Environmental lawyer turned state legislator Manny Rutinel was chosen by a vacancy committee in November 2023 to represent House District 32, which includes Commerce City. Rutinel, who was originally born in the Dominican Republic, came to Colorado in 2021 with a focus on economic justice and environmental concerns. Colorado Community Media’s La Ciudad sat down with Rutinel to hear more about his journey to the statehouse. Growing up with a single mom and facing economic diffi-
culties have shaped his perspective, said Rutinel. He highlighted legislation, such as HB24-1007, aiming to eliminate discriminatory housing practices. He also strives to engage younger residents and implement policies for a better future. Interviews have been edited for length and clarity. La Ciudad: State Rep. Manny Rutinel, you grew up in the Dominican Republic, went to school in Florida and you ended up in Colorado while you were working as a lawyer with EarthJustice. Share how those life experiences prepared you for the important role you have in the Colorado legislature. Manny Rutinel: First of all, thank you so much Rosanna for having me. I grew up in many different parts of not just the country, but different countries as well. I am the son of a single mother. She brought us from the Dominican Republic when I was six and we bopped around different
parts of the country in California and Florida while she was looking for better economic opportunity. So that really informs the sort of things that I prioritize for myself and for the communities that I represent. I have a very similar working-class background, I have very similar air and water issues that I experienced in the different environmental justice communities growing up. And so when I think about my priorities and who I am and what I represent, it’s that fight for working families and for environmental justice that I experienced growing up. La Ciudad: Since you are mentioning environmental justice, what’s your personal opinion on the $10.5 million fine Suncor just got and how the money is going to be used to counter arrest the problems that this industry brings to the community? Rutinel: It’s probably the largest against a single polluter in Colorado’s history. The sad reality is that Suncor has made billions of dollars in profit off the backs of communities like those in Commerce City, who I represent. And so, although I think it’s great to hold corporate polluters accountable to this extent, I think we can do a lot more, and I think we have to, in order to protect these communities. La Ciudad: What do you see as the most important issues besides the environmental issue as the challenges that your constituents have to face on a daily basis? Rutinel: My district represents Commerce City and a little bit of unincorporated Adams County that surrounds Commerce City. These areas are Latino, working-class areas. When I think about the issues that these communities face, besides the environmental justice concerns, it’s economic justice issues. The affordability issues across the state and in areas like mine, is front and center for so many families.

If you’re staring at your property tax bill and having a meltdown, a Colorado program might offer you relief. The state’s Property Tax Deferral Program allows homeowners to push their property tax payment down the road, potentially for years — depending on eligibility. “Anytime we can keep folks in their homes and help them find tax relief at the same time is a win for Coloradans,” Colorado State Treasurer Dave Young said in a prepared statement. Homeowners can delay, or “defer,” tax payment for as long as they own their home. The program charges interest — or a slow yearly increase — in the amount of taxes you owe. Here’s how the program works. Who is eligible
Colorado’s deferral program has traditionally helped seniors and active military personnel, but it was expanded last year to provide relief to homeowners affected by increased property taxes for the tax years including and between 2020 to 2023. (2023 property taxes are what you’re billed for this year.) The application period closes on April 1. Homeowners who aren’t seniors or active military can apply under different criteria — they’re eligible if their property taxes increased above what the program calls a “growth cap.” The tax-growth cap is met when the current year’s property tax amount has increased 4% or more compared to the average of the two preceding tax years’ amounts. Joshua Trinidad, a Denver trumpet player who grew up in Brighton, had a dream come true, helping to select the winners at the 66th Annual Grammy Awards earlier this month. Trinidad said he grew up watching the Grammys with his family. “When I got there, I honestly felt
like, do I belong here?” Trinidad said. “A lot of times in my life with music, I’ve always felt despair. But since I was supposed to be there, I was excited at that moment.” Trinidad said he started playing trumpet at age 7, and his family always watched the Grammys. He remembers being amazed by all the musicians’ coordination, and he liked the symphony and the brass sections and people singing and dancing. “I said this is beautiful, and my dad said you could do that someday and be there someday, and I said yeah, okay, Dad,” Trinidad said. “I got to go. When my parents found
out, they were so proud of me.” Trinidad said a friend of his, a piano player who they grew up in college, recommended him as a voting member for the Grammys a year ago in January. He received an email to fill out a 12-page application about his career, asking how he contributed in a way they saw fit. He also needed another recommendation from another person. “If the council sees that you’re fit to vote, they permit you to vote,” he said. “So, after getting officially nominated to be part of the Recording Academy, it took six months to hear back.”
Community work, to boot
Trinidad got word in June 2023 that he had been selected as a member of the Recording Academy and was cleared to vote for the Grammys. “When selected, they also recommended ways to get involved. It’s more than just a grant; there is community work, and there are ways to mentor upcoming musicians,” Trinidad said. Trinidad said there are two voting rounds to vote for a musician. The first round is called “for your consideration,” with literally 1000s of people per category. SEE TRINIDAD, P6

Most Sellers Don’t Know How to Interview a Listing Agent. Here’s Some Guidance.
Do you know what to look for in a listing agent, and the questions to ask during an agent’s listing presentation? You’ll probably want to know their level of experience, competence and success in selling similar properties, hopefully within your city or neighborhood. Like most people, not just Realtors, I monitor the real estate activity where I live, and I’m astonished how many homes are listed by agents I’ve never heard of. As I write, there are 70 active or pending listings within five miles of our office, represented by 66 different agents from 58 different real estate offices, only four of which are local to Golden. And despite practicing real estate here for 21 years, I only recognize the names of 18 of those 66 listing agents. Where did the sellers find all those different agents to list their homes? Many, I suspect, are friends and family — every agent’s biggest “competitor.” In other cases, the seller just went under contract or closed on their replacement home elsewhere and was convinced by that listing agent to list their current home. Don’t fall for that. It’s not the best decision if that agent is unfamiliar with your neighborhood, lives far away, and is unable to show the home on short notice, answer questions from buyers, or keep your brochure box well stocked. Or perhaps the agent sent a letter or taped a note to the homeowner’s door claiming to have a buyer for their home. It’s one of the oldest tricks in the book. The tactic got him or her an interview, in which the agent said that unfortunately the buyer found another home — but now the agent’s foot is in the door and the seller decides to list with him or her. Let’s say, however, that you want to
interview listing agents and make a rational hiring decision. Good idea? First, select two or three agents to interview based on their location and experience in your neighborhood. Second, study their active/sold listings to see (1) their geographic distribution and (2) how well their listings are presented on the MLS. To get an accurate history and profile of an agent you may need the help of another agent such as myself who has access to your MLS. You want to see each agent’s profile and their active, pending and sold listings. Do a web search of the agents you’re considering. Read their profile, if they created one. Look at their current and sold listings. Click on one or more listing to see how they described the home on the MLS. Did they list all the rooms, not just bedrooms and bathrooms, and did they provide dimensions and descriptions, or did they just enter the mandatory fields? Not all MLS fields are mandatory. For example, only half of those 70 listings I mentioned above indicate what direction the house faces, and 28 of them didn’t indicate whether or not there is fencing, both of which are optional fields. Only 20 of the 70 listings indicated whether it is in an incorporated or unincorporated location. Those and other non-mandatory fields provide information that is important to many buyers. Since they are searchable fields, your listing may not be found by a buyer who has one of those optional fields as a search criterion. Looking at an agent’s listings will answer the most important questions which you’d ask in person, but you won’t have to take their word — the truth is there in front of you. You’ll learn, for example,

This unit also comes with a reserved parking space (#30). A washer and dryer and private storage space are at the front of the common area.
whether they hired a professional photographer to shoot magazine quality photos or did their own point-and-shoot pictures, and whether they created a narrated video tour or just a slide show with music. Only 2 of those 70 listings (one of them mine) had the maximum number of photos uploaded to the MLS. And, although 37 of the 70 had URLs in the “virtual tour”
Keep in mind that the best indicator of how a listing agent will serve you is how they have served previous sellers. field, all but one of them were for either an interactive slideshow, a slideshow with a music track, or a gallery of pictures. The only one that was an live-action narrated video tour was my own listing! I’ve been doing narrated video tours for over 18 years and even gave a tutorial at my Realtor association to show other agents how easy it is to shoot and edit a video tour, yet I can only count on one hand the number of listing agents who are shooting videos now. It’s inexplicable to me why that is. Having chosen who to interview, ask these questions of those you invite into your home for an interview:
What commission percentage do you charge? Keep in mind, there is no standard commission. It’s totally negotiable, and the industry average is in the mid-5’s, not 6%. Will you reduce your commission if you don’t have to share it? Hopefully they include that in answering your first question. If you have to ask them, consider that a red flag. They hoped you wouldn’t ask. Only 17 of the 70 active or pending listings mentioned above indicate that they offer a “dual variable commission.” One of the things a fellow MLS member can research with their access to the MLS is whether that’s the established practice of the agent you’re interviewing. Will you reduce your commission if I hire you to purchase my replacement home? (Again, did they volunteer that, or did you have to ask?) Hopefully the candidate will have researched the market and will make a sound recommendation of listing price. Beware of agents who inflate their suggested listing price so you will list with them. When setting the appointment, ask the agent to bring a spreadsheet of their sold listings with dates, days on market, listing price and sold price.

So I think inflation is a top concern for a lot of my constituents. The price of food, electronics, housing. I think these are the things that my constituents are asking me to fight for. La Ciudad: Just this morning you were at the Capitol fighting for affordable housing. Housing Bill 24-1007 represents a significant shift in Colorado’s approach to housing policy by prohibiting local governments from enforcing residential occupancy limits not based on health and safety. Could you elaborate on how this bill was developed? What do you see as the most immediate impact on Colorado communities if it is implemented? La Ciudad: You had a positive outcome this morning. Rutinel: We certainly had some positive developments today that I’m excited to share more about. You asked, where this policy came from. Unfortunately, we are in the midst of a housing affordability crisis. Folks across the state are suffering from rising rents and housing costs. What we as legislators have decided to do is propose a series of policy solutions to help address the lack of affordable housing supply across Colorado. One of those proposals is the one that I’m championing. It’s about preventing cities across the state from imposing arbitrary and discriminatory occupancy limits that are based on whether you are related to the person that you want to live with. A few cities across the state say, you can only live with that person if they’re related to you. And that is unjust. It’s discriminatory, and it limits the amount of affordable housing supply. It’s a very simple bill, but it has a potential to have very large consequences in terms of expanding the amount of affordable housing. La Ciudad: Given the diverse economic backgrounds in Colorado, do you anticipate that this change will affect the housing market, particularly in terms of rental prices and housing availability? Rutinel: I think as soon as we end these very discriminatory occupancy limits, we’re going to see a large increase in the affordable housing supply right now. There are rooms in Fort Collins, Boulder and Denver, that are empty. We have empty rooms, and people want to fill them with friends or distant family members who may not share your same last name. And as soon as we pass this bill, I think we can anticipate a large increase in housing affordability. La Ciudad: With a considerable Latino population in Commerce City, many of whom are renters facing affordability challenges, how do you believe that HB24-1007 will address the specific needs of these families? Rutinel: So, Latinos, we like to live not just with our children, but also sometimes with our parents, our aunts, uncles, cousins. We like to live in multigenerational houses. And there’s a lot of good with that — you get to have caretakers for your children. La Ciudad: El tío, la tía, la abuela, el hermana, el primo, el amigo… Rutinel: Exactly. And so I think that Latino communities in particular are set to benefit from a policy like this, where now you’ll be able to live with distant family members or maybe friends that you are close with, or maybe new friends, so you can share the costs of housing.
La Ciudad: Finally, as a representative for House District 32, what initiatives or policies do you believe are crucial? Rutinel: I think there are many opportunities across health and economic justice and environmental protection that we can push for. Some of my policies that I’m bringing forward this incoming legislative session include not just this housing affordability bill, but also this large environmental justice bill that will help protect communities like Commerce City that havebeen the victim of corporate pollution across many decades. What this bill will do is allow communities to have local control over increases in emissions or permits. It’ll allow for somebody to be hired by the Colorado Department of Public Health and Environment so that they may regulate and put in place new regulations associated with petroleum refineries like Suncor. It will also provide for a rapid response team, to be able to report out to the community whenever there is an issue, and issue cumulative impact analyses to figure out what the problem is. What is the scope of the problem? What are the opportunities? How can we coordinate across different agencies to be able to protect these communities? So that’s one policy that I’m really excited about, and there are a few others that are tackling things like economic

justice, public health, and just general well-being. La Ciudad: We also had a special visit from activist and actress Jane Fonda. She came to Commerce City to see the people who are experiencing living there with toxicities and struggling because of the environmental issues. Do you think that in your lifetime, you will be able to make a difference? Because she’s nearly 90 years old, and she’s still fighting the fight. Do you think there will be changes to move toward sustainable energy, in your lifetime? Rutinel: There’s very little question in my mind that we’re going to move toward a more sustainable and just future for our environment and our public health. The question is when. And the reason why I think that it’s going to happen is because of solar, wind and other renewable energy sources are going to be not just cleaner and better for our public health, but also cheaper. It’s a matter of when we’re going to change. What I’m trying to do is make sure that we put the right incentives in place to help us ease into those transitions so that folks have the opportunity to take advantage of these new sources of electricity and energy so that we aren’t left behind. That’s what I’m trying to do. In terms of sustainable energy and just transition, it’s not a question of if but when. D IS C

Trinidad grew up in Brighton. He attended South Elementary, Vikan Middle School, and Brighton High School. He said his teachers helped guide his career. “The beautiful thread between those three schools is the top-notch music teachers. I didn’t go to any art school or Denver School of the Arts, but the education I got from my teachers growing up here was just as good, if not better; I was lucky,” Trinidad said. As a little boy, Trinidad loved music. He knew from the second time he picked up an instrument at 7- years old, that he’d found his niche. The first time, he’d picked up a saxophone. “I wanted to play the saxophone, but I couldn’t make a sound out of it. It was so hard. I remember the folks with Flesher-Hinton music company rented instruments in Denver; the guy was trying to help me make a sound,” Trinidad said. “I couldn’t. I thought I’d never played an instrument. I saw the trumpet on the way out and asked what’s that? I picked it up and made it sound.” Trinidad had an exciting journey with his trumpet and got serious about playing it early in his high school career. “My trumpet playing was important and made it into the high school honor bands,” Trinidad said. Trinidad said he had planned to attend school in Greeley at UNC but was rejected. “They said they didn’t see a music career in my life. I felt like quitting everything, and at 18, my path was carved out,” Trinidad said. He was glum when came to school the following week, and his band teacher asked him what happened. “He pulled some strings for me, got me to go to school at Western State College in Gunnison,” Trinidad said. “I even got some scholarship money to go. It was great. I didn’t stay at West-

It’s music you’d hear in a movie that is relaxing, spacey, echoing type trumpet,” he said. “I focus on a more creative approach with trumpet than what we’re used to.” That means he’s found new ways to expand his instrument’s abilities. “I connect my trumpet to guitar pedals, like what a guitarist would use,” he said. “I play through the microphone into the guitar pedals. And I get different sounds, such as an Echo delay.” Norway to ‘In November’
Trinidad got the idea for his first album, “In November” while he was touring the U.S. with a band. He and the group’s drummer spent a lot of time dreaming about their next gigs. “I told him I would like to record in Europe,” Trinidad said. “He said, ‘Do it!’ I said, it’s not that easy and he said, ‘Do it’. So I did it and booked a studio in Norway in 2016. While recording in Norway, Trinidad said he reached out to some of his favorite musicians, and they came, recording at this tiny rented house. “We lived together for three, four days, recorded an album, the house was near the ocean, water would like to hit the glass and watched icebergs, it was so beautiful, it was a dream come true,” Trinidad said. Trinidad said the recording did well. “It moved me into a new level, taking a risk and going out there to Norway; I didn’t make money from it but learned a lot,” he said. Trinidad’s next gig was in 2019; he was contacted by Arun Natarajan, Subcontinental Records label in Bangalore, India, who told him about an idea that he knew a famous electronic guy named Riatsu Umlaut. Natarajan said he would pay for them to work together. “We put out an album right before COVID called “Lithium” and later during COVID, put together another album called “Sleeping With My Worries. Trinidad said when he was in LA for the Grammys, the album “Sleeping With My Worries” was nominated nominee for Best New Age Album of the Year at the World’s Entertainment Awards on Feb. 2. Trinidad said they were invited to a party after the Grammys and saw one of his favorite jazz singers, Kurt Elling, performing. “While in Los Angeles, I got the opportunity to look up one of my favorite trumpet players, Arturo Sando-
val, and he invited me to his house; he’s an 11th-time Grammy Awardwinning musician. The Grammys were fun my highlight of the trip was meeting him,” Trinidad said. Trinidad has also recorded with Arun Natarajan with Sage Francis, Chicano Batman, Nathaniel Rateliff, Riatsu, Umlaut, and Bangalore, India.

Others applying under the tax growth-based eligibility can defer for as long as they own their home and reapply each year — as long as the amount being deferred does not exceed $10,000. For example, if you applied last year and were granted a $6,000 deferral and then apply again this year, only $4,000 more could be deferred. Under the program, homeowners don’t have to pay any portion of their deferred tax amount — including interest — so long as they continue to reapply, according to the Colorado Department of the Treasury.
“As long as the homeowner reapplies each year, they don’t have to pay until they don’t apply,” said Sheena Kadi, spokesperson for the department. The current deferral interest rate is 4.125%. That means after a year, the deferred tax amount will have grown by that percentage. Other criteria
