Healthcare has been at the forefront in America for several decades. On March 23, 2010, President Obama signed into law the Patient Protection and Affordable Care Act (PPACA). Just a little over two years later, on June 28, 2012, with a 5-4 vote the Supreme Court of the United States upheld the law as constitutional based on the individual mandate being a tax. Another facet of the law that was equally important deals with the states’ expansion of their Medicaid programs and the possible repercussions they could face if they did not participate. The Supreme Court ruled this provision unconstitutional based on the 8th Amendment. What does that mean to the business world? We need to keep an eye on the IRS to see how they will implement the new taxes. The Department of Health and Human Services will be coming out with guidelines on minimum health care coverage. The Department of Labor will organize random visits to see if companies are in compliance. States across the country will announce which will participate in the

FCAT: Broke, beyond fixing; Immigration Law Firm now’s the time to throw it out Recruits Top Staff BY GRANT MILLER, PUBLISHER

Give a politician a square peg and a round hole and they will stubbornly pull out a drill or sandblaster to make them somehow fit. Since former Florida Gov. Jeb Bush changed state law to require comprehensive assessment testing (or FCATs) be administered to all grade levels (Gov. Bush’s 1999 A+ Plan) education in Florida has never been the same. The problems have not been solved, they have only gotten worse. But, dang it, they won’t leave the test behind — even if the child is. “A” and “B” students are being left behind because of some impossibly unbiased be-all, end-all exam that is supposed to predict future competency and success. By simply applying the scientific method, it becomes a no-brainer that the FCAT is failing miserably. Consider the following: • At least 46 of the 67 school districts (and five school superintendents) have written to the Florida Department of Education (FDOE) to ask for FCAT data reviews on “anomalies.” (Orlando Sentinel, July 15, 2010). • Since the test began, public school teaching in Florida has all but imploded with a long list of celebrated instructors dropping out of the system over the years because they refuse to spend the academic year “teaching to the test.” In fact, the pressure has become so unbearable that at least one documented charter school was willing to cheat and view the test beforehand. As a result the FDOE has

now had to take new measures to prevent schools from cheating. (Palm Beach Post, Apr. 18, 2012). • State testing contractor NCS Pearson (being paid $254 million over four years to administer the test) has had to pay back millions in fees because of late FCAT results that essentially held the education system hostage until scores came in. (St. Augustine Record, June 8, 2010; Apr. 17, 2012). • The tremendous disparity in the drop of FCAT writing scores for fourth graders — from 81 percent last year earning 4.0 or better (out of a maximum 6.0) to only 27 percent this year passing. So they lowered the bar. Passing scores became a 3.0 to the tremendous embarrassment of the entire Florida Department of Education. (Tampa Bay News, May 15, 2012). In a recent Channel 10 News story by Michael Putney about the Broward County School Board voting unanimously against the FCAT, sponsoring board member Laurie Rich Levinson spoke for so many of us when she said, “Hundreds of millions is spent developing this test, while classes in science, social studies, art, music and PE are being cut.” We join with academicians and editorial page columnists around the state, as well as disgruntled teachers, parents, and students all over Florida who say, “let us do away with politicizing education in Florida; it was a bad idea. It can’t be fixed.” You don’t have to be a rocket scientist to figure out that a subjectively sketchedout test score does not determine a student’s ranking for success in life, nor the content of his or her character.

A newly formed full service immigration law firm, The Hermanni Law Group, recently established offices in Coral Gables and has since recruited several new attorneys to provide clients with a full plate of immigration services. The impetus for creating this firm came from Kurt Hermanni, who had earned a great reputation as a skilled, honest and competent international lawyer dedicated exclusively to the practice of immigration law. Hermanni remembers a time when a client’s friend called from New York to help his detained nephew get a bond from an immigration judge in Krome Detention Center. Thereafter, the family only wanted him despite the added travel expenses. That level of trust and dedication has propelled the Hermanni Law Group to handle cases throughout the United States. That is not hard to understand given the number of cases in which immigrants have been victimized by less principled and trustworthy attorneys. Passionately committed to serve his clients, Hermanni has developed relationships that have dramatically increased his client base through satisfied client referrals. Seeing the growing demand, Hermanni has recruited a group of outstanding lawyers all of whom have a general competency in general immigration law but also have a focus in variety of critical areas. While Hermanni is fluent in English, Spanish and Italian, his entire team his fluent in English and Spanish. The firm is currently comprised of five full-time house attorneys: Kurt Hermanni, Senior Partner; Norma Lorenzo, Managing Attorney; and Associate Attorneys Patricia Hernandez, Consuelo de le Ossa, Jenna McQuid and Greg Greenberg. The Hermanni Law Group currently represents numerous international companies throughout the world, with clients in Latin America, Europe, Asia and the Middle East, in support of their employees’ short-term or long-term placements in the United States. Additionally, the firm represents clients facing immediate removal from the United States and those seeking asylum, Cuban Adjustment and adjustment status. Successful representations have focused on defense of marriage fraud claims and cases involving violence against women. The firm’s distinguished clientele includes a former South American President and his family, several foreign dignitaries, a former military General, military attaches, professional athletes, and foreign investors from China, Serbia, Colombia, Venezuela, Spain and Italy. The Hermanni Law Group is located at 2655 LeJeune Road, Ste. 800, Coral Gables, FL 33134. Ph: 305 640-8222 or Mobile 786-271-6699. Visit our website at www.legalizationlawyer.com.

exchange or opt out. This is an election year; the political arena is preparing to mount campaigns for November, but this should not stop your company from taking a proactive approach to employee benefits. At this time, the alignment between HR departments/controllers/CFOs must collaborate with a qualified benefits consultant. We know the following things: • Employers must provide a summary plan description. • The maximum contribution to an FSA account is fixed at $2,500. • Carriers are willing to work with states to set up the health care exchanges. • Wellness programs are getting traction to help control the cost of health care at the employer level.

The Supreme Court has ruled. The stage has been set for the business world to focus on the political arena. Companies, benefit professionals, and carriers have their eyes on federal and state government regulations to better prepare for 2013 and stay compliant. Plans are being drawn to cover all possible scenarios. Employers and employees are aware that health benefits can help solidify employee loyalty. The cost of health care is an integral part of a company’s bottom line. To all the companies out there, do not go at it alone. The turbulent waters are better navigated with a benefit professional. Oral health tips from Smile Studio Associates Dentistry

Relief from Dry Mouth BY DR. RAUL GONZALEZ Clinical Director of Smile Studio

MWe all need saliva to moisten and cleanse our mouths and digest food. Saliva also prevents infection by controlling bacteria and fungi in the mouth. When we don’t produce enough saliva, our mouth gets dry and uncomfortable. Fortunately, there are many effective treatments for dry mouth. There are several causes of dry mouth. Dry mouth is a common side effect of many prescription and nonprescription medications, including those used to treat depression, anxiety, pain, allergies, colds, diarrhea, nausea, psychotic disorders, urinary incontinence, asthma and Parkinson’s disease. Dry mouth can also occur after taking muscle relaxants and sedatives. Common symptoms of dry mouth include: • A sticky, dry feeling in the mouth. • Frequent thirst. • Sores in the mouth, sores or split skin at the corners of the mouth and cracked lips. • A dry feeling in the throat. • A burning or tingling sensation in the mouth and especially on the tongue. • A dry, red, raw tongue. • Hoarseness, dry nasal passages and a sore throat.

• Bad breath. Take the following steps to help improve saliva flow: • Chew sugar-free gum or suck on sugarfree candy. • Drink plenty of water to help keep your mouth moist. • Protect your teeth by brushing with fluoride toothpaste, using a fluoride rinse and visiting your dentist regularly. • Breathe through your nose, not your mouth, as much as possible. • Use an over-the-counter artificial saliva substitute. If you are experiencing dry mouth or other oral health issues, visit Smile Studio Associates Dentistry. Dr. Raul Gonzalez, clinical director, has been helping patients in Miami to achieve healthy and dazzling smiles for more than 15 years. He is trained in various specialties, including general, neuromuscular, sedation, and aesthetic and reconstructive dentistry, as well as orthodontics. Dr. Gonzalez’s goal is to treat the whole family and educate patients that a spectacular smile does not simply make you feel better and have more confidence, but it is vital to your health and well-being. Julio G. Anta GET FIT WITH ANTA On June 24, Dave Clark and I became the first two certified C.O.R.E Krav Maga instructors with certification by by Chief Instructor Steve Ledford in Asheville, North Carolina. Krav Maga is the Israeli’s military reality-based fighting system which translates to “Combat Contact” or “Close Quarter Combat.” A complete reality-based self defense and fitness system, Krav Maga is great for men and women, civilians, military and law enforcement. (Who can forget Jennifer Lopez’s movie ,“Enough,” based on Krav Maga training?). Krav Maga aids students and instructors who are physically, mentally, and emotionally able to react to violent encounters as well as become analytical thinkers

From 1948 to 1963, Imi trained Israeli soldiers in Krav Maga and after retiring from the military, began teaching civilians. Those who read my column know that although ranked in Hung Gar Kung Fu as a master, I’m certified in numerous martial arts as an instructor and remain a student for life. My own self-defense went to

Clark, a retired police officer and a private military contractor, is a police mentor in Afghanistan and will be training that country’s force in Krav Maga while I’ll bring its instruction techniques to Doral classes. An experienced self defense instructor, Clark is certified in Commando Krav Maga at Level Four, World Wide Krav Maga, and other martial arts. He co-developed the CKM “Total Officer Protection”

another level by studying Ledford’s Krav Maga concepts. I was introduced to Krav Maga in 1999 during a workshop at the NAPMA World Conference by World Wide Krav Maga’s Darren Levine and UFC Champion Bas Rutton. In 2004 I took the Haganah F.I.G.H.T instructor trainers course and was the first instructor in Miami Dade County certified in Haganah. In 2009, I decided to take a Commando Krav Maga course for Elite Combat Fitness certification—three days in hell—the hardest fitness challenge I had ever been through since Marine Corps boot camp in Parris Island in 1980. That’s where I met Ledford, then a Krav Maga and ECF instructor, our guide through this Israeli fitness boot camp. You can learn to survive any street self defense situation (standing or on the ground) if attacked by gun, knife and blunt weapons with C.O.R.E Krav Maga, now coming to Doral. Gus Machado Way Unveiled in Hialeah Mayor Carlos Hernández and the Hialeah City Council unveiled “Gus Machado Way,” a portion of West 13 Ln. from West 44 Pl. to West 47 Pl. recognizing the prominent automotive dealer’s outstanding community leadership and presence in the city. Founder and owner of Gus Machado Ford of Hialeah and Gus Machado Ford of Kendall, the South Florida business leader and philanthropist left his native Cuba in 1949 and attended Edwards Military Institute and Greenville College in North Carolina. In 1956, the young entrepreneur settled in Miami and began to establish and grow his business. Over a period of two decades, Machado purchased and sold various car dealerships and during the mid1970s he ventured into exporting automobiles to Puerto Rico. In 1982, he entered the Miami domestic new car dealership market with Gus Machado Buick which soon became a local landmark. In 1984, he purchased Johnson Ford, an existing dealership that later became Gus Machado Ford. The dealership became the number one

Ford dealer in Miami-Dade County and was ranked number 22 among all Ford dealers nationwide. Over the past few decades, Machado has taken an active role in giving back to organizations that benefit South Florida neighborhoods. In 1998, he founded The Gus Machado Classic Charity Golf Tournament benefiting the American Cancer Society. Ten years later, he created the Gus Machado Family Foundation that contributes to multiple charitable communitybased organizations. Over the past 25 years Machado has personally raised more than $2.5 million for local Miami charities and causes. Most recently, Machado was named recipient of the 2012 Salute to Dealers award presented by Ford Motor Company, one of the company’s highest accolades given to Ford dealer principals worldwide for helping improve the lives of individuals in their community. Machado is one of six international winners recognized for their commitment to their community and the only South Florida dealer to receive the honor.

At Great Florida Bank, we are bringing that back.”

Miguel, also a vice president and senior relationship manager, says this personal level of service is what differentiates Great Florida Bank from other banks. “Our clients know that if they need us, we are here for them,” she said. “Additionally, what our clients love about us is our complete commitment to the communities we serve. Why Logistics Matter BY STEVEN SELTZER

Easier shopping is among the many things the Internet has given us. Even holidays have changed as a result. With Black Friday slowly giving way to Cyber Monday, we’re no longer limited to big box stores. I find what I want online, click a button, get a message that my purchases are on their way, and a few days later, a package shows up at my door. It seems effortless, but as someone with more than 30 years’ experience in logistics, I can tell you that it’s not. Now more than ever, companies need to be able to fill orders and ship them out quickly. Stores also feel the need for speed when it comes to receiving their merchandise – with so many options available to consumers, not having goods in stock often means losing the sale to a competitor. Many would define logistics as the movement of goods. But this is an incomplete view of a process that most businesses, particularly the retail sector, rely on to keep their doors open, and their customers coming back. In addition to tracking the transportation of goods on planes, trains, trucks and

ships, logistics also involves the location of goods when they’re not being moved. Along with movement and warehousing, a delivery service must seamlessly handle the myriad of other details: inventory management, proper loading and unloading (a must to avoid damaging goods), customs clearing, packaging and cargo insurance. If you think retail is the only sector that relies heavily on delivery services, guess again. Businesses often need to transport sensitive documents locally in a timely fashion, and a full-service logistics and delivery company, must be able to fill the role of courier as well. A shipment of retail merchandise can mean millions of dollars, but so can a small stack of papers. Size doesn’t matter when it comes to the importance of the product. Even entertainment and vacations rely on logistics, whether a DreamWorks animated movie premiere or an emergency coffee run for a cruise ship about to depart, such as we had to answer recently. Can you imagine what happens when a ship full of passengers can’t get their caffeine fix? Neither could the cruise line! LATIN AMERICAN

BY JOHN RICHARD

President/CEO, Arsht Center for Performing Arts Children are leaping, twirling and dancing their way through summer camp at the Adrienne Arsht Center for the Performing Arts of Miami-Dade County as the AileyCamp Miami celebrates its fourth season of serving Miami-Dade children. The six-week camp for public middle school students targets underserved youth who may face barriers in their academic, socio-economic or personal development. The program is tied to the Arsht Center’s mission of exposing the community’s youth to the transformational power of the live performing arts. Since its launch in 2009, the program has hosted almost 300 students. For many of these children, attending the camp is their first opportunity to visit the Center and receive instruction from some of Miami’s best dance instructors, as well as Alvin Ailey American Dance Theater alumni. The Arsht Center provides campers free transportation from as far away as Homestead and North Miami as part of the full scholarship program, along with breakfast, lunch, dance attire and field trips to round out the summer fun. The campers take classes in ballet, jazz, West African dance, Horton-based modern dance, personal development and creative communication. The Center also invites family, legal guardians, friends and the South Florida community to celebrate in the accomplishments of the campers at a final performance on the Knight Concert Hall stage that typically attracts more than 1,500 guests. Although the Center runs the camp and assumes all of its costs, AileyCamp Miami is one of 10 AileyCamps around the country. It is particularly dear to the Arsht Center and the community now that Miami’s own Robert Battle is the artistic director of the nationally acclaimed Alvin Ailey American Dance Theater. National supporters of the arts are taking note of the Arsht Center’s strides to raise the bar for arts education. Recognizing that AileyCamp Miami has impacted hundreds of students from all

The Arsht Center is the only Florida organization to receive an Arts Education grant in NEA’s latest grant awards announcement. Are the Marlins over extended? BY PRESTON MICHELSON

Believe it or not Miami, there is another local professional sports team currently playing. Your Miami Marlins have been playing winning baseball for the majority of this season — apart from a recent skid. And, as Miami Heat fans know very well, losing causes some widespread panic. Some of this panic has been directed at Marlins management for giving out undeserved long-term contracts. As an organization, the Marlins have long been reticent to dole out these long-term contracts. However, with the dawning of the “Marlins Park era,” their philosophy has shifted. This offseason, the Marlins and shortstop José Reyes agreed to a rich 6-year, $106 million contract. Reyes was coming off of a year with the New York Mets in which he led the National League in batting average and triples, and also put up the highest OPS of his career. Despite the fact that his stolen base total and his home runs have been on a steady decline, Reyes nonetheless continued to be a dominant force. While Marlins owner Jeffrey Loria dug deep into his pocketbook to fork over an average annual value of $17.6 million to the

CORNER then 28-year-old middle infielder, Reyes has proved why he is worthy of that contract. Although his offensive output so far this year has been less than expected, his career trend would claim that this is nothing more than an aberration or a slow start. For more perspective on what Reyes has and will bring to this team, look no further than the possibility of Matt Dominguez as the Marlins’ everyday third baseman, which would have been a reality had it not been for the signing of Reyes. While long-term contracts have plagued many an organization (see: Barry Zito, Vernon Wells and Mike Hampton), abstaining from these contracts would leave out the very real possibility of a positive outcome. Although Marlins ace Josh Johnson has had his struggles this year, he looks to be rebounding to his usual form. When Johnson and the Marlins signed his four-year, $39 million contract extension, he was coming off of a 15-5 and 3.23 ERA season. In his

first contract year, 2010, Johnson continued to improve. He finished the season 11-6, and had a National league-leading ERA of 2.30. His next season promised to be immensely successful, but it was cut short after only nine starts due to injury. If one word can be assigned to another recent recipient of a Marlins long-term contract Mark Buehrle, that word would be “consistent.” From 2001-11, he has started more than 30 games and has had an ERA less than 5.00, and in some cases, much lower than 5.00. The Marlins rewarded him with a 4 year, $58 million contract. So far in 2012, this contract has paid off. Although the Marlins have not had any long-term contracts that could be considered “major busts,” there have been some that have not lived up to their expectations. Hanley Ramirez’s six-year, $70 million contract has surely not been fulfilled. Likewise, while Ricky Nolasco has been decent, decent doesn’t equate to three years and $26.5 million. In a similar fashion to how Florida Marlins fans called out for the extension of Miguel Cabrera, Miami Marlins fans are now calling for the extension of power-hitter extraordinaire Giancarlo Stanton. He has become very well-known for hitting home runs to distances previ-

ously thought unreachable. Although he will not reach free agency until 2017, the best time to extend his contract would be right now. Wait any longer, and the potential cost to keep him a Marlin will skyrocket. A fitting comparison to Stanton’s potential cost would be Colorado Rockies outfielder Carlos Gonzalez. After three seasons in the MLB, Gonzalez was signed to a seven-year, $80 million contract. In addition, Gonzalez may have put up even more impressive statistics than Stanton has, so far. If the Marlins were to extend Stanton, his price may be even lower than $80 million. His contract would most likely be in the Hanley Ramirez range, a range that even the stingy Marlins management of years past was willing to enter. Long term contracts can be risky, but without risk there is little to no chance for a positive outcome. Marlins management, don’t abstain from giving out long-term contracts; just be careful. It’s Gabriel’s Story BY CRISTY MARTINEZ-PAEZ

For 7-year-old Gabriel and his family, the annual Miami-Dade Heart Walk is more than just a fun event; it’s a celebration of life. Three days after being born, Gabriel was diagnosed with a type of congenital heart defect named Hypoplastic Left Heart Syndrome, a condition that occurs when the left side of the heart does not develop properly in the womb. He had his first open heart surgery at just seven days old and underwent two more surgeries and three procedures before his fourth birthday. “If it weren’t for the contributions made to the research studies of new innovative surgical techniques to treat heart disease and congenital heart defects, Gabriel would not be with us today,” explained Cathy Gonzalez, Gabriel’s mother and a Miami Lakes resident. The American Heart Association has funded millions of dollars towards research studies conducted in South Florida through events such as the MiamiDade Heart Walk. The event has long been the American Heart Association’s premier fundraiser across the United States, raising critical funds to help combat heart disease and stroke, the No. 1 and No. 4 leading killers, respectively, of American men and women. “Before our son was born, we had no idea that congenital heart defects were a major issue in the lives of so many children. By participating in the walk, we are not only fundraising, but also educating others about the No. 1 birth defect,” said Cathy. Through the Heart Walk, the association strives to raise awareness about the prevalence of cardiovascular diseases. “By walking, we are paving the way for longer, stronger lives,” said Ernie Diaz, the 2012 Miami-Dade Heart Walk Chair and South Florida Market President for TD Bank.

Cathy and Gabriel Gonzalez

“Studies show that for every hour of walking, life expectancy may increase by up to two hours, so let’s get moving!” This year’s walk is taking place from 8:00 a.m. through 12 p.m. on Saturday, October 6 at Florida International University. Participants will enjoy free activities such as health screenings, a kid’s zone, entertainment and a healthy lunch. The Heart Walk is sponsored nationally by Subway restaurants and Jenny Craig. Last year, the Gonzalez family raised more than $1,600 through donations to their team “Gabriel’s Hope.” This year, they plan on doubling that amount. “Gabriel’s body functions with half a heart, but he definitely lives his life wholeheartedly,” said Cathy. Last year, Gabriel’s doctors determined that he was well enough to live a normal life and visit the cardiologist just once a year as opposed to several times throughout the year.
