Aventura Hospital CEO Heather J. Rohan honored as Distinguished Alum by Barry University Heather J. Rohan, FACHE, the Chief Executive Officer of Aventura Hospital, was recently honored at Barry University's Distinguished Alumni Awards for her 30 years of leadership and healthcare experience and for her service to Barry University, her alma mater. "I am truly honored to be recognized as a Distinguished Alumni," remarked Rohan. "I owe much of who I am today to the support and guidance that Barry University has provided me through the years." Rohan's expansive and impressive career in healthcare has included holding leadership roles in both the administrative and clinical areas for more than 25 years, including serving as Chief Nursing Officer at Cedars Medical Center in Miami, Chief Executive Officer at Pompano Regional Medical Center and Palms West Hospital, and as previous Chief Operating Officer of Aventura Hospital. Ankle Replacement Specialist joins Orthopedic Care Center BY LYNN CARROLL Dominic Lewis, M.D., has joined the staff of Orthopedic Care Center, which is located on the campus of Aventura Hospital & Medical Center. Dr. Lewis is an orthopedic surgeon specializing in problems of the foot and ankle. After receiving his M.D. at Georgetown University and doing his orthopedic residency at Howard University Hospital, he completed a fellowship at the world famous American Sports Medicine Institute in Birmingham, Alabama. While there he worked with professional athletes from the NFL and NBA and college athletes from the University of Alabama and Auburn University. Many people develop arthritis of the ankle after fractures or chronic sprains. According to Dr. Lewis, the usual treatment begins with conservative measures involving medications and injections that, after a period of time, may no longer work. Many patients then opt for ankle fusion, which in the past has been the standard operative procedure. While beneficial for pain relief, one side effect is loss of mobility, which creates stress and arthritis in adjacent areas.

Certainly there are some who take this day to their hearts, in solemn remembrance of the hundreds of thousands of our youngest and brightest who have been lost to wars over the years and in support of those who remain, some injured physically and some injured emotionally from the toll of wartime. These are the men and women who fought for our freedoms… allowing us to dream, to speak out against injustice, to attain a better life as free people - and for this – we honor our veterans just one day a year? No, I believe we should remember our veterans every day, for without them we would not be living in the greatest nation in the world. So, even though it is past the ‘official’ Veteran’s Day, let me do my small part in keeping our brave veterans in our

The "Bands of America" festival is calling out for the Dr. Michael M. Krop Sr. High School band to perform before a very distinguished audience next March. Now the 45-member ensemble is calling upon community leaders and business owners to help provide the financial lift the band needs to make the trip. Playing at the festival, held in Indianapolis March 5-7, is an unusual honor, says Bringle Cidel, Krop Sr. High band and orchestra conductor. "Hundreds of ensembles throughout the nation submit recordings for consideration into the festival," Cidel says. "A panel of nationally acclaimed conductors selects a total of 16 ensembles." Now the hurdle is finding the estimated $885 each band member needs to meet travel expenses. "Realistically," Krop's conductor says, "there are about 20 students in the group who are struggling to find funds to make the trip-- and if they can't go, the entire group can't go." To date, Cidel says, the band has raised about $7,000. "We've sold everything we can think of," he says, "from cookie dough to candy to Krispy Kreme doughnuts, but
it's like pennies compared with the cost of the trip." Anyone who extends a helping hand will find it's not a one-sided deal, Cidel says. "Sponsors will be invited to all concerts and have the name of their company in all our concert programs," he says. "We're also open to providing musical entertainment within the community as long as it doesn't conflict with school related activities." In the past, he adds, the ensemble has willingly used its own funds to cover transportation expenses when performing for the community. WLRN Channel 17 to air documentary on shelter for homeless BY LYNN CARROLL "Lotus House: A Place for New Beginnings," a halfhour documentary on a shelter for homeless women and their children in the heart of Miami's historic Overtown District, will be shown for the first time on public television this December. The program premieres on WLRN Channel 17 on Tuesday, December 15th at 9 p.m. and repeats Thursday, December 17th at 11:30 p.m.; Monday, December 21st at 8 p.m. and Sunday, December 27th at 2:30 p.m. and 11:30 p.m. WLRN's producer Meredith Porte says she set out to create an inspiring look at both the residents and the people who created and maintain Lotus House. "This shelter," Porte says, "is unlike others in the way that it provides support. It's about treating the whole person in order to help the women make changes in their lives and
stop living on the streets." She says the documentary shows Lotus House residents in everyday activities with an eye on how they evolve and eventually thrive. "We get insight," she says, "into what happened to make these women homeless, as well as how Lotus House has helped them." The production, Porte says, is also about attorney Constance Collins Margulies, Lotus House founder and director, and her recent marriage to Marty Margulies, a well known South Florida real estate developer and art collector. It also introduces other people who play a role at Lotus House, including Dr. Gordon Miller, who gives free eye examinations to residents, and high-school student Shelby Hinds, who sells baked goods to raise funds for the shelter. "Lotus House," says Porte, "is a true model for change in the way that homeless people are treated in America, and my aim was to showcase that."

Monsters under the bed BY PATRICIA C. FRANK mEvery parent is familiar with their child’s nighttime fears. Scary thoughts and feelings occur most often at night in the dark. Children often think that there are monsters under the bed. Do you know why children are so afraid of these monsters? It is because they know how dangerous they can be. Children seem to know instinctively that monsters can harm you and even eat you alive. When parents hear their child cry out, they come and put on the light, look under the bed and in the closet. They help them deal with their fears and they comfort and reassure the child that they are safe. Adults are just as susceptible to nighttime fears. Monsters exist. Monsters are real. Adults forget how much harm these monsters can inflict Worries about money, security, relationships, health and other facts of life can harm you and your health and truly eat you alive. For adults there are real monsters under the bed, and sometimes they even get into bed with you at night and terrorize you. Do not take your monsters to bed with you and do not let them get in bed with you.
As an adult when you experience nighttime fears and cry out, you will probably not have the luxury of having someone else come and look under the bed and in the closet and confront the monsters for you. There may be no one to calm you and to comfort and reassure you. You have to become your own loving parent. You have to switch the light on. The light of reality will allow you to see the monsters for what they really are. Although your monsters may be real and frightening, you can handle them. Think of something wonderful that you have accomplished in the past. Reassure yourself that you will accomplish wonderful things again. You can handle whatever situations arise. Remind yourself that you have the ability to find creative solutions to all of your problems. The core of your being is strong. Switch your thoughts from fear to faith. Have faith in yourself, God, an Infinite Spirit or the Universe. Reject any thoughts of doubt. Release your worry and excessive concern. This will help you make it through the night. It takes a lot of energy - both physical and electrical - to prepare meals for family and friends during the holidays. Whether you're cooking a feast for relatives or baking cookies for an office potluck, keep these tips in mind to minimize your electricity usage in the kitchen: • Don't waste energy by unnecessarily pre-heating your oven. Some foods, such as bread and desserts, require preheating, but holiday meal staples such as turkey and ham don't. • Keep the oven door closed. Ovens lose lots of heat when opened and require significant energy to heat back up to the appropriate temperature. Instead of opening the door to check on your food, turn on the interior light and look through the oven's window. • Oven-bake as many items together as you can. Although some items may cook at different temperatures, many
items can be cooked at a standard temperature. • Use smaller appliances such as crock-pots, microwaves and toaster ovens when possible. These can be much more energy-efficient for side dishes or small meals. • Match the size of your pan to the size of the heating element. For example, when using an electric cook top, a 6-inch pan on an 8-inch burner will waste more than 40 percent of the heat produced by the burner. • Choose glass or ceramic pans for the oven. These pans heat faster than metal ones and allow you to set the temperature 25 degrees lower than a recipe suggests for the same cooking time. • When possible, cover your pots and pans. This can help cook your food more quickly and keeps the cooking temperature higher, which allows you to turn down the stove. • Only use as much water as you need in a pot. Every extra drop requires more energy to heat and increases the cooking time.

mSo I am heading North on A1A, through Sunny Aisles toward Hallandale Beach. I am looking for a restaurant called Joseph’s on the Water . Sure, it’s on the water (the Intracoastal to be exact), but I am not seeing it. That’s because it’s hidden in the back of the Hemispheres condo building. To be fair, there is a sign, but I missed it. That was the bad news. The good news is that when I finally located the building and drove through the guard gate to the back, I found a lovely, old-world-meetsgothic-chic dining establishment. Stone façade outside gave way to a space that could support a dual crowd: early on, elder folks come to dine (No, not early bird specials, just older folks who don’t eat late), but then as the sun goes down, a 40s, 50s, and even 60-something crowd piles in to soak in the internal and external atmosphere. Let me explain. Numerous chandeliers wrapped in sheer, white fabric hang above whiteclothed tables, wine-colored banquettes, and a piano bar from vaulted wood ceilings. Additional swags of sheer, white fabric strategically hang as adornments, creating a “gothic-meets-chic” atmosphere. (Like an old-time supper club so many new restaurateurs are striving to achieve right now). But the bar looks like it could be on a cruise ship. Wooden, mirrored, rows of glasses hanging for the bartender to reach up and grab with ease…The place is not trendy. It doesn’t try to be. But it is incredibly inviting and unintentionally fashionable! As I walked toward the back, a few patrons were sitting, sipping, and socializing with the owner, Joseph Maggi, at “said” bar. “Hey, how are you? Welcome!” Maggi said, as if he knew me (which he did not). The cheer and mirth that exudes from this man sets the standard for the restaurant. The space seemed so comfortable, so easy to be there. And who can ask for much more than that? I chose to eat outside on the deck, which sits just atop the Intracoastal. Two rows of tables spanned the length (about 100 feet long), each offering a stunning view. You’ve got to love a place where
there isn’t a bad seat in the house. But how is the food? The menu offers a large variety of choices, all with a definite Italian edge. Starters are fairly typical—fried calamari, clams casino, oysters Rockefeller, Caesar salad, Gorgonzola dinner salad, but, “If it ain’t broke, don’t fix it.” These are safe and delicious, and work for the current clientele. “Joseph’s on the Water is a six-yearold restaurant with an older, established clientele,” Maggi explains. In the business for 30 years total, Maggi says that these folks “ate” with him as kids. “Now they are all grown up and have grandkids, and are still coming in!” he says. That’s because Joseph serves up straight-forward, understandable good food. He uses fresh produce, fresh fish and other healthy ingredients that can be broiled, baked or blackened to taste. Rainbow trout, Tilapia, Yellowtail, red snapper, lobster, sea scallops and on and on are available here. Stone Crabs in season are too. But wait, want Italian? Try the Chicken Parm, Francaise, Marsala, Florentine or many pasta dishes. Portions are very generous, and choice of potato and side of veggies. I had Seared sesame tuna, which for $25.95. It was rare and sweet and the portion was enormous. The NY Strip was a perfect medium-rare. For those who crave fried food (c’mon, who doesn’t love a good fish fry once in a while?), Joseph’s offers that too, but many of the dishes play to the healthier side of things. The only thing I thought could be better was superfluous; it was the plating. I thought “What if he made it a little more artsy on the plate, instead of just a protein, potato and vegetable.” As the meal came to an end, Joseph came over and sat down to chat and I asked him. His response: “I am open to anything. Sure we can try it.” I love trendy. I love all things fresh and new and hip. But even more, I love good food, nice and good people and Joseph’s on the Water has what it takes. It is a best kept secret…really. And, watch out for calories in soda, fruit punch, and eggnog. * Bring a healthful dish to a holiday party. This is one way to ensure you’ll have something healthy to eat, while sharing something nutritious with your family. * Learn to say no. Get in the habit of saying, “No thanks, I don’t eat dessert,” without feeling the need to explain yourself. At first you may be met with some resistance, but eventually people will get the point and stop asking you. * Enjoy good friends and family. Although food can be a big part of the season, it doesn’t have to be the focus. The important thing to remember is balance and moderation - it’s ok to indulge once in a while!.

Growing unemployment could hamper the holiday season

The latest unemployment numbers shows layoffs worsening due to 505,000 new benefit claims. While that is the lowest number since January, overall unemployment remains at a 26-year high with 5.6 million people needing extended benefits. The United States Department of Labor reported that 28 states, including Florida, had worsening unemployment in October. National unemployment is now running at 10.2 percent. In Florida, the unemployment rate was up slightly by 11.2 percent. That is close to September’s level, which could mean that the job market has bottomed out statewide. Yet, it still remains at its highest level since 1975. Miami-Dade’s jobless rate keeps getting worse and is now approaching 12 percent. That is up by about 0.4 percent since September, based on more job losses in the construction industry and trades. Broward is showing some improvement with October unemployment falling slightly to 9.7 percent. The growing unemployment problem is now prompting an international economics “think tank” to forecast that the United States recovery will remain weak for the immediate future. The latest data is showing that old problems are getting worse and it is hurting Main Street a lot worse than it is hurting Wall Street. The growing unemployment is keeping consumers away from the checkout counters. Personal spending remains flat as families struggle to stay in their homes.
Unfortunately, it remains a vicious circle. Businesses need to see enough improvements in consumer spending to push them into adding more employees. On the upside, the latest economic indicators from a private group known as, “the Conference Board,” showed improvement for the seventh straight month. The United States economy showed improvements in at least six out of 10 major indexes. The rate of October’s improvements slowed a bit from September. The dollar is picking up some strength in foreign markets and that is depressing commodity prices for gold and wholesale oil. That could mean that we will see stabilizing or cheaper prices at local gas pumps during the holidays. The Mortgage Bankers Association reported back in September that more than 14 percent of United States homeowners were either late with their mortgage payments or in some form of foreclosure filing. The group warns that continuing loan defaults and foreclosures could slow any hopes of a more rapid housing recovery. If the major indicators — the latest consumer confidence numbers, residential real estate trends and corporate profitability — show more weakness in the recovery, we can expect few more solid gains out of Wall Street as we approach the New Year. Investors are still very nervous about the economy and the continuing short-term weakness of our recovery. Yet, considering all of the latest concerns about recovery stalling, we should consider it as a “holiday blessing” that there is still growth and not deeper losses as we immerse ourselves into holiday season shopping, financial trading and the upcoming new year.

LET’S TALK CARS The Honda Odyssey debuted in the United States in 1995 and, after some early missteps, has become a popular minivan with American consumers, one known for having a lot of innovative features and engineering excellence. The Odyssey is an excellent family vehicle, with room for as many as eight people (seven on LX models), and comes with such available family-friendly options as a satellitelinked navigation system, a DVD rear entertainment system, Bluetooth, a backup camera, power side-doors and a power tailgate. Under the hood there’s an available 244-hp V-6 engine mated to a five-speed automatic transmission that delivers an EPA highway fuel-economy rating of 25 mpg on models equipped with Variable Cylinder Management (VCM), a system that can deactivate up to half of the engine’s cylinders when less power is needed. The engine is programmed to run on 3, 4 or 6 cylinders and the i-VTEC technology allows the VCM to
quickly and seamlessly activate or deactivate two or three cylinders by closing each cylinder’s intake and exhaust valves at the same time. The system provides V-6 power when accelerating or climbing, as well as the fuel efficiency of a smaller engine while cruising. Odyssey has an independent front and rear suspension and a rigid unit-body structure to help provide comfortable riding and refined handling. Additional chassis components include power-assisted four-wheel disc brakes and variable power-assisted rack-and-pinion steering. Odyssey LX, EX and EX-L models have 16-inch wheels, while Odyssey Touring models are equipped with 17-inch alloy wheels. With its 60/40 split third-row Magic Seat, the Odyssey’s seating areas easily adapt between passenger and cargo needs. The Magic Seat can accommodate up to three passengers and still provide 38.4 cubic feet of cargo space behind the seats, or fold completely flat into the floor to create 91.1 cubic feet of space, with enough room left for five passengers (four in the LX). With the second-row seats removed, total cargo volume expands to a huge 147.4 cubic feet. The unique second row PlusOne Seat on the Odyssey EX, EX-L and Touring models integrates a storage bin inside the seat structure and also is removable to create a walkthrough to the third row.

If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments.

Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
