Hard Rock Café Hollywood hosts food drive for ‘Big Mama’ with Aventura Marketing Council members

“I

magine there’s no hunger”... John Lennon’s haunting theme song about hunger and poverty around the world is just as relevant today as it was in the 60s when Lennon wrote the song, Imagine,” that became an international anthem. Lennon, legendary British pop star of The Beatles, died in 1980, but his wife Yoko Ono Lennon carries on his mission. Hard Rock Café International partnered with Yoko Ono Lennon and WHY (World Hunger Year), an organization dedicated to fighting childhood hunger and poverty worldwide, and Hard Rock Café Hollywood instills that mission in their team members and guests. At a recent breakfast sponsored by the Hard Rock Café Hollywood for the Aventura Marketing Council (AMC), members each brought in four Thanksgiving canned good items to help “Big Mama” and “Team of Life.” Big Mama, also known as Essie Reed, has one goal— to help feed the hungry in her Fort Lauderdale neighborhood (For more information visit bigmamahelp.com). Trust and Trusting

Patricia C. Frank FRANKLY SPEAKING Trust is a firm belief in the reliability, truth and strength of a deity, person or thing. When you trust in someone or something you have faith in them and you believe in them. You rely on them and depend on them. You have confidence and hope that what is inferred or promised will take place. It can be very painful and sometimes devastating when someone or something you trusted betrays that trust. You are most vulnerable in your relationship with your God and your religion. That is the ultimate challenge. You have to trust that everything you believe in is valid. The next challenge to trust is in your relationships. Your spouses, partners or family can break the faith and destroy your trust. A friend can also have a destructive impact on your trust. There was a clever sign in a retail

store years ago. It said, “In God we trust. All other’s pay cash.” This captures the commercial and monetary aspect of trust. Most business transactions are dependent on trust. They trust that you will be honorable and pay for your purchases and services. Some people have been disappointed so many times that at some point they can no longer trust anyone or anything. If a child learns that they cannot depend on their parents or caregiver they will stop trusting altogether. This will carry over into all of their relationships. It is possible to jinx a good relationship because you do not trust the other person or partner. In order to experience the best of life it is necessary to learn to trust. It usually requires a change in your thoughts and feelings. There are some exercises you can begin with. You can fall back into someone’s arms trusting that they will catch you. You will not get hurt. You can float in the water trusting that the water will hold you up and support you. You will not drown. Be someone that is trustworthy yourself. Patricia Frank is a Licensed Psychotherapist. She can be reached at 305-788-4864, 212-308-0309.

‘Gift Giving’

Bari Auerbach LIFE IN THE CITY This holiday season, what do you get for “the city that has everything?” If you were going to make a gift list for Aventura, it might feature some very special attributes like these: *The Gift of Patience – So what if Biscayne Boulevard’s backed up with traffic? If more people had the patience of a saint – like Nick – maybe there wouldn’t be as many horns blaring and road rage tempers flaring. But I bet even the “jolly old soul” wouldn’t be smiling if someone stole the parking spot he’d been patiently waiting for while people loaded packages, strollers and a few pets into a huge SUV that took forever to pull out! *The Gift of Grace – Can you imagine if the Aventura Police Department declared a “grace period” for giving out tickets so everyone who got pulled over between

now and the New Year would be exempt from a citation? That would mean all those people who always speed, run red lights, roll through stop signs and text while eating a burger could continue on their merry way! *The Gift of Willpower – People will soon be making New Year’s resolutions many based on the desire to lose weight. Wouldn’t it be great if the gift of willpower was bestowed upon the entire city so at restaurants you’d hear a resounding “NO!” to the question, “Would anyone like some dessert?” But if you’re planning to give the “gift of fitness,” make sure the recipient won’t be offended if you get them a membership to a gym or diet center! *The Gift of Unity – The old saying “every man for himself” is becoming an antiquated notion as Aventura fosters community unity with sports leagues, Founders Day celebrations and many more family-oriented activities. So since “we’re all in this together,” remember to be extra nice to your neighbors – but if you don’t feel like getting them all holiday presents that’s OK since the greatest gift everyone already shares is an Aventura address!

Aventura Hospital and Medical Center receives designation as Comprehensive Stroke Center Aventura Hospital and Medical Center has received designation as a Comprehensive Stroke Center from the Florida Agency for Health Care Administration (AHCA), joining an elite group of healthcare facilities statewide that provide lifesaving stroke care. Aventura Hospital is one of only three centers in Miami-Dade County with this designation, which nationally recognizes the hospital for providing the highest quality care for patients diagnosed with stroke. “This distinction validates the excellence in care that our team of physicians, nurses and staff consistently provide to our patients and I am thrilled that we have been named a Comprehensive Stroke Center,” said Heather J. Rohan, chief executive officer at Aventura Hospital and Medical Center. “We are proud to offer our community with resources to achieve better outcomes after a stroke.” The stroke intervention team at Aventura Hospital routinely meet and surpass the principles for stroke care by: • exceeding the national average of 90 minutes for patients receive treatment from their arrival at the Emergency Department; • working with a neuro-interventionist to assist in identifying key symptoms, diagnosing patients and quickly assessing treatment options to improve patient outcomes;

Electric vehicles could be stalled by more paperwork

Al Sunshine CBS MONEY WATCH With electric vehicles increasing in popularity, some might wonder if gaspowered cars eventually will become a thing of the past. With gas coming at such a high cost, many people are looking for an alternative to having to pay at the pump. Get ready to see fewer gas stations and more electric re-charging stations in the not too distant future as more and more electric cars start popping up on local streets and flying down the highways. The latest all-electric cars share one thing in common — they need to be recharged. And that can take as long as 20 hours or more using common household electrical current. That’s why public, high-voltage charging stations are starting to pop up all over the country. With major plans being put in place for Miami-Dade County, everyone agrees that new electrical charging stations definitely are needed. It also turns out that South Florida just was awarded $500,000 by Uncle Sam, a grant intended to initiate a new grid of public chargers. However, the $500,000 grant isn’t designated for any stations that actually will be built. Those funds are only to pay for the planning process for the stations. Owners of the new electric cars would be able to plug into public charging stations around South Florida — when they

are available — but insiders say that it could still take years. Broward County Commissioner Suzanne Gunzburger, who chairs the South Florida Regional Planning Council, agrees with that assessment. “It may take up to three years to see electric charging stations in South Florida,” she said. “If you were wondering where the money for the electric charging stations would be coming from, don’t look any farther. You and I and everyone else will be paying for it.” Some $350 million dollars in federal funding already is committed to building more than 20,000 charging stations in other parts of the country, but those construction dollars have yet to arrive in Miami-Dade County. In the meantime, some private companies are spending their own money to install chargers for their customers. The brand new units at the Aventura Mall are just one example. Still, there are those who believe an investment in new charging stations is like sinking money into a black hole. Others think that the money can be recouped, and that it’s a good investment for the state. It may not be until early next year before the $500,000 electric car study is complete. For now, there is no plan as to where public chargers will be built around South Florida, or ultimately, who’s going to pay for them. Watch Al Sunshine’s “Money Watch” reports Monday-Friday beginning at noon. You may find Al’s blog at cbs4.com/4yourmoney.

Why a Short Sale is Better than Foreclosure If you are one of the unlucky ones underwater on your home and are behind on your mortgage payments, you do have options! Foreclosure is not the only choice, nor is it the best. In many cases, a Short Sale will

ON REAL ESTATE

work better for you and your lender. It is important to understand the effects of losing your home to a foreclosure or selling it through a short sale. There are stark differences to how your credit, your borrowing

capability, and your general outlook on the future will be affected by your decision. Below is a table to help break down the difference of how a foreclosure and a short sale will affect you.

ISSUE

FORECLOSURE

SUCCESSFUL SHORT SALE

Credit Score & History

Foreclosures can affect your credit score by lowering it 175 to 300 points for up to 7 to 10 years.

Future Home Purchase (Primary Residence – Fannie Mae Loan)

Per Fannie Mae, individuals losing a home to foreclosure will not be eligible for a Fannie Mae loan for a time period of 5 years.

Not public records. Shows Late payments - Mortgage “settled for less than full amount due. Credit score may only be affected by 50 to 100 points. Per Fannie Mae, if an individual completes a short sale they will be able to purchase a home after 2 years (depending on credit score).

Future Loan with any Mortgage Company

Borrower will have to answer YES to the question “have you had property foreclosed upon or given title or deed in lieu thereof in the last 7 years? Final sales price is usually lower than in a short sale. If lender has deficiency rights, this can result in a higher amount that they will be able to pursue.

Amount of the Deficiency Judgment

There is no question related to short sales currently on a loan application.

The sales price in a short sale is typically higher potentially resulting in a smaller deficiency judgment, and possible waiver of deficiency.

Future Employment

Could impact employment opportunities.

Shows employer that the future employee worked with the lender towards a resolution.

Security Clearances

Foreclosure can be a challenging issue against a security clearance.

A short sale by itself does not challenge most security clearances.

Chevrolet Sonic: Made in America on global platform Ron Beasley LET’S TALK CARS The 2012 Chevrolet Sonic is quite a nice little subcompact. It’s built on the new General Motors global platform and comes in the form of a sedan or a hatchback. Both models of the new Sonic look good, with sleek styling and an urban design aimed at appealing to upscale younger American consumers. Our test car was the sedan, but I got a look at the five-door hatchback at the recent South Florida International Auto Show and I found it equally appealing, if not more so. Both versions of the Sonic have distinctive design elements, including sharp creases, exposed headlights and other design cues that seem like they belong on a motorcycle (and that’s what they were derived from). Other nice features include excellent fit and finish and standard forged alloy wheels. Three trim levels are offered — LS, LT and LTZ — and standard equipment

includes cloth upholstery, manually adjustable seats, trip computer, a tilt/telescoping steering wheel, air conditioning, 60/40 split folding rear seat, OnStar, a fourspeaker AM/FM stereo system with auxiliary jack, a roof spoiler, front floor mats, remote keyless entry, power door locks and 15-inch forged alloy wheels. Hatchbacks come standard with rear washer and wiper. Under the hood, Sonic offers an option of two four-cylinder 138 hp engines — a 1.8 liter naturally aspirated powerplant or a peppy little 1.4 liter turbocharged engine. The standard engine can be mated to either a six-speed automatic or a five-speed manual transmission, while the turbo is offered only with a six-speed manual gearbox (an automatic transmission option is planned for late 2012 models). On the highway, the new Sonic yields a quiet ride and handles quite nicely. I wouldn’t call it sporty, but it does have a stiff body and pretty good power for a subcompact. Chevy literature notes that Corvette engineers assisted in tuning the MacPherson strut front and torsion beam rear suspension, which probably accounts for the responsive handling characteristics. As for safety, the Sonic has antilock brakes (ABS), electronic brake force distri-

‘Chow Down’ on Chinese at the Chow Down Grill...

Shari Lynn Rothstein-Kramer

EAT THIS... DRINK THAT Growing up Jewish on Long Island, New York meant a few things to me: Youth group every Wednesday evening, saying the Chanukah prayer before receiving a present each day for eight days in a row during the holidays, and eating Chinese food. Lots of Chinese food. We’d call in for takeout every Sunday evening (without fail), on Christmas Day, for “Easter” dinner (no, Honey baked ham was not an option), on mom’s “Mahjong” nights, and whenever my dad had the craving - which was almost always. We’d hop in the car and drive to Hau Po, our neighborhood place, and stuff ourselves full of house-made shrimp chips while waiting for our order. In the car, we’d break open the noodles or eat an eggroll. And then, once we were finally home, we’d unload the bags: little sauce packets and white containers littered the table. From soup and ribs to all the main dishes we could eat - by the end of dinner, we’d be stuffed and sleepy, feeling a bit gross but satisfied. I moved to South Florida in 2000, and it took me until now to find a classic Chinese food restaurant I could call “great”. The place is called Chow Down Grill. And don’t let the name fool you. While it would seem to have nothing to do with Chinese food, it was named for the Chinese who ran “mess halls” in Miami and officers would tell the men to go “Chow Down”… But let’s talk about the food. Chef Joshua Marcus (formerly of China Grill and BLT Steak) makes everything from scratch – from the sauces including mustard, soy, duck, and peanut sauces to the tofu, which is firm and offers a solid consistency, and soaks up the flavor of any of the beautiful sauces in which it’s placed. (Chef uses tofu in many dishes, making Chow Down an amazing place for vegetarians to dine). The Menu offers so much good food –starters such as organic chicken wings, fried shrimp wontons in peanut sauce, scallion and herb pancakes and egg rolls (with pork or ground chicken and shrimp) really whet your appetite for more. The soups, which include the best hot and sour I’ve ever tasted, look standard when seen on the menu, but once you eat them, you taste the difference. Main dishes are abundant; beautiful proteins and wonderful sauces – that come together with veggies, in a variety of combinations. The sauces include Mongolian BBQ, Spicy Szechuan Sweet and Sour, Garlic-herb, Orange Chili, Spicy Green Curry, Black Bean, and more. Since everything is made from scratch (Chef Josh says that there are no shortcuts), you can really taste the difference. Where all too often, Chinese food is heavy

and leaves you feeling full and “nasty”, the food at Chow Down contains no MSG, no preservatives, and nothing artificial – just fresh, top-quality ingredients that are prepared to order and are always fresh. There are so many choices that it’s almost impossible to choose. Fortunately, an abundance of “little plates” and super reasonable prices enable guests to sample a variety of dishes without breaking their wallets. There are numerous ways chef prepares dishes – grilled, smoked, roasted, steamed, braised, and sautéed; each one a subtle reminder of how skilled he is. With so much “goodness” under one roof, it’s difficult to pinpoint what is “the best”, but if I had to narrow it down, I’d begin with the dumplings, which are one of the restaurants stars. All made daily onpremise, the five dumpling varieties include vegetable with soy beans in a beet wrapper; pork and chive in carrot wrappers; organic chicken in basil wrappers; beef in porcini mushroom wrappers; and shrimp, fennel and corn in squid ink wrappers. Hello, deliciousness. One is better than the next. Pho, a Vietnamese soup is a staple in many places. At CDG, the hearty bowl of noodles comes with beef broth, fresh herbs, red onion, jalapeño, and a protein. It is the type of meal that is so tasty, you want to slurp directly from the bowl and once you hit bottom, lick the sides so you don’t miss one drop. And finally, Bahn Mi, a sandwich that is served up “everywhere that’s anywhere” in the nation, but is severely neglected locally, is enough to get me to eat there every day. For just $8.95, you get a baguette stuffed with the protein of your choice (such as 24-hour braised beef, 5-spice roast pork, roasted organic chicken, and for the vegetarian s in the bunch, a Tofu and wild mushroom combo), cilantro, pickled carrot, cucumber, radish, jalapeño, and red onion. The under-eaten and under-appreciated dish is so delish I can’t even put it in words. To complete the picture, a “sauce holder” - a wooden block that has six little holes hollowed out to hold six little squirt bottles, each filled with unique house-made sauces - is delivered to the table. Peanut, hoisin, soy, duck, and mustard, sit quietly, awaiting their turn to enhance a specific dumpling or dish. It’s heavenly. There are noodles dishes (the Chow Fun is killer), salads, duck, lamb…I could go on all day, but I won’t. I will end this by saying, “Get to Chow Down Grill and try it for yourselves. You won’t be sorry.” The original location opened in Surfside more than a year ago; the second location on 9th and Alton on Miami Beach, opened its doors this past August. No matter which you choose, you are in for a treat! Shari Lynn Rothstein has been writing about food, wine, lifestyles and fashion for more than 20 years, in New York and Florida. A great gift for the holidays: Alternative Home Health Care College 15 Years of Caring With the holiday season here, one of the best decisions a shopper can make, is to stay home and invest their spending money into a 529 College Savings Plan. There are lots of ways to save for college, but most do not offer greater tax benefits than the 529 savings plans. Earnings on your investments grow tax free and withdrawals are not taxed, as long as the money is used for qualified higher education expenses. Anyone including parents, grandparents, aunts and uncles, can contribute to a child’s 529 savings plan. In addition, the plan is interchangeable, so if the beneficiary decides not to attend college or receives a full scholarship, another beneficiary can be put in their place, no age limit required. Saving for college has never been more important. Federal and State budget deficits can lead to cuts in traditional sources of financial aid, which means there’s a good chance there won’t be as much available when your child goes to college. Meanwhile, tuition continues to increase much faster than the rate of inflation. According to a recent report by the College Board, tuition and fees at public colleges and

Fast start your 2012 BY PETE DE LA TORRE The beginning of the New Year is always filled with great anticipation, hope and determination. We typically begin fired up and are ready to conquer the world. We tell ourselves this will be the year I will “finally” reach my goals. Sadly though, by January 31st, we revert back to our old ways of not doing the things we need to do to be successful and again frustration sets in. The good news is that this doesn’t have to happen. 2012 can be the turning point for you as long as you get off to a fast start. January 1st is known as the great equalizer. Everyone starts at zero. You have a golden opportunity to accomplish feats you’ve never reached before. Your responsibility is to set realistic goals and develop the actions plans necessary to implement immediately. The best favor you can do yourself is to share your goals and objectives with a trusted friend, advisor, mentor, etc. and ask them to hold you accountable for the implementation and follow-up you will need. Here’s a thought; Why not shorten your year to 3 months as oppose to 12 months. Create a sense of urgency in your day to day, hour to hour activities. What you’ll find is that you won’t have any time to waste. Once you’ve accomplished the goal, make sure to reward yourself. Along the way, it’s also important that you acknowledge the small victories achieved on the path to the bigger prize. This will keep you motivated. As you move forward, I suggest you

follow a process that will serve as a blueprint to accomplishing all the goals you’ve set for yourself next year and here it is: 1. Decide exactly what you want in every key area of your life 2. Write it down 3. Set a deadline 4. Identify the obstacles that you will have to overcome to achieve your goal 5. Identify the knowledge, information and skills you will need to achieve your goal 6. Identify the people whose help and cooperation you will require to achieve your goal. 7. Make a list of everything you will have to do to achieve your goal 8. Organize your list in to a plan. You organize this list by arranging the steps that you have identified by sequence and priority 9. Make a plan. Organize your list into a series of steps from the beginning all the way through to the completion of your goal. 10. Select your number one, most important task for each day. 11. Develop the habit of self-discipline 12. Practice visualization on your goals 13. Decide upon your major definite purpose Decide exactly what you want, write it down, make a plan and work on it every single day. When all is said and done, you’ll have to look at yourself in the mirror and answer that one pressing question” Have I given it my best effort today? If the answer is yes, you’re definitely on your way to achieving everything you want but don’t wait, make sure you get yourself off to a fast start in 2012.

Snyder & Gonzalez: Getting ‘fair and just results’ for injured clients BY BARI AUERBACH

On a rainy Christmas morning, Ms. Perez was looking forward to celebrating the holiday – but instead, she slipped while going down the stairs at her condo, suffering a painful dislocated ankle and fractured leg. Adding insult to injury, Ms. Perez’s condo association denied accountability claiming that by posting a “slippery when wet” sign they had done their job to alert residents and guests about the danger. Fortunately for Ms. Perez, she was represented by Barry M. Snyder and Julio E. Muñoz, part of the expert legal team of Snyder & Gonzalez, renowned for helping injured clients get “fair and just results.” Attorney Barry Snyder argued, “You can’t create dangerous conditions for unit owners and then absolve yourself of any responsibility because you put up a sign. It was also the association’s responsibility to properly maintain non-skid strips on the steps – but since they didn’t, Ms. Perez wound up slipping on one of the steps where the strips had peeled off.”

After Ms. Perez’s fall on the steps, her dislocated ankle required surgery and she ultimately incurred medical expenses exceeding $50,000. When Snyder & Gonzalez took the case to court, the jury returned a verdict in her favor for $529,000 and held the condo association “100% at fault.” “This was a just and fair result,” Snyder said. “It speaks loudly and clearly to other condo associations: ‘You must take care of your property and be responsive to those you serve.’” Snyder & Gonzalez, P.A. is a renowned personal injury/criminal defense law firm with over 50 years of experience helping clients throughout Florida recover millions in settlements and judgments. “We are committed to prioritizing the needs of each and every client,” Snyder said. “We’ll return your phone calls personally and promptly and see you in the office, at home or in the hospital when you need us.” For information about Snyder & Gonzalez, P.A., located at 16211 Northeast 12th Avenue in North Miami Beach, phone: 305-919-9797 or visit snydergonzalez.com

Mount Sinai Medical Center welcomes back its tiniest patients BY JOANNA PALMER

On Friday, December 2nd, Mount Sinai Medical Center welcomed back more than 100 patients for its 16th annual Preemie Party. This year’s “Superhero” themed celebration reunited babies who defied the odds in the Mount Sinai Abess Level III Neonatal Intensive Care Unit (NICU), and their parents, with the doctors and nurses who cared for them. “This is probably one of the best days of the year for us,” said Tony Adams, M.D. chief of the NICU at Mount Sinai. “It is very humbling to see so many of these kids come back knowing that, without our help, many of them wouldn’t have made it 10 years ago.” Among the returning patients, who ranged in age from 9 months to 18 years, was Michael Tintori and his parents, Veronica and Sergio Tintori. Michael was born in the Mount Sinai NICU on August 24, 2010 after just 24 weeks in the womb, weighing a mere pound and a half. “He was very little and he went through a lot but he’s a little fighter, “said mother, Veronica Tintori. After six months of much needed care, Michael was able to go home on Valentine’s Day of 2011 - a Valentine’s Day present that his mother says was the best she will ever receive. “We are fully committed to taking care of all the babies in our NICU as we know it can be a very stressful time for the parents,” said Ignacio Zabaleta, M.D., a neonatologist at Mount Sinai. Today, Michael is a healthy and vibrant 11 month old, based on the date that he should have been born. Michael’s parents are so grateful for the care he received that they arranged for his baptism to take place at Mount Sinai and selected Dr. Zabaleta to be Michael’s godfather. “We are from Italy and we had no family here when we went through this with Michael. But now, we consider Dr.

Zabaleta and his team at Mount Sinai our family. They saved Michael’s life. It felt natural that he should be Michael’s godfather,” said Veronica Tintori. Nursery levels are regulated by the state, which requires that Level III NICUs provide the most advanced care and adhere to rigorous state requirements. critically ill newborns, coupled with high caliber maternity and neonatal services. Parents delivering at Mount Sinai can take comfort in knowing that the highest level of neonatal care is available onsite, should the need arise. Mount Sinai NICU’s neonatologists, Jose Antonio Adams, M.D., and Ignacio Zabaleta, M.D., have worked together for more than two decades, taking care of babies from birth to discharge and providing a level of continuity rare in larger NICUs. The Mount Sinai NICU also counts on an experienced nursing team that is committed to highquality care and excellent outcomes. The annual Mount Sinai Preemie Party is held every December, a symbolic time to reflect on the triumphs of these tiny “superheroes” and to remind everyone that, sometimes, the best gifts come in small packages.

‘Quest’ for the best protein bar BY BARI AUERBACH If you’d rather jump off a “Cliff” than eat a bar with 26 grams of sugar – or if it’s too hard to “Think Thin” when you’re bloated from a bar with 14 grams of sugar alcohols – it’s time to try “Quest” for the best tasting, convenient protein bars “designed for anyone who cares about good nutrition and a leaner body.” Quest Bars have 20 grams of protein, 0 grams of sugar and 0 grams of sugar alcohols…they’re also promoted as “the only truly low-carb bars made with real food ingredients” including natural peanut and almond butters, sea salt and Lo Han Guo -a natural herb used as a sweetener in China for over 1,000 years. Only a tiny amount is 300 times sweeter than sugar. Whey Protein Isolate and Milk Protein Isolate are also main ingredients in Quest Bars. Whey Protein Isolate, generally recognized as the best protein source available, has a dynamic amino acid profile that delivers highly usable protein to the body and has been shown to increase muscle mass, aid in the loss of body fat and enhance immune function. Milk Protein Isolate is another extremely high quality protein that is slowdigesting. Almost every ounce of carbohydrate in Quest Bars comes from IMO fiber, which keeps insulin levels low and curbs appetite. Fiber has been shown to help control hunger, improve digestive health and prevent certain diseases. IMO is a 100% natural fiber derived from plant sources very similar to the better known chicory root fiber. The two fiber sources are almost identical in taste, feel and texture but with one minor exception: IMO does not cause intestinal upset - even for people with very sensitive stomachs. Between 170 to 210 calories depending on the flavor, Quest Bars make for convenient on-the-go meal replacements that are especially good when heated in the microwave for a few seconds or left in the

car (think warm cookies). The available varieties include: Vanilla Almond Crunch, Peanut Butter Supreme, Mixed Berry Bliss, Chocolate Brownie, Apple Pie and Peanut Butter & Jelly. From fitness champions to busy parents and professionals, everyone on a Quest for the best protein bar agrees with these rave reviews: “I use Quest Bars all the time – even when I’m getting ready for a competition because they let me get in quality proteins without the carbs. I have them in my car, desk and purse so I am never in a position of being unable to get in a nutritious meal.” Shannan Yorton, national level figure competitor “Quest bars are the first of its kind and the most perfect bar ever produced. I encourage everyone to try them. They taste great!” Dave Palumbo, top ranked bodybuilder The Quest team is so confident their bars are the best, they’re letting people order a single bar ($2.39) to try without having to commit to buying an entire box of 12 bars ($24.99) – a six flavor sample pack box is also available. Quest Bars are only available online. For more information, visit questproteinbar.com or phone 888-212-0601

Redistricting: The voters, legislators and courts R. Kenneth Bluh KENNETH’S COMMENTARY Just two years ago thousands of registered voters took to the streets of Florida promoting Constitutional Amendments 5 and 6. Nos. 5 and 6 simply stated that congressional and legislative districts must be drawn or redrawn to be compact in size and shape and respect the state’s ethnic diversity without focusing on providing incumbent protection. The campaign successfully obtained a sufficient number of signatures to get the amendments on the ballot. Voters went to the polls and by a startlingly high percentage, 62.6 percent, said “yes” to the two amendments. Voters understood that once every 10 years all state legislatures are required to add or delete congressional districts, and adjust their boundaries, as the populations of the various states increased or decreased. Historically, what ever political party who was in control of the state legislature at that time redrew the district boundaries to favor

its party members making sure that there were sufficient votes in each district to reelect the incumbent legislator. Gerrymandering, in many cases, flaunted the logic of community identity, distorting boundaries in search of voters. Amendments 5 and 6 put down guidelines to eradicate, or at least limit, the gerrymandering of Florida districts. The Florida Legislature, currently controlled by Republicans, recognized that the amendments would damage the efforts to realign the district boundaries to protect Republicans currently in office. They went to work to destroy the Nos. 5 and 6. Federal law requires that any state law that affects the voting rights of the public must, before it can go into effect, be reviewed by the federal government to make sure that no voter is disenfranchised. Once approved by the voters then Florida Gov. Charlie Crist, a Republican, sent the two amendments to Washington for review. Days later the new Republican Gov. Rick Scott was sworn in and one of the first things he did was to pull the amendments back to Tallahassee saying he wanted to make sure that the state could implement the changes. Republican legislators, in opposition to the amendments, pledged $20 million to fight

the implementation of the now in place two constitutional amendments. Ironically, the Florida secretary of state and the attorney general are required to fight any lawsuits filed to set aside a Florida law. You and I, the taxpayers of the state of Florida will be funding, with our tax dollars, both the legislature’s efforts to destroy 5 and 6 and also the secretary of state and attorney general’s efforts to defend the laws. Rather diabolical. Last June, members of the legislature took to the streets conducting community meetings to describe the progress in redistricting and to hear the opinions of the voters. Unfortunately, they did not bring maps showing their proposed realignment of district boundaries. All they provided were their opinions and prognostications. The overwhelming number of voters cuing up to speak took turns ridiculing the legislators for bringing nothing but words to the table. It would certainly appear that the Republicans will not voluntarily back down. Also the League of Women Voters, the Democrat Party and other groups of interest will not give in so easily ether. The only answer? Like years past, the battle eventually will end up in court with a judge making the final decision on where the

VIEWPOINT boundaries will be drawn and if the intent of Amendments 5 and 6 will be honored. Who is paying for all this? You and I, the taxpayers, as usual. Legislators can fight any battle with impunity inasmuch as it is “our” dollars, not “theirs” that they are spending. The protection of their political party, both Republican and Democrat, seems to be the primary goal of our elected officials. The needs of the community and the voters who put them in office run a far distant second in the eyes of those in Tallahassee. Always remember we are the ones that elected them to office. In the long run, what they do is a reflection of the wishes of the majority of the voters

Community Association Beat BY MITCH DRIMMER

I am honored to have been asked to serve as a columnist for Community Newspapers to share important and topical information about South Florida community associations. My column will specifically address business issues related to condominium and homeowner associations (HOA). Running an association is a complicated and difficult task, often thrust upon well-meaning residents who have volunteered their time to take on the enormous responsibilities of board membership. I also believe that nonboard member owners should understand the issues involved because they may decide to run for the board of directors one day. Perhaps the most critical issue facing condos and HOA’s today is the delinquency rate among members paying their association maintenance fees, also known as assessments. Some people pay late, and some owners do not pay at all. Since condos and HOA’s are known as a zero dollar business (what they are budgeted to collect is the same as what they are budgeted to spend) it has caused either a reduction of services or even an increase in assessments. This unfairly affects the owners who have been responsibly paying fees and is a problem that should not be taken lightly. So what is a community association to do when an owner is paying late or does not pay at all? Usually, the first reaction is for the association’s board of directors or management company to send the file to an attorney. Now while that may seem to be the best idea, and at some point in the life

of a delinquent unit it may be necessary, it does not have to start that way. The first thing that a board of directors needs to do is to plan a meeting with only one item on the agenda: collections. In this meeting, all options should be put on the table and discussed. The goal of this meeting is to agree to follow the association’s “uniform collection policy,” or to establish such a policy if one does not exist. The single most important paper in the room for this meeting is the governing documents of the association. Highlighted sections discuss how the bylaws address this issue. Every set of governing documents for all communities contemplate this issue and have parameters by which boards can deal with it. Such topics as when a payment is late, when it is past due, late interest, past due fees, and whether the association can file a lien for unpaid maintenance fees are usually included in the governing documents. The second most important documents are Florida State Statutes 718 (for condos) and 720 (for homeowner associations). A good understanding of these statutes along with a proper reading of the associations own governing documents will give a board direction in formulating a just and proper uniform collection policy. In my next column I will get down to the specific issues and present some possible policies that a condo or HOA may adopt to improve association cash flow. Mitch Drimmer is a licensed community association manager and the Vice President of Association Financial Services, a Miami finance, business process outsourcing, and accredited collection agency specializing in community associations.
