Don’t reduce hours of operation for county’s parks BY GRANT MILLER Publisher This economy has got everybody in a crunch, and Miami-Dade County government officials are feeling the pinch just like everybody else. Tax revenue is down sharply and officials are looking for ways to cut expenditures. Mayor Carlos Alvarez has already submitted a budget that slices huge allocations from areas previously sacrosanct –police and fire protection, the arts, education, even after-school care. And now comes word that the mayor’s proposed budget will sharply curtail the county parks and recreation budget. Hiring will be frozen, the number of parks employees trimmed, the frequency of workers cutting the grass reduced, even basic hours that parks remain open are set to be scaled back. Hold on there! You can’t see it in the budget, but if the hours that a park remains open are going to be reduced and in the case of our Nature Centers locked up unless a fee driven program is operating, that means there’s going to be a reduction in the number of athletic, recreation and nature programs that are offered to our young people. And if that happens, you can expect to see a sharp rise in the county’s crime rate. And, while it may not be evident to the casual observer, that means there will be a direct negative affect on the quality of life for all Miami-Dade County residents, but particularly for those people who live in the inner-urban areas and less affluent communities. Athletic programs attract young people who, without sports participation, might otherwise be hanging out on a street corner or joining a gang. The county’s youth sports programs hosted in the county parks are vital to the social

Positive PEOPLE in Pinecrest

JENNIFER FERRER Palmetto High School graduate Jennifer Ferrer, who graduated magna cum laude in the top eight percent of her class, is headed to California this month to become a freshman at the University of Southern California. She was one of only 60 students chosen to enter the theater program. However, she is reconsidering her decision to major in theater and is undecided about her future course of study, though she is thrilled to going to USC. “It’s the only school I ever really looked into,” Ferrer says. “At first it was my stretch school; it was a huge, huge dream.” While she’s uncertain about entering the theater program, she is determined to go into the entertainment industry, which is why she is so excited about attending USC. “I’m going to get my feet wet with screenwriting,” she says. “I’ll see what’s out there. It’s the place to go, I know that much.” Ferrer was in the theater program at Palmetto for four years. This past year she had the lead role in the play Medea (she even performed an excerpt from Medea at the 50th Anniversary picnic) and she played a reporter in spring musicale, Damn Yankees. Like a lot of drama students, Ferrer was in Palmetto Players and Thespians. In fact, she had been elected vice presi-

dent of Palmetto Players, but budget cuts forced that club to be folded into Thespians, with the result that officers of both clubs served on a board. Ferrer was also a member of the Improv Club and secretary in her senior year. Overall, Ferrer accumulated more than 600 volunteer hours in high school. She had many more in middle school. Some of her high school community service hours came from working with Palmetto Elementary School students and helping them prepare for drama club performances. “My mom was head of the (Palmetto Elementary) Drama Club,” she says. “They had a play in the wintertime and a musical in the spring. About three weeks before the show would start, they would have two or three dress rehearsals a week that I would help them with.” Ferrer is accustomed to working with kids. When she was in middle school, she was named the District Five Volunteer of the Year. Her mother was a fourth grade teacher at Palmetto Elementary so she would go to school with her and get there early, around 7:45 a.m. “Because the middle school started later than the elementary school, I would be there when the pre-K kids went in,” she says. The children were in the varying exceptionality class so she would hold their hands and walk them from the car pool and help them get situated in the classroom. “They’d sit in the morning circle with their books or their blocks and then I’d go to school,” she says. Outside of school, Ferrer was a member of Students Offering Support or SOS, a student led community service group founded in the past year. SOS is a coed organization modeled somewhat on Twenty Little Working Girls. “On Valentine’s Day, we went to His House, a shelter for children taken from their families, and made cards with them and had a little barbeque picnic,” she says. Ferrer was a board member of SOS and was in charge of Family Day, a day when potential membership candidates could come by with their family and meet with SOS members.

MELANIE JOHNSTON Incoming senior Melanie Johnston sings alto in the Coral Reef Senior High chorus. Being in the chorus magnet program requires a lot of work and untold hours of practice. Johnston is a member of the Tri-M Music Society and will be the historian when school begins. As historian, she keeps records of the society’s events and helps the president plan community service projects, including fundraisers for the United Way. “Last year we had a benefit concert at the school,” Johnston says. “It was the United Way Benefit Concert. We’re going to do it again this September.” At that concert, Johnston chose a tune from the Broadway musical Wicked and sang a duet with a friend from. They chose music from that show because they both loved the play and they knew the song. This year she will be working on the planning for the benefit concert and she hopes to do more advertising for the event, both in the school and in the community. The planning hasn’t started for the concert yet, but she thinks it will be held in mid-September in the school auditorium. “This year I probably won’t perform,” she says. “I’ll help with all the back stage work.” After the benefit concert, Johnston will be busy with other chorus events. Each year the chorus participates in the

Junior Orange Bowl caroling competition. She also takes part in district and state competitions. Each competition calls for a different group of singers. “When we go to the caroling competition, it’s a hundred people,” she says. “When we go to district and state, we have different groups and there are usually 25 people.” This year, Johnston has a ton of work ahead of her since she was named the show committee chairperson. The show committee organizes the end of the year show put on by the students. “Every year we perform numbers from Broadway shows,” she says. “We have auditions for solos. We decided everything.” As chairperson, she will lead the planning for the show by conducting the meetings and making sure the work gets done. “Most of the things are done as a committee,” she says. “I don’t do things on my own. We’ll have meetings and think of things.” She was an assistant for last year’s show and she saw how things worked. She has already thought about how to improve the planning process. “I hope this year I can bring the group together and have a smoothly run show,” she says. Planning the show takes a lot of time and effort. Johnston’s mother Debbie says when her daughter worked on the show, they didn’t see much of her for two months. Along with singing, Johnston also takes dance at the Jill Mallory Studios, participating in the senior company for the last couple of years. Johnston has been dancing since fifth grade. She dances strictly for enjoyment and doesn’t compete. However, she does do community service through dance, performing at community events such as the Parade of the Elves for the past eight years. So far, Johnston isn’t sure which colleges she plans to apply to, but she’s considering attending school in the northeast. She has a couple of ideas on a major. “I’m thinking maybe communications or public relations or something like that,” she says. “I like dealing with people and that’s what you do with that major.”

SCHUYLER YACKEE Baseball is huge in Palmetto High School senior Schuyler Yackee’s life. Even now Yackee still plays in the Howard Palmetto Baseball Softball League.

“I’ve played ever since I was old enough to play T-ball and worked my way up,” Yackee says. “I still play every year. This will be my last year.” All of his friends that he’s played with all his life also play on the team. “I’m close family friends with them,” he says. “We all pretty much go to the same high school.” Now, he umpires games for the league, usually for the teams featuring 10 and 11 year olds. He also volunteers for Howard Palmetto. “My dad is commissioner so I usually have to do the try outs for a couple of the age groups,” he says. “For the younger kids, I usually toss the ball so they can hit and the coaches can watch, or I roll them ground balls. For the older kids, I toss them pop flies, and I have to catch for all the pitchers trying out.” Because he loves baseball so much, he did play for Palmetto when he was in the 10th grade. “I played last year and I had fun,”

Yackee says. “But I realized that I really don’t want to play ball in college. I wanted to take a break this (past) year.” So instead of playing baseball, he took a time out for the year to concentrate on his studies and prepare for all the required tests that college-bound students take in the 11th grade, including the SAT and the ACT. “Right now I realize I want to play a high school sport because I get bored,” he says. He’s decided to go out for lacrosse, a club sport in public schools. Yackee enjoys working with kids, so when his friend Josh Parker went to Israel for four months, he took it upon himself to take care of Josh’s brother Phillip, who has autism. “I took him to the games,” Yackee says. “I got him out of the house for a little bit, and I took him with me when I ran errands.” He did that to give Phillip’s mom a break and to get Phillip out in the fresh air.

“It was a little struggle taking him to the park, but it always worked out,” Yackee says. “It makes you feel good that you can help someone out. When your older brother, who is your best friend, leaves, it’s a little tough.” Academically, Yackee us taking a couple of Advanced Placement classes, along with several health classes so he can apply for the Florida Gold Seal Scholarship and Florida Bright Futures Scholarship. He hopes to attend the University of North Florida with those scholarships. “It’s a nice, quiet, small campus,” he says. “I can get my stuff done, but still have fun.” As for his major, he’s still not sure. “I’m going to take the first two years and see what I like,” Yackee says. “I don’t have to choose a major until my junior year. I’d like to do something in medicine, but I’m just not sure yet.”

A kid that is seriously committed to playing on a baseball, football or basketball team, or any athletic endeavor, is a youngster that is not going to be joining a gang or getting into serious trouble with the law. films. Earlier, he produced such blockbusters as The Texas Chainsaw Massacre, Poseidon and Hostel, but is now going into features on a full-time basis. When Hirsh graduated from law school in New York she moved to California where she worked for William Morris Independent as an agent for films. She helped package the features and even worked on one film, Frozen River, which was nominated for two Academy Awards including Best Screenplay and Best Actress. She worked there for five years before taking this new position where she will find material to option to make into movies. That material may be anything from a magazine article to books or scripts. “Since I come from an independent film background, I have experience in packaging,” Hirsch says. In a switch of roles, Hirsch is now a client of the company she was an agent for. “In conjunction with them, we will put together each product,” she says. Hirsch will be searching virtually everywhere for material to option. “Sometimes we already have a script; sometimes, if it’s a book, we’ll hire a writer to adapt it,” she says. “We have a development fund.” Next Films is already working on several projects. They have a deal to create a horror movie franchise from Black Sabbath. “The lead singer of Black Sabbath (Tommy Iommi) will create the soundtrack,” she says.

And in many communities where there is no evening activity, these programs represent the only physical activity and mentorship these kids will ever receive. Certainly, declining tax revenues mandate that cuts must be made in the county budget and there are many obvious areas in that budget that should bear scrutiny. But the hours that our county parks are scheduled to be open and the staffing needed to operate, program and maintain them should not be reduced; the programs they accommodate are too vital to the youth of this community. The park hours of operation and requisite staffing should be exempt from the budget paring knife. Hirsch says Next Films already has the horror genre brand, but they want to branch out and expand their product library. “It’s always going to be the commercial entertaining films,” she says. “More the thriller type films like Seven or Taken, or comedies and documentaries. The only thing we’re probably not doing is tiny dramas.” Hirsch is looking to produce commercial films that are smart, films that everyone will want to see because they are just good films. “We’d be interested in things like Boiler Room and Fight Club,” she says. “Smarter, high concept.” Hirsch says Fleiss’ partner Chris Briggs is based in Paris, which will bring a different approach to films. “He’s into this international world,” she says. Hirsch told The Hollywood Reporter that Next will be looking into remakes of international properties. She says her expectations are to make great movies and be on the producing side rather than the agent side, as she was before. Her dream project would be something along the lines of There Will Be Blood, but with a commercial bent. Having been in the movie business for a while now, Hirsch says she is no longer in awe of actors, for the most part. “The only person that I haven’t seen yet that I would be star struck with is Christian Bale,” she says. “I’m more intrigued with the filmmakers as opposed to the talent. Like meeting Quentin Tarantino was very cool to me.”

Please help! Adopt a dog or cat BY KELLY CRAIG No matter how many times I go to this place, I never quite get used to it. I know what I’m about to see will break my heart, yet I hold out hope for all of them. They are of different ages, colors and history, yet here and now they are all the same. Their beds are right next to where they eat, their food is served just inches away from where they relieve themselves. And then, there’s that look. That’s another thing they share. Their confused and plaintiff eyes all seem to ask, “Why am I in here? What happened to my family? Have you come to get me?” As I approach the very last one, I instinctively put my hand up to the glass, knowing he won’t actually feel the touch that I so long to give him; the touch they all so desperately want and need. I take a deep breath and walk away, hoping that someone will take a chance on an older one. Everyone wants a cute little baby. But it’s the older ones who will likely stay here the longest. And this year, there are more and more seniors behind the glass. Unlike their younger counterparts just a partition away, these guys have been around for awhile, and they know what they are missing: Their loving families, their homes. For now, a 4 x 4 kitty cubicle at PetSmart will have to do. The store donates the enclosures to several pet rescue organizations, as do other pet supply shops. I salute them all. Because of our economy, the number of animals being surrendered to rescue organizations has skyrocketed. According to the Humane Society of Greater Miami Dade County, their inventory has tripled from this time last year. It is a sad and sobering fact: Many people simply can’t afford their animals any more and are forced to give them up. The Humane Society has a no-kill poli-

Life With kelly cy. That’s the good news. The bad news is two-pronged: With triple the number of animals to care for, the expense of housing, feeding and medicating them also has tripled. While donations are down, The Society is still getting by, but of course more help is always needed. Secondly, the sad fact is that many older animals aren’t as attractive to those looking to adopt, and they are the ones who conceivably could stay at the shelter until their dying days. Indeed, there are some dogs that have gone without a loving home for years. Our family has three cats, all of them adopted from those who could no longer care for them, including one from The Humane Society and another from the Cat Network. There is no feeling more gratifying than knowing we’re loving three of God’s creatures that needed us. Everything we give them comes back to us three-fold in the form of purrs, hugs and the occasional stunned lizard one of them brings us as a present. The cost of animal adoption is very affordable; the fee is usually under $100 to cover the cost of spaying or neutering and their initial shots. One final thing to consider: For every older cat or dog you see behind the glass or metal cage, there is a family who likely still grieves their loss. Now that I think about it, there may be one greater feeling than knowing you’ve helped one of God’s creatures. Maybe it’s the fact that by doing so, you’ll also be helping His children.

Why am I getting cancelled by Citizens? BY PHILLIP LYONS We have been fielding a lot of phone calls at InSource lately regarding policy cancellation notices by Citizens Property Insurance Corp. If you’ve received one, there’s no reason to panic, there is a logical explanation. After many years using a manual entry system for underwriting and claims, Citizens is finally moving into the 21st century and automating its systems. In doing so, however, they have had to start from scratch which entails canceling the current crop of policies, then issuing new ones based on data entered into their computers. This becomes an issue if you obtained your first windstorm policy in 1994, let’s say, and Citizens’ coverage didn’t keep pace with inflation on the value of your home. Now, as part of the process, your agent must compute a new amount to rebuild your home, which, more than likely, is higher than that stipulated in the expiring policy. This, in turn, will result in a higher premium. How might you get around this dilemma? Consider upgrading your home’s defenses against a strong storm or hurricane. In insurance parlance, we call this “mitigation” of risk which, if certified by a licensed home inspector, will entitle you to significant discounts on your homeowner insurance premium. Hopefully, you’ve already had MiamiDade County certified storm shutters installed. If you have provided proof that your shutters passed county inspection to your agent, then you should have received a credit for them. However, mitigation entails far more than shutters. Here are some other things that, if documented by a licensed home inspector, can save you up to 60 percent on your windstorm premium: • Having a hipped roof which performs better in windstorms than gabled roofs. • If you have a gabled roof, a licensed professional roofing contractor can employ certain construction techniques to strengthen it against strong winds and airborne projectiles. • A roof deck of solid plywood, fiveeighths inch thickness, constructed with

Insurance 10-penny common or 8-penny ring shank nails spaced at 4 inches along the panel edges and every 6 inches in the field of the plywood panel. The nails should penetrate the decking directly into the roof framing. • Single or double straps for tie downs. For more mitigation ideas and construction techniques that can improve the wind resistance of new and existing roofs and homes, visit the website of The Federal Alliance for Safe Homes at <www.flash.org>. In general, you will receive a bigger credit if your home meets the 2001 county building code versus the 1994 or pre-1994 codes. This year, Citizens has also made changes to its eligibility requirements. If your home is insured for more than $750,000, Citizens will not issue you a new policy if you do not have countycertified storm shutters. If this is the case, you may have to find an alternative homeowners policy, which does exist for non-shuttered homes at a higher cost. Citizens now also requires that roofs that are damaged, have visible signs of leaks or have less than three years of remaining useful life be replaced because they are ineligible for coverage. Shingle, asphalt and fiberglass roofs must be replaced if they are over 25 years old, while tile, slate, concrete or metal roofs must be replaced if they’re over 50 years old. If your roof does not meet these guidelines, it could still be eligible for coverage. Your independent insurance agent can provide you with more details. So don’t fret about getting that cancellation by Citizens. You probably will be renewed. And, by taking steps to strengthen your home against windstorms, you will qualify for what can amount to significant discounts on your premium and sleep better at night knowing your home and loved ones are better protected.

If you’re planning to go bargain hunting, you are likely to come face to face with a special challenge: The longvacant home. Many of these properties have been foreclosed and now rest in the hands of the bank. The owners are long gone. While the greatest percentages of these “distressed properties” are still in fair condition, how can you be sure of possible defects in the home when the previous owners are not available to disclose such facts? Since the bank-owners and their real estate agent may not know all the details about the previous owners, you would be well served by ordering a “pre-inspec-

tion” if you find an attractive property at a low price. Hire an inspector for a preliminary look and do not make an offer until you know more. You can pay just a couple hundred dollars for a brief inspection, money well spent, before you submit a bid. Having an idea of the home’s true condition can help you determine your offer or help you make a decision to walk away from the deal, without any obligation. If the utilities are cut off, ask your representative about getting them turned on during the inspection, which is critical to the inspection’s accuracy. Take a careful look at recent sales in the neighborhood, and make your offer armed with knowledge and confidence.

New public high school in Homestead offers 21st Century approach BY ELLEN SCHULMAN The Homestead City Council recently approved plans for the new Mavericks High School of South Miami- Dade County to be located at The Chamber Centre, 698 N. Homestead Blvd. The unique 21st Century, high-tech school will be part of the Miami-Dade Public School system with first year capacity to handle up to 400 students in three daily sessions. “We have been so pleased with the support we’ve received from the entire community and the enthusiasm among city leaders for providing parents an alternative school option,” said Mark Thimmig Mark Thimmig, presi–––––––––––– dent and CEO of Mavericks in Education Florida LLC, the firm that currently opening five charter public high schools throughout Florida. “It’s heartwarming and encouraging to see such a strong desire to help kids in this community.”

Time to go back to school BY AMY DONNER School supplies used to consist of one three-inch three-ring binder covered in blue fabric, a five-pack of tabbed dividers, a 500sheet pack of lined notebook paper, one blue ball-point pen, two #2 pencils and an eraser. If you wanted you could add a few duo-tangs. Today I am on the hunt for a rubber fuchsia binder that folds in thirds, an 11-inch metric ruler, tabulated composition books, desk-size sanitation cream, a 1.5-inch cardboard binder, a hard-cover two-inch binder, a bendable plastic three-inch binder, a pack of all-mint colored dividers, a pack of allmagenta colored binders, a pack of mixed primary-color binders and of course duotangs with side pockets but no paper holder thingy, a pack of duo-tangs with paper holder thingy but no side pockets, a pack of duotangs with both, a rainbow pack of highlighters, 540 #2 Dixon Ticonderoga pencils (three per day), erasable ink pens in black and blue, non erasable pens in black and blue, which means something new that appeared for the first time this year, corrective tape? Red felt pen for grading. Couldn’t you use one of the colored pencils? Maybe,

but according to the kids, teacher by teacher you can’t be sure. And don’t forget a flash drive with enough memory to run a Third World country. The kids will tell you that some of the mandatory stuff never gets used and some of the optional stuff is really mandatory. So you scour the isles and scout several stores ‘til you proudly have it all. At home with your bounty you divide and analyze, head back to the store because the not-too-big, plastic (but not the brittle kind) protractor was somehow missed. We stored some stuff for later, packed the stuff needed for the first day and readied ourselves. The children are excited until suddenly it dawns on them; they have to carry all this stuff on their backs. On Tuesday and Thursday, the backpack will weigh 25 pounds. The other days it will be roughly 18 pounds. Good thing it isn’t the other way around, the optimists inform. Budget cuts explain some of the requests, but corrective tape? Come on, teachers, give me a break. Future kids may have to come to class with their own brick and mortar. I guarantee that the children will arrive home after the first day of school with, yep, another list! That’s the truth.

Montessori School grows BY LEE STEVENS Forty-seven years ago, Beverley and Jim McGhee searched diligently for the right school for their preschool-age sons, Alex and James. Dissatisfied with what they found, Beverley McGhee decided to start her own school, the Alexander Montessori School. Today, that small kindergarten has grown to become one of the largest and finest Montessori schools in the country, with four campuses, programs for children 1 1/2 to 12 years old, and an enrollment of more than 590 students. Achtung! IRS cracking down on secret foreign bank accounts BY ROBERT BLUMENFELD Several years ago, I wrote a column warning American citizens and residents with overseas bank/securities accounts that they were facing a world of hurt if they failed to comply with the simple requirements of the Internal Revenue Service relative to reporting their existence: 1. On schedule B of form 1040, it is necessary at question 7 to check the box “yes” if you have a foreign account (in excess of $10,000) and name the country where the account is held. Either a pure bank account or any securities account can trigger the requirements. 2. On schedule B, report the amount of interest or dividend income you received from the foreign accounts; on schedule D, report capital gains and losses. 3. By June 30 of each year, one must file a form TDF 90-22.1 with the United States Treasury Department. This is fairly simple to comply with. The problem is, if you don’t comply, you are not only committing fraud with regard to your income tax return, but you are also facing criminal sanctions for failure to file the TDF form. The penalties for failing to file the foreign bank account report (FBAR) can be severe; up to five years in prison with a fine of $250,000 for a criminal conviction and civil fines of $10,000 or 10 percent of the maximum amount held in the foreign account up to 50 percent of the amount of the foreign account. The account need not be in your name; if

If you are currently in violation of the FBAR rules, the IRS has an amnesty program based on voluntary compliance. If you come forward to the IRS before they send out any type of inquiry, generally you end up paying the tax and a minimal penalty. If they come to you first, however, be prepared for the worst. The IRS is stepping up the compliance in this area. You will soon be reading about UBS clients who failed to comply and the sanctions which will be applied to them. The IRS has identified some 19,000 Americans with accounts at UBS. Only 1,100 of these clients are compliant with FBAR. The IRS is currently, with the cooperation of UBS, obtaining information about the 18,000 noncompliant account holders and will soon begin audit activities in this area. UBS has agreed to pay a $780 million fine for its wrongdoing. If you have such an account either with UBS or another foreign entity, it would be wise to come forward and comply with the statute on a voluntary basis rather than to wait for the IRS to come knocking at your door. BY RODNEY BARRETO Chairman, Florida Freshwater Fish & Wildlife Commission If you ask law enforcement officers with the Florida Fish and Wildlife Conservation Commission (FWC) about their job, in the mix of describing what they do, they likely will say they love the work that they do. Their work to protect natural resources is important and meaningful; they want to contribute to society and make their community, state and world a better place. Undeniably, their jobs are unique, rewarding and adventurous, but there is also an element of danger. We were all reminded recently of how dangerous law enforcement is, especially conservation law enforcement, after FWC Officer Vann Streety was shot multiple times while investigating a suspicious situation and attempting to arrest a man on a warrant for traffic violations. Officer Streety was on routine patrol – which is an oxymoron, because by the very nature of law enforcement it is never routine. Streety was doing what officers do on patrol — searching for evidence of crimes or criminals and working to make the woods, waters, communities and anything in between safe. Hundreds of times, Officer Streety would have been in a similar situation, checking out something that didn’t seem quite right. This time, though, when the gunsmoke cleared, the officer was seriously wounded and the perpetrator was on the run. What ensued was a manhunt for the shooter by many law enforcement agencies. Fortunately, a few days after the shooting, a Melbourne Beach police officer caught the suspect as he was breaking into a vehicle. While some may imagine the work of a conservation officer involves sunny days

FWC REPOR T among butterflies, mellow animals and happy-to-see-you people, in reality many days are not so sunny and neither animals nor people are happy to see them. Although officers may enjoy their jobs – nonetheless, it involves risk. The very nature of conservation law enforcement is especially dangerous. Conservation officers can enforce every law of the state – not just fish and wildlife laws. Therefore, when they encounter something suspicious they don’t call it in or walk away; they investigate it. Conservation officers are typically by themselves; backup may be many miles away; and they are mostly in remote areas in the woods or on the water. Still, they do the job, because it needs to be done and they are the type that gets the job done. Officer Vann Streety survived. I, on behalf of the FWC, would like to thank all of the law enforcement agencies who assisted Vann on the evening he was shot and assisted in the search for the shooter. We would also like to thank the paramedics, the hospital and other medical personnel who kept Vann with us. He is a fine man, and we would have hated to lose him. Equally appreciated were the many agencies, private and non-profit organizations who contributed to a reward towards finding the perpetrator. Last, but not least, thanks to all of you who had kind words, thoughts and prayers for Vann.

• • OBITUARY • • Of all things, death is certain BY RON BEASLEY Good friends are hard to come by at any time, but even more difficult to find in this modern, perplexing world. When you lose one – unexpectedly or otherwise – it leaves you with an open wound, a feeling of loss, of finality; that something valuable has left your life, something that you really had no understanding of until it was no longer there. I learned recently that Johnny Woodruff, my close friend of 45 years, had suffered a sudden heart attack and fallen overboard from his boat docked on the Miami River. The Miami police found his body downriver, floating in Hurricane Harbor two days later. Johnny was a very popular and wellknown man in the community and in the marine industry, where he had established himself as an expert in marine maintenance and repair through his business, Ship’s Crew Marine. He could tell you the best way to keep a head (that’s what you call a toilet on a boat) clean and flushing properly just as easily as he could determine why an engine was coughing and sputtering. He also was an incredible sailor and often flew to the Caribbean to retrieve a yacht and sail it back to the U.S. for the owners. I often called him a modern-day pirate and he would just flash that charming grin of his and offer me another beer or a shot from his bottle of rum. I first met Johnny Woodruff back in the early ’60s when I was a student at the University of Miami (he an exundergrad at the University of Florida) and we were both heavily involved in 1940s and ’50s era British sports cars. He drove an aging Austin Healey and I a 1956 MGA. We – John and I and a few other hearty souls — started a sports car club (the South Florida Sports Car Association) and began hosting monthly hound-andhare rallies out in West Kendall near Krome Avenue; in those days, the area was little more than farmland.

Those were wonderful days. We would usually wind up at somebody’s house in deep South Dade where we would tap a keg of beer and hand out a few trophies to folks who had participated in the rallies. Over the years, Johnny and I went our separate ways, but we remained friends and always somehow seemed to re-connect, usually at the annual King Mango Strut. We worked on a few movie productions together that were being filmed in Miami and I even

found myself sleeping on his couch in his Coconut Grove apartment during one difficult period in my life. Johnny was someone you could call on if you needed a friend, someone who was always there to lend a hand, someone who would help you as much as he could, no questions asked. I won’t get into how our paths diverged in later life. Suffice it to say that we remained friends and talked almost every day on the telephone, often meeting for lunch at Flanigan’s Laughing Loggerhead Saloon in the Grove. And now he is suddenly gone and I will miss him and all that made him special. His demise underscores an axiom that I have always believed; that of all things, only one is certain — death. It is final and there is nothing that anyone can do to change it. Goodbye, my friend.

As experienced Tax Attorneys, we strive to focus on the IRS’ most current target of wrath and explain it to our readers in a straightforward manner, in an attempt to demystify the IRS’ current tax initiatives and simplify all associated tax issues. Recently the IRS's best efforts have focused on obtaining information about American citizens and residents who have overseas bank/securities accounts which are not memorialized on their tax returns. To fail to do this invites substantial penalties; felony jail time and a fine equal to 50% of the amount held in the foreign accounts. Commissioner Shulman has offered amnesty to anyone who would confess his sins to the Internal Revenue Service before September 23, 2009. Entering the “voluntary compliance program” gives the taxpayer's two major breaks; no criminal prosecution and a fixed penalty which is limited to 20-25% of each year's additional tax liability plus an additional fine equal to 20% of the highest amount in the overseas accounts. Generally the voluntary disclosures will require: 1. Payment of all taxes and interest for the previous six years. 2. Assessment of an accuracy penalty of (20%) or a delinquency penalty (25%) for all years and 3. An FBAR penalty of 20% of the highest account balance during the six year period. To give you a feel for the extent of the actual economic bite of these various disjunctive penalties, we can look to an example provided by the IRS of an individual who's had $1 million in a foreign account, which earned 5% a year ($50,000). The cost for this individual to make a voluntary disclosure for this unreported income from this foreign account would be $386,000 (38.6% of amount in the account), plus interest. Such a deal!

Immigration and Naturalization has its own definition of what is a U. S. resident. The IRS and the various states, for income tax, real estate laws, property tax exemptions, marriage and divorce law, have individual (and not always similar) definitions of residence. Our main concern for the purpose of this article is residency for United States income tax purposes. The Internal Revenue Service has two principal tests for residence; if you meet either test, you are a United States resident for income tax purposes and subject to taxation on your worldwide income. The green card test; if you are a non US citizen who holds a “green” card (actually, it's pink now), you are a U. S. resident for tax purposes. This means that you have “a lawful permanent residence” in the United States. Once you obtain this card and you physically enter the United States after its acquisition, you are, in essence, admitting to the Internal Revenue Service, that you are a United States resident, ergo subject to all the same tax laws which are applicable to American citizens. The substantial presence test; this relates to a mathematical test predicated on the number of days you spend in the United States over a threeyear period. The formula is: (number of days present in the United States in the current year) + (1/3 of the days present in the United States in the immediate preceding year) + (1/6 of the days present in the United States in the second preceding year). If the total exceeds 183 days in a three-year period, you are a United States resident for tax purposes. Generally speaking, if an individual spends more than four months a year in the US, then they will be a US resident. This is true even where an individual is physically present in the US illegally!

The IRS feels that it is a good deal, that should be considered seriously by anyone who has undisclosed foreign income. An individual who does not come in voluntarily and is later discovered by the IRS, could be subject to an assessment of 231% in taxes, accuracy related penalties and FBAR penalties, in addition to facing possible Criminal Charges! This offer is only open to taxpayers who make voluntary disclosures by September 23, 2009.

Let's see how this works. Melvin, a Mexican citizen, has been spending substantial amounts of time in the United States during the last three years.

So who is potentially in trouble here? The United States is one of the three countries in the world to tax both its citizens and residents on their worldwide income. Most countries tax only people who are residents without regard to citizenship. Canadians, for instance, pay income tax only while they are resident in Canada. Once they leave Canada (changing residence), they are no longer responsible for Canadian income tax. This is the general rule followed by most countries in the civilized world. For American citizens, there is no reprieve. No matter where in the world you live, you are responsible for filing income tax returns and paying taxes to the United States. Magnanimously, if you live outside the United States, the IRS gives you an extra 60 days to file your tax return.

Conclusion: for tax purposes Melvin is a United States resident. He must pay United States income tax on all of his worldwide income. If he still has bank/securities accounts in Mexico which total in excess of $10,000, he must file the FBAR form. If he fails to do so, he is subject to criminal tax sanctions as well as a penalty of 50% of the total in all foreign bank or securities accounts. So long as he has signatory authority over a foreign account, he will be held responsible for paying all taxes on the income produced by this bank/securities accounts and criminal sanctions if he fails to file form TD F 90-22.1.

The gray area of law concerns United States residents. Actually, the law is quite clear- if you are a U. S. resident, you have a tax responsibility identical to that of a US citizen. The issue that often arises between “resident” taxpayers and the Internal Revenue Service relates to who is a resident of the United States. Many foreign nationals spend a lot of time in the United States. If they exceed the “residency” thresholds, their worldwide income would become subject to United States income tax. In addition to this, if they maintained bank/securities accounts in their home countries and fail to file the required form (FBAR), they would be subject to the same 50% penalty and potential criminal prosecution as any other US taxpayer. What is residence? This is a word which has a multiplicity of meetings depending on which government agency you are dealing with.

The Internal Revenue Service can and will check your passport and visa to count the exact number of days that you are in the United States during the period in question. This is really a trap for the unwary. You can be a United States citizen or a resident, inherit a substantial bank account or securities account in a foreign country, and still fall prey to this trap. If you have this type of potential problem, the soundest advice that I can give you is to review your situation with a knowledgeable tax attorney or accountant. Make certain that this person has knowledge in this particular area of the law because, as I stated previously, the punishment for failing to adhere to this area of the tax laws is confiscatory and potentially confining. 2010 GLK is sporty new compact Mercedes-Benz SUV Ron Beasley AUTOMOTIVE EDITOR

LET’S TALK CARS The compact and stylish GLK is the newest member of the Mercedes-Benz sport utility vehicle lineup. Launched earlier this year as a 2010 model, the GLK looks like a smaller and lighter version of the popular GL. However, the sporty profile, angular nose and a steeply raked windshield distinguish the GLK from its larger sibling. Projection headlights and an integrated rear spoiler are additional distinctive features. The GLK350 has plenty of power with a 268 hp 3.5-liter V-6 engine under the hood mated to a 7G-Tronic7 seven-speed automatic overdrive transmission. It clocks 0-60 mph in 6.5 seconds and has a top speed of 143 mph. Mercedes says this is one of the most efficient engines it has ever produced, with lightweight casting, forged connecting rods, variable valve timing on the intake and exhaust valves,

variable intake tuning and advanced combustion techniques for cleaner emissions and more power. The new GLK is unique with its fourwheel independent suspension that gives it the ride of a sports car, while the Standard Agility Control suspension allows for both soft and stiff shock absorbers. Each twin-tube shock absorber is fitted with a hydraulic by-pass piston that acts like a very soft shock absorber to effectively dampen road noise and tire vibration. On bumpy or uneven roads, the by-pass piston is negated to preserve the steering and handling response of a stiffer shock absorber. The GLK has good ground clearance for off-road driving and the standard roof rack and optional running boards emphasize the versatility of the vehicle. Other standard equipment includes 19-inch alloy wheels, fog lights, roof rails and privacy glass and chrome detail elements inside and out. On the inside, the GLK has all the usual Mercedes-Benz luxury, but with some new features, too, such as the central controller on the console for combined control of the sound system, navigation system and telephone. panel and dashboard layout are more angular and purposeful, with all dashtop panels made of anti-glare black, regardless of the interior color scheme. One drawback to the GLK is the relative lack of cargo space. In the standard seating configuration, the GLK has a capacity of just over 23 cubic feet and even with the rear seatbacks folded down there is less that 55 cubic feet of load space. There is a smaller hidden storage area beneath the floor. A power tailgate is a nice option; the gate can be raised and

lowered with the push of a button. Suggested retail price on the GLK350 with 4MATIC is $35,900, but with such add-ons as the Premium Package, Multimedia Package, Lighting Package and Sport Appearance Package, the bottom line can easily reach $50,000.
