O
n September 26, groups across Canada took time out of their days to celebrate one of our great natural resources, the tree. CNLA members across the country demonstrated the true spirit of our industry by partnering with almost 90 schools to teach students about trees by donating and planting one (or more) on school property. The purpose of matching schools with Member Company was to provide the opportunity for industry

remembered them. Other members returned to schools that they had attended as students, giving them the opportunity to give back. This year in Nova Scotia, Down to Earth Gardening & Landscaping planted a tree that was donated by Blomidon Nurseries, with the students of Port Williams Elementary; MacPhee’s Landscaping Services spent time with the students of Dutch Settlement Elementary School planting a tree that was donated by Elmsdale Landscaping Ltd; Highland Landscapes for Lifestyle planted a tree they donated to Sherwood Park Education Centre, Sydney; and Elmsdale Landscaping Ltd donated and planted at tree to the Elmsdale Square. Overall, response on both sides was very positive for those that participated. Schools that participated indicate that it was a very enjoyable event; the children were very interested and had lots of questions about the life of a tree. There are so many

Presidential Corner No Rant This Time.... ~ by Paul MacPhee, President, LNS
W
ow, how time flies. Where does it go? My two years as President for Landscape NS is already winding down. We have landscaped a lot of ground (pun intended) in last two years: transitions in the office, newly recruited members, apprenticeship, co-hosting the National Awards and EI reform to name a few. As I have said before there is lots going on at Landscape Nova Scotia and I am proud to be a part of it. As our new President takes the reigns, I am confident we are in good hands. All in all, it has been a great 2012 season. Anything would have been better after the spring of 2011 (with all the rain). But it has turned out to be quite the busy season for our industry. The office phone was quieter than usual throughout
the summer months and that means that everyone was busy making beautiful properties for our customers to enjoy and that’s what it is all about while making money! September was another story, but the rain keeps everything green and it makes us landscapers look good.
HORTEAST is here once again. The dates are November 19 for workshops and 20th and 21st for trade show and other events. It will be at the Cunard Center, as in years past. Please make every effort to attend the show and tell all your landscaper friends!
As I am sure most of you reading this are aware, EI reform is coming and LNS has had a voice and a position on the subject that has been delivered to the Honourable Diane Finley, Minister of Labour. Our worst fears are not being met, but the issues are still being worked through. You can bet, the CNLA is also being diligent about the importance of the issue and I can say with some confidence that they have made a significant contribution to the opinion of the industry and have delivered the message loud and clear.
And lastly, I would love to see every member of LNS attend our AGM this fall. This is your time to express your thoughts and concerns and get involved in the committees of the association. As outgoing President, I want to personally thank Ms. Pam Woodman, our ED, who even during her maternity leave was clearly devoted and involved in LNS activities. She is in no small part a great asset to this association.
As outgoing President, I want to instill in any members reading this that Certification, Apprenticeship, and Red Seal should be goals for everyone. Landscape Nova Scotia has been working hard with the provincial government in recent months trying to initiate the Apprenticeship Program and making Red Seal more accessible for our industry. The more education we can get, the more elevated the industry as a whole can become. Please consider achieving one of these designations. There will be financial gains to be had to those who commit to higher education.

LNS 2012 Golf Champs! Congratulations to Atlantic Cat
O
n Thursday August 9th, Landscape Nova Scotia hosted the Annual Grant Moser Memorial Golf Tournament at the Sherwood Golf & Country Club. The Golf Tournament was a huge success, and the weather was perfect. There were 14 teams registered for the event, and everyone had a great time.

Celebrating Tim Tregunno...
O
n October 24th Landscape Nova Scotia, NSCC with the help of Maritime Landscape Services hosted a Dedication Ceremony & Opening of “The Tim Tregunno Innovation Garden” at the Nova Scotia Community College, Kingstec Campus. The ceremony was held to commemorate the life of Tim Tregunno who was a member of Landscape Nova Scotia and icon to our industry for many years. With over 30 years of leadership as owner and operator of the Halifax Seed Company, Tim led his team through many great successes and created a true family atmosphere as he viewed the staff as the “work” family. An English Oak was planted by the crew of Maritime Landscape Services (Andy Ostrander & Matt Lyons) along with Tim Amos, his assistant Bonnie Levy and two of their students and will be maintained by the students of the Horticultural Program as the first phase of the garden while contributing to the student’s curriculum. Garden Centres Collect an Estimated 91,229 lbs Of Plastic During 2012 National Plastics Recycling Event
C
ustomers that visited their local independent garden centre from June 22 to July 1, would have seen piles of old garden pots stacked high. This year, an estimated 91,229 lbs of plastic was collected during the Canadian Nursery Landscape Association’s (CNLA) National Plastics
Recycling Event. 56 garden centres, spanning eight provinces, participated by acting as drop-off points for their community’s used garden pots and trays. Landscape Nova Scotia members Atlantic Gardens, Bloom Greenhouse & Garden Centre and Blomindon Garden Centre participated in the event. With a 40% increase in participation and plastics collected, this year’s event was a huge success! The CNLA would like to extend a huge thank you to all participating member garden centres who put in the extra effort to make this years event so successful - a lot of work goes into saving over 90,000 lbs of plastic from the landfill. The word was spread throughout the media, with mentions
by CBC News NB, various municipal newspapers, regional websites, association websites and more. A media listing can be found online at www.cnla-acpp.ca/plasticsrecyclingevent This was the third year for the program, which was launched in 2010, when just six garden centres collected more than 53,000 pounds of plastic, and last year over 40 garden centres participated collecting 63,150 pounds. The National Plastics Recycling Event is scheduled to return again in 2013 - Recyclers who can offer free pick-ups of unsorted garden and agricultural plastics, and garden retailers who wish to participate, are asked to contact the CNLA.
Sheridan Nurseries Awarded The Golden Rose
O
n September 13, Canada’s largest garden retailer and grower, Sheridan Nurseries, received the prestigious Golden Rose at the annual AIPH Election of the International Grower of the Year in Horst/ Venlo, the Netherlands.
Owen Vanstone, CNLA Growers’ Canada Chair, said, “This is the first time that any country has won the prestigious gold rose two years in a row. Sheridan Nurseries was certainly well deserving of the award, but the competition was particularly strong this year. Sheridan Nurseries has helped us to prove what we all know to be true, that Canada has some of the best nursery growers in the world.” Bylands Nurseries in Kelowna, BC won the Golden Rose last year.
AIPH (International Association of Horticultural Producers) preselected Sheridan to represent Canada in the contest after the nursery received the 2012 Royal Bank of Canada Grower of the Year Award at the CNLA National Awards of Landscape Excellence gala earlier this year. The competition was tough, with entries from five other national grower of the year award winners: Mansfield Propagation Nursery (Australia), Potplantenkwekerij Dirk Mermels (Belgium), Trapani Piante (Italy), Van den Berg Roses (the Netherlands) and Lovania Nurseries (the United Kingdom).
On the eve of their 100th year in business in 2013, Sheridan links their success to their standards of excellence and strong brand presence within the sector, as well as the dedication and commitment of their entire team. In both awards, the nursery was recognized for its innovative emphasis on new plant varieties each year, excellent human resource and educational policies, high quality and environmental standards, as well as its sustainable production policy and market place position. Sheridan CEO and CNLA President, Bill Stensson, said, “The International Grower of the Year award is a tribute to our staff who have worked tirelessly to make Sheridan Nurseries a better company every day. It is an honour to be recognized by one’s peers for your work and I encourage all growers to take part in the competition as it makes both your company and our industry better and stronger. Landscape Industry Certified Exam Fall Dates Announced for Truro

he Atlantic Region Certification Committee is excited to be holding a Landscape Industry Certified Exam on November 2-3, 2012 at Dalhousie University (formerly Nova Scotia Agricultural College). This test date will offer all specialties (Technician, Designer, and Manager). Interested in A Career in the Horticulture Industry?
T
here are many resources out there for those interested in advancing their skills in this industry. No matter what your stage in life, there are plenty of opportunities to get the skills you need.
Specialist High Skills Major: Horticulture and Landscaping Major This program is currently being run in 29 high schools across Ontario. Grade 11 and 12 students will be given the skills to advance into one of four streams: apprenticeship (agriculturalfruit grower, horticultural technician), college (tree service tech, parks operations manager, golf course tech), university (landscape architect, horticulturalist, botanist) or entry level workplace (greenhouse worker, landscaper). CNLA’s Landscape Committee along with the provincial associations, are working hard to get this program in at least one high school per province by year end. Post Secondary Horticulture and Landscape Educational Listings There are many universities across the country that offer a wide selection of programs and degrees for our industry. Apprenticeship / Red Seal In the past two editions of the CNLA Newsbrief, Landscape Priorities Manager, Liz Klose, has provided a run-down on the Canadian Red Seal apprenticeship program. Completing the Red Seal examination allows you to obtain Red Seal endorsement on your Certificate of Qualification. This means that you meet interprovincial standards for your trade. Changes to EI Program Affect Landscape Industry
O
n May 24, 2012 Minister of Human Resources, Diane Finley announced changes to the Employment Insurance (EI) program. These changes are intended to connect Canadians with existing jobs to reduce unemployment and to advance the Canadians First policy initiative. At the time of this release, the exact impact and implementation of these changes are unknown. CNLA will continue to work with the provincial associations to gather information and establish an advocacy strategy to help our members with the new policies. These policy changes are scheduled for implementation in early 2013. Points of Interest The consensus amongst stakeholders is the proposed EI changes do not accurately address the seasonal nature of our industry. As Michelle Gillespie of Sun Nurseries in Sussex, NB puts it, “our seasonal business will suffer as we lose good employees. Constantly retraining new employees will take a heavy toll on finances and lost business opportunities. Our climate dictates the seasonality of our industry not our lack of willingness to work in our chosen careers”. The following items have been identified as areas of potential interest for our industry: • Delay or loss of Seasonal Agricultural or Temporary Foreign workers: We believe this is unlikely given the distance and wage criteria for postings. The greater concern is delay in receiving positive LMO’s and thus filling the positions. • Loss of returning employees: Repeat users of EI are going to face additional pressure to find alternate employment. They will be required to take jobs at 70% of former wage as early as 6 weeks after starting EI. • Increase in applications: The new EI policies will likely result in many more applications for open positions. We anticipate this could become an administrative issue for companies large and small. Previous changes to note: • Reduction in the claw back amount to 50% of earnings to apply against EI claims. This helps reduce the disincentive to work by allowing workers on EI to keep more of what they earn for casual labour.
• Reduction in wages for SAWP workers by as much as 15% below minimum wage based on regional variation. This could widen the gap in some areas and help maintain the ability of foreign labour. Suitable employment depends on a number of issues: • Personal Circumstances-health, family obligations, transportation options and physical demands of the job • Commuting time-within 1 hour or typical for the region • Type of work-responsibilities, qualifications, experience • Wages Turning down a job that is considered suitable could result in EI benefits being discontinued. Below is a breakdown of what will happen when someone applies for employment insurance. The applicant will be filed into one of three categories: Frequent Claimants (17% of all claims): Seasonal workers would fall into this category • This includes anyone who has filed 3 or more EI claims in the past five years • Right away claimants will have to take any work that is a “similar occupation” of their old job and pays 80% of their previous earnings • After 6 weeks on EI, claimants will have to take any job they are able to do at 70% of their previous earnings Occasional Claimants (58% of all claims): Seasonal workers averaging 7 weeks a year on EI would fall into this category.
• For the first 6 weeks of receiving EI, they will only have to take a job in their same occupation that pays at least 90% of their previous earnings • After 6 weeks, they will have to take a job in a similar occupation that pays 80% of their previous workings • After 18 weeks they will have to take any work at 70% of their previous earnings Long tenured workers (25% of all claims): • Claimants must work for seven of the past 10 years while paying at least 30% of maximum EI payments and have received no more than 35 weeks of EI over the past 5 years • Claimants will have 18 weeks to find a job in their existing occupation that pays at least 90% of their previous earnings • After 18 weeks they must move to a similar occupation that pays 80% of previous earnings The Government is providing clarity on what constitutes a reasonable job search. EI claimants’ job search efforts would be assessed based on the following criteria: Job search and employability activities - Canadians receiving EI benefits will be required to complete the following job search activities while collecting benefits: • Researching and assessing job prospects; • Preparing for job application (preparing resume); • Searching for job vacancies; • Applying for positions; • Attending interviews; and • Other efforts to improve employability (workshops, employment agencies, job fairs, networking, etc.). This will be measured by the intensity of the search, the type of work being sought and evidence of job search efforts.
• This category includes people who don’t go on EI enough to be considered frequent claimants, but also who haven’t worked steadily enough to be long-tenured workers.

Education... Are You Showing People How To Do Things? Or Are You Training People To Do Things? Recently Landscape Nova Scotia held an On-the-Job (OJT) Training workshop at Elmsdale Landscaping last month. Given the great weather we’ve had all year it was a challenge to get members out to the event. However, this well developed, very important, professionally presented 2 day course, it is one that everybody should participate in and LNS plans to continue to offer the train the trainer workshops on a regular basis. What is OJT? Most of the learning in our industry happens on-thejob, working side-by-side with a more experienced or knowledgeable person. There is no doubt in the trainer’s skills, but how many have ever had training on how to train? CNLA and the provincial associations through support of CAHRC and HRSDC, offers a customized system for our industry that applies proven practice to training practical skills and best methods for improving the skills of trainers.
These improvements will lead to quicker training, more effective and productive trainees, improved safety and quality standards and an overall return on investment for your human resource dollars. On-the-job. That is where most of the learning in our industry happens. Every day, on-the-job, working side-by-side with a more experienced or knowledgeable person. The flaw in this model is that despite years of experience and brimming with knowledge most trainers have never been taught to teach. The OJT training workshop will improve the effectiveness of any and all training that you currently do. The OJT workshop is a two-day program. Participants learn through both in-class and practical role-playing, acting as both the trainer and trainee. All participants receive a copy of the CAHRC training standards for Landscape Horticulturist, method outline, quick review wallet cards, training moment templates and DVD summary.
OJT Master Trainer Joel Beatson was very impressed with the group last month “Rarely, have I seen a group grow so quickly and pick up the OJT method so well”. He also expressed thanks to Elmsdale Landscaping and LNS for being such gracious hosts. Joel is continuously impressed with the passion in this industry and the share frustration many have when it comes to training and re-training people. He says “OJT gives people the tool set to train, faster, better, and less often”. I think this is something we can all agree with, working smarter not harder. Dangers of Landscaping Mulch Bark mulch, commonly used as ground cover, can become a fire hazard in hot and dry conditions. In 2010, the fire department has seen a significant increase in the number of fires occurring in landscaping mulch, which are particularly dangerous due to how close they often are to homes and businesses. Fires starting in landscaping mulch can spread into shrubbery and then to the building. Below average rainfall, warm temperatures, extremely dry conditions and abnormal winds all increase the risk of serious damage from mulch fires. Another factor is smoking – most smokers are outside due to laws and facility policies. Cigarettes, cigars and matches discarded into landscaped areas could start a fire. Reduce the risk of fire – follow these guidelines: •
If you smoke, use the provided receptacles to discard your smoking material and matches.

Provide a minimum of an 18-inch clearance between landscaping mulch beds and combustible building materials. Ensure proper clearance to electric devices, such as decorative lights, by following the manufacturer’s instructions.

Keep landscaping mulch beds moist if possible.
•
If you see anything smoking in a landscaped bed, put it out if you can and report it to someone inside the building. If the burning material is not thoroughly wet or removed, it may re-ignite.

Grounds maintenance crews should be aware of the conditions that are favorable for mulch fires and increase surveillance of mulch beds in the afternoon when fires are more likely to occur.

Provide proper receptacles for smoking materials at all entrances to public buildings and in designated smoking areas. Do not use mulch in or near these areas.

Article... Directors and Officers Liability: Protecting Personal Assets from Corporate Risk By Tyler MacLaren
T
he media is full of headlines which have made corporations, and particularly their directors and officers, take notice. Sarbanes Oxley in the United States, Bill 198 in Ontario, and similar legislation in other provinces, have brought heightened focus to directors and officers (D&O) liabilities. These issues are shaping the way directors D&O liability is being handled by corporations and executives, and increasingly, executives are making this type of insurance one of their top priorities. There are three bases by which personal liability can be imposed on directors and officers: Breach of Fiduciary Duty, Breach of Duty of Care, and Statutory Liability. The first two duties were developed in common law and have now been codified within the various Business Corporations Acts. In addition, there are estimated to be more than 100 provincial and federal statutes imposing other personal liabilities upon directors and officers. D&O liability insurance policies are designed to protect directors and officers for the legal liability they may sustain when acting in their executive capacity. Coverage can also be extended to include the following: • Not for Profit Outside Directorship Liability - Coverage can be extended to directors and officers sitting on boards of outside not-for-profit organizations such as charities, associations, and sports clubs. • Spousal Liability - Coverage is extended to the spouse or domestic partner of the director and officer if named as a co-defendant in an action, but typically only to the extent that the claim against the spouse or domestic partner arises out of a wrongful act of the director or officer. There is no coverage if the allegations against the spouse or domestic partners involved their own wrongful act. • Employment Practices Liability - Coverage is provided to an expanded group of insureds (including employees) for claims arising out of employment-related issues such as wrongful dismissal, discrimination, humiliation, and sexual harassment. In certain circumstances, the policy is expanded to include the organization as well as the employees. This article is not intended to be a complete statement on the subject of directors and officers liability, but simply a general overview of some of the key issues and considerations facing directors and officers today. With changing federal and provincial legislation and an expanding business and legal relationship between Canada and the United States, directors and officers liability is an evolving and changing field which requires constant monitoring.
