Doug Carpenter • CAA President Greetings CAA Members: As Summer comes to a close and the cooler Fall temperatures arrive, we start thinking that the year is coming to an end. Along with the end of the year festivities, we, as your CAA Board of Directors, have begun the 2011 Convention planning. Lance Nichols, 1st Vice President, has put together a very good program. Please review the schedule of events, speakers and networking opportunities Lance has lined up for you. Please view the convention information on page 13. I want to encourage everyone to mark your calendars for this years CAA Annual Convention. Your Board works very hard to put together a program that will appeal to all auctioneers within the Association. You may not be interested in all the topics, however, the educational opportunities offered at this convention could greatly benefit your auction company or you personally as an auctioneer. If we all come to the convention with the attitude that we will take one piece of information back home with us and use it over the next year, it could make a huge difference in your business, whether that business is buildings and staff or just you as a contract auctioneer. This convention has something that every auctioneer can benefit from. During our Annual Business Meeting at the 2011 Convention we will be voting on a change to the Articles of Incorporation. This year Walt Partridge and Scott Alexander were given the task of revising the Colorado Auctioneer’s Association Bylaws and this revision was approved by your Board of Directors. The changes in the Bylaws made it necessary to change the Articles of Incorporation as well. These changes to the Articles of Incorporation need to be voted on by the CAA members. Please do not be alarmed with the revision to the Bylaws. The changes were all minor changes and basically updated and modernized the language. The changes to the Articles of Incorporation are mostly changes to the language so that they mirror the Bylaws. You can view the revised CAA Bylaws in the member section of our website – www.coauctioneers.com. I want to again thank Walt Partridge and Scott Alexander for the great job they did in revising the Bylaws. This was no easy task, which is probably why it had not been done earlier, but they were very persistent in getting it done.

During our 2010 Annual Business Meeting it was voted on and approved to adopt NAA’s Position Paper on Absolute Auctions. Please be aware of the content of this Position Paper which is posted in the members section of our website – www.coauctioneers.com. If you are selling real estate, or any other item, please be cautious when using the word “Absolute” as it can infer a meaning which is not totally accurate. The whole point of the Position Paper is to avoid misleading buyers and to not misrepresent your auctions as “absolute” when the seller has no intent of closing or selling a specific item if the bidding does not reach a certain dollar amount. This is our industry and we all have the responsibility to ensure that the public is served well. We work for the client (seller) but our representations to the buyer is just as important. The New Logo Is Here! By Rich Schur The issue of a new logo has been a concern for the past several years, and after much debate, has been resolved.

WE ARE MOVING!

The Board unveiled a new logo at least year’s General Meeting. Although there was a warm response, there was also some concern and criticism. We literally went back to the drawing board. We worked with both Jeff Steele of Scream Graphics, and utilized an on-line logo contest site to come up with some changes and modifications.

The concerns about the old logo were that it was out-dated (50th anniversary was no longer valid), and that the size, shape, and detail were hard to reproduce in certain marketing media. We were looking for a clean, attractive, simple design that we could use for years to come.

CAA BOARD ENDORSES COREY GARDNER By Dax Gillium Denver, CO—At a June16th meeting, the CAA Board of Directors voted to support and endorse Cory Gardner for Colorado’s 4th District in the race for U.S. House of Representatives against incumbent Betsy Markey. While representing Colorado’s 63rd District in the state legislature, Gardner has made economic development, healthcare, and education priorities. In 2007, he created the Colorado Clean Energy Authority, which has helped to bring millions of dollars in development to Colorado. He has also worked to increase community college funding, bring state-of-the-art tele-medicine to rural communities, and protect homeowners facing foreclosure. In a written statement, Gardner expressed his gratitude about the endorsement:

“It is an honor to be endorsed by a pro-small business organization like the Colorado Auctioneers Association.” “I am running for Congress because wasteful, out-of-control spending and disregard to the hardworking taxpayers’ money needs to stop, so we can get government out of the way and let America work.” Gardner has been supportive of the CAA’s past efforts to enact legislation that would compel the use of professional auctioneers in the sale of foreclosed properties. The congressman has also hosted members of the CAA for the association’s annual “Day At The Capitol” event for the past two years. ❖

CAA URGES REPEAL OF HEALTHCARE LAW’S 10-99 PROVISION By Rich Schur The Health Care bill recently passed by the government contains a provision that in essence requires all businesses to issue an IRS 1099 form for every time we spend more than $600 to a single source, in a given year. While we are used to providing 10-99’s for our contract workers, this would apply to all persons or entities that receive more than $600 a year from you. This would include your utility companies, credit cards, customers, clients, etc. Everyone. As you can imagine, the cost and time involved to produce a 10-99 for every vendor or customer would be an incredible burden on all of us. The National Auctioneers Association, as well as the US Chamber of Commerce, the National Federation of Independent Businesses (NFIB), and many other business organizations have stood in opposition this provision of the bill and urged congress to repeal it. Both the CAA and the NAA forwarded a link to our members by email, which would allow members to sign an electronic petition requesting our representatives to repeal the act. The petition was initiated and managed by the US Chamber of Commerce.

September 17, 2010 RE: Repeal of the 1099 reporting provisions of the new Health Care Act. Dear ( Senator) The Board of Directors of the Colorado Auctioneers Association (CAA) wishes to express our displeasure with the Senate’s failure this week to pass legislation modifying or removing the 1099 Reporting portions of the new Health Care Act. These provisions require businesses and business owners to undertake major administrative burdens to comply with the new act and will create a costly, unnecessary addition to their already stretched resources. We stand united with the US Chamber of Commerce, and the National Auctioneer’s Association in our opposition of these new burdens, and urge you to work diligently to have them removed from the Health Care Act. These requirements hurt small business, they hurt taxpayers, they hurt auctioneers and our proud industry, and they hurt our national economy.

On September 14, 2010, the Senate failed to repeal the provisions when it came to a vote.

On behalf our our Association and our members, we expect you to pursue this issue until it is resolved.

We stand firm that this provision is harmful to our members, and we have drafted the letter below that we have sent to our State Senators, Michael Bennet and Mark Udall. We urge you to do the same. ❖

By Mike Heitmann Once again the fall season has rolled around and the CAA finds itself in th CAHMPIONSHIP CONTESTe final stages of planning for this year convention coming up in January. It seems like just yesterday that we were enjoying ourselves with great fellowship, outstanding seminars, great food and facilities, and a couple of great evening entertainment venues with the Championship & Rookie Auction Competitions and the Fun Auction. As your Chairman in charge of the Championship Bid Calling Contest again this year, I would like to take this opportunity to encourage all CAA Auctioneers that have not won the coveted “Silver Buckle” to enter this year’s competition. We are very fortunate here in Colorado to have a great bunch of Professional Auctioneers that always are willing to get up in front of their peers and “Put it all on the line”. That being said, in recent years we have noticed a trend of the number of contestants getting smaller. Last year we had 12 great contestants that showed us their talent. But I also noticed that there were quite a few Auctioneers that chose to “sit it out”. In talking to several of them they had numerous reasons for not entering. The economy was one of primary factors but it was not the only one. Several members said that since they had tried several times but had never placed they were not so willing to enter. Others felt that the contest was geared to the “High Power” Auctioneers and the felt they were not in that same class.

Well I am here to tell you that every year we have the same concerns. And just like last year, I am here to tell you that the CAA has one of the best formats of any contest I have been involved with. Our judges are chosen specifically for their impartiality. We try to have a diverse group that is not made up of one specific group of Auctioneers (I.e. Auto Auctioneers, Livestock Auctioneers, and Contract Bid Callers etc.) Also we have changed the rules in the last couple of years so that you can sell the three items that you have brought for the preliminaries. In doing so we have seen a definite rise in the quality of items sold in the preliminary round. Also we have had a lot of positive comments about the fact that we do our interview portion of the competition in a “Public Forum” type of setting. Last but not least, we listened to your concerns have eliminated the requirement that you must be a CAA Member for 6 months in order to enter the contest. That allows our new members to enter even if they just paid their dues at the start of the CAA Convention.

So this is my personal appeal for all of you that are considering the Championship Contest to step right up and enter! Take it from me you never know who will come out on top. I personally entered lots of contests for lots of years until I won the prize. This year’s reigning Champion, Rich Schur, is a relative newcomer in our great industry, (Less than 10 years). Another thing about the competition is that it will make you a better auctioneer. I always learned a lot about my

chant and myself by entering. Sometimes the judges’ comments were flattering. Sometimes they were critical. But in all cases I kept all my scorecards over the years to see how I was progressing as an auctioneer. And not to mention, the sense of accomplishment you get when you compete against your fellow auctioneers! Remember the winner of the competition gets a custom designed silver trophy buckle, a $1000 prize to offset you expenses to the NAA International Bid Call Competition at the NAA Conference & Show and will be the recipient of the Chuck Cumberlin Memorial Traveling Trophy for your reigning year. Have they been an officer or a member of the Board of Directors; have they been on various committees; have they attended seminars and conventions; have they been a convention speaker or a member of a panel discussion at the conventions or seminars?

COMMUNICATION IS CRITICAL IN DELIVERING SUPERIOR SERVICE TO OUR CLIENTS By Christie King, CAI, AARE, BAS • Vice President, NAA It was great to see many of you during my brief visit to the Texas Auctioneers Convention, in June. The first day of the convention, I was able to speak about Real Estate Auctions. I want to share some of the things we reviewed during our class. As we work in our day to day business, we find one of the most challenging issues, even with today’s technology, is communication. Even inner-office communication can be quite challenging due to assumptions that everyone is working the same plan or downright failing to share information. It goes back to the right hand knowing what the left hand is doing cliché. Have you ever experienced that? Well I assure you, you’re not alone. No matter the size of your company, if you have two employees or 20, communication is one of the most important factors in conducting a successful auction. It ensures all team members must be working from the same page. Here are a few steps you can implement to improve your communications. Start with a “turn over” or “kick off” meeting. During this meeting, the sales person, that booked the auction, shares the needs and expectations of your seller(s). Create a document or form that becomes a quick reference guide with pennant facts pertinent to the sale. Some of the topics covered on this form and during the kick off meeting are:

Broker and Auctioneer’s license requirements: This line item will have the exact verbiage required by the state’s regulatory board(s). It includes broker/firm/auctioneer license information as well as any additional disclosures required in advertising. This leaves no room for interpretation when your layout and design person inserts it into your website and marketing material. Property specifics: The name of the auction seems to be a no brainer; but I’ve seen examples where an auction was addressed by the seller’s name, the location of the property, and even the property’s name. Be consistent. While this is an internal system, years from now, you may need to find this auction file. I’d also recommend including a description and location of the property, auction date, time and location of the event, will the sale be conducted off site, how the property will be sold (bid by the dollar or acre). Will High Bidder’s Choice be utilized, any improvements on the property, property disclosures, and if you are offering an online bidding component. Auction Specifics: Include information like, how the property is selling; Absolute, Reserve, or Hybrid. The sale site information, registration time, and any registration fee, if required. In addition, the down payment required auction day and the closing timeframe should be listed. You also want to track any internal deadlines so staff can ensure that they prioritize and stay on target. Some deadlines may include; brochure layout and print deadlines, deadline for gathering all property information for the (PIP), preliminary terms, and auction day contracts to be uploaded to your website for prior viewing by buyers. Email blasts and marketing deadlines can also be included on the form. The showing or open house date and times would also be important to list; along with the person who will be conducting these open houses and how to reach them.

COMMUNICATION continued from pg 8 Contact information for quick reference: It is helpful to also include the Seller’s contact Information, the Title Company/Escrow Agent/ Closing Attorney’s contact information, and any other groups the team might have to contact regularly. General information: One thing I like to have is the “reason for sale.” Many times our sellers, from a public relations standpoint, don’t want us to disclose they are getting a divorce. They’d rather us say a more general statement, such as; they are relocating to another state or area. While this is still true, it helps them to save face if you will. List the reason for sale on the reference guide so all staff are saying the same thing. Each sale is unique and there are many sale specific items you can add to the guide. Establishing procedures like this facilitates good communications from the very beginning of the sale. By improving your internal communications, you will enable your team to focus on the important issues. FUN AUCTION TO CHANGE GEARS By Courtney Ostblom As summer begins coming to a close, I am always amazed at how fast a year goes by. With that in mind, I thought it would be a good time to remind everyone to begin considering what you will bring to our annual Fun Auction. As most of you know, the Fun Auction is the only fundraiser our Organization benefits from the entire year. It’s contribution to our Association is important and desperately needed during these tough times. We are going to be trying something new this year by encouraging everyone to collaborate with their fellow Auctioneers to build a package deal. In years past, Members were asked to bring in around three items each valued at around $50.00 per item. There has been concern that the event is beginning to last too late into the evening. So this year we are simply asking that everyone bring a single item of greater value or a package deal so that we may attempt to raise funds for our association in a shorter amount of time. An example of a package may include a gift certificate to a restaurant, two tickets to a game, and one night’s stay at a hotel nearby. You may want to consider asking local businesses to donate goods and services to our Association or you can team up with your fellow Auctioneers to build a nice package together. We will be allowing the package deals to be sold first so come earily and be first in line. Think big here Auctioneers and good luck in your search for the perfect item or items! We truly appreciate your support and generosity and look forward to seeing what you will be selling this year. ❖

Truth is the great simplifier and never hurts the teller. Truth telling makes life better and easier, always. Much of living a good and productive life is determined by our parents and how we were raised, by our genes and the natural gifts we have been given. But we determine a great deal of our life quality by how we choose to live our lives – selfishly and deceitfully or with truth and consideration for others.

Well, America is not in Washington, it is in our businesses, our factories, banks, college campuses, hospitals, highways, churches and synagogues, our cities and towns – and in our families. The desire to build something and pass it on to our heirs, to our communities, to our country remains strong and vibrant. The desire to do the right thing and meet our responsibilities ourselves is strong. The entrepreneurial spirit is alive and well in America – keep it alive and well inside you.

Justice means applying a healthy balance to our lives and how we treat others. Justice means we get what we deserve, and in the long run that is true. Each day we get what we deserve. A life of peace and serenity, or a life of chaos, stress and worry.

Enjoy today and the people in your lives as if today were your last day – you’ll see today better and use today more wisely, and love those around you as we all should. ❖

We determine our life direction by our attitudes and our behaviors., living in fear, or living free of fear. Our attitudes determine practically everything. The next time you have a conversation, try to keep track of how much time you listen and how much time you talk – you’ll find this a revealing exercise to say the least. How much do you talk about yourself? How much do you talk about others? How much of what you say is kind, fair, true and just? We can learn a great deal about ourselves by listening to our conversations. Ah, the American Way, vilified by the media and those who don’t love America. Well, we believe that our government sometimes gets it right, and often it doesn’t. Remember the words “a government of, by, and for the people?” Sadly, most of those in Washington are in a

CAA 2011 Speaker Bios Spanky Assiter - His love and passion for the business has resulted in his becoming one of the most

dynamic and sought after auctioneers in the world. He has conducted auctions across the United States, England, Canada, South America, Puerto Rico, and South Africa. His inspirational story, celebrity status and motivational style of speaking have made him a much desired speaker and lecturer. Spanky has conducted seminars on the auction method of marketing at conventions around the world. In 1991, he was awarded International Champion Auctioneer at the National Auctioneers Convention and in 2005 he was titled world Champion Auto Auctioneer. Since 1992, he has held court at the Barrett Jackson Collector Car Auctions, billed as the greatest collector car auction in the world.

John S. Nicholls

- John is the President of Nicholls Auction Marketing Group, Inc., and oversees all the day to day operations of the company. John is a second generation auctioneer, licensed in 10 states and the District of Columbia. He is a graduate of Bob Jones University in Greenville, S.C. with a BA in Psychology and a MS in Personnel Services. In 1990, John graduated from the World Wide College of Auctioneering in Mason City Iowa. John is a active member of the National Auctioneers Association, currently serving a 3 year term on the Board of Directors.

Eli Detweiler

- Eli is a contract auctioneer, and works mostly auto auctions but also takes part in livestock, estate and farm equipment auctions. He started his career in the mid 1990’s when he was in his early 20s. In 1995, at the Wisconsin State Fair, he became the youngest-ever Wisconsin Auctioneer Champion. He is also a former North Carolina Auctioneer Champion. On Friday, July 16th 2010 Detweiler has named the National Auctioneers Association International Champion.

Woody Clouse - Woody was at the top of his racquetball game as 2009 US Open and Nationals Champion. He serves to win and make each return count. His experience in competition and wisdom about the winner’s mindset gives powerful impact to each presentation he delivers. Woody has been teaching his philosophies of success to large corporations. Universities and small companies around the country. Now, you too can learn how championed his world renowned racquetball accomplishments in to his prosperous business ventures.

Forres Meadows

CAI, BAS, ATS - Forres is a professional licensed Auctioneer and has held his Texas Auctioneer License since 1989. Forres founded Forres Meadows Auctioneers, Inc., TexasBid.com and HyBidz.com which he uses to conduct all types of auctions including City & County Surplus, Estates, Personal Property, Business Liquidations and Benefit Auctions utilizing the latest services and technology in the industry.
