Despite being one of the oldest universities in the state, Colorado School of Mines has a fresh look. On Feb. 9, the university hosted a 150th birthday party in conjunction with the ribbon-cutting for the Labriola Innovation District. This kicks off a year of sesquicentennial celebrations, as the university will incorporate its big anniversary into E-Days, Homecoming Week and other annual events. Thousands of students, staff members and alumni packed the two-floor Labriola Innovation Hub to pick up commemorative mugs and T-shirts, say hello
to mascot Blaster, eat some birthday cake and see the new facilities. The district, which is behind the Mines Museum of Earth Science, houses several student project spaces, a metals shop, a wood shop, automotive garages, laboratories, classrooms and other work areas. The celebration doubleheader truly showcased the university’s past, present and potential, as Mines officials described, as Orediggers want to continue building a better world through their expertise, leadership and determination. Here’s an Innovative Approach to the Off-Site (aka Modular) Construction Industry
Every day I receive email newsletters about real estate, and one of my favorite is “Construct Utopia,” published by Pro Builder magazine. This week is not the first time I have written a column based on or inspired by an article in that newsletter. A common subject these days is modular or off-site construction. The latest Construct Utopia newsletter has an article about Cuby Technologies, a startup which devised a solution for customizable mass-produced prefab homes — mobile micro factories. Instead of constructing big factories that ship new home modules, Cuby produces micro factories that are set up near the construction site, such as in a field or on a rented parking lot. Modular construction is typically off site, but bringing the factory to or near the worksite is an interesting twist — perhaps call it “on-site (or close-by) offsite construction.” But the factory could also serve other build sites, functioning as a traditional off-site modular factory but one that is much closer. The micro-factory is shipped in about 10 containers, and it is set up inside an
inflatable tent that covers 30,000 to 40,000 square feet of interior space for creating the modules to be assembled on a nearby construction site. The idea is to eliminate one of the major costs of modular construction, which is shipping the modules great distances to the work site. I’ve been a fan of the idea of modular construction ever since I purchased what I thought was a stick-built home in the Mesa Meadows subdivision in north Golden. I bought the home in 1997. After moving in, a neighbor told me he had watched my home go up in one day, delivered from Ft. Morgan on flatbed trailers for installation on a prepared foundation. The interior work was then completed by Pat Foss, a local builder. The advantages of building the home in a factory, I was told at the time, was better quality control, including better insulation. The exterior walls were all built with 2x6 instead of 2x4 studs, to better survive flatbed transportation from Ft. Morgan. Above is an artist’s rendering of one
Colorado Environmental Film Festival Is Next Week! Every February, Golden Real Estate is delighted to co-sponsor the Colorado Environmental Film Festival (CEFF). It’s the only film festival of its kind, and you can attend in person Feb. 22-25, or you can buy a virtual ticket (which I’ll do this year, since I’m on a cruise) that allows you to stream most of the films for 7 days, starting Monday, Feb. 26th. This year's festival features 66 inspiring world-class environmental films, including screenings of feature-length and short films from foreign, Colorado and young filmmakers. Fifteen of the films are world premieres. Another 25 have never been seen in Colorado. From films like “Rhino Man” which tells the heroic story of South African rangers who risk their lives to protect rhinos from poachers, to informational shorts like “Fight Food Waste,” you’re bound to find several that will inform and inspire you. I’m looking forward to such films as “Silent Skies—The First Electric Plane Flyover,” “Single Use Planet,” a film about plastic bags and other single-use products, and “Atomic Bamboozle: The False Promise of a Nuclear Renaissance.” Previously, the festival has been hosted by the American Mountaineering Center at 10th Street and Washington Avenue in downtown Golden. This year it moves to the Green Center, a bigger venue on the campus of the Colorado School of Mines, a few blocks to the southwest. The Green

It reminds me of how Elon Musk built a tent for assembling the Model 3 next to the Fremont factory rather than wait for a brick-and-mortar building to be permitted and built. Neighbors of construction sites would probably appreciate having the construction of a new building or subdivision taking place largely indoors, even if it is just a tent, reducing the noise and dust of on-site construction. Construction in a tent has other advantages including protection from the elements, whether it be rain or snow or simply cold weather. Productivity would be greatly enhanced. Workers will appreciate working a predictable number of days and hours as well as being warm during the winter months. Making working conditions better could also address one of the biggest problems facing the home construction industry: attracting and hiring enough workers.
By completing the major structural panels indoors, the subsequent on-site finishing work can be made more attractive thanks to being able to “weather in” the building quickly. This too improves working conditions and recruitment. “Inside the dome,” according to the company, “machines and conveyor belts produce and prep all the elements of the home — windows, wall panels, plumbing pipes, drywall, HVAC systems, and so on — then package them into kits.” The enclosed environment also contributes to less waste and better waste management and recycling. Although Cuby promotes its micro factories for home building, it’s not a home builder. It sells the micro factories for $10 –15 million. Their customers are typically developers, builders, general contractors and private equity groups, whose customers might be midsize home builders. Cuby claims that it can lower the cost of new construction from $150 per square foot to $100 per square foot. Cuby is a startup that began in Belarus. Cofounder Aleksandr Gampel says the first micro factory is being delivered to Detroit shortly. Within the next decade he expects to produce 275 micro factories that will build 200,000 homes and create 300,000 jobs, removing approximately 750,000 tons of waste from the construction process.

There’s an “Eco Expo” with table displays throughout the festival, featuring environmental non-profits, government agencies, and vendors involved in all aspects of environmental sustainability. We may have a booth there ourselves, as we have in prior years. Consistent with CEFF’s mission to “inspire, educate and motivate,” it provides teachers of 4th to 12th grades with free inclassroom virtual access to festival films from March 1st through May 31st.

Beware of Scammers Pretending to Be Alerting You to a Scam
Fox 31 reported last week about a Golden couple that was scammed out of more than $137,000. It began with a phone call purporting to be from the Chase fraud department. Question every phone call, text message or email you receive. If that Golden resident had said, “Thank you,” then hung up and called Chase’s customer service number to see if there was a fraud alert on his account, he could have avoided being the victim of that scam. Golden Police extending four-day workweek pilot to July City looks to test 4-32 schedule in other departments BY CORINNE WESTEMAN CWESTEMAN@COLOROADOCOMMUNITYMEDIA.COM
After collecting six months of promising data, the City of Golden has decided to extend the police department’s four-day workweek trial to July 1. Since July 10, all full-time GPD employees have worked a 4-32 schedule — four days and 32 hours for the week — with no change in pay. On average, response times have improved and overtime is down 80% from the same period in 2022. Plus, employees’ satisfaction with the 4-32 schedule has been high, based on weekly surveys. The pilot was scheduled to end Jan. 1, but City Manager Scott Vargo and Police Chief Joe Harvey said Feb. 8 there was nothing in the data to warrant terminating it after six months. By extending the pilot to July 1, Golden will have a full year of data to examine. It’ll host a one-year update meeting from 5:30-6:30 p.m. Aug. 6 at City Hall. In the interim, Vargo and his staff are considering other city departments to join GPD in the trial

period, perhaps starting in April. Nothing has been finalized yet, as department heads are still discussing the practicalities and possible impacts of moving to a 4-32 schedule, Vargo said. He clarified that Golden won’t make any permanent changes to any department’s schedule until
2025 at the earliest. If any city department does permanently move to a 4-32 schedule, Vargo said it needs to be “rational and defensible,” and not have any major negative impact on the community. He also recognized that a 4-32 schedule won’t be practical for every job or department, ask-
ing, “How can we be fair with those employees that have to work more hours?” Vargo continued: “We have to work through those bigger policy issues over the course of the next several months.” SEE POLICE, P16

Colorado Environmental Film Festival runs Feb. 22-25 on Mines campus
The Colorado Environmental Film Festival will have a new venue this year, as it will host its annual inperson event Feb. 22-25 at Colorado School of Mines’ Green Center. It’ll also host an online film encore Feb. 26-March 3, with 60 films total throughout the in-person and online events. This year’s films address food waste, the Maui brush fires, disappearing rivers, regenerative cotton, cleaning the oceans, and other topics. In memory of K-9 Graffit, who was killed during a suspect ap-
prehension call last February, the Jefferson County Sheriff ’s Office is hosting a monthlong pet food and supply drive for the Colorado Pet Pantry. The nonprofit provides temporary food supplies to Coloradans’ pets, helping families take care of their pets rather than putting them in shelters. The priority needs are dry adult dog food and dry adult cat food. Other items that can be donated include: canned food for dogs or cats, cat litter, treats, toys, leashes and other accessories. Items should be new and unopened. They can be donated through Feb. 29. To participate, drop off any donations from 9 a.m.-4 p.m. Monday through Friday at the Sheriff ’s Office headquarters in Golden.

Jordan Obernesser had just started his freshman year at Golden High School and was excited to try out for the boys soccer team. But, just as the season was gearing up, Jordan felt an intense pain in his
right leg. He and his family visited the doctor, where Jordan was diagnosed with bone cancer. “The world as we knew it stopped,” his mom, Kari Obernesser, said. Jordan spent much of his freshman year in the hospital, and ultimately had part of his right leg amputated. With the community’s support, Jordan and his family persevered, and he’s been cancer-free for nine months. Now a sophomore, Jordan joined his fellow Demons Feb. 5 for the school’s annual Wish Week assembly as this year’s featured Wish Kid. SEE WISH WEEK, P8

From chicken wings to Hawaiian shirts, from jars of pennies to rubber ducks, the Golden High School Demons are all-in on this year’s Wish Week. The seventh annual event is partspirit week, part-fundraiser with GHS, its partner schools and the larger Golden community supporting MakeA-Wish Colorado. In its first six years combined, Golden’s Wish week has raised $219,000 for the nonprofit — enough to grant 29 wishes. This year’s featured Wish Kid was the Demons’ own Jordan Obernesser, and each day’s theme — like Colorado Day and Shipwrecked Day — was based on his favorite things. Wish Week organizers set a $32,000 goal this year, and hoped having a fellow Demon as this year’s Wish Kid would provide extra motivation and donations throughout the week. It certainly did for sophomore Matt Zahn, who raised $1,700 for the Feb. 7 wing-eating competition. Zahn raised the most money of the five competitors, and thus had to eat the least-spicy wings. After competing in last year’s wingeating contest, Zahn had his heart set on doing better this year. He knew that, because Obernesser’s a fellow sophomore, he had to step up his fundraising efforts for his classmate’s sake. Zahn said Wish Week is his favorite time of the school year, as the funds raised support a great cause. He believed the Demons put more energy into Wish Week versus something like a general Winter Homecoming Week. Junior Noa Morgan, who’s on the student council, felt similarly. She said Wish Week was a more communityoriented event versus a Winter Homecoming Week. Plus, the philanthropic side gives the students and the community “something to really root for.”

Every winter, GHS celebrates Wish Week with spirit week-type activities to fundraise for Make-A-Wish Colorado. As part of the event, the school highlights a child from Make-AWish Colorado, and bases the week’s events and decorations on the child’s wishes and favorite things. This year, organizing students and staff members used Jordan’s love of soccer and Team USA as inspiration. This is the first time the school’s featured Wish Kid has been one of its own students, Jordan’s wish coordinator Capri Goldsmith said. “We’re thrilled Jordan gets to be a wish kid at his own high school,” she continued. “ … It makes (the students) feel more connected to our mission when the Wish Kid is their classmate.” Jordan thanked the student council members for helping put the Wish Week events and decorations together, and asked everyone to help support an organization that grants hundreds of wishes each year. Although the money won’t necessarily support his wish — to attend the 2026 FIFA World Cup finals — he said it’ll go toward funding other children’s wishes. Kari recalled being in the hospital for Jordan’s treatments and seeing other children going through similar experiences. She emphasized “how
strong these kids had to be” during their cancer treatments, and said having their wishes granted “helps keep (them) mentally strong.” Jordan added: “It gives them something to look forward to.” Goldsmith said there are 450 young Coloradans waiting to have their wishes granted. Meanwhile, more than 200 Colorado schools like GHS host Wish Weeks and other annual fundraisers. In its first six years of Wish Week, Golden has raised $219,000 for Make-A-Wish Colorado — enough to grant 29 wishes, Goldsmith confirmed. The school hopes to raise more than $30,000 this year, and Goldsmith said she was grateful for the community’s support as Wish Week grows bigger each year. Kari and Dan Obernesser thanked their family members, friends, neighbors and other community members for supporting Jordan and their family since he was diagnosed, and hoped that “amazing support” would continue for Make-A-Wish Colorado. Jordan said being this year’s Wish Kid was “cool” and “unique” because he gets to champion the organization at his own school. He recalled how he couldn’t participate in after-school events during last week’s Wish Week because he was still in treatment, but was looking forward to it this year. Longer-term, he’s excited to attend the World Cup in summer 2026, saying, “I’m a really big soccer fan … (so) going to it will be an incredible experience.”

VOICES A privileged life
F
rom climbing trees to heights to hitchhiking, risk-taking was part of my growing years. By the standards of my immigrant grandparents though, my derring-dos were hardly perilous. Nevertheless, I inherited that gene from them. Like they did, I migrated from the place of my birth in search of a better life. I found it in Colorado despite there being no guarantees I would. I had a vague dream, a gut feeling and an itch that needed to be scratched. Living with risk was a regular part of daily life for my grandparents from the day they launched themselves from nineteenth-century Eastern Europe. Believing in the promise of America, they flocked to America in search of opportunities
denied them in their native lands. Instead of amber waves of grain however, the men found themselves eking out a subsistent existence as they burrowed into coal mines or baked in the steel mills of Western Columnist Pennsylvania. The women valiantly toiled 24/7 in the squalor, scrubbing, cooking, sewing and raising the children. My family’s story is one of thousands differentiated only by the particulars, one that is being reenacted today by others coming

in search of better lives for themselves and their families. I remain in awe of their courage, forsaking all they’ve known and risking their lives so to get the blessings of liberty the Preamble speaks of for themselves and their children. It is through that grandson-ofimmigrants perspective I view much of what is unfolding today. It is through the lens of a child of a blue collar, skilled craftsman and a mother who, like her mother had, clawed out a borderline existence for her children after her husband and the family’s breadwinner — my father — died tragically while she was carrying her thirteenth child. It is why I find substantive literary characters, real ones like Joe Rantz
in “The Boys in the Boat” and fictional like Sethe in “Beloved” and Tom Joad in “The Grapes of Wrath,” heroic and dismissive of shallow, well-to-do characters, like Daisy and Tom Buchanan in “The Great Gatsby,” who don’t know what hard work is, have never sweated, baked or froze trying to make a living, have never had their hands coarsened with blisters and calluses, and haven’t experienced hunger, wondering if they could make rent, pay for their utilities, and buy groceries to feed their children, yet flaunt their wealth so to win the affectations of the masses in an attempt to give substance and meaning to their vacuous lives. ‘You Got Older’ tackles grief, forgiveness

rief is an especially difficult emotion to deal with. There’s no such thing as a right way to move through it — each person has their own journey. Even when we think we see it coming, that often doesn’t help. Such is the case in “You Got Older,” which is making its regional premiere as the Benchmark Theatre’s first production of the 2024 season. The show delves into grief and loss in a way that is both funny and tender while remaining achingly human. “It’s a really lovely script and very Benchmark,” said director and artistic director Neil Truglio. “Because it is so human, it delves into some really complicated corners of human intimacy.” Written by Clare Barron, “You Got Older,” runs at the theater, 1560 Teller St. in Lakewood, from Friday, Feb.

The themes of illness and anticipating grief are universal ones all people wrestle with. “All of us are dealing with something like this on some level. We all know somebody who is sick,” Truglio said. “It’s natural to think about that loss and how it will affect us. So, we’re grieving a bit for someone who is still alive.” The kind of searching humanity that exudes from the story is what makes it the perfect fit for the theater and while grief may not be something most like to think about, the hope is audiences come away with a more empathetic perspective on the topic.

Richard Smart Culver, age 86, a resident of Newbury Court in Concord, MA, formerly of Binghamton, NY, passed away on February 5, 2024. He was the beloved husband for 61 years of Margaret Harriet “Smuggles” Culver. He was born in Berkeley, CA on July 26, 1937, as the son of the late, Joseph Simpson Culver and Ella Elizabeth (Smart) Culver. Dick spent his first five years living in California, after which his family moved to Oak Ridge, Tennessee where his father was one of the first engineers to work at the Oak Ridge National Labs. Dick was a member of the first graduating class from the newly founded Oak Ridge High School. He worked in the Oak Ridge Labs while obtaining an undergraduate degree in Mechanical Engineering from Vanderbilt University where he was class valedictorian for the School of Engineering. Subsequently, he earned a master’s in Engineering Mechanics from Stanford University in 1960, and his PhD in Mechanics of Materials from Cambridge University in Cambridge, England in 1964. A Professor of Mechanical Engineering and Professional Engineer, Dick led a distinguished multi-national career in research and education, including roles as a Professor at Ahmadu Bello University, Nigeria and University of Calgary, Canada. At the Colorado School of Mines, Dick served several years on the Engineering faculty and as Dean of Students. Dick’s longest professional stay was at Binghamton University, in the Thomas Watson School of Engineering where he was the inaugural Associate Dean of Academic Affairs. He spearheaded the establishment of the Watson School’s nationally renowned lower division program from 1994 to 2000 and retired as Professor Emeritus in 2007. A passionate pioneer in engineering education, Dick understood the imperative of nurturing the holistic growth of students within the engineering curricula. He also enjoyed singing with the Binghamton Downtown Singers for over thirty years. In the 1950s, Dick’s family built a cabin on Watts Bar Lake in Rockwood, Tennessee where Dick and his brothers were avid trick water skiers. In later years, Dick and Smuggles enjoyed gathering “at the lake” with extended family for annual summer
vacations, and where Dick continued stunt skiing into his seventies. Dick was a lifelong skilled craftsman and artist who enjoyed drawing, woodworking, and stained glass. As a child, he built balsa wood and tissue paper model airplanes with which he won many flight competitions including holding a national record for indoor handlaunched gliders. He designed and built many things from furniture pieces to the family home in Golden, Colorado. In later years, he developed an extensive portfolio of original stained glass designs. Several of his pieces have been shown in galleries and are installed in homes and buildings in Binghamton. One of his later pieces hangs in the North Lobby at Newbury Court. Dick and Smuggles built lifelong communities of close friends who shared international travel, cycling, skiing and celebrations for decades, including a group from Cambridge University who call themselves the Blackbirds. Dick was a loving, kind, unassuming, and tirelessly helpful husband, father, and friend. He will also be remembered as a creative problem solver and master of the home project. In addition to his wife, he is survived by four children, Joseph Culver and his wife Mary of St. Louis, MO, Robert Culver of Durango, CO, Thomas Culver and his wife Polly of Amherst, NH and Kande McDonald and her husband Michael of Concord, MA, along with seven grandchildren, Easton, Owen, Audrey, Hannah, Marlena, Eliot and Naomi, and three brothers, Ed Culver of Maryville, TN, David Culver and his wife Ginny of Columbus, OH and Gene Culver of Maryville, TN. He also leaves behind several nieces and nephews. n the back of your mind, you might recall fond memories of your parents taking you to the park — or school programs busing you to faraway nature scenes. And in the bustle of adulthood, getting outdoors may have become less of a priority in your daily schedule. But the benefits of viewing and spending time in nature go deeper than the proverbial “getting some air.” In fact, it can lower blood pressure and is linked with lowering levels of stress, depression and anxiety, according to the National Park Service. One easy way to capture those benefits is hiking, a word that conjures images of mountains and rugged dirt trails. And in Colorado, chances are you’ve met someone with a “hiker” persona:

lots of gear, often heading out on weekends, probably driving a Subaru. But hiking doesn’t have to be so extreme. It doesn’t even have to involve big hills. In the purest sense, it’s just a long walk for pleasure or exercise. And if you live in any of the counties around Denver, the good news is you’re never far from a hiking spot. That includes places with breathtaking views in Douglas County. “Most Douglas County staffers will tell you that the open space that they like best is the last one they got to hike,” said Dan Dertz, director of Douglas County’s open space office. From Georgetown in the mountains to the plains of Elbert County, here’s a look at hiking spots for beginners and seasoned veterans alike — and some tips if you’re new to the activity. Douglas County
If you’re just starting out, one of the easiest
hiking trails in Douglas County is Bluffs Regional Park, Dertz says. Just a few miles from Park Meadows mall, Bluffs Regional Park offers sweeping views of the mountains and the Denver metro area. It’s a short drive south of Yosemite Street and Lincoln Avenue near Lone Tree. If you’re seeking high elevation and more of a challenge, try Spruce Mountain Open Space Trail. That’s off Spruce Mountain Road south of Noe Road, west of Interstate 25. There are no costs for parking or access at those hiking spots. Jefferson County

There, you can brave a 2,100-foot elevation gain from the Stagecoach Boulevard trailhead to the 9,708-foot Bergen Peak, according to Jefferson County Open Space. As city officials have described previously, Golden Police Department was chosen to test the schedule because it already collects productivity data that could serve as a baseline. It’s also a “microcosm of city government,” as Vargo has described, with various shift schedules and work environments. Vargo emphasized during a Feb. 8 meeting that the trial is focused on a compressed and efficient workweek, “not working less and doing less.” GPD employees have focused on cutting down the number of and the length of meetings, and streamlining their activities while they’re at work, he said.

With the pilot extended to July, Vargo said the city will continue monitoring GPD’s data, including the amount of sick time taken, the flexibility of schedules and remote work, and its team environment. In identifying any cost savings, Vargo said the 80% reduction in overtime has already saved the city $115,000 as GPD employees worked 1,800 fewer overtime hours than July through December 2022. There could be additional cost savings on the recruitment and retention side, with Vargo believing a 4-32 schedule could save the city hundreds of thousands of dollars in hiring, retraining and lost productivity. Vargo and Harvey noted GPD had 50% fewer retirements and resignations during the six-month pilot than the previous year, but they said that’s “very circumstantial.” Vargo added: “We can’t say we’ve dramatically (improved) our retention, but it didn’t triple either. Colorado hits Suncor with $10.5m settlement BY MICHAEL BOOTH THE COLORADO SUN
Colorado has issued a $10.5 million penalty on the Suncor refinery in Commerce City over three years of air pollution violations, calling it the largest-ever action against a single facility, and also settled a suit resulting in a doubling of fenceline monitoring at the troubled fuel plant. The agreement surpasses a $9 million deal in 2020 for similar releases. Colorado director of public health Jill Hunsaker Ryan called it a “historic enforcement package” to “demonstrate our unwavering commitment to environmental protection and the health of our residents.” “We will continue to use every tool available to prevent Suncor from having future violations,” Hunsaker Ryan said. The $5 million in required plant improvements in the 2020 settlement have made a measurable difference in Suncor violations since then, and the new settlement requires $8 million more in plant changes, she said.
The new $10.5 million settlement includes a $2.5 million cash fine, which will be split between environmental justice grants and the general fund. The violations lasted through June 2021. The Colorado Department of Public Health and Environment investigates Suncor violations on a two-year cycle, and is still probing air pollution releases from the past two and a half years, said Michael Ogletree, director of the department’s Air Pollution Control Division. With Canada-based Suncor reporting $2 billion in profits from the third quarter of 2023 alone, “it’s a really good question” whether a $2.5 million fine is enough to change Suncor’s behavior, Hunsaker Ryan said. “What I would say is, we are limited in the penalties that we can assess by law,” she said. It’s also important for the state to protect the community by reaching a reasonable settlement “that’s not going to drag out a long time, but get some meaningful action,” she said.
The settlement is not part of Suncor’s application for a renewed air pollution permit for part of the sprawling Commerce City refinery, which is still pending revisions at the state health department. State officials said the violations from July 2019 through June 2021 often involved power disruptions. Violations cited include: - Exceeding EPA and state emissions limits on sulfur dioxide, carbon monoxide and nitrogen oxides. - Exceeding hydrogen sulfide concentration caps. - Exceeding opacity and visible emissions standards. - Violations from causes other than power outages. Suncor, the only vehicle and airplane fuel refinery in Colorado and one of the few in the West, has long been a target for environmental and community groups, as well as state regulators, for both local pollution violations and greenhouse gas emissions. Suncor has responded that it has made continual improvements to both refining and monitoring equipment to better protect the community, and that the plant is an important economic engine for the neighborhood and Colorado. A fire at the refinery in December 2022 disrupted operations for months, and may have contributed to an increase in fuel prices for

Forest Service seeking comments on old-growth logging restrictions
The latest settlement also include a deal for more intensive fenceline monitoring and community alerts about air pollution releases in Commerce City. A 2021 state law required Suncor and three other large facilities to implement fenceline monitoring of certain toxins and sharing data with the public. Suncor had sued the state in 2022 over
how Colorado was applying monitoring regulations to the refinery. The deal will have Suncor doubling the number of monitors from its latest proposal to the state, officials said. Suncor will also expand the number of toxins monitored from the minimum list in the 2021 law. Colorado had required covered facilities to monitor and alert for hydrogen cyanide, hydrogen sulfide and benzene. Suncor has agreed to also monitor toluene, ethylbenzene and xylenes, state officials said. Suncor will also alert the public
sooner than previously required when certain pollution thresholds are crossed, Ogletree said. For some compounds, alerts were triggered when releases hit the EPA’s more stringent one-hour thresholds for certain toxins. By the end of 2024, when the monitoring equipment

The move announced last month would put restrictions on harvesting within a small fraction of lands managed by the U.S. Forest Service. Josh Hicks, conservation director for The Wilderness Society, sees the proposal as an important step to conserve the remaining 8% of oldgrowth forests so they can do what they do best: store carbon and stabilize ecosystems. “After centuries of logging, and
now more recently climate-driven impacts from severe wildfire and drought, there’s not a lot of old growth left in the country or in Colorado,” Hicks pointed out. “It’s just a fraction of what it used to be.” Forests absorb carbon pollution directly from the air, and are seen as an important tool for mitigating climate change. But industry groups worry the proposal will prompt lawsuits aiming to block logging projects, including those seen as necessary to reduce the scale of wildfires. The program does not exempt homeowners from paying taxes but, rather, serves as a loan that a homeowner pays later. Seniors and active military can defer for as long as they own their home and they reapply for deferral each year. Others applying under the tax growth-based eligibility can defer for as long as they own their home and reapply each year — as long as the amount being deferred does not exceed $10,000. For example, if you applied last year and were granted a $6,000 deferral and then apply again this year, only $4,000 more could be deferred. Colorado’s deferral program has traditionally helped seniors and active military personnel, but it was expanded last year to provide relief to homeowners affected by increased property taxes for the tax years including and between 2020 to 2023. (2023 property taxes are what you’re billed for this year.) The application period closes on April 1. Homeowners who aren’t seniors or active military can apply under different criteria — they’re eligible if their property taxes increased above what the program calls a “growth cap.” The tax-growth cap is met when the current year’s property tax amount has increased 4% or more compared to the average of the two

Opponents looking to take down the Colorado School of Mines wrestlers on their home mat should receive a warning beforehand: “Count the Orediggers out at your peril.” On Feb. 8, the Mines wrestling team hosted CSU Pueblo for a home dual, with a rowdy crowd of fans yelling from the darkened stands. With their encouragement, the Orediggers battled back from a 17-9 deficit, as its final four wrestlers helped them win 24-17. The Orediggers, who are now 7-2 overall and 5-2 against conference opponents, hope to close out its 2023-24 home season undefeated with its Feb. 15 Senior Night dual against Canada’s Simon Fraser. After that, they’ll prepare for the NCAA Division II regionals March 2 in Pueblo. Any qualifying Orediggers will advance to the NCAA Division II national championship March 15-16 in Wichita, Kansas. Ryan Cody, a redshirt sophomore who won his 197-pound match Feb. 8, said he couldn’t believe Mines only had a month left in its 2023-24 wrestling season. After five consecutive away duals in January, he felt Mines was building muchneeded momentum in its February home duals. “We’ve really put it together near the near the end of the season,” he continued. “We’re ready to gear up for regionals.” Against CSU Pueblo, Mines started on the backfoot, as it was missing two starters and had to forfeit the 125-pound match. So, CSU Pueblo already had a 6-0 lead when the first official match started. Mines’ missing starters were expected to return for the Feb. 15 Senior Night dual, Coach Austin DeVoe said. But, starting at a deficit isn’t something the Orediggers are used to, so DeVoe was proud of his wrestlers’ indomitable spirits. “It was pleasant to see the guys just claw and scratch and fight all the way back, for a pretty exciting end to the dual,” he said. Both DeVoe and Cody praised Mines’ young wrestlers, including four true freshmen in the Feb. 8 lineup, who stepped up against the ThunderWolves. DeVoe hoped they could help Mines win its first conference title since 2019-2020 and help give their departing seniors a final home win on Feb. 15. “I’m just happy for these guys to be able to compete the way they do, at home in front of a good crowd,” DeVoe continued.

Gig workers are employees, Denver auditor says BY TAMARA CHUANG THE COLORADO SUN
More than 3,000 temporary workers serving food or cleaning hotel rooms are employees, not gig workers, and should be treated as such, the Denver Auditor said in a decision that seeks more than $1 million in penalties against two staffing agencies. Instawork and Gigpro, which specialize in hourly workers for the restaurant and hospitality industries, call the workers “independent contractors,” but the jobs that the companies fill run counter to that term and fall under what the state law defines as employees. The companies also were accused of numerous unpaid wage and overtime violations, and failing to provide sick leave. “You can’t be a dishwasher in a restaurant and be an independent contractor,” Denver Auditor Timothy O’Brien said. “That defies logic.” Both companies provide mobile apps for the temp workers to apply for openings. The business clients pay Gigpro or Instawork directly, not the worker. And both companies take an extra fee as payment. Neither company withholds taxes or pays for unemployment insurance for the worker — that’s left to the individual worker. But like permanent employees, temps go through a vetting process, confirm shifts a day in advance, meet requirements like dress codes, go through something akin to performance reviews and can be terminated based on the company’s discretion. An independent contractor, on the other hand, has a contractual agreement that “prevents consequence-free termination because ending such an agreement early and without cause gives
rise to damages.” “Instawork does not operate as a passive online marketplace where clients merely post shifts and receive responses from — potentially — the entire body of users. Instead, the employer takes direct action to ensure compatibility for its business clients by ‘automatically’ and ‘intelligently’ (matching) businesses with our vetted pool … of workers,’” the auditor’s order said. San Francisco-based Instawork received the brunt of the fines — more than $820,000, most of which came from 13,195 violations of failing to provide sick leave. They also must pay another $275,516 in restitution to nearly 3,000 workers. Gigpro faces about $50,000 in fines and restitution to about 90 workers. The companies were ordered to cease and desist from misclassifying workers and have 30 days to comply. In an email, Kira Caban, Instawork’s head of strategic communications, said, “Instawork is coordinating with the City of Denver to address an incomplete and nonfinal administrative determination issued by Denver Labor. While the company does not comment on active investigations, Instawork prioritizes compliance with applicable regulations and is committed to ensuring every person who uses our platform to find local work receives full and proper worker protections including payment at hourly rates that meet or exceed the minimum wage.” In Colorado, staffing agencies are employers that supply the temporary placements to a second employer and that is how a company like Instawork operates, O’Brien said. manently, they must pay a “direct hire fee” to Instawork. The auditor’s office did not share which hotels or restaurants had worked with the staffing agencies because it’s considered confidential. A new wage-theft ordinance was passed last year in Denver giving the auditor’s office the ability to proactively conduct investigations. “We don’t have to have a complaint to go forward,” O’Brien said. “We know that in the hospitality industry, workers are subject to abuse, for
lack of a better term, from employers.” His office has aggressively gone after wage theft, which can happen after the minimum wage increases and Denver employers don’t raise wages accordingly. Last year, the auditor’s office said it recovered more than $2 million owed to workers. This story was printed through a news sharing agreement with The Colorado Sun, a journalist-owned nonprofit based in Denver that covers the state.
