Park’s amphitheater welcomes ‘Battle of the Bands’ BY GARY ALAN RUSE

The “Battle of the Bands” concert and competition on Saturday, Mar. 27, was the very first outdoor special event at the new Edward and Arlene Feller Community Room and Amphitheater at Ludovici Park, drawing a modest crowd in pleasant weather for a program starting at 7 p.m. and running until just after 10 p.m. Of the 10 bands that entered the competition, seven were selected to perform: “Heroes and Cons,” with Adam Fernandez, Neil Goldman, Bryan Horne, Sam Bush and Greg Bush; “Serpentine,” with Julio Sanchez and Carlos Devin Fernandez; “Offbeat,” with Kawan Amelung and Jason Kozarek; “Sane,” with Nick Gladieux, David Palmer, Nicolas Naranjo, Jeremy Bryan and Carlos Delima; “Dark Around the Edges,” with Sean Smith, Alex Musarra, Babatunde Carew and Davin Sosa; “Xpelled,” with Emily Barron, Jake Dalton, Eric Green, Christian Padron and Chloe Santiago, and “The Robot Tea Party,” with Nick Verrire, Isaac DaSilva, Christian Anteen, Pedro Aviles and Javier Amador. Village Parks and Recreation director Fanny Carmona Gonzalez welcomed everyone and made the introductions, including student Yelina Davis who served as the event’s emcee. Davis also, with Bethany Keime, ran the auction of special items to benefit Perrine Elementary’s fifth grade class. All of the groups participating were rock and roll bands with varying degrees of stage experience. All seemed to enjoy the opportunity to perform there and the amphitheater itself drew high praise from many people in attendance, including Cutler Bay Vice Mayor Ed MacDougall. “I’d like to see something like this in Cutler Bay,” MacDougall said. Student’s foundation spreads wheelchair impact awareness

T

he WheelCharity Foundation, founded by Coral Reef High School junior Nicole Brandfon in February, is on a mission to spread awareness of the impact of wheelchairs on society. According to the foundation’s website at <www.wheelcharityfoundation.com>, its members currently are collecting wheelchairs, ramps and walkers to be donated to disabled people who cannot afford these essential aids.

Members visit local middle and high schools to explain to students the reasons why people use wheelchairs and how they can help the wheelchairbound community. Brandfon already has visited Palmetto Middle School, and in the coming weeks plans to visit other elementary and middle schools. Nicole’s inspiration for starting the foundation came from her mother, Beatriz, who in November 2008 suffered three strokes, forcing her to use a

The official opening of the Miami-Dade Public Library System Palmetto Bay Branch, 17641 Old Cutler Rd., took place on Friday, Mar. 19. A large number of residents joined in the ceremony along with library director Raymond Santiago and staff, Miami-Dade county manager George Burgess, assistant county manager Alex Muñoz, Palmetto Bay Mayor Eugene Flinn, Vice Mayor Brian Pariser, Pinecrest Mayor Cindy Lerner, Palmetto Bay Council members Ed Feller, MD; Howard Tendrich, and Shelley Stanczyk; village manager Ron Williams, village staff, and a number of other county

officials and staff. The 5,000-square-foot building is located on the grounds of Ludovici Park with miles of lush green space, pleasing walkways, and well-lit parking. The complex also is connected to the historic Old Cutler Road trail, which allows residents to walk or bike to enjoy the collection of 21,000 books and materials, free Internet access with WiFi, as well as classes on financial assistance, jobhunting or resume writing, and a variety of adult, teen and children’s programs. The library is open Monday, Thursday, Friday and Saturday from 9:30 a.m. to 6 p.m.; Tuesday and Wednesday from 11:30 a.m. to 8 p.m., and is closed on Sunday. For information, call 305-232-1771.

the votes were tallied and a tie was announced, with First Place going to “Dark Around the Edges” and “The Robot Tea Party.” Each band received $200 and an additional $100 was awarded to Perrine Elementary. South Motors, which co-sponsored the event, provided the cash prizes. Judges for the event were Palmetto Bay Mayor Eugene P. Flinn Jr., “Mosquito Heads” band member Ron Derrick, “Miamians” singer Mike Espinoza, and students Hannah Keime and Patrick Muñoz, both 11 years old. Sound engineer Dwayne Summers ran the audio for the event and will, through the Commercial Music Department of Miami Dade College, provide studio recording time for the winners. Organizers Stephanie Keime and Sarah Muñoz, working with the Village Parks and Recreation Department, pulled everything together with an assist from volunteers such as Albert Stellmach, Gideon Keime, Juan M. Zamora and others, all of whom put in a lot of hours to make the event happen. Gonzalez was pleased with the concert/competition. “It’s a great event that we hope to continue to have many more times,” Gonzalez said.

“This is the perfect setting for this type of event. People came out with their blankets and picnic baskets to listen, and the performers are the youth of our community.” Sean Smith, lead singer for “Dark Around the Edges,” one of the winning bands, said he normally performs a few times each month at coffee houses and other locations, but he especially liked the Battle of the Bands and the amphitheater. “I think it’s really great,” Smith said. “It’s awesome that it’s such a family friendly event. I play a lot of shows for teenagers, and it’s good to be here with clean fun and a good environment. It’s a very nice setting — probably one of the best shows I’ve ever played.” Pedro Aviles of “The Robot Tea Party,” the other winning group, felt good about the win and also enjoyed the amphitheater. “I like being outside better than inside for stuff like this, so this is a good idea,” Aviles said. “Our group started a year ago, so today is our anniversary.” Javier Amador, also with “The Robot Tea Party,” agreed, saying, “I’m totally happy with the way things turned out.” Another band event likely will be scheduled sometime this year, with the date and details still to be decided.

Living with someone confined to a wheelchair gave Nicole a firsthand glimpse into this altered lifestyle. “It’s really hard,” Nicole said. “There are ADA [American Disabiliity Act] guidelines you’re supposed to follow. Most places follow these guidelines, but there are still narrow passageways, [inconveniently located] steps, silver door linings [that obstruct a wheelchair-bound person’s path].” The WheelCharity Foundation’s website identifies several things to keep in mind when dealing with a wheelchair-bound person. For example, it’s always a nice gesture to offer that person assistance by speaking to them directly, but if they decline, don’t insist. Also, if you’re having a long conversation with someone in a wheelchair, sit in front of them so that your eyes generally are level with theirs. Anyone can vouch for the fact that it is uncomfortable to be looking upward constantly while speaking to someone. For a complete list of these guidelines, go to the website and click on the

“info” tab. To help raise money for the cause, Nicole has started a penny drive. In a nutshell, she has placed a jar in her kitchen, so whenever people pass by and want to help out a good cause, or just get change for a dollar, they deposit some money in her jar. She is planning to institute this fundraising effort at her sister Hayley’s bat mitzvah this month and place jars at local businesses, as well. Having raised $20 just with the jar in her kitchen, she’s optimistic about the prospects for the additional ones, too. For the time being, the WheelCharity Foundation is local to the area. Brandfon suggests that it will expand progressively to other areas. The WheelCharity Foundation is trying to fill positions in its organization. Available positions include planning chair, promotion chair, community service chair and secretary. Workshops will be going on from noon to 5 p.m. on various topics including: Raised bed organic gardening; raw foods preparation, introduction to permaculture design; retrofitting your home for greater efficiency; growing a food forest in your backyard; Qigong and Yoga; every child outside; World Café, deep ecology, and more. EarthFest also will feature musical and artistic performances by groups including Heavy Pets, Teri Catlin, Sosos, PHIsonica with Kavayah Amn and Xavier Hawk, Soulflower, Jai (formerly Soul Temple), Jude Papaloko, and Lucho performing an Earth healing ceremony hosted by Val Silidker. There will be a community drum circle and patrons are encouraged to bring a drum or other percussion instruments to participate. Okay, so that’s an old joke, but we did want you to know that since Earth Week takes place April 19-24, the Village’s 3rd annual participation in the event includes Biscayne Bay kayak trips on Saturday, April 24, hosted by the Tropical Audubon Society. The cost is reduced to $10 this year, and the first 50 to register get a commemorative Earth Week t-shirt, sponsored by Community Newspapers, Inc. You never know who you’ll run into… At the recent Battle of the Bands, held at that really jazzy facility, the Edward and Arlene Feller Community Room and Amphitheater at Ludovici Park, we heard that besides the usual folks you would expect to see there sharing the moment, there were some you might be surprised were together. Mayor Gene Flinn and Pamela Gray were having a good chat and apparently are “best buds” despite the fact that they’re rival candidates for the county commission seat being vacated by Katy Sorenson. Well, hey, that sure beats the usual politics we’ve been seeing lately. And by the way, also among those folks there checking out the facility were Cutler Bay Vice Mayor Ed MacDougall and Ken Kurtz, a local stage lighting and set design whiz who used to teach his craft at the University of Miami Ring Theater. But wait, you also get… Due to limited space this issue, there wasn’t room for more than one of the photos we had cover-

Plugging the state’s budget hole with stimulus money R. Kenneth Bluh KENNETH’S COMMENTARY The Florida House and Senate, controlled in the main by elected officials who vehemently oppose Washington’s stimulus packages as inflationary and spending beyond our ability to repay, are hypocritically looking to plug the hole in our proposed state budget with an anticipated $880 million in stimulus dollars from Washington, DC. I have no problem with our elected officials in Tallahassee philosophically opposing the concept of excessive spending in our nation’s capital. But, I do strenuously object to their backdoor use of that same money to solve the problems that, in many ways, they created. The members of our Florida Legislature did not create the employment problems facing our state. But, they seem to be doing little to help ease the problem. Basically, we must generate state income, reduce

costs to balance our state’s budget, and create jobs. Generating income at times can appear tricky. A good example is the Senate’s cap on sales taxes as they apply to buying high priced boats. At first glance, the idea of capping sales taxes at $18,000 regardless of the purchase price seems to be a big gift to the yacht brokerage business. But the concept is sound as purchasers of expensive boats completely bypass paying a sales tax by going outside the state, establishing an investment corporation, and bringing the yacht back into Florida waters, sales tax free. Contrast this with the sales tax exemptions on skyboxes at ballparks and football stadiums. You can’t go outside the state and buy a skybox and bring it back into the state as you can a yacht. So there is no excuse for not taxing skyboxes. The simple answer is to tax all goods and services in our state to generate income. Taxing all goods sold and services rendered could be offset by a reduction in the sales tax percentage because we would be generating so much money.

–– VIEWPOINT –– I know my attorney friends will object to this statement. But, do we really think that an unhappy couple will stay married rather than proceed with a divorce because they must pay a service tax on the legal fees required to end their marriage? Will we really stop creating new corporations because of a service tax? I don’t think so. One major revenue for the state is the dollars generated by gambling. The Seminole tribe currently is paying the State of Florida $37.5 million a month for the privilege of running gambling establishments in the state. We receive $37.5 million a month, when 12.5 percent of our workforce is unemployed. Just think of the dollars we will receive when everyone is working. The legislature has a very difficult and delicate balancing act when granting gambling licenses to racetracks and kennel clubs around the state and at the

same time not upsetting the Seminoles who would like to control 100 percent of the gambling in the state. If the conservatives in Washington are successful in eliminating or at least greatly reducing the current spending levels, the anticipated $880 million in stimulus money needed to plug the hole in our state budget will disappear. It is time for a mental reconciliation between conservatives in Tallahassee and in Washington. Ladies and gentlemen, you can’t have it both ways. Years ago, one of my clients opened a Traditional IRA and made non-deductible contributions for many years, since he fully participated in his 401k. The reason he did this was because he was trying to shelter as much income as possible from taxes. The fact that he was not deducting his annual Traditional IRA contributions will turn into a huge benefit for him this year. With the passing of the new law, he will now be able to convert his Traditional IRA into a Roth IRA. In the year 2010, anyone is allowed to convert their Traditional IRAs into Roth IRAs regardless of income amounts. This client started making Traditional IRA contributions in 2001 when the contribution limit was $2,000. He continued to make these contributions through the years and increased them as the contribution limits increased. His total nondeductible contribution amount was $31,000. Knowing this nondeductible amount is important because this amount is convertible to a Roth IRA tax free. Since he was not able to deduct this amount from his income taxes in the past, he does not owe taxes on this portion. The only part of the Traditional IRA that is taxable at the conversion is his appreciation. Well, this is a time that having a stock market decline is actually a benefit. His portfolio value is now approximately $32,500 meaning that his taxable amount is only $1,500. He has the option to pay this tax fully in 2010 or spread it over 2011 and 2012. Since it is a small amount he will pay it in 2010, avoiding the potentially higher tax brackets in 2011 and 2012. This client now has more than 20 years to sit back and watch his new Roth IRA grow tax-free for him. All available land must be purchased to save Everglades To the Editor: The restoration of the Everglades is a massive undertaking. It must start with the purchase of any and all available land for the storage and treatment of the water that will be diverted to the Everglades to re-establish the sheet flow that has been interrupted through many ill-conceived canals, dikes, berms, roads, highways and railroads. Land not purchased specifically for Everglades restoration will be subject to purchase by builders and developers who have no interest in the restoration process and whose ultimate use of the land will be to build projects that contravene the restoration effort. This not only applies to the U.S. Sugar Corporation lands south of Lake Okeechobee, and to downstream lands as far south as Florida Bay, but also to enough land north of the lake to provide storage and treatment for water that will be introduced into Lake Okeechobee. Once the sheetflow has been re-established, it must be protected against future interruption, and that can only be guaranteed if the Everglades lands belong to the state. The many obstructions to sheetflow must be plugged, removed or fitted with culverts, bridges or elevated portions of highways to allow passage of water and migrating wildlife, both floral and faunal. Mistakes were made in the past that must be rectified. The present generation is not responsible for these mistakes, but sadly, the responsibility for the rectification must be borne by this and future generations. It should not be a question of money, and if a special tax or an addition to the present sales tax must be assessed, so be it. The restoration must take place whatever the cost. Florida is a special place to live, not only for people, but also for the diverse forms of wildlife that attracted residents and visitors in the first place. Without a restored Everglades, the quality of life enjoyed by Floridians will be decreased and eventually will cease to be. Kabbalah comes to Kendall in just ‘29 Amazing Minutes’ BY ROBERT HAMILTON

“Studying Kabbalah has helped me find my place in the world,” long time Kendall resident Anita Swartz said while explaining her feelings for Kabbalah and the exciting opportunity to share this knowledge with her Kendall friends and neighbors of more than 30 years. Anita and her daughter, Nadine, first discovered Kabbalah 13 years ago and are thrilled to participate in bringing Kabbalah to the community. Kabbalah Kendall will be kicking off a series of classes with a dynamic free introductory program, “29 Amazing Minutes,” on Tuesday, Apr. 20, presented by Zev Auerbach, a student of Kabbalah for many years. Zev has been presenting his “29 Amazing Minutes” to huge crowds all over South Florida from Boca Raton to Weston and Aventura, and is happy to share his story with the Kendall community. Zev credits Kabbalah with many personal miracles in his life, particularly with family members who have benefitted tremendously thanks to the applied principles of Kabbalah. He is well-known in the advertising world as the creative director of Zimmerman Advertising and in the public service arena as a commissioner with the City of Aventura. For Anita Swartz and her husband, Alan, the study of Kabbalah has been life changing. Alan, a pediatrician in Kendall for 30 years, began studying Kabbalah as a way to spend time with his wife, a nutritionist. “We had to drive over an hour for our classes, but it was well worth it,” Alan recalled. “Kabbalah teaches you what it means to be a human being.” In his practice, Alan has incorporated his Kabbalah knowledge to help his young patients. “I see a large number of children that have

ADD (Attention Deficit Disorder), they are anxious and unhappy at such a young age, but I explain the bigger picture in life to them, and that with each new challenge we have the opportunity to grow.” Along with Alan and Anita, their daughter Nadine and son Mark also have experienced positive life changes. “I know my actions have the ability to change the world,” Mark said. “I realize that I can be in the driver’s seat and go for everything I want.” Nadine, like her dad, is able to mesh the study of Kabbalah with her work as a clinical social worker for a private mental health agency. Since her first exposure to Kabbalah, when “everything the teacher said just made sense and clicked,” Nadine has been active in studying and mentoring others. She also volunteers with the organization SFK (Success for Kids) a related program that utilizes spiritual principles to help at-risk children. Anita recalls an immediate pull to Kabbalah’s teachings as soon as she began her studies and an indescribable change in her life. Anita is a native of Venezuela and remembers “for the longest time, even when I was a teenager, my father asked me why I was so angry. I was such an angry person and there was no reason. The most important thing is that I am now a happy person.” “29 Amazing Minutes” will be offered at 7:30 p.m. in English and 8:30 p.m. in Spanish at the Miami Marriott Dadeland. In recognition of Autism Awareness Month in April, the Carrie Brazer Center for Autism is sponsoring an open house on Apr. 10, from 11 a.m. to 3 p.m., at the Kendall Campus, 8790 SW 94 St. (behind Baptist Hospital). Parents are invited to tour the facility, meet the staff and learn more about the center. The celebration includes activities for children. The Kendall Campus operates a full day school for children ages 3 to 12. The programs include: The Early Steps: Designed for early intervention for children from birth to 5 years old. The unique speech- and language-based programs completely center on each child’s individual goals — both cognitively and behaviorally. Children experience one to four hours of intensive, hands on, educational training, behavior modification and cognitive sensory-based activities. The Leaps & Bounds: Designed for early intervention for children ages 3-6 years. Emphasis placed on communication, social skills training through music therapy, speech and sensory integration therapy in a classroom setting. Certified elementary teacher, behavior, speech, occupational and music therapists collaborate to design a specific program for each

child for the school year. Options include 1-4 hours of intensive speech- and language-based ABA therapy. The Elementary School: Serves children from 5 to 12 years. Each class is led by a Special Education teacher with 1-2 trained teacher aides per class. A 5 or 6 to 1 student to teacher ratio is maintained, 1to-1 ratio is available. The school day includes Cognitive & ABA Therapy, Speech/OT/PT Therapy. Field trips to community attractions such as bowling, horseback riding, zoo, swimming, museums, etc. are planned bi-weekly to develop social interaction skills. The Carrie Brazer Center for Autism has a second location for its middle school, high school and adult vocational programs. This center is located at 7425 SW 42 St. Both locations accept Florida McKay Scholarships for Students with Disabilities for full payment based on a sliding scale if the child’s Matrix is 254 or 255. Baptist Hospital’s Relay for Life draws 3,000, raises $208,000 BY JOSE BOZA

Baptist Hospital’s fifth annual American Cancer Relay for Life event saw another record crowd with approximately 3,000 participants and raised more than $208,000 for American Cancer Society’s research, programs and services. It was the fifth consecutive year that Baptist Hospital hosted the American Cancer Society’s East Kendall Relay for Life — an all-night campout, survivors’ celebration and relay-style walk around the hospital campus’ lake. Cancer survivors were given special Tshirts and participated in a celebration lap around the lake. Thereafter, they were treated to a special dinner and other gifts. The event continued overnight, where event attendees experienced a moving candlelight ceremony that honored people battling cancer and those who have died from the disease. The event was supported by the BaptistSouth Miami Regional Cancer Program, and health professionals and patients from Baptist, Baptist Children’s and South Miami Hospitals. The Dranoff International Two Piano Foundation will host the second annual Piano Slam,, a two-piano classical music and rap poetry concert, on Wednesday, May 12, in the John S. and James L. Knight Concert Hall at the Adrienne Arsht Center for the Performing Arts of Miami-Dade County. Susan and Sarah Wang, 2008 winners of the 11th Dranoff International Two Piano Competition featured with prominent Miami rap artists Lela Lombardo and Summer Hill Seven will be performing with Miami-Dade County middle and high school student poets in a program that is free to the public. As part of the event, Dranoff will hold a competition for poetry from students inspired by live classical music performances. Contest prizewinners will be presented with laptop computers and cash awards at the event and their poems will be

presented as part of the spoken word, rap and classical music “mash-up.” For the first time, Dade County Public Schools are making Piano Slam available to all middle and high school students online through a generous sponsorship by CA (Computer Associates) including MacArthur Genius Poet Campbell McGrath, Miami Heat player James Jones and DJ Irie. NWSA presents BFA graduates’ exhibition opening on Apr. 10 BY ROBERT HAMILTON

New World School of the Arts will present “2010,” a group exhibition by the 22 newest Bachelor of Fine Arts (BFA) graduates opening on Apr. 10. Emerging from the first decade of the new millennium, the 2010 class celebrates a show that conveys predominant themes significant to artists today. Thanks to recent funding from the Knight Foundation, New World has expanded to a 6,000-square-foot studio space located in Miami’s Arts District. Individual studio spaces have intensified an atmosphere for group practice and production. Curated by the students themselves and by gallerist Fredric Snitzer, the show will embrace a compelling range of subject matter. The work featured addresses a wide range of issues using the media of drawing, photography, video, painting, sculpture, and graphic design. The opening reception of 2010 will take place on Apr. 10, from 7 to 10 p.m. at the Cisneros Fontals Art Foundation (CIFO). The exhibition will be open to the viewing public Thursday through Sunday from noon until 5 p.m. through May 7. CIFO is located at 1018 N. The New Credit Card Rules: Will it help us? BY DANIA S. FERNANDEZ, ESQ., Attorney at Law On February 22, 2010 many new regulations took effect where credit card companies have to abide by. These regulations are part of the Credit CARD Act of 2009. What does this law mean to the cardholder? There are several provisions that will benefit the cardholder such as: 1. Limits on interest rate hikes on existing balance 2. A 45 day delay on “universal default” which means that because you defaulted on one credit card, does not mean the credit card company of another can increase their interest rate too. 3. The Credit Card Company must apply your payment first to purchases with a higher interest rate. 4. No more over the limit transactions 5. A minimum 21 day nonpayment time before the Credit Card Company defaults your account. Is there a cap on the interest rate the Credit Card Company can charge? No. I do not see a limit on the interest rate, however when an interest rate is set there are limitations to its increase. This law does provide some benefit, but they do not protect the card holder from everything. Interest rates can be raised and there is no cap at the moment. Is my Business and corporate card covered by the CARD Act? No. They are not covered by

the CARD Act. These cards will not have the protections listed above and others not listed above.

Can the Credit Card Company close my accounts? Yes. The Credit Card Company can close your account and slash credit limits abruptly, without notice or warning. Many of these Credit Card Companies are already finding ways around the law. Many fear that this law will increase the price of and limit the availability of credit cards. This can be a problem for many that are surviving on credit cards. Even though there are benefits to the cardholder there is still the big problem of rising interest rates, which I have seen up to 36%. Many of the these credit card companies’ profits are going to be decreased due to this law and may cause other profit margins or costs to rise in a different way. For many, Bankruptcy is still going to be an option despite this Credit CARD Act. Bankruptcy will still continue to be a way for individuals to have a fresh start and eliminate most or all of their debt. There are many issues left to be resolved and for those caught in the battle of the CARDS will need to determine their plan of action. The High Cost of Avoidance By Michelle Estlund, Criiminaal Defense Atttorneyy One of the most unnecessary headaches confronting many people is the consequence of delayed action. People often waste vast amounts of time, energy, and money because of procrastination. Particularly in the criminal defense arena, avoidance can make a bad situation worse. When people avoid work that they have contracted to do, or delay depositing money in the bank to cover checks, or when they fail to address driver’s license problems, criminal charges can result. Moreover, once a criminal case has been closed with a plea to probation, a delay in satisfying accompanying conditions can trigger a violation of that plea agreement. A client recently came into my office feeling distressed about a situation that had been brewing for two years. He had endured severe marital problems at the same time that his business became one of the many casualties of the economy. He allowed his stressors to spiral out of control and was arrested for a misdemeanor offense, but had never appeared in court after the initial hearing. He knew that a warrant for his arrest was outstanding, and it

was haunting him. Coming into my office to resolve the matter was the first step in regaining control of his life. The best decision a person can make when confronted with any tough situation, whether it is a debt owed, a lapsed obligation, or a more serious matter of knowing that police are interested in speaking to the person, is to confront the matter directly. By simply contacting the party to whom the debt or obligation is owed, and making an honest effort to resolve the situation, criminal charges or other litigation can be prevented. If the situation has become more serious, and the police are already involved, an attorney can contact the authorities, arrange for the client to surrender, and begin defending the case, thus negating the stress of wondering when or how the police will appear. Luckily, my client was able to avoid the embarrassment of being surprised at work or with his family. The matter was successfully resolved because of his willingness to face his problem, create a resolution, and move forward in life. Even when procrastination has created an unpleasant circumstance, a little bravery goes a long way towards a resolution.
