For anyone who’s worn weights or used resistance bands in their workout routine, the experience is entirely different once the burden is gone. Not only is it easier, lighter and faster, but ideally one’s muscles are stronger for it.
Intermountain Health sta members expect something similar will happen once they move into the new hospital near Interstate 70 and 32nd Avenue.

Ives in June 2024,” Case said. “FRH is currently welcoming 50 new households to these units that are beautiful, durable, environmentally friendly and service-enriched.”
According to Case, the space adjacent to Phase I of the Ives is still in the beginning stages of development.
“While there is no currently approved site plan or building permit for a second phase of units, we look forward to bringing forth a proposal that will be aesthetically consistent with the rst phase,” Case said. is plan includes larger units. Case said the rst phase consisted
entirely of one-bedroom units. e second phase will have one-, twoand three-bedroom units for families.
Before it can begin the site, approvals and permits for Phase 2, Foothills Regional Housing must secure funding. at’s why the housing agency needs a $1.9 million bond from the city.
“Foothills Regional Housing appreciates the support of the City of Wheat Ridge in allocating FRH its federal private activity bond volume cap to this important development,” Case said.
e agency deputy CEO also wants residents to know that neither the city nor the residents will bear the burden of the debt from the bond.
“An allocation of volume cap by a
municipality does not obligate the unit of local government to repay any debt issued subject to this cap, nor does it reduce the city’s nancial resources,” Case explained. “Rather, it allows community bene tting projects such as a ordable housing to issue debt at a tax-exempt rate that makes these undertakings more nancially feasible and meets federal requirements for the generation of equity investments.”
According to Case’s presentation at the July 8 city council meeting, e Ives 2 needs about $20 million to complete. She explained that the private activity bond allocation was given to the city of Wheat Ridge to help fund large projects that bene t the community. With the allocation, Foothills Regional can issue bond debt to help pay for the project. According to Case, the agency will pay the debt back, not the city or city residents.
Case said that Wheat Ridge had until September 2024 to assign its allocation, which expires then.
Wheat Ridge’s bond allocation is only part of the project’s funding source. Foothills Regional received bond allocations from the city of Golden in 2023 and Je erson County in 2022.
Case said the Ives Phase 2 would “provide larger units for families and continue to support the city’s vision of reimaging the Wadsworth corridor as a transit-oriented urban center, taking advantage of workforce opportunities and green space such as Apel-Bacher Park.”
On July 22, at the regular meeting, the Wheat Ridge City Council will hold a third reading of the resolution to allocate a $1.9 million bond allocation to Foothills Regional Housing. For more information on the assignment and the project, visit wheatridgespeaks.org.

Many Homeowners Don’t Understand Title Issues, Which Can
Lead to Big Problems Later on
Our office hosted estate lawyer Dan McKenzie at last week’s office meeting, where he shared some horror stories about homeowners who made mistakes in the execution of deeds on their property.
It’s important to understand the difference between “joint tenants” and “tenants in common.” Most married couples hold title to their home as joint tenants, meaning that both of them own the whole house, and if one dies, the surviving spouse still owns the whole house by himself or herself. Tenants in common own part of the house, typically but not necessarily equal parts. When one of them dies, the heirs on the deceased party inherit that part of the house. The problem arises when that new relationship may not be a friendly one.
When a single person owns their home by him/herself (“in severalty”) and wants to add a lover or spouse to the title, a “quitclaim” deed is used to accomplish that, usually with zero dollars exchanged. For example: John Doe quitclaims his home to John Doe and Jane Roe. Dan told us of a case where John Doe mistakenly quitclaimed his home to Jane instead of to both of them, leaving him off title. When she died, her heirs inherited the house, not him. Because they weren’t married and he wasn’t in her will or on good terms with her heirs, it created a real problem reclaiming his former home.
A common mistake is for a homeowner, whether single or a couple, to put their heir(s) on title as joint tenants so they would instantly own the home when they die. The problem with that

approach is that the value of the home is not “stepped up” at death. You want to will the home to your heirs or create a “beneficiary deed” so that the value of the home is stepped up to the value at the time of death. Otherwise, the heir could owe a significant amount of capital gains tax. If that heir sells the house soon after inheriting it, the capital gains tax would be close to zero.
In a beneficiary deed, you name the person who is to inherit the home, independent or outside of your will. Thus, the transfer of ownership is automatic at your death without that tax liability.
A “life estate” is a special kind of deed that allows you to sell your home while you’re alive, but not have to vacate it until you die. When my brother died ten years ago, my sister-in-law (his
widow) was able to sell their farm to a buyer who gave her a life estate, allowing her to live free (except for utilities) in the farmhouse until her death many years later. The buyer got full use of the rest of the farm during those years, so it was a win/win.

We’re Seeing More Active Listings & Price Reductions
Like us, you’ve probably noticed that there are more homes on the market — and that there are more price reductions on listings before they go under contract. The evidence is right on this page, with the price reduction featured at the bottom of this page.
I always like to quantify my observations, so here are two charts I created from REcolorado, our Denver MLS.
After several years of low inventory, we saw jumps in active listings as high as 72% year-over-year this May.
REcolorado doesn’t provide statistics on price reductions prior to homes going under contract, but that information can be imputed from the chart below.
January and February of this year actually out-performed the same two
months in 2023, ultimately selling for a higher percentage of the original listing price. However, June and July of this year show that the average listing went under contract for its full listing price, but only because the price had been cut.

Lutheran Medical Center, a Level II trauma center located at 8300 38th Ave., has served Wheat Ridge and the surrounding communities for more than 100 years. Because it was built out over the years, there are many ine ciencies on the campus, o cials have explained.
For instance, the helipad is located away from the main building, patient rooms are not consistent in size, and it’s hard to get internet service because of the buildings’ structure.
e new Lutheran Hospital campus at 13155 West 40th Ave., which is inside Wheat Ridge city limits but adjacent to unincorporated Je erson County’s Applewood area, was designed with modern and forthcoming technologies in mind.
Andrea Burch, president of Lutheran Hospital, said its layout and features were designed to maximize e ciencies among sta members and improve patients’ experiences and outcomes.

can easily be transported down to the emergency room. Burch added that, because much of the design process happened during the COVID-19 pandemic, o cials made sure Lutheran Hospital would meet demands during the next pandemic. Lutheran Hospital is also more centrally located for patients, especially those from the mountain communities. Its location is close to several major thoroughfares, including I-70, providing more convenient access for emergency responders and patients.
Overall, it will have 226 licensed inpatient beds across six oors, with
the helipad on the seventh.
‘Our community needs this’
Dr. Kathy Crabtree, assistant chief medical o cer, has been working at Lutheran Medical Center for more than two decades. She rst started there as an emergency room tech when she was 18, so she said leaving the current campus will be “bittersweet” because of the memories she’s made there.
However, she was excited to see the new hospital open, saying, “Our community needs this.”
Crabtree expected employees and patients alike would appreciate the
spacious patient rooms, technology upgrades, state-of-the-art operating rooms, and other features. Overall, she expected care would be more efcient and faster.
She added how Lutheran Medical Center already has a very low employee turnover rate, which she believed translates to better patient care. So, once it’s open, she believed Lutheran Hospital would reach new heights in that regard.
During the July 20 ribbon-cutting ceremony, Wheat Ridge Mayor Bud Starker said Lutheran Medical Center has been a vital part of the city for more than a century. He said community members have ideas for the current campus once it’s decommissioned, describing how it might help meet housing and other community needs.
As for Lutheran Hospital, Starker said the Wheat Ridge community was excited to start a new chapter there on Aug. 3.
Burch said Lutheran Hospital wouldn’t have been possible without thousands of people working together — from Intermountain Health employees to local o cials to community members. e project has been in the works for ve years, including three years of construction, and cost approximately $680 million.
She thanked everyone for their continued support, saying, “You can’t pull o something like this alone.”

Chatfield State Park visitors log hundreds of trips on new e-bikes

It’s only been about a couple months since Colorado o cials launched an e-bike rental program at Chat eld State Park. Since then, Chat E-Bikes cyclists have logged 387 trips and 543 miles.
e tally left the governor boasting about the new program.
“Outdoor recreation is the cornerstone of a fun summer in colorful Colorado,” Gov. Jared Polis said in
an address at the state park. “E-bikes reduce tra c and pollution while saving people money and time.”
Park visitors can rent the e-bikes to explore the state park or just cycle around the reservoir by scanning the Chat E-Bikes QR code at the station. It costs $1 to unlock the bike and 25 cents per minute to use.

Police departments across the state embrace the technology

ere are some new members of the force at the Wheat Ridge Police Department, and they have that unmistakable buzzing sound of propellers.
Like many other departments across the state, the o cers have embraced drone technology.
On July 17, o cers were behind headquarters on 29th Avenue, lighting up one of the department’s three “birds” and sending it zooming into the blue sky in preparation for use at an upcoming event.
Lucas Hunt is the commander for the drone program and oversees police o cers in building searches, missing persons and in special events.
“It helps us cover more area and is really a force multiplier,” Hunt said. e drones were purchased in December and programs began in earnest in the spring.
“It’s really an extension of what we’re already doing,” said spokesman Alex Ross. “It’s incredibly help-
building, where the drone searched the premises, found exactly which area the man was in, and gave ocers a sense of what to expect when they entered the building. While the man refused to leave initially, the situation did not turn violent.
“ e o cers have more information to determine how to approach a situation,” he said. “But I’d much rather have someone shoot the drone than our people.”

According to a recent report from radio station KUNC, more than 1,400 law enforcement agencies across the country are using drones, according to the American Civil Liberties Union. e Denver Post reports at least 20 departments are using them in Colorado.
Ross noted that reaction to the use of drones has been mixed, which is why he’s taken extra e orts to be transparent with their use. He posts drone videos on Facebook and how they’ve helped o cers — and sus-

“ ere’s a fear that it’ll be like 1984; I’m trying to dispel that,” he said. “We have a policy that we will not use the drones in a place where people have a reasonable expectation of privacy.”

Unlike the rules surrounding police bodycams outlined by SB217, the Enhance Law Enforcement Integrity act that passed the Colorado legislature in 2020, o cers are not required to start recording unless they decide to use the video for evidence.
“It’s a live surveillance tool. If we believe there’s criminality involved, we start recording,” he said. Ross makes it a point to share on social media what they get from drones, unless it is tied to an active criminal investigation.
“We are not just Big Brother in the sky,” he said, “but the applications to use them are fascinating.”
‘Manny for Us’ takes a hilarious and unique look at love and aging

e production is written by local playwright James “Jim” P. Hayes and directed by the company’s executive director, Maru Garcia.
“Manny for Us” is a lively dramedy that explores the complexities of aging as a couple. However, the story of Pete and David has the added perspective of gay men navigating aging in today’s world.
e play is a new endeavor for Hayes.
“I was an attorney from California. I moved here in the 80s and managed law rms for most of my career, retired and started acting in
2020, right during COVID,” he said. “And I’ve never been that much of a writer, other than in legal stu , you know, writing briefs and that kind of thing.”
e playwright learned to act in classes at the Denver Center for Performing Arts and started writing last September while he was battling a COVID-19 infection.
Hayes says the play is unintentionally autobiographical, and it started when the actors started noticing some e ects of aging.
“As I’ve gotten a little older, I’ve noticed it’s a little harder for me to memorize lines, so I’ve been taking smaller parts in plays because it’s too hard to memorize them,” Hayes said. “My husband and I were talking about it then. I said, ‘You know,

Clear Creek Makerspace provides public access to cutting-edge technology

e Clear Creek Makerspace is one of many in the area. However, the edgling space for maker innovation across from Anderson Park on 44th Avenue in Wheat Ridge is the largest along the Front Range, according to makerspace program director Tyler Kerr.
e 7,500-square-foot space is designed to accommodate the needs of makers in the Wheat Ridge community, Kerr said.
“ e makerspace is as much a place to pool resources and access things you might not have at home,” Kerr said. “ ose could be things that are more expensive, too big, or they require special ventilation, special power, any of those things that make it a little bit hard for you to have the tools at home. Maybe you only need a table saw for a speci c project, and you don’t need to buy a full table saw. at’s the purpose of a makerspace.”
e space supports projects that require emerging tech, such as 3-D printing, computer numerical control woodworking and computercontrolled cutting for fabric, plastic, leather and more. It also has equipment and materials for makers in traditional trades like woodwork, welding, metalwork and more.
“ ere’s certainly a lot of tradition-
all the way through rapid prototyping. So, there’s a lot of machine cutting and bending equipment in here. MIG and TIG welding as well as plasma cutting.”
Kerr said the goal of year one in the makerspace is to provide a wide range of tech for the community. However, there are limits.
“You’re not going to be mass producing,” Kerr said.
In addition to the equipment, the space includes a learning lab where the makerspace holds classes for

According to Kerr, size isn’t the only asset that distinguishes the Clear Creek Makerspace from the rest. e center is also enhanced by its partnerships with the city of Wheat Ridge, nonpro t Local Works, and federal grant organizations.
“Our funding comes right now, partially from the city, partially from grants,” Kerr explained. “We do have
some federal grants and we are consistently applying for more. Part of it is funded through LocalWorks.”
Kerr said that the rest of the funding comes from membership fees and fees for speci c training courses.
“We’re not looking to make millions,” Kerr said. “We’re really just looking to ensure that we can stay open and provide the resources to folks.”
Kerr said the goal of the makerspace is to be a public place to go for tech innovation and education, like a library or gym.
“In our gyms in Wheat Ridge, we o er up exercise equipment and space to grow and improve health,” Kerr said. e makerspace is a third option besides a library and gym resource. “It’s a third place to allow folks to express their creativity, learn the new skills, allow small businesses to grow and potentially start here in Wheat Ridge.”
LocalWorks executive director Paige Piper said the makerspace has many bene ts for the city of Wheat Ridge.
“I think the makerspace is conducive to entrepreneurship,” Piper said. “It’s conducive to innovation. It’s conducive to another third place that people can resort to. And I think it brings people to Wheat Ridge.”

“Part of the message I’m trying to get across on this play is that you’re never too old to go after your dreams or to accept who you are,” Hayes said.
He wants the audience to take a few other things away from the play.
“ is is not just a gay play,” Hayes said. “ ere are senior aspects, but this is one thing I’m trying to communicate: there are some aspects of this that all of us, as we get older, deal with. So even when younger people see this, they might recognize some things their parents or grandparents are going through. Also, older people are going to recognize that there’s some commonality between all of us.”
e play also stars Sina Hirsch as Pete’s daughter Susan and Elliote Enochs as manny candidate Jason. Arden Phanes is the stage manager, and Selena A. Naumo is the lighting designer. Maru Garcia designed the sets, props and music.

When most people think of live jazz, many probably imagine dimly lit, smokelled clubs. However, the music sounds just as great at a higher elevation.
at’s the idea behind the Evergreen Jazz Festival, which is returning for its 21st year on Friday, July 26 through Sunday, July 28.
“What makes the festival unique is we focus on classic and early forms of jazz,” said Ed Danielson, the event’s music director. “ ere are still plenty of people out there playing and appreciating this kind of music.”

Some of the legendary artists who pioneered this music include Louis Armstrong, Duke Ellington and Jelly Roll Morton, just to name a few e three-day festival features musicians performing at a variety of lovely venues in Evergreen: the Evergreen Elks Lodge, Evergreen Lake House, Evergreen Christian Church and Center Stage. Each space provides a unique live experience and they all have the bene t of being surrounded by Evergreen’s natural beauty.

Appealing to younger audiences is a key goal for Danielson, and bringing in younger performers and groups that play music attendees can dance to is a key part of that e ort.
“ ere’s been a renewed interest in recent years in swing dancing, so we want to make sure the performances are danceable,” he said. “We o er dance lessons as part of the festival as well.”

DIA Takes Live Music to the Skies

As you get ready, here are some tips from actual guides about what to expect, as these patient men and women have experienced a few trips that did not go well. First, follow the packing list. Do not leave your raingear at home because your brother tells you it never rains in the desert. If it is 100 degrees in the shade at your house and the list recommends a down parka: bring it. It

Do not lie about your physical abilities. You tell yourself you have six months to get into shape, but we know what the road to hell is paved with. Walking the dog twice a day instead of once is not a strenuous exercise routine.
Be realistic. On the rst morning of a ve-day mountain bike tour, a participant announced that he had never been on a bike in his life. e entire rst day was spent teaching him how to ride and the itinerary readjusted to t his needs.
Do not stop taking your medications. Medicines can have side e ects. Stopping a long-term medication may also have side e ects. I did not know that stopping anti-depression meds could cause massive irritation until a non-medicated hiker grabbed their gear and stomped o in a snit.
Don’t be sel sh. I was on a on river trip that eliminated all day hikes because one person threw a hissy about “wasting time” that could better be spent sitting on the beach drinking Mai Tais.
Don’t be a twit. I was busily bisecting bagels one morning to prepare lunches when a would-be epicurean loftily told me not to touch his bagel. “Bagels should be sliced just prior to eating.”
Everyone began demanding that I stop touching their bagels until the senior leader chimed in. “ ose bagels have been bouncing around in packs for three days! Give us a break!”

If you want a true educational trip, opt for one o ered by a nonpro t organization.
A guided trip can still lead to frustration. It can rain for days, high winds can make putting up a tent a chore and blisters can manifest. But if you’re prepared to accept some hardship, getting outdoors can also lead to new friendships and a more relaxed approach to adventure.
Maybe, even, it can be the trip of a lifetime.

Lynn Ann Marie “Shrubbery” Bush
September 7, 1952 - July 2, 2024
Lynn Ann Marie Bush, 71, of Lakewood, Colorado passed away on July 2, 2024 at her home after ghting a battle with cancer.
Lynn was born on September 7, 1952 to William Ralph and Rita Marie Bush in Dayton, Ohio. After graduating from St. Joseph Commercial High School in 1970, she started her rst government job at Wright Patterson Air Force Base. ere she helped build the A-10 Aircraft, the Warthog. is was just the beginning of a long career with the federal government.
Lynn was predeceased by her mother and father and older brother Bill and sister Mary. She is survived by 4 brothers, 2 sisters, 12 nieces and nephews and 15 great nieces and nephews as well as dear life-long friends.
In 1989 Lynn married Bob Martinez who was the love of her life. He passed in 1994.
In 2022, Lynn retired from the VA where she worked for 22 years. Her passion in working with the Veterans never ceased. Just 7 days after her retirement she was diagnosed with pancreatic cancer. She fought a tough, hard battle for the next two years.
Her candid sense of humor, strength and independence as well as her love for the Broncos and Rockies will be greatly missed. Services will be held at the Cathedral Basilica of the Immaculate Conception in Denver at 9:30am on Friday, October 18, 2024. A celebration of life luncheon will follow at 11:30am at the Old Spaghetti Factory in Westminster, Colorado.

Local single moms use low-cost automotive services to provide for families

Danicka omas’ car was on its last legs.
For weeks, the Denver resident asked her neighbors for rides or spent hundreds of dollars on rideshares. With six children who all needed to be in di erent places at varying times, omas said public transportation wasn’t a viable option. She needed a car — a real, working car.
Finally, last month, she caught a ride to a concert at Clement Park, and then drove home in a new car.
“It’s been a long time coming,” omas said. “ … I’m beyond words.”
On June 28, Goldenbased nonpro t organization Hands of the Carpenter hosted a bene t concert to help omas and other single moms throughout the Denver area.
e faith-based nonpro t o ers low-cost automotive services, including maintenance and placement, for working single moms. It serves clients in Adams, Arapahoe, Boulder, Broomeld, Denver, Douglas and Je erson counties.
Hands of the Carpenter started in 2003 and has garages in Golden and Aurora. It plans to open a third in the Federal Heights area this fall, Founder Dan Georgopulos said.
In 2022, it served 355 families. Last year, after opening the Aurora garage, it served 609.
Georgopulos added that Hands of the Carpenter had helped more than 400 fami-
lies so far in 2024, and believed the third garage would enable it to serve even more clients than 2023.
“We know there’s a lot of need in the northern Denver area,” he said, adding that the Federal Heights garage will be the largest of the three, with eight bays total.
As its operations expand, Georgopulos hoped the nonpro t’s clients, volunteers and other supporters would continue to spread the word about Hands of the Carpenter’s mission and services.
“Everybody knows somebody who needs help,” he continued.
‘It’s life-changing’ omas, who heard about Hands of the Carpenter from a coworker, reached out to the nonpro t in October. With her new car, she’ll be participating in the three-year Lift UP Program, which includes low-cost repairs and maintenance. e car itself was 35% of the retail cost under the Lift UP Program.
With her new 2010 Ford Edge Sport, omas said that she’s looking forward to driving herself to and from work, getting her children to all their commitments, and making a road-trip to visit her out-of-state relatives without issue.
“It’s life-changing,” she continued.
She thanked all the Hands of the Carpenter leaders and volunteers, and everyone who helped with the June 28 bene t concert, including musicians Hazel Miller & the Collective.

On July 9, Lakewood’s Jasmine Coronado-Lopez took her car to the Golden garage for maintenance. After being referred through Hope House, she’s been in the Lift UP Program since March.
Coronado-Lopez said her car’s been having transmission problems, and Hands of the Carpenter referred her to an outside shop for additional evaluation. She hoped to get it xed soon, saying the nonpro t has been helping her navigate the stressful situation.
“ ey’ve been so helpful and encouraging on my journey to gure out cars and get my kids around safely,” she continued.
As a delivery driver and a relative’s primary care worker, Coronado-Lopez said having a car is crucial for picking up medication, grocery-shopping, and other tasks. She was thankful Hands of the Carpenter has kept her car running “when I thought it was going to break down for good,” she said.
She’s referred other moms, saying she’s learned a lot about cars as the Hands of the Carpenter mechanics walk her through everything her car needs and why. While she believed other shops might talk down to their clients or take advantage of them, Coronado-Lopez felt informed on the process at Hands of the Carpenter.
“It feels home-like,” she said of bringing her car into the Golden garage. “… I’m so thankful for all the work they’ve already done in the last few months.”
Aurora’s Antoinette Ogunwo is starting her third year with the Lift UP Program this August, as Hands of the Carpenter placed her with a 2011 Chevy Malibu a few years ago.
Ogunwo recalled trying to apply for help several years ago, but Hands of the Carpenter wasn’t serving her area yet.
After it expanded, though, she received a yer in the mail and applied that night.
She described how, before getting her current car, Ogunwo “kept driving lemons.” She became trapped in a vicious cycle of needing to x or replace her car on a regular basis. So, after she received her new car at a bene t concert like omas did, Ogunwo said it was “truly a blessing.”
Not only has it helped her family get around town, but Ogunwo said, “I’ve learned to manage my nances and appreciate what I have.”
Overall, she said her experiences with Hands of the Carpenter were reassuring, adding, “You’re in good hands.”
‘They do it with heart’
Along with individual donors, Hands of the Carpenter receives grants and donations from businesses, civic and philanthropic organizations, and faith-based groups.
Nancy Smith of St. Paul’s Episcopal Church in Lakewood said her group has been supporting Hands of the Carpenter’s work for years. She also volunteers at the Golden garage, helping families when they bring their cars in for service.
She said people don’t need to be mechanics to volunteer.
Just welcoming the clients and spreading the word is key, Smith continued, adding, “ ere’s something for everyone (to help with).”
In addition to monetary donations, Hands of the Carpenter also accepts vehicles. Georgopulos said that, depending on its condition, it might be placed with a family or sold to fund additional services.
From her experiences as a volunteer, Smith described just how important having a working and reliable car is for every family the nonpro t helps. She and Georgopulos hoped people would continue to support Hands of the Carpenter as it opens the third garage later this year.
“ ey’re making a di erence in people’s lives,” Smith said, “… and they do it with heart.”

e Je erson County Republicans have settled on a new District 2 County Commissioner candidate: former RTD Board Member Natalie Menten will step in for Charlie Sturdavant, who dropped out of the race because of a knee injury.
A vacancy committee met on July 12 to ll the open position, and picked Menten to run against Democrat incumbent Andy Kerr, according to Je erson County Republican Party Chair Nancy Pallozzi.
Menten was the RTD District M board member for 8 years, and has been involved in advocacy against tax hikes and against Senate Bill 213, which would have taken away a degree of local control regarding land use decisions.
“I’m not a newbie in any sense of the word, and actually thought about entering the race back in 2016 but at that time, I was on the RTD board as an elected board director, and knew there’s still worth some things I was completing

there,” Menten said. “Now, this is the right time, an ideal time. “ ere’s a demand for myself to enter this race, because what we have at stake here is the nancial impact to the taxpayers of Je erson County, which I want to protect, and so that that really requires that I step into this race now and put my name in,” Menten continued.

e cost for a student to participate in one extra-curricular activity in a season was about $833 in 2022, according to the Aspen Institute’s Project Play. For families with annual household incomes of $150,000 or more, that average is $2,068. e Evergreen-based Wooden Hawk Foundation wants to help, and it’s doing so in a unique way — by helping to coordinate a largely student-run mountain music festival through which students can gain unique experience, and raise
money and awareness about their sports and clubs.
“Firefall” will headline the Aug. 3 Mountain Music Fest, which will include eight bands playing from noon to 9 p.m. at Evergreen’s Buchanan Park elds.

In addition to her term on the RTD board, Menten also has experience owning and managing an automotive shop based in Golden.
She says she plans to take a “hands on” approach to county management if elected, including shoring up some “redundancies” and “duplication” in certain departments, which she believes could be streamlined into a more cost-e ective operation.
Her priorities include making sure Je co residents don’t have to give up property tax caps, reviewing the taxation of food with the aim of making it more a ordable and ghting against “land use mandates” such as those found in the now-dead SB 213.
Pallozzi mentioned Menten’s advocacy in maintaining TABOR within the county as one of the reasons why she was selected for the vacancy, which Menten echoed in her comments as well.
“Je erson County has asked the voters to de-TABOR twice in the last ve years,” Menten said. “I was one of the main opponents, working with a large group of volunteers to defeat both of those issues, meaning I was printing 1000s of yers out of my home o ce and handing them to volunteers.
“I will work to the end to defeat this measure they want to get passed,
which will eliminate our property tax caps and it is a tax increase, eliminating our Tabor refund forever,” Menten continued.
With regards to entering the race at this stage, Menten said it wasn’t a concern for her, as she also jumped into the RTD race late and was able to secure the vote there.
“We want somebody who’s really going to bring some balance back to government, require more open meetings of government, nd deciencies in the government, have the ability to actually say those words you don’t hear that often in government, which is, ‘No, that’s not the best idea and not the best role of government,’” Menten said.
“We can do better for the community (in terms of) protecting taxpayers’ wallets,” she continued. “I hope all those years where I spent doing that work already is re ected on the vote in November.”
Pallozzi said Menten has the full support of the Je co Republican Party.
“(Menten) knows how to run government and be a part of that process,” Pallozzi said. “ e Je erson County Republicans are very excited that she is our candidate for County Commissioner in District 2 and we are looking forward to seeing her prevail in this race.”
District 2 covers parts of Golden, Lakewood and Edgewater. Election day is Nov. 5.

e operation runs from ursday to Monday during the summer season and o ers special events like the Full Moon paddles.
Owner/operator Shoyer said the goal is to run a successful business but it’s also an opportunity to open the unique experience of Georgetown Lake to anyone, and local knowledge of the lake is crucial to making it a safe experience.
“It’s a beautiful space, a dynamic space where locals know the wind e ects tremendously and for us to be out here managing that for folks helps keep people safe, helps keep us con dent,” Shoyer said.
Sources from the Clear Creek County Sheri and Fire Authority told the Courant they were aware of the business but had no formal agreement or operational knowledge of it as a “rescue” organization.

The FIRM and, if applicable, the FIS report have been revised to reflect these flood hazard determinations through issuance of a Letter of Map Revision (LOMR), in accordance with Title 44, Part 65 of the Code of Federal Regulations. DESCRIPTION OF CONDITIONAL WATER RIGHTS. a. Name of Structure. Tommy Davis Park Pond (only irrigation use remains conditional). i. Date of Original Decree. October 3, 2011 in Case No. 09CW266, Water Division 1 (09CW266 Decree). ii. Subsequent Diligence Decrees. June 14, 2018 in Case No. 17CW3162, Water Division 1 (17CW3162 Decree). iii. Location. In the NW1/4 of the NW1/4 of Section 22, Township 5 South, Range 67 West of the 6th P.M. The center of the dam is located approximately 16 feet from the north section line and 961 feet from the west section line. The center of the Tommy Davis Park Pond is located approximately 201 feet from the north section line and 917 feet from the west section line. The location of the Tommy Davis Park Pond is illustrated on the attached EXHIBIT 1. iv. Source. A tributary of Goldsmith Gulch, tributary to Cherry Creek, tributary to the South Platte River. v. Appropriation Date. January 1, 2007. vi. Amount. 5 acre-feet and the right to refill with continuous refills. vii. Uses. Recreation (5 acre-feet, absolute), aesthetic (5 acre-feet, absolute), piscatorial (5 acre-feet, absolute), wildlife habitat (5 acrefeet, absolute), storage and the right to refill continuously (5 acre-feet, absolute) and irrigation on 19 acres in part of the S1/2 of the SW1/4 of Section 15, Township 5 South, Range 67 West and the N1/2 of the NW1/4 of Section 22, Township 5 South, Range 67 West of the 6th P.M. (1) Denver Lease Water. The primary sources of exchange water are water rights perpetually leased from the City and County of Denver (Denver Lease Water) delivered from replacement points described in the 09CW266 Decree. Description of Exchange Reach. The Exchange Rights were confirmed in the 09CW266 Decree and operate within all or part of the following reach: (1) Delivery Point of Denver Lease Water. From the City of Denver’s point of replacement described at or upstream of the proposed Lupton Lakes Reservoir Complex located in the SE1/4 of the SW1/4 of Section 18, Township 1 North, Range 66 West of the 6th P.M. up the South Platte River to the confluence of Cherry Creek in the NE1/4 of the NW1/4 of Section 33, Township 3 South, Range 68 West of the 6th P.M., then up Cherry Creek to the confluence of Goldsmith Gulch in the SW1/4 NE1/4 of Section 20, Township 4 South, Range 67 West of the 6th P.M., then up Goldsmith Gulch to the point of depletion on an unnamed tributary of Goldsmith Gulch in the NW1/4 of the NW1/4 of Section 22, Township 5 South, Range 67 West of the 6th P.M. Platte River from points upstream of its confluence with Cherry Creek, the exchange reach is up Cherry Creek, then up Goldsmith Gulch to the point of depletion on an unnamed tributary of Goldsmith Gulch in the NW1/4 of the NW1/4 of Section 22, Township 5 South, Range 67 West of the 6th P.M. A map showing the locations of the exchange reaches and replacement points is attached as EXHIBIT 1. v. Appropriation Date. January 1, 2007. vi. Amounts. (1) Exchanges Involving Denver Lease Water. Each of the Exchange Rights involving Denver Lease Water is decreed for 2.83 cfs, conditional, which is also a cumulative limit for all the exchange rights in the 09CW266 Decree. (2) Exchanges Involving Greenwood Village’s Nontributary Well. The exchange right involving Greenwood Village’s Nontributary Well is decreed for 0.45 cfs, conditional. (3) Cherry Creek/South Platte Exchange Reach. The exchange right involving the exchange reach from the confluence of Cherry Creek and the South Platte River to the Tommy Davis Park Pond was decreed absolute in the 09CW266 Decree for 0.19 cfs. (4) Robert W. Hite Treatment Facility Exchange Reach. The exchange right involving the exchange reach from the Metropolitan Denver Wastewater Plant, now known as the Robert W. Hite Treatment Facility, was decreed absolute in the 17CW3162 Decree for 0.04 cfs. 4. GREENWOOD VILLAGE’S INTEGRATED WATER SUPPLY SYSTEM. Paragraphs 2, 10 and 13 of the 17CW3162 Decree confirm Greenwood Village’s water system, including the Tommy Davis Park Pond Water Right and the Exchange Rights, is an integrated water supply system under C.R.S. § 37-92-301(4)(b) and work on other components of Greenwood Village’s integrated municipal water supply system is evidence of diligence on the Tommy Davis Park Pond Water Right and the Exchange Rights. 5. CLAIM TO MAKE TOMMY DAVIS PARK POND WATER RIGHT ABSOLUTE. a. Statutory Authority. C.R.S. § 37-92-301(4)(e) states “[a] decreed conditional water storage right shall be made absolute for all decreed purposes to the extent of the volume of the appropriation that has been captured, possessed, and controlled at the decreed storage structure.” (Emphasis added). b. Factual Bases for Request. Paragraph 11 of the 09CW266 Decree and Paragraph 7.1.7 of the 17CW3162 Decree both found the full 5.0 acre-feet of the Tommy Davis Park Pond Water Right has been stored in the Tommy Davis Park Pond. c. Requested Relief. Based on C.R.S. § 37-92-301(4)(e) and the findings in the 09CW266 Decree and the 17CW3162 Decree, Greenwood Village requests the Tommy Davis Park Pond Water Right be made absolute in the full decreed amount of 5.0 acrefeet and for all decreed purposes (Tommy Davis Park Pond Absolute Claim). 6. DILIGENCE CLAIM. a. Diligence Period. The most recent diligence period for the Tommy Davis Park Pond Water Right and the Exchange Rights was from June 14, 2018, the date the 17CW3162 Decree was entered, through June 30, 2024 (Diligence Period). b. Expenditures and Activities. During the Diligence Period Greenwood Village, together with its prior water counsel, undersigned water counsel, and BBA Water Consultants, Inc. expended approximately Two Million Four Hundred Sixty-Eight Thousand Dollars ($2,468,000.00) and completed activities which demonstrate Greenwood Village’s steady and diligent efforts to complete the appropriations of Tommy Davis Park Pond Water Right and the Exchange Rights and include: i. Accounting and Consulting for Tommy Davis Park. Accounting and consulting support for Tommy Davis Park operations including development and operation of the Tommy Davis Park Pond Water Right and the Exchange Rights. ii. Tommy Davis Park Pond Fishing Derby. Costs of the annual fishing derby at the Tommy Davis Park Pond. iii. Tommy Davis Park Maintenance and Improvements. Costs of Tommy Davis Park channel improvements and landscaping and park maintenance. iv. Monitoring of Division 1 Water Court Resumes. Greenwood Village monitored the Division 1 resumes and substitute water supply plan notices for new water rights applications and to determine if such applications would result in injury to Greenwood Village’s water rights, including the Tommy Davis Park Pond Water Right and the Exchange Rights. v. Water Rights Acquisition. Greenwood Village engaged counsel to analyze and prepare title abstracts and acquire water rights in the Arapahoe Aquifer to expand its water rights portfolio to maximize long-term beneficial use of its water rights, including the Tommy Davis Park Pond Water Right and the Exchange Rights. vi. Monitoring of Case No. 21CW3025. Greenwood Village continues to be active in proceedings in Water Division 1, including reviewing pleadings, as necessary to protect Greenwood Village’s water rights, including the Tommy Davis Park Pond Water Right and the Exchange Rights. vii. Case No. 24CW3045 Water Court Application.
(1) Application. On April 5, 2024, Greenwood Village filed an application in Water Division 1 Case No. 24CW3045 for storage rights and an augmentation plan (24CW3045 Application). (2) Claims in 24CW3045 Application. The 24CW3045 Application includes a claim for: (a) approval of absolute storage water rights; (b) approval of an augmentation plan to replace evaporative depletions and out-of-priority diversions. 7. NAMES AND ADDRESSES OF OWNERS OR REPUTED OWNERS OF LAND UPON WHICH STRUCTURES ARE LOCATED. Greenwood Village owns the land where the Tommy Davis Park Pond is located. 8. REQUESTED RULING. a. Tommy Davis Park Pond Absolute Claim. Greenwood Village respectfully requests the Court approve the Tommy Davis Park Pond Absolute Claim. b. Diligence for Conditional Portion of Tommy Davis Park Pond Water Right. If the Court does not approve the Tommy Davis Park Pond Absolute Claim, Greenwood Village respectfully requests that the Court continue the remaining conditional amounts and uses of the Tommy Davis Park Pond Water Right for an additional diligence period. c. Diligence for Conditional Portions of Exchange Rights. 4. Detailed outline of activity during the diligence period. During the relevant diligence period, Applicant has taken steps to diligently develop the subject conditional water right including, but not limited to, the activities described below. 4.1 Mount Carbon incurred more than $15 million for the design and construction of a new water treatment plant to serve the Town of Morrison and Mount Carbon. 4.2 Martin/Martin has served as Mount Carbon’s consulting civil engineers who have expended approximately 2,245 hours and incurred nearly $400,000 in fees and costs on a variety of water and wastewater matters, including the following: O Analysis and preliminary design of new water treatment plant. O Preparation of water and wastewater master plans. O Analysis of raw water diversion requirements. O Oversight of water system improvements and maintenance of infiltration gallery, water pipeline, water tank and associated infrastructure. O Analysis of water use and necessary infrastructure associated with development within Mount Carbon’s service area.
4.2 Mount Carbon has engaged BBA Water Consultants to provide technical support in connection with Mount Carbon’s development of a municipal water system. During the diligence period, BBA’s activities for Mount Carbon were exclusively related to the support of the Mount Carbon’s water rights and development of water supply service. These activities include: O Support Mount Carbon’s negotiation of water service and shared water facilities with the Town of Morrison. O Review and analysis of Mount Carbon’s water rights. O Research potential water storage at Chatfield and Bear Creek Reservoirs for use by Mount Carbon. O Support water diversion operations, collect measurement data, preparation and submittal of required monthly water accounting reports, coordination with Water Commissioner and other DWR personnel. O Participate in regular Board of Directors meetings as needed. O Assist with review of Mount Carbon water share ownership, stock certificates and payment of assessments. Applicant incurred approximately $78,400 in fees and costs for BBA’s work, for which BBA invested approximately 388 hours of work among its staff. 4.4 Mount Carbon has engaged the law firms of Porzak Browning and Bushong and Brownstein Hyatt Farber Schreck, LLP (Brownstein) to act as its water counsel. They represented Mount Carbon in its negotiations with the Town of Morrison over a joint water supply and water system, and in reviewing and analyzing Mount Carbon’s water rights, including the conditional water rights at issue in this Application, and on water supply planning. Mount Carbon has incurred attorneys’ fees and costs of more than $60,000 for this work. 4.5 Applicant expended more than $500,000 on water system improvements and repairs. WHEREFORE, Mount Carbon requests:
1. A finding of reasonable diligence for the subject conditional water right; 2. Continuing the subject conditional water right in full force and effect; and 3. Such other relief as the Court deems just and proper.

Well Permits. Permit No. 44958-F: The Flying J Ranch Well was originally registered under this well permit number, and it was originally decreed for 10 g.p.m. absolute in Case No. 1995CW0154, with augmentation of out-of-priority depletions covered by the augmentation plan decreed in Case No. 1995CW0154. Permit No. 68814-F: The Flying J Ranch Well was decreed in Case No. 2007CW0146 for an additional 50 g.p.m. conditional (in combination with all supplemental and replacement wells therefor, known as the Flying J Ranch Well System), with augmentation of out-of-priority depletions from this expanded use covered by the augmentation plan decreed in Case No. 2007CW0146. b. Legal description of Flying J Ranch Well: NW 1/4 NW 1/4, Section 28, Township 9 South, Range 71 West of the 6th P.M., in Jefferson County, Colorado, at a point approximately 1,250 feet from the North section line and 800 feet from the West section line of said Section 28. See Exhibit 1 to the application. This well is within 100’ of Wigwam Creek and can be administered as a surface diversion without delayed depletions. c. Legal description of Flying J Ranch Well System, Including Existing Supplemental Well: As provided in the decree in Case No. 2007CW0146, the Flying J Ranch Well System includes all supplemental and replacement wells needed for the Flying J Ranch Well to obtain the full yield of 60 g.p.m. decreed for the Flying J Ranch Well in Case Nos. 1995CW0154 and 2007CW0146. All wells in the Flying J Ranch Well System must be located within the Flying J Ranch, which is located in the E 1/2 of the NE 1/4 and the NE 1/4 of the SE 1/4 of Section 29, and the NW 1/4 and the N 1/2 of the SW 1/4 of Section 28, all in Township 9 South, Range 71 West of the 6th P.M., Jefferson County, Colorado, as more particularly depicted on Exhibit 2 (“Flying J Ranch”). Further, all wells comprising the Flying J Ranch Well System must be located within 100 feet of Wigwam Creek and in the same quarter-quarter section as the Flying J Ranch Well. The supplemental well (permit no. 81320-F) is located in the NW 1/4 of the NW 1/4 of Section 28, Township 9 South, Range 71 West of the 6th P.M., Jefferson County, Colorado, at a point with the following UTM coordinates (based on UTM Zone 13 and datum NAD83): Easting 469987.0, and Northing 4343386.0. Source of water: Groundwater which is tributary to Wigwam Creek, a tributary of the South Platte River. e. Appropriation date: March 1, 2006. f. Amount: 50 g.p.m., conditional. g. Uses: All camp purposes on the Flying J Ranch, including in-building domestic uses, fire protection, swimming pool, stock watering, and irrigation of up to 1.4 acres within the Flying J Ranch, as such ranch is more particularly described in paragraph 2.d. above. h. Depth: 304 feet (decreed); 305 feet (as constructed). Flying J Pond. a. Legal description: The Original Decree provides that “The Flying J Pond will be a small off-channel excavated pond located on the Flying J Ranch, as shown on Exhibit B [to the Original Decree]. Water will be diverted from Wigwam Creek at [at a point located on the Flying J Ranch property in the SE 1/4, NW 1/4, Section 28, Township 9 South, Range 71 West of the 6th P.M., in Jefferson County, Colorado, approximately 2150 feet from the North line of Section 28, and 1380 feet from the West line of Section 28], and will be carried in a pipeline or ditch to the pond headgate, which will be located in the SE 1/4, NW 1/4, Section 28, Township 9 South, Range 71 West, of the 6th P.M., approximately 2450 feet from the North line of Section 28 and 1500 feet from the West line of Section 28.” A survey of the decreed location of the intake from Wigwam Creek to Flying J Pond demonstrated that the decreed location of the intake is approximately 100’ east of Wigwam Creek. Based on the survey, the engineering design and planned construction of the Flying J Pond and intake, the planned point of diversion from Wigwam Creek will be within 105’ of the decreed point of diversion from Wigwam Creek described above. The legal description of the planned point of diversion is: “Water will be diverted from Wigwam Creek at a point located on the Flying J Ranch property in the SE 1/4, NW 1/4, Section 28, Township 9 South, Range 71 West of the 6th P.M., in Jefferson County, Colorado, approximately 2150 feet from the North line of Section 28, and 1275 feet from the West line of Section 28, and will be carried in a pipeline to the pond, which will be located in the SE 1/4, NW 1/4, Section 28, Township 9 South, Range 71 West, of the 6th P.M., approximately 2600 feet from the North line of Section 28 and 1250 feet from the West line of Section 28.” As designed, the water diverted from Wigwam Creek will be delivered to the pond by gravity in a pipeline; a pond headgate will not be required. b. Source of water: Wigwam Creek, tributary to the South Platte River. b. Appropriation date: March 1, 2006. c. Amount: 5.0 acre-feet, conditional, with the right to fill and refill when in priority. d. Rate: 1.0 c.f.s. from Wigwam Creek via the ditch or pipeline. (In accordance with the design drawings, the water will be delivered via pipeline from Wigwam Creek.) e. Uses: The primary uses are augmentation, irrigation, and fire protection, with incidental uses for recreation, piscatorial, and wildlife protection and propagation. Irrigation use is for up to 1.4 acres within the Flying J Ranch. (Irrigation is planned to be made in the vicinity of the camp buildings.) f. Surface area: 1 acre. (Based on the engineering design and planned construction of the Flying J Pond, the surface area will be 0.77 acres.) g. Total capacity: 5.0 acre-feet. 4. Evidence of Reasonable Diligence. a. Legal Ownership. In June 2017, Ramah in the Rockies (“Ramah”), a Colorado nonprofit corporation, became the sole member and manager of the Flying J Ranch LLC. The Board of Directors of Ramah, and its designated agents, oversee, operate and manage Flying J Ranch. The JCC Camp mentioned in the original water decree is no longer a participant in the Flying J Ranch. b. Infrastructure Improvements. On August 5, 2017, a fire destroyed the Lodge Building on the property, requiring the construction of replacement facilities, which delayed further design and construction of additional planned facilities, and therefore delayed development of these conditional water rights. During this diligence period, the Applicant hired JDS-Hydro to review the existing wastewater treatment facility and provide recommendations for expansion and in 2019 contracted with JDS-Hydro to design the upgraded wastewater system for current and future wastewater needs. In the spring of 2019, the Applicant completed the construction of the new Health Center and connected it to the water and wastewater system. In the spring of 2020, the Applicant completed the installation of the upgraded wastewater system. During this diligence pe-
riod, the Applicant has spent approximately $5 million on capital construction and infrastructure development at Flying J Ranch. c. Pond Development, Engineering and Financing. In the fall of 2019, the Applicant contracted with JDS-Hydro (now a Division of RESPEC Company, LLC) for a preliminary review of pond design options and received its report in 2021. In the spring of 2022, the Applicant contracted with RESPEC to design, prepare engineering drawings, determine costs, and obtain needed approvals for the excavated pond and intake. In 2022 and 2023, the Applicant reviewed pond design options, regulatory requirements, floodplain and other engineering reports, and other factors affecting the pond design. The Applicant’s Site Committee met with RESPEC regularly (sometimes monthly). The Applicant determined that the pond and intake could be designed to minimize complex regulatory, environmental, engineering, and cost issues, and to permit water to be delivered from Wigwam Creek by gravity via pipeline to the pond. In June 2023, RESPEC provided initial design drawings of the intake and pond. In August 2023, the Ramah Board of Directors reviewed the initial design and cost in detail, approved a $1 million budget for the pond project, and requested the Flying J Site Committee to work with the engineers to develop a revised design for the pond project within the budget. Between August 2023 and the present, the Applicant, its Site Committee and RESPEC revised pond design options and developed a costing approach. RESPEC’s subsequent design proposal, provided in June 2024, enables water diverted from Wigwam Creek to flow in a pipeline by gravity, without pumps, to the pond, saving approximately $100,000 in construction costs and eliminating many operational problems. The Flying J Site Committee reviewed and approved with minor changes the RESPEC design proposal and construction budget. The Applicant expects that the design and budget will obtain the needed internal approvals on or about June 30, 2024, enabling the Applicant to proceed with the project. The Applicant expects to begin construction of the pond project in the Fall of 2024, with a goal to complete and fill the pond by Spring 2025. d. Legal Expenses: Since 2018, the Applicant engaged legal counsel to review issues related to the water decree and water rights and spent approximately $7,500 in legal fees. 5. Provide a detailed outline of what has been done toward completion or for completion of the appropriation and application of water to a beneficial use as conditionally decreed, including expenditures, during the previous diligence period: (a) During this diligence period, Broomfield has continued to improve, operate and maintain its integrated water supply system, of which the conditional water right described herein is a part. To enable Broomfield to more effectively provide water service to its existing and future customers, it has expended

approximately $370 million during this diligence period for overall capital infrastructure investment to construct, repair and improve its water system infrastructure and related infrastructure and projects that are part of the efficiency, operation and maintenance of its integrated water supply system. These efforts have allowed Broomfield to continue to provide reliable water service to its existing customers and to plan for anticipated future demand. (b) During this diligence period, Broomfield has expended approximately $1 million in costs related to permitting, monitoring, design and construction, and rehabilitation of major components related to Great Western Reservoir described herein; and approximately $363,000 in engineering fees related to permitting and design of other facilities related to Broomfield’s water reclamation system. (c) During this diligence period, Broomfield has defended its water rights against applications filed by others in water court cases in which Broomfield determined that injury to its water rights could occur in the absence of appropriate protective terms and conditions. Broomfield has also filed applications for water rights in water court to maintain diligence on its existing water rights and adjudicating additional water rights to supplement Broomfield’s water portfolio. Broomfield has expended in excess of $660,000 for representation by water counsel and $1 million in water resource engineering fees in these water court proceedings. 11. E. Appropriation Date: September 14, 1981, Case No. 81CW446 in the amount of 20 c.f.s. F. Use: Pursuant to the decree entered in Case No. 81CW446, the water diverted will be used in the City of Westminster’s municipal utility system for municipal, irrigation, domestic, commercial, industrial, recreational, exchange, replacement, and augmentation purposes. During the present diligence period, the rate of exchange has not exceeded the 2.56 c.f.s. previously determined absolute by the Court in Case No. 95CW088. B. During the diligence period, Westminster began working on improvements to its City Park. These enhancements are intended to improve sections of Big Dry Creek by reconnecting the natural floodplain, reducing maintenance costs, creating healthier stream conditions and improving flood management. These activities are ongoing. In addition, during the diligence period, Westminster began installation of an impervious liner to its City Park Pond located adjacent to Big Dry Creek. Activities associated with this effort included draining of City Park Pond, removal of excess sediment and regrading of the pond, stabilizing the local channel; reconstructing or replacing grade control structures, box culverts, and retaining walls; and installing a polyethylene pond liner. Depending on progress and flow conditions, the City hopes to have City Park Pond refilled by the end of this year. One of the sources of water that may be used to refill City Park Pond includes water diverted pursuant to the 1981 BDC Exchange. Costs related to these activities have been incurred during the diligence period. C. During the diligence period, Westminster has, pursuant to the decree in Case No. W-8743, diverted water into the municipal utility system and put such water to beneficial use in Westminster’s water service area. Beneficial use of said water has then generated effluent at Westminster’s Big Dry Creek Wastewater Treatment Plant for exchange pursuant to the decree in Case No. 81CW446. In a prior diligence period, Westminster expanded the capacity of the Big Dry Creek Wastewater Treatment Plant thereby allowing treatment of additional effluent at the Plant. D. Westminster has previously participated in a joint effort with the City of Thornton and the USGS to construct a flow gauge on Big Dry Creek. During the diligence period, Westminster has made annual contributions of approximately $5,000.00 to cover a portion of the operations and maintenance for said gauge. The gauge is used to measure flows in Big Dry Creek and provides a basis for the calculation of exchange potential on Big Dry Creek. Moreover, Westminster staff has participated in the Big Dry Creek Watershed Association, a cooperative effort among all Big Dry Creek water users to monitor flow data, as well as other information. Costs associated with this effort were incurred during the diligence period. E. During the diligence period, Westminster has participated in a number of water court proceedings in an effort, in part, to protect and maintain return flows to both Big Dry Creek and the South Platte River. In addition, Westminster has participated in a number of water court proceedings in the Clear Creek basin in an effort, in part, to protect and maintain the full entitlement of water available to the water rights decreed in Case No. W-8743, Water Court, Water Division No. 1, State of Colorado. Under the terms of Case No. 81CW446, effluent generated by the use of said water rights in Westminster’s municipal utility system may be used for exchange purposes. F. Consistent with the findings in the decree issued in Case Nos. 08CW273 and 17CW3169, the 1981 BDC Exchange water right adjudicated in Case No. 81CW446 is part of Westminster’s Clear Creek raw water supply system, an integrated system as defined by § 37-92-301(4) C.R.S. During the diligence period, Westminster continued the development of its Clear Creek Water Supply System. Activities have included, but are not limited to, prosecuting Water Court applications to incorporate purchased Clear Creek water interests into Westminster’s water supply, participation in various water court proceedings to protect Westminster’s water supply system, participation in continuing efforts to effect improvements to and the enlargement of Standley Lake, significant improvements to the wastewater collection system associated with the Big Dry Creek Wastewater Treatment Facility, which is an “exchange from” point for the 1981 BDC Exchange, significant improvements to the Big Dry Creek Wastewater Treatment Facility and ongoing master planning efforts related to said Facility, substantial efforts to protect the quality of water of Westminster’s water supply system. Costs related to these activities have been incurred during the diligence period. 5. Water applied to beneficial use: Since diversions by exchange during the current diligence period did not exceed the current absolute flow rate of 2.56 c.f.s. for the 1981 BDC Exchange, Westminster is not claiming additional amounts absolute in this matter. 6. Name(s) and address(es) of owner(s) or reputed owners of the land upon which any new diversion or storage structure, or modification to any existing diversion or storage structure is or will be constructed or upon which water is or will be stored, including any modification to the existing storage pool: With the exception of Big Dry Creek Intake No. 3, the diversion structures involved in this exchange are all on property owned by the applicant, the City of Westminster. On information and belief, the existing Big Dry Creek Intake No. 3 is located on lands owned by the State Board of Community Colleges and Occupational Education. Big Dry Creek Intake No. 3 is an existing, not a new, diversion structure and there are no plans to modify said structure at this time. 7.Remarks/Other: Any decree entered in this matter will incorporate by reference the exchange terms and conditions contained in the underlying decree, Case No. 81CW446, including specifically the exchange terms set forth in paragraph 9 of said underlying decree. Description of Structure: The reservoir formed by the Chatfield Dam is an existing structure located on the mainstem of the South Platte River; the right abutment of which is located in Douglas County, Colorado, in Sections 6 and 7, Township 6 South, Range 68 West of the 6th P.M., and the left abutment of which is located in Jefferson County, Colorado, in Section 1, Township 6 South, Range 69 West of the 6th P.M. 2.4 Source: The South Platte River and its tributaries. 2.5. Appropriation Date: August 24, 1984. Pursuant to paragraph 13 of the 83CW184 Decree, Central’s Chatfield Reservoir Water Right shall be administered as having been filed in 1983. 2.6. Amount: 22,300 acre-feet, conditional. (Central conveyed 4,100 acre-feet of the original 26,400 acre-feet decreed conditional right to Centennial Water and Sanitation District on May 15, 2005.) 2.7. Uses: Augmentation, replacement, exchange, irrigation, commercial, industrial, recreation, municipal, domestic, fish, wildlife and recreation and all other beneficial uses. 3. Outline of What Has Been Done Toward Completion: 3.1. During the diligence period, Central has participated in the Chatfield Reservoir Mitigation Company, Inc., the purpose of which is to conduct such business as may be necessary to satisfy the mitigation obligations of the reallocation project participants, including Central. In addition, Central has continued to negotiate with other Chatfield reallocation project participants regarding acquiring additional storage space in Chatfield Reservoir. 3.2. During the diligence period, Central expended over $6,721,200 in legal expenses, participation in various activities related to the Chatfield Reservoir Mitigation Company, engineering, assessments, carriage expenses and acquisition of additional storage space in Chatfield Reservoir. 3.3. Integrated System. Central owns numerous water rights and ditch and reservoir structures on the South Platte River and its tributaries which are operated as an integrated system to provide augmentation to over 1,200 member wells in two subdistricts. The conditional right decreed for Chatfield Reservoir is a part of Central’s integrated system. During the diligence period, Central undertook many different projects on its integrated system, including but not limited to purchasing water rights, constructing water storage and delivery infrastructure, filing applications for and obtaining decreed water rights and changes of water rights, and participating as an objector in water court cases for the purpose of protecting Central’s water rights. 4. Claims To Make Partially Absolute and for Finding of Reasonable Diligence Pursuant to C.R.S. § 3792-301(4). From April 2023 to March 2024 Central diverted and stored 5,945.1 acre-feet of Central’s decreed right for 22,300 acre-feet, in priority, in Central’s storage space in Chatfield Reservoir, storage space in Chatfield Reservoir leased by Central, and the Colorado Parks and Wildlife environmental pool. Central seeks a decree approving 5945.1 acre-feet absolute. The remaining 16,354.9 acre-feet should remain conditional. As
described above, Central’s Chatfield Reservoir water right is part of an integrated system under C.R.S. § 37-92-301(4)(b). Work performed and effort or costs expended by Central on any water rights or structures which are part of its integrated water system should be considered in finding that reasonable diligence has been shown in the development of water rights for all features of the system as provided in C.R.S. § 37-92-301(4) (b). 5. WHEREFORE, Central requests the Court enter a decree finding that Central has satisfied the statutory standard of steady application of effort to complete the appropriations described above for Central’s Chatfield Reservoir water right in a reasonably expedient and efficient manner under all the facts and circumstances, that reasonable diligence was performed during the diligence period in the development of the Chatfield Reservoir water right, that a portion of Central’s Chatfield Reservoir water right should be made absolute as described herein, and that the remaining conditional portion of the water right should continue. “ e foundation wanted to provide students an opportunity to have skin in the game, a large event where they could be in charge of running it and have an opportunity to garner awareness and donations for their clubs,” said foundation president Pam Lush-Lindquist, adding the festival will be an annual event. “We’ve struck a nerve in so many entities. Whether they’re sponsors, people or musicians that understand what our core mission is — which is to support our students where programs have been cut.
“Public education is no longer an equal playing eld. Home economics, woodworking, driving instruction — these programs are long gone. On top of that, it costs you to get on the bus to go to school. To play a sport, you have to pay for all equipment
and transportation. It costs to become a member of the DECA club, and if you go to state or international, it costs much more. We’ve lost public education the way in which we once knew it.”
With the idea of o setting some of those costs, EHS clubs and teams will have booths at the event to showcase their activity.
“ e Mountain Biking Team is going to build a little mountain biking course where people can participate by a suggested donation that goes directly to the team,” Lindquist said. “Each club and sports team is doing their own rendition of an activity.”
e concert line-up includes local connections. Non-Prophet, winners of Conifer’s Got Talent, features three students from the Morrison-Conifer area. Country singer Jenna Weidner and Hand Turkey Band lead vocalist Andy Seracuse are EHS graduates.
“Every one of our acts has a passion or program for students,” Lindquist said.
e foundation will use its share of the proceeds to help build its planned Future Center and Alumni Center at Evergreen High School.
e Futures Center is planned as a platform to guide students on their future career pathways, o ering resources for those seeking work in trade careers, community college, the military, universities, internships, or other options.
