The sale of 2975-2995 Jutland Road in Victoria, BC was unique as it was the sale of an Option to Purchase. Not only was it an option to purchase, but that option was not exercisable for three years. The +/-180,000 SF office building was purpose built in 1997 for the Province of BC and has been solely occupied by them on a 20-year leaseback since. As part of the original agreement, the owner provided the province with an option to purchase exercisable within the last 12 months of the term at a predetermined price. As part of the disposition, the Province of BC agreed to a new 10 year lease to commence upon the transfer of ownership under the option to purchase. The delayed ability to execute the option not only limited potential buyers to those who would not require financing, it also brought overall building maintenance and liability over the next three years to the forefront of negotiations.
