eadership” was the theme of an Aventura Marketing Council Chairman’s Roundtable luncheon hosted by Bnai Zion Foundation and Holistic Health Care Miami, featuring State Attorney Katherine Fernandez Rundle. The event highlighted successful leaders dedicated to diverse missions including humanitarianism, natural healing and crime fighting. AMC Chair Cliff Schulman of Weiss Serota, Helfman, joined by Bnai Zion southeast regional director Eileen Glastein; and Holistic Health Care Miami cofounders Maria Stellato and Adriana Perez welcomed business and community leaders

Daniella’s Journey Healing Through the Arts, at Joe DiMaggio Children’s Hospital welcomed dancers from Arts Ballet Theatre of Florida “Daniella’s Journey, Healing Through the Arts” is a child run program that provides art and performing arts activities for patients and their siblings at Joe DiMaggio Children’s Hospital in Hollywood, Florida. Sharon Rozencwaig a senior at Pine Crest School, Fort Lauderdale and a junior member of Arts Ballet Theatre of Florida, originally conceived the program as a way to give back to the community by sharing her passion for art and dance. Sharon shared her passion with Daniella Folleco, a classmate who was diagnosed with osteosarcoma in 2004, and passed away from treatment complications in 2007. Daniella’s Journey was established to carry on her name and to raise funds to build the atrium in her memory at the new Joe DiMaggio Children’s Hospital, in Hollywood, Florida. Upon the completion of the atrium in the

summer of 2011, Sharon and a group of Daniella’s friends committed themselves to lead an ongoing arts program every other Saturday, from 10:30 a.m. to 12 p.m., at Daniella’s Journey’s atrium. The Saturdays in between, from 3:30 to 4:30 p.m., other teens lead an interactive performing arts activity that include singing, dancing and acting to provide patients and siblings a way to heal through the arts. On special days, professional musicians, singers and dancers are invited to participate in the program. Arts Ballet Theatre of Florida, under the direction of Ballet Master Vladimir Issaev, recently performed excerpts of The Nutcracker for the children at Joe DiMaggio Children Hospital.

Silly Syllogisms to think about

Patricia C. Frank FRANKLY SPEAKING To think is to contemplate ponder and reason. It is to mull over and arrive at a conclusion. It has been humorously said, “That some people think that they are thinking when all they are doing is rearranging their prejudices.” To see clearly and to be able to follow the thread and chain of thought is very important. There are many types and styles of thinking. Some are more beneficial and accurate than others. A syllogism is an example of faulty and illogical thinking. It is circular thinking that comes to an erroneous conclusion. It is very tricky because it is a type of logic that draws inaccurate conclusions based on basic truths. It is a mental formulation in which you have a major premise, a minor premise and a conclusion based on the agreement or correlation between these two premises. An example would be Major

premise- Aristotle is a man. Minor premise – All men have facial hair. ConclusionAristotle has facial hair. Stated another way, Aristotle has facial hair. All men have facial hair. Therefore, Aristotle is a man. So, round and round it goes in ever expanding silly circles. It is not unusual for illogical thinking to masquerade as logical thinking. People do it every day and cannot see how illogical it is. It prevents you from having a meaningful or productive conversation with them. One technique that may reduce your frustration is to keep repeating the truly logical statement like a broken record. Some people may not be able to ever see the error in their thinking. They lack the intelligence and intellectual ability to follow the precise trend of thought. You may have to just give up on them. But, don’t give up on yourself. In your own life you may be prone to make the same syllogism mistakes in your thinking. Hopefully, you will become aware of it when you use it. Adams, Jefferson and Haiti

Bob Diamond HISTORICALLY YOURS Inspired by the immortal words of Thomas Jefferson in his Declaration of Independence that “All men are created equal,” Toussaint Louverture, Haiti’s founding father, began a slave insurrection against France in 1791 that was to last for 13 years. Toussaint asked President John Adams for aid for the same liberty that had been achieved by the United States. Adams, from Massachusetts, responded with mercantile trade, appointment of a Council General and sent the American navy to help provide seapower for Toussaint. On January 1, 1804, having defeated Napoleon’s troops, Haiti declared independence and sought American recognition. Jefferson, now president, faced a problem. Recognition of Haiti represented a possible insurrection by his own slaves and his neighbors. Historian Roger C. Kennedy states that Jefferson, “May have had theoretical objections to slavery, but he objected more strenuously to power in the hands of former slaves. Freedom, he knew, is conta-

gious. While Jefferson had some anxiety lest Napoleon re-colonize beyond Haiti, he did not relent in his efforts to ‘starve out the black republic.’” According to Kennedy, “Napoleon attempted to restore to Haiti a notoriously cruel system of servitude, a restoration to which Jefferson provided aid and comfort.” In March, 1804, Jefferson proposed to Britain that America join with the European powers in “an agreement not to allow the former (slaves) to have any form of navigation whatsoever or to furnish them with any arms or equipment.” Jefferson then deployed the U.S. navy to help the European powers restore slavery to Haiti and issued an American embargo on all trade with Haiti. Following Jefferson’s lead, many southern states passed laws forbidding immigration from Haiti. Printers were jailed for publishing the Haitian Declaration of Independence. In Jefferson’s home-state of Virginia, “the legislature required that blacks who were freed by their masters must leave the state within one year.” According to Kennedy, “Although slavery was never restored to the island, in economic isolation and virtually under blockade, it declined into poverty.” Every American president thereafter refused to recognize Haiti until Abraham Lincoln in 1862, despite the fact that in 1825 France granted recognition of Haiti.

LETS (not) TALK ABOUT SEX

A Brief History of the Loss of Consortium Claim BY JASON NEUFELD In Florida if you are injured due to the negligence of another, your spouse may have a claim for “loss of consortium.” But just because your spouse has a right to make that claim, does not mean he/she should do so (more on that later). Loss of consortium refers to the comfort, support, and services that the injured spouse is no longer able to provide to the non-injured spouse – e.g. household responsibilities and child-rearing responsibilities, (that noninjured spouse now has the added burden of handling); not being able to do the fun things you used to enjoy together but now cannot because of the injury; and of course, the loss of ability to engage in sex. Many of our clients who are able to make this claim emphatically desire us to do so under good intentions: “my spouse was injured because of someone else’s negligence, why not seek every dollar to which we are fairly and legally entited?” In theory, I agree. In an ideal world, you SHOULD get the value of everything that was violently ripped away from you after an injury caused by another. But as a litigation strategy, except under the most dire circumstances, we usually advise our clients to avoid making this claim. Before explaining why, a brief history of the consortium claim is in order: A long time ago, in England, a proclamation of the monarchy established that a man’s wife was his property. If you damage a man’s wife, you were deemed to have damaged the man. Just as if you were to have negligently injured a man’s cattle, he would be entitled to the diminished

value of that cattle (for not being able to provide its services, such as producing milk or tilling the land)… if you took away his wife’s ability to provide her services to him, that man would be entitled to the diminished value of his wife. Over the years, this law eventually evolved into the loss of consortium claim described above. Fast forward to just a few decades ago and you would find bad plaintiff’s attorneys abusing the loss of consortium law to place huge monetary values on the value of lost services and sex. Eventually, this claim became synonymous with “bad lawyers looking to abuse the system.” In addition, the defense uses this claim to not only ask the client many inappropriate and embarrassing questions, but also to try to paint them as someone looking to abuse the system. FOR BETTER OR FOR WORSE goes the most famous of wedding vows. The defense will inevitably dwell on this and argue (perhaps rightfully so in certain situations) that non-injured spouses are SUPPOSED to pick up the slack when their other is unable to perform their usual services. Isn’t that what marriage is all about? In addition, I do not represent Brad Pitt and Angelina Jolie; and so the average juror does not want to hear or think about my client having sex. The reality is – loss of consortium claims tend to draw attention away from the real value of the primary cause of action - the very reason we filed a law suit in the first place – which is to fairly compensate the one who endured significant and lasting pain and suffering due to the negligence of someone else.

The borrower prepares a detailed package of documents outlining the reasons for “Hardship� and the Short Sale request. If the bank accepts, the owner may be released from some or all the money owed, benefit from “Relocation Assistance� and the bank cuts its losses. The short sale can be done in as little as 90 days and the borrower's credit rating takes a way lesser hit than either Foreclosure, Deed in Lieu or Bankruptcy while not being destroyed. As you can see, it's not a total win/win situation; however, a Short Sale can make a bad situation way better for the homeowner

Hyundai Genesis gets new Tau V-8 engine option Ron Beasley AUTOMOTIVE EDITOR

LET’S TALK CARS Since its launch in 2008, the Hyundai Genesis sedan has captured honors from just about every automotive association in the country — including the Miami-based Southern Automotive Media Association — and it continues to draw rave reviews with the 2012 model. Hyundai engineers keep improving the beautifully styled car, this year adding new direct injection technology to the standard Lambda V-6 engine, a new eight-speed automatic transmission and enhanced chassis tuning. They have even added a new power option, a 5.0-liter direct injection Tau V-8 engine available on the 5.0 R-Spec model. The new Tau V-8 is the most powerful Hyundai engine ever, producing 429 hp at 6,400 rpm and 376 pounds-feet of torque at 5,000 rpm, and the cylinder bore was increased for a total displacement of 5.0 liters. At the same time, direct injection technology has been added to dramatically increase

power and torque, while reducing fuel consumption and emissions. Compression ratio has been increased from 10.4 to 11.5:1 for greater efficiency and output. The Tau also has a revised bedplate for improved block rigidity and less noise, as well as camshaft carriers and a roller timing chain to improve valvetrain stability. This new V-8 still offers all of the premium engine technology from the 4.6-liter V-8, including Dual Continuously Variable Valve Timing (D-CVVT), a tuned variable induction system, and low-friction diamond-like coatings (DLC) on piston skirts, rings and tappets. Even with these power increases, fuel economy is 16/25 mpg, almost matching the 4.6liter engine (17/26 mpg). The Tau 5.0-liter V-8 is mated to a new eight-speed transmission. This new Hyundaideveloped transmission adds two more ratios for better acceleration, shifting smoothness and efficiency over the old six-speed gearbox. All eight-speed transmissions include SHIFTRONIC manual shift capability and this new eight-speed transmission is the first offered by a non-luxury branded manufacturer. Hyundai engineers have made further refinements to the 3.8 and 4.6 model suspension damping calibrations. These pre-

cise adjustments minimize the compromises between handling precision and ride comfort. In addition, body roll control for the 3.8 model is enhanced with a larger rear stabilizer bar, while diameter increasing from 17 mm to 18 mm. Braking also is improved with rotor size on the 3.8 model increasing from 12.6 inches to 13 inches and the addition of higher performance four-piston brake calipers, and the 4.6 model front brake rotors increasing from 13 inches to 13.6 inches for better fade resistance. There is little change to the exterior; the

grille has been enhanced and the headlights have been redesigned with the addition of LED accents and daytime running lights, while the taillights have been redesigned and new dual asymmetrical exhaust tips are more cleanly integrated with the new bumper fascia. Pricing on the 2012 Hyundai Genesis ranges from $34,200 to $46,500.

PIP, Personal Injury Protection insurance coverage, (also known as no-fault insurance) has been required by Florida law for every driver since 1972. PIP benefits are paid by your own insurance company if you’re ever in an accident regardless of who was at fault. But now, due to fraudulent claims, there is a big push in Tallahassee to eliminate PIP – or at a minimum, strip hospitals and ER doctors of their right to collect millions in underpayments. Explaining why it’s imperative to protect PIP is of primary concern to attorney Russel Lazega and the expert legal team at Florida Insurance Advocates – the firm that writes the state’s main legal text on PIP; and represents over 350 medical facilities throughout Florida including ten hospitals. “PIP law changes could stop providers and insured patients from being quickly and justly compensated,” Lazega says. Currently, PIP insurers must pay up to $10,000 in medical expenses. If this stops happening, hospitals could stand to lose significant revenues – resulting in diminished levels of patient care. Another change in PIP law could cap legal fees, which could ultimately prevent disputed claims from ever making it to court. Recognizing that large medical providers

Putting ‘Santa on a diet’ BY BARI AUERBACH If you’d rather fit into a swimsuit than a Santa suit, here are some guilt-free treats that can help your diet survive the holiday season: Pseudo cinnamon bun: Mix 1/2 cup plain flavor oatmeal with 3/4 cup water; microwave for 60 seconds; mix in a packet of Splenda and sprinkle with cinnamon Protein pudding: Mix a large box of sugar-free Jello pudding with a cup of water blended with one scoop of protein powder; refrigerate until set Strawberry sundae: In a tall glass, alternate layers of Greek yogurt, sugar-free strawberry jam or fresh strawberries and crunchy high-fiber cereal flakes Pizza omelet: Top an egg white omelet with Pomi chopped tomatoes (available in a convenient pourable carton in the canned vegetable aisle); add your choice of vegetables and sprinkle with shredded low-fat mozzarella cheese Buttered popcorn: Use an air popper to eliminate oil and instead of melted butter, use an “I Can’t Believe It’s Not Butter” spray bottle Hot Chocolate: Try Swiss Miss “Sensible Sweets” diet Hot Chocolate mix with only 25 calories per serving topped with fat-free whipped cream or Cool Whip Holiday Hotcakes: Mix together 1/4 cup plain oatmeal, 3 egg whites, a scoop of protein powder and blueberries – a great antioxidant; then cook as you would regular pancakes. Zoo Miami celebrates new solar array donated by FPL Recently, FPL and Zoo Miami celebrated the unveiling of the first solar array installed on the Zoo grounds, located in the Amazon & Beyond exhibit on top of the trellis area in the main plaza. Part of FPL’s Next Generation Solar Education Station program, the solar array is a donation from Florida Power & Light Company and the result of a partnership with Zoo Miami and the Zoological Society of Florida to expand the zoo’s green initiatives. The Zoo Miami Next Generation Solar Education Station features operational solar panels, similar to those in service at FPL’s DeSoto Next Generation Energy Center in Arcadia, Fla. The array of photovoltaic panels converts sunlight directly into electricity, producing on average 617 kWh of energy a month, which represents significant savings to the Zoo’s energy costs. The solar array will also provide school groups and other visitors to the zoo with a hands-on tool to learn about renewable energy. “For the leaders of tomorrow, solar and other clean forms of renewable energy will be a major part of everyday life,” said Manny J. Rodriguez, regional director of external affairs for FPL. “In addition to providing real energy savings for the zoo, the solar array also serves as a science learning tool visitors can enjoy year-round.” “Zoo Miami is a leader in conservation and we

Citizens Interested in Arts (CIA) honors Sonia Tita Puopolo as 2012 Champion of The Arts and Tara Solomon as 2012 Champion of The Arts Honorary Chairperson Sonia Tita Puopolo lost her beloved mother on September 11, 2001. On that awful day, she sat two seats away from Mohammad Atta on American Flight 11. It was the first plane to hit the World Trade Center and the first symbol that evil had arrived. Sonia’s mother’s body was never found, but remains were discovered 11 months later. Sonia’s father's wish that he could once again hold the ring he had given his wife of 40 years was answered. The wedding band was recovered completely intact, still on her mother’s hand, under tons of rubble. It was a miracle. Everything about 2012’s Champion of the Arts Sonia Tita Puopolo’s story is a miracle. She took an event that would harden the strongest of hearts and used it to inspire others. Her book, Sonia’s Ring: 11 Ways to Heal Your Heart, was released in September 2010 and the Spanish-language version was launched September 2011.
