News. “We have the world’s best justice system because it’s about what can be proven,” Eiglarsh said. “To arrest someone requires probable cause - but before someone can be found guilty there must be proof beyond a reasonable doubt that the crime was committed and that the defendant was the one who committed the crime. I would change jury forms so instead of ‘guilty or not guilty’ the choice would be ‘proven or not proven.’” Eiglarsh went on to enlist the help of the audience to hold a mock trial highlighting how difficult it can be to obtain convictions due to lack of sufficient evidence. Aventura Mall, Miami’s premier shopping destination, created the Largest Chocolate Mousse in history at its annual Chocolate Festival on Sunday, Oct. 6. Totaling 496 pounds, the dessert was submitted to Guinness World Records. The event raised thousands of dollars for the Children’s Craniofacial Association, a national non-profit organization that addresses the medical, financial, emotional, and educational concerns of children with craniofacial conditions. Aventura Mall shoppers watched as Executive Chefs Rick Chiavari from Turnberry Ocean Colony and Danny Malone from Turnberry Isle Miami led the effort to beat the previous 313pound world record set in France in 2010. The Cranky Cure
Patricia C. Frank FRANKLY SPEAKING Being cranky is a feeling. You might not even know that you are cranky. You may just feel testy, irritable, cantankerous, snappish, ill-tempered, bad-tempered or short-tempered and a bit peevish or crotchety. What makes you cranky? Make a list of the things you feel cranky about in that very moment. Sometimes, it is a thought, a fear or an actual event. Get to know your triggers and what makes you upset and unhappy. Get to know your vulnerabilities. Learn to identify what is making you feel peevish, contentious, querulous and irascible. Crankiness is usually born out of frustration and conflicting desires. Frustration because you cannot do something you want to do and frustration because you do not have control over the inconvenient interruptions in your life or daily routine. Things can be a definite annoyance especially when things are out of your hands and they are no longer pleasant or enjoyable.
Crankiness may be born out of rebellion because you are being forced to change, adapt, tolerate and accept less than an ideal situation. Do not let crankiness escalate into anger because something has been taken away from you. And you feel that you will no longer be able to do what you like, or want or what you are used to, because of these outside changes to your routine or life. The most important thing you can do is to tell others. Announce your mood. Warn your loved ones, family and friends, coworkers and boss. Let them know that it is not them, it is you. Tell them when you feel cranky. Talk to yourself, “What is really bothering me?” “What can I do about it?” Keep it in perspective. It is OK to accept sympathy. It can be very helpful to have others agree with you and commiserate with you. Remember that these feelings will pass eventually. Let it go. Redirect your thoughts onto something else pleasant and unrelated. Do something fun to change your mood. Patricia Frank is a Licensed Psychotherapist. Lincoln, Simon Wolf and the Jewish deserter
Bob Diamond HISTORICALLY YOURS Jews throughout the world revere Abraham Lincoln as a hero of unsurpassed distinction. In fact, a street in Jerusalem is named after him. Several of Lincoln’s close friends and supporters during the Civil War were Jewish, including Simon Wolf. According to historians David G. Dalin and Alfred J. Kolatch, Lincoln’s association with Wolfe was widely publicized after an incident that occurred during the Civil War involving a young Jewish soldier who was accused of desertion and was to be shot the following day. Simon went to see Lincoln to plead for the life of the soldier. Simon advised that the soldier was not a deserter, but had simply left the camp without permission “to see his dying mother.” Lincoln advised that he could do nothing to help the young soldier because Secretary of War Stanton threatened to
resign if I pardoned another deserter. Simon then appealed to Lincoln’s compassionate nature: “What would you have done in the boy’s place? If your dying mother had summoned you to her bedside to receive her last message before her soul would be summoned to its Maker, would you have rather have been a deserter to her who gave you birth or a deserter in law but not in fact, to the flag to which you had sworn allegiance? Simon had reached into Lincoln’s heart, as the president was devoted to his beloved mother who died when he was a youngster and the stepmother who thereafter raised him. After Lincoln’s election and prior to his trip to Washington, he went back to Kentucky to visit to his aging stepmother, who said of him that he was the finest boy she had ever met. Lincoln reflected on Simon’s words, called in his secretary and “ordered that a telegram be sent to halt the execution.” The soldier soon returned to his regiment and in the 1864 battle of Cold Harbor was killed while leading a charge with an American flag held aloft in his hand. When the president learned of the soldier’s heroism, he said: ‘I thank God for having done the right thing.’”

What to do when your Insurance Company is not on your side

So, they had a catchy slogan that made you expect that when disaster struck they would be neighborly, or stand beside you, or take everything into their good, capable hands. But now that you need them to defend or pay your claim, does it feel like your good neighbor has packed up and left the barrio? Know that Florida has tough laws to protect consumers against insurance company misconduct like refusing to defend you when you make a claim; unreasonably delaying the payment of your claim or improperly dropping your coverage without reason or warning. Also know that insurance companies don’t want you to know that you have these protections. So here’s what they’re not telling you: For most types of insurance claims insurance companies are required to pay you interest if your claim payment is more than 30 to 60 days overdue. If your claim payment was unreasonably delayed, check that interest was also paid.
If a claim is made against you, immediately notify your insurance company to accept and defend the claim. If they refuse to defend the claim or ignore it, know that they may have to pay your attorney’s fees if you hire a lawyer to challenge them. If your claim is denied, delayed or underpaid, have a lawyer look at it – FOR FREE. Most lawyers handling insurance cases will work on a percentage of what they recover and don’t charge any upfront fees or retainer. Better yet, in many cases the insurance company may be have to pay your attorney’s fees ON TOP OF YOUR recovery, meaning the lawyer charges you nothing. A good attorney will know what to look for and will generally look for free – so ask! The important thing to remember is you don’t have to stand there and take “nobody’s home” for an answer. Although natural gas pipeline incidents are uncommon, these tips will help you identify a possible leak and know what to do.
Carbon Monoxide
LISTEN for a hissing or roaring sound near a natural gas appliance or line.
Incomplete combustion of any fuel – produces carbon monoxide. Carbon monoxide is poisonous and has no odor, taste or color. Carbon monoxide detectors are helpful, but they are no substitute for using equipment safely. This includes having it inspected once a year by a certified contractor.
Appliance Safety According to the Federal Emergency Management Agency: • It’s important that you have your furnace inspected by a qualified specialist. • Be sure all furnace controls and emergency shutoffs are in proper working condition. • Keep trash and other combustible material away from your air heating and water heating systems.
LOOK for blowing dirt or continued bubbling of standing water.
SMELL for the distinctive rotten-egg scent of natural gas. Take action if you detect even a small amount of this odor. LEAVE the area IMMEDIATELY if you detect a natural gas leak. Don’t try to identify the source or stop the leak. CALL Florida City Gas at 888.352.5325 or 911 once you are safely away from the possible leak site. Stay away from the area until a Florida City Gas representative or emergency personnel indicate it is safe to return. REMEMBER while near a possible natural gas leak, do not touch or use anything that may cause a spark. This includes lighters, matches, cigarettes, flashlights, light switches and telephones. Family Fun Series returns to Aventura Arts & Cultural Center Offering a complete family outing, the Broward Center Family Fun Series presented by Whole Foods Market returns to the Aventura Arts & Cultural Center. The weekend performances at 11 a.m. and 1 p.m. feature free pre-show arts and crafts with Young At Art Museum as well as face painting. The series continues on November 16 with The Very Hungry Caterpillar, a collection of three Eric Cale stories in a production which the Los Angeles Times called "a quiet delight... brought to memorable life." The series takes flight with Peter Pan on January 25 in a touring production adaptation of J.M. Barrie's classic tale created by Broadway and London directors John Caird and Trevor Nunn. tury London, children use their imaginations to reenact the story of Peter Pan in Neverland and escape the evil Captain Hook while learning the importance of friendship and the value of family. Two lost children find adventure when they must escape a wicked witch in a haunted forest in the series conclusion. Stages Productions’ thrilling musical Hansel and Gretel, based on Englebert Humperdinck's opera, is performed on April 27. Tickets to each production are $15 and $17 the day of the show. You’ll want to go back again and again to Port of Call BY LEVI MEYER
My wife Lauren and I like to think of ourselves as “foodies” and when we stumble upon an incredible dining experience, we like to share it with the world. If you haven’t already heard, Chef Ben Huselton, who was awarded 2013 “Best Chef America,” has joined together with one of New York’s most famous sushi artists, Kevin Z, to open a new restaurant in The Village at Gulfstream Park. Port of Call: Modern American Cuisine, better known as POC, is a fusion restaurant that brings together modern American cuisine and exquisite sushi creations, with a fun tapas style theme. Feeling adventurous, we left our dining fate up to our server and played a game of Culinary Roulette. She asked a few questions about preference and allergies and proceeded to hand select some personal favorites from the menu. Admittedly, I am not too adventurous when it comes to my drink, so I ordered single malt, of which they had a vast collection from which to choose. My wife, less picky in this subject, had the bartender whip up a fruity concoction in a martini glass, and all was well in the world. After a few sips and a little conversation, the food began to arrive and the presentation was show stopping.
Our server brought us two soups – one of them was a cold tomato gazpacho, split down the middle with red and yellow tomato to form a Ying Yang shape in the bowl. The lobster bisque, presented in an incredibly unique fashion, was served with the lobster alone in an empty bowl and the bisque was poured over the top at your table (whoa!). For appetizers, we were served a Watermelon Asparagus & Mozzarella Salad and Foie Gras on a bed of Jameson flavored Shredded Pear. The salad was artfully displayed and very refreshing, while the Foie Gras was surprisingly salty sweet. We were sufficiently teased and eager to see what was in store for our main course. Queue the Glazed Beef Short Ribs with Whipped Carrots! Having my best table manners in mind, I reached for my fork and knife, only to discover that a knife would not be necessary. The meat was so tender you could have pulled it apart with a spoon! Definitely among the top five short ribs I’ve ever had. Needless to say, manners went out the window as I cleaned the plate with my bread. I was so engulfed with my short ribs, that I barely stopped to make note of my wife’s gorgeous sushi platter that was so well presented that it could have (and probably has) won an award. We were stuffed, but decided to wait
around long enough to let our food settle so we could see what dessert masterpieces were in store for us. What? You didn’t think we would skip dessert, did you? I could go on and on describing dessert, but instead, you will just have to trust me when I tell you to order the Deconstructed Carrot Cake with Cream Cheese Ice Cream and Spicy Pecans. You might also want to get the homemade Mango, Watermelon and Mojito sorbet assortment. As we waddled to the car, we were already planning our next visits (yes, visits – plural). We want to make sure we go for POC’s $21 weekend brunch as well as the weekday “order guaranteed in 15 minutes” lunch. We look forward to going back and we encourage everyone to go check it out. LET’S TALK CARS The all-new 2013 RAV4 is the fourth-generation of Toyota’s popular crossover utility vehicle. The new design features a sleeksloping roofline, an aggressive character line, sculpted front and rear fenders and boldly proportioned taillights. The new interior has a premium, sophisticated look with softtouch accents and driver-centric controls. In a break with its heritage, RAV4 switched from its side-hinged rear door to a convenient roof-hinged liftgate, with a spacesaver spare tire stored beneath the cargo floor. Standard on the Limited grade is a onetouch power rear liftgate with driver-selectable memory height settings. There’s tworow seating for five and a host of available in-cabin technologies. RAV4 offers a balance of performance and all-around capability, including excellent cargo capacity, striking design, eight standard airbags and a broad array of standard features. It’s available in three grades — LE,
XLE and Limited. For power, there’s a fuel-efficient fourcylinder engine mated to a new six-speed transmission. There are several powertrain technologies, including a 2.5-liter four-cylinder that produces 176 hp at 6,000 rpm and 172 pounds-feet of torque at 4,100 rpm. The optional V-6 of the previous-generation RAV4 has been discontinued. A six-speed transmission with Sequential Shift replaces the previous four-speed automatic. First and second gear ratios have been optimized for aroundtown performance. To keep engine revs lower at highway speeds and enhance fuel mileage, fifth and sixth gears are overdrives. RAV4 front-wheel-drive models have an EPA-rated fuel efficiency of 24/31 mpg, while all-wheel-drive models get 22/29 mpg. A new Eco mode is designed to promote more efficient driving and enhance fuel efficiency. The new RAV4 also delivers a more dynamic drive, with new technologies like a Sport Mode with Dynamic Torque Control AWD, enhancements in suspension performance and optimized electric power steering. The spring rates have been enhanced and the shock absorbers have been optimally tuned to enhance handling characteristics. RAV4 has a MacPherson strut front suspension, double-wishbone rear suspension and four-

wheel disc brakes. The LE rides on 17-inch steel wheels, XLE on 17-inch alloys and the Limited on 18-inch alloys. In both front- and all-wheel drive RAV4’s Sport Mode sharpens shift timing, throttle response and steering response. When downshifting the RAV4 six-speed automatic transmission in “S” Mode, engine revs rise with a clearly audible “blip,” adding to the driving experience. In the RAV4 with AWD, Dynamic Torque Control AWD has additional benefits. When turning into and through a corner, power is
sent to the rear wheels to help enhance cornering performance, detecting steering angle and lack of yaw rate in Sport Mode (and detecting lack of yaw rate in Normal and Eco Mode).
