New condo insurance requires unit purchase BY RICHARD YAGER

dded protection against storm damage was the primary basis that now requires condominium unit owners to purchase protection, over and above association-held coverage, according to a group insurance specialist. The change was applicable to policies issued or renewed on or after July 1. Consequences of the new law were reviewed by Lorraine Carrio, executive vice president of one of Florida’s top seven insurance agencies specializing in condominiums and homeowner association’s policies. “Every association board, as well as individual unit owners, should be aware of the need for coverage in existing policies,” she advised a sparse but attentive audience attending a Nov. 9 meeting of the Kendall Federation of Homeowner Associations (KFHA). Nature centers announce new hours of operation

espite severely slashed budget cuts elsewhere, Miami-Dade County Commissioners will keep Kendall’s LIFT program for seniors alive and well for fiscal 2009-10. “We were literally holding our breath since October,” said a relieved Ruth Hudson, president of LIFT (Living, Involvement, Fulfillment and Togetherness — the organizational name reflecting its philosophy). On Monday, Nov. 1, the word came to Hudson and the nearly 500 members among Kendall’s age 55-plus set that a $140,000 appropriation will stay in place to pay the rent, insurance, utilities, and other necessities to maintain

activities for another year. Finances have been a continuing problem for Kendall’s only organized non-profit, volunteer senior program, since 2004 when LIFT was ordered to vacate a 6,000-square-foot area at the former Town and Country’s Shopping Mall, contributed by a former ownership, The Codina Group, before planned demolition for new development by a corporation that later purchased the center as a real estate investment. Through two years that included four moves, LIFT continued its activities in temporary Town and Country storefronts until Miami-Dade

ue to required budget reductions, Miami-Dade Parks’ Nature Centers now have a new operating schedule. The following nature centers will be open every week from Wednesday to Sunday, 9 a.m.-5 p.m., and will be closed Mondays and Tuesdays: A.D. Barnes Sense of Wonder Nature Center, Arch Creek Park, Bill Sadowski Park and Castellow Hammock Park. The Crandon Visitors and Nature Center will be open MondaySunday, 8 a.m.-4 p.m. All nature centers will be open on holidays — except the Thanksgiving, Christmas and New Year’s Day holidays — regardless of what day of the week it falls. Miami-Dade Parks is the third largest park system in the United States, consisting of 258 parks and more than 12,600 acres of land. It is one of the most unique park and recreation systems in the nation. The owner’s condominium association is named as an additional insured and loss payee, with coverage required regardless of any exemption under existing condo documents. “It’s particularly important that the coverage is in place now, if only because of the current increased numbers of foreclosures creating potential deficits for budgets administered by boards,” she stated, adding the current economic downturn “waves a red flag” to review, revise and possibly tighten all owner insurance policies. “Empty units that sit without air conditioning for months can wreak havoc on adjoining wall structures through mold accumulation alone,” she said. Condo owners obviously are affected by what may be happening in an empty residence next door. “Frankly, it can become a crazy situation in areas like these,” she added. “But that’s all the more reason why associations and individuals need to be aware of

exactly what their policies cover — and especially, what they may not.” Carrio urged association board members and individual homeowners to review coverage “if only because of the limited number of carriers still writing policies following Hurricane Wilma.” The state’s “safety net,” Citizens Property Insurance Corporation created by the Florida Legislature in 2002,” will be raising rates by an estimated 10 percent as of the first of the year,” due to as much as $1 billion required by additional claims during the past year, she said. “We have been nearly five years without a major hurricane but the losses from Wilma in 2005 remain significant for property owners, if only because so many carriers quit writing in Florida and have not returned, as might be expected, due to the economic downturn of recent years,” Carrio added. “Check everything to make sure you are covered, even to furnishing anti-slip abrasive carpeting around a dumpster area to avoid lawsuits,” she said. “Demographics from 2008 to 2009 have changed the insurability of condominiums; board members need to be aware of where they may need new or added protection.” For details, visit online at <www.kfha.org> or to contact Corporate Insurance Advisors, telephone 1-954-3155050.

That sum also allowed LIFT to sign a five-year lease in 2007 with Kendall Breeze Shopping Center, 12480 SW 127 Ave., and occupy 4,500 square feet of space on the upper story of an L-shaped retail-commercial building, south of Publix. Quartered in a combination of roomy areas, Kendall seniors for three years have existed without financial concerns, thanks to an annual $140,000 appropriation from the county’s general fund, aiding senior activity daily from 10 a.m. to 4 p.m., Monday through Friday. “It also allowed us to buy a new pool table that was delivered last Monday [Nov. 9],” said Hudson, now in her sixth year as LIFT president, ably assisted by Marilyn Green, vice president; Shirley

Gruber, treasurer; Joyce Woolridge, recording secretary; and Barbara Mlcuch, corresponding secretary plus a host of volunteers. It means that square dancing under Bud Miller will continue to meet from 10 to 11:30 a.m. each Wednesday, classes on 20 units will be taught in a separate computer room and an overflow art class will remain in session for three hours every Tuesday morning. Other activities from learning Spanish to playing Mah Jong, bunko or tap dancing can go forward. Three outings to Actors’ Playhouse in Coral Gables will go ahead as planned through January, “Mini-Vegas Cruises” will continue with a bi-monthly lunch and a sold-out Birthday Bash on Dec. 13 will mark senior birth dates, all on schedule. Open ‘back door’ deals says Souto Michael Miller EXECUTIVE EDITOR

AROUND TOWN Commissioner Javier Souto is sponsoring a resolution to strengthen the Sunshine Law by opening the door to suspected wheeling and dealing with Commission votes. On December 1, he will ask 12 Commission colleagues to outlaw any individual or collective vote trading between Board members and county administrators. His ordinance proposes disclosure of all meetings on pending legislation between any County Commissioner(s), Mayor Carlos Alvarez, County Manager George Burgess, or their assistants and Department Directors, taking place in any public form, whether a briefing or a formal meeting. Such wording would prohibit ‘back door’ deals many suspect occur downtown, just as in D.C. by elected reps and the executive branch. “Our state’s Sunshine Law was put in place to ensure that people had easy access to their government’s proceedings, as well as transparency in government,” says Souto. “How can the people trust the legislative process and their local government when all the decisions are made behind the scenes as part of back room deals and vote trades? While very difficult to prohibit outright, we can at least take (them) out of the corridors and back rooms and require any tit-for-tat to be discussed in a public forum or memorialized in writing, where it is made available to the press.” The current law fails to apply to communications or outright vote solicitation between administrators, the Mayor and a County Commissioner or multiple Commissioners, he adds, concluding: “The public is entitled to know if their Commissioner voted to raise taxes in

exchange for a pet project being included in the budget or voted against the labor unions in exchange for support for a law the Commissioner is sponsoring.” All we can add to that is: HEAR! Community Council non-zoning meetings will be the subject of a January 14 workshop that Commissioner Jose ‘Pepe’ Diaz will chair as sponsor of the resolution to reduce the current countywide 10 to four regional boards. That was the key outcome of a County Commission Government Operations subcommittee meeting November 9 when no specific recommendation was made, according to an aide for Chairperson, Com. Carlos Gimenez. All Comish Committee members oppose member appointments, informs a second reliable source. East Kendall Council 12 was present, bird-dogging the process! Commissioner Joe Mar tinez honored Detectives William “Bill” Nadramia and Alberto D. Morciego, Sgt. Steven P. Signon and Lt. Eric L. Garcia with special commendations for matching DNA evidence connected to four sexual assault cases to William Angel Rivera, believed the infamous “Kendall rapist” attacking women during the early 1990s. Baptist Health Home Care recently named to the 2009 HomeCare Elite list, a compilation of the most successful U. S. Medicare-certified home health agencies, by the scoring in the top 25 percent of nearly 9,000 home care agencies nationwide. First, airport racetrack; now, drilling in Everglades R. Kenneth Bluh KENNETH’S COMMENTARY You thought that the idea of creating a racetrack at the airport in order that the county could install slot machines in the terminal was a crazy idea? Try this one for size. The Miami-Dade County Commission is considering leasing a tract of land that Miami-Dade County owns in the middle of the Everglades for oil drilling and/or gas exploration. We dread beach contamination if the government permits oil rigs miles offshore in the Atlantic Ocean. Yet our county commissioners would drill for oil in the middle of our source of drinking water to develop a few bucks? How desperate can we get when we are short of money? Our county government wasted millions of dollars when we were flush with real estate tax revenues. We never thought about a rainy day. Now that money is tight, these elected officials

would sell out our biggest asset — the Everglades. Incredible. Thirty-five years ago the county acquired what was called the Everglades Jet Port, with the possible intent of relocating Miami International Airport to the middle of the Everglades, roughly halfway between Miami and Naples. Naturally, the idea died as anyone with an ounce of sense realized that having thousands of airplanes taking off and landing, together will all the traffic from passengers trying to get to and from the airport would pollute the Everglades beyond recognition. Interestingly, an article appeared in The Miami Herald a few days after the oil drilling news: The environmental group, Friends of the Everglades, founded in 1969 by Marjory Stoneman Douglas, was closing down for lack of revenue. More than likely contributors perceived that the major threats to the Everglades are understood and are now being resolved. The federal government realized the value of the Everglades and has committed multimillions to unblock the earthen dam created by the construction of the

––– VIEWPOINT ––– Tamiami Trail (US 41). The Everglades is vital to the survival of South Florida. Local environmentalists have known this for many, many years. The State of Florida and the federal government have acknowledged this. What is wrong with our county commissioners? The creation of the Big Cypress National Wildlife Preserve, which encompasses the Everglades Jet Port site, was created in part as a result of the anticipated disaster that would have been caused by the creation of an “Everglades” airport 35 years ago. I would suggest that our county commission look elsewhere to find the money needed to cover its mismanaged projects such as the expansion of the airport, which is now at a cost overrun of $2-plus billion and years behind schedule. Perhaps [tongue in cheek] the coun-

ty commission could put the anticipated horse racetrack in the old Everglades airport site. First, we wouldn’t have to worry about car traffic as no one is going to drive halfway to Naples to watch horses run. Secondly, I don’t think the small amount of horse manure that would be dropped, when added to all that coming from the birds, bobcats and alligators would hurt the waters of the Everglades. You’ve got to hand it to our county commission and county management — they are creative. We appreciate your opinions on this column whether in agreement or disagreement. Loan modification, foreclosure, short sale or bankruptcy? What should I do? BY DANIA S. FERNANDEZ, ESQ., Attorney at Law I am asked this question everyday. Not everyone is going to have the same alternatives. However, understanding your options is the first step to saving your home and your sanity. Is a Loan Modification for me? The Making Homes Affordable Plan is President Obama’s loan modification plan that helps homeowners who are struggling to make their monthly mortgage payment stay in their homes. This plan requires lenders to reduce monthly payments to no more than 31 percent of the homeowner’s monthly income. The first step in this plan is to lower the interest rate of the loan—sometimes as low as 2%. Second, if the mortgage payment is still too high with the reduced interest, then the loan may be extended to a 40 year term. Third, if the monthly payment is still not affordable, then there may be a reduction of the principal of the loan. Is a loan modification what you need? It is if you want to keep your home. I see loan modifications being given every day, allowing homeowners to stay in the home they have worked so hard to keep. Why do I need to defend my foreclosure with an attorney? Once you are given a complaint to foreclose, take that complaint to an attorney so legal responses can be given to the complaint. The response should be specific to each point/count made in the complaint; and affirmative defenses should be formulated for your individual case. The attorney you hire should know foreclosure law, mortgage law and how to properly prepare and answer the foreclosure complaint. If you fail to answer appropriately you risk your right to bring any affirmative defenses against the lender. Do you need to defend against a foreclosure? If you want to save your home and your credit, the answer is yes. Even if you are working on a loan modification, are in the middle of a short sale, or simply want to avoid foreclosure on

your credit you must take legal action to prevent the foreclosure process. Should I agree to a short sale and leave my home? If you want to throw the towel in or you do not qualify for a loan modification, then a short sale is a good option. A short sale is when a lender accepts less than what you owe on the property and agrees to the sale of your home. With a short sale, you need to find a realtor experienced in short sales; and an attorney who can properly negotiate the short sale with your lender. The short-sale process is similar to a loan modification and must be properly executed so as not to delay the closing and ultimately lose the interested buyer. Should I file Bankruptcy? If so, when and which Chapter should I file? Bankruptcy is a perfectly legitimate way to stop foreclosure, put an end to lawsuits, protect paychecks from garnishment, and regain control of your financial situation. However, this should be your final option after having tried reaching a loan modification, you have defended your foreclosure with a real estate attorney and time is ticking towards the foreclosure sale date of your house. In the Chapter 7 Bankruptcy there is no loan modification option and if you stop paying your mortgage you could lose your home. In the Chapter 13 Bankruptcy you can save your house and you are given time to pay off your debt. Do not lose hope. Changes and new programs are being offered to help homeowners every day. Even though this is a time of great challenge, do not forget the true meaning of life—the love of your family, the beautiful children you may have and the beautiful place you live in. Frequently, therapy for swimmer’s ear (otitis externa) involves the use of a prescription ear drop that relieves pain and is now available in a non-brand version known as "antipyrine and benzocaine". However, in some patients, the topical analgesic benzocaine can cause irritation and worsen or prolong inflammation, so in those cases, oral pain relievers may be preferred. For severe ear pain and itching, ear preparations containing an antibiotic and a cortisone-like steroid can be used to fight infection and reduce inflammation. Suspensions may be less acidic and therefore less irritating than solutions that contain the same medications. Special care must be taken if there is a chance that the eardrum is perforated, because some medications can be ototoxic (affect hearing) if they enter the inner ear. According to the Pharmacists’ Letter, if a patient complains about a bad taste after using their ear drops, it is a sign that the eardrum is perforated, and the doctor should be notified. BY RICHARD YAGER It’s almost always a sellout because there are just 200 tickets to go around for Miami Elks Chapter 948’s annual Charity Ball, an event themed this year as a “Winter’s Tale” that begins at 6 p.m. on Nov. 21. With 1,200 members, Miami’s oldest Benevolent and Protective Order of the Elks chapter should ring up another success, just as it has been doing for more than a half-century, the last 20-plus years at the Lodge’s activity-oriented complex at 10301 Sunset Dr. Tickets at $40 per person for festive beverages and a prime rib dinner (plus miniauctions and program advertising) are expected to realize $20,000 or more to help fund a host of community causes supported by Elks members during 2010. The night of dining and dancing in 2008 was themed around “New York, New York” but this year, the decor for “Winter’s Tale” will include a forest of icy branches and decorated evergreens in the main dining room. Complimenting the scenery will be handsome crystal place settings on white table linens, bathed in soft lighting to provide a northern glow for the evening gala. Realized dollars will help fund services like the local chapter’s free child therapy program and keep over 6,000 Kendall and Miami area youth busy in an after-school “Hoop and Shoot” competition, while

assisting disadvantaged and disabled youth at a state Elks Youth Camp. To maintain such activities, the Elks always “welcome new members,” said Joaquin (Jack) Lopez, ball chair whose planning committee includes nine others. “I joined the lodge several years ago with my buddies for a weekly night out with the boys,” Lopez said. “Soon I realized that the lodge had much more to offer besides the restaurant and lounge services. I’ve made so many friends here, and all were incredibly supportive of Lina and me when our son was deployed to Iraq.” Originally established downtown in 1905, Elks Lodge 948 members have had three homes in Miami, the first on Flagler Street and a second at Brickell Point before the chapter occupied what many call “The Taj Mahal of Lodges” in Kendall, according to Robert Schmidt, a veteran trustee who, with William Henderson, Exalted Ruler, and fellow officers, greet new members at the lodge every week. Charitable services supported by special events are only part of what occupies Elks the year-around in their contemporary Sunset Drive quarters where the grounds include handball and tennis courts adjoining a central building housing offices, meeting rooms, a lodge hall and main dining hall with full bar and an oak dance floor added in 2006. The event, which attracted more than 150 viewers to the opening, is co-sponsored by the Rotary Club of Miami Dadeland Pinecrest and the college, and is held in memory of Rotarian Robert Horwitz. Four students received $350 each and a commemorative plaque for their winning entries. They are Javier Bejamno, paint-

32nd Annual Miami Greek Festival returning to Kendall, Nov. 20-22 BY DANIELLE BECK PAPPAS During a time when many businesses are closing and the economy is struggling, there still remains a Miami tradition that lives strong. The 32nd Annual Miami Greek Festival in Kendall begins on Friday, Nov. 20, and continues through Sunday, Nov. 22. Presented by St. Andrew Greek Orthodox Church, the Miami Greek Festival provides all things Greek — from mouth-watering food and homemade pastries to authentic music and dance. For more than three decades, this colorful celebration has offered a fun, festive way for the Miami community to be a part of the Greek culture — if even just for a weekend. “We’re excited once again to present this wonderful event,” said festival cochair Alex Sarafoglu. “Although times are tough for many of us right now, we think everyone is ready to come out and

party Greek-style and enjoy the food and fun that this tradition provides year after year.” So, while a trip to Greece may be out of budget for now, individuals can still enjoy a delicious taste of it — both gastronomically and culturally — right in their own backyards. “Our goal is to celebrate the Greek culture with the community,” Sarafoglu said. “There’s something for everyone, even rides for the kids.” The Miami Greek Festival, the church’s largest fundraiser of the year, is open from 11 a.m. to 11 p.m. all three days at St. Andrew Greek Orthodox Church, 7901 N. Affordable Senior Living: Options to Pay for a Great Lifestyle BY HELEN SHAHAM Q. Planning to move to a senior living community, I put my home on the market more than a year ago. With the current market, I haven’t been able to sell it. I’d like to move sooner rather than later. Are there any new, maybe nontraditional options for funding senior living? A. Seniors who prefer the peace of mind, care-free lifestyle and enhanced opportunities for socialization afforded by senior living communities, are finding new solutions for addressing the lack of traditional funding. According to Richard Rash, a Certified Reverse Mortgage Specialist with Transcontinental Lending Group, Inc., seniors 62 years of age and older typically did not have the best options when it came to getting cash from their homes. But today, there are alternatives available: Reverse Mortgages A reverse mortgage enables you to convert part of the equity in your home into tax-free income without giving up title or take on new monthly mortgage payment. Instead of making monthly payments to a lender, as with a regular mortgage, a lender makes payments to you. “Traditional home loans only offered the option of either selling the house or borrowing against its equity,” explained Rash. “With reverse mortgages coming on the scene, seniors now have some additional cashflow alternatives. This type of loan allows mature borrowers to convert their home equity into taxfree income.” The amount of funds you’re eligible to receive depends on several factors including: your age; home’s appraised value; interest rates; and the lending limit in your area. Typically, the older you and the more valuable your home, the more money you’ll receive from the lender. With a reverse mortgage, you can choose how you want to receive the money: all at once as a lump sum; fixed month payments for a set term; or as a line of credit which allows you to draw proceeds at any time. The reverse mortgage loan is repaid when your home is sold. If your home

sells for more than what is owed on the reverse mortgage, then the excess money goes to you or your estate. Life Settlements If you have a life insurance policy, life settlements are another technique for you to pay for a senior living community. This involves the sale, assignment, transfer or bequest of a life insurance policy by a policy owner to a third-party investor. Rash says the policy owner typically receives cash (generally an amount greater than the cash surrender value in the policy but less than the full amount of the death benefit) and the new owner becomes responsible for the payment of all future premiums. Asset Backed Lending With asset backed lending, you can tap into the potential power of your stock and bond portfolios without having to end their participation in possible future growth. You can leverage your securities and, depending on the quality and stability of the collateral securities, could borrow as much as 85 percent of their portfolios as cash. These are just a few of the financial options available to seniors. I recommend you seek the advice of your accountant or tax advisor for information specific to your case as you begin weighing your options. Most recently at The Palace communities, a few of our newest residents have tapped some other methods to offset the costs of retirement living. VA Benefits The U.S. Department of Veterans Affairs’ Pension with Aid & Attendance Program offers assistance to veterans and/or their surviving spouses. In order to qualify, applicants must prove that the majority of their income is spent on medical expenses such as co-pays, insurance deductibles, prescriptions, caregivers or assisted living community expenses, etc. The VA reimburses the veteran up to $1,644 per month and the surviving spouse up to $1,056 per month. A Veteran Service Center can provide specific information on how to qualify for VA benefits. They can be reached by calling 305-270-2940. Medicaid Diversion Program The Long-Term Care Community Diversion Program may also help cover the costs of senior living, more specifically assisted living communities. The Medicaid Waiver program is designed to provide community-based services to people who would otherwise qualify for

Security Agreement Senior living communities may offer special incentives or programs to assist with expenses. For example, The Palace’s new “Security Agreement” allows you to move to the community paying only a discounted monthly rate (whatever you can afford without selling the home) while you await the pending sale of your home. Once your home is sold, The Palace is reimbursed the accrued rental difference with minimal interest fee. If you continue to have difficulty selling your home, you may consider proceeding with your move to retirement community and having a relative or friend rent the existing home to help offset costs. The five-passenger Forte has crisp styling, with swept-back headlights and a sleek profile. It’s available in three trim levels — LX, EX and SX — and pricing ranges from $13,695 for the base LX, $15,795 for EX and $17,195 for the sporty SX. Forte has a unibody structure with an independent front suspension, MacPherson struts and a stabilizer bar, and a torsion beam rear suspension with struts and coil springs. An engine-speedsensitive, power-assisted rack-and-pinion steering system allows for precise handling in just about any road condition. Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.

If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments. Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
