"Student Connection" of Aventura Marketing Council visits State Attorney Katherine Fernandez Rundle's office College Planning Specialists sponsors field trip Over 80 at-risk students from the Aventura Marketing Council's "Dade Partner" schools recently spent the morning with Leah Klein, Division Chief and Scott Dunn, Assistant State Attorney, from the office of Katherine Fernandez Rundle, Dade County State Attorney. State Attorney Katherine Fernandez Rundle serves as the Honorary Chair of the Student Connection, and each year, meets with the students to talk with them about issues ranging from domestic violence to sentencing guidelines. Rundle was scheduled to speak to the students, but in a true "life lesson", was called away for an emergency press conference on the ethics issues involving local elected officials, which her office is handling. "It is truly an honor to serve as the Honorary Chair of the Student Connection program," said Rundle, " and I am extremely pleased that the students look forward to coming here each year to learn about the State Attorney's office. We want the students to know that they can contact our office at any time with their questions or concerns." Leah Klein and Scott Dunn ably stepped in to speak to the students who were eager to learn about domestic violence, criminal behavior and the ramifications of criminal actions. There was no dearth of questions from the students to Klein and Dunn, and each question was answered honestly and thoroughly. Domestic violence was a topic of great interest, and the students were encouraged to call the State Attorney's Domestic Violence Hotline at (305) 547-0150 (8 a.m. - 5 p.m. M - F) or the weekend/after-hours emergency hotline at (305) 547-0100. VIEWPOINT Botched investigations lead to executions BY LARRY COX When the United States abolishes the death penalty, some of its most ardent proponents ironically may be remembered for having made the most effective case for its demise. Texas Governor Rick Perry's obvious attempt to suppress the truth in the supposed arson case against Cameron Todd Willingham, executed in 2004 for a crime that probably didn’t occur, reveals the heinousness of capital punishment. That an innocent individual can be executed is disturbing. That the death penalty—which has claimed about 50 lives in the United States so far this year—is used for political purposes, while doing nothing to deter violent crime, is abhorrent. Less than two hours before Willingham's execution, Perry received a report challenging the central evidence against him for the supposed arson that killed his three young daughters. But Perry permitted the execution anyway. Five years after Willingham’s execution, the state Forensic Science Commission was on the verge of reviewing new findings that made a compelling case for his innocence. But recently, just two days before the commission's review, Perry began replacing all four governor-appointees on the commission. He called his move purely routine. Maybe so. One week before Thanksgiving, Texas executed Robert Lee Thompson after Perry rejected a rare recommendation from the state clemency board for the prisoner's life to be spared. In that case, the person who actually shot the victim is serving a life sentence. Why is this routine in Texas? Facing a Republican primary in March, Perry’s actions have struck most observers as purely political. After all, the death penalty does more to help politicians get elected than keep us safe. Most criminologists believe that it doesn’t deter murder. A recent Death Penalty Information Center study shows that police chiefs around the country rank the death penalty last among measures that help fight crime. Nevertheless, few politicians publicly oppose it. Additionally, the election of district attorneys and judges creates such a strong political motive to secure harsh sentences that investigations and prosecutions can be sullied by manipulating evidence. Securing testimony from dubious sources to justify a theory of someone’s guilt is too easy. For example, the government relied on a jailhouse snitch (the most dubi-
ous of all such sources) in Willingham’s case and in numerous other cases where strong innocence claims have later emerged. That’s a factor in the Georgia case of Troy Davis, who has spent two decades on death row and now will have a court hear his claim of innocence, following a ruling from the Supreme Court. The death penalty gives government godlike power that, given human fallibility, is incredibly dangerous. In Willingham’s case, arson investigators used techniques that have since been debunked as “junk science.” While witnesses initially reported seeing Willingham attempting to help his children out of his burning house, they seemed to change their story and remember less sympathetic things about him once investigators started to say they saw clear signs of arson. Texas and other states should improve their use of fire science and the best technical tools available. But bias and ambition can always corrupt perceptions and conclusions. Justifiable outrage over senseless killings can color emotions in the search for truth. Even the most honorable and wellintentioned prosecutors and judges can succumb to intense political pressure. The results, predictably, are wrongful convictions or, as in the Willingham case, a wrongful execution. Supreme Court Justice Antonin Scalia said in 2006 that he didn’t believe the United States had executed anyone who was innocent. If that had happened, Scalia said, “we would not have to hunt for it; the innocent’s name would be shouted from the rooftops.” Willingham's name isn’t being shouted from rooftops, though it should be, along with the names of other innocent men who were executed like Carlos de Luna, Ruben Cantu, and Larry Griffin. Have we become so numb that the killing of innocent people is acceptable? Had Willingham been sentenced to life in prison, he could be a free man today. Instead we are left to ask, as former Texas Governor Mark White recently did: Why do we impose the death penalty, given the possibility that an innocent person will be executed?

Sick leave policies spread swine flu BY JIM HIGHTOWER Sometimes, being mean to people can turn around and bite you in the butt-even if you're a corporation and, physiologically speaking, have no butt. One of the meanest and stingiest workplace policies is the denial of paid sick days for employees-a reality faced by almost 40 percent of private-sector workers. These people are mostly in lower-wage jobs and cannot afford to miss even a single day's pay. So, the result of this corporate stinginess is that tens of millions of coughing, wheezing, vomiting, employees are on the job, rather than calling in sick and staying home. These include food handlers, healthcare workers and others who deal directly with the public. While this corporate approach saves money for employers, ill workers pay a heavy price-and their contagious illnesses can easily spread to co-workers and customers. This has always been a public health problem, but with a swine flu pandemic sweeping the country, it has become a national health threat. In addition to workers who get no paid sick days, millions more are employed by
such outfits as Walmart that aggressively discourage any use of the benefit. The retailing behemoth runs a "points system": use one sick day, and you get one demerit; accumulate five or more, and you can be fired. But this stinginess is now biting those corporate butts. Because of swine flu, executives are demanding that ill employees stay home, yet workers get no pay or get demerits if they do stay home, so they don't. Instead, they're at work, greeting customers with: "[cough-cough] May I [cough-cough] help you [cough-cough]?" Meanwhile, these same companies are fighting a legislative requirement to provide a mere seven paid sick days a year. The new company slogan could be: "Walmart: Spreading Swine Flu, One Customer at a Time." --

Life in the City BY BARI AUERBACH ‘Signs of the Times’ Around Aventura there are signs promoting public safety like the one posted by the Police Department asking potential speeders “Is it worth it?” But wouldn’t it be awesome if new signs could also go up all over town with proactive messages like these: “Stop Honking!”: It’s always so frustrating when the motorist behind you keeps honking their horn – urging you to accelerate directly into oncoming traffic. But maybe if there was a “Stop Honking!” sign, impatient drivers would realize they really don’t want to be responsible for the demise of others just so they won’t be late for their hair appointment. “Don’t Eat That!: Imagine getting ready to devour a jumbo sized treat that isn’t on your diet when all of a sudden you look up and see a sign flashing “Don’t Eat That!” Considering obesity is growing faster than any previous public health issue in the nation, this sign would really
be a public service! “Be Honest!”: From public corruption scandals – to posting very old photos on dating sites, telling the whole truth and nothing but the truth may be an endangered concept – but if there were “Be Honest!” reminder signs posted throughout America, odds are people would at least think twice before stretching the truth about as far as the Brooklyn bridge. “ M e d i t a t e M o r e ! ” : Crying babies, screaming moms, angry customers, cursing drivers…Since the prevalence of upset and agitated people seems to be on the rise, “Meditate More” signs could be very helpful, subconsciously reminding everyone to breathe deeply and relax – even if someone cuts you off, won’t take back the merchandise or disconnects you after you’ve been put you on hold forever forced to listen to an endless loop of Calypso music. “Happy Holidays!”: It’s always nice to feel holiday cheer and look forward to the New Year – but if you’re lucky enough to live in Aventura, pledging to thoroughly enjoy life in the city is at least one New Year’s resolution you never have to worry about keeping!

BY LYNN CARROLL Not even bad weather could keep the racket down at The Fairmont Turnberry Isle Resort & Club for the recent Tennis for a Cure event. Event chairman Dr. David Muransky, director of the Aventura Chiropractic Care Center, said the bash was a real smash, raising more than $1,000 despite a turnout limited by rain. "The general intent was to have fun, network and raise money," the doctor said. "It was supposed to be a two-day event and, sure enough, it rained on Saturday." Dr. Muransky, a former tennis pro turned chiropractor, said plans called for officers from the Aventura Police Department to measure everyone's serving speed by radar on Saturday, but that had to be cancelled due to the downpour. Most events were rescheduled for Sunday. "We had a lady's round-robin followed by a hit-the-target, win-a-prize contest," he said. "The men's round-robin followed, as well as matches for those who paid to play with the various pros who were there." They included Hall of Famer and Grand Slam Champion Australian Fred Stolle, Turnberry's Ambassador of Tennis for the past 20 years; grand-slam champ offspring Anthony Emerson and Turnberry's Director of Tennis Elizabeth Cusack, the event co-chairman.

Since no one knows how long they will live or how long they will have here on earth. It is a good idea to know what you want to accomplish and what you want to enjoy, while you are here. It is estimated that the average person will have 4,420 weeks or 31,025 days in their lifetime if they live to be 85 years of age. You may not live to be 85 or you may live past 85. It is just the average. This knowledge should not frighten you or make you sad. It should empower and inspire you. It should stimulate you to make resolutions and take action of some kind. South Florida residential inventory plummets 35% BY ROMAN PAVLIK As the South Florida winter tourism seasons begins this week, buyers coming to the tricounty region will find that there are one-third fewer resale properties to choose from compared to a year ago. Residential properties for resale have tumbled by more than 37,730, or 35 percent, on a year-over-year basis to 69,797 single-family houses, condominium units, and townhouses in Miami-Dade, Broward, and Palm Beach counties, according to a new report <http://www.condovultures. com/images/stories/vdreports/november2009/cv_active_pending_inventory_run ning_total_11_23_09.pdf> from Condo V u l t u r e s . c o m <http://www.condovultures.com/> . Compared to Thanksgiving week 2008, the single-family house inventory in South Florida has tumbled by 19,657 residences to 26,942 homes available. Condominium and townhouse inventory has slipped by 18,073 properties to 42,855 properties, according to the Condo Vultures.com report based on Florida Association of Realtors <http://www.floridarealtors.org/> data. "The South Florida real estate market is showing signs of potentially bottoming out," said Peter Zalewski, a principal with the Bal Harbour, Fla.-based real estate consultancy <http://www.condovultures. com/en/consulting-services.html> Condo Vultures® LLC. "Resale inventory is down 35 percent across the region, all of the construction cranes developing condos in Greater Downtown Miami have been down for at least a year, and 19 bulk deals - four in November alone - have closed since July 2008. "The looming question that remains is whether the South Florida market is at a plateau or a bottom given that foreclosure filings are still rising." “ 35% Decrease in Homes for sale “ Well it looks like the buying spree that we have experienced in the last 12 months is continuing. July, August and September saw sales volumes higher thatn anything we have seen in over many years. # of sales in
September have tripled since 2007. This has caused the inventories to shrink 35% from last year. According to MLS statistics, there are 26,942 houses for sale now versus 46,599 last year, and there are 42,855 condos and townhouses versus 60,928 last year. The surge of buyers is due to several reasons: 1) low interest rates around 5% for end users 2) price drops anywhere from 50% to 80% depending on the areas, 3) foreign investors taking advantage of a weak dollar and low prices 4) the tax credit for first time home buyers 5) the foreclosure moratorium that was in effect most of 2009. Where the market will go in the next 12 months? There are two large factors that will determine that. The first is that the government has extended the first time buyer tax credit and added a tax credit for move up buyers also. This should help maintain the pace of the buying activity. The second, and probably most significant factor is what we call “shadow inventory”. These are all the foreclosures that the banks are holding and not releasing yet. The 20+ banks and servicers that personally give me foreclosures to sell, have only been trickling in. There is 6-8 months of inventory that has been accumulating and not released. Banks are trying to work out short sales and loan modifications with a large number of these homeowners rather than foreclose, but within record numbers of new foreclosures being filed, nobody knows how many and how fast these will hit the market. As long as the monthly releases do not exceed a large percentage of the monthly sales we are experiencing, then the market should continue to recover. ‘Still stuffed?’ How to burn off holiday feasts BY BARI AUERBACH If your Thanksgiving feast added up to a critical mass of fat and calories, this week you may want to make an early New Year’s resolution to start burning off everything that left you feeling extrastuffed plus all the leftovers that may still be stuffed in the fridge. Nutrition experts estimate a typical Thanksgiving dinner, with three ounces of skinless roast turkey; 4 ounces of mashed potatoes; two tablespoons of gravy; four ounces each of green bean casserole and honey-glazed carrots; a dinner roll with two teaspoons of margarine; assorted relishes; a few tablespoons of cranberry sauce; and a slice of pumpkin pie with a tablespoon of whipped topping have about 1,100 calories, 38 grams of fat, 150 grams carbohydrate and 40 grams of protein. To burn off all the calories from a typical holiday meal, you’d need to do at least four hours of walking at three and a half miles per hour or two hours of jogging at five miles per hour. But if all that cardio doesn’t sound too appetizing, you can learn to burn the calories in different ways. The good news is feeling “stuffed” can be just the catalyst needed to jumpstart a renewed commitment to improved fitness and nutrition plans. Diet Programs This may be the perfect time to sign up for Weight Watchers, Jenny Craig, Nutrisystem or another diet program that can help you stay disciplined – at least until the holiday season is over. Breaking Plateaus If you’ve been doing the same exercise routine since a few Thanksgivings ago, it may be time to change things up so you can break plateaus that can hold you back
from attaining your fitness goals. For example, if you’ve always exclusively done cardio but never step foot in the weight room of your gym, try incorporating resistance training to target problem areas cardio alone can’t firm and tone. Ask an Exper t Even if you don’t have the budget for a personal trainer, most gyms offer complimentary consultations and at least one training session. Taking advantage of this “learning session,” you can ask a trainer what kind of program would be most beneficial for you. This is also a good opportunity to share the routine you currently have and ask for alternatives that could change things up so you can achieve more optimal results. Get Moving If your job requires you to be very sedentary during the day, resolve to devote at least 30 minutes either before or after work to do some form of invigorating exercise that will get you up and moving more. Eat Less Mor e Often Whatever portion size you usually have on your plate, try making it smaller. Then start eating more frequently throughout the day…A healthful meal or snack every three to four hours can stave off hunger, kickstart your metabolism and definitely help get rid of some of the extra stuffing that somehow made a beeline from the holiday table to your waistline!

It feels good to get off work-a-day treadmill BY KELLY CRAIG We’ve all heard of the Four Horsemen of the Apocalypse. You know, those biblical equine trouble-makers empowered to wreak havoc on the world. Well, last June I got my own feathered version of looming disaster when a beautiful peacock showed up in my front yard. The sight of one of these colorful creatures strutting around the neighborhood is nothing new for a lot of South Floridians, but I’d never before seen one on my street. On this particular Saturday evening, the bird not only inspected the grounds, he actually swooped up onto my roof and perched there for about 10 minutes, staring straight at me. I actually said to my husband, “Wow, it’s as if the peacock knows he’s found safe haven on the home of an NBC staffer.” Hubby just rolled his eyes, but I basked in my

for this; it was the weak economy, plain and simple, so why hold a grudge? Third, I can now actually take a breath and smell the roses. Yup, I now understand the perks that stay-at-home Moms get to enjoy. I’m up bright and early to wake my family, fix them breakfast and take my son to school. Then I happily motor back home so I can go back to sleep until the crack of noon. This might sound easy, but you try getting some shuteye when that pesky lawn guy won’t stop buzzing around next door or the phone rings or, God forbid, I actually have to do something that requires me to be in an upright position. Do you know how hard it is to feign disgust when other parents of teenagers complain to me about how late their little slackers sleep in? And what about the panic that sets in when I realize I might have forgotten to reset the alarm to six a.m. after my snooze fest? If Hubby sees that it was somehow “mistakenly” set for noon, the jig would totally be up. I’d
get busted worse than the father who concocted that freaky little Balloon Boy hoax. Thank you to all the ladies in Publix who stop me and say, “Gosh, we miss you on TV.” Truth be told, yes, there are days when I miss it, too. All in all though, for now it feels good to get off the work-a-day treadmill and onto a real one. Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.
If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments.

Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
