Aventura Comm. Billy Joel and his wife Sandra and Comm. Bob and Arlene Diamond recently invited their friends to hear the story of the Israel Sports Center for the Disabled, a center in Israel that opened in 1960 to become the first sport center for the disabled in the country and a world pioneer in the field. The center specializes in the physical and psychological rehabilitation of Israeli children and youth in order to encourage them to take part in sports activities. The spirit and motivation of sport is used as a means to help guide the disabled from a state of helplessness to productive, fulfilling lives. It has been proven that, in addition to promoting physical and mental rehabilitation, sports activities significantly prolong the life expectancy of the seriously disabled. Today, over 2,000 youth and adults participate in more than 20 different sports activities. "Each May, Sandra and I visit the ISCD and have the honor of presenting the medals at their sports competitions. Our hearts are so full of love and admiration for the children of ISCD, and we want to tell the story of their courageous battle against overwhelming odds to excel in international sports arenas, giving hope to everyone who faces physical disabilities," said Comm. Joel. Rubin Salant of Aventura hosted the evening reception in his beautiful home at Island Estates in Williams Island. Special guests included David Weissman, president of the Florida Friends for the Israel Sports Center for the Disabled; and major donors Paul and Maggie Fischer, Mitchell and Sandy Fishman, Joe Platnick, Dr. Amir and Sue Baron of Aventura Turnberry Jewish Center. Six students from David Posnack Hebrew Day School in Davie were also there representing the National Honor Society. The NHS, represented by NHS President Noa Ghersin, Gabriella Ittah, Maytal Levy, Romi Sher, Arielle Ozery and Sammy Barak, voted to raise funds for ISCD during the coming year. " My wife Maggie and I are so proud of these students, that in honor of our three daughters, Sophie, Ariel and Emma who attend the Posnack Day School in Plantation, we will donate matching funds to the students' donations." Attending this very special event in Aventura on behalf of the ISCD were Dr. Boaz Kramer, a former student at ISCD who went on to attain his medical degree and then returned to work with the children. Dr. Kramer is currently ranked 12th in the world in wheelchair tennis, is the current 2009 French Open Gold Medalist in tennis; Silver Medalist World Cup tennis; and Silver Medalist in the Beijing ParaOlympics 2008. Dr. Kramer is married and has one child. Asael Shabbo, 17 years old, came to ISCD after Palestinian terrorists broke into his home, killed his mother and three brothers and shot his leg so many times that the leg had to be amputated. Today, Asael is competing for Israel in the Olympic swimming competitions. Caroline Tabib, 13 years old, was born with a spinal disease and entered ISCD at age three. Caroline has just placed fourth in European table tennis in Italy and is a 2012 Olympic hopeful. Boaz, Asael and Caroline owe their spirit for living and competing in sports to the Israel Sports Center for the Disabled. Comm. Joel, recently elected Chairman of the Florida Friends of ISCD, and his wife

Sandra first visited the school in 2006, When they saw the children being taken out of the swimming pool and placed on the cement ground to change their clothes, they made a commitment to raise enough monies to build 11 fully-equipped, handicapped accessible private dressing rooms. The rooms were completed this past June. "Our new goal is to raise $250,000 for the installation of eco-friendly heat pumps to access the heat from the atmosphere to heat the water for the pool, the hydrotherapy pools, showers and for all the hot water for the facility" said Weissman. Financial strategies to help cope during difficult times

Al Sunshine 4 YOUR MONEY We’ve seen some trriple-digit losses as we’ve entered the last quarter of 2009. And they may be triggering concerns that we’re getting back into a volatile period on Wall Street like we faced almost exactly a year ago — scary times indeed. Fortunately, this October Wall Street is in a lot better position than it was last year when the stock market dropped some 1,600 points in the first week of the Fourth Quarter. Since the Dow bottomed out in March, dropping down to 6,547, it has gained almost 3,000 points. And recently, it actually approached the 9,900 mark before we started seeing some recent triple-digit drops. Financial planners say that’s correct. And that is why it’s critical to double check your finances. Coral Gables-based financial planner Matt McGrath says, “It’s a very important

time to know how much your spending, how much you’re earning. You have to know where your money’s going.” First: Know where your money is. Put together your own financial balance sheet. Look for cheaper credit cards and cheaper mortgages. Force yourself to cut spending however you can. Volunteer for more overtime to try and boost your salary however you can. Double check your payroll tax withholding and adjust it to make sure you’re taking out enough taxes so you won’t owe Uncle Sam too much money come tax time next year. Continue your savings and retirement contributions as much as you can and fine tune your investments to better balance risks versus rewards. Cut the investments that are not doing well and move your money into areas where you think it may be safer and yield better returns. Consider increasing your savings and consider signing up right now for end of the year “Christmas Club” or travel accounts to get ready for next year. Contact lenses - new and improved but that’s not all! BY DR. STEVEN WIGDOR Contact lens designs and materials are constantly being improved. Every major company now has a silicon based lens to increase oxygen transmission and to help with dryness. Initial lens materials and designs were only able to increase oxygen by making the lens very thin or by increasing the water content. Thin lenses were hard to handle and lenses with high water content needed your tears to help maintain their water level. If your tears didn’t have enough moisture, neither did your lens. Silicon by its nature allows a tremendous amount of oxygen, and doesn’t increase the water content of a lens at all. With increased oxygen there is less corneal swelling and in general a more comfortable lens. Spherical, astigmatic, and multi focal designs are all available in these new materials. Although not available everywhere yet, Vistakon’s silicon Oasys for Presbyopia lens for example, has shown excellent promise in early studies that were performed in our office. That isn’t to say that some conventional lens designs and materials are not good for you. Many of my

patients still wear some early slightly less costly designs, very comfortably, all day long. The key is to fit lenses based on your needs, and your eye’s needs. The next step in comfort might very possibly come from the solution the lens is stored in and not the lens itself. Our office is currently doing a study for a company soon to be a new player in the contact lens solution market. Interestingly, different solution formulas so far have resulted in varying degrees of lens comfort late in the day. You might think that the “comfort” of a solution would only have an effect early in the day when the lens is first placed on your eye. It seems that solutions might have a significant impact on end of day comfort as well. If you ever wanted to wear contact lenses or were once unsuccessful, lens designs, materials, and solutions can now give almost everyone a very comfortable, clear outcome. Light is an electromagnetic radiation that is visible and makes everything else visible. It reveals things and clarifies them. It brightens everything. Many cultures celebrate the light at certain times of the year, when the world is at its darkest point. This is known as the season of light and people add lights to their homes both indoors and out. It is a great tradition born out of mankind’s needs. There are many kinds of light. Light can be good or bad. Someone or something can be seen in a good light or a bad light. It can make a favorable or unfavorable impression. Make sure that you only see and speak of things in a positive light and make sure that you only portray people in a positive light. Be a shining light yourself that offers peace and joy to others. There is also the light of mental and spiritual illumination sometimes referred to as enlightenment. A person can be enlightened themselves and they can also be a light source and a leading light to others. They can provide insight, hope and

happiness for themselves and for others. They can perk up and cheer up lives. If you are enlightened you will see everything in a special light. You will also be able to share your enlightenment with other receptive spirits. When you lighten someone’s load in life you reduce the load they are carrying. You relieve them of their burdens. You bring relief to their minds and hearts. A light heart is not heavy. It is unburdened. You can help to comfort and unburden others with a light touch that is a delicate and tactful. Be a candle that casts a warm glow and gladdens the hearts of others. Brighten every life you touch. Continue bringing the light of the season to everyone and everything throughout the year. If someone or something is full of light, they are pleasurable, cheerful, happy, sunny, easygoing and untroubled. They are merry and a delight to be around. Like a star you can serve as a guiding light. You can be a beacon in the dark. You can be the light of someone’s life. A person who lights up someone’s life is a much loved person. Watch your step! BY REV. WILL KEYSER It is probably more important today than any other time in our history to Watch Your Step!! with the impact of the inter-net and all the cell phone “conveniences” it has become more convenient for the scam artists and con-men to lure you into one of their traps and steal your identity along with everything else you own. Many people blame it on the electronic age in which we live, but the fact is people have had to watch their step way back in the days of Moses. There was no telephone, inter-net or computer yet God gave the Ten Commandments, one of which includes these words: “You shall not steal!” (Exodus 20:15) We can conclude that mankind has always had the tendency to steal from his fellow man. The Psalmist, David wrote this: “Be merciful to me, O God, for men hotly pursue me. All day long they twist my words and are plotting to harm me. They conspire, lurk and watch my steps eger to take my life.” (psalm 56:1-6) Things have not changed much! How many times have you had someone twist your words and you end up owing for something you never ordered nor wanted?

The same applies to the tele-marketers and even the legitimate organizations hotly pursuing you to donate to their cause. They may not want to take your life...only your life-savings! So Watch Your Step!!! As careful as we may be, there is still the strong possibility that we will be tripped up and fall. How does the young, single Jewish Community celebrate Christmas? The Mazel Tov Ball, of course! BY HARRY BAUM Let’s face it, everything is closed on Christmas Eve, so what’s a person to do? No, actually, what’s a young, single Jewish person to do? That was the exact question Harry Baum had. Baum is the president of South Florida Single Living, a Jewish singles organization. His solution; produce the Mazel Tov Ball - a singles event for the Jewish community,, where young Jewish singles can celebrate in their own way by getting together on this highly festive day of the year. That was 23 years ago. “Since virtually everything is closed, and only a few restaurants are open, there’s very little to do!! Jewish Film Fest reveals the power of social and personal choices BY SHEILA STIEGLITZ The Miami Jewish Film Festival was chosen Miami’s Best Film Festival* in 2009, and the 2010 lineup of films opening Saturday, January 16 lives up to the accolades. The award-winning films from Israel, Argentina, France, Germany, Slovakia and the USA are comedies, documentaries and contemporary dramas that ironically weave a subtle theme – people having options and making significant life choices – whether the characters are faced with life-threatening decisions, antiSemitism, sexual orientation or marital issues. The hilarious Israeli comedy, A Matter of Size, opens the 13th annual Jewish Film Festival opens at the Colony Theater, and deals with personal battles and self-acceptance. Four overweight friends live in a small Israeli town, and are fed up with diets and their dieting club. When Herzl (341 lbs.), the main protagonist, loses his job and starts work as a dishwasher in a Japanese restaurant, he discovers the world of Sumo wrestling, a sport that involves “two fatsos in diapers and girly hairdos,” and finds a place where large people are honored and appreciated. This universally appealing story uses the richness of Jewish humor to reveal that self-acceptance and happiness come from within. Several of the films in this year’s festival are based on true stories. Broken Promise is a unique Holocaust film that explores anti-Semitism among invaders and liberators alike. It is the story of teenager Martin Friedman’s numerous escapes from deportation - from a work camp, a tuberculosis sanatorium, to a monastery and partisan hideaways. The film is Slovakia’s Official Oscar Entry for

Best Foreign Film, and was the Los Angeles Jewish Film Festival Audience Award Best Feature. The provocative, award-winning documentary Killing Kasztner, follows Rezsö Kasztner, a Hungarian Jew who, in 1944, chose to save the lives of 1,685 Jewish countrymen from the Nazis by negotiating with Adolf Eichmann. Live action, animation and still photography are blended in the Argentine film, Camera Obscura. The innovative and lyrical film is set in Buenos Aires at the beginning of the 20th century, and Gertrudis and her family are Jewish immigrant who have recently settled there. Gertrudis is labeled ugly by her younger brother, and as a young girl, tends to blend into the background. When she is married off to an older Jewish rancher, she appears to have a happy life, raising a loving family. But changes occur, when her husband hires a nomadic photographer to take a family portrait. The comical film Oy Vey! My Son is Gay!, follows Shirley Hirsch (Lainie Kazan) and Martin (Saul Rubinek) when each Shabbat, they optimistically invite another perfect girl for dinner hoping to entice their son, Nelson (John Lloyd Young). Nelson reluctantly reveals that he is seeing someone, and Shirley is thrilled. Hilarity ensues as the family makes great strides to come together through love and understanding. The film’s Director Evgeny Afineevsky will attend the screening Saviors in the Night shatters the myth that opposition to the Nazi regime was impossible and futile. Based the memories of Marga Spiegel, the film recounts how courageous farmers in Westphalia, Germany hid her, her husband and their young daughter, saving them from the extermination camps. Exonerated cardiovascular and thoracic surgeon tells his story

Dr. Alex Zakharia, a highly-esteemed American Board Certified Cardiovascular and Thoracic Surgeon with a 40-year career, has been vindicated by the State of Florida and the Florida Board of Medicine and is in the process of getting his medical license reinstated in 2010. “It is time to clear my name in the court of public opinion,” stated Dr. Zakharia. “My family and I have suffered from this unspeakable injustice. The truth has prevailed. I am so grateful for the support and letters of good wishes from my colleagues and patients. I get calls from patients every day, and I offer them guidance respecting their health issues.” In a letter to Dr. Zakharia dated June 10, 2009, the Florida Department of Health affirmed that the Board of Medicine’s Probable Cause Panel “found there was insufficient evidence to support prosecution” and the pending case against Dr. Zakharia, which investigated past medical cases and his personal health was dismissed. There are no pending cases. This is just one of the final steps in a long legal battle that Dr. Zakharia has endured since 2002 when he proffered a medical opinion during a telephone deposition on behalf of a veteran in Michigan who brought a civil malpractice lawsuit against the Veteran’s Administration. The veteran had undergone a coronary artery bypass graft surgery (CABG) and experienced a brain stroke during the surgery. The prosecution had hired Dr. Zakharia as a vascular surgery expert, who was approved by the Michigan Supreme Court, to testify that if a proper ultrasound was performed prior to the surgery, the disease in the carotid arteries would have been revealed and corrective surgery performed prior to the CABG procedure. Dr. Zakharia offered no criticism of the CABG procedure itself during this 49 minute long-distance deposition and it was never used in court. The case was settled in the veteran’s favor. In May 2004, the Assistant U.S. Attorney (AUSA) Eastern District of Michigan filed charges against Dr. Zakharia, claiming he exaggerated his credentials and made false statements with regards to his CABG experience in the deposition. The AUSA claims were based on records obtained from the defunct Cedars Hospital in Miami naming only the “main surgeons” for CABG procedures performed at that hospital. Dr. Zakharia maintained during his deposition that he was not the main surgeon in these procedures at Cedars, but was, in fact, the attending physician for the period of time in question. Dr. Zakharia had been a main CABG surgeon for 30 years prior, but at other centers. “There is a difference between attending physician and main surgeon, and it was imperative that the AUSA use correct terminology,” said Dr. Zakharia. “My experience as attending physician qualifies me to recommend that an ultrasound treatment should have been conducted prior to this CABG procedure.” Had Cedars Hospital provided complete records to the AUSA, they would have attested to the fact that Dr.

Zakharia was undeniably the attending physician, consultant and provided patient care in over 400 cases spanning a period of seven years, and also had active privileges in Thoracic and Vascular Surgery over the past 25 years. Dr. Zakharia has a pending lawsuit against Cedars Hospital which alleges intentional omissions in record production, fraud, defamation, and misrepresentation of hospital privileges. “These misrepresentations have been repeatedly produced in tandem in many Miami Herald publications and were relied upon by the AUSA in Detroit to try to build this case,” said Dr. Zakharia. The doctor and his attorney provided the AUSA with medical records and letters from patients corroborating his role in CABG procedures as attending physician. Letters from the Chief of Cardiac Surgery at Miami Heart Institute, Chief of Anesthesia and Director of Nursing also confirmed Dr. Zakharia’s role as assistant surgeon/ co-surgeon at that facility in CABG and Primary Surgeon in Thoracic and Vascular procedures. Dr. Zakharia also provided the AUSA with extensive character, professional and public service records as evidence of his impeccable record over the past 35 years. Dr. Zakharia had no pending lawsuits, investigations, or complaints from any professional, hospital, medical, criminal or civil authorities. “The case was also reviewed by prominent Miami legal authorities, judges, as well as presidents of national surgical societies, who concurred that the AUSA’s position was unwarranted and outrageous,” said Dr. Zakharia. “I

simply gave a medical opinion which was never refuted and suddenly found myself facing criminal charges.” Since the motion to change venue to Miami was denied, and the costs and stress of a full blown trial were overwhelming, Dr. Zakharia settled the case with a plea agreement for Contempt of Court/One Count Misdemeanor. “I had 15 doctors who would have testified on my behalf, but with the trial in Detroit, it was simply not feasible,” said Dr. Zakharia. He said that he and his attorney were led to believe that the proposed penalty in this plea agreement was based on a downward departure and was fair and just. In reliance on this, they accepted the terms, which required the doctor to relinquish his medical license. During sentencing and following the signing of the plea, the AUSA admitted that a mistake was made in calculating the penalty. This meant that Dr. Zakharia had agreed to a penalty that did not correspond to a misdemeanor offense. The proposed penalty was based on a felony charge and not a misdemeanor, and the AUSA admitted this mistake in court. Simply stated, there was no need to trade the practice of medicine for the illusion of a downward departure. “How can an allegedly experienced AUSA commit such malpractice?” Dr. Zakharia said. “If there is no downward departure, why should I retire from the practice of medicine? The issue of relinquishing my medical license was tied to the downward departure, which was not even necessary. I accepted the plea, which was supposed to be a lesser penalty. It was not so. In retrospect, I paid the price for the AUSA’s fraudulent representation and lack of candor. When I realized this, I stated that I wanted out of the plea agreement. We are appealing this miscarriage of justice, and my goal is to get my medical license back.” Dr. Zakharia is encouraged by the finding. “The vindication by the State of Florida is a major victory, which by all standards of fairness and justice, refutes the entire basis for the AUSA’s arguments, the defamatory articles published by the Miami Herald and Cedars’ malicious claims,” he said. Dr. Zakharia has been in private practice in cardiovascular and thoracic surgery in Miami since 1985. Prior to this, he served as an Assistant Professor at the University of Miami’s School of Medicine, the Attending Cardiovascular and Thoracic Surgeon at Jackson Memorial Hospital and the Chief of Cardiovascular Surgery at the Veterans Hospital in Miami. “I’ve practiced at seven different hospitals in Dade County and have trained hundreds of students and residents,” said Dr. Zakharia. “I’ve been published in various books, publications and medical journals and lectured at numerous seminars including the Armed Forces in Bethesda. I am an active member in most national and international societies for Cardiovascular Surgery and was the subject of an editorial in the Annals of Thoracic Surgery, recognizing my pioneering innovations in cardiothoracic trauma.” Dr. Zakharia has been married to wife Andree for 38 years, and they are the proud parents of Yara, Kareem, and Alex.
