Albertsons calls o Kroger merger in wake of rulings

Colorado waits for decision in antitrust case, but that may now be moot

A day after two judges in two lawsuits ruled against the proposed $24.6 billion supermarket merger, Albertsons Companies said Dec. 11 it would end its merger agreement with Kroger.

“Given the recent federal and state court decisions to block our proposed merger with Kroger, we have made the di cult decision to terminate the merger agreement. We are deeply disappointed in the courts’ decisions,” Alb-

ertsons CEO Vivek Sankaran said.

At the same time, the Idaho grocery chain, which owns 105 Safeway and Albertons grocery stores in Colorado, also led a lawsuit against Kroger for breach of merger agreement because the larger supermarket chain “ignored regulators’ concerns,” the company said in a statement.

As part of the merger proposal, if the deal failed to go through, Kroger must pay “an immediate $600 million termination fee” to Albertsons, the company said. e company is also seeking billions of dollars in damages from Kroger as it seeks to regain value for shareholders.

Kroger operates 118 King Soopers and 32 City Market stores in Colorado. e company called Albertsons’

claims “baseless and without merit” and looks forward to another day in court, said a Kroger spokesperson.

“Kroger refutes these allegations in the strongest possible terms, especially in light of Albertsons’ repeated intentional material breaches and interference throughout the merger process. is is clearly an attempt to deect responsibility following Kroger’s written noti cation of Albertsons’ multiple breaches of the agreement, and to seek payment of the merger’s break fee, to which they are not entitled,” the company said.

On Tuesday, a federal judge in Oregon overseeing the Federal Trade Commission antitrust case issued a preliminary injunction to give federal regulators additional time to consider implications

of the merger. at temporarily halted the merger from moving forward. A judge in a second lawsuit in the state of Washington issued a permanent injunction later that day.

Colorado’s trial opposing merger

Colorado already had a preliminary injunction to block the merger in the state. Attorney General Phil Weiser had sued the companies in February alleging that the two grocery chains already demonstrated anticompetitive behavior during the King Soopers worker strike in January 2022, when management discussed not poaching striking workers or marketing to King Soopers pharmacy customers who were trying to avoid crossing the picket line.

Final price tag of race in CD8: $40 million

About $24 million was spent to benefit Caraveo, who lost to Evans by about 2,500 votes

e nal price tag of the race in Colorado’s highly competitive 8th Congressional District this year was about $40 million, with three-quarters of that sum being spent by super PACs.

Most of the money — or about $24 million — was spent to bene t incumbent U.S. Rep. Yadira Caraveo, a Democrat. But it wasn’t enough, as she lost to Republican state Rep. Gabe Evans by about 2,500 votes, or about 1 percentage point. Caraveo’s campaign raised about $8.1 million for her reelection bid, spending all but about $90,000 of that through Election Day, according to her campaign nance report led ursday with the Federal Election Commission. e report re ected fundraising and spending from Oct. 17 through Nov. 25.

Caraveo spent more than $2 million in the nal weeks of the campaign, most of that on advertising.

Evans’ campaign raised and spent about $2.5 million to beat Caraveo. at includes $642,000 in the nal weeks of the contest, with most of that money going to advertising. e campaign paid

Evans $3,000 in salary in November, and still owed $128,000 to vendors on Nov. 25, mostly for victory bonuses.

e campaign had about $88,000 left in cash on Nov. 25.

e single-biggest super PAC spender on the contest was the Congressional Leadership Fund, which is tied to House Speaker Mike Johnson, a Louisiana Republican. e group dropped about $6.7 million on the contest, the outcome of which helped Republicans keep their narrow majority in the U.S. House. House Majority PAC, a Democratic group, was the second-biggest super PAC spender on the race, at $6 million. Caraveo also bene tted from $2.3 million in spending by Fairshake PAC, a group that

Veteran news innovator to helm CCM

Brooke Warner brings vast experience in digital transformation

Brady Monzingo dismisses the smoke and haze of a re and focuses instead on the main reason he wants to be a reghter.

“Yeah, res can be a little scary,” said the 18-year-old Monzingo, whose grandfather and uncle were re ghters. “But it’s the type of job where you don’t have to sit at a desk all day and you can get out and help people.”

“Being a re ghter just sounds like a whole lot more fun than the usual job,” he said ursday.

Emma Hurley quickly rattles o the reasons she wants to be an arson investigator.

“ ere are lots of hands-on things you are able to do….like gather ngerprints, study blood splatter and which kind of accelerates are used to start res.

“It’s just so cool,” said Hurley, who is also 18. “I can’t wait to get out there and solve an arson.”

Monzingo and Hurley are both students at FutureForward at Washington Square, a ve-year-old facility that unies all Career and Technical Education – or CTE – programming across Adams 12 Five Star Schools. e school’s curriculum gives students a competitive advantage in getting a technical education and good paying job, say school o cials.

Monzingo and Hurley are enrolled in the school’s specialized Fire ghting 1&2 and Fire ghting 3  courses which o er students on-the-ground experience in ghting res. On ursday, their classmates were with veteran instructors in a unique live re training exercise.

out the ames. Later, Hurley and other CSI students conducted a post-incident investigation of the cause of the blaze.

All was done under the watchful eyes and hands-on instruction of Joel Sherry, Kyle Naas and Doug Finley. All three are retired re ghters from re departments in the the north metro area.

Finley said the retirees recognize the importance of getting the next generation of re ghters on the streets as retirements cut into the ranks of local re crews.

“When these students go through the type of programs at FutureFoward, they get a leg up on getting certi ed to be a re ghter in Colorado,” Finley said. “Local re departments will say ‘Hey I remember him from the classes in ornton’ and that gives them a heads up on who they want to hire.”

Students at FutureForward will learn

re ghter safety, re behavior, building construction, re ghter personal protective equipment, re streams, re control, re detection, alarm and suppression systems, loss control and communications, according to the school.

Students, when nished, will also obtain both their CPR and HAZMAT certications in the Fire ghting 1 program. e FutureForward re ghting program is supported by the ornton Fire Department, North Metro Fire Rescue District and other neighboring re departments, say school o cials. e re ghting curriculum is in its rst year at FutureForward which aims to teach students practical education they can use almost immediately, said Principal Marvin Lewis.

“We want our students to be out in the community, helping out in elds that will help others,” Lewis said.

Westminster councilor targets puppy sales

Plan would target puppy mills

A Westminster city councilor is pushing for an ordinance that would ban the sale of all animals in the city.

Councilor Amber Hott said the proposed new law is aimed at stopping local pet stores from selling puppies and kittens from mass-produced inhumane puppy and kitten mills. e ordinance would also likely cover birds and other larger animals who are kept in cages in pet stores.

“I do think it goes beyond dogs and cats,” Hott said. “I just think this is the exploitation of lives for pro t.”

Hott made her comments after hearing from a group called Puppy Mill Free Westminster, whose members lobbied councilors for an all-encompassing pet sale ban.

“Our mission is to actively engage with the Westminster City Council to request a humane ordinance that would accomplish this goal,” according to the group’s

website. “If you believe in the motto, ‘Adopt, Don’t Shop’, join us in our e orts to make Westminster a more compassionate place for our furry friends.”

Other councilors appeared open to considering an ordinance outlawing animal sale in the city.

“It would be good to represent a city with the right ordinance in place,” Councilor Claire Carmelia said.

Westminster currently has three pet stores, none of which sell dogs or cats, said City of Westminster spokesman Andy Le said in an email.

e city’s two PetsMart and Petco also partner with the Humane Society to host adoption fairs, said Le.

e city’s pet limit ordinance limits residential homes to no more than 4 dogs and/or cats, which would preclude puppy mills from Westminster, he said. e City’s Animal Control unit also works closely to adhere to the state’s Pet Animal Care and Facility Act, which regulates hobbyist breeders, added Lee.

City sta members gave no indication when they might produce an ordinance for the city council to consider.

This is one article you’ll want to read at http://RealEstateToday.substack.com, where the buyer and seller settlement statements at right appear much larger on your computer screen. I have anonymized the actual closing statements from a property I sold for $698,000 this year which had an HOA, a seller loan to pay off, and a buyer loan to fund. This should cover most of the expenses that a buyer or seller might encounter when closing on a home sale or purchase.

We’re blessed in Colorado when it comes to the cost of buying and selling real estate. In many states, there are transfer taxes imposed by state or local jurisdictions, but not here by Colorado or in metro Denver. Also, in some states, both buyer and seller need to hire a lawyer, not just a real estate agent to complete a transaction. Long ago the State of Colorado passed a law giving licensed real estate brokers limited legal authority to explain state approved contracts, so it’s rare for a client to spend money on a lawyer. The exception is when a buyer purchases a new home, because builders have lawyers create their own contracts, and we would be practicing law without a license if we were to interpret those contracts and their provisions for our buyer.

On this seller’s settlement statement, the HOA dues are also pro-rated to the date of closing, and since the closing was on the 30th of August, the statement refunds two days’ worth of HOA dues, which the seller had paid on August 1st.

The biggest deductions for the seller (other than property taxes) are the real estate commissions and the title insurance policy. The purchase contract specifies whether the buyer or seller will pay for the buyer agent’s commission and the owner’s title insurance, but it is still common for the seller to pay both agents’ commissions plus the title policy, as in this case.

There are HOA fees which can also be paid by either party but are typically paid by the seller. Typically, the title company which is closing the transaction pays those fees (for status letter, documents, transfer fee, and more), so those fees are shown here as being reimbursed to the title company rather than paid to the HOA.

statement. If the buyer were paying cash, he or she would have very few expenses other than recording the deed for $10. The biggest costs associated with buying the home are related to the loan, especially if the seller has paid the buyer’s real estate agent and paid for the owner’s title policy.

So let’s look at the seller’s settlement statement first. Not all the debits on this statement are considered the cost of selling. For example, the property taxes for the current year, pro-rated to the date of sale, are not a cost of selling. Since property taxes are paid in arrears (not due until April of the following year), you’re always going to find that pro-ration of property taxes on the settlement statement. If selling in December, that’s almost an entire year’s tax bill. In January through April, if your taxes haven’t been paid, you will find the full year’s taxes plus a portion of the current year’s taxes deducted from your proceeds.

If that’s an overcharge, the seller will get a check for the surplus from the title company within a few weeks.

The title company will also escrow a few hundred dollars to pay the final water and sewer bill (unless water is included in the HOA dues), and will refund the excess after they pay the final water/sewer bill. This is the only utility which the title company pays and transfers on your behalf, because an unpaid water/sewer bill would result in a lien against the property, and the title company’s job is to assure the buyer that they are getting the home clear of any liens.

Those loan costs are large and varied, as is detailed in the buyer’s settlement statement above. There’s the origination fee, from which the loan officer is paid. There is also the cost of appraising the home (in this case paid prior to closing), underwriting, credit report, flood certification, and a couple other lesser fees.

The buyer’s lender wants to be sure the home is insured, so you see that debit on the last line of the buyer’s settlement. (A cash buyer might choose not to insure.)

Not only does the buyer have to pay all those expenses, the buyer is charged for a title policy that covers the lender for the amount of the loan ($500 in this case) and a loan closing fee ($450). The lender will probably want to escrow for property taxes and insurance and will require a deposit for both those expenses that will vary depending on when in the calendar year the clos-

There is one big credit which the buyer receives from the seller. The funds which were deducted from the seller’s proceeds for the current year’s property taxes are credited to the buyer, not paid to the county. That’s because the buyer will paying the current year’s entire property tax bill when it becomes due. You see that credit — almost $3,000 — near the top of the above settlement statement.

There could also be a concession for repairs that the seller agreed to in the inspection resolution, although not in this case. Sometimes that concession takes the form of a price reduction, which does not appear as a line on the settlement statement.

Notice that the closing services (notary) fee of $360 is shared 50/50 in this case, as is commonly done, $180 for each party.

FHA Loan Limits Have Been Raised

Each year, the FHA raises the limits on its federally guaranteed loans. The limits are based on the median sale price of homes in each county.

Because the Denver metro area’s median home price was calculated by FHA at $710,000, the loan limit for single-family homes was raised to $816,500 this year. That is the loan limit, not the purchase price, although FHA only requires a 3.5% down payment.

The loan limit for a duplex/2-family home was raised to $1,045,250. For a three-family home it was raised to $1,263,500, and for a four-plex, it was raised to $1,570,200.

Boulder County’s limits in each category are slightly higher, starting at $856,750 for a single-family home.

In the country’s lowest-cost counties, the loan limit is $498,257 for a single-family home, and in the highest-cost areas (Alaska, Hawaii and the U.S. Virgin Islands), the limit is $1,724,725, rising to $3,317,400 for a 4unit property. (Whether 1-unit or 4-units, the borrower has to live in the subject property.)

Non-FHA (“conventional”) loan limits are slightly lower for 2024. In most areas, the conforming conventional loan is limited to $766,550. Alaska, Hawaii and high-cost areas have a conforming conventional loan limit of $1,149,825 for a single-family home. FHA loans are attractive because they only require a 580 credit score (as low as 500 with a 10% down payment), and your debt-toincome ratio only needs to be below 57%.

The biggest negative of FHA loans is that they require a mortgage insurance premium (MIP) of 1.75% at closing, plus an annual premium which varies based on your loan-tovalue ratio. MIP is for the life of the loan, unless your downpayment is at least 10%, and remains in effect no matter how low the loan-to-value ratio falls (i.e., how much your equity increases). If your down payment was 10% or higher, the MIP goes away after 11 years. Otherwise, most 15- or 30-year FHA mortgages should be refinanced once the owner can qualify for a conventional loan, hopefully at a better interest rate, to get rid of the MIP.

Finding cold weather shelter for homeless

Locations across region o er unhoused folks a warm place to stay

During cold weather in the Denver region, people without homes may struggle to nd a safe, warm place to go — and that can be a matter of life and death.

Unhoused Coloradans face the risk of hypothermia, a sometimes-deadly condition caused by exposure to cold temperatures. Staying outside also can cause frostbite, a freezing of body tissues that can lead to amputation.

e nonpro t Severe Weather Shelter Network, a program that kept people warm in a large swath of the Denver metro area, recently shut down permanently. But several programs in Adams, Arapahoe, Denver and Je erson counties, and beyond, o er shelter.

Here’s a look at where you may be able to nd a warm place amid cold weather.

Adams and Broomfield counties

In a large part of the north metro area, the Severe Weather Activation Program, or SWAP, provides hotel vouchers to the unhoused.

e program generally activates when temperatures reach 32 degrees and wet, or 20 degrees and dry, according to the website for Brighton-based organization Almost Home.

People with documented ties to Broom eld or Adams County may qual-

O cials in Adams also o er transportation to help people reach a safe destination.

“Adams County believes that transportation should not be a barrier to lifesaving shelter. We o er bus passes and no-cost Lyft rides through our municipal and nonpro t navigators to help low-income community members access necessary resources,” said Nikki Kimbleton, a spokesperson for Adams County. “For those who need transportation to stay with friends or family in another community, we can purchase bus, plane or train tickets to reunite folks with friends, family and housing.”

Thornton

When temperatures drop below 32 degrees for daytime highs and below 20 degrees for nighttime lows, ornton opens a “warming center” at the Margaret Carpenter Recreation Center at 11151 Colorado Blvd. — near 112th Avenue — according to the city.

When active, the warming center is open from 9 p.m. to 5 a.m. Monday through Friday and from 6 p.m. to 8 a.m. on Saturday and Sunday, according to Gary Hobbs, deputy chief of administration with ornton Fire Department.

“ is program does not o er services such as warm meals, showers, bunk rooms, storage for belonging, etc., that are typically provided by emergency shelters,” Hobbs wrote in a statement.

“If a community member requires longer-term emergency sheltering, sta will work to nd a sheltering solution. Typically, this includes relocating the person(s) to a shelter in another jurisdiction or working to acquire a SWAP voucher.”

Anyone in need of a place to warm up can drop in without an appointment anytime the warming center is operational, Hobbs said.

Westminster

Westminster activates a cold-weather shelter when weather is projected to be zero degrees or sustained wind chill below zero degrees for six hours or more, said Andy Le, a spokesperson for the city. e shelter will stay open for at least 48 hours, Le said.

e city converts e MAC recreation center — at 3295 W. 72nd Ave., a short walk west of Federal Boulevard — into a temporary shelter.

You can call ahead of time to check availability at 303-426-4310, according to the city.

Hotel vouchers are also part of the local strategy for addressing homelessness.

“Our Homeless Navigator program helps distribute hotel vouchers provided by Je co and Adams County for people experiencing homelessness,” Le said. “Westminster provides additional vouchers when the weather drops below 10 (degrees) to provide additional support for our most vulnerable population.”

Northglenn

ere are not any city-managed coldweather shelters in Northglenn, said Diana Wilson, spokesperson for the city.

But the Crisis Response Unit, or CRU, is available by appointment or during open o ce hours from 9 a.m. to noon on Fridays at the Northglenn Justice Center’s west door entrance at 50 Community Center Drive — east of Huron Street and 112th Avenue.

and 60th Avenue — and the Bison Ridge Recreation Center at 13905 E. 112th Ave., near state Highway 2, according to Knoll. Each location has capacity for up to 30 beds and o ers kitchen and sanitary facilities, Knoll said. is capability is intended to meet the short-term — no more than three nights or four days — needs of up to 30 residents per location in the event of various emergency situations, Knoll said.

“Once the location, timing and capacity have been determined, Community WellBeing division sta and Police Department sta will contact known people experiencing homelessness and assist with transportation, if needed,” Knoll said. e following criteria trigger activation of at least one shelter, Knoll said. e same criteria will be used to activate an overnight shelter if one of the below scenarios occur between the hours of 7 p.m. and 7 a.m.:

• Anticipated cold below 10 degrees

• Wind chill below zero

• Winds or blizzard conditions

• “72/48/24/12-hour alerts” and warning from the National Weather Service. At least one of the criteria needs to be met — or anticipated — for shelter to be activated, Knoll said.

Brighton

e City of Brighton does not have a standing cold-weather shelter program, said Jared Putnam, a spokesperson for the city

“Almost Home is the only such program in Brighton,” Putnam said.

Commerce City

Commerce City operates two emergency shelters when conditions warrant, said Kristen Knoll, a spokesperson who provided information for the city.

e city’s two shelter locations are the Eagle Pointe Recreation Center at 6060 Parkway Drive — near U.S. Highway 85

“At this time, we do not have any designated cold weather or warming shelters under the city’s operation,” said Juan Arellano, a spokesperson for the city. e city encouraged people to reach out to Hope at Miracle House in Fort Lupton, Almost Home, or United Way of Weld County, or call 2-1-1 for listed sheltering services that may be nearby.

Northglenn giveway finds homes for recycled bicycles

Christiano Dahl’s bike was stolen this past summer, so he and his Dad came to Northglenn’s Stonehocker Farm Dec. 7 to kick tires and look for a replacement.

“As a single father with a limited budget, there’s not a lot I’d be able to do about it,” his father Jesse said. “It’s a perfect program.”

Northglenn sta – including police and sanitation workers – collect discarded or lost bicycles throughout the year, before turning them over to a group of volunteer bike mechanics. ose volunteers x them up and then give them away, free of charge. ey found new homes for 623 refurbished bikes in 2023.

“Did you see the Denver Broncos bicycle?” Volunteer Dave Slowey asked. “I worked on it myself. It was covered in rust but it’s in good shape now.”

e city gives the bicycles away at events throughout the year, usually one per month during the summer and one big giveaway just before Christmas.

Noel Northglenn kicks o holiday season

Volunteers brought 178 bikes to the farm for the pre-Christmas giveaway, ranging from toddler balance bikes to adult-sized cruisers.

Northglenn resident Ricky Noble said his daughter picked up a new bike last year.

“We still expect the court to engage in its work and to rule,” Weiser said. “If the parties want to make a showing that somehow this merger is completely dead, that is their burden to make. But unless the judge concludes that, this merger challenge is still alive in the Colorado courts and, for that matter, in other courts insofar as the case could still be appealed.”

But Weiser, who said he brought the case to court after a 19-city listening tour to hear concerns of locals, said he has a good feeling about Colorado’s case.

“I think we can say that the statements Albertsons is making are supportive of our case and we can say for sure that the two rulings are very supportive of our case,” he said. “I do not believe this merger is going to happen.”

Lakewood

Lakewood’s homelessness navigation center at 8000 W. Colfax Ave. — a short walk west of Wadsworth Boulevard — serves as the city’s severe-weather shelter.

When the shelter is open, it operates from 7 p.m. to 7 a.m. the next morning, said Stacie Oulton, spokesperson for Lakewood.

ose needing shelter do not need to arrive until the 7 p.m. opening, Oulton said.

“No registrations or referrals are required for shelter services that are available to adults, and service animals/pets may be accommodated if they do not disrupt the comfort or safety of other guests,” Oulton said.

“Once the shelter is open and has reached capacity, the contractor may coordinate transportation to other locations,” Oulton added.

e city will consult the National Weather Service for two thresholds that may activate the shelter: when overnight low temperatures are forecast to be 32 degrees or lower and arrive with active, accumulating snowfall; or overnight low temperatures are forecast to be 20 degrees or lower with or without active snowfall, Oulton said.

“Lakewood retains the discretion to activate or not activate outside of these thresholds, but decisions generally are based on these weather conditions,” Oulton said.

Wheat Ridge

ere are no programs o ering coldweather shelter in Wheat Ridge for people experiencing homelessness, but the city participates in a “countywide sheltering model,” said Amanda Harrison, spokesperson for Wheat Ridge.

“Je erson County Public Health determines shelter activation based on a centrally located National Weather Service station and will alert all concerned parties in the region, including the homeless navigator at Wheat Ridge,” Harrison said. e “best way to stay up to date is to subscribe for email updates about activations.”

e public can subscribe to the Heading Home newsletter at headinghomejeffco.com, Harrison said.

Wheat Ridge navigators give their clients — and anyone else seeking shelter — bus tickets, Harrison said.

Evergreen

e EChO Shelter in the Evergreen area is an overnight-only shelter open each night from 6:15 p.m. to 7 a.m. from October to late April, said Tim Clancy, the shelter manager.

All shelter guests must rst be registered by an EChO case worker at the EChO o ce. To make an appointment to register, call 303-670-1796.

Shelter guests are welcomed with services such as dinner, shower, laundry, and a quiet, safe place to sleep, and in the morning, they are provided a breakfast and a sack lunch to go, according to Clancy.

All EChO shelter guests meet with a case worker for further needs, he added.

When EChO is closed, people needing shelter should call the sheri non-emergency line at 303-277-0211, according to Clancy.

Englewood-Littleton-Sheridan area

Homelessness Awareness and Action Task Force, or HAAT Force, and Movement 5280 will be the primary overnight shelters for the Tri-Cities area, according to the City of Englewood.

HAAT Force is to serve as the main shelter, with Movement 5280 serving as an over ow shelter, according to the city. ey activate under the following conditions, according to the city:

• e shelter is activated on severeweather nights from Oct. 1 through April 30 when temperatures are expected to reach 20 degrees or below with no active moisture, or 32 degrees or below with active moisture.

• Temperature and moisture must be projected for three hours or more during the overnight hours from 6 p.m. to 6 a.m.

• Moisture is de ned as predicted rain or snowfall. It may not include previously fallen moisture remaining on the ground.

Clients can call the hotline — 720-4837864 — daily at 9 a.m. to get the weather determination, according to the city.

Advance.

During cold-weather activation, no one will be turned away, according to Advance’s website.

To receive alerts about cold-weather activations at the center, text “Advance” to 38276.

e center sits a few blocks north of Colfax Avenue and a couple blocks west of Interstate 225 — north of Children’s Hospital.

At Aurora Day Resource Center, overnight cold-weather sheltering starts at 5 p.m., and there is not a cuto time for when people need to show up in order to get shelter for the night, according to Matt Brown, who served as a spokesperson for the city when Colorado Community Media reached out.

At the center, the threshold of weather conditions that trigger the cold-weather shelter to open is 20 degrees and below, or cold and precipitating, Brown said. e center will be providing a coldweather shelter program through the end of the year, and the city is looking at alternatives for sheltering in the new year, Brown said.

“If there is an alternative cold-weather sheltering option, the ADRC will no longer operate as an emergency coldweather shelter but will still operate day services. No matter the outcome, emergency cold-weather sheltering will be provided,” Brown said.

Denver

During the cold-weather months, Denver shelters generally see more people coming indoors and often provide overow capacity to help meet the need, according to the city.

The DeAngelis Center Foundation offers a variety of trainings and services supporting school and community safety. Our mission is to teach proper response and past lessons learned to help prevent and avoid traumas. Helping to create more beautiful futures for our children and every person living in our community.

If open, registered clients must call to reserve their spot between 10 a.m. and noon, or until full, for shelter that night. Reservations for unregistered clients “begin from 1 p.m. to 2 p.m.” only if rooms are still available, according to the city.

e hotline will be transferred to Movement 5280, which will respond to requests for shelter from 2-5 p.m., according to the city.

Movement 5280 will open the doors for shelter at 6 p.m., and doors will be closed for the night at 9 p.m., according to the city.

HAAT Force sits at 4300 S. Lincoln St., o Quincy Avenue near Broadway, in Englewood. Movement 5280 is located at 3190 S. Grant St., o Eastman Avenue a short walk east of Broadway, also in Englewood.

Generally, there are no shelters in Centennial, according to Allison Wittern, a spokesperson for the city.

Aurora

e Aurora Day Resource Center is available for shelter amid severe lifethreatening weather. e center is located at 13387 E. 19th Place and serves as an overnight shelter for adults 18 years or older on a rst-come, rst-served basis, according to the City of Aurora. e center can accommodate close to 200 people per night and is managed by

Families in need of shelter should call e Salvation Army Connection Center at 303-295-3366, according to the city. According to the city, Denver opens the extra shelter when capacity is exceeded in the existing homeless shelter system and one of the below criteria is met:

• Forecasted overnight low temperature of 25 degrees or below or

• Two inches or more of snow are forecasted for Denver; existing snow accumulation will also be taken into account, and activation will depend on amount and city’s ability to clear snow from roads, sidewalks, and bus stops; or

• A cold weather advisory, extreme cold watch, or extreme cold warning is issued for Denver by the National Weather Service.

In his Dec 5th column Bill Christopher penned another anti-Trump, pro-crime missive to the Westminster community. It was especially tone-deaf and of poor timing, considering: An illegal immigrant with ve previous DUI convictions mowed down a Broom eld mother and her 16-year-old son and was only recently convicted within the last few weeks. He was traveling between 80 and 100 miles per hour in a 40 mph zone, according to the 17th Judicial District Attorney’s O ce. Imagine how the family and friends felt after reading Bill’s column ridiculing the citizenry’s understandable concerns about their safety and well-being in regard to illegal immigrants who are causing harm to members of the community.

What’s the rest of the story?

Colorado has gone from holding the top spot in the nation for vehicle theft down to the 4th spot. Yes, Colorado is still the 4th worst in the nation! I urge Bill to take a closer look at what is happening around us.

Bill also praised the drop in crime but failed to add enough context to how incredibly bad the crime still is. He touted the downward trends, speci cally citing the drop in motor vehicle thefts.

Take heed - “Operation Aurora” is not that far o

nyone who thinks President-elect Donald Trump is simply “blowing smoke” at implementing an aggressive deportation program is bad wrong.

Remember, he is the one who said immigrants are “poisoning the blood of America.” It is being planned as we speak with two of the most hawkist anti-immigrant appointees in Trump’s soon-to-be cadre of henchmen.

Policy-maker Stephen Miller and “Border Czar” Tom Homan are scary people. ey are dead serious in rst going after immigrants who are criminals. en it remains to be seen what group will be targeted next, but it will come.

e logistics of this mass deportation are mind-boggling along with the procedural requirements. Remember, Trump has stated that he will use military resources if needed to enforce his campaign promise.

Also, the state of Texas is lining up to be a key staging or holding area once immigrants are arrested. Governor Abbott has already o ered Trump a sizable tract of land owned by the State of Texas near the Mexican border. So, get ready. January 20 is right around the corner and this round-up will commence early after Trump is sworn in.

Let’s hope that someone in his administration has thought about the negative impacts of losing employees across the country who carry out manual labor like construction work, landscaping, sanitation work, oil extraction, roo ng and many more lines of work. Who will ll those vacancies?

Senators address a troubled U.S. Supreme Court

As re ected in one opinion poll after another, the U.S. Supreme Court does not enjoy much credibility or trust today from the American public. Ethics scandals involving Justices Clarence omas and Samuel Alito Jr. plus rulings from the 6-3 conservative supermajority that have overturned legal precedent have accelerated the public’s disdain for the highest court in the land.

ose in Congress who care about improving the court’s image and credibility have struggled with how best to tackle this 800-pound gorilla.

e latest action comes from two U.S. Senators who have introduced a constitutional amendment that would establish term limits for future Supreme Court justices. e amendment has been introduced by Senators Peter Welch (D-Vermont) and Joe Manchin (I-West Virginia) which calls for 18-year term limits on future Supreme Court appointees. e current nine members of the court would not be a ected. e senators’ action was the easy part.

In order to achieve a Constitutional Amendment, approval is required of two-thirds of both the House and Senate. en, at least three-fourths of the states or a convention of two-thirds of the state legislatures must approve the amend-

Manchin, who is leaving the Senate at the end of this year, stated “the regular appointments would inject new energy into the court.” He called the amendment a necessary “shot of adrenaline” on a court where lifetime appointments can lead to tenures of three decades or more.

Is the proposed Supreme Court term limits legislation a long shot?

Just about any Constitutional Amendment is a long shot given the height and number of the hurdles to be jumped. While currently, the Democrats in Congress would likely favor such an e ort, the Republican members would probably go with the status quo given their supermajority of conservative Justices on the bench.

On the other hand, the American public could nd favor in such a change restricting the tenure of Justices. It could also address the current issue of the age of Justices and whether they are functioning on all eight cylinders.

Recent national polls indicate the American public favors term limits for the Justices. e Annenberg Constitution Day Civics Survey dated September 2024 showed that about two-thirds of Americans support imposing term limits. e idea of lifetime appointments that our Forefathers approved has to be questioned. ey didn’t know that life expectancy would change so much over the life of our Constitution.

Plus, does the concept of a lifetime appointment for any position in any line of

work seem realistic in this day and age? I would support the change that Senators Welch and Manchin have launched. If it does “get legs”, it will be a lengthy drawn-out process. However, it would be worthwhile. Something needs to be done to re-center the members of the Supreme Court.

Acting director of Parks, Recreation & Libraries appointed

By now, this is not “hot o the press” news, but still worth sharing with readers about the change of leadership involving the Westminster Parks, Recreation & Libraries Department.

With the exit of Tomas Hererra-Misler, an interim appointee was needed. City Manager Jody Andrews selected Aric Otzelberger as the interim appointee.

Aric comes from the Community Services Department where he is Operations Manager supervising the Building Division, Code Enforcement and Parking Enforcement. He has had two stints with the City of Westminster with the rst one in 2006-2015 serving in the City Manager’s O ce under Brent McFall. He returned to Westminster, working in the Community Development Department since 2017. His several years of Westminster experience serve him well in how the organization is run, the mission and goals of the city, budgets and knowing the “players.” e previous head of the department left some problems and issues which Mr. Otzelberger has already addressed initially internally.

Understanding the taxes that may apply after death

BMany people worry about the potential tax implications their families may face after their passing. Fortunately, for most individuals, the tax burden is not as heavy as anticipated. Federal Estate Tax

e federal estate tax applies to the value of an individual’s estate at the time of death. However, most people won’t need to worry about this tax due to a generous exemption amount. As of 2024, estates valued at less than $13.61 million are exempt. is means that if your estate falls below this threshold, no federal estate tax will be due.

For those with larger estates, there are strategies to minimize tax exposure. For instance, assets left to a spouse or charities may be exempt. However, it’s important to note that this exemption will be reduced to approximately $7 million on January 1, 2026, so planning ahead is essential.

While Oklahomans have led lawsuits to rescind this mandate, the state’s request for proposals to purchase the needed Bibles for the classrooms was very tightly drawn. e description of which Bibles quali ed was so limiting that one of the few qualifying Bibles was a $60 edition endorsed by President-elect Donald Trump. Talk about mixing church and state. is takes the cake. But let’s remember Oklahoma is not only in the “Bible Belt”; they are also immersed in “Trump Country.”

Attention, attention tra c/red light cameras coming to Federal Heights

e Federal Heights City Council has unanimously approved an ordinance to add tra c cameras at four key locations. eir action intends to slow down tra c and help prevent fatal vehicle crashes. e “automated vehicle identi cation system” will track drivers at the intersections of Federal Boulevard and Pine Street, Federal Boulevard and 92nd Avenue, 92nd Avenue and Tejon Street and 84th Avenue and Huron Street.

Even though Federal Heights police frequent these key locations regularly, the equipment will be “working” 24 hours a day. Violators will be faced with paying nes of up to $40 for speeding, $80 in school zones and $75 for running a red light.

I say “three cheers” for the Federal Heights Council to move ahead with this tra c enforcement tool. I drive 92nd Avenue all the time and it is a speedway.

As their City Manager Jacqueline Halburnt pointed out, it’s not just speeders in Federal Heights. It is a chronic problem throughout the Denver metro area.

With that in mind, more towns and cities should implement such enforcement measures. I never have understood why Westminster and other north area municipalities have overlooked this enforcement tool.

Hopefully, it does not take more horrendous tra c deaths to motivate other local governments to evaluate this speeding and red light enforcement technology.

TULA Life Balanced is an on-demand personal and family assistance platform that operates similarly to companies like Uber. TULA matches clients with an assistant to complete tasks ranging from grocery shopping and laundryto meal prep.

Having a to-do list to complete when people get home from a regular job can be overwhelming, and Trask said TULA aims to give busy people and their families a little more time in their days to do what matters most to them.

“(It’s) to create a way that people could ask for help without feeling kind of guilty about it,” Trask said.

While the assistants — who are fully vetted — are available year-round, Trask said the business sees about a 30% to 40% increase in services starting in October to mid-January.

During the holiday season, TULA Life Balanced can source gifts, wrap them and deliver them. Also, based on certain preferences, the company can create a list for the client to be able to quickly make purchases.

e clients pay for the materials, whether they provide wrapping materials or the assistants stop at a store to pick up supplies.

Although she is the co-founder of the business, Trask loves to wrap gifts and said she is more than happy to take gift-wrapping requests.

“It’s kind of like a nice break to just wrap somebody else’s gift beautifully,” Trask said. “What better gift to give than somebody getting the gift of time back?”

Always looking for ways to be creative, Kammy Witulski, a Highlands Ranch resident, also loves gift wrapping for others and started her home business, Wrap Paper Scissors, about a decade ago.

Witulski used to be an area manager for a high-end retail company in which one of the services provided was gift wrapping. After she had her daughter, Witulski felt she needed to take a few years o .

Trask agrees that measuring before wrapping is the foundation to beautiful gift wrapping. Once the paper is picked out, measure straight lines before cutting the paper to ensure a clean look. It’s also helpful to have all of the supplies in one place instead of making multiple trips to stores as you are wrapping.

One of the most important tips from Trask and Witulski is to not leave gift wrapping to the last minute and to take 10 to 15 minutes to wrap gifts as you purchase them. And don’t forget about those gifts you’ve been hiding in the closet, attic or under the bed.

“ at’s much easier to do than to try to block out like three, four hours on Christmas when you’re already trying to clean your house, cook for company or maybe you’re having a party,” Witulski said.

Charles Dickens’“A Christmas Carol” is largely responsible for so much of what Christmas looks like in modern times. ere have been so many interpretations of the story on screen and stage and for Miners Alley Playhouse, it’s all about nding the right balance of humor and heart.

“ is is our fth year doing the show with mostly the same cast and crew and this year we’ve made the show even more Christmasy,” said Len Matheo, Miners Alley artistic director. “We’ve adjusted the script a bit and tightened it and made it funnier. ere’s more of a wink in this version — even as it gets serious, at any moment, something funny is going to happen.”

Frisch spent $1.7 million in the nal weeks — most of it on advertising — and still had $417,000 in campaign cash left on Nov. 25.

Hurd beat Frisch by 5 percentage points.

“ ere are very few stories people want to hear every Christmas, but this is denitely one,” Hunt said. “ ere’s something about this version and the changes that have been made that makes it more than a story you don’t mind hearing every year. It’s something you want to hear again.”

e Colorado GOP brought in $631,000 between Oct. 17 and Nov. 25, while spending nearly $684,000. But $589,000 of that spending was on money sent to the Republican National Committee in an apparent return of dollars raised by a joint fundraising committee with Presidentelect Donald Trump and other state Republican parties.

Chairman Dave Williams’ consulting rm received $24,000 from the Colorado GOP, bringing the total Fox Group Ltd. has been paid during Williams’ term — which began in March 2023 — to $144,500. e party also paid $22,000 to two law rms between Oct. 17 and Nov. 25 and had $276,000 in cash leftover at the end of the reporting period.

Colorado Democrats raised $2.1 million and spent nearly $2 million in the nal weeks before Election Day, ending with $431,000 in leftover campaign cash on Nov. 25. e state party sent $1.3 million to the Democratic National Committee during the reporting period after receiving $1.5 million from a joint fundraising committee with Vice President Kamala Harris’ campaign and other state Democratic parties.

Voters in ornton’s Ward 1 will be asked to select a new City Counclior via mail in ballot in March.

e election was initiated after Kathy Henson, the former City Council Member elected to Ward 1 in 2021, was elected to serve as an Adams County Commissioner in November. Henson resigned from her City Council position on Nov. 27 and the council declared the vacancy at their Dec.17.

Police identify cold case remains from 1973

Detectives ID 15-year-old Roxanne Leadbeater, look for cause of death

e Weld County Sheri ’s o ce has identi ed a set of remains found in 1973 along the St. Vrain River west of Platteville as that of Roxanne Leadbeater, a teen who disappeared in 1972 from the Los Angeles area.

However, police are still investigating the circumstances that brought her to Weld County and the cause of her death. “ is is our oldest cold case; I am glad Roxanne has nally been identi ed, and some of her remaining family members have gotten answers about what happened to her,” said Detective Bryon Kastilahn in a Dec. 5 press release.

“In the future, I hope to discover what events led to her death and how she ended up in Colorado.”

According to o cials, Leadbeater’s remains were found near the bank of the St. Vrain River Nov. 19, 1973, north of Highway 66, four miles west of Platteville.   Kastilahn, of the Weld County cold case team, took over the investigation in 2021 and requested the unidenti ed woman’s

remains be exhumed from Lin Grove Cemetery in Greeley in 2022. Her remains were submitted for a DNA for a genetic genealogy test, according to o cials.  ose results came back this year. Melissa Kraker, a forensic genealogy analyst with the Colorado Bureau of Investigation, identi ed the body as that of Roxanne Colleen Leadbeater. Leadbeater’s parents and brother have died, so her closest relatives are rst cousins.

Kastilahn contacted the cousins and found they lived in di erent states. However, they heard she had gone missing in 1972 at age 15. According to o cials, the family had no connection to Colorado and her cousins did not know why she lived there or if she had run away.

According to o cials, one of the cousins approved providing her DNA to the CBI to test whether Leadbeater was related to them. Kraker’s forensic genealogy analyst results con rmed that Leadbeater’s DNA was related to the cousin.

According to o cials, when Leadbeater went missing, her cousins thought she and her family lived in the Redondo Beach area of Los Angeles. Kastilahn contacted several law enforcement agencies in California seeking a record of the missing girl, including Redondo Beach Police, Huntington Beach Police, Inglewood Police, Hawthorne Police, Los Angeles Police and the Los Angeles Sheri ’s Department.
