JOBC crowns members of festival’s Royal Court BY FERNANDA MEDICI

hree young ladies have been chosen to be the queen and princesses of the 2009-10 Junior Orange Bowl Festival, and together they are known as the Royal Court. Marilyn Rodriguez, 14, is the queen; Madison Nasser, 13, and Kamelah Jones, 13, are princesses. The Royal Court will represent the Junior Orange Bowl Committee (JOBC) as ambassadors of goodwill and their first task was going to the Miami Veterans Hospital on Veterans Day (Nov. 11). “This 59-year-old tradition is much more than a beauty pageant,” said Enid Miguez, chair of the JOBC Royal Court. The girls were selected based on personality, academics, community service, and poise. Queen Marilyn, from South Dade High School, is a member of her church’s youth group where they obtain donations of books and money for the

hen you are 8 years old, the saying “Follow Your Dreams,” is supposed to be more of a metaphor for life when you grow up, than an actual daily mantra for a second or third grader. But don’t tell that to Katiya Pedrouzo or Andrea Contreras, two Miami girls who are acting out their own dreams on the big stage at Actors’ Playhouse at the Miracle Theatre. Pedrouzo and Contreras, 8, are both starring as Madeline in the upcoming Actors’ Playhouse Musical Theatre for Young Audiences production of the holiday favorite,

Madeline’s Christmas. Pedrouzo, who has taken Theatre Conservatory classes at Actors’ Playhouse, was first exposed to theater a few years ago when her older sister, Natalya, played Daphne in the 2006 Actors’ Playhouse production of Madeline’s Christmas and later appeared in the 2009 Actors’ production of Les Misèrables. However, both girls really began to take an interest in acting after attending the Summer Theatre Camp at Actors’ Playhouse earlier this year. When each girl heard about the auditions for Madeline this fall, they both knew it was

With the recent celebration of Veterans Day, it seems appropriate to honor Korean War veteran Sonny Holtzman. Holtzman graduated with a degree in business administration from the University of Pittsburgh and went on to receive a law degree from the University of Miami, where he served as editor-inchief of the Miami Law Review. His history of accomplishments includes serving as SONNY HOLTZMAN founding chair of the Miami-Dade Expressway Authority (MDX) where he managed and directed its initial $2.5 billion work plan. He served as chair of the Transportation and Expressway Membership of Florida (TeamFl), and also serves on its board of directors representing the corporate and private sector members of the organization. A sustaining member of the International Bridge, Tunnel and Turnpike Association, he specializes in innovations of violation enforcement.

City participates in government exchange with Aix-en-Provence

BY BELKYS PEREZ Coral Gables International Affairs Coordinating Council vice chair Steven Edelstein recently returned from Aix-enProvence, France, Coral Gables’ Sister City. His trip to the south of France was not all pleasure. Edelstein was one of many international delegates who converged in the picturesque city for a weeklong symposium focusing on various aspects of government. All of the delegates come from countries that share strong economic and cultural ties with Aix. The panel discussion Edelstein participated in was specifically on the election of

municipal officials. Among panel participants was José Torres Hurtado, Mayor of Granada, Spain, a city that also shares a sister city relationship with Coral Gables. During the visit to Aix, Edelstein represented the City of Coral Gables in several meetings with the Aix leaders concerning the creation of cultural, social and professional exchanges. Despite a busy schedule, Edelstein set aside some time to visit the statue of impressionist painter Paul Cezanne, the city’s most famous resident. Coral Gables helped raise a portion of the funds to create the statue, which was unveiled in 2006 commemorating the 100th anniversary of Cezanne’s death.

Gables Rotarians use Halloween as theme for social event Gloria Burns GLORIA’S GAB Fall has arrived with Halloween being a holiday that adults have taken over from children at times. In fact, the Coral Gables Rotarians also took advantage of Halloween as a theme for their Fifth Friday Social.

On Halloween Eve, club members decked out in various costumes entertained a Group Study Exchange (GSE) team visiting from Peru. Team leader Raul Sanchez, a Rotarian from “Lima Colonial” and a past resident of that club, surprised the partygoers with his talent as a singer while others from his team gave a folk dance exhibition. Sanchez was joined by Milagros Mesones, an educational psychologist from Santiago; Elvira Gonzales, a CPA from Lima; Carlos Lechuga , from Brena, a graduate in Industrial Engineering and Business Administration, and Karla Nunez, an advertising executive from Santiago. Helping to spearhead a welcome and arrange meetings for the GSE visitors was Yolanda Woodbridge. Among the many stops was one at Coral Gables City Hall to meet with Mayor Don Slesnick, also a Rotarian. That following Thursday, Gables Rotarians once again were treated to a terrific program presented by Metrozoo’s Ron Magill. His enthusiasm simply is contagious and, as always, hearing him speak makes one anxious for a visit to the zoo to see the new exhibits. Following Magill’s talk, club president Wiley Hicks surprised Magill when he announced that he had

been made an honorary member of the Rotary Club of Coral Gables. Magill was very touched by the honor and expressed is appreciation to the club and to a Coral Gables community that is so supportive of the zoo’s efforts. By the way, Rotarians now can do makeups at Metrozoo by attending weekly Wednesday lunch meetings of the newly chartered Rotary Club that meets there. President Bill Tuttle welcomes all to come for a visit at the only Rotary Club in the world that meets in a zoo. The University of Miami Sports Hall of Fame announced its Class of 2010, headed by football All-American tight end Bubba Franks, All-American pitcher Alex

Santos and current major league baseball player Jason Michaels. Joining them are Olympic diver Jenny Keim Johansen; tennis star Sid Schwar tz; football player Jim Cox; basketball’s Ed Mor ris, and women’s athletic administrator Connie Nickel. The group will be inducted officially during the 42nd annual UM Sports Hall of Fame Induction Banquet scheduled for the spring. Coral Gables Fire Department joins other local fire-rescue departments in Dade County in providing topranked cardiac care. –––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––

BY ROBERT HAMILTON Since 2007, the Coral Gables Fire Department has been working with other fire rescue departments in MiamiDade County to deliver top ranked cardiac care. The cities of Coral Gables, Miami, Hialeah, Miami Beach, Key Biscayne and Miami-Dade Fire Rescue collaborate with the Miami-Dade STEMI Network, a system that speeds the transport of heart attack patients to prepared hospitals facilitating the treatment in a situation when every minute counts. STEMI is an acronym for segment elevation myocardial infarction, a heart attack caused by a

blocked coronary artery. Hospitals within the STEMI Network restore blood flow to a patient within an hour of arrival. Since its inception, the Miami-Dade STEMI Network has treated 1,800 patients experiencing life-threatening cardiac emergencies. Prior to the implementation of the STEMI Network, approximately 12 percent of patients suffering a blocked coronary artery did not survive. Thanks to this program, Miami-Dade County today possesses the lowest cardiac emergency mortality rate in the nation — less than 1 percent. This achievement has not been replicated anywhere else in the continental United States.

After auditioning for the part, Theatre for Young Audiences director Earl Maulding cast both girls as the beloved Madeline. “Both girls have excellent stage presence, strong melodic voices and an inherent star quality,” Maulding said. In addition to Pedrouzo, a third grader from John I. Smith Elementary in Doral, and Contreras, a second grader from Kendale Elementary in Kendall, there also will be nine young performers from area schools in each cast that make up the ensemble. The girls will miss about 10 mornings of school during the run of the show, but both girls’ parents say their teachers have been nothing but supportive. “Her teachers have all been extremely supportive and encouraging of Katiya’s acting,” said Tracy Pedrouzo, Katiya’s mother. “They have already lined up field trips for her classmates to come see her perform.” Madeline’s Christmas will be performed at 10 a.m. almost every weekday throughout the run of the show for area school groups to have an opportunity to see their fellow classmates on stage. For both Pedrouzo and Contreras, this will be their first role in an actual production alongside professional adult actors. The girls received valuable experience on stage during summer camp and theater classes, but nothing quite like playing the lead role in front of a 600-person audience. Contreras said she is not nervous at all, just very excited. “I want everything to come out perfect,” she said. Both girls feel that the classes and camps have really helped them prepare for their acting debut. “The summer camp taught me to have

more energy inside my heart, so I could get used to being in front of a lot of people,” Pedrouzo said. The two young starlets are both eager and excited about their upcoming role as Madeline. “There is a lot of running around and pulling out beds,” Pedrouzo said. They also recognize the important lessons Madeline teaches about the holiday season in putting others before yourself. “It’s about helping others,” Contreras noted as Pedrouzo nodded her head in agreement. So where does the dream go from here? “Obviously you want to see your kids chase a dream,” said Ivan Contreras, Andrea’s father. “She realizes acting is a tough career, and obviously you always want her to have something to fall back on; but as long as it is something she wants to do, I say go for it.” Andre Pedrouzo, Katiya’s father, added, “It is something she tried, and she fell in love with it.” Contreras sees the stage in her future. “I want to be an actress when I grow up,” she said. It looks like Contreras and Pedrouzo are both well on their way. You can watch both girls live out their dreams on stage at Actors’ Playhouse at the Miracle Theatre on Saturdays at 2 p.m., Nov. 19 through Dec. 26. Additional holiday performances will be on Sunday, Dec. 20, and Thursday, Dec. 24, at 5 p.m. Tickets are $15 each. kids with the Children’s Miracle Network. In addition, she is a member of her school’s Key Club where they write letters to veterans, and a member of UNICEF where she obtains donations of food, clothing and money for children in Africa. “As you can see from her involvement in the community, Marilyn is the perfect candidate for this award and I am very proud of her level of commitment to the community,” Miguez said. The event took place at the Miami Elks Lodge No. 948, and more than 20 girls participated. Queen Marilyn also was the winner of the “Give-a-Hand” essay, where the girls had to write an essay about community service commitment. Princess Madison is a student of Devon Aire K-8 Center, and she is in the National Junior Honor Society. Princess Kamelah, is a student at Herbert Ammons Middle School, and she also has participated in different community activities such as the United Way Marathon and the American Heart Association Walkathon. The contestants had to pass a preliminary selection in order to participate in the final. Community involvement is one of the most important traits that the

judges consider. The JOBC hopes to encourage the girls to be tomorrow’s leaders in the community and open the doors to a brighter future. The queen and princesses of the 200910 Junior Orange Bowl Festival are expected to reign over all the events, especially the 61st Junior Orange Bowl Parade on Jan. 2, 2010. During the festival, the Royal Court will participate in many award ceremonies for the children who succeed in the various JOB events. A number of children who participate in the Junior Orange Bowl festival discover a large passion for the arts and sports and continue their pursuit becoming extremely successful. Anastagia Pierre, the 2009 Miss Florida USA, was the Junior Orange Bowl Queen in 2001. HOLTZMAN, from page 1 –––––––––––––––––––––––––––––––––––––––––––– Holtzman is vice chair of the Transportation and Infrastructure Committee of the Greater Miami Chamber of Commerce, and recently was appointed to the board of directors of ConnectUs, which is a new statewide grassroots organization to inform Floridians about Florida’s application for over $2.5 billion of federal high speed rail funding. A close friend and advisor to the late U.S. Senator and Florida Gov. Lawton Chiles, Holtzman helped guide Chiles’ political campaigns, earning victories in every campaign for almost three decades. Holtzman was chair of the governor’s initial governance transition team, co-chaired his second term inaugural committee, and was appointed to chair the State of Florida PariMutuel Commission. Adding to this illustrious list of accomplishments, Holtzman has served as honorary consul for the Republic of Panama. ‘Halloween on the Mile’ honors scary story contest winners As part of “Halloween on the Mile,” Downtown Coral Gables hosted a scary story contest where local elementary school students wrote scary stories that took place in Coral Gables. Loan modification, foreclosure, short sale or bankruptcy? What should I do? BY DANIA S. FERNANDEZ, ESQ., Attorney at Law I am asked this question everyday. Not everyone is going to have the same alternatives. However, understanding your options is the first step to saving your home and your sanity. Is a Loan Modification for me? The Making Homes Affordable Plan is President Obama’s loan modification plan that helps homeowners who are struggling to make their monthly mortgage payment stay in their homes. This plan requires lenders to reduce monthly payments to no more than 31 percent of the homeowner’s monthly income. The first step in this plan is to lower the interest rate of the loan—sometimes as low as 2%. Second, if the mortgage payment is still too high with the reduced interest, then the loan may be extended to a 40 year term. Third, if the monthly payment is still not affordable, then there may be a reduction of the principal of the loan. Is a loan modification what you need? It is if you want to keep your home. I see loan modifications being given every day, allowing homeowners to stay in the home they have worked so hard to keep. Why do I need to defend my foreclosure with an attorney? Once you are given a complaint to foreclose, take that complaint to an attorney so legal responses can be given to the complaint. The response should be specific to each point/count made in the complaint; and affirmative defenses should be formulated for your individual case. The attorney you hire should know foreclosure law, mortgage law and how to properly prepare and answer the foreclosure complaint. If you fail to answer appropriately you risk your right to bring any affirmative defenses against the lender. Do you need to defend against a foreclosure? If you want to save your home and your credit, the answer is yes. Even if you are working on a loan modification, are in the middle of a short sale, or simply want to avoid foreclosure on

your credit you must take legal action to prevent the foreclosure process. Should I agree to a short sale and leave my home? If you want to throw the towel in or you do not qualify for a loan modification, then a short sale is a good option. A short sale is when a lender accepts less than what you owe on the property and agrees to the sale of your home. With a short sale, you need to find a realtor experienced in short sales; and an attorney who can properly negotiate the short sale with your lender. The short-sale process is similar to a loan modification and must be properly executed so as not to delay the closing and ultimately lose the interested buyer. Should I file Bankruptcy? If so, when and which Chapter should I file? Bankruptcy is a perfectly legitimate way to stop foreclosure, put an end to lawsuits, protect paychecks from garnishment, and regain control of your financial situation. However, this should be your final option after having tried reaching a loan modification, you have defended your foreclosure with a real estate attorney and time is ticking towards the foreclosure sale date of your house. In the Chapter 7 Bankruptcy there is no loan modification option and if you stop paying your mortgage you could lose your home. In the Chapter 13 Bankruptcy you can save your house and you are given time to pay off your debt. Do not lose hope. Changes and new programs are being offered to help homeowners every day. Even though this is a time of great challenge, do not forget the true meaning of life—the love of your family, the beautiful children you may have and the beautiful place you live in. Frequently, therapy for swimmer’s ear (otitis externa) involves the use of a prescription ear drop that relieves pain and is now available in a non-brand version known as "antipyrine and benzocaine". However, in some patients, the topical analgesic benzocaine can cause irritation and worsen or prolong inflammation, so in those cases, oral pain relievers may be preferred. For severe ear pain and itching, ear preparations containing an antibiotic and a cortisone-like steroid can be used to fight infection and reduce inflammation. Suspensions may be less acidic and therefore less irritating than solutions that contain the same medications. Special care must be taken if there is a chance that the eardrum is perforated, because some medications can be ototoxic (affect hearing) if they enter the inner ear. According to the Pharmacists’ Letter, if a patient complains about a bad taste after using their ear drops, it is a sign that the eardrum is perforated, and the doctor should be notified. BY RICHARD YAGER It’s almost always a sellout because there are just 200 tickets to go around for Miami Elks Chapter 948’s annual Charity Ball, an event themed this year as a “Winter’s Tale” that begins at 6 p.m. on Nov. 21. With 1,200 members, Miami’s oldest Benevolent and Protective Order of the Elks chapter should ring up another success, just as it has been doing for more than a half-century, the last 20-plus years at the Lodge’s activity-oriented complex at 10301 Sunset Dr. Tickets at $40 per person for festive beverages and a prime rib dinner (plus miniauctions and program advertising) are expected to realize $20,000 or more to help fund a host of community causes supported by Elks members during 2010. The night of dining and dancing in 2008 was themed around “New York, New York” but this year, the decor for “Winter’s Tale” will include a forest of icy branches and decorated evergreens in the main dining room. Complimenting the scenery will be handsome crystal place settings on white table linens, bathed in soft lighting to provide a northern glow for the evening gala. Realized dollars will help fund services like the local chapter’s free child therapy program and keep over 6,000 Kendall and Miami area youth busy in an after-school “Hoop and Shoot” competition, while

assisting disadvantaged and disabled youth at a state Elks Youth Camp. 32nd Annual Miami Greek Festival returning to Kendall, Nov. 20-22 BY DANIELLE BECK PAPPAS During a time when many businesses are closing and the economy is struggling, there still remains a Miami tradition that lives strong. The 32nd Annual Miami Greek Festival in Kendall begins on Friday, Nov. 20, and continues through Sunday, Nov. 22. Presented by St. Andrew Greek Orthodox Church, the Miami Greek Festival provides all things Greek — from mouth-watering food and homemade pastries to authentic music and dance. For more than three decades, this colorful celebration has offered a fun, festive way for the Miami community to be a part of the Greek culture — if even just for a weekend. “We’re excited once again to present this wonderful event,” said festival cochair Alex Sarafoglu. “Although times are tough for many of us right now, we think everyone is ready to come out and

party Greek-style and enjoy the food and fun that this tradition provides year after year.” So, while a trip to Greece may be out of budget for now, individuals can still enjoy a delicious taste of it — both gastronomically and culturally — right in their own backyards. “Our goal is to celebrate the Greek culture with the community,” Sarafoglu said. “There’s something for everyone, even rides for the kids.” The Miami Greek Festival, the church’s largest fundraiser of the year, is open from 11 a.m. to 11 p.m. all three days at St. Andrew Greek Orthodox Church, 7901 N. Affordable Senior Living: Options to Pay for a Great Lifestyle BY HELEN SHAHAM Q. Planning to move to a senior living community, I put my home on the market more than a year ago. With the current market, I haven’t been able to sell it. I’d like to move sooner rather than later. Are there any new, maybe nontraditional options for funding senior living? A. Seniors who prefer the peace of mind, care-free lifestyle and enhanced opportunities for socialization afforded by senior living communities, are finding new solutions for addressing the lack of traditional funding. According to Richard Rash, a Certified Reverse Mortgage Specialist with Transcontinental Lending Group, Inc., seniors 62 years of age and older typically did not have the best options when it came to getting cash from their homes. But today, there are alternatives available: Reverse Mortgages A reverse mortgage enables you to convert part of the equity in your home into tax-free income without giving up title or take on new monthly mortgage payment. Instead of making monthly payments to a lender, as with a regular mortgage, a lender makes payments to you. “Traditional home loans only offered the option of either selling the house or borrowing against its equity,” explained Rash. “With reverse mortgages coming on the scene, seniors now have some additional cashflow alternatives. This type of loan allows mature borrowers to convert their home equity into taxfree income.” The amount of funds you’re eligible to receive depends on several factors including: your age; home’s appraised value; interest rates; and the lending limit in your area. Typically, the older you and the more valuable your home, the more money you’ll receive from the lender. With a reverse mortgage, you can choose how you want to receive the money: all at once as a lump sum; fixed month payments for a set term; or as a line of credit which allows you to draw proceeds at any time. The reverse mortgage loan is repaid when your home is sold. If your home

sells for more than what is owed on the reverse mortgage, then the excess money goes to you or your estate. Life Settlements If you have a life insurance policy, life settlements are another technique for you to pay for a senior living community. This involves the sale, assignment, transfer or bequest of a life insurance policy by a policy owner to a third-party investor. Rash says the policy owner typically receives cash (generally an amount greater than the cash surrender value in the policy but less than the full amount of the death benefit) and the new owner becomes responsible for the payment of all future premiums. Asset Backed Lending With asset backed lending, you can tap into the potential power of your stock and bond portfolios without having to end their participation in possible future growth. You can leverage your securities and, depending on the quality and stability of the collateral securities, could borrow as much as 85 percent of their portfolios as cash. These are just a few of the financial options available to seniors. I recommend you seek the advice of your accountant or tax advisor for information specific to your case as you begin weighing your options. Most recently at The Palace communities, a few of our newest residents have tapped some other methods to offset the costs of retirement living. VA Benefits The U.S. Department of Veterans Affairs’ Pension with Aid & Attendance Program offers assistance to veterans and/or their surviving spouses. In order to qualify, applicants must prove that the majority of their income is spent on medical expenses such as co-pays, insurance deductibles, prescriptions, caregivers or assisted living community expenses, etc. The VA reimburses the veteran up to $1,644 per month and the surviving spouse up to $1,056 per month. A Veteran Service Center can provide specific information on how to qualify for VA benefits. They can be reached by calling 305-270-2940. Medicaid Diversion Program The Long-Term Care Community Diversion Program may also help cover the costs of senior living, more specifically assisted living communities. The Medicaid Waiver program is designed to provide community-based services to people who would otherwise qualify for

Security Agreement Senior living communities may offer special incentives or programs to assist with expenses. For example, The Palace’s new “Security Agreement” allows you to move to the community paying only a discounted monthly rate (whatever you can afford without selling the home) while you await the pending sale of your home. Once your home is sold, The Palace is reimbursed the accrued rental difference with minimal interest fee. If you continue to have difficulty selling your home, you may consider proceeding with your move to retirement community and having a relative or friend rent the existing home to help offset costs. Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.

If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments. Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
