After neck-and-neck race for a seat in the Colorado’s 8th Congressional District in November, incumbent Democratic Yadira Caraveo conceded to Republican Gabe Evans ve days after the nal votes were cast.
e two ran a tight race since the Nov. 5 vote, with Caraveo holding a a narrow
lead until votes began trickling in from conservative Weld County in the far- ung 8th District.
e district was as created in 2022 and Caraveo won the seat with by just over 1,632 votes over her Republican opponent Barb Kirkmeyer that year.
e race was considered pivotal as Republicans and Democrats tried to hold majorities in the U.S. House of Representatives. Nearly $15 million in super PAC money streamed into the race by late October.
In all, over $20 million in total was spent by PACs and the candidates on the 8th Congressional District contest by late fall.
Northglenn protests halfway house for sex o enders
Protests by residents and
city o cials in Northglenn in April, prompted the State of Colorado to back o its plan to house convicted sex offenders at two group homes in a Northglenn neighborhood.
e proposal ignited the ire of residents who feared for the safety of children at nearby Stukey Elementary.
City o cials said they were informed at the last minute about the transition homes and the possibility that sex o enders could live there.
A public meeting over the proposal at the Northglenn Recreation Center drew over 400 people. e city council passed an emergency ordinance putting the distance a sex o ender could live near a school at 1,000 feet. e previous distance was 750 feet.
e Mental Health Transitional Living Facility at 11255
and 11275 Grant Drive will now be the site of a two-year pilot admission process, focusing on “those individuals who can most safely transition to the MHTL homes,” according to the Colorado O ce of Civil and Forensic Health.

A united Northglenn City Council voted in late April to le an ethics complaint against State Sen. Faith Winter for showing up drunk to an April 3 community meeting of over 400 people. Winter was invited to the meeting to discuss a controversial move by the state to place group homes in a Northglenn neighborhood that would house convicted sex o enders.

In Colorado, a person can be convicted of these crimes — plus dozens of others — and still qualify to be a licensed peace o cer responsible for dealing with people at their most vulnerable moments.
e state agency in charge of licensing the state’s law enforcement o cers wants that to change.
e Peace O cers Standards and Training Board voted unanimously this month to ask the state legislature to add another 31 misdemeanor crimes to the existing list of 44 as “decertifying to be a peace o cer.” at means if the legislature agrees, a law enforcement o cer convicted of any of these crimes will also be decerti ed. e state already bars anyone convicted of any felony from being able to serve as a law enforcement o cer.
Colorado Attorney General Phil Weiser, whose o ce manages the POST board, said that adding to this list of disqualifying misdemeanors is long overdue.
“Over a decade ago, the POST Board had recommendations for additional categories that should merit being decerti ed. e legislature failed to act,” he said. “It’s important that the public have full con dence in law enforcement, and conduct in these misdemeanor categories is unacceptable and should prevent someone from serving in law enforcement in Colorado.”
Currently not included in that disqualifying list is violating a protective order – something state o cials hope the legislature adds.
New kids clinic opening in Westminster
The Alto Clinic will o er pediatric primary care including for mental health

A children’s health clinic in southwest Westminster will be a key component of a campus that will provide housing, food and medical care for low-income residents in Adams County, say planners.
“We are seeing that health and wellness will be a theme around this campus,” said Drew O’Connor, Chief Operating O cer of Maiker Housing Partners. Maiker is the “socially conscious” public housing authority for Adams County, according to Maiker’s website.
Five Maiker housing communities are located within a two-mile radius of the new clinic, called the soon-tobe-opened Alto Community Clinic.
e clinic will be operated by the non-pro t Kids First Health Care, which provides health care for kids from birth to 21 years of age.
Alto Community Clinic moved into the vacant retail space in the Maiker property in one of Maiker’s a ordable housing communities in the area of 71st Avenue and Federal Boulevard in Westminster.
Doors to the clinic are scheduled to open in January.
Several businesses made inquiries about moving into the space but Maiker wanted the tenant to move in that would bene t nearby residents.
“We were looking for something that would add something to the campus we are developing here,” O’Connor said.
at idea led Maiker to form a partnership with Kids First, which has operated in Adams County since 1978.

towards families, which is just one block away, say clinic o cials.
e Food Bank of the Rockies will also have a presence on the Maiker campus, O’Connor said, helping feed families who are stretched thin nancially.
Alto Community Clinic is squarely within the boundaries of Westminster Public Schools – which added 600 new students this past year. Clinica Colorado, an adult-serving nonpro t primary care provider, is also nearby, said Whitney Gustin Connor, executive director of Kids First.
“We are looking to be a mainstay in this neighborhood and be a one-stop shop for people who need us,” Gustin Connor said. “ is will help eliminate one of the biggest barriers to health care – transportation.”
Anyone from birth to 21 can use the clinic, which accepts Medicaid, CHP+, private insurance as well as those who are not eligible for insurance, Connor said. “About 20% of our clients have no insurance, but
we work with them, and we provide a sliding scale for them to pay,” Connor said.
“But we never, ever turn anyone away,” she said.
e clinic’s pediatric primary care services include well-child checkups, sports physicals, vaccines, reproductive health, sick visits, and management of chronic diseases like asthma.
Alto Community Clinic will also provide mental health care including visits with a counselor and well as one-on-one therapy, Connor said. “Mental health care has become a huge issue in this community now,” Connor said. “We will do what we can to get the mental health care our patients need.”
e clinic will operate regular business hours ve days a week, Monday through Friday. One day each week have evening appointments available.
“We are looking to be a key asset for this whole area,” Connor said. “We can’t wait to get started.”

e majority of Westminster residents who responded to a community-wide survey this year have a generally rosy picture of their city.
e survey, done by ETC Institute, was distributed to over 6,000 randomly selected Westminster residents and a statistically valid sample of 905 residents participated, ensuring a high level of con dence in the results, said city spokesman Andy Le.
A community survey is done every two years to gauge awareness of the city’s communication channels and to inform city leaders on what policies and services need to be changed, Le said.

e explosive saga of the house at 7731 Knox Court in Westminster seems to be nearing a satisfactory conclusion.
e house was destroyed in the early hours of Feb. 22, 2022 when a propane tank erupted, killing the occupant, Duane Doyle. Doyle had apparently been living in the house, which was boarded up after a re heavily damaged the structure in 2021.
With the house gone, the remaining lot remained empty, a persistent scar on the neighborhood that rests just south of U.S. 36.
But on Monday, the Westminster City Council approved the sale of the lot to Sergio Parades Rodriguez, who will pay the listed price of the property of $150,000, according to a city sta report to the city council.
Rodriguez plans to build a home on the site for his family, the city says.
e news makes Nick Villar happy. Villar recalls being jolted out of his sleep, when the home blew apart at 2:22 a.m. Villar, who lives just a few steps away from the vacant lot, said he looks forward to having a new neighbor living on the infamous spot of the eruption.
“It’s nice to see something good happen to it,” Villar said. “ at’s something (the explosion) that you can’t quickly forget.”
City Councilor David DeMott said neighbors have long asked that the city do something with the vacant lot. DeMott also said he agreed with the decision to spend $400,000 toward cleaning up the property.
e property’s owner couldn’t pay for the abatement, prompting the city to place about $340,000 of liens on the property, which re ected the work performed by the city’s contractors, according to the sta report.
“I think the money was well spent,” DeMott said Monday. “It was more of an investment to protect other neighbor’s property as well as everyone’s health and wellbeing.”

spondents rated Westminster as an “excellent” or “good” place to live.
Satisfaction with neighborhood quality (76%) and community safety (76%) was strong.
Top-Rated Services: Parks and recreation facilities (81%), libraries (80%), and emergency services (80%), received the highest satisfaction scores.
Public Safety: High marks were given for re (83%), and medical services (81%)
ETC’s Derek Harvey told the city council this week that the results show Westminster is ahead of most cities nationally in key livability benchmarks.
“You guys are leading the way in this area,” Harvey said.
Police, tra c come up short
Residents responding to the survey said the city is falling short in other areas, including police visibility in retail areas, in local neighborhoods and enforcing tra c laws.
Code enforcement also got low scores with 45% saying they were satis ed with those e orts. e survey
said debris cleanup, weed control, and property maintenance should be top priorities for the city.
Street conditions got 57% satisfaction ranking among those who responded, and 73% were satis ed with the city’s snow removal e orts.
Most residents – 80% - identi ed the high cost of housing as a signi cant challenge along with concerns about crime (68%) and growth (62%).
Harvey told the council that Westminster’s concerns about growth, crime and homelessness are shared by nearly every other city in the country.
“Westminster is on par with regional and national averages,” he said. e survey results were not a big surprise to city o cials, Le said via email.
“We appreciated that the survey aligned with what we have been hearing from the community, and we will keep working to address those issues in 2025,” Le said. “While Westminster is well ahead of our peer communities in the Rocky Mountain area, it doesn’t mean we cannot continue to improve the quality of life for our residents.”
Settling the ownership of the property and determining the responsible parties represented a complex interplay between lenders, lien holders, attorneys, the United States Department of Housing and Urban Development and others, the sta report states.
A private lender and HUD released their respective deeds of trust on the property on Aug. 8, 2022, the report states.
Following the property’s cleanup, Westminster started judicial proceedings regarding its liens on the lot. A judge ordered the Adams County Sheri to proceed with the sale of the property on Jan. 13, 2024. e city was the only party to submit a bid at the sheri ’s sale on May 30, and a deed was awarded to the city on June 12, the sta report states.
e City Council directed the city sta to list the property for sale and the listing went live on October 23 with an asking price of $150,000. An o er was received within two weeks of listing. A second o er was in the works but never materialized, the report states.
Rodriguez has more than 20 years of construction experience and has reviewed all applicable due diligence documents including reports and invoices from the clean-up and abatement work in 2022, the sta report states.
e city’s priority of overall community health and safety “is met by helping to close the chapter on the disaster that occurred at the site and allowing the neighborhood and community a path to move forward,” the report states.
Small Landlords: Looking to Cash Out Due to New Pro-Tenant Laws? Here’s
One
Option.
Under laws enacted by the 2024 General Assembly, Colorado tenants gained many protections, both from eviction and for “habitability,” but those protections for tenants have made being a landlord trickier, more expensive, and riskier, especially for the small landlord who manages his or her own rental units.
Last week, I helped one such small landlord dispose of his rental duplex and invest the proceeds in a way that deferred his capital gains but didn’t get him into yet a new investment that carried those problems and management.
you’re able to put the entire proceeds to work generating income. If you keep doing 1031 exchanges until you die, your heirs will inherit your final holding(s) with a stepped up value and no capital gains tax liability at all.
In his case, he had to deal with a squatter who knew his protections against eviction that already existed under Colorado law and refused to leave. That experience left such a bad taste in my client’s mouth that he chose to sell instead of finding a new tenant.
I was once a commercial landlord myself and earned some great passive income from it for several years, but I vowed never to be a residential landlord. Back then, the big concern was whether your tenant might be cooking meth — a nightmare situation requiring not only eviction but very expensive mitigation before the property could be put back on the rental market or sold. I preferred being a commercial landlord, because my tenants’ offices were always open and I knew they wouldn’t trash their office, because they had customers.
These new protections for residential tenants only add to the unattractiveness of being a small landlord of residential properties.
Other changes in landlord-tenant law include the banning of occupancy limits based on familial relationships by local governments and prohibiting rent increases in excess of 10% over the prior year’s rent (defined as “rent gouging”). Local governments may still implement residential occupancy limits based on demonstrated health and safety standards, such as international building codes, fire codes, Colorado Department of Public Health and Environment wastewater and water quality standards, or affordable housing program guidelines.
College towns, including Boulder and Golden, have in the past implemented occupancy limits to prevent the use of singlefamily homes by large numbers of unrelated college students. Those laws are now invalidated by state law.

Meanwhile, selling a long-held investment property can subject the seller to capital gains tax and depreciation recapture that can wipe out much of the profit from selling. A common tax strategy for deferring those taxes is to do a “like kind” exchange under Section 1031 of the Internal Revenue Code.

You may be saying, “I don’t want to own any new investment property, especially a residential rental property,” given these new laws, but I have good news for you.
“Like kind” properties are broadly interpreted by the IRS to include any real estate (except a Real Estate Investment Trust or REIT). This allows you to reinvest your funds as a passive investor in what’s known as a Delaware Statutory Trust (DST). However, a DST investment is only for accredited investors. Individual accredited investors come under two categories:
They have an individual net worth, or joint net worth with their spouse, excluding primary residence, but including home furnishings and personal automobiles, of more than $1,000,000, or
They have an individual income in excess of $200,000 or joint income with their spouse in excess of $300,000, in each of the two most recent years and have a reasonable expectation of reaching the same income level in the current year.
DSTs are exploding in popularity, and with good reason. A Delaware Statutory Trust (DST) is an ownership structure that allows an investor to purchase a fractional interest in a large property or portfolio of properties. The DST is a legal entity (formed as a trust under the laws of Delaware) which holds legal title to property(ies) held in the trust.
For Federal income tax purposes, each DST investor owns a “beneficial interest” in the trust and is treated as owning an undivided fractional interest in the real estate being held by the trust. A real estate company, known as the sponsor, purchases the real estate for the DST and sells “beneficial interests” to 1031 exchange investors through broker/dealers.
The investors, as beneficiaries of the trust, receive their prorated share of the income, tax benefits, and any capital appreciation produced by the real estate. The real estate company, the sponsor of the DST, serves as the trust manager and is responsible for making the major management decisions of the trust. Some examples of the type of real estate that a DST may invest in are: Industrial, MultiFamily, Medical Office, Student Housing, Senior Housing, Retail, Storage, etc. The sponsor purchases the real estate for the DST and sells "beneficial interests" to 1031 exchange investors through broker/dealers. If you list your investment property for sale and your listing agent doesn’t tell you about DSTs, it could be because it’s an investment of your proceeds that doesn’t allow your agent to earn a commission. It could also, however, be because he or she is not familiar with DSTs. Show him or her this article!
We learned more about DSTs when Wayne Bernardo of Bernardo Asset Management, a boutique real estate securities firm in Evergreen, spoke to our broker associates and me at a recent office meeting.
One problem with doing a traditional 1031 exchange is that you must identify your replacement property within 45 days of closing on the relinquished property, and close on the replacement property within 180 days. It’s not uncommon for a 1031 exchange to fail due to missing these deadlines, leaving the seller of the relinquished property to owe the capital gains tax which he or she was intending to defer. The good news in that situation is that it takes almost no time to switch to a DST. If it’s day 45 and you know you’ll miss the deadline, there’s still time to invest in a DST. But you must identify the DST by day 45 with your Qualified Intermediary (QI).
That’s because there are always some DSTs being offered, and Wayne Bernardo can assist you in finding a DST option to complete your 1031 exchange. He proved that last week when he spoke to us on Monday, and I told him I had a closing that Friday in which the seller was facing over $500,000 in taxable capital gains which he was willing to pay to get out of his rental investment. “Can you help him,” I asked.
The answer was clearly “yes,” because at the closing on Friday, the settlement statement showed $500,000 of the sellers’ proceeds going to my client's Qualified Intermediary for a DST purchase. Wayne was able to find a few DST options for my client and my client decided to purchase one of Wayne's DST recommendations.
Instead of paying capital gains tax (and depreciation recapture) on his sale and wondering how to invest what was left, my client is investing $500,000 in a DST that will earn him an expected monthly income stream over the life of the DST. (Note: Distributions are not guaranteed.)
One of the “negatives” about DSTs is that it is not a liquid investment. You can’t pull your money out of the DST for at least 5 to 10 years, but if that is not problematic, it’s a great solution for the seller who wants to get out of an investment property without paying capital gains tax but having no further management concerns or liabilities. Wayne refers to it as “mailbox money,” because you get a
check in the mail without the headaches of being a landlord.
Note: You don’t have to invest your entire proceeds in a 1031 exchange. My client who invested $500,000 in the DST also received $153,000 in proceeds on which he will pay capital gains tax but still providing him over $100,000 in net proceeds for other purposes, such as travel. I did the same thing when I sold an office building in 2004 and didn’t reinvest the entire amount using a 1031 exchange.

Reduction or Elimination of Monthly Cas Flow Distributions: Like any investment in real estate, if a property unexpectedly loses tenants or sustains substantial damage, there is a potential for suspension of cash flow distributions.
No Performance Guarantee: General real estate market risks also apply to DSTs. There can be no assurance that a property will perform as projected. DSTs are subject to economic volatility, tenants not paying their rent on time, and other traditional risks of owning, operating and selling real estate.
Potential Change in Tax Law: Tax laws are subject to change, which may have a negative impact on a DST investment.
Why Are HOA Dues Being Raised So Much?
This is a question which I have been asked by readers, so I reached out to Stan Hrincevich, president of Colorado HOA Forum, who suggested some possible causes.
Many HOAs are discovering that their reserve accounts are underfunded and are increasing monthly dues in lieu of a one-time special assessment.
Insurance costs have skyrocketed, and if the HOA is responsible for more than just common elements, this could be a reason for increased dues. If the dues weren’t raised in a timely manner, the eventual increase could be even bigger.
Insurance deductibles have increased significantly, too, and if, for example, the HOA insures the community’s roofs and there’s a hail storm, your individual share of the deductible for replacing the roofs could result in
a special assessment in the tens of thousands of dollars. Ask the provider of your individual insurance policy about a rider to cover such an assessment.
Fees charged by HOA management companies and the contractors hired by them, such as for grounds maintenance and snow removal, have increased substantially.
Water charges have skyrocketed, and if the HOA provides irrigation, that could cause dues to increase.
If the HOA embarks on lawsuits and loses, this can result in a financial impact that could raise monthly dues or result in a special assessment.
If you are worried about misappropriation, ask to see the check register and bank statements of your HOA and see where the money is going.

Je co, Adams 12 could see fewer at-risk students

is fall, fewer students at some Colorado schools are being counted as at-risk because pandemic-era rules for Medicaid left many families suddenly unenrolled by spring 2024.
Students enrolled in Medicaid are automatically counted as at-risk students in calculations about funding. A drop in the number of at-risk students can cause some schools to lose federal Title I funding used to help those students, who generally have higher educational or socialemotional needs.
e Je co district, the second largest in Colorado, told its school board last month that 6,000 of the district’s approximately 75,600 students were unenrolled from Medicaid.
At some schools, the decrease in at-risk students may be enough to drop a school below the required threshold to receive Title I money. Currently in Je co, that threshold is 55%, but may change for next year.
Title I funding varies between schools and districts, but in Je co, on average schools get about $900 extra for each atrisk student. e money is used to hire additional sta and provide extra resources.
Some families are worried that their children’s schools could lose that funding. Edgewater Elementary School parent Angela Cryan took her concerns to the Je co school board last month.
“We are so concerned, and the families that are here tonight with me are so concerned, about losing the funding that is critical even for one year,” Cryan told school board members and the superintendent. “Whatever that amount is, it is
too much to lose for our students.”
Superintendent Tracy Dorland told Cryan not to fear. Dorland said Edgewater Elementary would still qualify for Title I funds next school year.
District o cials have refused to share school-level data, saying that everything is still being reviewed for accuracy. Ocial enrollment demographic data is usually published by the state in January.
For students who were unenrolled or those who aren’t eligible for Medicaid, including students from families that may not have legal status, parents can still ll out free and reduced-price lunch forms and, if eligible, be counted in at-risk gures that way.
e district has shared the number of students who qualify for free or reducedprice meals. e gures are usually similar to at-risk numbers. At-risk counts include all students who are eligible to receive subsidized meals, but also other students including those who receive Medicaid. Overall, the district projects the percentage of students eligible for subsidized meals will be 31% this school year, down from 34% last school year.
e trend of having fewer students eligible for subsidized meals, and fewer at-risk students, is not unexpected, Je co leaders told the school board.
“ at’s actually about what we thought was going to happen over time,” said Brenna Copeland, chief nancial o cer for Je co Public Schools. “ e reality is the counts district-wide are going down, and that’s going to impact, over time, our Title I district-wide.”
Kym LeBlanc-Esparza, deputy superintendent in Je co, said the district has not set the percentage threshold that deter-
mines which schools will get Title I funding next year.
“We’re still going back and forth, making sure we have exactly what those numbers are,” she said.
Title I trends were worrying districts before the pandemic
Before the pandemic, districts were having to adjust the bar for which schools receive Title I status. Despite declining enrollment and overall stable numbers of students from low-income families, the distribution of those students was not even within districts. Students from highpoverty households tended to be concentrated in select schools. at meant that more schools were more likely to hit the thresholds of 65, 70, or 75% of students in poverty, for example, to qualify for the funding.
More schools qualifying for Title I status in a district can be a problem, because it doesn’t necessarily mean the district is receiving more federal funding for those schools. e federal government has a di erent calculation based on census data for determining how much funding to send districts. at data doesn’t take into account school choice laws that allow Colorado students to attend schools outside their neighborhoods, changing the demographic makeup of students at schools when compared to their community.
Districts also have exibility to determine which schools will receive the money. ey specify the percentage of at-risk students schools must have to be considered Title I.
In Je co, that bar is currently set at 55%, and this year, 31 schools are receiving Title I funding.
and is now at 31.
But Aurora, and other metro area school districts, said they’re not expecting declines in the number of schools qualifying for Title I status.
How one Je co school uses Title I funding
Although Title I money is important, it’s not the only source of extra funding for schools with lots of at-risk students. Many districts also direct state and local dollars to these schools.
In Je co, for example, the district money given to schools for at-risk students is signi cantly more than what the schools get for having Title I status. e money is given on a per-student basis regardless of whether a school meets a threshold, which can make the total funding amount less likely to change by large amounts from one year to the next.
Pandemic-related demographic changes and the state’s 2023 decision to use Medicaid eligibility to determine the number of at-risk students in a school initially made the numbers rise, but those numbers could decrease now in districts like Je co and Adams 12.
Je co leaders wouldn’t say how many schools could lose the funding if the current threshold of 55% was used for next year. O cials are deciding whether or not to change it.
If the decision causes some schools to lose eligibility, the district can do a phase out so that schools don’t immediately lose the funding when their demographics change, LeBlanc-Esparza said.
In Adams 12, Gina Lanier, the district’s chief nancial o cer, said the district is seeing a drop of about 3,900 students who qualify as at-risk based on Medicaid eligibility. Last year, about 50% of the district’s nearly 35,000 students quali ed for subsidized meals, meaning they were counted as at-risk students.
Overall, Lanier predicts the number of students who qualify for free meals in Adams 12 will have dropped this school year by more than 6%.
Lanier said if Adams 12 keeps the thresholds it currently has for Title I eligibility, ve schools will no longer qualify for the funding next school year.
As budget planning gets underway, Lanier said the district will discuss whether to change those thresholds or create a plan to support schools that would lose funding so that it’s phased out instead of immediately going to zero.
In the Aurora school district, leaders have pushed the threshold for how many at-risk students a school must have to receive Title I to the federal government’s maximum allowed limit of 75%. e district had 14 new schools qualify last year
Principal Megan Martinez of Deane Elementary in Je co said her school in Lakewood has had Title I status for several years, and that the funding is helpful in supporting the needs of her students.
Enrollment at Deane this fall is up compared to what was expected, and Martinez is seeing a major increase in the number of students who are learning English as a new language. Many of the new students are newcomers and English learners. e percentage of students qualifying for free or reduced-price meals appears to be holding steady. Last year, about 82% of Deane’s nearly 300 students quali ed for subsidized meals. Martinez said the school helps families ll out the free lunch applications and explains other available bene ts.
At Deane, Martinez said she uses the Title I funding primarily to hire teachers to keep class sizes small, or to avoid having to do combined-grade classrooms. e funding also pays for a restorative practice liaison, two interventionists helping teachers work on reading and math instruction, and supplements the school’s mental health resources. is year, that means that in addition to the full-time social worker paid for by the district based on the number of students who have special needs, Deane’s Title I funds pay for an additional social worker to come in at least two days per week. “ ey might support with setting lessons around behavior expectations, they might pull a friendship group or lunch bunch or another targeted group working on relationship skills, or do crisis response,” Martinez said. “We wouldn’t be able to do that without Title funding.”

Program for 5th-year high schoolers needs overhaul, report says

A Colorado program that allows students to stay in high school for a fth year to take free college classes should be realigned to focus on low-income, at-risk students.
at’s just one of several recommendations in a new report meant to address problems with the state’s fragmented workforce readiness programs.
State lawmakers commissioned the report from the Denver-based Slalom Consulting rm, which was to present its recommendations Dec. 11 to the Colorado State Board of Education.
e report calls for changes to the state system so it is easier for districts to o er students career education opportunities. For example, the report says the state can consolidate programs into one o ce and create a dedicated fund for counselors.
e proposed changes would support more districts in creating workforce programs with the goal of exposing students to career education that leads to college credit, classes that will lead to an industry certi cation, or on-the-job training. e recommendations also call for a new fund that would help districts hire more school counselors, including career coaches that support students’ aspirations.
Lawmakers commissioned the study after a larger report on the state of Colorado’s career education system — called the 1215 report — revealed a need for changes if the state wants to graduate more students with the skills for college and a career.
e 1215 report also outlined the need for further reports on speci c workforce
and college programs. Di erent programs are overseen by di erent departments despite having similar goals.
e Slalom report’s rst recommendation calls for consolidating grants and programs into one overarching Postsecondary and Workforce Readiness fund.
e change would bring various programs under one roof and make accessing them easier for districts.
e second recommendation says lawmakers should then create a categorical fund within the budget, or a line item speci cally for certain programs or students, that would speci cally pay for counselors, at a cost of $300.8 million a year. e money would support students as they explore career elds and college options.
Creating the categorical fund might be a challenge because historically these have been underfunded. In the short-term, lawmakers this year must also nd budget cuts.
e report also recommends the state standardize tuition agreements to make it easier to account for program costs, and create reimbursement models for certain expenses like books and fees.
One notable facet of Slalom’s report is a call for the state to reassess the Accelerating Students through Concurrent Enrollment program, often called ASCENT.
ASCENT is one of the state’s rst career education programs and grew in recent years after lawmakers lifted a student enrollment cap. e program provides students a fth year of high school enrollment while they attend college, but doesn’t spell out what students will learn.
Newer programs have similar structures but clear workforce goals, such as one called TREP that helps students get into
teaching, and another called P-Tech that is designed to get students into science, technology, engineering, or math careers.
In addition to questions about its requirements, ASCENT’s costs have also increased. e state has projected it will spend about $18 million on ASCENT in the 2024-25 budget year, more than quadruple what the program cost in 2022. Lawmakers also chose to place a cap back on the program.
Lawmakers could shift the $18 million for ASCENT to other programs, the report says.
Some school leaders say the program is
crucial to keep students who have a more complicated educational journey on track to college and a career with good pay. If lawmakers decide to keep ASCENT, districts should be reimbursed for costs, rather than receiving a per-pupil allocation, the report says. e program should also be realigned to focus on low-income, at-risk students with 15 or fewer credit hours to help them complete a college credential.

Council members said there was no other way to punish Winter for her conduct since she is term-limited and can’t be voted out of o ce. Anyone else who showed up drunk to their job would face dire consequences, council members said.
In a May 1 letter to the city council, Winter apologized for her behavior at the community meeting and said her actions that night led her to seek treatment for substance abuse disorder.
Long-awaited Thornton pipeline approved
A nal 10-mile section of a pipeline from the Poudre River in Larimer County that will spur ornton’s growth for the next several years gained unanimous approval from the Larimer Commissioners in May. e granting of the 1041 permit for the pipeline project came after two lengthy public hearings along with meetings with Larimer residents to ease fears about the impacts of the pipeline, say city o cials. Most of the 70-mile pipeline will run through Weld and Adams counties before ending south of ornton.
Larimer County residents and environmentalists have long worried the pipeline would damage and drain the Poudre River. ornton bought the water rights to the river in 1986, and city o cials say the water they are conveying is already being diverted at a point at the Larimer County canal.
No additional diversions will be made once the pipeline is built, o cials say.
Westminster’s popular o -leash dog park will remain as is
In June, the Westminster City Coun-
cil decided that one of the state’s largest o -leash dog parks will likely stay intact.
Councilors said the city should do more to make the 470-acre parcel self-sustaining, including charging out-of-town visitors a fee to use the area.
Councilors said at a work session that they wanted to keep the o -leash area asis. is is despite a city sta recommendation to cut the parcel roughly in half or more to increase open space in the city.
Councilors said they were responding to the desires of most residents who covet the o -leash area as a prime getaway for dogs and their owners.
e Westy Dog Park Guardians – an advocacy group that pushed for the preservation of the 470 acres – said it is taking on much of the maintenance work at the dog park, which drew huge support from dog owners and other residents in public hearings.
“Under Council’s advisement, we will continue to be part of the ongoing stewardship for this area that’s so important to the community,” said Westy Dog Park Guardians’ Andrew Guthrie in June.
Thornton tries to stop sewage spills from mobile home parks
A new ordinance requires owners of private wastewater systems in ornton to do more to prevent sewage spills from contaminating public water systems.
e City Council in December unanimously approved an ordinance to amend the ornton City Codes aimed at private wastewater disposal system maintenance. e new law comes after two mobile home parks in ornton – Friendly Village of the Rockies and Woodland Hills – were cited by the city for sewage spills from their properties that seeped into Niver Creek.

F-bomb hurled during debate over code of conduct in Thornton
A proposed code of conduct for ornton City Council members that fueled animosity among members for the past several months, failed to make the books in December. e council voted 4-4 in December on the code question which means it remains on the shelf.
Rancor over the proposed code sparked profanity between council representatives, including the use of the F-bomb.
e proposed code would have had council members agree to a pledge upholding the City of ornton Code of Ethics and the Code of Conduct, put the public interest rst, conduct themselves in a manner that brings credit to the city, and serve with integrity, impartiality and transparency.
e code also asked that council members “practice civility, professionalism, and decorum in discussions and debate” and to honor the role of the Presiding O cer in maintaining order.
Council members were also to avoid personal comments.
“In addition, discussion must not attack or make suggestions as the motives of other members. No in ammatory language, including statements by spoken word or audio or visual materials, should be used and a member of may not criticize a prior action of the group,” according to the proposed code.

Thornton gains a new city manager and loses a police chief
Tansy Hayward, a veteran manager of major city projects, was named the city manager for the City of ornton in August.
Hayward was appointed city manager by a unanimous city council. Hayward was among ve nalists for the job, which was created when Kevin Woods retired as city manager in March.
Hayward took over as city manager in October, earning her $329,000 in base salary and receiving $3,250 monthly stipend for temporary housing, not to exceed three months, and $6,500 for relocation expenses, according to her contract presented to the city council on Tuesday.
Terrence Gordon in September retired as ornton’s Police Chief after a four-year tenure. Gordon replaced 45-year ornton police veteran Randy Nelson.
Before taking the ornton job, Gordon served for nearly 30 years at his hometown Milwaukee Police Department. While in Milwaukee, he worked in sensitive crimes/crimes against children, violent crimes and homicide divisions. Gordon also served as a crisis negotiator and supervisor of the crisis negotiators unit.

Using Santa’s time machine, the opportunity to rewind the clock going back a year ago and announce that he decided not to seek a second term as President.
He and his family and advisors would have seen the light. is would have given various Democrats an opportunity to fully compete in the party’s primary elections and provide plenty of time for the winning candidate to campaign against Donald Trump.
Plus, it would have saved Mr. Biden’s public image to some extent. Would it have changed the course of history? We will never know.
Vice President Kamala Harris is one is a real challenge according to Saint Nicholas. What’s the best path to take for someone who lost running for President of the United? States?
Nick thinks running for President in 2028 would be a mistake. History shows that candidates who try to rebound by running a second time right after being defeated for the position do not do well. Nick suggests that she throw her hat in the ring to run for California governor. She did well against Trump in the state with a 20 point gap. She has been successful running for district attorney, state attorney general and U.S. Senator. She knows the territory.
Plus, it buys time to wait and decide if she wants to try again for president in 2032.

So, Saint Nick has selected giving the governor another opportunity to correct a mistake made with the re-introduction of wolves in Colorado. While Colorado voters approved the re-introduction, Polis’ administration has been responsible for implementing the plan. e state has spent $5 million on bringing ten wolves from Oregon with only ve still alive. In the process, he has angered and frustrated the ranchers of our state on the management of the plan.
Guv, take the opportunity to rescind an ill-conceived program and cut the losses by putting it on the ballot in 2025. Also, don’t move forward on the planned 10-15 additional wolves from Canada.

Given the tall task of overcoming approximately a billion de cit in the current 2024-2025 state budget, you need help from the generous ole man who drives the reindeer on Christmas. So, he is up to the task and has some choices for you.
First of all, do not (Yes, I said do not!) propose to raise or create any taxes to pull the state back in the black. e legislature got carried away last session, spending tax money like there was no tomorrow! ey need to solve the gap within current resources.
Santa says you have to cut some funds from K-12 and higher education. e de cit is too big to avoid touching these “sacred places.” How about an across the board cut to each state department of say 10%?
en freeze all state grants except for a ordable housing. As mentioned above, freeze the wolf introduction program. Cut everyone’s co ee allowance and reduce travel reimbursements.
Let’s learn to be frugal.

On this Christmas 248 years later, it’s timely to recall what Washington and the men and women fought and died for in the American Revolution. Like standing and removing one’s cap during the singing of “ e Star-Spangled Banner,” taking a few moments to re ect upon Washington’s feat should be requisite for every American on Christmas Day. For far too many take for granted the freedom the millions since Washington fought and many died for.
From the outset, the Founders knew personal rights and liberties would need to be endlessly defended not just from abroad but from within. Unlike many Americans today, they knew their history. ey also understood the “will to power,” as Fried-
rich Nietzsche called it a century later in “ us Spake Zarathustra,” runs deep within the soul of men, and if it isn’t harnessed and redirected toward noble, unsel sh pursuits, bad things happen at the hands of the unprincipled and unscrupulous. History had clearly shown that.
But some grow weary of the struggle and decide their and their fellow citizens’ rights and liberties aren’t worth defending despite Ben Franklin’s admonition that “ ose who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety.” ey become willing to compromise and agreeable to watered-down versions of their inalienable rights that in their essence become like junk jewelry and cheap goods bought at dollar stores.
Paine took to task such people, calling them “the summer soldier and the sunshine patriot” who “shrink from the service of their country.”
“What we obtain too cheap,” he wrote, “we esteem too lightly: it is dearness only
that gives every thing its value. Heaven knows how to put a proper price upon its goods; and it would be strange indeed if so celestial an article as freedom should not be highly rated.”
When the head winds blow at gale force 24/7, it can try one’s soul. When that happens, the danger of falling into one of two extremes—denying reality and insisting everything will be all right or shrugging one’s shoulders and plaintively asking, “What’s the use?”—arises.
Brad Stulberg, a mental health authority, suggests an alternative in a New York Times essay: wise hope and action. By not looking at the anti-freedom forces through rose-colored lenses and by not giving into futility, he says a person is better able to “muster the strength, courage and resolve” to keep their focus on what they can control. e challenge for the individual then is identifying what is in their power and deciding on how to act on it.
What brightens you?
Igrew up in a family where stories were a nightly part of our meals. My father, a great storyteller, came from a family of nine, seven boys and two girls. His baseball team-sized family gave him a huge volume of tales to share on seemingly endless topics. While my father told many stories around the dinner table, there were moments when the storytelling would come from my mom. Mom had tales of her father’s work as a traveling salesperson, her time in high school and many “neighborhood” stories. When Mom told us her favorite story, her face would light up and she would talk about dancing. In that story, she did not spend much time talking about speci c performances, her attempts to make every child born into the extended family a dancer, or even her time learning from and eventually teaching for Colorado Ballet founders Lillian Covillo and Freidann Parker. What she talked about was her love of motion. She would explain that as a teenager her favorite game was to walk quickly through a crowd of people without touching any of them but coming within a few inches of every person she passed. She would describe feeling the air as she passed individuals, appreciating the uidity of her motion and the fact that so many people were gathered, allowing her to play her game.
I loved the story partly for the vision it created of Mom as a teenager, but more for the absolute passion you could feel in the words she shared. When she told this story, you gained an insight into the way she viewed the world. You understood that she saw things di erently than others. at the daily mundane physical tasks most people muddled through were, in her mind, a dance; a beautiful dance to be appreciated.

Charles Small Jr. May 31, 1942 - November 19, 2024
Raymond Charles Small Jr. of ornton, CO, passed away peacefully on November 19, 2024 at age 82. Ray was born on May 31st, 1942 to Raymond Charles Small Sr. and Marcia June Smith.
Ray was preceded in his death by his son, Jason and his wife, Sue. Ray is survived by brothers Tom (Shirley) Small and Ron (Alisa) Small, sisters Marcia (Bud) Watkins and Tina (Rob) Clapper, daughter Deanna (Je ) Hart, and grandchildren Devin (Nicola) Hart and Taylor (Prosper) Hart.
Ray was a dedicated husband, father, grandfather, and brother. Ray was a member of the Loyal Order of Moose that provided needs in his community. His Eagle Scout life skills remained with him throughout his life, which always included carrying
an extra bag during his dog walking to keep his community clear of trash. Ray was drafted into the Vietnam War and served until he was honorably discharged at the end of his term, marrying his wife Sue shortly after. In both his professional and personal life, Ray was always known for being the “go-to guy” for helping x any problem no matter the size or complexity. He had an open door mindset for his friends as well as his children’s friends as they were experiencing life’s challenges and always enjoyed learning and teaching alongside them. Ray will be laid to rest with his son and wife at Ft. Logan National Cemetery on January 17, 2024. In his memory, donations of any kind to Folds of Honor are welcomed, supporting the passions he shared in life.
e joy in Mom’s face is still fresh in my mind even though it has been more than 35 years since I last heard her share the story. is memory will never fade for me.
We all need things in our lives that ll us with such joy that it is re ected on our faces whether we are engaging in the activity or telling the story of it. We need things that color our vision, helping us to see the beauty that surrounds us.
Take time this week to think about the things that are so exciting to you that they light your face when you mention them.
During struggles, unmitigated joy is a tonic that will help each one of us.

Every artist, crafter or hobbyist needs a collection of supplies, materials and equipment to accompany their creative passion.
A few stores around Denver seek to help creatives both build their collection and rehome it, if necessary. e Craft Box in Wheat Ridge, and ReCreative in downtown Denver, are both dedicated used art supplies stores that accept donations for resale – essentially thrift stores for artists.
“We’ve had kilns, massive oor looms, pottery wheels, everything down to the individual buttons,” ReCreative Programs Director Kelly Eigenberger said about the store’s inventory.
Eigenberger, who is also a clay artist, said her main goal at ReCreative is to help make art more accessible, especially when it comes to cost. Eigenberger said she knows and relates to the nancial squeeze working artists face, between studio rentals, equipment and marketing their creations.
“I love getting to hook it up for people who I see working really hard and creating access on the retail side of art,” she said. “I mean, the cost of rubber stamps is criminal.”
In addition to the reuse store, ReCreative is a nonpro t that houses artist studios, a membership-based woodshop and an art gallery. e store also o ers classes, ranging from watercolor painting to sewing to kintsugi, a Japanese technique for repairing pottery with gold.
Eigenberger said a community has built up around ReCreative, with a loop of customers becoming featured artists in the gallery or instructors of classes, creating loyal shoppers and connections for donations.
“It means a lot to have friendly neighbors and the support that comes from our people,” Eigenberger said.
Another of ReCreative’s missions is to throw away as little as possible. As of December, the store had diverted 28,000 pounds of supplies from land lls in 2024. Donations are accepted by appointment, which can be made online.
Eigenberger said donating supplies has the dual bene ts of being more environmentally friendly and helping other artists.
“I think that we’re all inclined to collect in one way or another,” Eigenberger said. “But as we collect and lose interest, there’s a lot of guilt about it, so being able to con rm for people that what I’m taking will be used by someone is important.”
Similar to ReCreative, e Craft Box is part used sup-
ply store and part haven for artists, providing space for a variety of art groups and clubs, like Quilts of Valor and the Aspen Leaf Button Collectors.
Liz Boxler, the owner of e Craft Box, said her goal is to create a community space through thrifty crafting.
“Our purpose is twofold, of course, to nd homes for all this crafty stu , but also to work with local charities that need or want things that are handmade,” Boxler said.
When donated supplies aren’t t for resale, Boxler, who is also a quilter, will sometimes use them to create goods for people in need. For example, Boxler has made dget quilts for people with Alzheimer’s, crochet pouches for catheter bags and reusable grocery bags for the food pantry.
Boxler has found that there are more supplies that could be reused than she will ever be able to manage, but she tries to do what she can. is year, the store has diverted 1.4 tons of fabric, books, rubber stamps and other craft supplies from land lls.
Boxler estimates that since she opened the store in 2012, that amount is more than 9 tons and 260,000 items. Most of her donations come from estates and
people who are moving, Boxler said. e store accepts donations by appointment, which can be made online.
“ ey’re de-stashing, is what we call it when people are moving, or they’re downsizing, or they just realize they’re gonna have to live to be 150 years old to do all these projects,” she said.
Luckily, there are also plenty of people eager to nd new purposes for the various beads, frames, yarn, fabric, paints and endless other materials stocked at e Craft Box.
Not only is it a cheaper way to maintain a collection of supplies, Boxler said used supplies are also popular with people wanting to test a new hobby.
“People can try out new crafts much easier,” Boxler said. “If somebody wanted to try quilting but fabric is so expensive, this is a way they can do that without investing a lot upfront. And then if they like it, they can expand on that.”
Boxler said one of the best things about the store is that there’s something for everyone and every skill level.
Kelly Eigenberger, the programs director at ReCreative, said the store’s mission is twofold: to help divert supplies from landfills and to make art more financially accessible. ReCreative also houses an art gallery, studio space and a membershipbased woodshop.
ReCreative is fueled by donations, which Eigenberger said mostly come from estate sales and people who are moving or downsizing. In 2024, the store accepted more than 28,000 pounds of materials.

Mountain Range High School administrator arrested
A school administrator at Mountain Range High School in Westminster faces charges after he was accused of sending inappropriate photos to an underage student in October.
Tate Drane, 27, was arrested after several reports were made over the weekend through Safe2Tell, an anonymous online reporting system, about Drane’s alleged activities. Drane was taken into custody on charges of Sexual Assault on a Child by One in a Position of Trust, Internet
Sexual Exploitation of a Child and Internet Luring of a Child.
Drane had been working as Dean of Student at Mountain Range High School since Aug. 1, according to the Adams 12 Five Star School District. e district placed Drane on administrative leave after his arrest and will not work or coach in the district until further notice, the district states.
Drane has worked in other schools in the district since 2018. He worked at Rocky Top Middle School from August 2021 to July 2023 and was girls’ basketball coach at ornton High School for the 2021-22 season and at Mountian Range since 2022. He was also working as the Head football coach at ornton High School at the time of his arrest.

Julia Stahnke was an Aurora police o cer who, in 2021, was found to have violated a protective order, after she was charged with domestic abuse and a colleague drove her back to her house to pick up a car.
Stahnke was going to get red for that, according to news reports at the time, but she resigned before getting red.
She ended up getting decerti ed in September 2023, but not for violating a protective order. She was found to have been untruthful and the POST board pulled her certication.
“It’s horrifying that these are not already violations that would decertify an o cer. ese are the people the state entrusts to protect civilians in the most vulnerable times of their lives,” said Mari Newman, a Denver civil rights attorney who has sued law enforcement agencies on behalf of clients dozens of times. “We really should expect better from our o cers. If the state tolerates obviously bad behavior from law enforcement o cers, none of us should be one bit surprised when they engage in misconduct that endangers members of our public.”
e Colorado Association of Police Chiefs declined to comment on the proposal, saying they were still studying it. Since the pandemic, law enforcement agencies have complained about how di cult it is to nd quali ed o cers given a slew of retirements and low morale
between 2020 and 2024.
e state’s voters in November approved a $350 million grant, paid for by state dollars, to help agencies recruit and retain ocers, though how that money will be spent is still unclear.
Hashim Coates, an Aurora community advocate who has been critical of police misconduct, said he supports tightening regulations on who is quali ed to become a police o cer.
“Sometimes these are the least educated and least experienced people who have the greatest amount of control over someone’s future and so I think they should be held to a higher standard,” Coates said. “Child abuse, theft, these are things they arrest on on a daily basis and the fact someone could be a police o cer after being convicted of these things is troubling.”
Tom Raynes, the executive director of the Colorado District Attorney’s Council, said that the state’s DAs support adding any criminal o ense to the decertifying list where the conduct “clearly exhibits a lack of integrity, is morally wrong or of evil intent.”
e state’s Fraternal Order of Police said they haven’t seen the full list of proposed changes but will review them with an open mind.
“We always welcome conversations to ensure we maintain the highest level of integrity and public trust in our o cers,” the group said.

A BILL FOR AN ORDINANCE AMENDING TITLE XIV CHAPTER 2, OF THE WESTMINSTER MUNICIPAL CODE CONCERNING THE EMPLOYEE 401(a) DEFINED CONTRIBUTION PLAN
THE CITY OF WESTMINSTER ORDAINS:
Section 1. Section 14-2-1, W.M.C., is hereby AMENDED to include a new subsection (J) to read as follows:
(J) On December 9, 2024, the City approved changes made to the Code to reflect a ¼ percent increase in the employer contributions for payroll periods beginning on or after January 1, 2025. The City also clarified the state tax treatment of contributions to Retirement Medical Savings Accounts and how forfeitures would be used.
Section 2. Section 14-2-4(A), W.M.C., is hereby AMENDED to read as follows:
(A) Contributions by the City:
(1) Determination of Contribution by the City The City shall contribute to the credit of each full Participant’s Account, (i) for each pay period on and after January 6, 1986, and prior to January 3, 2022, 10.25 percent of each full Participant’s compensation for that pay period; (ii) for each pay period on and after January 3, 2022 and prior to the pay period beginning on or after January 1, 2024, 11.25 percent of each full Participant’s compensation for that pay period; and (iii) for each pay period beginning on or after January 1, 2024 but prior to the first payroll period beginning on or after January 1, 2025, 11.75 percent of each full Participant’s compensation for that pay period; and (iv) for each pay period beginning on or after January 1, 2025, 12 percent of each full Participant’s compensation for that pay period; provided that, during any period in which the City is required to make contributions on behalf of Participants under the Federal Insurance Contributions Act or the Social Security Act, the contribution to the Plan for each Participant shall be offset by the amount of the OASDI portion of the social security taxes paid by the City for such Participant. This offset shall not exceed the City contribution.
(2) Time and Method of Payment of Contribution by the City. The contributions of the City shall be made every pay period and shall be credited to the Plan each pay period.
(3) Forfeitures. All unvested amounts forfeited by reason of a Participant’s termination of employment before the Participant becomes fully vested shall be used as City contributions to the Plan and shall offset and reduce the City’s employer contribution obligation.
Section 3. Section 14-2-8(A), W.M.C. is hereby AMENDED to read as follows:
(A) Contributions to Retirement Medical Savings Accounts
(1) General. Each Participant shall have the option of designating up to 25 percent of the Participant’s combined mandatory and City contributions made to the Trust Fund pursuant to Sections 14-2-4(A) and (B)(1), W.M.C., to be used for future medical care expenses as provided for in Code Section 401(h). Contributions designated by a Participant for future health benefits under Code Section 401(h) as described in this subsection (A)(1) shall be maintained in a separate account (the “Retirement Medical Savings Accounts”).
(2) Subordinate; taxation. It is intended that the benefits provided by the retirement medical savings accounts shall at all times be subordinate to the retirement benefits provided by the Plan. Contributions to the Retirement Medical Savings Accounts will not be subject to federal taxeds upon a Participant’s retirement, termination of employment, death or Total Disability nor upon use for medical expenses upon a Participant’s retirement, termination of employment, death or Total Disability. These amounts will also not be subject to state tax unless applicable state laws provide otherwise.
(3) No refunds. No refunds of contributions to a Participant’s Retirement Medical Savings Account shall be made to the Participant or the Participant’s spouse or dependents.
(4) Non-transferrable. Except as provided in subsection (B)(5) of this section, all contributions to a Participant’s Retirement Medical Savings Account shall not be transferred and shall remain in the Retirement Medical Savings Account until such contributions are used for medical care expenses for the Participant and the Participant’s spouse and dependents.
(5) Other rules and requirements. The Retirement Medical Savings Accounts will be subject to the rules and requirements issued by the City Manager, which can be changed from time to time.
Section 4. This ordinance shall take effect upon its passage after second reading. The full text of this ordinance shall be published within 10 days after its enactment after second reading.
