Council creates separate dept. for Pinecrest Gardens
BY CINDY LERNER Mayor, Village of Pinecrest The Village Council fully appreciates the significance and value of Pinecrest Gardens as a crown jewel in this community and it must be treated as such. Therefore we have taken the steps necessary to provide opportunities to strengthen its capacity to serve as the cultural arts center for the Village. We voted to create a separate department for the Gardens with its own executive director whose primary responsibility will be to create arts, musical and theatrical programs, market them to the community, provide professional development to bring in a strong revenue stream, and to build a strong base of volunteers to support the cultural, educational and horticultural aspects of the gardens. The executive director position is now open and advertised. The salary is in the $80,000-$100,000 range. The deadline for acceptance of applications is Dec. 11. The application is available at <www.pinecrest-fl.gov>. The rationale for doing this was simple; we have an asset that is not meeting its best and highest use. It is a true jewel and a place for our community to experience cultural enrichment in a gorgeous setting and learn more about our history and our environment. We can no longer afford to have the Gardens remain a financial drain on the Village. We fully realize that with some specialized attention, professional marketing and development skills it is capable of bringing in significant revenue to cover the $1 million it costs to operate the Gardens. We will also begin to aggressively seek federal grants and have recently hired a federal lobbying team to help us acquire funds for this and other infrastructure. Pinecrest Gardens holds much promise

The following nature centers will be open every week from Wednesday to Sunday, 9 a.m.-5 p.m., and will be closed Mondays and Tuesdays: A.D. Positive PEOPLE in Pinecrest
ANDREW KOFF Andrew Koff began bowling at a very young age. He rolled his first bowling ball down an alley at the venerable Bird Bowl Lanes in Southwest Miami-Dade County when he was just six years old. “I started off well and I took lessons,” he says. “Bowling just came pretty easy to me and I enjoyed it, so I stuck with it.” Koff started bowling in leagues and then, when he was 11 years old, he began entering tournaments. Initially, he lost; but suddenly, when he turned 14, he began to take home the top trophies in the tournaments he entered. He won so many tournaments that he lost track and he says he is not sure about the number of tournaments he has won. Today, Koff is a senior at Gulliver Prep and he bowls in both national and international tournaments as a member of Team USA. “I made Team USA two years in a row,” he says. “I have 11 or 12 gold medals for the Team USA tournaments. They have youth tournaments and I’ve bowled in those, as well as pro tournaments.” Koff says he will try out again for Team USA. The first time he went out for the team he finished fourth and last year he finished second. “They have a national qualifying tournament every July,” he says. “They have 1,200 people compete and the top four make it.” At 17 years old and in high school, he is the youngest person on the team. The others are all in college.
“I’m on the junior team until I’m 20,” he says. Koff says he hopes to include bowling in his future and has his eye on a career as a professional bowler. “I do like the professional tournaments,” he says. “I’m also going to go to college and study something like mechanical or computer engineering.” Being a professional bowler will not keep him off the adult Team USA because the rules now allow for professionals to compete. “I will try to do both,” he says. In the meantime, Koff has started a foundation called Bowl For All to promote high school bowling. The foundation raises money to enable high school students to take bowling lessons. “We’ve had garage sales and we have events (to raise money),” he says. “We ask people to donate. The foundation helps any school that wants to bowl; Palmetto, any of the teams around here, you can bowl. I got the league rate, I got the free lessons and I try to coach.” The foundation is based at Bird Bowl, which Koff says is the only bowling alley within a 40-mile radius. Koff also coaches other high school students and younger players and is a member of the Gulliver bowling team. “We should do pretty well this year,” he says. Even with all the time he spends bowling, Koff doesn’t let his grades slide. He is a member of the National Honor Society, an academic club which also does community service. “Mainly I do my community service through bowling,” he says. “I run tournaments.” The tournaments take place at the Kegel Training Center in Lake Wales, which trains players for both national and international events. The center is a valuable resource because it has the most up to date equipment around. “The technology they have is unmatched by any other place in the world,” Koff says. “I’ve trained there for nine or 10 years.” Because of bowling, Koff has earned $70,000 in scholarships to the university of his choice. He recently was given the 2009 United States Bowling Congress Chuck Hall Star of Tomorrow Award, which comes with a $6,000 scholarship. The award is given to a male high school or college student who bowls and has a terrific personality. By Linda Rodriguez Bernfeld
JASON VEITCH For three weeks last summer, Gulliver Prep junior Jason Veitch followed a health train in South Africa as a member of a film crew making a documentary on the charitable organization. “It brings primary health care to the rural people in South Africa,” Veitch says. He was invited along on the shoot because of his computer skills, which he used to not only document what was going on during the filming, but for a small part in the editing process. “I was the IT technician,” he says. “I also took still pictures and some video, and I interviewed some people.” The producers hoped to enter the film in the Miami Film Festival depending on editing and festival deadlines, but Veitch says it will definitely be in the Los Angeles Film Festival. If it does well at the LA festival, the producers may enter it in other film festivals. Veitch was asked to go on the trip just a month before the director and her family were departing. The director, Kirsten Cavendish, is family friend. Veitch says he learned a lot while on the trip. “Everything from how to operate a camera, to documenting footage, how to get interviews and how to do interviews,” he says. His time in South Africa was eye opening. “You go to see hands-on what medi-
cine could do to help,” he says. “You see it here in Miami, but you don’t see it at their level of poverty. They make $24 a month. They are really poor and below the poverty line in that country. We met a bunch of people that walked over 40 kilometers to get to the train. It comes once every two years.” Once the filming was over, Veitch and his friends toured the rest of the county. “It was extremely interesting, it was still such a fresh country out of the Apartheid era,” he says. The country was somewhat unsettled while he was there. Veitch says the country was experiencing rioting at the time. “We actually drove through a town that had had a riot the night before,” he says. But he was also able to have fun. They did go on safari for four days and stayed at a beach resort for one day. “We might go back next year for another charity,” he says. Because of his experiences, he’s working on raising money to help the organization get a second train. It’s also made him more active in his community service At Gulliver, Veitch is a member of Open Ears, Open Arms, a club that helps the homeless. “We do blanket drives, shoe drives, toiletry drives,” he says. He’s also a member of HISA, the Biomedical Science Club, JETS (Junior Engineering) and Scuba Diving. College is not that far away and so far his top choices are both in the United Kingdom – St. Andrews University for biology or Imperial College in London for bio-technology. England is a draw for him because his father is British. Although he enjoyed his time working on a film, he’s pretty sure his life’s work will be in the sciences and not the movies. But, if he does change his mind and go into film, he says, he wants to be a producer. By Linda Rodriguez Bernfeld

MARTIN AROSTEGUI Gulliver Prep senior Martin Arostegui has an unusual hobby. “Ever since I was four, I’ve been fishing,” he says. “I live to fish.” At first glance, his love of fishing doesn’t
seem that unusual, but he takes it one step further – he is constantly in pursuit of fishing world records. “I have 120 world records,” Arostegui says. “It takes a lot of time, effort, dedication and a lot of patience. I think I caught my first one when I was six.” Arostegui became interested in pursuing fishing world records because of his dad. “My dad has the most world records out of everyone,” he says. “He has over 300.” Those world records took more than 10 years to accumulate. Arostegui says it’s not a matter of just going out and finding a favorite fishing spot and kicking back until a record breaking fish comes by. “We do a lot of research; we know specifically what we want to catch, we know who we need to go with and what kind of line we need,” he says. “It’s difficult, but sometimes you can get lucky and stumble into one. You have to have the right tackle, it has to match the IDF recommendations; you have to have witnesses and you need to match the GFA recommendations.” While it all sounds complicated, he says some fishing records are easier to break.
Sometimes it’s a matter of finding out which record to go after. “There are thousands of fishing records that could potentially be broken. Every year they add new species,” he says, adding that the newer species’ records are easier to break. “My dad and I do a lot of fishing around here, but we also do a lot of international fishing in the hunt for world records.” Arostegui entire family has a world record or two, or three. In fact, his mom is fishing in a year-long fishing tournament with the International Women’s Fishing Association. When he’s not fishing, Arogstegui participates in several school clubs. He’s treasurer of HISA, a student health club that runs blood drives at school. Club members also participate in the Susan G. Koman Walk for Breast Cancer. He’s also a member of the Juvenile Diabetes Research Foundation at Gulliver, which is the most successful high school club in the nation for raising money for diabetes research. Arostegui is interested in health organizations because his father was an emergency room physician and his mother was a nurse.
Arostegui is also a part of the Gulliver Prep School Clean Water Project. The organization is developing a solar powered water filter system for Haiti and recently finished prototype one. “Currently, we are designing and will soon build prototype two,” he says. “This is something the third-year engineering class has been trying to bring to fruition.” Arostegui’s other main volunteer activity is working as a camp counselor at the International Game Fish Association (IGFA) museum in Dania. “I go up there and teach a group of kids how to fish and about conservation,” he says. “We end up traveling a bit, going different places nearby to go fishing. And we visit a couple of nature preserves.” Now that’s he’s a high school senior, Arostegui is sending applications to Stanford, Rice, the University of Miami, Brown, Georgetown, Johns Hopkins, Princeton, Harvard and a liberal arts school in Maine. He says he might major in biology, but is also considering medicine and marine biology.

What’s that old saying? Ah yes, the best things in life are free. In our current economy, even the mere mention of the word “free” gets our attention doesn’t it? Certainly one of the best things in the lives of those fortunate enough to live in the Village of Pinecrest is the lovely library that opened this year, right next door to Pinecrest Gardens and adjacent to the Pinecrest Community Center. I find myself using it more and more these days. Yes, like a lot of folks, I still love the convenience of walking into a book store and plucking exactly what I need from the shelves, paying for it and then hitting the highway. These days when every penny counts, plunking down 25 bucks for something I could borrow for free just seems silly. What’s more, I’ve always felt guilty for buying a book, reading it and then simply retiring it to my dusty pile of other tomes that rarely see the light of day ever again. Apparently, the rest of the country agrees. Nationwide, book sales are down 20 percent. Library use on the other hand, has skyrocketed. Books are meant to be shared and enjoyed by all and, thanks to our state-of-the art branch, books are just part of the draw. If you haven’t yet been there, you owe yourself a trip. You’ll pardon the
Life With kelly expression, but this ain’t your parent’s library. It’s 15,000 square feet and with so many windows that the place is illuminated with natural light; this library has a very organic yet modern feel. There’s the main area with moveable shelves for future reconfiguration, and also a cafe-like section where you can bring your own PC or use one of the library’s. Children and teens have their own sections chock full of DVDs and CDs. I’ve seen more than a few moms having to use serious persuasion techniques (bribes) to get their little ones to finally agree to go home. Little wonder since there is a total of 35,000 materials from which to choose. There is also a large meeting room that can facilitate a multitude of needs, including book clubs and guest speakers. The icing on the cake? You can check out using a little scanner tag that fits right on your key ring. Yup, seems everything old is new again. In the case of the Pinecrest Library, however, everything is simply new and beautiful. You can visit the branch at 5835 SW 111 St. Enjoy! Pinecrest lawyers help win $8.5M verdict FROM ROBIN’S DESK ––––––––––––––––––––– BY ROBIN KORTH –––––––––––––––––– On Friday, Oct. 30, a jury returned an $8.5 million verdict and found Dr. Alba Martinez 30 percent liable for the death of Clementina Brown. Attorneys John Perez, Brett Panter, David Sampedro and Josh Wintle fought vigorously to make the jury understand how easily this tragedy could have been prevented by timely action on the physician’s part. Dr. Bruce Clarin began his optometric practice as a tiny boutique shop on Fern Street in 1980 after working at Bascom Palmer Eye Institute. It has since blossomed into Palmetto Bay’s premier eye care center, focusing on individualized patient care and quality eye health examinations. Once, the typical perception of a chef was a large, beet-red individual with stress painted all over his face who yelled “BEARnaise” and “HOLLANdaise” at his staff, and had a personal bad habit with mixing wine leftovers with cognac used for flambéing. Then came the ’90s where cooks had to be bald and muscular poets in their own mind who challenged the world’s possible and impossible cuisines on their plates (i.e. truffles and chili-marinated shrimps from Thailand, soya baked coconut and cabbage wontons with sautéed onions). Their creations were endless with never a dull moment in order to reinvent the wheel. A professional chef is constantly in competition between heaven and hell — creating heaven, but going thru hell getting there — a battle that has swallowed many culinarians through time as demands were raised to levels that nobody could possibly continue to compete at. Luckily, my age and years in the kitchen (27 be exact) have given me insight into the above-mentioned phenomena, but mostly in the end have left me with experience and knowledge of what works on a plate, and what doesn’t. My motto has always been learn to perfect the trade before challenging it. With that said, I urge you to come together around the stove and cook your favorite family recipes to find comfort in this interesting fourth quarter of 2008, when a great deal of uncertainty has weighed on us. Alternatively, spend an evening in your favorite restaurant and share moments with staff and company. Here are a few classics not to be forgotten or challenged. PIGS IN A BLANKET I just love this very simple, but forgotten delight. Wrap a favorite “wiener” in a puff pastry and bake for 10 minutes in an oven at 400 degrees; sauce it with mustard and ketchup. What else need be said?
MEATLOAF 1 lb ground beef 1 lb ground pork or veal 4 eggs 1 cup breadcrumbs 2 cup milk 2 strips of bacon cut into pieces 1/2 cup chopped onions 1/2 cup finely diced carrots 1/2 cup finely diced celery 1/4 cup BBQ sauce Splash of Worcestershire sauce Salt and pepper Mix bacon, carrots, onions and celery and sauté gently for 10 minutes and set aside. Mix meat with salt and pepper and stir for about a minute; add vegetables and mix. Add remaining ingredients and mix. In a loaf pan or baking tray, mold the meat loaf. Bake the loaf about 45 minutes at 300 degrees. Serve with mashed potatoes, buttered Brussel sprouts, smothered onions and pan gravy. CHOCOLATE SOUFFLÉ Serves 8 8 6 oz. ramekins coated with butter and dusted with sugar 1 cup flour 1 stick of butter 1 cup sugar 1 cup of bittersweet chocolate 2 cups of milk 8 eggs whites separated from yolks Bring milk and sugar to a boil; melt butter with flour and toast into a roux. Add milk mixture and stir at medium heat for 2 minutes. Add chocolate and let melt while stirring. Place “ batter “ in mixer and mix for 5 minutes, Add 1 egg yolk at the time 8 all in all Whisk egg whites until stiff peaks, gently fold into batter until totally mixed, Divide into ramekins, bake for 15 minutes at 350 degrees, serve immediately Serve chocolate sauce, ice cream or fudge alongside. Much comfort to you and yours.

ORTHODONTIST’S CORNER Thumb Sucking and Pacifiers
It is fairly well known that thumb sucking or pacifier use can have detrimental effects on the teeth, but did you know that facial and jaw development can be affected as well? What are the results of prolonged thumb sucking or “binky” use? Most commonly, the upper front teeth tip forward and stick out. This creates an open bite in the front, generally referred to as “buck teeth” (See dental photo above). In addition, the upper jaw may fail to develop properly, leading to a high palate and a narrow upper jaw. The back teeth can grow into a cross bite, meaning they do not fit together properly when closed. The lower and upper jaws may grow disproportionately, leading to a “weak chin” profile. Functional issues may develop as well. The high palate mentioned above has been shown
to be associated with recurrent ear infections in young children. The most damaging problem is that the open bite often causes the tongue to rest and function too far forward and in an incorrect position. This is referred to as tongue thrusting. The tongue positioning and open bite lead to difficulty pronouncing the “S’’ and “TH” sounds. Re-training the tongue is not always possible, increasing the chances of the open bite to relapse after orthodontic treatment (even with good retainer wear). Orthodontics can usually correct the above dental problems; however, these can be some of the most challenging cases to treat. The more severe the problem at the start, the longer, more complicated, more expensive, and less predictable the treatment will be. To prevent the complications and expenses of a “misguided” tongue, it is strongly advised that parents help the children stop sucking the thumb or pacifier by the age of two. Palmer Trinity athletes get high-tech treatment BY SUZANNE GOTTLIEB CALLEJA The ability of coaches and trainers to prevent and treat athletic injuries has increased tremendously in the last few years, and Palmer Trinity School is right on the cutting edge. Through his connections in the industry, trainer Clint Jones recently fit one student athletes with a high-tech knee brace that would normally cost thousands of dollars. Senior football player Eric Torbert is wearing a custom knee brace from BREG Inc. that enhances his recovery from recent knee surgery and allows his full participation in competitive sports. After a lengthy rehabilitation, Torbert was fitted with the new knee brace made of a lightweight material that allows for full movement, while providing increased stability and safety compared to the older, bulkier knee braces. Nick Rodriquez, another Palmer Trinity senior, also suffered a knee injury earlier in the year and was treated with a similar brace. However, since Rodriquez has not yet made a full recovery, Dr. Dan Kalbac, of the Orthopedic and Sports Medicine Center of Miami, has decided to perform a new and innovative proce-

own blood and spinning it down in a centrifuge. This separates the plasma layer from the blood.” The plasma has different growth factors that Dr. Kalbac injects into the knee to stimulate the ligament to heal without surgery. So far, he has had success with many types of problems, including tendonitis of the knee, tennis elbow, and rotator cuff and shoulder injuries. His goal is to have Rodriquez back playing football before the end of the season with his new brace on. Coach Jones and Dr. Kalbac have established a strong working relationship with several sports medicine companies to allow Palmer Trinity athletes access to these new-age products. Kalbac is the team physician for the U.S. World Cup Soccer Team and for the Gold Cup Soccer Tournament held in Miami, and he treats professional, college and high school athletes in all sports. “The service and care of the sports medicine group at Palmer Trinity is more like a college environment than that of a small independent school,” said athletic director Jake von Scherrer. “We are truly blessed to have these services for our kids.” For information, go to <www.palmertrinity.org>.

Exonerated cardiovascular and thoracic surgeon tells his story BY NANCY EAGLETON Dr. Alex Zakharia, a highly-esteemed American Board Certified Cardiovascular and Thoracic Surgeon with a 40-year career, has been vindicated by the State of Florida and the Florida Board of Medicine and is in the process of getting his medical license reinstated in 2010. “It is time to clear my name in the court of public opinion,” stated Dr. Zakharia. “My family and I have suffered from this unspeakable injustice. The truth has prevailed. I am so grateful for the support and letters of good wishes from my colleagues and patients. I get calls from patients every day, and I offer them guidance respecting their health issues.” In a letter to Dr. Zakharia dated June 10, 2009, the Florida Department of Health affirmed that the Board of Medicine’s Probable Cause Panel “found there was insufficient evidence to support prosecution” and the pending case against Dr. Zakharia, which investigated past medical cases and his personal health was dismissed. There are no pending cases. This is just one of the final steps in a long legal battle that Dr. Zakharia has endured since 2002 when he proffered a medical opinion during a telephone deposition on behalf of a veteran in Michigan who brought a civil malpractice lawsuit against the Veteran’s Administration. The veteran had undergone a coronary artery bypass graft surgery (CABG) and experienced a brain stroke during the surgery. The prosecution had hired Dr. Zakharia as a vascular surgery expert, who was approved by the Michigan Supreme Court, to testify that if a proper ultrasound was performed prior to the surgery, the disease in the carotid arteries would have been revealed and corrective surgery performed prior to the CABG procedure. Dr. Zakharia offered no criticism of the CABG procedure itself during this 49 minute long-distance deposition and it was never used in court. The case was settled in the veteran’s favor. In May 2004, the Assistant U.S. Attorney (AUSA) Eastern District of Michigan filed charges against Dr. Zakharia, claiming he exaggerated his credentials and made false statements with regards to his CABG experience in the deposition. The AUSA claims were based on records obtained from the defunct Cedars Hospital in Miami naming only the “main surgeons” for CABG procedures performed at that hospital. Dr. Zakharia maintained during his deposition that he was not the main surgeon in these procedures at Cedars, but was, in fact, the attending physician for the period of time in question. Dr. Zakharia had been a main CABG surgeon for 30 years prior, but at other centers. “There is a difference between attending physician and main surgeon, and it was imperative that the AUSA use correct terminology,” said Dr. Zakharia. “My experience as attending physician qualifies me to recommend that an ultrasound treatment should have been conducted prior to this CABG procedure.” Had Cedars Hospital provided complete records to the AUSA, they would have attested to the fact that Dr.

Zakharia was undeniably the attending physician, consultant and provided patient care in over 400 cases spanning a period of seven years, and also had active privileges in Thoracic and Vascular Surgery over the past 25 years. Dr. Zakharia has a pending lawsuit against Cedars Hospital which alleges intentional omissions in record production, fraud, defamation, and misrepresentation of hospital privileges. “These misrepresentations have been repeatedly produced in tandem in many Miami Herald publications and were relied upon by the AUSA in Detroit to try to build this case,” said Dr. Zakharia. The doctor and his attorney provided the AUSA with medical records and letters from patients corroborating his role in CABG procedures as attending physician. Letters from the Chief of Cardiac Surgery at Miami Heart Institute, Chief of Anesthesia and Director of Nursing also confirmed Dr. Zakharia’s role as assistant surgeon/ co-surgeon at that facility in CABG and Primary Surgeon in Thoracic and Vascular procedures. Dr. Zakharia also provided the AUSA with extensive character, professional and public service records as evidence of his impeccable record over the past 35 years. Dr. Zakharia had no pending lawsuits, investigations, or complaints from any professional, hospital, medical, criminal or civil authorities. “The case was also reviewed by prominent Miami legal authorities, judges, as well as presidents of national surgical societies, who concurred that the AUSA’s position was unwarranted and outrageous,” said Dr. Zakharia. “I
simply gave a medical opinion which was never refuted and suddenly found myself facing criminal charges.” Since the motion to change venue to Miami was denied, and the costs and stress of a full blown trial were overwhelming, Dr. Zakharia settled the case with a plea agreement for Contempt of Court/One Count Misdemeanor. “I had 15 doctors who would have testified on my behalf, but with the trial in Detroit, it was simply not feasible,” said Dr. Zakharia. He said that he and his attorney were led to believe that the proposed penalty in this plea agreement was based on a downward departure and was fair and just. In reliance on this, they accepted the terms, which required the doctor to relinquish his medical license. During sentencing and following the signing of the plea, the AUSA admitted that a mistake was made in calculating the penalty. This meant that Dr. Zakharia had agreed to a penalty that did not correspond to a misdemeanor offense. The proposed penalty was based on a felony charge and not a misdemeanor, and the AUSA admitted this mistake in court. Simply stated, there was no need to trade the practice of medicine for the illusion of a downward departure. “How can an allegedly experienced AUSA commit such malpractice?” Dr. Zakharia said. “If there is no downward departure, why should I retire from the practice of medicine? The issue of relinquishing my medical license was tied to the downward departure, which was not even necessary. I accepted the plea, which was supposed to be a lesser penalty. It was not so. In retrospect, I paid the price for the AUSA’s fraudulent representation and lack of candor. When I realized this, I stated that I wanted out of the plea agreement. We are appealing this miscarriage of justice, and my goal is to get my medical license back.” Dr. Zakharia is encouraged by the finding. “The vindication by the State of Florida is a major victory, which by all standards of fairness and justice, refutes the entire basis for the AUSA’s arguments, the defamatory articles published by the Miami Herald and Cedars’ malicious claims,” he said. Dr. Zakharia has been in private practice in cardiovascular and thoracic surgery in Miami since 1985. Prior to this, he served as an Assistant Professor at the University of Miami’s School of Medicine, the Attending Cardiovascular and Thoracic Surgeon at Jackson Memorial Hospital and the Chief of Cardiovascular Surgery at the Veterans Hospital in Miami. “I’ve practiced at seven different hospitals in Dade County and have trained hundreds of students and residents,” said Dr. Zakharia. “I’ve been published in various books, publications and medical journals and lectured at numerous seminars including the Armed Forces in Bethesda. I am an active member in most national and international societies for Cardiovascular Surgery and was the subject of an editorial in the Annals of Thoracic Surgery, recognizing my pioneering innovations in cardiothoracic trauma.” Dr. Zakharia has been married to wife Andree for 38 years, and they are the proud parents of Yara, Kareem, and Alex.

When Five Sisters opened a little more than two years ago, Elizabeth Zosman was thrilled. She now had a place where she could continue her spiritual practices, one that had everything she wanted. Little did she know that her Pinecrest store would do so well that it would have to expand? “It was a good location,” she says. “We got a lot of traffic with our signs. But because we wanted to do bigger events, it was too small.” Zosman moved into her new space at 8805 SW 132 Street at the end of October and held a grand opening event Nov. 1. “We had 200 people show up,” she says. “We had a party Oct. 30 for 150 people.” At the grand opening, Zosman sold half of the store’s inventory of tarot cards. She also sold a lot of books. “We’re going to stay focused on our yoga books and try to support our local authors,” she says. “I sold out of Sandra Richardson. Her books sold out in three weeks.” Richardson is a psychic and a Wicca priestess. With the move, Five Sisters is moving closer to what Zosman envisioned when she opened the store. Two and a half years ago, she had visited a Paradise Island Yoga Center for a 10-day Spring Fast and then she journeyed to the Kripalu Center for Yoga & Health in Lenox, Massachusetts. The trip helped her return to her spiritual practices that she had abandoned for a time. She searched for spiritual learning centers in Miami that had a full range of services, but didn’t find one; so she decided to open her own place. She named the
store Five Sisters in honor of her five daughters. It didn’t take long for the New Age community to find her and as a result, the store thrived. Now, in its new location, Five Sisters will be able to host more and larger events. The offerings will be diverse, including a monthly Yoga Night for teens. Zosman says a number of local yoga teachers have volunteered to teach the Teen Night classes. “They want to get them (teens) off the street or out of The Falls at night,” she says. “I’m hoping to get the crowd that is most at need, the 11-14 year olds.” However, teens up to age 17 are also welcome to the event. “The kids will get free pizza,” she says. “We have enough teachers. We’re going to be teaching Karma Yoga.” Karma Yoga includes teaching teens to do good deeds without expecting anything in return. Zosman says they will also teach the kids how to meditate. For adults, upcoming events include readings by Bridgette, Psychic Medium Readings with Amy, a drum making workshop and a Reiki Level One class. Zosman says they also have the drumming circle, which is a circle of people drumming for wellness. “The instructor brings his drums and you drum in a guided situation,” she says. “It’s great for stress relief. We have to do it when no one else is open.” The inventory is eclectic and includes candles, clothing, crystals, angel items, drums and inspirational gifts. Danny Berry JCC Baseball joins Little League Linda K. Landy ALPER JCC NEWS More than 22 years ago, I drove up to a summer baseball camp to drop off my very excited five-year-old and his brand new glove. I was greeted by baby-faced Danny Berry with a contagious smile who assured me it was a “grrrrreeeeaaatt day for baseball!” By the end of the week, my son was hooked on baseball and I recognized that I was dealing with a man who understood youth sports. You couldn’t find a nicer guy who so consistently and genuinely cares about kids and fairness. Over the years my extended family followed him to a program way out on Sunset Drive and finally to the Alper JCC in 1994. Today my little boy is a practicing attorney with his own home, but he still heads out to Danny Berry’s every Sunday morning for the men’s softball league. Don’t take my word for the quality of the Danny Berry Baseball program. The fact that children of four Major League players (including one who hit a home run in the 2009 World Series) participate in the program validates the opinion of this mom. Active players include a pitcher for the St. Louis Cardinals, a fielder for the Baltimore Orioles and an All-Star leftfielder for the Philadelphia Phillies. The fourth player is a retired pitcher from the New York Yankees. Coach Berry offers his unique brand of youth baseball through a wide variety of leagues, clinics, camps, school vacation mini-camps and parties. There’s also a men’s softball league, All-Star traveling teams and flag football. The latest news is that his program is
now sanctioned by Little League Baseball. Surely you’ve seen the Little League World Series on ESPN. Established in 1939, Little League Baseball is the most respected sports organization on the planet. The fact that the Little League program stresses the character development, sportsmanship, discipline, teamwork skills and physical well being fits right into the Danny Berry philosophy. The big excitement is that teams will have a chance to advance to post season play, including district, regional and state competition and ultimately the televised World Series. In addition, Little League allows a tremendous reduction in program fees. The impressive Phyllis and Arnold Grossman Ball Park features six lighted ball fields, 10 lighted automated batting cages, five pitching tunnels, a concession stand, air conditioned bathrooms and an All Star Sports Store where players can choose from a large selection of top-ofthe-line equipment. Players can improve their hitting skills in the automated batting cages where The Iron Mike pitching machines simulate a real pitcher. Players can buy tokens for pitches, rent cages by the half hour or hour, or purchase an annual membership. Team coaches can rent fields, batting cages and hitting tunnels where they can pitch to their players. The program provides the ideal setting for boys and girls three to 13 years old to learn the “national pastime” in a “no pressure” fun-filled environment, with volunteer coaches under the direction supervision of Coach Berry. In fact, volunteer coaches and score keepers are needed for season, which begins in January. The emphasis is on player development and team interaction. Parents are discouraged from coaching during a game from the bleachers and asked to reinforce the message that that as long as you try your best, it’s okay to lose. Frequent positive reinforcement helps players build self esteem. At the daily award ceremony, children are recognized for “hustle” and improvement, as well as home runs and great plays. “I encourage parents to look toward the purpose of participating in a social and team sport,” says Berry, one of South Florida’s most popular youth coaches. “It is certainly not winning or losing, or whether a child gets to play his favorite position. It’s about a child developing as a social and competent being. It’s about a child improving and being encouraged in this great game. Most children will never play this or any game professionally; however, a positive experience in Little League sports has been proven to nurture success in life.” Instructional leagues are offered year round for boys and girls five to 13.
Emphasis is on fun and instruction, with authentic Big League uniforms. Players learn and play different positions. An introduction to baseball clinic for boys and girls 3 and 4-years-old is designed to introduce the fundamentals of baseball, with strong consideration for the physical and emotional needs of young children. For the more competitive player, Coach Berry maintains traveling teams for boys age seven to 12, which play against other local leagues but also adhere to his rules of fairness and pressure. Games are played at Danny Berry’s JCC facility. Tryouts for the travel teams will be held on Wednesday, Jan. 6, at 4 p.m. Area coaches are invited to enter a team in this fun, competitive league. There are also tournaments throughout the year. One of Coach Berry’s most popular programs is his winter vacation, summer and spring break camps. The half- or fullday sessions include exciting pennant races, as well as solid instruction in catching, pitching, fielding fundamentals, base running, batting, strike zone recognition and the ever-popular awards ceremonies (I couldn’t begin to count the number I have sat through). Full day campers will receive lunch and snack, field trips, swimming, flag football, stickball, kickball, indoor basketball and water relays. Summer camp is available in a series of one- or two-week summer camp sessions with free pre-camp supervision available as early as 7:30 a.m. Full-day campers can stay until 6 p.m. at no additional charge. Flag (no contact) football is also offered for children age five to 13 on Saturday afternoons beginning Jan. 16. The program is true to Coach Berry’s philosophy of providing a non-pressured, fun-filled environment stressing the importance of sportsmanship, physical fitness, goal setting/achievement and,
most importantly, teamwork. Flag football focuses on athletic skills development — speed, coordination, quickness, technique, power and agility. Every child will have an equal opportunity to play in each game. The program director is Sean Chase, a sports coach and personal trainer with a great way with kids and many years of coaching and playing flag football. You haven’t lived until you’ve attended a Danny Berry baseball or flag football birthday party. My photo albums are full of pictures of Danny Berry baseball parties for my sons and nephews. I can report with all honesty that the kids had a really great time, but the adults had an even better time. Each special day includes an exciting one hour instructional game led by two coaches and concludes with, that’s right, an awards ceremony (seeing a trend here?). The guest of honor receives a trophy, tee-shirt and coach’s hat. Each guest receives a pack of baseball cards. An allyou-can-eat lunch of hot dogs, hamburgers or chicken nuggets; chips and soda are also available. Hey, moms, one-stop shopping. Even the invitations are included (no, they don’t address them for you). The baseball fields heat up on Sunday mornings, when the men age 16 to 76 come out for a friendly, but competitive softball league from 8 a.m. to noon. You don’t have to be a superstar to play in the league; its all about having fun. Bring in a whole team or let Coach Berry find you a team looking for another player. If you want your child to learn the fundamentals of baseball in an environment that teaches the joy of the sport and promotes positive self esteem, then Danny Berry’s JCC baseball is a “grrrrreeeeaaatt” program for you. Original Lots of Lox is a family-run business BY RON BEASLEY Nick Poulos, his brother Steve and cousin Jimmy are third-generation Miami-Dade restaurateurs. Between them, they have owned or operated some of the county’s most storied snack shops and coffee shops. Their latest acquisition came two years ago when they bought The Original Lots of Lox, at 14955 S. Dixie Hwy., a popular New York-style delicatessen that recently celebrated its 30th anniversary and received a proclamation from the Palmetto Bay Village Council “recognizing the importance of this neighborhood restaurant and meeting place.” “I give all the credit for the purchase to my brother and my cousin,” says Poulos. “They live in the area off Old Cutler and they’ve been customers here for about 15 years. They got real close with the previous owner and about three years ago he started saying he was going to sell the place.” After a year of discussion, the Pouloses cut a deal and bought the business. They retained most of the staff and Poulos maintains that is a big reason for the continued success. “We have a great wait staff,” he says. “We have three girls who have been here over 20 years apiece and one girl has been here 25 years; and our chefs, a couple of them have
also been here for over 20 years. Our wait staff is tremendous, the food is excellent and we have great customers, so it’s a winning combination.” The Pouloses are all Miami natives and one wall in Lots of Lox holds a collection of photographs and memorabilia in tribute to their grandfather, James Poulos, who started out in the 1930s with a fruit stand on Flagler Street in downtown Miami. “He was an immigrant who came over here penniless to find the American Dream and turned pennies into serious money,” said Poulos. “He started out vending peanuts, selling them for a nickel a bag. Then he started a fruit stand on Flagler Street and built that into the Paramount Soda Shop right next door to the Paramount Theater. My father worked there, then went off to World War II and came back. After that it was pretty much the three brothers — my father and my uncles – that ran the business. So we grew up in the restaurant business, we’re third generation.” In the 1960s, Poulos’ father operated such popular spots as the Urmey Coffee Shop in the Urmey Hotel, the National Coffee Shop, Johnny’s Restaurant on Northeast Second Avenue and the Miracle Mile Coffee Shop in Coral Gables. “We also had snack shops in six locations

in Allen Morris properties,” he says. “We were with Allen Morris for about 35 years. We took the names of the buildings, so if it was the 1000 Building, we called it the 1000 Snack Shop. We also had the 330 Snack Shop on Third Street and Biscayne and the 909 Brickell Plaza and the Brickell Deli at 1101 Brickell Avenue. My cousin Jimmy had the 1444 Coffee Shop on 14th and Biscayne.” Today the Original Lots of Lox is the family enterprise. It’s open for breakfast, lunch and dinner. “You can eat breakfast at any time here seven days a week,” Poulos says. “No matter what time it is, you can order eggs, even Eggs Benedict. We are known for our corned beef and pastrami sandwiches. All of
our soups are homemade; our matzo balls and latkes are all made fresh, all prepared on the premises. Our soups are to die for and our chicken salad is excellent. And we’re also known for our tuna salad. “We’re a New York-style deli, but we’re also like a diner where everybody knows everybody. We have some people who eat here twice a day. LET’S TALK CARS The Honda Pilot received a complete makeover last year, so little has been changed for 2010. The eight-passenger Pilot is a nice looking SUV and has been popular with American consumers since its introduction in 2003. It’s a solid performer, handles well around town or on the highway and has good cargo-hauling capability. The Pilot is available in four models — LX, EX, EX-L and Touring — each offered in either a two-wheel-drive or four-wheeldrive configuration. The Pilot comes with a lengthy list of standard features, including a front and rear air conditioning system with air-filtration, keyless entry, tilt and telescope steering column, cruise control, power windows with auto-up/down driver’s and passenger’s window, power door and tailgate locks, AM/FM/CD stereo system with seven-speakers including subwoofer and Radio Data System (RDS), trip

The Recycled Closet — Mother and daughter team working with 70% off designer labels BY ROBIN KORTH For mother and daughter Jennifer and Jenna Kaloti, The Recycled Closet is a delightful success story. Their Palmetto Bay boutique featuring “recycled” designer brands for teens and young adults just celebrated its one-year anniversary and they are thriving. That’s because they provide the answer to two basic problems: Problem No. 1: Teen-agers love new clothes, all the time. Problem No. 2: Teen-agers can’t afford all the new clothes they want. At The Recycled Closet teens recycle their “gently used” brand name clothing for 40% of sale price. This creates the boutique’s stock of almost-new designer treasures such as Abercrombie and Fitch, Forever 21, Juicy Couture, and Lucky Brand. Shopping for that cool new top or just-right pair of jeans is a fun adventure rather than a pocketbook challenge. And, for almost always cash-poor teens there is often significant income with the forty-percent of consignment sale price arrangement that is standard. Jennifer Kaloti, is a Pinecrest native and daughter of the Vosters family who were Pinecrest pioneers in the wholesale nursery business. As a busy mother of two
Women Mean Business design-conscious daughters, Jennifer often found herself buying brands like Marc Jacobs and Seven Jeans for her fastgrowing girls. When the clothes were outgrown there was nothing to do but pass them on to the housekeeper or to Goodwill. “When the girls were younger I often went to consignment shops to find bargains and to recycle their quality clothing. But as they grew, there just wasn’t a place to take their teen-age size clothes. I then started to think about opening a business like this,” says Jennifer. In 2005 Jennifer’s life changed and she began looking to start a business. That’s when the old conundrum of designer clothing for teens and the strain on ones budget re-entered her mind. She began to do her research. “I discovered that consignment shops for teens have been expe-
riencing a lot of success in other parts of the country such as New York and L.A. ‘Thrift’ shopping was the new cool activity for teens. I looked into my options and spoke with friends and professional acquaintances. There definitively was a place for a boutique like The Recycled Closet in the Pinecrest area,” says Jennifer. With the idea firmly in place, Jennifer approached daughter Jenna, and offered her a fifty-fifty partnership in the new endeavor. Jennifer was the idea gal behind The Recycled Closet and Jenna was the hands-on, let’s make this happen, energy girl. Jenna had the retail clothing store management experience and the innate grasp of what it would take to get The Recycled Closet off the drawing board and into the shopping center. Jenna came up with the name of the store which is a good one for the importance of “reduce, reuse, and recycle”. When the lease was signed, Jennifer hired Steve Allen of Copperwood, Inc., to build out the store. Jenna is the “nuts and bolts” daily operation manger of the boutique. “I basically keep the place running on a day-to-day basis,” says Jenna. “I don’t think my Mom
nor I realized the amount of work involved when we started. But it is so worth it to have our own business and be able to watch it grow,” she continues. The Recycled Closet is all about the customer. “We have regulars that stop by frequently so they can check to see what new items have come in. I even have a ‘wish list’ for clients to tell me what they are looking for,” says Jennifer. “As we are taking consignment merchandise in for a customer they often find two or three items in the shop that they want to buy for themselves. This happens all the time,” states Jenna. Jennifer and Jenna suggest that you visit The Recycled Closet on a regular basis because the inventory changes from day to day as the result of brisk traffic. Therapy for Swimmer’s Ear BY SONIA MARTINEZ, RPH
Frequently, therapy for swimmer’s ear (otitis externa) involves the use of a prescription ear drop that relieves pain and is now available in a non-brand version known as "antipyrine and benzocaine". However, in some patients, the topical analgesic benzocaine can cause irritation and worsen or prolong inflammation, so in those cases, oral pain relievers may be preferred. For severe ear pain and itching, ear preparations containing an antibiotic and a cortisone-like steroid can be used to fight infection and reduce inflammation. Suspensions may be less acidic and therefore less irritating than solutions that contain the same medications. Special care must be taken if there is a chance that the eardrum is perforated, because some medications can be ototoxic (affect hearing) if they enter the inner ear. According to the Pharmacists’ Letter, if a patient complains about a bad taste after using their ear drops, it is a sign that the eardrum is perforated, and the doctor should be notified. Antibiotic eye drops (ophthalmics) are

Experience the difference at FLEMING’S RESTAURANT - STILL TRADITIONAL WITH NEW UPDATED STYLE By Julianne Power – Independent Restaurant Critic If you have not been to Fleming’s lately its time to come in and see the classy, warm ambiance that reflects the new and also keeping to their traditional quality service and one-of-a-kind dining experience. After experiencing a facelift from Chef Gordon Ramsay (Hell’s Kitchen, Kitchen Nightmares), one thing is hard to change and that is the exceptional food that Fleming’s is noted for. Subsequent to a brief change in menu, upon ordering any entrée they have brought back the crudités (fresh veggie plate with outstanding dipping sauce), soup de jour and traditional Caesar salad that comes with all meals. They have also brought back their famed dessert display with a wonderful selection of such traditional tasty treats as the apple walnut pie, marzipan, napoleon and more for us to indulge. Chef Orlando Casanova has also added his offerings to the variety of dinners with scrumptious tastes and presentation and daily specials. Fleming has a complete and well priced wine list to compliment any occasion or meal. There is also a full liquor bar where there friendly bartender can make anything from a classic cocktail to one of their specialty drinks. I visited Fleming’s for dinner with a friend recently so I could personally see what changes and non-changes had been made. As we entered the establishment we were greeted by Owners Andy Hall and wife Suzanne Thomas-Hall, who obviously after owning the establishment for the last 8 years, have created a restaurant to reflect their vision without compromising the integrity of Fleming’s tradition. You are sure to meet one or both of them during any of your visits to their restaurant, as they are its heart and soul. Noticing the rich browns and “Bird’s in Flight” theme as the new décor, we were instantly relaxed. As we sat at our table, a menu, wine list and a sheet with their weekly specials was presented. We picked the right night! On Wednesday’s the special was half priced bottles of wine (ALL WINES!). As water was poured and a crudités was given, our server immediately came to our table and asked what we would like to drink. I am not one to necessarily match my wine to my meal since I am a Merlot type of gal, I spotted a Bogle Merlot and ordered the bottle (for half price!). While our server pre-
sented and poured the Merlot, we reviewed the menu. They also have small plate specials on Wednesday’s which is an extension of their existing list of appetizers. We ordered a Steak Blue and a Blackened Mahi. We enjoyed our wine while waiting for the appetizers which came in a short time and looked delicious. The Steak Blue was steak medallions served in a marvelous blue cheese sauce and the Blackened Mahi presentation was great and served with a dipping sauce. Next we ordered our entrees. I ordered the Lamb Chop’s medium and substituted a Wedge salad for an additional $3.00 forgoing the Caesar. My friend ordered their Roasted Duck. After taking our orders we were given a bread basket and a cup of the soup de jour, which on this day was corn chowder. The soup was hot and mouth-watering filled with diced potato and corn. As our server cleared the empty soup bowls we were then presented with a traditional Caesar salad and my Wedge salad. The salads were served fresh and very tasty. Now we were in anticipation for the main courses. My Lamb Chop was cooked to perfection served with a mint chimichurri, sundried tomatoes atop couscous. My friend received her duck and was taken aback by how big the portion was. The half of duck was served with apples, prunes roasted potato and a traditional red cabbage that tasted perfect. By this time we were certainly filled and satisfied. But wait! Now it was time for coffee and dessert! We were directed to Fleming’s Dessert display to see if we could fit another bite. They had a selection of approximately eight desserts that I was told changes daily. Hmmmmm, there it was, a chocolate cake lover’s dream……Chocolate Mousse Cake. My friend and I decided to make room and share this dessert with coffee. YUMMY! As we finished our dining experience, we were presented with a check and could not believe the amount of food and drink we received for the price. Fleming’s has been a best-kept secret in the neighborhood of Pinecrest for 25 years offering its patrons “the best bang for your buck” while keeping a “fine-dining” experience. Fleming’s is located on the East side of US-1 in a quaint, quiet strip of businesses behind the Home Depot and Office Max on SW 136th street.

The results of “Hat Racking” or improper pruning Star vation— “Hat Racking” removes more than 50% of the Right Tree – Right Place tree’s crown, plants can starve quickly, especially if trees are poor quality at pruning time. The preferred practice, called “crown reduction,” removes less than 1/4 of the crown, boosting the tree’s ability manufacture food. This can be seen in palms as well, where over-pruning can and will lead to the starvation death of many palm species. Insects and Diseases—an improperly pruned tree will result in large branch stubs that are more susceptible to insect damage and fungi. Weak Branches—weak branches can grow after a larger one is removed. Often, a tree will produce many thin and weakly-attached branchlets called water shoots which don’t add to the structure of a tree. Tree Death—some species of trees will not tolerate improper pruning and die after being topped or hat racked. An arborist can lend accurate counsel at the outset of a job. Ugliness—an improperly pruned tree is a disfigured tree. Even with its re-growth, it never regains the grace and character of its species. The landscape and the community are robbed of a valuable asset. “Lower Cost”—hat racking a tree is

much faster and easier than employing the skill and judgment needed for good pruning. Improperly pruning a tree may cost less in the short run; the true costs are hidden. These include reduced property value, the expense of equivalent replacement, increased future maintenance, and the risk of liability from weakened branches. Liability—the weakened wood from an improperly pruned tree is much more susceptible to breakage. This may result in legal liability. Further, poorly pruned trees are more likely to fail in storms, sometimes catastrophically. Beware of Door Knockers—most reputable companies have all the work they can handle without going door to door. Make sure they are certified arborists. Affordable Senior Living: Options to Pay for a Great Lifestyle BY HELEN SHAHAM Q. Planning to move to a senior living community, I put my home on the market more than a year ago. With the current market, I haven’t been able to sell it. I’d like to move sooner rather than later. Are there any new, maybe nontraditional options for funding senior living? A. Seniors who prefer the peace of mind, care-free lifestyle and enhanced opportunities for socialization afforded by senior living communities, are finding new solutions for addressing the lack of traditional funding. According to Richard Rash, a Certified Reverse Mortgage Specialist with Transcontinental Lending Group, Inc., seniors 62 years of age and older typically did not have the best options when it came to getting cash from their homes. But today, there are alternatives available: Reverse Mortgages A reverse mortgage enables you to convert part of the equity in your home into tax-free income without giving up title or take on new monthly mortgage payment. Instead of making monthly payments to a lender, as with a regular mortgage, a lender makes payments to you. “Traditional home loans only offered the option of either selling the house or borrowing against its equity,” explained Rash. “With reverse mortgages coming on the scene, seniors now have some additional cashflow alternatives. This type of loan allows mature borrowers to convert their home equity into taxfree income.” The amount of funds you’re eligible to receive depends on several factors including: your age; home’s appraised value; interest rates; and the lending limit in your area. Typically, the older you and the more valuable your home, the more money you’ll receive from the lender. With a reverse mortgage, you can choose how you want to receive the money: all at once as a lump sum; fixed month payments for a set term; or as a line of credit which allows you to draw proceeds at any time. The reverse mortgage loan is repaid when your home is sold. If your home
sells for more than what is owed on the reverse mortgage, then the excess money goes to you or your estate. Life Settlements If you have a life insurance policy, life settlements are another technique for you to pay for a senior living community. This involves the sale, assignment, transfer or bequest of a life insurance policy by a policy owner to a third-party investor. Rash says the policy owner typically receives cash (generally an amount greater than the cash surrender value in the policy but less than the full amount of the death benefit) and the new owner becomes responsible for the payment of all future premiums. Asset Backed Lending With asset backed lending, you can tap into the potential power of your stock and bond portfolios without having to end their participation in possible future growth. You can leverage your securities and, depending on the quality and stability of the collateral securities, could borrow as much as 85 percent of their portfolios as cash. These are just a few of the financial options available to seniors. I recommend you seek the advice of your accountant or tax advisor for information specific to your case as you begin weighing your options. VA Benefits The U.S. Department of Veterans Affairs’ Pension with Aid & Attendance Program offers assistance to veterans and/or their surviving spouses. In order to qualify, applicants must prove that the majority of their income is spent on medical expenses such as co-pays, insurance deductibles, prescriptions, caregivers or assisted living community expenses, etc. The VA reimburses the veteran up to $1,644 per month and the surviving spouse up to $1,056 per month. A Veteran Service Center can provide specific information on how to qualify for VA benefits. They can be reached by calling 305-270-2940. Medicaid Diversion Program The Long-Term Care Community Diversion Program may also help cover the costs of senior living, more specifically assisted living communities. The Medicaid Waiver program is designed to provide community-based services to people who would otherwise qualify for
Medicaid Nursing Home placement and they generally pay up to $1,100 per month towards the cost of the Assisted Living Community. Seniors must meet several qualifications in order to be eligible. For more information, contact the Department of Elder Affairs at 305-6717200.

Security Agreement Senior living communities may offer special incentives or programs to assist with expenses. For example, The Palace’s new “Security Agreement” allows you to move to the community paying only a discounted monthly rate (whatever you can afford without selling the home) while you await the pending sale of your home. Once your home is sold, The Palace is reimbursed the accrued rental difference with minimal interest fee. If you continue to have difficulty selling your home, you may consider proceeding with your move to retirement community and having a relative or friend rent the existing home to help offset costs. Please remember each option has pros and cons which should be reviewed thoroughly before finalizing plans. With the right plan in place, you’ll begin enjoying a

LOST DOG TARZAN.... Pure breed German Shepherd. About 3 yrs old. Tarzan came to us a year ago & was very mistreated. He was kept in a crate too small for him and had a lot of ticks and fleas. He is a really good dog that needs someone to care for him. He was adopted to a couple w/another dog and 2 small girls. They all got along fine especially with the children. He just knows how to be a good dog. He eats well but the stress is not allowing him to gain weight. The husband is in the Army and is being shipped to Iraq and they can’t keep him. He has a skin problem that we are trying to solve. He has lost a lot of hair. It is not contagious at all.. He gets along with all other dogs real good and with young children. Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose. Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments.
