First of a Series from Sunny Isles Beach Police Department Staff BY CHIEF FRED MAAS At least once a week, local or national media devote their attention to the topic of “The Homeless.” Whether it is an isolated incident, a local story or a national ruling by the Supreme Court, the issue is constantly in the limelight. How local communities deal with it and respond to it, is the subject of much controversy as well. The following is the first of a series of articles on this topic because quite frankly there is too much to cover in just one writing. Contributions to this report have come from multiple departments in the City, from the City Manager and Police Chief to the Crime Prevention Specialist and Patrol Officer. –––––––––––––––– See

he scholarship committee for Sunny Isles Beach College Tuition assistance has made applications available earlier than previous years. The purpose is to allow qualifying high school seniors even more time to prepare for their community service hours or work on the required documents over the Holiday Season break from school. The scholarship application will be available on December 2, 2013, in various formats. A student can go “On Line,” or drop by the Government Center’s 1st floor, Pelican Community Park’s 1st floor to pick up a hard copy application. The rules and restrictions are almost identical to previous years with minor adjustments. Last year, a record number of scholarships were awarded to Sunny Isles Beach students and Golden Beach students, under the joint program. Many of the recipients expressed their absolute gratitude toward the City for its annual financial assistance for future college tuition and expenses. So Don’t Delay! Get started early and join the growing number of students who know their city is behind them as they plan their college careers. ecord numbers of ghosts and goblins of all sizes toured through the haunted house at this year’s Booogie by the Beach in Sunny Isles Beach. But only the brave and fearless ventured to the second floor, known for its pure terror and horrors at every turn. The two-day event was graced with fabulous weather which encouraged many residents to come out and enjoy all that was offered each night. The haunted house was not the only game in town. Many in the younger crowd, who carefully avoided the second floor of the haunted house, were able to participate in the scare games of skill set up in the gymnasium. There were also amazing creepy, crawly creatures to visit and touch, the likes of which impressed even the parents. At a stage on the baseball field live entertainment was presented hourly featuring a magic act which levitated one body and sawed another one in half. Yikes! As expected, the costume and pumpkin carving contests were visited by some very imaginative horrors and creations. The usual spinning and bouncing rides for the little ones and food for sale contributed to the overall enjoyment of each evening. They arrive by day or night, all their worldly possessions in duffle bags, suitcase or several plastic bags. Some have only the clothes on their back to wear. In many cases they are unsightly and the average citizen will simply avoid them. Some pass thru our city, others stay for a few days or weeks, others make it a place to call “home.” Their reasons are varied but center around a core group of common factors: financial ruin, loss of job and home, mental illness, physical ailments or restrictions. And of course, “homeless by choice” which we hear of more and more in today’s society. One of the biggest obstacles the law enforcement officers encounter that even when they do extend an offer for help, to be taken to a shelter or a home, it is emphatically refused. Many do not want the restrictions imposed upon them at a shelter. They want the freedom to move about and do what they want. So they forego the offers for help. Most shelters also fill up quickly by those who do want some assistance. So when there is a need to house someone, there is NO guarantee you will get them placed. NO BEDS means just that; we are full and have no space. This makes it tough on the officer or social worker who tries to offer assistance to a homeless person, but then finds out there is nothing for them. They have no choice but to leave them or if they have committed a criminal act, arrest them. The aspect of incarceration is a whole matter of its own to be taken up in a separate article for this series. On first sight, they make us feel uncomfortable. They are more of an annoyance by their actions than threatening. They often refuse help to help themselves, but at the same time they infringe upon the rights of other citizens. For example: IT IS NOT A CRIME to sleep on a bus bench. Does it look unsightly, of course, especially if it is widespread and frequent in a community. But, it is unacceptable to prevent others from sitting on that bus bench because you have taken it

Unfortunately, law enforcement officers can only contact, check out and either move along or modify the homeless behavior. In order to incarcerate there MUST be a criminal act and quite frankly, Florida State Statutes don’t deal with routine matters of life sustaining issues of homelessness, as a criminal act. In some areas, local ordinances will be the catalyst for arrest for acts such as urinating in public or panhandling in the streets. Those are no more effective than the trip to the county jail as the arrestee is released in the morning with credit for time served. And many, including the A.C.L.U. and other organizations have challenged the constitutionality of arresting a homeless person for committing life sustaining acts in public. Too often we in law enforcement hear the calls and complaints from residents to do something about the problem. Some have even captured on photo, the acts of the homeless, like sleeping on bus benches. Unfortunately, you can take ALL the pictures you want, but it is still NOT a crime to occupy a bus bench in public. Local law enforcement may require you to sit up and not impose on others’ space, but it is not an arrestable offense. However, when persons cross the line and do commit minor misdemeanor offenses, or violate local ordinances, then it becomes a clear cut issue for law enforcement. Even then our goal is to get them help, not short term incarceration. But as we all know, the help starts from within and the desire has to be there on their part. Bob Diamond HISTORICALLY YOURS With little opposition and significant ant-Semitism, the Northern Congress adopted a new law at the start of the Civil War in 1861 requiring all regimental chaplains to be “regularly ordained ministers of some Christian denomination.” This presented serious problems for a large number of Jews who enlisted in the Union Army and wanted a minister of their own faith. Shortly thereafter, it was discovered that Cameron’s Dragoons, a Pennsylvania regiment led by Colonel Max Friedman, had appointed Michael Allen, a Jew, as regimental chaplain. Allen was not an ordained rabbi although educated at the Philadelphia Hebrew Education Society. Although the army had several Christian chaplains who were not ordained ministers, Allen was fired for not being “an ordained Christian minister.” Jewish organizations, supported by some Christian clergy, challenged the new law demanding equality for the Jewish soldiers, but Allen, lacking ordination, was the wrong test case. Several Christian organizations lobbied Congress, insisting upon only Christian chaplains.

Colonel Friedman and his fellow officers selected as their chaplain ordained Rabbi Arnold Fischel of New York. Fischel moved to Pennsylvania to fight this important cause. Simon Cameron, the Secretary of War, for whom the regiment was named, rejected the Fischel appointment. Fischel appealed to President Lincoln on December 11 1861 seeking equal rights for Jewish soldiers, contending that the law was blatantly unconstitutional because it endorsed Christianity as the official religion of the United States and Jews, as loyal and patriotic citizens deserved to have rabbis minister to them. Lincoln listened carefully, “fully admitted” to the justice of Fischel’s comments and agreed to submit a new law to Congress “broad enough to cover what is desired by you in behalf of the Israelites.” With Lincoln’s full support, on July 17, 1862, Congress amended the chaplaincy law to allow the “appointment of Catholic, Protestant and Jewish religions.” The Battle having been won, Fischel stepped aside and on recommendation of The Board of Ministers of the Hebrew Congregation of Philadelphia, Lincoln appointed Rabbi Jacob Frankel of Rodesh Shalom Congregation to serve as the first Jewish military chaplain, to the gratification of America’s entire Jewish community.

City Historian

One hundred and sixty-seven years before the birth of Christ, a Syrian King named Antiochus captured the land of Israel. He ordered the Jews to give up their religion and worship his idols. All who refused to obey his command were put to death. What followed was the first fight for religious freedom. The Jews fought back. Even though they were greatly

outnumbered by the Syrian forces, the Jewish Maccabean army defeated the enemy and recaptured Jerusalem. Immediately they marched to the Holy temple, smashed the idols the Syrians had put there. When they cleaned and repaired the temple, everyone gathered to celebrate the rededication. However, only one flask of Holy Oil was found to light the new Menorah. This was just enough oil to burn for one day. But, a great miracle happened; to everyone’s amazement, this little flask of oil burned for eight days and nights. Because of this miracle, we celebrate Chanukah for eight days.

Marina Palms Yacht Club & Residences closes on $98 Million construction loan for first tower

Marina Palms Yacht Club & Residences closed on a $98 million loan to fund construction of the project’s first residential tower located on the north side of the waterfront property. The lender is HSBC Bank USA, NA. “This was an ideal loan for us given the highly desirable nature and uniqueness of the project and the first-class development team that is executing on the business plan,” said Michael Wadler, vice president of real estate finance at HSBC Bank USA. Marina Palms Yacht Club & Residences, located in North Miami Beach, features two 25-story towers with a combined 468 residences. Construction began on the North Tower in September. Virtually all of its 234 residences have been sold with only penthouses now available for purchase. Coastal Construction is the general contractor. Due to continued strong buyer demand, Marina Palms will begin selling residences in the South Tower with introductory prices averaging at $550 per square foot. “Our first building was a major success and we are transitioning our sales momentum into phase two of the project,” said Anthony Burns, a principal of The DevStar Group, one of the development partners. “The demand to own a well-located condominium residence in South Florida remains strong and Marina Palms Yacht Club & Residences offers one of the best values in the area for a luxury product that promotes life on the water. System, Adaptive Cruise Control with LowSpeed Follow, remote engine start with an extended range of at least 300 feet, a new Ultra-Wide DVD Rear Entertainment System with HDMI connectivity, and front and rear parking sensors.
