Planned village hall will be better than ‘green’

BY GARY ALAN RUSE he planned Palmetto Bay Village Hall facility will not only meet the needs of the village and be a LEED Gold certified “green” project, it also will be a showcase of environmentally positive building design and the first among municipal structures to do so.

This is according to information presented during a special village council meeting on Sept. 24.

Master Builders of South Florida has been awarded the contract and, besides making the presentation during the council meeting, company representatives also recently joined village officials in Washington, DC, to pursue grant opportunities for the project.

Construction for the new village hall is slated for completion in fall 2010.

he Miami-Dade Park and Recreation Department, the Parks Foundation of MiamiDade, and the University of Miami School of Architecture will host an urban planning workshop titled “People and Places: Building Our Public Realm—East/Central/South Miami-Dade County,” on Thursday, Oct. 8, 8 a.m.-1 p.m., at the University of Miami Bank United Center, Hurricane 100 Room, 1245 Dauer Dr. in Coral Gables The workshop, the second in a three-part series covering different regions within the county, will bring together key municipal and regional agencies from the cities of Coral Gables, Homestead, Miami, Miami Beach, North Bay Village, South Miami, West Miami, Village of Key Biscayne, Village of Palmetto Bay, Village of Pinecrest, and Town of Cutler Bay, to continue the dialogue aimed at forging mutually beneficial partnerships for the implementation of greenways and civic spaces that connect to the greenways, providing the user with a meaningful experience.

Each participating municipality and agency has been requested to bring a significant current and/or future destination project such as that for a park, library, cultural, historic,

Youth coach Lou Confessore beat U.S. Soccer by 12 years

— US Youth Soccer news release • • • • • • • • • • • • • • • • When it comes to youth soccer, no one knows the game better than Kendall’s Lou Confessore. Now marking 47 years of coaching smallfry soccer, he began coaching the sport 12 years before formation of the first nationwide youth program in California in 1974.

Today, Confessore, Coral Estates coach for its Under-6 and Under-8 boys teams, confirms what few in youth soccer may realize — Coral Estates is the oldest private soccer club in MiamiDade County.

“I should know; I started the program in 1962,” said Confessore, already enshrined in both Florida State Soccer and Florida Youth Soccer Association halls of fame for his near half-century of devotion to popularizing and coaching the sport.

When Miami-Dade Parks director Jack Kardys christened three new Kendall soccer fields in September, he introduced Confessore as a Kendall soccer legend.

“Well, yes, Jack would have said something nice like that,” Confessore recalled. “After all, I coached his father,

the late Walter Kardys, in youth soccer.”

Kardys said, “Lou and my father were both coaches in the first soccer leagues formed in Miami-Dade County. My father was a coach for Norwood Soccer Club while Lou was at Coral Estates.”

Confessore, at 72, still teaches tots two afternoons a week at Coral Estates Park.

“You just grow to love the sport,” the coach explained. “At Adelphi College in New York (where I grew up), I was really a lacrosse and football player. But the school needed a ready-to-play soccer roster to kick off its schedule in September, so a lot of us were ‘recruited’ to play. I was on defense.”

After graduation in 1960 with a teaching degree, Confessore came to Florida, joining his relocated family in Dade County and coaching at Hialeah’s Recreation Department.

In 1962, he started a life-long career, teaching physical education at Coral Park Elementary School, located sideby-side with Coral Estates Park where he introduced the sport and founded the oldest Miami-Dade regional soccer club.

Married soon after coming to Miami, Confessore said, “My mother pushed me into it; she wanted me to meet a girl (Harriet) at church; she had come here from St. Louis, a soccer stronghold, so

that worked out just right.”

Settling in the Village of Kendale, the Confessores’ children would later carry on the family soccer connections with two sons, David and Steven, as well as daughter, Carolyn, playing on youth teams.

“David’s still on an adult team and Carolyn’s two children, our grandchildren, are playing on Homestead teams at age 5, but Steven, a police officer, figures soccer might not work out with his job responsibilities.”

From 1968 to 1977, as one of the “old guard Miami soccer coaches,” Confessore helped create the varsity sport at Coral Park Senior High, one of several schools building successful programs based on a feeder system from active youth leagues.

“Soccer grew in popularity here because at that time, basketball wasn’t a big sport in Miami,” Confessore explained. “It filled a gap between fall football and baseball in the spring.”

Serving from 1977 to ’81 as president of the Florida Youth Soccer Association, Confessore saw local and state youth leagues steadily expand in Florida at a time when only three Miami-Dade parks had regulation soccer fields.

“Some still say soccer hasn’t grown that significantly, but back then, we had 25,000 youngsters playing,” he reflected. “Now, we have 125,000 youth, statewide. Last year, in the 15 to 18 age group, we had 32 leagues in MiamiDade. This year, there’s 40 with 55 active coaches.”

Will he ever retire?

“I thought I would by now,” Confessore said with a laugh. “But the kids keep me going.”

Flinn Jr. said during a recent interview. “We’re really looking forward to this project. I think this is going to be a village hall everybody’s going to be proud of for its practicality and efficiency.

“Our staff and the builders went to Washington looking for grant money and, while we never count our chickens before they’re hatched, we’re always working hard to bring our tax dollars back to our community,” Mayor Flinn said. “This has a real potential of being a great demonstration project that should attract not only ‘green’ money but also FEMA money.”

Mayor Flinn was referring to the fact that the new village hall will be a hurricane-hardened Emergency Operations Center (EOC) facility that will function as the city center for communications and resources — local police, fire and rescue operations — after a hurricane or similar event. This makes the building eligible for FEMA funding.

The complex will employ the newest water conservation and recycling techniques, special windows to reduce heat and cooling costs, special insulation and solar panels that not only can reduce electricity costs but also can on off days produce additional power that can be “sold” to Florida Power and Light.

“It’s ‘green’ because of the technology, and it’s ‘green’ because of what it’s doing for the community,” Councilmember Shelley Stanczyk said.

“It’s an infill project in an area that’s in transition, and a site that was ready to be revitalized. It’s near transit and it it’s going to help provide for future devel-

opment around it.

“Our lobbyists have been hard at work and our staff has been looking into a number of departments in Washington for funding, from Energy to Homeland Security.”

Dr. Ed Feller, District 1 councilmember, echoed the enthusiasm of the others for the new project and what it will mean for the area and the village as a whole.

“It is an example of everything we’ve done, namely a new village taking the lead to do what’s right, both technologically and environmentally,” Feller said.

“I’m really excited about this because, if the builders can accomplish what they’re promising, the project will be a model for the whole Southeastern United States. Even governments that are building new buildings are not trying to be energy neutral. They’re trying to be ‘green,’ but not taking that extra step of being energy neutral.”

Master Builders of South Florida is based in Oakland Park and during the past 35 years has done a large number of residential, commercial and government projects.

Mayor Flinn said that the people of Palmetto Bay should experience improved service as well in the new building because of the additional space.

“Residents will see the benefits of the new building when they come in to pull building permits or conduct other business there,” he said. “We were cramped into a small space for a long time at the current village hall and we resisted expanding on that while we were renting. This is going to bring a renaissance to the area.”

Miami-Dade County Board of County Commissioners unanimously approved the county’s Park and Open Space System Master Plan (OSMP) on February 2008, which was developed by the County’s Park & Recreation Department. The OSMP vision for Miami-Dade County provides a roadmap to develop a more sustainable community by using a comprehensive and coordinated model park system as its engine.

Great parks, public spaces, natural and cultural places, greenways, trails,

and streets will connect to provide residents and visitors with the experience of a world-class park system at their doorstep, much like the heralded modern redevelopment of cities like Seattle, Boston, Portland, Chicago and Chattanooga.

An important element in the creation of a model park system is that a vision as ambitious as this one, cannot be accomplished by any one single agency, but rather by a team of leaders that partner together to integrate seamless and sustainable practices throughout the community.

Many of the ideas, findings and partnerships from these workshops will be presented in the upcoming Great Park Summit of the Miami-Dade Park & Recreation Department, scheduled for Mar. 5, 2010, at Fairchild Tropical Botanic Gardens.

The third and final workshop, scheduled at FIU on Oct. 14, will cover the western portion of Miami-Dade County.

On again, off again Port of Miami tunnel; off again?

Kenneth Bluh KENNETH’S COMMENTARY Back in May 2007, the often proposed and almost contracted-for tunnel from the Port of Miami under the ship channel connecting to Interstate 95 via I-395, almost was derailed by detractors objecting to an international consortium of construction companies with a construction history in Cuba being awarded the $1 billion contract.

Fidel Castro once said a few good words about the French construction company Bouygues Publics Travaux which had completed a project in Cuba.

To Miami’s anti-Castro element that was enough to try to kill the whole port project, notwithstanding the fact that the tunnel was desperately needed to alleviate traffic congestion on Biscayne Boulevard.

The Florida Department of Transportation (FDOT) projects 70,000

vehicles a day by 2020, of which 20,300 will be gigantic 18-wheelers crossing the intersection of Biscayne Boulevard and Port Boulevard, the road coming off the port. Add to that the thousands of cars entering and exiting the many high-rise condos under construction opposite the port and you can easily visualize a nightmare traffic jam. In addition there will be many hundreds of cars trying to get to the Performing Arts Center, AmericanAirlines Arena or Bayfront Park and you have added to the nightmare.

The proposed and approved subjectto-financing tunnel, would take all the truck and car traffic coming off the port and funnel it under the channel and come up with an entry onto the interstate. That’s 20,300 vehicles a day that would not interfere with the traffic on the Boulevard.

Individuals trying to kill the project kept talking about the fact that a tunnel would flood as the port is at sea level and couldn’t be kept dry. They seem to forget that England and France built and currently are using a tunnel under the English Channel. Funny, but it does-

Now, here we are, late in 2009, and everything is ready except for the City of Miami’s financial contribution. MiamiDade County has made its financial pledge, and ditto the State of Florida.

The federal government is ready with its Transportation Infrastructure Finance and Innovation Act (TIFIA) money. The only one holding up the deal, as of Sept.

27, was the City of Miami, which was to provide a $50 million letter of credit that was due on Friday, Sept. 25. After that date the deal with TIFIA could be dead.

Miami’s city manager Pete Hernandez was busy finalizing the city’s budget and didn’t have time to complete “shopping” for the best bank rate for the letter of credit. The city manager, I hope, can buy the letter of credit, and get it to FDOT in time to convince the federal government to give the go ahead, even though the city is a few days late.

How something this important could be lost because Miami’s administrators are too busy with another project is beyond my comprehension. We will know the results by the time this column goes to press. I want you to understand the type of dilemmas facing our community. Only public pressure on our elected officials will bring logic to our government.

Just think, one day’s missed action might have killed a billion dollar project that would have brought hundreds of jobs to Miami as well as solve a major, and still growing, traffic problem in downtown Miami.

Some strength showing in the housing markets

Al Sunshine 4 YOUR MONEY It is not a major signal that home prices are going to start climbing as high as they were before our local real estate bubble burst. However, the latest numbers out of Washington, DC, point out another sign the critical housing markets are seeing new strength here and across the country.

At the same time, it’s also potentially bad news for anyone who’s still deciding whether or not to jump in and buy a home or condo. The flip side is sellers may finally be able to hold out for a little bit higher price, if they can play for more time.

The latest Federal Home Finance Agency numbers from Uncle Sam shows July residential prices gaining 0.3 percent over June. And that’s a solid gain from March’s probable market bottom. Still, overall prices are down more than 4 per-

cent from July 2008 and off more than 10 percent from its peak in 2007.

Closer to home, prices are doing even better. Florida is part of the South Atlantic region and July prices here grew by twice as much as the national average. Regionally, our prices shot up 0.6 percent from June and they finally are seeing steady, positive growth from early summer when prices were still dropping. According to the latest statistics, since January residential prices have shown some steady improvements. And with the residential real estate market improving and prices slowly picking up, the so-called buyers market could soon be ending.

Local home sales still are getting a solid boost from that first-time buyer’s tax credit. However, that expires in November.

As far as single-family homes go, the great deals and rock bottom low prices available over the summer may soon be gone as the inventory of homes and condos continues to get bought out.

Shopping weekend to benefit Baptist Health Breast Center

BY AMANDA GONZALEZ In an effort to raise money and awareness for women’s cancers, Saks Fifth Avenue Dadeland will host the 2009 Key to the Cure charity shopping weekend from Thursday, Oct. 15, through Sunday, Oct. 18.

A percentage of the weekend’s sales will benefit the new Baptist Health Breast Center, a centralized resource for patients with a suspected or confirmed breast cancer diagnosis that features the most advanced digital imaging technology, top-quality diagnostics and expert surgical care.

Nationwide, Saks stores, Saks Fifth Avenue OFF 5TH stores and saks.com will donate 2 percent of sales up to $250,000 from the shopping weekend to local and national women’s cancer organizations and research centers.

Additionally, Saks will make a donation of $500,000 to the Breast Cancer Research Foundation.

“We’re so pleased that Saks Dadeland selected the Baptist Health Breast Center as the beneficiary for the highly successful Key to the Cure shopping weekend,” said Tom Larsen, director of the Breast Center. “It’s a great venue to raise awareness for the

The Orange Bowl Youth Football Alliance (OBYFA), home to more than 15,000 players and cheerleaders, is celebrating its 11th anniversary as leagues from across Florida kickoff their 2009 seasons.

The OBYFA’s nine member leagues spread out across eight Florida counties, including Miami-Dade, Broward, Palm Beach, Monroe, Martin, and St. Lucie on Florida’s southeast coast; Collier and Lee on the southwest coast.

“The Orange Bowl Committee and its OBYFA partners are extremely excited to begin its 11th year of competition this fall,” said Jose A. Regalado, youth sports manager of the OBYFA. “When the Alliance’s concept was created in 1999, the goal was to promote the growth of youth football and cheerleading in South Florida and now, 11 years later, we can proudly say that youth football and cheerleading is thriving in the region.”

This season, OBYFA will support five recreational leagues and four competitive leagues under its umbrella. The recreational league rules stipulate that all kids have an opportunity to play, while the competitive leagues hold tryouts for roster spots.

This season, with assistances from its sponsors — American Airlines, Doctors Hospital, Playmaker Charities and Foundation, Blue Cross Blue Shield of Florida, Land Shark Stadium, Nestle Waters, MetroPCS and Toyota — the Orange Bowl Committee will provide an overall direct financial contribution, apparel and distributed grant money exceeding $325,000.

Today all of the more than 15,000 football players and cheerleaders participating in the nine leagues under the OBYFA banner enjoy the direct benefit of the association. OBYFA’s contribution to the communities goes beyond the financial impact.

Participation in youth football engages the kids in positive activities with the goal of preventing them from spending their time in ways that could be

detrimental to their futures.

“Our leagues and parks can always count on us year-to-year to be a loyal partner,” Regalado said. “We welcome the opportunity to support the leagues under our OBYFA banner with our resources to encourage youth development, character building and teamwork through athletic competition.”

Coinciding with this season’s games, some of which began as early as Aug. 22, is OBYFA’s “Park of the Week” program.

The program brings a festive caravan to numerous park locations every Saturday through the season and conducts activities such in-game contests, promotions, handouts and recognition of park leaders, volunteers and parents.

Additionally, OBYFA action is featured throughout the season on Inside the Orange Bowl YFA television show statewide on Sun Sports, Thursday’s at 5 p.m.

At the culmination of the season, the best of the best can look forward to the OBYFA Championships and the right to play for the famed Orange Bowl Trophy in the Orange Bowl Youth Football Alliance Championships at FIU Stadium on the campus of Florida International University. The two-day championship event, televised by Sun Sports, pits champions from the different leagues against each other to crown winners in eight weight-class divisions.

This year’s event is scheduled on Dec. 12 and 13.

Cheerleaders also get their chance to shine as squads from throughout the OBYFA perform routines at the Orange Bowl Youth Football Cheer & Dance Competition with winning squads getting a trophy of their own. The all-day extravaganza, scheduled at Nova Southeastern University’s University Center Arena, is Nov. 15.

Local IndyCar driver sets pace in many endeavors

BY HARRY CAPEHART IndyCar Driver Milka Duno, who calls Miami her home, and HomesteadMiami Speedway her “home track,” will be competing in the season finale of the 2009 IndyCar Series Championship at Homestead-Miami Speedway on Saturday, Oct. 10. Practice and qualifying will take place on Friday, Oct. 9.

The race weekend also will feature the season finale of the Rolex Series. It was in this series that the Caracas, Venezuela-born Duno scored two historic wins at Homestead-Miami Speedway. With her first win at the Miami circuit Duno became the first woman in history to win a major international sports car race in North America.

Duno currently is in her third consecutive IndyCar Series season, having started in the popular open-wheel racing series in 2007. She made history when she became the first Hispanic woman to compete in the world-famous Indy 500 and the IndyCar Series.

In the 2008 season finale at Chicagoland Speedway, Duno became the first Hispanic woman in history to lead an IndyCar race. She also led the most race laps of any female driver in the 2008 season, as well as being the only female driver to finish at the 2008 Indy 500.

In addition to being one of the most successful female race car drivers in history, she also is a qualified Naval Engineer with four master’s degrees — in Organizational Development, Naval Architecture, Aquaculture and Maritime Business — earning the last three degrees simultaneously.

Duno recently was selected as a Special Achievement Honoree in the Sports Category as part of the 2009 NCLR ALMA Awards. She also co-presented the Male Actor/TV Comedy ALMA Award with Rainn Wilson from the hit television show The Office. The 2009 NCLR ALMA Awards, co-hosted by film and television actors Eva Longoria Parker and George Lopez, pays tribute to Hispanic heritage in film, music, television and sports. The

show aired Sept.18 on ABC. In May, Go, Milka, Go!, the book about Duno’s life and racing career, was awarded the Best Young Adult Sports/Recreation Book of 2009 at the 11th Annual International Latino Book Awards. Her passion and determination aren’t reserved only for her on-track activities — they extend off-track as well. Six years ago Milka created the “Milka Way” program with a mission to inspire children and young adults to “Aim for the Stars” and achieve academic excellence.

In a tour of eight Latin American countries, Duno took this message to schools in each country to help inspire and motivate students and help them understand the importance of education and how a strong academic background will benefit them their entire life — in all aspects of their life — and in any career they choose.

“I am very passionate about education and I want to do everything that I can to inspire young people to study hard and aim for the stars,” Duno said.

Even minor criminal charges can have major immigration consequences

BY MICHELLE ESTLUND, Criminal Defense Attorney Walk down almost any street in South Florida and chances are good you will pass many people who are not United States citizens but who are living here legally. They may be here on an investorâ&#x20AC;&#x2122;s visa, an employment visa, or they may hold permanent resident status. Most people are aware that persons here illegally can be deported for law violations, but many are surprised to learn that even those here legally can face deportation for certain misdemeanor offenses. These may include petit theft, possession of marijuana or drug paraphernalia, battery, or issuing a check for insufficient funds.

Non-citizens must be extremely cautious when dealing with criminal matters, even though the charges may seem relatively minor in the criminal justice system. This is true for persons with currently pending immigration cases and for those who do not plan to adjust their immigration status for years to come.

Criminal law meets immigration law when a non-citizen is charged with a criminal offense. It is important that the non-cit-

izen not rely on the advice of friends regarding how other cases have been resolved.

Hiring a criminal attorney who is cognizant of immigration law to navigate the legal system is very important. This is because under immigration law, the same offense may impact different persons in different ways.

For example, the amount of time a person has been in the United States and the possible penalties for different levels of the same crime will influence whether one person is deported and another is not.

Any non-citizen facing any type of criminal charge, whether they were arrested or simply ordered to appear in court, must understand the ramifications the resolution of their criminal charge may have upon their immigration status. Clients are frequently surprised to discover that having resolved a criminal case with probation years ago now has a negative effect on their current immigration status. For this reason, it is critical that any non-citizen seeking to resolve a criminal matter disclose their immigration status to their attorney and discuss possible immigration consequences before closing the criminal case.

There is no denying the Miami Children’s Hospital Foundation 2009 Diamond Ball and Concert, “An International Affair,” will be infused with a world of energy when such acclaimed performers as the All-Star Members of The Billy Joel Band and young musical sensations Ethan Bortnick and Charice take center stage on Oct. 16 during one of South Florida’s most anticipated charity events.

LOAN MODIFICATIONS: Can I qualify for Obama’s loan modification plan?

The key components of President Obama’s program to stabilize the housing market through foreclosure reductions are loan modifications and refinancing. This initiative is called the Homeowner Affordability and Stability Plan (HASP).

The program is also called “Making Home Affordable.”

Eligibility is based on the following: • The property must be your homestead—your primary place of residence.

• The amount you owe on your property must be equal to or slightly less than the value of the property.

• There must be sufficient income to begin paying a new mortgage payment.

• The original loan must have originated on or before January 1, 2009.

• There must be a hardship.

• The unpaid principal balance must be $729,750 or less.

• Your mortgage payment must be more than 31% of your gross monthly income.

Aside from these eligibility requirements, here are some of the questions I answer daily about the “Making Home Affordable” program.

1. Do I have to stop paying my mortgage to qualify for a modification?

Technically, NO. I would love to say that lenders are providing loan modifications to all individuals that are current on their payments and meet the above qualifications, but this is not true.

There are several lenders that have given loan modifications to those that are current. However, the majority of lenders are giving priority to those that are at risk of losing their home for nonpayment due to some kind of hardship.

I will never advise my client to stop paying their mortgage because there are ramifications. Non-payment will affect your credit score and foreclosure proceedings will commence. Therefore, for those who believe they have no alternative but to stop paying the mortgage, please consult with your lender or seek the advice of an attorney first.

2. Will my equity line be modified together with my first mortgage?

No. The loan modification program is only for the first mortgage. The second mortgage or an equity line will need to be negotiated directly with the Lender or Servicer. It is best to modify the first mortgage before negotiating the second. It makes no sense to start modifying the second without knowing if you can even afford the first mortgage payment.

3. What type of interest rate is being offered through the ‘Making Home Affordable” program?

The interest rate may go as low as 2%. The purpose is to get you an affordable payment. The “Making Homes Affordable” program works to first reduce the rate of interest, second the term of the loan, and third the principal of the loan. Each step will be taken as needed depending on your particular situation and financial status.

4. Will I have to pay the property taxes and house insurance separately?

No. The new loan payment will include a monthly escrow amount for the payment of property taxes and insurance. This is a requirement.

5. What will happen to all my past due amounts, late fees and/or penalties?

Those that qualify for a loan modification through the “Making Home Affordable” program will not have to pay past due late fees. All other costs such as unpaid taxes, past due interest, etc., are usually added to the amount you owe.

This also is the case for many loan modifications that are not through the “Making Home Affordable” program.

The most important information to be gained from this article is that there are options available. The hardest part may be in acknowledging that you need help. We are all in this together and together many things can be accomplished. My best advice is to call an attorney for a consultation. Know what is available to you and then plan your next steps accordingly.

LET’S TALK CARS The Dodge Avenger has a lot to offer consumers looking for a mid-size family sedan; it’s nicely styled and well equipped, and with the optional V-6 under the hood it has more than enough power for every day driving and highway cruising.

The Avenger looks a lot like its sibling, the popular Dodge Charger. It has the same aggressive exterior lines, the signature crosshair grille, muscular rear shoulders, large wheels and tires, a rear spoiler and chrome-tipped dual exhausts.

Standard power is a 2.4-liter I-4 World Engine that produces 173 hp and 166 pounds-feet of torque, delivering 21 mpg in the city and 30 mpg on the highway.
