Community Center Thanksgiving food drive unites city to help needy families Rackear read

he annual food drive handled through the city’s Community Center brought area organizations together to help less fortunate families in the City of Pleasant Living. Cesar Garcia of the City of South Miami Parks and Recreation Department is pleased that so many volunteers pitched in and helped with the special project they do each year at this time. “As many of you know, we have an annual Thanksgiving basket give-a-way in which we give the needy families in our community a much needed thanksgiving basket which usually includes a box of various canned goods and a turkey or a giftcertificate to purchase one,” says Garcia. “Yearly we feed about 100 to 125 families that are identified as families in need of a little help within our City. This year we have a lot of momentum and help in making this event completely possible.” Gathering at the center on Wednesday November 18, Girl Scouts from South Miami Daisy’s Troop 204 and other volunteers worked to decorate boxes and get

The biggest shopping day of the year is the day after Thanksgiving. The Red Sunset Merchants Association has joined forces with the City of South Miami to offer customers two hours of free parking on November 27, the Friday after Thanksgiving. If you need more than two hours, park in the municipal garage for a $2 flat fee if you arrive before 4 p.m. The Municipal garage is on SW 74 St where Ra Sushi is located. “It’s a great opportunity to make it easier for our customers to come shopping” said Ed Boas of Lanes. The City of SM and the members of the RSMA want to express gratitude at Thanksgiving time to their loyal customers. The Green House is a great new concept that opened last week. The tiny bright green shop at 7388 SW 56 Ave., is behind Ace Hardware and the Chevron station, around the corner from John the Tailor. The owner, Marilu, has created an adorable gardening center that is just right in every way. You will find herb plants, seeds, and all the gardening supplies you need for growing vegetables and herbs in your garden or in your kitchen window. S. Peter Capua: profile of a passionate musician

Music has always been a part of S. Peter Capua’s life and he loves to share his passion with friends. Capua, who has lived in his South Miami home for more than 50 years and has been an attorney in Miami for 44 years, recently shared his musical talents on the clarinet at a private recital held at Gil Capa’s Bistro on SW 113 Place, near Miami Dade Community College. Capua plays classical music and is often accompanied by Tatjana Surev on the piano. Their music tells a story that is as interesting to listen to as the story of their own lives. Capua and Surev met over 18 years ago and since then have been delighting audiences at their recitals and impromptu rehearsals. Surev is the music teacher at St. Agnes Academy on Key Biscayne, has a Doctorate in Music from the University of Miami and was a child prodigy in Yugoslavia, according to Capua. “It’s always a blessing to play with her,” he said. Capua graduated from the University of Miami, received his masters in music from the Manhattan School of Music and obtained his law degree from the South Texas College of Law. During his career, he’s been a school teacher, lawyer, circuit court judge and,

always, a musician. He’s done everything from play the clubs on Miami Beach to perform at weddings in Cartagena. Capua played in the past with such big names as the Benny Goodman Trio, Freddy Martin, Tex Beneke, Al Donahue and the New York City Symphony Orchestra. For a time he even had his own group called the Cappy Peters Trio, turning his own name around to jazz it up a little, doing perform-
ances and appearing on the old Arthur Godfrey Show. Capua even played a large colonial style drum at the inauguration of President Bill Clinton, and has won a number of national awards in music. At their recent recital at Gil Capa’s, the duo started with Mozart and Rossini and ended on a lighter note, taking requests such as Volare and True Love from the enthralled audience. “It’s interesting and I like it,” said Capua
when asked how he chose what to play during the evening recital. Gil Capa, owner of Gil Capa’s Bistro, is always pleased to have them perform. “I’m enchanted when they ask if they can rehearse here,” said Capa. “We are all so lucky to enjoy their company and their music.” Capua and Capa have been good friends since 1970. Capa and his wife, Carmen, have owned and operated Gil Capa’s Bistro in its current location for 16 years and the previous location in Miami Beach for 18 years. The motto on the wall says, “slow Italian cuisine.” Translation: all homemade dishes that are painstakingly prepared by Capa. “We feature about 20 different old-fashioned Italian specialties,” said Capa. “I make each and every order to ensure the quality meets my standards.” Gil Capa’s is located at 10712 SW 113 Place and the phone number is 305-2731102. Is Sarah’s home less important than water on the moon? R. Kenneth Bluh KENNETH’S COMMENTARY “Sarah” lives in Liberty City. She and her late husband bought their home in 1971. Sarah and her husband refinanced their home six years ago to raise money to help their youngest daughter purchase a home with her husband and three young children. The home in Miami Gardens is perfect and “Rachael” and her family are happy. Unfortunately, Grandma Sarah is not happy. First, she lost her husband “Samuel” several years ago. When she lost her husband she also lost the benefit of their combined Social Security incomes. Now, trying to make mortgage payments, pay the utilities and groceries on $987 a month is impossible. Her mortgage is in default and the loss of her home is imminent. Sarah is fortunate in the fact that when she loses her home she can live with her kids and grandchildren in
Miami Gardens. But it will not be the same. She will be uprooted from her home of more than 39 years and will be forced to share a bedroom with two of her grandchildren. Not the way a decent, law-abiding citizen should be forced to live out her senior years. Sarah’s friend from church suggested that she look into a reverse mortgage to pay off her defaulted mortgage. If successful, she could stay in her home and skip making mortgage payments — great idea. Unfortunately, FHA changed its rules the other day reducing the benefits under the program. Under the old program Sarah could have saved her home if she had made application for the mortgage last summer. Now, under the new rules, Sarah would have to bring money to the closing to pay off her old mortgage. It’s money that neither Sarah nor her family has. Sarah is losing her home because Congress would not appropriate $900 million to keep the program running under the old formula — a program that has saved the homes of thousands of senior citizens.
––– VIEWPOINT ––– Sarah asked her friend why Congress can spend billions of dollars trying to learn if there is water on the moon when taxpaying citizens who have worked their entire lives are losing their homes because Congress says they don’t have the money. Good question, Sarah. Evidently, water on the moon is more important than you and thousands of other seniors who will lose their homes because of a money shortage at FHA. Sarah is right. It just doesn’t make sense. In addition to Sarah’s problem there are dozens of other government programs that are being shut down or curtailed because of the lack of money to keep them going. It is okay for Sarah to lose her home. Who will really know about Sarah’s loss? It certainly will not make the headlines in tomorrow’s newspaper. But Sarah is a real human being. Her problem is real
and her government has let her down. The money allocated to moon exploration could be put to better use solving the problems of the Sarahs of America. I wonder if Congress realizes that there are millions of Sarahs with foreclosure problems and medical needs who will remember that their government forgot them when they go to the polls to vote. ‘In the Company of Women’ seeking nominees for 2010 BY EDITH TORRES Miami-Dade County is seeking outstanding women nominees for the 22nd annual “In the Company of Women” Awards Ceremony which will take place in March 2010. The deadline for nominations is 5 p.m. on Friday, Dec. 18. This year there are two new categories — the Community Spirit Award and the Posthumous Award. The Community Spirit Award recognizes an outstanding woman who, through volunteerism and service, has made a difference within the community. No specific professional background is required for this nomination. The Posthumous Award is in honor of a woman who has passed away, and recognizes her accomplishments within Miami-Dade County. The award spotlights the accomplishments of outstanding professional female leaders in the community in the following categories: • Outstanding Woman in Arts and Entertainment; • Outstanding Woman in Business and Economics; • Outstanding Woman in Communications and Literature; • Outstanding Woman in Education and Research-Outstanding; • Outstanding Woman in Government and Law; • Outstanding Woman in Health and Human Services; • Outstanding Woman in Science and Technology; • Outstanding Woman in Sports & Athletics; • Community Spirit Award; • Posthumous Award, and • Mayor’s Pioneer Award. Experience the difference at FLEMING’S RESTAURANT - STILL TRADITIONAL WITH NEW UPDATED STYLE By Julianne Power – Independent Restaurant Critic If you have not been to Fleming’s lately its time to come in and see the classy, warm ambiance that reflects the new and also keeping to their traditional quality service and one-of-a-kind dining experience. After experiencing a facelift from Chef Gordon Ramsay (Hell’s Kitchen, Kitchen Nightmares), one thing is hard to change and that is the exceptional food that Fleming’s is noted for. Subsequent to a brief change in menu, upon ordering any entrée they have brought back the crudités (fresh veggie plate with outstanding dipping sauce), soup de jour and traditional Caesar salad that comes with all meals. They have also brought back their famed dessert display with a wonderful selection of such traditional tasty treats as the apple walnut pie, marzipan, napoleon and more for us to indulge. Chef Orlando Casanova has also added his offerings to the variety of dinners with scrumptious tastes and presentation and daily specials. Fleming has a complete and well priced wine list to compliment any occasion or meal. There is also a full liquor bar where there friendly bartender can make anything from a classic cocktail to one of their specialty drinks. I visited Fleming’s for dinner with a friend recently so I could personally see what changes and non-changes had been made. As we entered the establishment we were greeted by Owners Andy Hall and wife Suzanne Thomas-Hall, who obviously after owning the establishment for the last 8 years, have created a restaurant to reflect their vision without compromising the integrity of Fleming’s tradition. You are sure to meet one or both of them during any of your visits to their restaurant, as they are its heart and soul. Noticing the rich browns and “Bird’s in Flight” theme as the new décor, we were instantly relaxed. As we sat at our table, a menu, wine list and a sheet with their weekly specials was presented. We picked the right night! On Wednesday’s the special was half priced bottles of wine (ALL WINES!). As water was poured and a crudités was given, our server immediately came to our table and asked what we would like to drink. I am not one to necessarily match my wine to my meal since I am a Merlot type of gal, I spotted a Bogle Merlot and ordered the bottle (for half price!). While our server pre-
sented and poured the Merlot, we reviewed the menu. They also have small plate specials on Wednesday’s which is an extension of their existing list of appetizers. We ordered a Steak Blue and a Blackened Mahi. We enjoyed our wine while waiting for the appetizers which came in a short time and looked delicious. The Steak Blue was steak medallions served in a marvelous blue cheese sauce and the Blackened Mahi presentation was great and served with a dipping sauce. Next we ordered our entrees. I ordered the Lamb Chop’s medium and substituted a Wedge salad for an additional $3.00 forgoing the Caesar. My friend ordered their Roasted Duck. After taking our orders we were given a bread basket and a cup of the soup de jour, which on this day was corn chowder. The soup was hot and mouth-watering filled with diced potato and corn. As our server cleared the empty soup bowls we were then presented with a traditional Caesar salad and my Wedge salad. The salads were served fresh and very tasty. Now we were in anticipation for the main courses. My Lamb Chop was cooked to perfection served with a mint chimichurri, sundried tomatoes atop couscous. My friend received her duck and was taken aback by how big the portion was. The half of duck was served with apples, prunes roasted potato and a traditional red cabbage that tasted perfect. By this time we were certainly filled and satisfied. But wait! Now it was time for coffee and dessert! We were directed to Fleming’s Dessert display to see if we could fit another bite. They had a selection of approximately eight desserts that I was told changes daily. Hmmmmm, there it was, a chocolate cake lover’s dream……Chocolate Mousse Cake. My friend and I decided to make room and share this dessert with coffee. YUMMY! As we finished our dining experience, we were presented with a check and could not believe the amount of food and drink we received for the price. JOBC crowns members of festival’s Royal Court BY FERNANDA MEDICI Three young ladies have been chosen to be the queen and princesses of the 2009-10 Junior Orange Bowl Festival, and together they are known as the Royal Court. Marilyn Rodriguez, 14, is the queen; Madison Nasser, 13, and Kamelah Jones, 13, are princesses. The Royal Court will represent the Junior Orange Bowl Committee (JOBC) as ambassadors of goodwill and their first task was going to the Miami Veterans Hospital on Veterans Day (Nov. 11). “This 59-year-old tradition is much more than a beauty pageant,” said Enid Miguez, chair of the JOBC Royal Court. The girls were selected based on personality, academics, community service, and poise. Queen Marilyn, from South Dade High School, is a member of her church’s youth group where they obtain donations of books and money for the kids with the Children’s Miracle Network. In addition, she is a member of her school’s Key Club where they write letters to veterans, and a member of UNICEF where she obtains donations of food, clothing and money for children in Africa. “As you can see from her involvement in the community, Marilyn is the perfect candidate for this award and I am very proud of her level of commitment to the community,” Miguez said. The event took place at the Miami Elks Lodge No. 948, and more than 20 girls participated. Queen Marilyn also was the winner of the “Give-a-Hand” essay, where the girls had to write an essay about community service commitment. Princess Madison is a student of Devon Aire K-8 Center, and she is in the National Junior Honor Society. Princess Kamelah, is a student at Herbert

The JOBC hopes to encourage the girls to be tomorrow’s leaders in the community and open the doors to a brighter future. Miami Fencing Club stages eighth annual tournament BY ASRA JAWAID The Miami Fencing Club’s eighth annual tournament took place on Saturday and Sunday, Oct. 24 and 25, at South Miami Middle School, 6750 SW 60 St. Michael Elder, general manager of the club, said that 127 people participated. This was a drop from last year’s 160 or 170 attendees by Elder’s estimation, one he attributed to the fact that this year SAT testing took place on the same weekend. Eduardo Andrade, 19, a student at Barry University, found out about the event online. Having fenced for just six months, he said this was his first time at this tournament. “My coach said this was a pretty good tournament to start off, so I came,” he said. Brooke Yates, a 12-year-old South Miami Middle School student attended only as a spectator “just to get the feel of it.” She is a student in the semiweekly Miami Fencing Club class, which takes place at the school on Tuesday and Thursday evenings from 6:30 to 9:30 p.m. Three types of fencing were practiced during the tournament — foil, epee and sabre. The main difference, Elder explained, is that in foil and epee, which are named after types of swords, the fencer attacks with thrust whereas in sabre-style, one attacks with a slashing action. Foil and epee-style fencing were scheduled on Saturday and sabre-style took place on Sunday. On Saturday, the pool bouts for foil and epee fencing took place from 8:45 until 10:15 a.m. Specifically, after registration, which cost $30 per entrant, participants were assigned randomly to pools of six people. Each of the six people fenced the other five
and was ranked based on an indicator, a number calculated by subtracting the number of hits the person received from the number of hits he gave his opponents. “The purpose of the pool bouts is to see how everyone else is playing and to segregate who’s good and who’s not so good,” said Darwin Cantero, a member of the University of Florida Fencing Club. At other tournaments, not everyone gets past the pool round. This event was an exception. Beginning at 10:15 a.m., the elimination rounds began. Registered participants fought in one of the following events: open mixed foil, open women’s foil, open mixed epee, open junior mixed epee, open mixed foil, open Y14 mixed epee, open Y14 mixed foil and open Y14 mixed foil. Elder estimates that each event had between 20 and 30 participants. “The events are by age,” Elder said. “As long as one is in the age group, there is not a limit on how many events a fencer may participate in.” Awards ceremonies took place on Saturday night and Sunday evening after the competitions had concluded. Winners were given a ribbon commemorating their achievement. Interfaith Thanksgiving Eve Service scheduled Nov. 25 BY MARK HART Although religious beliefs may differ, members of various faith groups in Coral Gables will come together in a spirit of unity during the annual Community Interfaith Thanksgiving Eve Service at 7 p.m. on Wednesday, Nov. 25. The service will be hosted by Coral Gables Congregational Church United Church of Christ, located at 3010 De Soto Blvd. in Coral Gables. The theme of this year’s service is “Many Voices, One Earth.” Readings, prayers, and music from the different faith traditions will be presented. A highlight of the service is the evening’s message with Patricia Siemen, OP, JD. A Dominican Sister and civil rights attorney, Siemen currently serves as the director of the Center for Earth Jurisprudence, a collaborative initiative cosponsored by Barry and St. Thomas universities. For the seventh year in a row, Dolphin Mall’s Magical Snowfall will take place in the Ramblas Plaza. In addition to the daily 7 p.m. snowfall, snow will fill the air at 9 p.m. every Friday, Saturday and Sunday until Jan. 3, 2010. There will be no snow on Thanksgiving Day (Nov. 26), Christmas Eve (Dec. 24), Christmas Day (Dec. 25) or New Year’s Eve (Dec. 31). Miami-Dade residents now have a new place to treat their tastebuds. Commissioner Katy Sorenson joined officials from the Miami-Dade Park and Recreation Department to host the grand opening of the Mango Café at Fruit and Spice Park on Friday, Nov. 13. Operated in the oldest house in the Redland, the Bauer-Mitchell-Neill House, the Mango Café is open for lunch and late afternoon dining. Guests can enjoy a menu selection including seasonal and locally grown produce found in the Redland community and Fruit and Spice Park itself, all in the midst of the park’s beautiful lush landscaping. Dishes are prepared by local Chef Brian Cullen. Also in attendance at the grand opening were Parks director Jack Kardys; Rosemary Elliker, daughter of Mary and Herman Heinlein, founders of the Fruit and Spice Park and board member of the South Dade Garden Club; Brian Cullen, public facilities manager for Fruit and Spice Park and Mango Café manager; Fran Mitchell, who donated Bauer-Mitchell-Neill House where the Mango Café is located; Chris Rollins, park manager; Bill Irvine, assistant director of attractions, and Miguel Cisneros-Abreu, president of Redland
Evening Herb Society. “One of the best things about living in Miami-Dade is our access to fresh fruits, vegetables, and herbs grown by our own agricultural community,” Commissioner Sorenson said. “We have some of the best and most exotic produce there is, and I’m happy to see it being promoted and utilized here at the Mango Café.” Popular menu items include a Fresh Tropical Fruit Mélange Salad, which serves a bountiful array of succulent exotic fresh fruits with cottage cheese and banana bread, and a wide variety of Fruit and Spice smoothies and shakes. Patrons also can find café specialties such as Florida Lobster Roll, Shrimp Tacos, an assortment of salads, sandwiches, entrees, and dessert items like Mango Passion Cheesecake and fresh homemade Key Lime Pie. The Mango Café is open seven days a week, except Christmas Day, from 11:30 a.m. to 4:30 p.m. Special events can be accommodated by coordinating with the restaurant in advance. BY MICHELLE PALOMINO Students from across South Florida who are part of Miami-Dade County Future Farmers of America (FFA) and the 4-H Miami-Dade Program began the first stage of the exhibit process for the 2010 Miami-Dade County Fair as they weighed-in the Market Steer to be exhibited in the 2010 fair. “Participation in our animal exhibits program is no easy task,” said Phil Clark, CEO of the Miami-Dade County Fair. “The students must commit to feed, water, bathe, groom and exercise their animals everyday until next year’s fair in March 2010. “The Miami-Dade County Fair is proud of its designation as an agricultural fair and is committed to providing
students of Miami-Dade County access to agricultural education,” he added. It is estimated that a steer will eat an average of 18 pounds of feed per day and will gain approximately 2.5-3.0 pounds per day. Students will be expected to showcase their breeds in qualities and strength next year at The Fair. The Fair will be celebrating its 59th year from Mar. 25 to Apr. 11, 2010, and is expected to attract more than 700,000 visitors. Awarding more than $8 million in scholarships, awards and premiums along with outstanding educational student and youth programs, The Fair is more than just an 18-day event and a sought after venue for community events and festivals held throughout the year.

LET’S TALK CARS The Honda Pilot received a complete makeover last year, so little has been changed for 2010. The eight-passenger Pilot is a nice looking SUV and has been popular with American consumers since its introduction in 2003. It’s a solid performer, handles well around town or on the highway and has good cargo-hauling capability. The Pilot is available in four models — LX, EX, EX-L and Touring — each offered in either a two-wheel-drive or four-wheeldrive configuration. The Pilot comes with a lengthy list of standard features, including a front and rear air conditioning system with air-filtration, keyless entry, tilt and telescope steering column, cruise control, power windows with auto-up/down driver’s and passenger’s window, power door and tailgate locks, AM/FM/CD stereo system with seven-speakers including subwoofer and Radio Data System (RDS), trip
computer, digital compass, auto on/off headlights, heat-rejecting tinted glass, and integrated class III towing receiver. The models build on that, each level adding luxury features and equipment that is almost mind-boggling. Under the hood, the Pilot is powered by an advanced 24-valve 250-hp V-6 iVTEC engine with “intelligent” Variable Valve Timing and Lift Electronic Control (i-VTEC) technology. Variable Cylinder Management allows the engine to operate in a six-cylinder mode for power and in four- or three-cylinder modes for efficiency. Fuel economy is an EPA-estimated city/highway/combined 17/23/19 miles per gallon on two-wheel-drive models and 16/22/18 miles per gallon on four-wheeldrive models. A 21-gallon fuel tank can yield a driving range of more than 400 miles on the highway. The available Variable Torque Management 4-Wheel-Drive (VTM-4) enhances traction in rain, snow and slippery terrain. LOST DOG TARZAN.... Pure breed German Shepherd. About 3 yrs old. Tarzan came to us a year ago & was very mistreated. He was kept in a crate too small for him and had a lot of ticks and fleas. He is a really good dog that needs someone to care for him. He was adopted to a couple w/another dog and 2 small girls. They all got along fine especially with the children. He just knows how to be a good dog. He eats well but the stress is not allowing him to gain weight. The husband is in the Army and is being shipped to Iraq and they can’t keep him. Is Your Association Attorney Taking Their Legal Fees Out of Your Assessments? BY: BEN SOLOMON, ESQ.
If your homeowners or condominium association attorney is taking their legal fees and costs out of your assessments they are collecting (or only collecting the assessments due to the association and then billing the association without collecting such fees and costs on top of the association assessments), then you may want to consider finding a new attorney. Florida Statutes and most association governing documents protect an attorney’s right to collect his or her legal fees and costs in addition to the assessments due to the association. Therefore, if the attorney only collects the assessment amount for the association and then separately bills the association for their legal fees (which fees, in some cases, may be more than the actual assessments collected) then, in essence, the attorney has taken their fees out of the association’s money instead of taking advantage of the association’s legal right to collect all of its legal fees and costs in addition to the assessments. Additionally, some attorneys either bill their association clients up front or at some other stage of the collection matter instead of deferring such legal fees until the matter is successfully concluded and the association also receives its money. While smaller practitioners may need to bill their clients up front or along the way in order to cover overhead expenses and other financial needs, the irony is that most associations in this market cannot afford to pay any legal fees (which is why they need a good collection attorney in the first place) and therefore should consider finding an attorney who agrees to defer all of their legal fees until such legal fees are fully collected from the debtor or the lender. Additionally, having to pay legal fees up front or along the way is actually a deterrent to many associations from even pursuing advisable legal remedies such as filing their own association foreclosures against delinquent owners (instead of just waiting for the lenders to come through) because the legal fees are cost prohibitive.

Some naïve attorneys also allow lenders’ counsel to convince them that the statutory cap for a qualified first mortgagee (who completes a foreclosure against its borrower) also includes a cap on the association’s legal fees and costs. It does not. Such statutory caps, if applicable, only apply to “assessments” and, as such, the legal fees and costs are all recoverable in addition to the capped amount of assessments due from the prior owner. If the Florida Legislature had intended to cap legal fees and costs for qualified first mortgage holders, it would have stated so in the applicable statute. Practically speaking, this also could not have been the intent because the legal fees and costs are typically more than the statutory cap in the first place, which would mean that if the legal fees were capped, the association would not only typically get nothing (because the fees would be greater than the assessments due), but would possibly leave the association upside down owing an additional balance to the attorney, in which case no association would be able to hire an attorney for such purpose.
