Former Jr. OB queen lends a hand in Israel BY GARY ALAN RUSE
E
liza Berse is probably best known to her fellow residents of Palmetto Bay as the first girl from the village to become Junior Orange Bowl Queen, which she did in 2002 at the age of 12, or for her singing and dancing talent often displayed at local events and in an album of inspirational music. Now 19 and a student at Purchase College in New York, Berse took on a project over the summer during which all of her other activities took a back seat. She became just another person wanting to help a community in Israel. It was her second trip to that country, and quite different from the first. “I found out about the program through my school,” Berse said after her return for fall classes. “It was an inexpensive trip that was giving back to the community there. “I was interested in doing that because the first trip that I went on was all about how beautiful the landscapes were and how pretty Israel is, and this trip was more about the reality of Israel and the help that it needs and the people. It was more interaction with the community and what goes on there.”
The project took place in a town called Migdal Haemek, just 45 minutes southeast of Haifa. Berse worked with a group of girls at a center with a purpose to help them develop a stable and bright future. The girls came from abusive homes and most are on welfare, and the center provides different activities for them to learn and grow to develop the tools necessary to succeed. It wasn’t glamorous, and it was definitely work. “It was more of a getting your hands dirty kind of job,” Berse said. “I absolutely loved it. We worked in an area that was under attack during the Golan Heights war. They were already in poverty because the war messed up their community, so it felt good to be able to help them. I was working a lot with children, and I felt it was good to be able to set an example and find out more what their day to day lives were like.” Life in that part of the Middle East is potentially dangerous, but even though one of her projects was painting a bomb shelter and helping the girls do a mural there, the element of risk was not on her mind. “I wasn’t nervous at all,” Berse said. “I had no idea what to expect. It was an opportunity that came my way and it ended up being absolutely incredible. It was an amazing

experience — it was my favorite summer.” The teen, whose list of accomplishments and outgoing personality have endeared her to her own community in South Florida, recommends that others look into participating in similar projects over there, for what they can accomplish and discover about that country and themselves.
“Most people feel they have seen Israel, but I think they should give it another try doing service work projects over there,” Berse said. “No. 1, because they need the help, and No. 2, because it shows you another side of Israel that not many people get to see if you don’t live there. It’s a humbling and growing experience. I really learned a lot from that trip.”

he Magnet Dance Department of Southwood Middle School is presenting two special performances of the famed Nutcracker ballet on Dec. 10 and 11. Presented only once every three years, Southwood’s production is the full-length traditional version of the Nutcracker with full costuming and sets. Some 110 students participate, mostly dance students from the Magnet Dance Department’s sixth, seventh, and eighth grade classes, with some students from the Drama Department as well in non-dancing roles. This year, the role of Sugar Plum will be performed by former Miami City Ballet dancer Maribell Modrono. Dance teacher Hilda Jimenez said that those attending won’t be disappointed.
“It will be an enchanting evening and a wonderful performance for families to enjoy together,” Jimenez said. “We have some super talented students this year.” The students have been in rehearsals and pre-production since the beginning of the school year. Jimenez said that the Nutcracker performances are a big collaborative effort on behalf of the teachers, students, parents and the school administration. Performances take place at 6:45 p.m. in the school auditorium. Cost for students is $5 while general admission price is $8. Advance tickets will be sold a week before the performances with the remainder sold at the door. In the past, performances usually have played to sell-out crowds. Assurant’s EAC Veterans Day drive fills 24 boxes for troops

In honor of Veterans Day, the Assurant Employee Activities Committee (EAC) sponsored a “Care Package Drive” from Nov. 2 to Nov. 13. The drive, led by Violeta Corzo, Betty Corzo and Jeannie Aragon-Cruz, was a huge success filling 24 boxes with magazines, snacks, board games and lots of cards from Assurant associates and the children at the Assurant schools. The boxes were shipped to two units in Iraq and a unit in Afghanistan. Units were picked from the AnySoldier.com website and represented the Army and Marines. “My sister, Violeta, and I started sending care packages through AnySoldier.com in 2003,” Betty Corzo said. “Assurant got
involved a few years ago and began an annual troop drive through AnySoldier.com. It has become an annual event and I feel extremely humbled and honored to be a part of such a great yearly event. Commissioner Souto is tired of backroom, secret deals R. Kenneth Bluh KENNETH’S COMMENTARY Miami-Dade County Commissioner Javier Souto is tired of commissioners and administrators meeting behind closed doors and making deals that should be made in front of the public. Souto is proposing an ordinance that simply would require all meetings between individual commissioners, or groups of commissioners, and county staff be held in the sunshine — open to the public. If a commissioner wants to meet with the county manager or his staff the proposed meeting must be noticed in the press in order that public can attend and learn what is being negotiated. For years I have felt that individual commissioners meet with high ranking staffers and cut deals that will guarantee
the appropriate commissioner’s vote on issues sensitive to management. Not only will it make public the agreements between the individual commissioner and staff but will permit all commissioners to share in the same knowledge thus eliminating “back room” deals that might benefit one commissioner’s constituents at expense of the balance of the county. Michael Lewis, publisher and editor of Miami Today, editorialized on Nov. 19, as an example of such a series of meetings between individual commissioners and the county manager that took place before the final vote on the Marlins Stadium. Who knows what deals were offered the individual commissioner in exchange for a favorable vote. Florida’s “Sunshine Law,” one of the best pieces of legislation to come down from Tallahassee, does not apply currently to elected officials and administrative staff. The law only applies between elected officials. While meeting between commissions and staff are not a violation of the law, it does violate the “spirit” of

––– VIEWPOINT ––– the law. Souto’s proposal would make such meetings, without public notice, a violation with penalties. Here are the specifics of Souto’s proposal. Any meeting between elected officials and staff on pending legislation must be held at a public meeting. A 24hour advanced notice of such meeting must be published in the appropriate media, and minutes must be taken of the meetings. Violations could be up to 60 days in jail or fines up to $500. I am not a betting man, but if I were, I would give odds on the proposal dying for lack of supporting votes from other commissioners. Such an ordinance effectively would eliminate commissioners and the manager’s office of making deals that if known would reflect poorly on our elected officials and members of the
manager’s staff. My hat is off to Commissioner Souto. His proposal is appropriate and much needed. It looks like Commissioner Carlos Gimenez is stepping up and asking Souto’s permission to co-sponsor the ordinance. That’s two votes. How many more commissioners will come on board? Those that do support the legislation should be congratulated by the voters of Miami-Dade. We appreciate your opinions on this column whether in agreement or disagreement. Despite bad unemployment news investors still pushing envelope
Al Sunshine 4 YOUR MONEY Despite continuing bad news about growing unemployment, investors are still slowly pushing the envelope. There’s growing evidence that retail improvement is coming from the auto sector, initially boosted by the “Cash for Clunkers” program. Business is improving for General Motors in particular. Despite losing $1.2 billion dollars from their post bankruptcy, they are doing better than expected. Starting soon, the company plans to pay back the first $1.2 billion of their federal bailout. Federal Reserve chair Ben Bernanke’s recent forecast anticipates slow growth for the United States economy through the first half of 2010. He also expects low interest rates to remain a key part of the Federal Reserves recovery plan. The commodities markets are seeing solid gains. Gold is setting new record highs almost daily. Investment and retirement accounts are looking better than in previous months. Still, the overall economy is in its early stages of recovery and it may remain fragile for some time. The Federal Reserve Board reported that the overall United States industrial production grew by 0.1 percent in October. That’s the lowest gain reported over the past three months. With home sales still depressed, home improvement stores like Home Depot and Lowes are reporting deepening third quarter losses. Home Depot just upgraded its latest fourth quarter forecasts on recent signs of an improving economy. While interest rates are at record lows, overall consumer prices are growing. According to the Bureau of Labor
Statistics, there has been a growth of approximately 0.3 percent. Why the sudden hike? Blame October’s rising wholesale oil prices that are pushing retail gas prices up by about 1.9 percent, and causing food prices to increase. Vegetables are up by 24 percent and fresh fruit is up 7 percent. Looking for bargains during the holiday cooking season? Baked goods have been lowered by about 0.5 percent, beef 2.7 percent, and pork 1 percent. Unfortunately, turkey went up about 3 percent from last October. Still, the overall Thanksgiving dinner prices are lower than last year. As supermarkets cut Thanksgiving prices to lure back customers, expect to see turkey for as low as 49 cents a pound, or even cheaper. President Barrack Obama now is openly discussing how the deepening federal deficit, low interest rates and a weak dollar could team up to cause a so-called, “Double-Dipper” recession next year. However, the President seems convinced that it will not happen. He is reluctant to expand the federal deficit any further through additional “Economic Stimulus Spending.” Why the sudden concern about another possible economic downturn? Growing unemployment is keeping consumers away from the checkout counters. Personal spending remains flat as families struggle to stay in their homes. For the first time since the summer, residential construction has fallen. Though record low interest rates and expanded tax credits are available for homebuyers, new mortgage applications are dropping. Yet, there is still a lot of pent-up demand to put more money into the markets. It’s a popular option for investors who are worried about a possible “Double-Dipper” recession next year, after seeing the current mixed signals on the direction of the economy. In 2008, the Florida Kindergarten Readiness Screener (FLKRS) conducted a study measuring the development of emergent literacy skills in children ages 0 to 5. The results of Miami-Dade County’s screening revealed that 31.1 percent of the students were considered as moderate to high risk in the area of Alphabet Recognition, 40.7 percent as moderate/high risk in the area of Sound Recognition (phonics), and 14.1 percent were identified as not being classroom ready. In an effort to aid in the development of early literacy skills among children, ages 0 to 5, the Miami-Dade Public Library System has launched Reading Ready, a program aimed at parents, families and caregivers. Families and caregivers joined staff at all 48 libraries throughout the system on Monday, Nov. 16, for a simultaneous launch, and a special celebration at the International Mall Branch, where parents and children had the chance to explore the new early literacy center, a model for future centers in branches throughout the system. The early literacy center offers
materials and an interactive play area that engages adults and children in the six early literacy skills that are needed for learning to read. At each branch, staff shared resources and demonstrated ways in which parents and caregivers can teach the skills at home using the appropriate books, DVD’s, CDs, crafts, finger plays and nursery rhymes. “The library system is committed to meeting the informational, educational, and recreational needs of the community and we’re pleased to offer this new program,” said library director Raymond Santiago. “We encourage all families to take advantage of it.” Judy Oh, a frequent visitor to the International Mall Branch, along with daughter Jennifer, 22 months, joined other families for the storytime. “This new program adds an exciting component to the storytime that was being offered by the library before,” Oh said. “I really like the finger plays and the online resources.” For additional details on Reading Ready visit online at <www.mdpls.org>; call 305375-BOOK (2665), or visit any branch of the library system.

Today, 20 per cent of the American Jewish population over 65 must deal with the effects of cataracts, glaucoma, diabetic retinopathy, macular degeneration or some other age-related vision problem. A recent study by the National Eye Institute found that more than 4.6 million Americans over age 40 currently are visually impaired. The study reports that these numbers are expected to double over the next 30 years as the Baby Boom generation ages. JBI, founded nearly 80 years ago as the Jewish Braille Institute, is an essential resource for the burgeoning population of older adults faced with agerelated vision diseases. The physically disabled who find it difficult to hold a book, including those who suffer from Parkinson’s disease, stroke or crippling arthritis, also utilize JBI’s materials. Talking books and large print materials can restore the lifelong pleasure of “reading” and enable users to stay connected to their communities. With a growing library of 13,000 talking books and several thousand large print and Braille materials — all of which are free to those in need — the JBI Library is the largest collection of Jewish interest materials (very broadly
defined) in the world. The Talking Book collection includes fiction, history, biographies, short stories, humor, mysteries, psychology and self-help, memoirs, cookbooks, Jewish studies and more. JBI users may subscribe to a variety of magazines such as Hadassah and Commentary. A wide range of liturgical materials — including English and Hebrew Tanachim, Siddurim, and Haggadot of all denominations, as well as Biblical commentaries — also are available. The JBI Library can honor special requests from students. Line Drive Performance trains winning athletes BY PAT FULTON Just an A-Rod home run from S. Dixie Highway (US1) is a place where children of all ages — and adults, too — can hit baseballs (or softballs) and test their indoor speed and agility. Line Drive Performance is the creation of Gator Rebhan, a Miami native whose life in baseball started at age 6. Today he is the running coach and head coach for South Florida’s largest girls fast-pitch travel softball program. What could have been a warehouse has been transformed into a comfortable, airconditioned facility for baseball and softball training, where parents can watch the workouts and the personal training for general fitness and competitive sports. In the batting cages, one token purchases 18 automated pitches. Private batting, pitching, and catching lessons for baseball and softball are available for all ages. Rebhan won All-County honors for baseball at Killian High School. He went on to play baseball for Miami-Dade College and University of New Orleans. As baseball coach at Palmetto Senior High, he combined with Booster Club president Ron Nentwig in 2004 to

acquire a home field for the school’s baseball program. The newly opened training facility operates Mondays through Fridays from 2 to 10 p.m. Saturday and Sunday hours are 10 a.m. to 5 p.m. Personal training is available by appointment for one-on-one or group coaching. The typical training
plan follows an individual profile created to meet individual goals. Manny Fonseca, South Miami strength and conditioning coach, puts his clients through their paces with medicine balls, weight machines, and other state-of-theart equipment to build speed, power, strength, flexibility and agility. Fluorescent
orange cones form an obstacle course to develop leg strength and ability. Fonseca, who charts each student’s progress, recommends three-a-week workouts, noting that in the early stages of a personal program, “There are both learning and conditioning phases, with a steady build-up of aerobic capacity. “It may take two to six months for a person to get over the first barrier in program development before new goals are set,” said Fonseca, a Fitness Boot Camp instructor. Visitors to Line Drive Performance have included Danny Cook of the San Francisco Giants baseball team as well as local high school football players. Self-Representation in a Criminal Case There are many reasons why some defendants may wish to represent themselves in a criminal trial. Although it is usually wise to get a defense lawyer, sometimes it's not necessary. The key to deciding if you need a lawyer is to look at the punishment you'll face if convicted. The harsher the potential punishment, the more important it is that you are represented by counsel. Why Some Defendants Want to Represent Themselves Defendants may choose to represent themselves for a variety of reasons: • Some defendants can afford to hire a lawyer, but don't do so because they think the likely punishment is not severe enough to justify the expense. • Some defendants may plan to plead guilty to an offense whose sentence never varies, and they realize that hiring a lawyer will do them little good. • Some defendants believe (often mistakenly) that an attorney who represented them previously was not competent, and might do just as well on their own. • Some defendants believe that lawyers are part of an oppressive system and seek to make a political statement by representing themselves. • Some defendants who are in jail awaiting trial can gain privileges through self-representation, such as access to the jail's law library. Self-represented defendants are • not bound by lawyers' ethical codes. This means that a defendant who represents himself can delay proceedings and sometimes wreak havoc on an already overloaded system by repeatedly filing motions. However, this approach is not recommended because it often backfires. Choosing to Represent Yourself While it's not usually a good idea for a criminal defendant to represent himor herself, it may make sense in some situations. The most obvious rule is that the less severe the charged crime, the safer it is for a defendant to self-represent. For example, defendants charged with minor traffic offenses or shoplifting may get by without hiring an attorney, while defendants charged with violent offenses or felonies should rarely be without one. Some crimes have sentences that appear relatively minor, but the conviction may have serious repercussions later. For example, convictions for some vehicular offenses may result in increased insurance rates. Or, if the defendant reoffends, the sentence for the second conviction may be
much more severe than the first offense. So before deciding whether to hire an attorney, defendants should try to learn what the punishment is likely to be if they are convicted, both immediately and in the future (if the defendant is arrested or convicted for a similar crime), and whether there are collateral consequences, such as insurance rate hikes. Find Out the Likely Punishment It can be difficult to learn about common sentencing practices. Typical sentences aren't usually listed in statutes or court rules. (Sentencing in federal court is a big exception, though judges aren't bound by those guidelines.) However, some states do have what are called determinate sentencing laws. These laws provide specific sentences (or a range of sentences) for each crime. Other states have indeterminate sentencing laws, which allow the judge to sentence an offender for a period of time between a minimum sentence and a maximum sentence. If a defendant wants to find out what the punishment is likely to be if convicted, the defendant might take the following steps: • Pay a private defense attorney who handles cases in that court for an hour of consultation. An experienced defense attorney can often make accurate predictions as to likely punishment. • Ask a relative or close friend who is an attorney for informal, unpaid advice. • Talk to an attorney from the public defender's office. Representing Yourself at the Arraignment In most criminal courts, the arraignment is where the defendant first appears before a judge and enters a plea of guilty or not guilty to the offense charged. Assuming the defendant plans to enter a plea of not guilty, which almost every defendant does at this early stage, the court will then: • Set a date for the next procedural event in the case • Consider any bail requests the defendant or the prosecutor makes (usually if the defendant is at liberty -- not in jail -- at the arraignment, the defendant will continue at liberty without a change in bail status) • Appoint a lawyer for the defendant upon the defendant's request and a showing of eligibility, and Most people can handle an arraignment without a lawyer. However, if the defendant can get the court to appoint a lawyer for him or her without having to delay the arraignment, or the defendant is able to arrange for private representation before the arraignment, having a lawyer at this stage is always better. Experience the difference at FLEMING’S RESTAURANT - STILL TRADITIONAL WITH NEW UPDATED STYLE By Julianne Power – Independent Restaurant Critic If you have not been to Fleming’s lately its time to come in and see the classy, warm ambiance that reflects the new and also keeping to their traditional quality service and one-of-a-kind dining experience. After experiencing a facelift from Chef Gordon Ramsay (Hell’s Kitchen, Kitchen Nightmares), one thing is hard to change and that is the exceptional food that Fleming’s is noted for. Subsequent to a brief change in menu, upon ordering any entrée they have brought back the crudités (fresh veggie plate with outstanding dipping sauce), soup de jour and traditional Caesar salad that comes with all meals. They have also brought back their famed dessert display with a wonderful selection of such traditional tasty treats as the apple walnut pie, marzipan, napoleon and more for us to indulge. Chef Orlando Casanova has also added his offerings to the variety of dinners with scrumptious tastes and presentation and daily specials. Fleming has a complete and well priced wine list to compliment any occasion or meal. There is also a full liquor bar where there friendly bartender can make anything from a classic cocktail to one of their specialty drinks. I visited Fleming’s for dinner with a friend recently so I could personally see what changes and non-changes had been made. As we entered the establishment we were greeted by Owners Andy Hall and wife Suzanne Thomas-Hall, who obviously after owning the establishment for the last 8 years, have created a restaurant to reflect their vision without compromising the integrity of Fleming’s tradition. You are sure to meet one or both of them during any of your visits to their restaurant, as they are its heart and soul. Noticing the rich browns and “Bird’s in Flight” theme as the new décor, we were instantly relaxed. As we sat at our table, a menu, wine list and a sheet with their weekly specials was presented. We picked the right night! On Wednesday’s the special was half priced bottles of wine (ALL WINES!). As water was poured and a crudités was given, our server immediately came to our table and asked what we would like to drink. I am not one to necessarily match my wine to my meal since I am a Merlot type of gal, I spotted a Bogle Merlot and ordered the bottle (for half price!). While our server pre-
sented and poured the Merlot, we reviewed the menu. They also have small plate specials on Wednesday’s which is an extension of their existing list of appetizers. We ordered a Steak Blue and a Blackened Mahi. We enjoyed our wine while waiting for the appetizers which came in a short time and looked delicious. The Steak Blue was steak medallions served in a marvelous blue cheese sauce and the Blackened Mahi presentation was great and served with a dipping sauce. Next we ordered our entrees. I ordered the Lamb Chop’s medium and substituted a Wedge salad for an additional $3.00 forgoing the Caesar. My friend ordered their Roasted Duck. After taking our orders we were given a bread basket and a cup of the soup de jour, which on this day was corn chowder. The soup was hot and mouth-watering filled with diced potato and corn. As our server cleared the empty soup bowls we were then presented with a traditional Caesar salad and my Wedge salad. The salads were served fresh and very tasty. Now we were in anticipation for the main courses. My Lamb Chop was cooked to perfection served with a mint chimichurri, sundried tomatoes atop couscous. My friend received her duck and was taken aback by how big the portion was. The half of duck was served with apples, prunes roasted potato and a traditional red cabbage that tasted perfect. By this time we were certainly filled and satisfied. But wait! Now it was time for coffee and dessert! We were directed to Fleming’s Dessert display to see if we could fit another bite. They had a selection of approximately eight desserts that I was told changes daily. Hmmmmm, there it was, a chocolate cake lover’s dream……Chocolate Mousse Cake. My friend and I decided to make room and share this dessert with coffee. YUMMY! As we finished our dining experience, we were presented with a check and could not believe the amount of food and drink we received for the price. Fleming’s has been a best-kept secret in the neighborhood of Pinecrest for 25 years offering its patrons “the best bang for your buck” while keeping a “fine-dining” experience. Fleming’s is located on the East side of US-1 in a quaint, quiet strip of businesses behind the Home Depot and Office Max on SW 136th street.

LET’S TALK CARS The 2009 version of BMW’s Z4 two-seat sports car is really something special. It’s the second generation of the Z4 (the Z3 debuted in 1996) and it’s an all-new vehicle, right up to the nifty retractable hardtop. The new retractable hardtop model replaces both the roadster and coupe versions of previous generation Z4 models. The new retractable hardtop closes and opens in 20 seconds with the press of a button and provides better security, rigidity, rear visibility, quiet and protection from the weather than was available with the old ragtop. This latest Z4 is built on the same wheelbase as its predecessor, but it’s about six inches longer in the tail and the lines are softer. Chalk up the added length to the need to accommodate the hardware for the retractable hardtop. This Z4 sits low to the ground and has classic roadster styling, with a long hood and a short decklid, with
curves and creases that caress the front fenders and curve to the rear wheels. The 2009 Z4 comes in two models, the sDrive30i and sDrive35i (sDrive means rear wheel drive). The 30i is distinguished by the black vanes in the grille and a silver slash across the outer lower bars, while the 35i has matte-silver grille vanes. The sDrive30i (18/25) starts at $45,750 and comes with a 255-hp 3.0-liter inline six-cylinder engine mated to a six-speed manual transmission; a six-speed sport automatic with paddle shifters is an option for an extra $1,325. The sDrive35i (17/25 mpg) is a bit pricier at $51,650, but you get a little more bang for your buck. It comes with a 300-hp 3.0liter inline six with twin turbochargers and is mated to a six-speed manual tranny, with a seven-speed dual-clutch automated manual gearbox as an option for an extra $1,525. As for comparables, the new Z4 is a slightly longer than the Mercedes-Benz SLK and Audi TT, but shorter than the Porsche Boxster. The sport seats are tight, but comfortable and there is plenty of room for two adults. The head and legroom really are quite spacious for a two-seat sports car and the standard manual seats and tilt-telescoping steering column allow for enough
