Parks Department studies new access to pine preserve P

roviding an eight-acre Kendall pine rockland park with a nature trail is under study by MiamiDade of Park and Recreation Department planners to help stimulate public interest in more active use of preserved areas, several now fenced off to the public. Miami-Dade Commissioner Katy Sorenson and James A. (Andy) McCall, park planner, conducted a public meeting on July 20 to discuss future improvements to Pine Shore Pineland Preserve, a natural pineland located at 11151 SW 128 St., immediately west of Gloria Floyd Elementary School. Of special concern are about 20 plant species including 14 indigenous to pine rocklands that exist in what is known as Pine Shore Park, “apparently part of the original Pine Shore Acres housing development and now open from sunrise to sunset,” McCall said. Protected under Florida Endangered Lands regulations approved in 2000, the rockland interior still bears the imprint of a two-lane road, which McCall said could be converted to a nature trail.

Miami-Dade Fire Rescue gets $284,404 grant from FEMA
BY LEE STEPHENS he U.S. Department of Homeland Security’s Federal Emergency Management Agency (FEMA) awarded $572,671 from the Assistance to Firefighters Grants (AFG) program to local fire departments and organizations in the state of Florida. Among them Miami-Dade Fire Rescue received $284,404 for fire prevention. Nationally, the fiscal year (FY) 2008 AFG awards will provide approximately $500 million to fire departments and nonaffiliated emergency medical service organizations throughout the country. “This direct funding is essential to train and equip our first responders who protect lives and property against

Clinton recognizes schools for creating healthy environments BY TERE ESTORINO President Bill Clinton, founder of the William J. Clinton Foundation, recently joined Dr. Clyde Yancy, president of the American Heart Association, and Dr. Risa Lavizzo-Mourey, president and CEO of the Robert Wood Johnson Foundation (RWJF), to recognize 18 Miami-Dade County schools during the Fourth Annual Healthy Schools Program Forum in New York. “As kids head back to school this fall, it is important to remember that healthy students are more likely to attend class, concentrate on their schoolwork, and perform better academically,” President Clinton said. “I am pleased to recognize 114 outstanding schools that have succeeded in building healthy learning environments for students and staff. “To date, the Alliance’s Healthy Schools Program has helped give more than 3 million kids increased opportunities for physical activity and healthy eating, and we look forward to reaching even more in the year ahead.” Local Silver National Recognition Award recipients were as follows: George Washington Carver Elementary School, Silver Bluff Elementary School and Miami Edison Middle School. PINE, from page 1 –––––––––––––––––––––––––––––––––––––––––––––––––––––––––– enhance an existing road through the preserve at the north and south ends to ease entry into center,” he said. “A second proposed amenity is the placement of small interpretive signs in appropriate locations to identify plants and trees for those walking through the preserve.” The Pine Shore Preserve is maintained by the Parks Department’s Natural Areas Management Division with funding for interpretive signage to come in 2011 from $250,000 earmarked in Building Better Communities program. Creating a footpath would be provided by DERM (Department of Environmental Resources Management) through its Environmentally Endangered Lands (EEL) program. Only 2 percent of Miami-Dade’s original pine rocklands, once the dominant pre-development landscape feature of eastern Miami-Dade County, now remain preserved in the county, a “globally imperiled habitat,” McCall noted. Fellow planner Eric Hansen of the department’s Planning and Research Division believes the project could lead to controlled but easier accessibility to fenced pine rockland preserves, now isolated forests amidst Kendall’s housing and shopping centers. “We have a number of properties classified as natural area preserves totaling approximately 1,700 acres,” Hansen said. “Within other park classifications, natural areas are accessible to the public to some degree,” he said, noting Kendall Indian Hammocks Park, a 105acre park that includes 43 acres of hardwood hammock, and the 60-acre A.D. Barnes Park with 10 acres of natural pine rockland.

Two other Kendall areas with natural pine rocklands include the 40-acre Nixon Smiley Preserve on SW 128th Street, immediately west of SW 127th Avenue, and Camp Matecumbe, which once housed “Pedro Pan” refugee youth, north of Kendall-Tamiami Executive Airport. Both areas, however, are surrounded by chain-link fences that bar public access with signs warning against trespass. Miami-Dade College’s Kendall campus offers an opportunity for public visits to its Environmental Center, a nineacre nature preserve including a pine rockland and hardwood hammock, tucked between the MDC Kendall campus and Glen Cove community at SW 104th Street and 117th Avenue. (Trips to visit the preserve may be arranged by calling 305-237-2528 or the center’s campus office at 305-237-2600). “Making the preserved pine rocklands more accessible could extend long-range enhancement of natural county features,” Hansen told East Kendall Community Council 12 members in July. “While the Open Space Master Plan envisions interconnected county parks, it does not specifically address natural areas but eventual removal of fences and allowing some degree of public access while integrating the property into a neighborhood could prove beneficial to the community.” No concrete plan or schedule for such a program is currently in effect, he said. AROUND TOWN In a somewhat unusual action earlier this month, Commissioner Joe Martinez transmitted a four-page “e-Newletter” summarizing key concerns about HR3200 or “Health Choices Act” that has stirred up so much controversy from DC to Dogpatch. Passing on information received from the Obama White House, Martinez is troubled about 39 individual sections of the proposal, adding: “As you are all aware, I am very concerned with the number of residents that do not have health insurance.” Commissioner Martinez hosts his own Health Care Expo annually providing basic services to the community and also created the first public/private partnership with Blue Cross/Blue Shield of Florida to provide a “Miami Dade Blue” health benefit program. Citizens Insurance had bad news for owners of older homes R. Kenneth Bluh KENNETH’S COMMENTARY Proposed increases in homeowners’ insurance premiums are hurting homeowners almost to the point of despair. While this is bad news, the news to owners of older homes — that is homes over 40 years old — is disastrous. If you have a mortgage on your home, the lender requires that you carry insurance. Sufficient coverage is required to replace the home, exclusive of land, in the event of total destruction. If you have a mortgage on your home and you let your insurance lapse, the lender will provide coverage. The coverage is called “force-placed insurance.” It is insurance that is forced upon the uninsured homeowner by the lender. Coverage is limited to the cost of repaying your mortgage debt in the event of a loss. If you have a mortgage balance,
smaller than replacement cost, and you have a total loss, the lender will be paid off and the homeowner will end up with a destroyed home and possibly only a lot after the destroyed home is demolished. While Citizens Insurance is a “state” insurance company, it cannot give away coverage. Therefore it structures its premium in an attempt to provide sufficient funds to cover future claims and pay the cost of running Citizens. Citizens will require homeowners with homes over 40 years old to prove that the home meets minimum structural requirements so as to not cause any additional risk for the insurance company. Before you can obtain insurance coverage on the older home you must obtain a four-point inspection which checks the condition of the roof and electrical system to make sure the home is in insurable condition. Additionally, Citizens no longer will provide coverage if the house has a shingle or gravel roof over 15 years old, or a tile roof over 25 years old that doesn’t meet their standards. ––– VIEWPOINT ––– replaced with a new roof. You can’t even renew your current Citizens policy if it doesn’t meet their requirements. A 70-year-old husband and wife have owned the same home for the last 50 years. They have a small mortgage balance therefore they must have property insurance. Their Citizens policy comes up for renewal and they learn that the policy cannot be renewed unless they replace their roof. The 70-year-olds, living on $1,100 a month Social Security, quickly learn that a new roof will cost them $18,000. This couple, with a family income of $1,100 a month, cannot qualify for a bank loan for a new roof. They quickly learn that if they don’t give their lender evidence of coverage the lender will force place coverage and increase the seniors’ payment by hundreds of dollars a month to cover the cost of the new coverage. They can’t afford a new roof, they
can’t afford the increased monthly mortgage payments and their mortgage goes into default. After 50 years of owning their own home where they raised their kids and grew old together, they find themselves in foreclosure. We will have hurricanes in the future. Homeowners will need insurance coverage to satisfy their mortgage lender as well as to protect their investment. Perhaps the answer is to federally require that insurance companies pool the premiums collected from every state in which they operate. This will spread the risk, lower the cost and ease up on underwriting requirements.

Wall Street fix worked, but we’re still waiting for ours
Al Sunshine 4 YOUR MONEY We recently passed a milestone: Wall Street had the best July gains in about two decades, and the nation’s gross domestic product (GDP) only shrank at 1 percent, which is better than expected. This is great news because earlier in the year, at the probable height of the recession, the nation’s economy almost dropped off the cliff after the GDP dived more than 6 percent. The third quarter, which ends in September, actually may not be much better as far as showing actual, positive growth. But the Titanic didn’t start steering away from the iceberg immediately, and the U.S. economy couldn’t either. The recession is ending, but it’s not even close to being over. Though recovery is beginning, we cannot expect to see a quick turnaround. However, I think by this time in 2010, we’ll have a much better perspective of the significance of what we’re seeing today. Nationally, improvements will be spreading out over the next 24 months as the American industry gets back to the business of making, distributing and selling what consumers want and need. Here in South Florida, however, it’s going to take more time. We felt the effects of the recession later, and our overbuilt housing markets pulled us down more than expected. Residential construction here may be stalled anoth-

er two to three years until the supply of available homes and condos gets bought up and demand grows strong enough for new ones to be planned and built. But that won’t happen until the unemployment problem gets fixed. People have to get back to work, and consumers need to feel comfortable spending again. We also need a second national stimulus for “Main Street.” Wall Street is getting back on its feet with billions of tax dollars in government help. But where is the help for the rest of us who are paying for it all? When will the banks start paying us back with cheaper fees, lower interest rates, and quicker loan modifications to make owning a home more affordable? And here’s another possible milestone we just passed. RealtyTrac is a national real estate tracking company that checks out local foreclosure rates nationwide. When I asked for the latest monthly foreclosure figures for MiamiDade, Broward and Palm Beach counties, I found that after the recession’s deepest period in March, foreclosure numbers in South Florida actually declined. South Miami-Dade residents have fun new ways to spend the summer at South Dade Park, 16350 SW 280 St. On Wednesday, July 22, Miami-Dade County Commissioner Katy Sorenson and the Parks and Recreation Department hosted the ribbon-cutting ceremony for a new splash playground and the skate court at park site. The grand opening was part of a free “Skate and Splash Bash,” where attendees enjoyed refreshments, games, and entertainment.
The additions to the park include a skate court and 1,424-square-foot splash playground (spray park). The splash area is designed with interactive elements and accommodates those with disabilities. The skate park features various ramps and equipment that let skate aficionados watch and participate in the sport. “These additions to South Dade Park provide a wonderful variety of activities for families, particularly during a recession when it is difficult to find affordable recreational activities to keep children active,” Commissioner Sorenson said.

Janine Hensley, who owns Aleren, kept getting requests for larger sizes, and decided to open an additional location to meet those requests. “Our customers are very sophisticated shoppers and the older girls wanted a more sophisticated place to shop focused on them,” Hensley said. Aleren expanded by opening a new “young contemporary” store in the Riviera Plaza at 1560 S. Dixie Hwy. (US1) in Coral Gables. While the Pinecrest location continues to focus on toddlers through size 14 girls, the Coral Gables store focuses on lines with
sizes for juniors and women. The store has an edgy feel with vintage, concretestained floors and metal fixtures stocked with designer brands targeted at juniors and women. Learn skills to create, maintain beautiful South Florida garden BY ADRIAN HUNSBERGER Would you like to learn the skills it takes to create and maintain a beautiful South Florida garden, and do you enjoy helping others? Now you can achieve those goals by becoming a Master Gardener volunteer for Miami-Dade County. Join this elite group of dedicated gardeners who help others solve their horticulture problems. The Miami-Dade Cooperative Extension Division will hold a preview session about this program on Thursday, Aug. 20, 3 p.m., at the John D. Campbell Agricultural Center, 18710 SW 288 St. in Homestead. The preview session lasts one-and-a-half to two hours. The program is for MiamiDade County residents only. Through the Master Gardener training program, participants receive more than 70 hours of classroom and field training from University of Florida faculty. Participants will learn about flower and vegetable gardening, fruit trees, insects, disease and plant identification, land-
scape care, proper pesticide and fertilizer use, and much more. Master Gardeners are individuals who are interested in gardening, educating and helping others, and making civic contributions through volunteer work. They help answer gardening questions on the phone at the Cooperative Extension office, help establish demonstration and school gardens, and they are plant consultants at local events. Even if you are not physically able to do much gardening, there are plenty of volunteer opportunities, To become a Master Gardener, simply attend the Master Gardener training program and complete an internship at the Homestead office. Classroom training is one day during the workweek from 9 a.m. to 4 p.m. Classes begin in September and run 11-12 weeks. Congregation to welcome its ‘new’ Torah with procession BY KIM FIELDER The Torah is a Hebrew scroll containing the first five books of the Old Testament and is the embodiment of the Jewish faith. Beginning with the creation of the world, and spanning Jewish history from Abraham to Moses, it includes the terms of God’s Covenant with the Jewish people. It addresses many aspects of life covering an entire range of human and social behaviors. In most synagogues, the Torah Scroll is kept in a Holy Ark, which is a cabinet or recess in the wall, covered by a curtain. Reading from the Torah is an important part of many synagogue services. When Congregation Ahavat Olam was founded four years ago in Kendall, Rabbi Danny Marmorstein wanted to find a Torah that survived the Holocaust for the new synagogue. He felt that reading from it would be the most meaningful way of honoring the memory of his grandparents and all others who perished in the Nazi death camps. Although most Torahs in existence at the time of the Holocaust were destroyed by the Nazis, there is a repository in London for surviving scrolls and Ahavat Olam was placed on its waiting list. This past spring Rabbi Marmorstein’s vision became a reality when he was invited to come to the repository and select a scroll for Congregation Ahavat Olam. He flew to London to examine the scrolls, each one having been carefully checked and recorded for identifying marks. After two days of examining nearly 50 scrolls, he came across one that had an inscription dated 1878. The inscription apparently had been overlooked by the examiners of the repository. A more thorough examination by Rabbi Marmorstein surprisingly revealed the Torah was in perfect condition; the parchment had not yellowed and the ink had not faded, as one would expect of a Torah that was over 130 years old. Further investigation revealed an amazing history; this Torah had been confiscated by the Nazis and preserved under the most perfect conditions, intending it to be displayed later in a museum dedicated to the obliteration of European Jewry. Torahs such as these, very few in number in the world today, were immediately spoken for when the repository
opened in 1964. This Torah had been overlooked. “In Hebrew, we say the sacred union of this Torah and Congregation Ahavat Olam is beshert,” Rabbi Marmorstein said. Its meaning, “‘It is meant to be.” Ahavat Olam will welcome this Torah into the congregation on Friday, Aug. 28, with a mile-long procession from Rabbi Marmorstein’s home, to the Temple at 10755 SW 112 St. in Kendall. Shuttles to the procession will run from the temple parking lot starting at 6:30 p.m., with the procession beginning at 7 p.m. The entire community, everyone of every faith, is invited to be part of the procession and the special Sabbath Service to follow. The Torah will be placed in the Holy Ark to first be read during the upcoming High Holy Days in September, the start of the Jewish New Year. The story has one more unique facet. A sofer, an expert Torah scribe, has become part of a team that is designing a protective breastplate for the Torah. In November of this year, once again the entire community, everyone of every faith, will be invited to write passages of scripture on a scroll that will be placed inside of the breastplate. A formal dedication ceremony for the Torah, the breastplate and all of its adornments will be held during the Jewish festival of Hannukah, a time commemorating the rededication of the Holy Temple in Jerusalem. MEET
ROCKY, GAIL, AND FUZZY I did not intend to have any dogs in my life, because I have always been so busy at work. When my best friendâ&#x20AC;&#x2122;s dog passed away, I went in search of a dog to replace her little Maltese dog. I looked on the Miami-Dade County Animal Services Website. While searching the website for her, I saw this adorable little puppy named Fuzzy. The minute I saw him, I knew that I had to rescue this dog and take him home with me. This picture is of me and â&#x20AC;&#x153;my boys,â&#x20AC;? Fuzzy and Rocky. Fuzzy is the dog on the right. When I brought Fuzzy home from Animal Services, he had been exposed to a severe case of Bordetella and he almost died. With love, and affection, intravenous fluids and antibiotics, he survived. Fuzzy was so lonely that he would curl up in a little ball every time I would leave for work. I knew I had to do something to ease his loneliness. A few weeks later, while I was driving down Old Cutler Road, I saw a firefighter selling baby Labrador Retrievers puppies on the side of the road. I stopped and there was one baby puppy left. That baby became my second puppy, Rocky. Together, me and my boys form our family. The boys love to walk together on the same leash. They are so proud when they are out walking and they strut their stuff. It is wonderful to have two adorable and precious dogs in my life. -Gail Grossman

Assurant donates $10,000 to YMCA Strong Kids Campaign BY ROBERT HAMILTON Assurant, a provider of specialized insurance products and related services and a major South Florida employer, has donated $10,000 to the YMCA of Greater Miami’s Strong Kids Campaign. The company’s gift benefits the Y’s after-school care program hosted at Campbell Drive Elementary School in Homestead, the donor’s school of choice. Assurant will be honored later this fall at an event at Campbell Drive. “Strong Kids is an important initiative in the YMCA’s ongoing efforts to address the changing needs of children and families in Homestead,” said Ana Rojas-Filliben, senior vice president, Corporate Communications. “In addition to this gift, Assurant will support various events and collection drives at [Campbell Drive] and encourage our employees to increase their volunteer involvement in other school activities.” Last year, the YMCA of Greater Miami committed over $750,000 in financial assistance for various community programs. Port of Miami winner of AAPA Information Technology Award BY ANDRIA MUNIZ-AMADOR The Port of Miami has been selected as the winner of the 2009 American Association of Port Authorities (AAPA) Information Technology Award in the Port Operations and Management Systems category for its Integrated Cargo Gate Vehicle Processing System. The criteria for this award was the implementation of new innovations in technology to enhance data flow for port operations; technologies to improve the safety and productivity of cargo and container handling; technological innovations for the tracking and maintenance of chassis, containers, cranes, and other yard handling equipment; methods to improve traffic flow, and improve truck turnaround time entering and leaving a terminal/port. The new state-of-the-art security gate complex includes 10 inbound lanes and six outbound lanes for the efficient and secure flow of trucks in and out of cargo terminal facilities. Automated features such as interactive consoles, a FastPass processing system and a prepaid scale
program speed the movement of truck traffic through the gate complex, while radiation portal monitors (RPMs) and other nonintrusive inspection technologies provide heightened security without impeding cargo flow. The new gates system has allowed the Port of Miami to meet its commerce needs, exceed state and federal security mandates, as well as enhance customer satisfaction. While ethnic restaurants serving up favored fare of most South American countries now abound in Miami-Dade County, those with authentic menu items of Peru still are a comparative rarity. For a non-Peruvian diner, there’s charbroiled chicken breast with rice or the Express’ own version of churrasco, a sizzling tenderloin steak with onions or fried plaintains to provides a more “Americanized” fare. A children’s menu of chicken fingers, fish strips or steak at $5.99 each underscores the appeal of family dining. BY MARILYN LUNA The Celtic Cultural Series will present “Irish Stories for Children” at 2 p.m. on Saturday, Aug. 29, at the Coral Gables Branch Library, 3443 Segovia St. The stories will be read by Dan Fitzgerald, past president of the Emerald Society, and Mary Ann Kerr, the current First Lady of the Emerald Society. Fitzgerald is a veteran of many plays and films. His latest film was In Her Shoes starring Cameron Diaz. He spends time each week reading stories to students in
the Miami-Dade school system. Kerr was a teacher in the Miami-Dade school system for 28 years. She has read stories at the Epiphany and Pinecrest schools. 2010 GLK is sporty new compact Mercedes-Benz SUV Ron Beasley AUTOMOTIVE EDITOR
LET’S TALK CARS The compact and stylish GLK is the newest member of the Mercedes-Benz sport utility vehicle lineup. Launched earlier this year as a 2010 model, the GLK looks like a smaller and lighter version of the popular GL. However, the sporty profile, angular nose and a steeply raked windshield distinguish the GLK from its larger sibling. Projection headlights and an integrated rear spoiler are additional distinctive features. The GLK350 has plenty of power with a 268 hp 3.5-liter V-6 engine under the hood mated to a 7G-Tronic7 seven-speed automatic overdrive transmission. It clocks 0-60 mph in 6.5 seconds and has a top speed of 143 mph. Mercedes says this is one of the most efficient engines it has ever produced, with lightweight casting, forged connecting rods, variable valve timing on the intake and exhaust valves,
variable intake tuning and advanced combustion techniques for cleaner emissions and more power. The new GLK is unique with its fourwheel independent suspension that gives it the ride of a sports car, while the Standard Agility Control suspension allows for both soft and stiff shock absorbers. Each twin-tube shock absorber is fitted with a hydraulic by-pass piston that acts like a very soft shock absorber to effectively dampen road noise and tire vibration. On bumpy or uneven roads, the by-pass piston is negated to preserve the steering and handling response of a stiffer shock absorber. The GLK has good ground clearance for off-road driving and the standard roof rack and optional running boards emphasize the versatility of the vehicle. Other standard equipment includes 19-inch alloy wheels, fog lights, roof rails and privacy glass and chrome detail elements inside and out. On the inside, the GLK has all the usual Mercedes-Benz luxury, but with some new features, too, such as the central controller on the console for combined control of the sound system, navigation system and telephone. panel and dashboard layout are more angular and purposeful, with all dashtop panels made of anti-glare black, regardless of the interior color scheme. One drawback to the GLK is the relative lack of cargo space. In the standard seating configuration, the GLK has a capacity of just over 23 cubic feet and even with the rear seatbacks folded down there is less that 55 cubic feet of load space. There is a smaller hidden storage area beneath the floor. A power tailgate is a nice option; the gate can be raised and
lowered with the push of a button. Suggested retail price on the GLK350 with 4MATIC is $35,900, but with such add-ons as the Premium Package, Multimedia Package, Lighting Package and Sport Appearance Package, the bottom line can easily reach $50,000.

Many homeowners and condominium associations throughout South Florida are experiencing a cash crisis as a result of owners failing to pay their required maintenance assessments. Without this necessary income, the associations bills pile up quickly leaving important services such as insurance, lawn care, management, and maintenance unpaid for, with some vendors unwilling to provide further services. Severe cases can leave associations without enough money to maintain basic necessities such as fire and safety equipment, security gates, and even water and garbage services. To make matters worse, some lenders are refusing to issue loans on the units within these communities and condominiums due to the severe delinquency rates of the associations, essentially putting a freeze on the marketability of such units. Much of the problem can be attributed to investors, many of whom own multiple units in the same community or condominium, not paying their assessments (some of whom receive income from tenants living in their units but still refuse to pay their assessments). An association’s best course of action is to find a competent, diligent and aggressive attorney. Legal incompetence (including not utilizing effective legal strategies for the current market), an attorney’s inability to communicate with the board and manager of the association, and/or the failure of an attorney to proceed aggressively and diligently on behalf of the association, can cause unnecessary delays and additional financial suffering. For instance, some attorneys advise their clients to follow the passive approach of not filing liens against delinquent units and not proceeding with association foreclosures, thinking that lenders will eventually foreclose their defaulted borrowers and pay the association its money. The reality is that in today’s market, lenders are stalling their foreclosures until they find buyers first, so the process can take an unreasonably long period of time. Meanwhile, if the first mortgage holder does finally take title to the unit through its foreclosure, it is then entitled by law to a sizeable write off of the prior owner's past due amounts, resulting in significant bad debt to the association. This bad debt is then absorbed by the association and eventually paid for by the responsible owners who are paying their assessments.

To succeed in the current market, associations need an aggressive attorney who files liens against the delinquent unit owners quickly and, in applicable cases, files foreclosure complaints (lawsuits) against the delinquent unit owners to collect the amounts due to the association. There is also a new blanket receivership approach where, by law, associations can petition the court to appoint a single receiver to collect the rents from all tenants living in units that are under foreclosure by the association or which come under foreclosure in the future (which prohibits investors from collecting income from tenants while failing to pay their assessments). Aggressively applied legal pressure against the owner and/or their lender is especially necessary in this type of depressed real estate market and will undoubtedly bring in a lot more money to the association in a much faster time than simply waiting for the lender to come through.
