equally important not to over shop. A settlement is based upon several key factors. Two main factors are life expectancy and the premium. The factors are used to determine an investor’s rate of return. While some investors can be more aggressive than others, there will be limits to what a contract is worth. Because the market is finite, if the same policy if presented to many times the investors will actually begin to revoke their offers, possibly resulting in a decreased policy value. As a final note, it is most important to discuss any potential tax liabilities with your tax advisor. Unlike income tax-free life insurance death benefits, life settlement proceeds may be subject to income and capital gains taxes. I admit to watching hockey only a few times in my life. I was a Florida Panthers fan during the days when we threw rubber rats on the rink after the Panthers had scored. I have also watched the film The Mighty Ducks many times. The images of those speedy, violent melees stay with me. My job as a teachers’ union president and public schools advocate has thrust me into a metaphoric hockey league. Politics, like hockey, is a game for the resilient. Both involve speed, sticks, personal body armor, and a willingness to take a hit and keep skating.

Unfortunately, our public schools are often used as hockey pucks, whacked at by competing interests whose goal is to score political points rather than create public schools that adequately serve the children of our state. No legislator has ever been able to brag that Florida has provided the competitive salaries, resources and technology necessary for a topranked school system.

What’s a hockey coach to do? First, I’m recruiting you for the baddest team going. We are Stanley Cup material. Whether you are a parent, a business owner, a worker, a volunteer, a man, woman, or child, it’s time to suit-up for public schools. Second, attend practice. Each team member must be a voice for adequate funding for our public schools, especially here in Miami-Dade County. More of our locally raised real estate tax dollars need to stay here in South Florida to fund our local public schools instead of being sent to other parts of the state. Our Miami-Dade legislative delegation needs to take care of business at home. They must join with Broward and Palm Beach counties to ensure that our area of the state receives our fair share of Florida’s education revenue. Finally, show up at game time! Florida must retain funding for education at current levels. There can be no more cuts to education! Whether we play at home (South Florida) or away (Tallahassee and Washington, D.C.) we need you in the game. We need you to be a goalie, blocking harm to our public schools. We need you flying across the ice, moving public education forward so that the victory is ours. The final victory really belongs to the Florida’s children. The United Teachers of Dade represents 38,000 teachers and school support personnel in MDCPS. Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.

If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments. Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive. Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
