Lawsuits blamed for costly home insurance

is may come as no surprise to homeowners, but the cost of Colorado’s homeowners insurance is the eighth highest in the nation, according to Bankrate, a nancial services company that tracks all sorts of monthly bills.

At an average of $266 per month or nearly $3,200 a year, premiums are higher here than in states such as California ($121) and New York (144), as well as neighbors Arizona ($172), Utah ($104), New Mexico ($169) and Wyoming ($131).

Blame extreme weather, hail damage and wild res for our lofty rank, said Shannon Martin, Bankrate’s insurance analyst and a licensed insurance agent. But diving a little deeper, Martin also cited how policies are structured by states, the rising cost of homes, and something called “social in ation,” a term used by the insurance industry to describe the impact beyond regular economic in ation.

“ at’s the increase in lawsuits and the amount of payouts from the lawsuits,” Martin said. “Public opinion has changed on who’s really liable for these actions and how much money you should get in a lawsuit. … It’s impacting how policies are rated and how much they cost.”

e narrower Lake Avenue packed with vendors and food trucks on Sept. 7 and the work to convert ornton’s N-Line Eastlake station into a temporary festival space were not lost on neighbor Drew Morris.

Morris, who owns a circa 1920 Union Paci c boarding house in the Eastlake neighborhood, said the Eastlake Street Fair is just what he wants to see the neighborhood become.

“What we care about is seeing Eastlake become a vibrant community center,” Morris said, who has converted his house to a short-term rental. “ ere is so much history here, there’s a cool way to show how old and new can be brought together in this particular part of ornton and give us a nice downtown.”

Longtime East Lake resident Jeanette Riggans said she isn’t so sure. “ ey want to develop Eastlake into something it’s not, and there’s just not room for them,” Riggans said. “Some of the new people, they just have no clue what Eastlake is about.”

Drawing out both sides was the point of the street fair, according to Krista Nightengale of the national group the Better Blocks Foundation.

“We want to let people touch it and feel it and live in it for a while,” Nightengale said. “And then they can say what they liked about it or what they really hated.”

e fair was sponsored by ornton’s economic development department and the Better Blocks Foundation to demonstrate how a few street-level changes can change the feel of a neighborhood.

“ ere are concerns about what changes are going to do to a community and a little bit of distrust,” she said. “ is event is the culmination of a 120-day project, the culmination of everything we’ve discussed and worked on with members of the com-

Nightengale said the foundation has hosted some 90 demonstration festivals in 70 di erent cities around the world. Foundation sta come in and meet with neighbors and city sta ers, uncovering the history of the area and the hopes residents and neighbors have for the area.

“What we’ve heard from this community is that they love this area,” Nightengale said. “ ey want to see these buildings protected. A lot of folks would like to see more businesses here and more reasons to come, but above all they want the beauty and the character to remain.”

Eastlake is the ornton neighborhood south of 128th Avenue and west of York Street. It was originally founded in 1919 as a railroad company village, dominated by the grain elevator to the north. It’s currently home to a local bar, the Lake Avenue Inn, and a smattering of businesses around it as well as some newer developments along 124th Avenue leading up to the RTD’s N-Line station. It’s also home to

across the roads.

Nightengale and her team turned Eastlake Avenue’s intersection with First Street into an impromptu festival space, installing temporary wooden signs and benches on the street, painting the ground and turning the N-Line station’s steps into a stage for the day.

More paint and tape were used on both sides of Lake Avenue, lling the ample on-street parking on both sides to create a narrower road that is meant to slow tra c and encourage walking.

“ e idea is that you’re pausing the cars, making it slower and safer for people walking around,” she said. “We’ve also told people, it would make the street safer for the Eastlake turkeys.”

She said the demonstration removed 16 parking spaces from public use.

“We know we have a couple of vacant buildings that we want to ll and bring in some local small businesses,” he said. “And so this is an opportunity to bring in some new energy and create some energy the community can enjoy and see what its like.”

Riggans said she was part of the local residents who worked with the city and Nightengale’s group to put on the fair, and she said it was lovely day and nice to see the streets lled with people. She remains skeptical, however, and worries the city will approve changes for the area without checking with residents.

“I think the big thing is the tra c,” Riggans said. “If they could come to the citizens with a plan and say ‘ is is what we’d like to do. Now, you know, give us your ideas.’ We don’t want them to come to come to us with a done deal.”

Inspecting and Dealing With Inspection Issues Is Crucial to the Buying Process

Sellers and their listing brokers are required by law to disclose all known defects to prospective buyers, and buyers should get and study the Seller’s Property Disclosure and share it with their inspector prior to conducting a professional inspection of the home they are buying. This form is to be completed “to the seller’s current actual knowledge,” but shouldn’t be counted on.

contract, so my buyer can see whether it’s worth the expense of a professional measurement, which can cost several hundred dollars. (I also place this device in the basements of homes I list, to give the seller a heads-up on whether to expect radon mitigation as an inspection demand.)

As a buyer, you absolutely must hire a professional inspector who will perform an overall inspection of every system and appliance within the house. Your inspector will ask if you want to do a radon test or a sewer scope, both of which cost extra. Say “yes” to both those services.

Sewer scopes only cost $100200 and are money well spent, because if they reveal a problem requiring excavation, that could cost thousands of dollars.

Schedule the inspection early, because your inspector may recommend additional inspections by an electrician, a plumber, a structural engineer, a roofer or other specialist based on what he saw.

You need to disclose all defects you know about, and any listing agent worth his salt (and his license to practice real estate) won’t work with you if you aren’t completely honest and forthcoming about every known defect in your home. Don’t hire an inspector to do the job of a buyer’s inspector. Let your buyer alert you to defects you aren’t yet aware of.

Feds boost Rocky Mountain airport funding

Critics of Rocky Mountain Metro Airport attack new funding going into the facility

Critics of Rocky Mountain Metropolitan Airport in Broom eld blasted a nearly $7 million funding boost for the facility, which they claim is a major contributor to environmental pollution as well as being a safety hazard to local neighborhoods.

e funding will allow RMMA to construct a new 1,300-foot paved Taxiway O for the facility, even though resi-

dents say they are already besieged by too many airplanes ying out of the airport and over houses throughout the day, said Westminster resident Carolyn Farbman.

“I am both shocked and deeply disturbed that our state representatives are backing the AIP grant for the construction of Taxiway O at RMMA,” Farbman wrote via email. “ is new taxiway is expected to bring an additional 35,000 operations annually, a gure that’s alarming given that surrounding communities are already struggling with record-high tra c, particularly from ight schools.”

supposedly aimed at addressing noise concerns — yet they continue to fuel airport growth with taxpayer-funded grants. e contradiction is hard to ignore.”

Sharing federal money

Colorado U.S. Senators Michael Bennet and John Hickenlooper announced this week that RMMA will share almost $100 million from the Federal Aviation Administration to improve airport infrastructure across the state. e funding comes through the Airport Improvement Program  (AIP) and the Bipartisan Infrastructure Law, as well as discretionary supplemental grant funding, according to a news release.

RMMA’s cut of the funding will be $5,498, 829 for the construction of a new 1,300-foot paved Taxiway O to bring the airport into conformity with current standards. e airport will also reconstruct 970 feet of the existing paved Taxiway D pavement that has reached the end of its useful life, according to the news release.

RMMA also will get $1,400,633 to conduct a noise compatibility plan study.

Bennet and Hickenlooper said in the news release that local airports are key to economic growth in Colorado and the funding will help the airports meet expansion demands.

“Colorado’s regional and municipal airports help connect communities across our state and support local economic development,” said Bennet. “ ese dollars will help them invest in safety and capacity upgrades to meet Colorado’s changing needs.”

communities and power local economies,” added Hickenlooper. “Our Bipartisan Infrastructure Law is still delivering improvements to make air travel safe and accessible for all Coloradans.”

Farbman said all revenue generated by RMMA goes right back into funding the airport itself.

“It’s di cult to see what bene t this brings to Je erson County residents,” she said. “In fact, our taxpayer dollars are essentially supporting businesses like ight schools, which are abusing a public facility with no return for the surrounding community other than noise and lead pollution.”

Farbman and others say the leaded fuel used by piston-powered aircraft at RMMA drifts onto local homes, causing health hazards for residents.

Neighbor complaints

Westminster resident Charlene Willey said RMMA and Je erson County, which manages the airport, have long ignored complaints from residents about operations at the facility. eir suspicions were con rmed in 2023 when airport director Paul Anslow was reportedly dismissed after he was recorded calling airport critics “nut jobs” and that a Community Noise Roundtable of local leaders was a “waste of time and money.”

Anslow’s departure set o the resignations of half the members of the Airport Advisory Board, Willey said.

In May, the county hired Erick Alan Dahl as the new airport director, who has pledged to forge new relationships with the surrounding community.

Westminster joins Rocky Flats group exodus

Other cities dropping out of stewardship council prompted the move by Westminster

e City of Westminster is joining other local governments that are pulling out of the Rocky Flats Stewardship Council.

Westminster City Councilors voted 7-0 Monday night to leave the oversight group. e move was not a surprise as six other

communities have already voted to leave the stewardship council, said City of Westminster spokesman Andy Le.

e stewardship council – or RFSC – includes 10 local government members and has served to provide a platform for mayors and city council members to have say on the management of the closed Rocky Flats nuclear facility. e agreement that formed the RFSC began in February 2006, according to a city sta report.

e terms of the agreement states that the RFSC ceases to exist if six government members drop out. In recent weeks, Golden, Superior, ornton, Northglenn, Broom eld and Boulder

County have said they will leave, the sta report states.

e dissolution of the RFSC will not alter the Department of Energy’s management responsibilities of Rocky Flats or its obligations to provide updates and reports, the sta report states.

Councilors Monday night also postponed an executive session to discuss the city’s next move regarding the Rocky Mountain Greenway Trail.

Activists have urged the City of Westminster to stop building the trail which would link the city with the abandoned Rocky Flats Plant, saying local recreation will disturb soil still contaminated with deadly plutonium.

e city added NinjaCross, a state-ofthe-art retractable obstacle course. e NinjaCross is suspended above the lap pool at the Northglenn Recreation Cen-

ter indoor aquatics facility and will be available to both members and drop-in guests during designated times. In the future, formal programming and rental packages will also be offered.

Open year-round, NinjaCross provides a unique workout opportunity and fun, challenging experiences for all participants, according to a Northglenn city news release.

e NinjaCross website states the system was designed for competition pools and facilities seeking an outof-the-box system to redevelop programming without a ecting current scheduling.  For indoor facilities, the

Tempers flare during Thornton City Council session

Council member accuses colleagues of causing hostile

work environment

Simmering animosity within the ornton City Council came to a boil Tuesday night as members yelled accusations that some were bullying city sta and cursing each other in public.

e hostility prompted council members to ask for more civility amongst themselves and to tamp down the vitriol.

Council member Chris Russell said much of the bad blood among council members goes back years and that he doesn’t support any type of “vendetta” among his council colleagues.

“We can do better,” Russell said.

“It’s not civil to conduct ourselves this way. I do expect us to do better as a whole to be good leaders.”

Text messages spur furor e focus of most of the angry disagreements has usually been between Mayor Jan Kulmann, Councilmember Jessica Sandgren and Mayor Pro Tem Karen Bigelow and Kathy Henson.

e ash point came Tuesday night, during a regular meeting of the council, over a set of text messages between Bigelow and former City Manager Kevin Woods. e text messages were unearthed through a

CORA - Colorado Open Records Act – request led by Sandgren.

In one message, Bigelow used an expletive in asking Woods who put cost estimates in an article in ornton’s City Voice newsletter explaining an upcoming ballot issue that would change the city charter to decide council vacancies.

Bigelow, who backs the charter amendment, said the City Voice article did not include all the information voters needed to decide the issue. She pointed out that the cost of an election to ll a council vacancy would vary depending on whether the election was coordinated with Adams County or is a special election.

“Really, I just want to give our residents a choice,” Bigelow said.

Russell objected to Bigelow’s picture being displayed on the text messages.

Sandgren, meanwhile, said the tone of the text messages showed that city sta works in a hostile work

environment promoted by members of the council.

“I am tired of seeing sta leaving the room defeated,” Sandgren said, adding she does not want sta to leave the city because of the council’s antagonism.

Henson said she agreed the council needs to practice more civility. She also hoped better communication between sta and council would come with the arrival of Tansy Hayward, who was picked as the new city manager. “We have a new city manager coming on board soon and I am very hopeful and optimistic,” Henson said.

She and Sandgren then quickly started a loud back and forth after Henson accused Sandgren of swearing at her. “I think council members should not swear at each other in council meetings,” Henson said.

Sandgren denied she swore at Henson. She also said the new city manager would help the council “refocus” on policy issues.

Cool schools: AC a must for students, teachers

How local schools keep kids cool in this long stretch of hot weather

As summer’s 90-degree-plus days crawl into September, local school ofcials say students and sta are staying cool largely thanks to air conditioners in nearly every building. School staers are also using other means to lower temperatures in buildings without central air.

“Beyond ensuring our building sys-

tems are running well, our school sta is always mindful of keeping kids cool during the heat, whether they are inside or out,” said Kevin Denke, Adams 27J School District spokesman, said via email. “ is can include frequent water breaks to keep students hydrated and encouraging the use of re llable water bottles.”

All the buildings and facilities in the Brighton-based Adams 27J School District are equipped with air conditioning, even in the oldest building, which was built in 1926, said Denke. at means there was no need to include the installation of new HVAC systems in the district’s $515 million bond issue in 2021, he said. However, there are funds allocated for

some HVAC related needs such as upgrades to control systems, and in some cases, new boilers, Denke said.

“As far as how our schools are doing in the recent heat wave, our building systems are holding up pretty well,” he said. “With varying ages of our systems, it can be di cult to anticipate issues with the combination of having full buildings again and mid to late August heat.”

e 2023 school year, Denke added, got o to a warm start with some system issues in a few of the district’s buildings. “But so far, so good this year,” Denke said.

Nationally, an estimated 41 percent of public school districts need to replace or update their HVAC systems in at least half their schools – roughly 36,000 schools across the country, according to a General Accounting Ofce report and published in NEAToday.

e absence of working HVAC systems is even more alarming considering that rising temperatures due to climate change could cause even more uncomfortably hot days in classrooms soon, NEAToday states.

Due to high heat and saddled with infrastructure in dire need of repair or upgrade, school districts across the country have also been left with little options other than to send students home, the magazine states.

Closing schools because of high heat should be “unthinkable,” says Joseph G. Allen, director of Harvard University’s Healthy Buildings Program and Associate Professor at the Harvard T. H. Chan School of Public Health.

“We’ve been in the sick building era for over 40 years, and we’ve neglected our school buildings. It’s just something we’ve tolerated, and I’m not sure why. We know that good ventilation and ltration are key to student health, student thinking, and student performance, and yet closing schools has become our new reality,” Allen told NEAToday.

All the schools in Adams 12 Five Star Schools, which is in western Adams County, have air conditioning although some schools don’t have air conditioning in the gym, the kitchen or the cafeteria, said Adams 12 spokeswoman Christina Dahmen, via email.

As the summer’s heat extends into the school year, local districts say they are relying on good air conditioning — thanks to recent bond issues — to keep the classroom temperatures at a comfortable level.

As part of the district’s proposed $830 million bond issue, air conditioning would be added to the remaining four school cafeterias and 12 school gyms that don’t currently have it, Dahmen said.

Nearly all of the schools in Westminster Public Schools/Adams District 50 have air conditioning in almost all its buildings, as a result of a 2006 bond issue for $98.6 million and a $9.9 million mill levy override in 2018, said district spokesman Stephen Saunders via email.

“We made a concerted e ort to get it into our buildings,” Saunders said. e district is installing air conditioning at Shaw Heights Middle School. ere is no central air at the district’s STEM Union and Hidden Lake Secondary School. Big air blowers are being used at both schools to mitigate the heat, Saunders said. Westminster Public Schools Board of Education voted last month to place a $111 million bond issue on the November ballot. If approved, the measure would extend the 2006 bond issue which built Westminster High School and the Hodgkins Leadership Academy.

e 2006 bond also included the installation of air conditioning in almost every school in the district, according to a news release.

Colorado Creates provides 125 grants to arts organizations across the state

Gov. Jared Polis and the Colorado Creative Industries Division of the Colorado O ce of Economic Development and International Trade announced that 125 arts organizations across 33 Colorado counties have been awarded $909,000 in Colorado Creates grants. ese grants will help organizations and communities create art and cultural activities by providing general operating support. Grantees receive funding for two years, totaling $1,818,000 in awards over the funding period.

Red Rocks’ 9/11 Memorial Stair Climb draws estimated 2,500 attendees

Participants honor firefighters and other Sept. 11 victims with nine laps around amphitheatre

An estimated 2,500 people — many re ghters in full gear, some seniors climbing slowly but steadily, a few babes in arms and a handful teens vaulting easily up the stone steps — paid tribute on Sept. 11 by participating in the Colorado 9/11 Memorial Stair Climb at Red Rocks.

e event honors the 343 re ghters and nearly 3,000 people who died in the Sept. 11, 2001 attacks, which included two planes crashing into the World Trade Center towers. It also honors the 362 re ghters who’ve died since from illnesses related to the terrorist attacks.

Participants did nine laps up and down the Red Rock Amphitheatre

stairs, the equivalent of the 110 stories of the World Trade Center.

e event began with the replaying of a 9/11 New York City radio broadcast, during which callers witnessing planes hitting the towers called in to share their observations and express horri ed disbelief.

Event coordinator Shawn Duncan, noting the divisiveness that accompanies national elections, urged participants to remember that day and the days that followed.

“ ink about how united our country was,” he said. “All we cared about was being there for one another. As we climb these stairs today, remember that feeling. Carry it with you. Let’s get back to caring for one another and let’s be united again.”

“It was amazing; I love doing things like this,” said Lena Humphrey, 13. “It was a really good experience … in memory of all these amazing people.”

In its 15th year, the Red Rocks event drew participants from 24 states, the Virgin Islands and the United Kingdom.

Last year’s event raised $116,000 through donations.

are aware of our struggles and yet they congratulate themselves for facilitating the use of public money to support the interests of a mostly wealthy minority. is public facility profoundly harms tens of thousands of people and threatens our environment.”

In Westminster, the environmental hazards of the expansion were made clear when it was discovered that the application for the AIP grant to build Taxiway O included false information, Willey said. It stated that there were no nearby sources of a water supply when in fact Standley Lake, the water source for nearly 300,000 residents in Westminster,

ornton and Northglenn, is less than two nautical miles downhill from RMMA, she said.

e threat to local water sources was made public by community members making Colorado Open Records Act requests, Willey said.

“It appears no o cial at the airport, Je erson County or the FAA is providing adequate oversight of the data submitted on AIP grant requests for this facility,” she said.

Adams 12 Five Star School Board of Education has unanimously approved putting an $830 million bond issue before their voters along with a $34.5 million mill levy override for operations.

It’s important to note that the bond issue does NOT require a mill levy increase. ere are two key investment areas for the district which include facilities and programming. Here are the highlights from their “Blueprint: Investing in Student Success” which breaks down how the bond funds would be utilized.

e largest single project would be to rebuild ornton High School. e 50-year-old facility has aged out and needs replacing. e cost is listed at $236 million.

Can we govern Westminster better?

We have a representative democracy so why are the representatives seeing so many items pushed into votes by the uninformed public? e public is not getting enough details to make informed decisions on spending or regulation change ballots. Ballot wording is also often confusing or misleading. Here are some citizen observations on areas where our local governance could improve.  Why are we spending so much on education? We are already near the top in per-student spending, yet our current education approach ranks near the bottom for results.

It’s budget time for most local governmental entities

September usually signals the end of a lot of hot summer days with cooling noticeable in the mornings and evenings. It also means that municipalities, counties and special districts will nalize their annual budgets for the coming calendar year and provide an opportunity for the public to weigh in. School districts are on a scal calendar basis from July 1 to the following June 30. Federal money generated from the COVID pandemic is de nitely on the wane, but there are bond issues and tax increases waiting in the wings with the Nov. 5 election. Besides voter-required issues, the proposed budgets will reect water and sewer rate increases as well as hikes in fees which can be acted upon with a TABOR vote of the people. So, if you are interested in knowing what the water rate is going to look like next year or the proposed increase in roadway improvement fees or other, you best be reaching out to your local city manager’s o ce or city clerk’s o ce to get speci c answers to your questions. Trump’s rants remind me of

South American dictators

Never one to disappoint when making outlandish threats and untrue statements, former president Donald Trump was at it again while campaigning in Wisconsin. He posted a warning on his special media site threatening to jail those “involved in unscrupulous behavior” this election, which he stated would be given intense scrutiny.

He went on: “When I win, those people that cheated will be prosecuted to the fullest extent of the law, which will include long term prison sentences so that this depravity of justice does not happen again.”

Now, don’t such rantings give you con dence in this man that he would be fair, open-minded, a big supporter of given the bene t of the doubt, willing to compromise and not be judgmental if elected president again?

Hardly would be my reply. It shows me that he carries a burning desire for retribution. Secondly, he subtly is already implying that the 2024 Presidential Election will be rigged.

Such threats of harassment and imprisonment reminds me of some South American dictators both current and from past history. It’s an attitude of “if you oppose me, I will take you down.”

Another example which he previously said is, “If you mess with me, I will mess with you.” Don’t you love such “raw meat” statements from a presidential candidate?

Unfortunately, too many Americans seem to do so and our democracy is under serious threat.

A welding fabricator by trade, Joe Cole only dabbled in steel and bronze sculpting as a pastime and then eventually gave it up in 1993. But 30 years later, after he made an urn for his departed family dog, Cole caught the passion for creating again.

At the same time, the Northglenn resident couldn’t shake a persistent echo in his head of an owl calling out, “HOO.” He decided then he needed to mold something that paid homage to an owl building a life in a tree in the forest.

“ e conclusion was made, and I spent an estimated 40 hours sculpting the bird and a limb to hold,” Cole said. He spent another 30 hours adding three more owlets and a tree trunk.

Later he added moss to represent growth, a snail for patience, a stump for reaching out and a mouse for courage. e result is a steel statue called “Hoo What Where and When” by Cole, and the sculpture is being displayed this year at Northglenn’s EB Rains Jr. Memorial Park.

His work is also featured in Castle Rock and Alamosa. But the one in Northglenn holds special meaning for the 60-year-old since it was his rst attempt to have his work dis-

played for the public.

He entered three of his sculptures into four cities in Colorado to exhibit. ree accepted his work.

“I wanted to share with the public…and Northglenn is my only home, and I wanted to share a piece of me,” Cole said via email. “ ree out of four ain’t bad.”

Other sculpture programs that dot the Front Range host Colorado artists from varying backgrounds who have molded bronze and steel frames that lure the eyes with humor and mysticism. From novice to well-established, artists say metro cities have o ered nurturing environments for their projects.

O cials say the sculptures, including those of Cole, Zink and Bunting, were chosen by a diverse volunteer committee in February and will be on-site at the park for one year.

e other works and artists chosen for the 202425 season include: “Spiral Vortex” by Diego Harris, “Sun Lion” by D’Jean Jawrunner and “Magnify” Kirk Seese. Photos of the works are available on Northglenn’s website.

e annual Art on Parade program is an on-loan outdoor sculpture exhibit funded by NAHF and the Adams County Scienti c and Cultural Facilities District. e new sculptures will remain at E.B. Rains Jr. Memorial Park through May of 2025. e park is located at 11701 Community Center Drive, half a mile south of 120th Avenue and Grant Street in Northglenn just south of the new Webster Lake Promenade.

e NAHF is a non-pro t group that provides funding for “dynamic theatre, public art, and other cultural endeavors in the city. e NAHF was founded in 1990, according to the NAHF website. Zink, native of New Orleans, came to Colorado and received a Bachelor of Studio Arts and Art Education for CU-Boulder. After working with many mediums, the past 25 years Zink has collaborated with her partner Ben to create Zink Metal Art, Zink said.

e steel “Eternal Echoes” was created in 2022 after Zink lost someone very special her, she said. e sculpture symbolizes the beauty of a vast universe, Zink said.

Bill Bunting said his iron “With Wings Like Eagles” has been an inspiration to those who view it. e piece is also one of his favorites, he said via email.

“I chose the piece to display at Northglenn because I have always had a strong interest in the Native American culture and the history of the West and love sharing that with others through my art,” Bunting said. e inspiration for the sculpture “With

Wings Like Eagles”, Bunting said, comes from the belief of most Native American Tribes that the Eagle and Eagle Feathers are sacred, carrying their prayers to e Creator, combined with a passage from the ancient text of Isiah which states, “ ose who wait upon e Creator shall mount up With Wings Like Eagles.” Bunting pointed out that the following original poem is mounted at the base of the sculpture. A 2023 analysis by the Colorado Division of Insurance found payouts have increased in recent years causing insurers in Colorado to lose money on the premiums collected. And premiums for the average homeowner increased 51.7% between January 2019 and October 2022. e report also touched on wild re risks near densely populated areas of Fort Collins, Denver and Colorado Springs where “insurance carriers would be reassessing their appetite for wild re risk (and) could have an impact on a material group of Colorado homeowners.”

Colorado is ranked second in the nation for hail-damage claims and has a “highly litigious climate,” said

Carole Walker, executive director of the Rocky Mountain Insurance Association, a trade group that represents insurers. And nearly half of the state’s population lives in wildlandurban areas that include another one million people living in areas with “moderate to very high risk of wild re,” according to the Colorado State Forest Service. Combined with a growing population and pricier homes that cost more to rebuild, there are a number of reasons for higher prices.

“We truly are at a tipping point in Colorado,” Walker said. “(Colorado) ranks second after California for risk of wild re. … I think fears of what we’ve seen happen in California in recent years of an exodus of insurers, a lot of the reasons that insurers were reducing the number or policies or leaving California was because of man-made catastrophes.”

According to the state’s insurance division, the agency has asked homeowners and insurers about renewals and nonrenewals. e results are expected next year, a spokesperson said.

Walker, who sits on many local government boards, doesn’t recall any insurers exiting Colorado yet but are reducing the number of policies on risky properties they no longer can a ord to cover. She’s trying to make sure government restrictions and outdated regulations better balance insurer risk with availability of insurance for all Colorado households.

“If we stabilize the market, that’s what we’ve all been working toward,” she said. “Put in more hail-resistant roofs. If we scale up our mitigation for wild re and make it measurable, those are all things we can do to reduce the risk of hail and wild re. at’s going to have a long-term im-

pact on keeping insurers here (and) keeping those homes insurable.”

According to RMIA, the average increase in homeowners’ premiums in Colorado grew 57.9% from 2018 to 2023.

Lawmakers passed legislation last year after there were concerns about households losing their insurance due to cancellations and nonrenewals. e Fair Access to Insurance Requirements, or FAIR plan, is an “insurer of last resort” and designed to provide property coverage to homeowners and businesses in the highest-risk areas who are unable to get coverage.

FAIR coverage is funded by insurance assessments based on an insurer’s market share. e policies should be available to homeowners and businesses in early 2025. But it’s just one “tool in the toolbox,” said Walker, who is on the state’s FAIR board.

No Hate Tour returns to Colorado high schools

Students of ornton High School were treated to likely the most extreme assembly they’ll see this year on Sept. 10.

For the second straight year, X Games athletes brought the No Hate Tour back to Colorado, stopping at four high schools last week in a campaign to end bullying and promote mental health awareness. e tour, now entering its 25th year, is run by ASA Entertainment, a leading producer of action sports events in the U.S.

Some of the world’s top BMX riders back ipped, 360-ed and tricked their way through ornton, Northridge, Mountain View and Prairie View High Schools with a positive message, thrilling students and educators alike.  “ ey do (get red up for this event),” said Jeremiah Johnson, the athletic and activities director at ornton. “It’s cool to have these community events where we get everybody in the school together. It brings some community and camaraderie and gets everybody focused on one thing for a while.”

September has been the National Suicide Prevention Awareness Month since 2008, according to the Substance Abuse and Mental Health Services Administration.

With mental health emerging as a hot topic in athletics in recent years, combining action sports with a positive message is truly valuable, Johnson said.  “All of our coaches are trained in mental health and suicide prevention,” Johnson said. “It’s a huge part of our life right now and it’s important. e more people know about it, the more we can a ect it.”

e event featured renowned BMX riders Oscar Marquez, Trey Herrera, Matt Mecher and Dane Beardsley. It was also emceed by Zack “Cat sh” Yankush, a pioneer BMX announcer and popular voice of the sport at major

competitions, such as the X Games.

Yankush said he’s always been hyperpassionate about BMX, but for more than 15 years has been channeling that passion into the No Hate Tour.

Of all the national stops the tour makes, he loves coming to Colorado, he said. He’s even moving to Denver soon.

“Colorado is awesome for a couple of reasons,” Yankush said. “I think the students here are more accustomed to seeing action sports because you guys have skate parks everywhere. A big shout-out to the municipalities here in Colorado. Action sports provides an anchor for us to kind of get their attention, and then we talk about our message.”

at message starts with curbing bullying, whether that’s physical, verbal, relational or cyberbullying. It involves testimonials from the riders and Yankush in cases where they were bullied in their youth.

Using BMX as a channel for spreading a positive message is a dream come true for Yankush, who has been all over the country and the world over through the sport. It’s not just about ghting bullying and promoting positive mental wellness; it’s about encouraging students to follow their dreams.

“For me, it’s brought me so much joy in life,” Yankush said. “And I’m from nowhere in Ohio. e fact that I’ve been able to make it this far — and looking back on it sure there was hard work put

into it — but I’m a rm believer that everybody has something that they’re passionate about. I think society and the media think living your dream — they attribute it to luck. If you’re doing something you love, money doesn’t matter. I’d do this for free.”

He said the impact has been huge. People approach him years later and say the tour was the reason they got into BMX or got through a di cult time.

“I’ve had students come up to me and tell me I’ve saved their life,” Yankush said. “It’s super rewarding and super awesome, and to do it through BMX is a lifelong dream.”

Road to top of Mount Blue Sky closed until 2026

e highest paved road in North America, Mount Blue Sky Scenic Byway, closed Sept. 3 to all travel to the peak including motorized, biking and most hiking as road repairs continue until Memorial Day 2026, according to the U.S. Forest Service.

e byway, also known as CO Hwy 5, closed from the Forest Service gate near Highway 103 in Clear Creek County through the project area, above Summit Lake, USFS representatives said.

USFS plans to repair the damaged roadway from the Summit Lake overow parking lot to the rst switchback past Summit Lake.

Danille Perrone from Toronto, Canada stood at the peak of Mount Blue Sky with friends on Aug. 23 in 40-degree temperatures with a cold wind blowing strong across the peak as she gazed at the view from 14,264 feet with Summit Lake below.

“It’s raw and fresh, it’s God’s country,” Perrone said.

e USFS said its goal is to “improve public safety while reducing ongoing impacts to the fragile alpine ecosystem and restore the natural hydraulic processes through the area.”

Traveling the highway to the summit recently made apparent the need for repairs. Cars, SUVs and pickup trucks crawled up the last section

of roadway between 10-15 miles an hour over and across large potholes.

e road itself, barely wide enough to accommodate two vehicles heading up or down, heaved with massive dips in the asphalt that required smaller vehicles to crawl up and down the buckled road at a snail’s pace.

As you approach the summit you’re enveloped by the high clouds that appear like fog, until you break through and realize you’re above the wisping white and gray clouds.

Once you’ve arrived at the summit and exited the vehicle you’re in a completely di erent environment than you left at the start of the journey to the top of one of Colorado’s 14ers.

e outside temperature is below 40 degrees and strong blasts of cold winds whip across the summit and blast those who decide to complete the journey to the peak with a short hike to the top.

e rocky path to the top leads hikers through at least four switchbacks to the peak where a brass plate embedded in the rocks marks the summit and elevation; it was placed there in 1955.

Once on top, the view above the clouds goes for miles, notably with Pikes Peak to the south and Mount Bierstadt to the west.

As Perrone put it, “You’re on top of the world.”

Formerly known as Mount Evans, the U.S. Board on Geographic Names voted 15-1 on Sept. 15, 2023 in favor of

the change to Mount Blue Sky.

e name change followed years of lobbying and petitions by the Cheyenne and Arapaho Tribes of Oklahoma to disassociate the mountain from its original namesake territorial governor John Evans.

According to historical references, Evans authorized what’s known as the Sand Creek Massacre.

On a November morning in 1864, U.S. Army Col. John Chivington and elements of the Colorado Infantry Regiment of Volunteers and Regiment of Colorado Cavalry Volun-

teers launched an attack on Arapaho and Cheyenne civilians where they camped about 180 miles southeast of Denver. Over the course of eight hours, the troops slaughtered some 230 people, many of them women, children and elderly, according to the National Park Service.

e new name for the mountain comes from the Blue Sky Ceremony, a ceremony for all living things, including “men, women, children, plants, earth, water, life,” Chester Whiteman of the Southern Cheyenne tribe said in 2023.

RESOLUTION APPROVING THE REFERRAL OF A BALLOT ISSUE FOR THE NOVEMBER 5, 2024, GENERAL ELECTION AUTHORIZING THE IMPOSITION OF A TEMPORARY .15% COUNTYWIDE SALES TAX FOR THE PURPOSE OF INCREASING THE AMOUNT OF AFFORDABLE HOUSING IN THE UNINCORPORATED AND INCORPORATED AREAS OF ADAMS COUNTY

Resolution 2024 - 447

WHEREAS, the COVID-19 pandemic and resulting economic conditions have caused dramatic unanticipated increases in the cost of housing in Adams County (“County”) and the lack of affordable housing in the County for low and moderate income households has caused economic distress to Adams County individuals, families and businesses; and,

WHEREAS, the County has an estimated housing unit deficit of approximately 10,000 homes that is expected to increase to approximately 30,000 by 2050 if not addressed; and,

WHEREAS, a dedicated revenue stream to support the availability of affordable homes is critical to meeting the housing development goals set forth in Colorado State law; and,

WHEREAS, the County is legally authorized to impose a sales tax on the sale of tangible personal property at retail and the furnishing of services, subject to the approval of the registered electors of the County; and,

WHEREAS, the Board has determined that it is in the interest of the residents of Adams County to impose a temporary Countywide sales tax at the rate of .15% for the period beginning January 1, 2025, through December 31, 2044, the receipts from which shall be restricted in application to the expansion of affordable housing in the incorporated and unincorporated areas of Adams County; and, WHEREAS, the Board has determined that a question regarding the imposition of a temporary sales tax for the purposes enunciated herein should be submitted by the Board to the eligible electors of the County; and, WHEREAS, the Board has determined to set the ballot title and ballot question for the issue to be submitted at the election called by this Resolution.

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, County of Adams, State of Colorado: 1.Pursuant to §§ 1-1-111, 1-5-203(3), and 30-11-103.5, C.R.S., the Board hereby authorizes and directs that the following ballot issue be certified herewith to the Adams County Clerk and Recorder (“Clerk and Recorder”) for submission to the registered electors in Adams County to be included on the ballot for the November 5, 2024, General Election:

BALLOT ISSUE

SHALL ADAMS COUNTY TAXES BE INCREASED BY TWENTY- TWO MILLION, TWO HUNDRED THOUSAND DOLLARS ($22,200,000) (FIRST FULL YEAR DOLLAR AMOUNT, FOR COLLECTION IN CALENDAR YEAR 2025) ANNUALLY, AND BY WHATEVER AMOUNT IS RAISED THEREAFTER, BY THE IMPOSITION OF A TEMPORARY COUNTYWIDE SALES TAX AT THE RATE OF .15% ($0.15 CENTS ON A $100 PURCHASE) EFFECTIVE JANUARY 1, 2025, AND EXPIRING DECEMBER 31,2044, WITH THE PROCEEDS TO BE USED SOLELY FOR THE PURPOSE OF EXPANDING THE AVAILABILITY OF AFFORDABLE HOUSING IN ADAMS COUNTY, BY:

DISTRIBUTING GRANTS TO MULTIJURISDICTIONAL AND COUNTY HOUSING AUTHORITIES ESTABLISHED IN ADAMS COUNTY FOR THE PURPOSES OF:

FINANCING, PLANNING, ENTITLING, DEVELOPING, OPERATING, ACQUIRING, PRESERVING, RENOVATING, ADMINISTERING, MAINTAINING AND CONSTRUCTING AFFORDABLE HOUSING FOR SALE OR RENT IN THE UNINCORPORATED AND INCORPORATED AREAS OF ADAMS COUNTY; AND SHALL ADAMS COUNTY BE ALLOWED TO COLLECT, RETAIN AND SPEND THE REVENUES FROM SUCH TAX AND THE INTEREST EARNINGS THEREON AS A VOTER-APPROVED REVENUE CHANGE WITHIN THE MEANING OF ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION AND ABOVE ANNUAL LIMITS WHICH MIGHT OTHERWISE APPLY OR BE PROPOSED, INCLUDING AS AN APPROVED EXCEPTION TO THE LIMITATIONS SET FORTH IN SECTION 29-1-301 OF THE COLORADO REVISED STATUTES; ALL IN ACCORDANCE WITH BOARD OF COUNTY COMMISSIONERS’ RESOLUTION NO. 2024 – 447. YES/FOR NO/AGAINST

2.This Resolution shall serve to set the ballot title and text of the ballot issue.

3.The election shall be conducted by the Clerk and Recorder in accordance with the Uniform Election Code, C.R.S §1-1-101, et. seq., and other laws and regulations of the State of Colorado, including without limitation, the requirements of Article X, Section 20 of the Colorado Constitution (hereinafter “TABOR”).

4.The Clerk and Recorder shall cause all acts required or permitted by the Uniform Election Code and the Rules relevant to be performed by the Clerk and Recorder or its designees.

5.The Clerk and Recorder shall cause a notice of election to be published in accordance with the laws of the State of Colorado, including but not limited to, the Uniform Election Code and TABOR.

6.The Clerk and Recorder shall mail a TABOR notice package to all active registered voter households in Adams County, pursuant to Colo. Const., Art. X, §20, which shall include the ballot issue adopted herein.

7.Pursuant to C.R.S. § 29-2-104(5), the Clerk and Recorder shall publish the text of this Resolution four separate times, a week apart, in the official newspaper of the County and each city and incorporated town within the County.

8.If a majority of the votes cast are in favor of the ballot issue of implementing the temporary sales described herein, (“the Affordable Housing Sales Tax”) then such tax shall be imposed and shall apply to all taxable transactions, unless exempt, occurring on or after January 1, 2025, and through December 31, 2044, and shall be collected, administered and enforced in accordance with this Resolution and the schedules set forth in the rules and regulations promulgated by the Colorado Department of Revenue.

9.Imposition of Tax. There is hereby imposed on all sales of tangible personal property at retail or the furnishing of services in the County as provided in Section 29-2-105, et. seq., Colorado Revised Statutes, as amended, a tax equal to .15% of the gross receipts, the “Affordable Housing Sales Tax”.

10.All retail sales are sourced as specified in Section 39-26-104(3). For purposes of this sales tax, all retail sales are consummated at the retailer’s place of business unless the tangible personal property sold is delivered by the retailer or his agent outside the County limits. The gross receipts from such sales shall include delivery charges when such charges are subject to state sales tax imposed by article 26, title 39, C.R.S., regardless of the place to which delivery is made. If a retailer has no permanent place of business in the County, the place at which the retail sales are consummated for the purpose of this sales tax shall be determined by the provisions of Article 26, Title 39, C.R.S., and by the rules and regulations promulgated by the Colorado Department of Revenue. Without limiting the broad application of this sales tax and recognizing that mobile telecommunications services are subject to particular legal requirements, this sales tax shall apply to mobile telecommunications services to the greatest extent permitted under Section 29-2-105(1.5), C.R.S.

11.Transactions Subject to the Sales Tax. The transactions subject to the Affordable Housing Sales Tax shall be as set forth below and as

required by Colorado state law. The amount subject to the tax shall not include the amount of any sales or use tax imposed by Article 26 of Title 29, C.R.S. The sale of tangible personal property and services taxable hereunder shall be the same as the tangible personal property and services taxable pursuant to C.R.S. §39-26-104, except as provided herein, and shall be subject to the same exemptions as those specified in 7 of Article 26 of Title 39, expressly including the following exemptions:

(A)The exemption for sales of machinery or machine tools specified in section 39-26-709 (1), C.R.S., other than machinery or machine tools used in the processing of recovered materials by a business listed in the inventory prepared by the department of public health and environment pursuant to section 30-20-122 (1)(a)(V), C.R.S.;

(B)The exemption for sales of machinery or machine tools specified in section 39-26-709 (1), C.R.S., used in the processing of recovered materials by a business listed in the inventory prepared by the department of public health and environment pursuant to section 30-20-122 (1)(a)(V), C.R.S.;

(C)The exemption for sales of electricity, coal, wood, gas, fuel oil, or coke specified in section 39-26-715 (1)(a)(II), C.R.S.;

(D)The exemption for sales of food specified in section 39-26-707 (1)(e), C.R.S.; for the purposes of this exemption, “food” shall be defined as in 39-26-102(4.5);

(E)The exemption for vending machine sales of food specified in section 39-26-714 (2), C.R.S.;

(F)The exemption for sales by a charitable organization specified in section 39-26-718 (1)(b), C.R.S.;

(G)The exemption for sales of farm equipment and farm equipment under lease or contract specified in section 39-26-716 (4)(e) and (4)(f);

(H)The exemption for sales of motor vehicles, power sources, or parts used for converting such power sources as specified in section 3926-719 (1);

(I)The exemption for sales of wood from salvaged trees killed or nfested in Colorado by mountain pine beetles or spruce beetles as specified in section 39-26-723, C.R.S.;

(J)The exemption for sales of components used in the production of energy, including but not limited to alternating current electricity, from a renewable energy source specified in section 39-26-724, C.R.S.;

(K)The exemption for sales that benefit a Colorado school specified in section 39-26-725, C.R.S.;

(L)The exemption for sales by an association or organization of parents and teachers of public school students that is a charitable organization as specified in section 39-26-718 (1)(c), C.R.S.;

(M)The exemption for sales of property for use in space flight specified in section 39-26-728, C.R.S.;

(N)The exemption for manufactured homes and tiny homes set forth in section 39-26-721 (3);

(O)The exemption for sales of period products as specified in section 39-26-717 (2)(m);

(P)The exemption for sales of incontinence products and diapers as specified in section 39-26-717 (2)(n);

(Q)The exemption for sales of eligible decarbonizing building materials set forth in section 39-26-731;

(R)The exemption for sales of heat pump systems and heat pump water heaters set forth in section 39-26-732;

(S)The exemption for sales of energy storage systems set forth in section 39-26-733.

12.The Affordable Housing Sales Tax shall not be imposed on the following:

(A)The sale of construction and building materials, as the term is used in section 29-2-109, C.R.S. if the purchaser of such materials presents to the retailer a building permit or other documentation acceptable to the County evidencing that a local use tax has been paid or is required to be paid.

(B)The sale of tangible personal property at retail or the furnishing of services if the transaction was previously subjected to a sales or use tax lawfully imposed on the purchaser or user by another statutory or home rule county equal to or in excess of that sought to be imposed by Adams County. A credit shall be granted against the sales tax imposed by Adams County with respect to such transaction equal in amount to the lawfully imposed local sales or use tax previously paid by the purchaser or user to the previous statutory or home rule county. The amount of the credit shall not exceed the sales tax imposed by the subsequent statutory or home rule county.

(C)The sale of tangible personal property at retail or the furnishing of services if the transaction was previously subjected to a sales or use tax lawfully imposed on the purchaser or user by another statutory or home rule city and county, city, or town equal to or in excess of that sought to be imposed by Adams County. A credit shall be granted against the sales tax imposed by Adams County with respect to such transaction equal in amount to the lawfully imposed local sales or use tax previously paid by the purchaser or user to the previous statutory or home rule city and county, city, or town. The amount of the credit shall not exceed the sales tax imposed by the subsequent statutory or home rule city and county, city, or town.

(D)The sale of food purchased with food stamps. For the purposes of this subsection (D), “food” shall have the same meaning as provided in 7 U.S.C. sec. 2012 (g), as such section exists on October 1, 1987, or is thereafter amended.

(E)The sale of food purchased with funds provided by the special supplemental food program for women, infants, and children, 42 U.S.C. sec. 1786. For the purposes of this section (E), “food” shall have the same meaning as provided in 42 U.S.C. sec. 1786, as such section exists on October 1, 1987, or is thereafter amended.

(F)Notwithstanding any provision of this section to the contrary, sales of cigarettes shall be exempt from the Affordable Housing Sales Tax pursuant to 29-2-105(9), C.R.S.

13.Transactions subject to Specific Ownership Tax. All sales of personal property on which a specific ownership tax has been paid or is payable shall be exempt from said county, town, or city sales tax when such sales meet both of the following conditions:

(A)The purchaser is a nonresident of or has his principal place of business outside of the local taxing entity; and

(B)Such personal property is registered or required to be registered outside the limits of the local taxing entity under the laws of this state.

14.Collection, Administration and Enforcement. The collection, administration and enforcement of the Affordable Housing Sales Tax shall be performed by the Executive Director of the Colorado Department of Revenue (the “Executive Director”) in the same manner as the collection, administration, and enforcement of the Colorado state sales tax. The provisions of article 26 of title 39, C.R.S. and all rules and regulations promulgated thereunder by the Executive Director shall govern the collection, administration, and enforcement of the Affordable Housing Sales Tax.

15.Vendor Fee. No vendor fee shall be permitted or withheld with respect to the collection and remittance of the Affordable Housing Sales Tax.

16.Distribution of Sales Tax Revenue. The Board of County Commissioners shall be responsible for and shall establish policies and procedures concerning the oversight and distribution of proceeds from the collection of the Affordable Housing Sales Tax, and shall define the term “Affordable Housing” for the purpose of the distribution of the Affordable Housing Sales Tax.

17. Deposit and Expenditure of Revenue.

(A)The County shall establish an Affordable Housing Fund within which all revenues and expenditures from the Affordable Housing Sales Tax shall be deposited and accounted for.

(B)Up to three percent (3%) of the Affordable Housing Sales Tax collected may be used for administrative purposes associated with administrating the Affordable Housing Fund.

(C)After payment of the administrative expenses described in Section 17(B) above, moneys remaining in the Affordable Housing Fund shall be used for the purpose of distributing grants to multijurisdictional and county housing authorities established in Adams County for the purpose of expanding the availability of affordable housing for the benefit of the unincorporated and incorporated areas of the County in Continued to Next Page No. NTS3878

accordance with the policies and procedures adopted by the Board of County Commissioners or its designee(s).

18.The Clerk and Recorder shall provide the Colorado Department of Revenue with written notice of this Resolution submitting the question to the registered electors no later than ten days after the adoption of this Resolution.

19.If a majority of the votes cast on the issue of the imposition of the Affordable Housing Sales Tax are in favor of such ballot issue, in accordance with §29-2-106, C.R.S. the Clerk and Recorder shall provide the Colorado Department of Revenue with a written notice of the adoption of the Affordable Housing Sales Tax, along with a copy of this Resolution, no later than forty-five days before January 1, 2025.

20.The officers and employees of the County are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this Resolution.

21.The rate of the Affordable Housing Sales Tax and the deposit of revenues collected as set forth in this Resolution shall not be amended, altered, or otherwise changed unless first submitted to a vote of the registered electors of the County for their approval or rejection. Other provisions of this Resolution may be amended as necessary to effectuate the purposes of this Resolution by resolution adopted by the Board of County Commissioners in accordance with Colorado law.

22.All actions consistent with the provisions of this Resolution heretofore taken by the members of the Board of County Commissioners and the officers and employees of the County and directed toward holding the election for the purposes states herein are hereby ratified, approved and confirmed.

23.All prior acts, orders or resolutions, or parts thereof, by the County inconsistent or in conflict with this Resolution are hereby repealed to the extent only of such inconsistency or conflict.

24.If any section, paragraph, clause or provision of this Resolution shall be adjudged invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining sections, paragraphs, clauses or provisions of this Resolution, it being the intention that the various parts hereof are severable.

25.The cost of the election shall be paid from the County’s general fund.

26.This Resolution shall take effect immediately upon its passage.

List of all Subsequent Decrees Awarding Findings of Diligence. 3.1.2.1. Findings of Fact, Conclusions of Law, Judgment and Decree, 2017CW3119 (August 20, 2018). 3.2. Name and Description of Reservoirs. 3.2.1. The South Reservoir Complex. The South Reservoir Complex is comprised of two existing and operationally interconnected gravel pit storage vessels currently designated as Bambei-Walker Reservoir and Welby Reservoir. The two storage vessels are connected by a pipeline allowing the reservoirs to be operated as an integrated unit. In 2013, Denver Water renamed Cat Reservoir as Welby Reservoir and Miller Dam and Reservoir as Bambei-Walker Reservoir. The South Reservoir Complex is located on the east and west side of the South Platte River between I-270 and I-76. Water may be diverted to BambeiWalker Reservoir at the Burlington Ditch headgate or from the Metro Wastewater Reclamation District Robert W. Hite Treatment (“Metro”) South Platte River Outfall. A portion of the water stored in Bambei-Walker Reservoir can be released to the South Platte River through a gravity flow outlet located in the west embankment of Bambei-Walker Reservoir. The primary outlet for water stored in the South Reservoir Complex is through the pump station constructed in the east bank of Welby Reservoir. The configuration of the storage vessels and operational facilities at the South Reservoir Complex is shown on Exhibit A. 3.2.2. The North Reservoir Complex. The North Reservoir Complex is comprised of the Howe-Haller A Reservoir, Howe-Haller B Reservoir, Hazeltine Reservoir, Dunes Dam and Reservoir and Tanabe Reservoir as further described herein. The North Reservoir Complex is located adjacent to and east of the South Platte River between 108th and 120th Avenues. Water is diverted to the North Reservoir Complex at the Fulton Ditch headgate. The Fulton Ditch was lined with concrete and enlarged by up to 300 cfs for the purpose of carrying water to the complex. Water will be pumped from a pump station located in Hazeltine Reservoir to Dunes Dam and Reservoir and Tanabe Reservoir. All five vessels are connected by pipelines so that they function as an integrated unit. Water stored at the complex will be released to the South Platte River through the outlet constructed on the north embankment of Hazeltine Reservoir either by gravity or by pumping. The current configuration of the North Reservoir Complex is shown on Exhibit A. 3.3. Appropriation Date. December 28, 2001. 3.4. Source of Water. South Platte River and streams and wastewater tributary thereto. 3.5. Use. The water diverted under the water rights decreed herein will be stored and then used by exchange or directly for non-agricultural irrigation, commercial, industrial and all municipal uses, including, but not limited to, domestic, mechanical, manufacturing, industrial, power generation, fire protection, sewage treatment, street sprinkling, irrigation of parks, lawns, grounds and open spaces, recreation, piscatorial, maintenance and preservation of wildlife and aesthetic values, lake and reservoir evaporation, augmentation and/or replacement, and maintenance of adequate storage reserves. Such water may be fully consumed by direct use, storage and subsequent release, and by reuse, successive use, further exchange and disposition, subject to the terms and conditions of this Decree. 3.6. South Reservoir Complex. 3.6.1. South Complex Storage Right Amount. 2,400 acre-feet, for the South

Reservoir Complex, with the right to refill up to 2,400 acre-feet, subject to the carryover storage rule set forth in paragraph 33 of the decree entered in Case No. 2013CW3056 WD1. The individual storage vessels of the South Reservoir Complex are interconnected and can be operated as a contiguous storage unit. 3.6.2. Legal Description of South Reservoir Complex Vessels.

3.6.2.1. Welby Reservoir. Welby Reservoir is an off-channel reservoir located adjacent to the South Platte River in the E1/2 of the NW1/4, SE1/4 of the NW1/4, and the N1/2 of the SW1/4 of Section 1, T3S, R68W of the 6th P.M., Adams County, Colorado. 3.6.2.2. Bambei-Walker Reservoir. Bambei-Walker Reservoir is an off-channel reservoir located between the Burlington Ditch and the South Platte River in the S1/2 of the NE1/4, NE1/4 of the SE1/4, NW1/4 of the SE1/4, SW1/4 of the SE1/4 of Section 1, T3S, R68W, 6th P.M., Adams County, Colorado. 3.6.3. Points of Diversion for the South Reservoir Complex.

3.6.3.1. The Headgate of the Burlington Ditch and Approach Channel. The Burlington Ditch approach channel, which diverts and delivers water to the original Burlington headgate is located on the east bank of the South Platte River, in the NE1/4 of the SW1/4, Section 14, T3S, R68W, 6th P.M., in Adams County, Colorado, 2,456 feet east of the west line of the southwest quarter and 2,347 feet north of the south line of said southwest quarter of Section 14. 3.6.2. Metro Pump Station. The Metro Pump Station is located near the Metro South Platte River Outfall. The Metro Pump Station diverts treated water from the wastewater treatment plant effluent stream at two points, both of which are located in the NE1/4 of the NW1/4, Section 12, T3S, R68W, in the 6th P.M., in Adams County, Colorado, approximately 90 feet from the north section line and 1,440 feet from the west section line. The Metro Pump Station diverts treated wastewater from Metro before it reaches the South Platte River. 3.6.4. Current capacity of ditches or pipelines used to fill the South Reservoir Complex. 3.6.4.1. Burlington Ditch, a maximum of 50 cfs. 3.6.4.2. Metro Pump Station, a maximum of 50 cfs. 3.6.5. Capacities of South Reservoir Complex vessels. The South Reservoir Complex vessels are complete and operational, and have the following capacities: 3.6.5.1. Bambei-Walker Reservoir. (1) Total Capacity: 2,057 acre-feet. (2) Active Capacity: 1,895 acre-feet. (3) Dead Storage: 186 acre-feet. (4) Approximate Surface Area at the High Water Line: 65 acres. (5) Maximum Depth: 41 feet. 3.6.5.2. Welby Reservoir. (1) Total Capacity: 1,496 acre-feet. (2) Active Capacity: 1,349 acre-feet. (3) Dead Storage: 147 acrefeet. (4) Approximate Surface Area at the High Water Line: 64 acres. (5) Maximum Depth: 32 feet. 3.6.5.3. South Reservoir Complex Totals. (1) Total Capacity: 3,553 acre-feet. (2) Total Active Capacity: 3,244 acre-feet. (3) Total Dead Storage: 333 acre-feet. 3.6.6. South Complex Storage Right – Amounts Made Absolute in Prior Proceedings and Amounts Remaining Conditional. Initial Fill: Absolute: 2,400 acre-feet. Total: 2,400 acre-feet. Refill: Absolute: 35 acre-feet. Conditional: 2,365 acre-feet. Total: 2,400 acrefeet. 3.7. North Reservoir Complex. 3.7.1. North Complex Storage Right Amount. 17,747 acrefeet, for the North Reservoir Complex, with the right to refill up to 17,747 acre-feet, subject to the carryover storage rule set forth in paragraph 33 of the decree entered in Case No. 2013CW3056 WD1. The individual storage vessels of the North Reservoir Complex are interconnected by pipelines and may be operated as a contiguous storage unit. Water delivered from the Fulton Ditch into Howe-Haller A Reservoir, Howe-Haller B Reservoir and Hazeltine Reservoir can be further delivered to Dunes Dam and Reservoir and Tanabe Reservoir. 3.7.2. Legal Description of North Reservoir Complex Vessels. 3.7.2.1. Howe-Haller A Reservoir. Howe-Haller A Reservoir is located in the E1/2 of the NW1/4 and W1/2 of the NE1/4 of Section 9, T2S, R67W, 6th P.M., Adams County, Colorado. 3.7.2.2. Howe-Haller B Reservoir. Howe-Haller B Reservoir is located in the SW1/4 of the SW1/4 in Section 3; the SE1/4 of the SW1/4 and S1/2 of the SE1/4, in Section 4; and the NE1/4 of the NW1/4 and the NE1/4 in Section 9 of T2S, R67W, 6th P.M., Adams County, Colorado. 3.7.2.3. Hazeltine Reservoir. Hazeltine Reservoir is located in the NW1/4, N1/2 of the SW1/4 and W1/2 of the NE1/4 of Section 3; and in the NE1/4 and N1/2 of the SE1/4 of Section 4, T2S, R67W of the 6th PM, Adams County, Colorado. 3.7.2.4. Dunes Dam and Reservoir. Dunes Dam and Reservoir is located in the SW1/4 of the NW1/4, and NW1/4 of the SW1/4 of Section 2 and in the E1/2 of the SW1/4, SE1/4, and S1/2 of the NE1/4 of Section 3, T2S, R67W of the 6th P.M., Adams County, Colorado. 3.7.2.5. Tanabe Reservoir. Tanabe Reservoir is located in the NW1/4 of Section 10, T2S, R67W, 6th P.M., Adams County, Colorado. 3.7.3. Points of Diversion for the North Reservoir Complex. The headgate of the Fulton Ditch as it currently exists is located on the east bank of the South

Platte River in the NE1/4 of the SE1/4, in Section 17, T2S, R67W, 6th P.M., Adams County, Colorado, at a point approximately 2,815 feet south and 145 feet west of the NE corner of said Section. 3.7.4. Current capacity of ditches or pipelines used to fill the North Reservoir Complex. The enlarged portion of the Fulton Ditch has a current capacity of 300 cfs.

3.7.5. Capacities of North Reservoir Complex vessels. Denver Water anticipates that the vessels will have the following capacities, subject to modification. 3.7.5.1. HoweHaller A Reservoir. (1) Total Capacity: 1,718 acre-feet approximately. (2) Active Capacity: 1,718 acre-feet approximately. (3) Dead Storage: 0 acre feet approximately. (4) Approximate Surface Area at the High Water Line: 48 acres approximately. (5) Maximum Depth: 54 feet approximately. 3.7.5.2. Howe-Haller B Reservoir. (1) Total Capacity: 4,490 acre-feet approximately. (2) Active Capacity: 4,490 acre-feet approximately. (3) Dead Storage: 0 acre feet approximately. (4) Approximate Surface Area at the High Water Line:170 acres approximately. (5) Maximum Depth: 48 feet approximately. 3.7.5.3. Hazeltine Reservoir. (1) Total Capacity: 5,626 acre-feet approximately. (4) Approximate Surface Area at the High Water Line: 40 acres approximately. (5) Maximum Depth: 24 feet approximately. 3.7.5.6. North Reservoir Complex Totals. (1) Total Capacity: 17,838 acre-feet approximately. (2) Total Active Capacity: 17,838 acre-feet approximately. (3) Total Dead Storage: 0 acre feet approximately. 3.7.6. North Complex Storage Right – Amounts Made Absolute in Prior Proceedings and Amounts Remaining Conditional. Initial Fill: Absolute: 0 acre-feet. Conditional: 17,747 acre-feet. Total: 17,747 acre-feet. Refill: Absolute: 0 acre-feet. Conditional: 17,747 acre-feet. Total: 17,747 acre-feet. 4. Claim for Finding of Reasonable Diligence. The following activities describe Applicant’s efforts to complete the conditional appropriation for the North and South Complex Storage Rights and apply the waters to a beneficial use as conditionally decreed, including expenditures: 4.1. South Complex Storage Right. 4.1.1. Completed annual operations and maintenance including annual dam safety inspections with State Engineer’s Office (“SEO”) at Miller Dam and survey for movement. 4.1.2. In 2017, Brown and Caldwell provided all labor, materials, and equipment for the North and South Complex Water Quality Improvement Project. The total project cost was approximately $3,063,000. 4.1.3. In 2021, Jacobs Engineering Group Inc was contracted to perform the North and South Complex Water Quality Study project. The total project cost was approximately $21,000. 4.1.4. Storage, diversion, and beneficial use of the South Complex Storage Right during the diligence period. 4.2. North Complex Storage Right. The following work, undertaken during the diligence period, was necessary to develop the diversion of water to and from the North Reservoir Complex: 4.2.1. Howe-Haller A Reservoir: 4.2.1.1. Repaired south slope of Howe-Haller A Reservoir that was damaged during a 2023 spring storm. The total project cost was approximately $71,800. 4.2.2. Dunes Dam and Reservoir. 4.2.2.1. Completed annual operations and maintenance including annual dam safety inspections with the SEO at Dunes Dam and survey for movement. 4.2.2.2. Denver Water began filling Dunes and Tanabe Reservoirs by gravity from the Fulton Ditch in February 2018. 4.2.2.3. In 2017, United Power Inc. provided construction services for required electrical instrumentation and control for Dunes Reservoir valve connection vault operation. The total project cost was approximately $26,000. 4.2.3. Hazeltine Reservoir: 4.2.3.1. In 2021, Concrete Express, Inc., provided mining services to remove material from Hazeltine Reservoir. The total project cost was approximately $5,927,000. 4.2.3.2. In 2022, Olsson Associates performed a hydraulic analysis of the Hazeltine Reservoir Spillway. The total project cost was approximately $14,000. 4.2.3.3. In 2022, Guarantee Electrical Contracting LLC provided estimating, constructability, and value engineering assessment services for the North Complex Hazeltine Pump Station Site Electrical Project. The total project cost was approximately $2,600. 4.2.3.4. In 2022, Alden Research Laboratory Inc. provided structural and architectural design services

for Phase 1 of the North Complex Hazeltine Pump Station and Complex EI&C Project. The total project cost was approximately $569,000.

4.2.3.5. In 2022, W.W. Wheeler and Associates provided engineering services to design and construct a spillway on the Hazeltine embankment adjacent to the South Platte River. The total project cost was approximately $241,000.

4.2.3.6. In 2023, Guarantee Electrical Contracting LLC provided all labor, materials, and equipment for the North Complex Hazeltine Pump Station Site Electrical project. The total project cost was approximately $2,105,000. 4.2.4. Tanabe Reservoir: 4.2.4.1. In 2017, Environmental Logistics provided all labor, materials, and equipment for the Tanabe Reservoir Fencing and Roadway Improvements project. The total project cost was approximately $373,000. 4.2.5. Work Related to North Reservoir Complex. 4.2.5.1. Storage, diversion and beneficial use of the North Complex Storage Right during the diligence period. 4.2.5.2. In 2017, United Power Inc. provided construction services for required electrical instrumentation and control for the North Reservoir Complex. The total project cost was approximately $7,000. 4.2.5.3. In 2017, Shannon & Wilson Inc. provided support for a geotechnical field exploration of the Hazeltine and HoweHaller B reservoir cells. The total project cost was approximately $19,000. 4.2.5.4. In 2017, RE Monks Construction LLC provided all labor, materials, and equipment for the Hazeltine/Howe Haller B Reservoirs temporary platform fill slope repair. The total project cost was approximately $533,000. 4.2.5.5. In 2018, JDR Engineering Inc. provided conceptual level civil, mechanical, and electrical engineering for the Interim Pump Station Study at the North Reservoir Complex. The total project cost was approximately $32,000.

4.2.5.6. In 2022, Garney Companies LLC provided Phase 1 Design Assistance Contractor Services for the North Reservoir Complex. The total project cost was approximately $154,000.

4.2.5.7. In 2022, EnSafe Inc. conducted forensic analyses necessary to identify the source of PFAS contamination of groundwater in and around the North Reservoir Complex. The total project cost was approximately $29,000. 4.2.5.8. In 2022, Carollo Engineers Inc. provided engineering services to estimate the treatment cost for uranium, selenium, and PFAS in a groundwater source. The total project cost was approximately $61,000. 4.2.5.9. In 2022, HRS Water Consultants Inc. provided hydrogeologic consulting to design a test of the North Reservoir Complex’s Mounding Drain. The total project cost was approximately $135,000. 4.2.5.10. In 2023, Clemson Engineering Hydraulics Inc. provided a scaled physical model of the North Reservoir Complex facility station design to ensure Hydraulic Institute Standard compliance. The total project cost was approximately $65,000. 4.2.5.11. In 2023, Pinyon Environmental Inc. provided environmental engineering for Mounding Drain Permitting Support at the North Reservoir Complex. The total project cost was approximately $70,000. 4.2.5.12. In 2023, HRS Water Consultants provided civil and hydraulic engineering for the Mounding Drain Gravity Design Project for the North Reservoir Complex. The total project cost was approximately $64,000. 4.2.5.13. In 2023, HRS Water Consultants provided hydrogeologic consulting services for the Mounding Drain Gravity Design Project for the North Reservoir Complex. The total project cost was approximately $110,000. 4.2.5.14. In 2024, United Power Inc. provided construction services for required electrical instrumentation and control for the North Reservoir Complex. The total project cost was approximately $59,000. 4.2.5.15. Denver Water continues to maintain active sand and gravel mining permits through the Division of Reclamation, Mining, and Safety on an annual basis for the mining operations remaining at the North Reservoir Complex and the Lupton Lakes Complex. 5. Claim to Make Amount Absolute for the North Complex Storage Right. 5.1. North Complex Storage Right. Denver Water claims 3,916.3 acre-feet ABSOLUTE for the North Complex Storage Right initial fill. The amount of 3,916.3 acre-feet was diverted at the Fulton Headgate and placed into storage during two periods in 2018 from February 13th through ¬¬¬¬¬March 8th and May 24th through June 3rd. The water diverted under the North Complex Storage Right was stored and then used by exchange or directly for the decreed beneficial uses. Denver Water may rely on accounting records of other diversions under the North Complex Storage Right to support its claim to make absolute. Daily data from Denver Water’s raw water accounting sheets was reviewed to verify the volume claimed absolute. Specifically, call data, authorized inflow data, and authorized storage data provided on the North Complex Reservoir Operations Accounting sheet used to calculate the volume of water stored in-priority under the North Complex Storage Right. A summary of the

accounting is attached as Exhibit B. 6. Names and addresses of owners or reputed owners of the land upon which any new diversion or storage structure, or modification to any existing diversion or storage structure is or will be constructed or upon which water is or will be stored, including any modification to the existing storage pool. Denver Water is not proposing any new diversion or storage structures that do not already exist, nor is Denver Water proposing modifications to any existing diversion or storage structure or the existing North and South Complexes. However, Denver Water is providing notice to the following entities because this application relates to certain structures and property in which the following entities may have a property interest. WHEREFORE, Denver Water requests the Court enter a decree finding Denver Water has exercised reasonable diligence in the development of the North and South Complex Storage Rights described herein, to continue the conditional portions of the North and South Complex Storage Rights water right in full force as decreed, to make 3,916.3 acre-feet of the North Complex Storage Right absolute, and for other such relief as this Court deems just and proper.
