The Miami-Dade Park and Recreation Department, the Parks Foundation of Miami-Dade, and the University of Miami School of Architecture will host an urban planning workshop titled “People and Places: Building Our Public Realm— East/Central/South Miami-Dade County,� on Thursday, Oct. 8, 8 a.m.-1 p.m., at the University of Miami Bank United Center, Hurricane 100 Room, 1245 Dauer Dr. in Coral Gables The workshop, the second in a threepart series covering different regions within the county, will bring together key municipal and regional agencies from the cities of Coral Gables, Homestead, Miami, Miami Beach, North Bay Village, South Miami, West Miami, Village of Key Biscayne, Village of Palmetto Bay, Village of Pinecrest, and Town of Cutler Bay, to continue the dialogue aimed at forging mutually beneficial partnerships for the implementation of greenways and civic spaces that connect to the greenways, providing the user with a meaningful experience. Each participating municipality and agency has been requested to bring a significant current and/or future destination project such as that for a park, library, cultural, historic, natural, or commercial center, and street that can link to select greenways and trails that connect the eastern, central and southern regions of the county to form a framework for greater partnership, collaboration and social connectivity. The goal is to coordinate efforts, network and seek partnership opportunities to build a more beautiful, healthier, and economically vibrant community provid-

ing residents and visitors with more meaningful experiences and improving the quality of life in Miami-Dade County. Miami-Dade County Board of County Commissioners unanimously approved the county’s Park and Open Space System Master Plan (OSMP) on February 2008, which was developed by the County’s Park & Recreation Department. The OSMP vision for Miami-Dade County provides a roadmap to develop a more sustainable community by using a comprehensive and coordinated model park system as its engine. Great parks, public spaces, natural and cultural places, greenways, trails, and streets will connect to provide residents and visitors with the experience of a worldclass park system at their doorstep, much like the heralded modern redevelopment of cities like Seattle, Boston, Portland, Chicago and Chattanooga. An important element in the creation of a model park system is that a vision as ambitious as this one, cannot be accomplished by any one single agency, but rather by a team of leaders that partner together to integrate seamless and sustainable practices throughout the community. Many of the ideas, findings and partnerships from these workshops will be presented in the upcoming Great Park Summit of the Miami-Dade Park & Recreation Department, scheduled for Mar. 5, 2010, at Fairchild Tropical Botanic Gardens. The third and final workshop, scheduled at FIU on Oct. 14, will cover the western portion of Miami-Dade County. Celebration marks topping off Coral Gables Museum Gloria Burns GLORIA’S GAB Coral Gables Museum recently celebrated a ceremony topping off the new annex honoring Rober t Fewell. Fewell’s contribution provided critical funding for the new building upon which was placed a grapefruit tree during the reception. Coral Gables Museum board chair George Kakouris ; Steven Klindt, the museum’s first executive director, and a host of other donors and city officials attended. Included was Commissioner Chip W ithers, who spearheaded this project from its incubation with the Coral Gables Community Foundation more than 10 years ago. The Junior Orange Bowl Committee geared up for a busy season with a meeting at Restaurant St. Michel recently and then a big presentation at the monthly meeting of the Coral Gables Chamber of Commerce. As one of the sponsors for the chamber breakfast at the Biltmore Hotel, the JOBC was given time to speak and gave JOBC president Mar ti Bueso an opportunity to premiere JOBC’s new promotional video that highlights the many festival events and their huge economic impact on the South Florida community. At that same chamber meeting, Gables Mayor Don Slesnick, a past JOBC president, gave his State of the City address GFWC Coral Gables Woman’s Club’s (CGWC) recent Bunko Night fundraiser raised almost $400 for Heifer International. The event was organized by Barbara Lapsley. Club president Pam Schaefer made the spaghetti sauce for all while other members brought salad and

desserts. Mayra Dominguez got KP duty cooking pasta. Molly Adams was surprised with a cake that evening to celebrate her 80th birthday. The club’s recent indoor garage sale also brought in some much needed funding for the club’s May Van Sickle Children’s Dental Clinic, which provides more than $160,000 in free dental care annually to disadvantaged children. Organized by Susie Tilson, it served as a great way to meet new friends including Mor ris Zucker man who attended with his son, Dan. Morris, a 24-year Air Force veteran with a Distinguished Flying Cross who recently celebrated his 100th birthday, was treated to pastries by Claire Frances Whitehurst. He posed for a photo with members including Mrs. American Image National,, Mireya Kilmon. CGWC is also partnering with Young Stovall & Company and Turnberry Bank for an upcoming Wine Tasting & Food Celebration to benefit the Safespace Foundation Endowment Fund on Friday, Oct. 9, 6:30-9 p.m., at 1001 E. Ponce de Leon Blvd. in Coral Gables. Tickets are $75 per person. To RSVP, call Carol Nobles at 305-661-5227. The Safespace Foundation is a non-profit 501(c)(3) organization committed to the advocacy and empowerment of domestic violence victims and survivors through the collaboration and support of the Miami-Dade County agencies and other entities that provide emergency shelter, transitional housing and financial assistance to these individuals. Finally, Coral Gables has lost a man of great humor, integrity and warmth, Rober t Moor man, owner of Carroll’s Jewelers. City joins JohnMartin’s in celebrating 20 years on Miracle Mile BY ERIKA ARRIOLA Coral Gables city officials and leaders of the Gables community gathered recently to celebrate JohnMartin’s Irish Pub and Restaurant’s 20 years on Miracle Mile. The VIP reception was hosted by proprietors Martin Lynch and John Clarke of JohnMartin’s. The JohnMartin’s 20th Anniversary VIP reception event featured a proclamation presentation made by City of Coral Gables Mayor Don Slesnick, who declared Sept. 23, 2009, as “JohnMartin’s Day” in the City of Coral Gables in honor of its 20th Anniversary. “I’m very excited to be the first homeowner in the city to install photovoltaic cells to power my house,” said Dr. Hevia, a dermatologist. “I feel that we all have an obligation to do our part to live in a cleaner planet and I feel that anyone that can afford to do it should do it.” The resident recently installed the cells to cut down on his power bill. Making a home more energy efficient has a significant payoff in lower energy bills. “In the summer months I pay approximately $500,” Dr. Hevia said. “I was pleasantly surprised when I got my electricity bill this month. I saved almost $250 in one month.” Photovoltaic cells convert sunlight directly into electricity. During the day, the cells generate enough electricity to power the house and pool pump. At night, the power company takes over. “I love renewable energy. I think it’s a beautiful thing. Everyday the sun comes up and powers my house and that cycle is repeated over and over.” The City of Coral Gables applauds Dr. Hevia’s conscientious efforts for living a greener life and it is making

it easier for residents to follow his lead. The Building and Zoning Department has implemented guidelines that follow state law to expedite all green buildings and projects with renewable energy sources, provided those projects complete the criteria for submission. “Dr. Hevia is setting a great example for residents,” said Building and Zoning Department director Ed Weller. “His sense of responsibility for the environment is commendable.” As for Hevia, he is just happy to have made a personal contribution to preserving the planet and encourages others to see the good in going green. “We love it. Every home in Coral Gables should have this.”

Having distinguished himself by working on such cases as liability suits against General Motors, McDonnell Aircraft and large pharmaceutical companies as well as serving as Florida Counsel in antitrust class action against Microsoft, his community and environmental work are equally impressive. Parks is past president of the International Academy of Trial Lawyers, a Fellow in the American College of Trial Lawyers. An original appointee by the Florida Bar to the Florida Supreme Court Commission of Professionalism, he chaired the American Bar Association’s Forum on Air and Space Law. Annual Oktoberfest returns to Fritz & Franz Bierhaus BY ROBERT HAMILTON The legendary Coral Gables Oktoberfest continues a 15-year tradition in which an elite cultural event has been hosted in the City Beautiful. The festival, which continues through Oct. 11, is celebrated on the beautiful plaza in front of Fritz & Franz Bierhaus at 60 Merrick Way in downtown Coral Gables.

The festival has become one of the area’s most anticipated annual neighborhood celebrations and typically attracts up to 15,000 guests during a two weekend span. Event hours are weekdays from 11 a.m. to midnight and weekends from 11 a.m. to 2 a.m. Performers have included Austrian

Angelo and I started by using the medicine ball (3kg) to stretch and warm-up – up and down, side to side, diagonal across the body in both directions. I actually participated with him on this little ditty and broke a sweat immediately as if I had been driving 1000 head of cattle across the great plains during a heat wave. Next up were the sit-ups, squats and pushups (I passed on these – imagine that). Now, I was personally not built for these little fun activity morsels, but Angelo took to them like a champ and made sure I was fully aware of his prowess. I was comfortable offering words of encouragement while he worked out,

motivational moments I call them, and little reminders that you are never going to get a beach body doing squats like that! Then it was on to the punching bag – 60 seconds of pure adrenaline being infused with rapid fire strokes into a bag that looked oddly like my face. Then the treadmill for a quick run (I tried this, too, but at more of a trotting pace) to make sure Angelo’s heart rate was in the maximum range set forth by his “real” trainers. Finally, we concluded with some weight work and jumping rope (yes, like they do on the playgrounds)…only to be repeated in full two more times. After our 45 minutes of work-out bliss (and it was fantastic!), it was time to take stock of our collective physical success and learn more about the business. And catch our breath. I was impressed with the pristine facilities, the one-on-one care and concern for each client, as well as the feeling that you are the most important person in the room while you are there working out. While this experience is not for all, especially if you see fitness as a more social activity, the results are impressive and cannot be denied. Junior Orange Bowl Committee President Marti Bueso was introduced by Chamber Chair Sarah Nesbitt Artecona. Even minor criminal charges can have major immigration consequences BY MICHELLE ESTLUND, Criminal Defense Attorney Walk down almost any street in South Florida and chances are good you will pass many people who are not United States citizens but who are living here legally. They may be here on an investor’s visa, an employment visa, or they may hold permanent resident status. Most people are aware that persons here illegally can be deported for law violations, but many are surprised to learn that even those here legally can face deportation for certain misdemeanor offenses. These may include petit theft, possession of marijuana or drug paraphernalia, battery, or issuing a check for insufficient funds. Non-citizens must be extremely cautious when dealing with criminal matters, even though the charges may seem relatively minor in the criminal justice system. This is true for persons with currently pending immigration cases and for those who do not plan to adjust their immigration status for years to come. Criminal law meets immigration law when a non-citizen is charged with a criminal offense. It is important that the non-cit-

izen not rely on the advice of friends regarding how other cases have been resolved. Hiring a criminal attorney who is cognizant of immigration law to navigate the legal system is very important. This is because under immigration law, the same offense may impact different persons in different ways. For example, the amount of time a person has been in the United States and the possible penalties for different levels of the same crime will influence whether one person is deported and another is not. Any non-citizen facing any type of criminal charge, whether they were arrested or simply ordered to appear in court, must understand the ramifications the resolution of their criminal charge may have upon their immigration status. Clients are frequently surprised to discover that having resolved a criminal case with probation years ago now has a negative effect on their current immigration status. For this reason, it is critical that any non-citizen seeking to resolve a criminal matter disclose their immigration status to their attorney and discuss possible immigration consequences before closing the criminal case.

LOAN MODIFICATIONS: Can I qualify for Obama’s loan modification plan? BY DANIA S. FERNANDEZ, ESQ., Attorney at Law

The key components of President Obama’s program to stabilize the housing market through foreclosure reductions are loan modifications and refinancing. This initiative is called the Homeowner Affordability and Stability Plan (HASP). The program is also called “Making Home Affordable.” Eligibility is based on the following: • The property must be your homestead—your primary place of residence. • The amount you owe on your property must be equal to or slightly less than the value of the property. • There must be sufficient income to begin paying a new mortgage payment. • The original loan must have originated on or before January 1, 2009. • There must be a hardship. • The unpaid principal balance must be $729,750 or less. • Your mortgage payment must be more than 31% of your gross monthly income. Aside from these eligibility requirements, here are some of the questions I answer daily about the “Making Home Affordable” program. 1. Do I have to stop paying my mortgage to qualify for a modification? Technically, NO. I would love to say that lenders are providing loan modifications to all individuals that are current on their payments and meet the above qualifications, but this is not true. There are several lenders that have given loan modifications to those that are current. However, the majority of lenders are giving priority to those that are at risk of losing their home for nonpayment due to some kind of hardship. I will never advise my client to stop paying their mortgage because there are ramifications. Non-payment will affect your credit score and foreclosure proceedings will commence. Therefore, for those who believe they have no alternative but to stop paying the mortgage, please consult with your lender or seek the advice of an attorney first.

2. Will my equity line be modified together with my first mortgage? No. The loan modification program is only for the first mortgage. The second mortgage or an equity line will need to be negotiated directly with the Lender or Servicer. It is best to modify the first mortgage before negotiating the second. It makes no sense to start modifying the second without knowing if you can even afford the first mortgage payment. 3. What type of interest rate is being offered through the ‘Making Home Affordable” program? The interest rate may go as low as 2%. The purpose is to get you an affordable payment. The “Making Homes Affordable” program works to first reduce the rate of interest, second the term of the loan, and third the principal of the loan. Each step will be taken as needed depending on your particular situation and financial status. 4. Will I have to pay the property taxes and house insurance separately? No. The new loan payment will include a monthly escrow amount for the payment of property taxes and insurance. This is a requirement. 5. What will happen to all my past due amounts, late fees and/or penalties? Those that qualify for a loan modification through the “Making Home Affordable” program will not have to pay past due late fees. All other costs such as unpaid taxes, past due interest, etc., are usually added to the amount you owe. This also is the case for many loan modifications that are not through the “Making Home Affordable” program. The most important information to be gained from this article is that there are options available. The hardest part may be in acknowledging that you need help. We are all in this together and together many things can be accomplished. My best advice is to call an attorney for a consultation. LET’S TALK CARS The Dodge Avenger has a lot to offer consumers looking for a mid-size family sedan; it’s nicely styled and well equipped, and with the optional V-6 under the hood it has more than enough power for every day driving and highway cruising. The Avenger looks a lot like its sibling, the popular Dodge Charger. It has the same aggressive exterior lines, the signature crosshair grille, muscular rear shoulders, large wheels and tires, a rear spoiler and chrome-tipped dual exhausts. Standard power is a 2.4-liter I-4 World Engine that produces 173 hp and 166 pounds-feet of torque, delivering 21 mpg in the city and 30 mpg on the highway. Also available is a 3.5-liter, 24-valve highoutput V-6 engine that’s coupled with a six-speed automatic transaxle to produce 235 hp and 232 pounds-feet of torque (16/27 mpg). A six-speed automatic transmission with

Auto Stick provides a quicker standingstart, while a stronger differential and lower overall top-gear ratio yield a quiet ride with improved fuel economy at highway speeds. On the road, the Avenger’s ride is smooth and quiet and the V-6 engine is very responsive both off the line and at highway speeds. Handling was surprisingly crisp and sporty and there was very little body roll in the corners. Avenger is offered in two trim levels — SXT and R/T — and the grill distinguishes the two; the SXT has a body-colored grille and the R/T’s is black-and-chrome. The R/T also has a decklid spoiler and fog lamps. Both models come standard with power mirrors, keyless entry, 60/40split rear seat, rear defroster, cruise control, tilt-telescoping steering wheel, tirepressure monitor and air conditioning. The R/T has standard anti-lock brakes, power heated mirrors, steering-wheel mounted audio controls, an upscale sound system with six speakers and 17inch tires and alloy wheels, while the SXT has 16-inch tires and steel wheels and a little more luxurious interior.
