Colorado feels brunt of crisis in home insurance

Ice, fire, ‘wildly di erent market’ come together to squeeze owners

A homeowners insurance crisis fueled by escalating natural disasters has arrived in the Centennial State.

Home insurance now costs $818 more per year on average compared to 2020, and Colorado now has the fourth-highest insurance premiums nationwide, according to a July research paper by Benjamin Keys and Philip Mulder. In places like Philips County, home insurance is now 55% more costly than just four years ago, the data show.

Even ling a single claim can now be a permanent scarlet letter, agents and insurance o cials say.

“ ere is a real risk right now that insurance companies will not renew you if you le a claim,” said Michael Conway, Colorado’s insurance commissioner, during an October insurance town hall.

“Does it make sense for people to be non-renewed if they led one claim in 20 years?”

Places like Grand County have seen insurance nonrenewals increase by around 77% in 2023 compared to 2018, according to new data from the U.S. Senate Budget Committee.

Colorado homeowners are also scrambling to stave o cancellation notices and keep their mortgages.

In October, Trevor Donahue and Trish Krajniak bought their mountain dream home in Nederland and moved from Littleton with their children. e couple bought homeowners insurance from Allstate — the only major carrier that would insure them. ey needed insurance to

close on the home and for their mortgage; Donahue was surprised by how cheap the rate seemed.

An Allstate agent told them there was “nothing incredibly serious” to x after their home inspection, according to an email shared with CPR News.

A few weeks after closing, an insurance cancellation letter arrived from Allstate. Initially, the company gave them until Jan. 11, 2025, to conduct extensive wildre and hail mitigation on their property, or risk losing their insurance, defaulting on their mortgage and losing their home.

“None of it was outlandishly unreasonable, what they were asking,” said Donahue. “ e biggest problem is that they gave us a 60-day deadline from when we closed. We’re covered in snow, there’s ice on the roof, and they’re making no exceptions for an extension whatsoever.”

Scandal clouds water quality tests

Latest twist in an expanding scandal at health department

e Colorado Department of Public Health and Environment suspended testing of drinking water at the state laboratory, the latest twist in an expanding water-testing scandal that’s been going on for a year. e scandal involves at least two chemists accused of cutting corners and falsifying data on quality-assurance tests — essentially practice tests run to make sure their machines are working correctly. e state says it has no evidence that public health was threatened through falsi ed data on tests of actual water samples sent into the lab for analysis.

“At no time did we nd levels that we knew would pose an immediate threat to public health,” Dr. Ned Calonge, CDPHE’s chief medical ofcer, said in an interview.

While testing is suspended at the state lab, CDPHE has transferred testing duties to third-party labs that are certi ed by the federal government.

Here’s what else we know so far about the testing scandal.

What kind of tests are we talking about?

ese are tests conducted on drinking water to look for harmful levels of various things like metals or toxins. e water samples could be submitted by a community or municipal water provider or they could be sent in by individuals whose drinking water comes from a well. e speci c test at issue is known as Method 200.7. It looks for metals like barium, chromium and copper. Calonge said this is not the test the state uses to look for lead.

To conduct the test, a lab chemist runs a water sample through a machine, which spits out a result. e result is then compared to federal water quality standards to see if it exceeds allowed limits.

Westminster closes in on cell tower at the 136th Avenue Walmart

Councilors say the cell tower would improve cell service in

north Westminster

Westminster City Councilors appeared so ready to welcome the construction of a 150-foot-tall cell tower to the south side of the Walmart Supercenter at West 136 Ave. that Mayor Nancy McNally said Monday night she would do “cartwheels” at its nal approval.

e Supercenter, located on the south side of West 136th Avenue and west of I-25, is a virtual dead zone for cell phone users, say o cials. e cellular monopole is expected to boost coverage and capacity in the area, a feature sorely needed as development and tra c expands in north Westminster.

Councilors reviewed the proposed plans for the cell tower in a concept review Monday night. No o cial vote was taken to approve the project and at least two public hearings need to be held before the tower can be constructed. In all, the tower likely won’t appear for at least a year, o cials said.

But councilors said they wanted the tower to go up as soon as possible. “Can we accelerate the process?” Councilor Obi Ezeadi said.

e project includes a 35-foot-by-65foot walled area containing mechanical equipment in addition to the 150-foottall monopole. e proposed location is a landscaped area to the south and rear of the Supercenter, adjacent to the rear access drive used primarily for loading purposes, according to a city sta report.

To accommodate the cell site, a portion

of the landscaped area would be removed, and a retaining wall built into the existing slope. More landscaping would be planted around the perimeter of the cell sit for screening, city sta members state.

SBA Towers originally proposed putting the cell tower on the northeast corner of the Walmart Supercenter, between the building and the southbound onramp. “Visually, the original site would have been highly prominent as viewed

from both I-25 and from West 136th Avenue which serves as a gateway into the city,” the sta report states. at site also would have required an access easement crossing the existing multi-use trail for maintenance, the report states.

SBA Towers agreed to move the cell tower to the south side of the building where it will be less visible from surrounding roadways and not interfere

with trail use, according to the report. e monopole cannot be completely screened because of its height, but it should be less noticeable behind the building and set back from I-25, the city report states.

e city restricts most new structures to 35-feet. SBA Towers will ask for an amendment to the city rules to allow for the 150-foot-tall monopole.

Westminster hosts two new restaurants in an old location

Westminster is the ideal spot to expand a Denver restaurant lineup that aims to bring people together over vibrant food and drink for an almost communal experience, said Peter Newlin, Chief Visionary O cer and co-founder of Gastamo Group.

e latest Gastamo Group venture is Homegrown Tap & Dough and Perdida Kitchen, which opened late last year at the former C.B. Potts brew house at 1257 W. 120th Ave. e 12,000-square-foot building has been the focus of a three-year redevelopment and will house both unique dining experiences with one giant shared kitchen.

e result will rewrite the local dining experience, Newlin said recently via email.

Westminster will be the fourth location for Homegrown Tap & Dough which has locations in Littleton, Olde Town Arvada and Washington Park. Homegrown, Newlin said, celebrates Colorado’s ski culture and o ers comforting, handcrafted Italian American cuisine.

“ e menu includes wood- red pizzas, freshly made pastas, hearty salads, and craft beers,” Newlin said. “It’s familyfriendly, o ering dishes that both kids and adults will enjoy in a casual yet polished environment that feels warm and welcoming. It has a kid’s free arcade.”

Westminster will be the second location for Perdida Kitchen which opened in Denver.

I’ll Say It Again: The Mill Levy Should Be a Required Field on MLS Listings

The dollar amount of property taxes has always been a data field on the MLS, because buyers need to know how much they should expect to pay if they purchase a listing. But that number does not provide context to the home buyer. In other words, how do the taxes for this home compare with the taxes for a home of the same value nearby, across town, or elsewhere in the metro area? The answer is in the mill levy.

A few years ago, REcolorado (the Denver MLS) and other MLSs added a “yes/no” field for metropolitan tax district, but how much does that tax district add to the property taxes for that listing? MLS listings don’t currently have a data field for mill levy.

Some metro districts have a zero mill levy, but some metro tax districts have mill levies so high that they double the tax bill for a home compared to a comparable one nearby that is not in that tax district.

A good broker should let a buyer know the premium he or she is paying to buy a home in such a district, but that broker cannot currently get that information from the MLS listing. The broker would have to go to the assessor’s web page for that listing in the county where that home is located and look at the breakdown of mill levies for that house.

Jefferson County provides the breakdown of mill levies by each taxing jurisdiction, but

An example of how much taxes can vary can be found in two Jeffco homes that sold in the last few months. One house in the Mesa Meadows section of Golden which sold for $1,500,000 has a mill levy of 91, like all homes in the City of Golden, which has no metro tax districts. The tax bill for that home is $6,761. Meanwhile, a house three miles to the north in a metro tax district which sold for $972,500 has a mill levy of 165, resulting in a 2024 tax bill of $10,105, a $3,344 difference.

A metropolitan tax district is created to fund the infrastructure (roads, gutters, sewers, water lines, sidewalks, etc.) for a new subdivision. Instead of the developer paying those costs, a bond issue provides the funds for that purpose, and home buyers in that subdivision will be paying an extra mill levy for two or more decades to pay off those bonds.

In the above example, the metro tax district’s mill levy is 70 mills. The owner of that home will pay $100,000 or more over time for the infrastructure costs. In Golden, those costs were paid for by the developer or the city. Yet, an appraiser or real estate broker would not factor that long-term expense when

Does a Seller Say They Won’t Repair Anything?

Every buyer should hire a professional inspector, even if a home is sold “as-is.” That’s a bogus term intended to convey that the seller won’t correct any defects uncovered by the buyer’s inspector. I call it “bogus,” however, because the contract does or should contain an inspection termination deadline, and, even if it doesn’t, the buyer always retains the right to inspect the property.

If your inspector finds a serious issue, you can threaten to terminate because of it, and it’s likely the seller will agree to deal with it rather than lose the contract and start over, in which case he must disclose the newly found issue to the next buyer.

That being said, the seller could still call the buyer’s bluff, especially if the buyer’s agent has given the listing agent the impression that the buyer loves the house and would

not let a few thousand dollars in repairs stand in the way of getting a house they love.

That was the situation with a listing of mine. I had been told that the buyer lost out on a prior listing, and their offer had a clause saying they would beat any competing offer by $5,000. That won them the contract, but my seller (who met the buyers a couple times during showings and inspection) knew how much the buyer loved the property and wouldn’t want to lose it.

Therefore, when the inspection objection included a demand for a 5-figure concession to fix a major health and safety problem that any other seller would have agreed to fix, my seller refused, and the demand was withdrawn.

Remember: getting under contract is only the beginning; inspection is a negotiation, too.

When an appraiser or real estate broker values a home, they look at square footage, lot size, garage, bedrooms/bathrooms — in other words, everything but the tax rate (and the HOA dues) when doing an appraisal or comparative market analysis. Yet, the bottom line cost of owning homes in a metropolitan tax district can be dramatically higher.

That is why I have argued for over a decade that REcolorado should include the mill levy for each listing and not just the dollar amount of the property taxes.

Some counties make it easier than others to find the mill levy. In Jefferson County, the assessor’s website breaks down the mill levy from every taxing jurisdiction. A link provides the dollar subtotals and total.

You can, however, calculate the tax bill from the assessor’s website by multiplying the mill levy by the assessed valuation of the property. The assessed valuation for residential real estate statewide is currently 7.15% of the “full valuation” which the assessor as-

When you purchase a home that is within a homeowner’s association, state law requires that you receive a wide array of documents, financial and otherwise, about that association.

These include, for example, the covenants, the rules and regulations, financial statements, bylaws, budget, reserve study, the minutes of the last six months of board meetings, and the minutes of the most recent annual membership meeting.

The contract to buy and sell a home in Colorado provides deadlines for providing these association documents, objecting to them, and resolving any objections. A buyer can terminate a contract and get the earnest money deposit refunded if he or she is unhappy with what those documents reveal.

For example, the reserves of the association may be insufficient, suggesting that a special assessment is likely. The minutes might reveal issues which are upsetting to some members, or legal action which the association is undertaking, at some expense, to enforce its rules against one or more members. These and other reasons could exist that might cause the buyer to terminate the contract.

Thus, if your home has a full valuation of $1,000,000, the assessed valuation would be $71,500. That’s the number against which the mill levy is calculated. A mill levy of 100 would compute to a property tax bill of $7,150. It’s called a “mill” levy (from the Latin word for thousand) because it is levied against each thousand dollars of value. Thus, 100 mills x 71.5 = $7,150.

The math becomes complicated when the state legislature says, as it did last year, that $55,000 should be subtracted from the full valuation before calculating the assessed valuation. How much did that reduce taxes? $55,000 of reduced full valuation is worth $3,932.50 in reduced assessed valuation. At 100 mills, that’s worth about $393.25 off the home’s tax bill.

Although giving the total mill levy for each MLS listing would be a great improvement, the best way to inform buyers of the effect of a metropolitan tax district would be to say that there is such a tax district, and to add a separate field to enter the number of mills for that tax district.

Recently, at an open house, a visitor told our broker associate that in California the questions he was asking about the HOA (such as why the HOA dues are so high) would be readily ascertainable in advance rather than only after going under contract.

When we have been on the buyer side, we have rarely found that a listing agent already has the HOA documents — and answers to important HOA questions — to provide us.

That got us thinking, and the answer came last week when Pam Giarratano, our sales rep at First Integrity Title, brought to our office meeting Julietta Voronaov from Rexera. For a reasonable fee, Rexera provides all those required HOA documents prior to going on the MLS, so we can provide them to interested buyers and their agents.

Currently Rexera’s service is only available through our preferred title company, First Integrity Title. After Julietta’s presentation, our broker associates and I agreed that from now on, when we list a property that is located in an HOA, we will use First Integrity and order the pre-listing package from Rexera.

We look forward to providing complete HOA information in advance from now on for all our listings that are located in a homeowner’s association.

Illegal street racing targeted by state

At least 16 arrested and 11 vehicles impounded in street racing operations last year

At least 16 arrests were made and 11 vehicles impounded onsite in connection to street racing complaints in Colorado in 2024, according to the Colorado State Patrol.

e Patrol along with several local agencies combined e orts as part of the state’s Street Racing Working Group – or SRWG – to ght illegal street racing in the state.

e SRWG was created to address the continued problems posed by illegal street racing, according to a CSP news release. “ e dangers associated with illegal street racing, as well as the nuisance

of loud engines zipping by neighborhoods late at night brings this issue to the top for many citizens,” the news release states.

e SRWG is made up of law enforcement o cers, investigators, analysts, district and city attorneys, and support sta all aimed at eliminating or drastically reducing illegal street racing. Members include police departments from Federal Heights, Golden, Arvada, Brighton, Commerce City, ornton, Westminster and Wheat Ridge. e Adams and Jefferson County sheri ’s o ces are also members.

In 2024, 1,959 citizen complaints were logged at the SRWG website, reportstreetracing.com, and many more complaints have come into local police dispatch centers directly.

In response to those complaints, the SRWG made six targeted operations in 2024. ose resulted in 506 tra c contacts that resulted in 360 tra c citations issued.

ose included 108 for street racing-related charges, 20 for reckless driving, 10 for careless driving, ree DUIs and 130 citations issued for driving at speeds of more than 25 over the posted limit.

e SRWG’s operations also resulted in 16 arrests and 31 public nuisance abatement seizures initiated for street racing vehicle and 11 vehicles were impounded at the time of contact.

e Regional Transportation District swore in seven new Board directors and

one incumbent Tuesday during a special Board of Directors meeting.

Among those sworn in was Karen Benker, a staunch proponent of a new commuter rail line from Denver to Boulder, who will represent portions of ornton and unincorporated Adams County. Benker, who served on the RTD Board from 1992 through 2000, was also elected to the Board’s executive committee for 2025.

Troy Whitmore, who represents District

K, which includes Brighton, Commerce City, much of ornton and unincorporated Adams County, was elected Second Vice Chair of the executive committee.

RTD is governed by a 15-member, publicly elected Board of Directors, each of whom is elected to a four-year term and represents a speci c district within the RTD service area. Board members elect o cers each year to serve on the executive committee.

Northglenn invites artists to compete in annual “Art on Parade” competition

Six sculptures, each valued at $35,000 or less, will be selected for display at E.B. Rains Jr. Memorial Park for one year

Northglenn wants area artists to compete in the city’s 2025/26  “Art on Parade” onloan sculpture program, an annual event that attracts some of the top works in the state.

e city announced in December that two artists tied for the top spot for the 2024/25  People’s Choice Award in last year’s Art on Parade program.

Artists Joseph Cole and Bill ( ree Feathers) Bunting were both honored as recipients for their sculptures, “Hoo, What, Where and When” and “With Wings Like Eagles.”

Each chosen artist will receive a $1,000 honorarium to support their creative e orts. Additionally, the artist whose piece earns the coveted “People’s Choice Award” will receive an extra $1,000. Artists also bene t from signi cant exposure and opportunities to sell their work, as all selected sculptures must be available for purchase, according to the city of Northglenn.

Colorado lawmakers will debut two major bills to rein in home insurance. e state will also begin selling insurance plans to homeowners who are no longer o ered insurance in the private market, likely in the rst few months of 2025.

For Donahue and Krajniak, having an “insurer of last resort” can’t come fast enough.

“We have a gun held to our head right now,” Krajniak said. “I have no guarantee if we complete all of these steps, and spend the several thousand dollars, that [Allstate] will actually continue to insure us.”

In mid-December, after the couple led a complaint with Colorado’s Department of Regulatory Agencies, the company o ered them an extension to complete their mitigation, allowing them to hold onto their insurance for the time-being.  e couple’s Allstate agent did not return a request for comment about their policy, and Allstate’s corporate o ce did not answer questions about cancelling homeowner policies before mitigation work is complete.

Fire and ice — and climate change

Conway estimates that 55% to 70% of home insurance premiums on average in the state are driven by hail.

Colorado recorded nearly $2 billion in overall losses from a single hailstorm that pelted the Denver metro area in May. Brief and violent hailstorms can cause hefty damages to roofs and cars, and occur several times a year. Since 1980, the number and severity of all types of billion-dollar disasters have dramatically increased in the state.

Third-party modeling and reinsurance add to woes

Insurers rely on “reinsurance” — basically insurance for insurance companies — to help companies o oad some of their risk. Reinsurance costs have roughly doubled since 2017, which is partly driven by higher rebuilding costs after catastrophes and high interest rates, Keys said during a July town hall.

“A lot of these challenges for insurance companies will continue, and that they’ll be passing these costs on in the primary market to homeowners,” he said.

Insurance companies also rely on analytical models to map out risky areas. An insurance carrier is more likely to ratchet up rates, or call it quits altogether, in high risk areas.

Colorado is facing both insurance affordability and availability challenges, which means that carriers are issuing fewer home insurance policies in certain areas, while policies now cost more per year on average.

“Our market in Colorado is wildly different than what it was at the end of 2022,” Conway said during a July insurance town hall with residents struggling with insurance availability.

In March 2023, the state released an in-

dustry report, which showed that small and medium-sized insurance carriers were issuing fewer policies. But the top ve insurers – Allstate, State Farm, Liberty Mutual, USAA and American Family — were picking up the slack. at has now changed.

Colorado “has seen some of those top ve insurers start to write fewer policies. And we do have little pockets of availability concerns popping up,” Conway said. Areas that are now seeing insurers pull back include corners of Je erson

County, like Evergreen, and the Boulder and Colorado Springs foothills.

While availability issues are primarily driven by wild re risk, insurance unaffordability is being driven primarily by hail damage.

“Hail is by far the biggest driver of losses in most years for the homeowners insurance market,” Conway said. “In 2023, [hail reports] went up dramatically over the previous highest year … both in the overarching number of events, but also in the severity of those events, too.”

On a state and community level, mitigation e orts to reduce wild re risk involve pruning trees, prescribing burns, and grazing grassland. Mitigating for homeowners involves installing hail-resistant shingles, delimbing nearby trees and sealing homes so embers can’t waft in. Structural adjustments, and clearing nearby vegetation, can reduce a home’s wild re risk by up to 75%, according to the National Association of Insurance Commissioners.

INSURANCE

But Conway worries that models — which assign wild re risk scores — are not actually reducing rates even after mitigation e orts.

“If [models] are not sophisticated enough to incorporate mitigation work that both individual property owners are doing, that communities are doing, we’ve got a signi cant problem in our market,” Conway told CPR News.

He was more blunt to homeowners.

“ ird-party companies are doing a terrible job of building mitigation into their models,” he said during a separate October town hall. “And it really pisses me o . And it should really piss you o too.”

Playing defense on the front lines

Chris Dirolf cased the perimeter of a large, wood-paneled home in Nederland, trudging through a foot of snow to tag trees to cut down.

For two hours on a frigid Wednesday, Dirolf used an iPad to tick through a 50 question assessment prepared by Wildre Partners, a Boulder County program that mitigates wild re risk. Since 2014, Wild re Partners has o ered a homeowner certi cation program, which starts with an assessment, leads to property-level mitigation and ends with a certi cate that homeowners can send to insurers.

Wild re Partners hopes the certi cation can drive down insured losses and save homes using the best available science, according to a July presentation by program manager Jim Webster.  e program can be laborious – on average, a homeowner will spend thou-

sands of dollars and over a year to get certi ed. Certi cation is only o ered in the foothills and mountainous parts of Boulder County, though the county does o er other mitigation inspections in urban areas.

But it does save homes. In 2016, the Cold Springs Fire ripped through Nederland and destroyed eight homes and seven additional structures. Within the burn zone, eight homes were certi ed by Wild re Partners, and all eight survived.  e re came within a few dozen feet of Darrin Harris Frisby’s home, leaving a giant burn scar, a thinned canopy and sweeping views of the Indian Peaks. Frisby, a Boulder realtor, called Partners to assess his home after attending a training for realtors.

Dirolf pointed out numerous areas for improvement, like patching and caulking holes in Frisby’s siding, which could let in embers, and pruning smaller lodgepole trees. e two rounded the corner to potentially the biggest issue, an open shed near the house, which Frisby called a “bomb lled with wood.”

“I’m not going to sugarcoat it, but yeah,” Dirolf said.

e certi cation may not lower a homeowner’s insurance premium, or guarantee them a renewal. But that may be besides the point, at least until the market accurately re ects mitigation in prices.

“People in our community aren’t mitigating for any discount,” Webster said during a July townhall. “ ey’re doing it to save their homes.”

Looking for a fix

Conway expects lawmakers to introduce two bills during this upcoming legislative session to x the market. One, sponsored by Rep. Kyle Brown (DBoulder) and Rep. Brianna Titone (D-

Je erson), would nudge models to better account for mitigation performed at the homeowner, community and state level.

e bill would also allow homeowners to appeal their wild re risk score so they can get credit for mitigation work they’ve done, and release more information to homeowners about insurance discounts.

Another bill would set up two major programs in the state. One would help homeowners install hail resistant roofs so they can qualify for insurance discounts. Eventually, Conway hopes the program will drive down hail claims and make insurance more a ordable statewide. e second program would set up a state reinsurance fund in order to oset wild re insurance costs embedded in premiums.

“If [insurance companies] want to be part of that reinsurance program, they’re going to have to o er coverage in the highest wild re areas of the state,” Conway said.

e bill would also require a “lossratio” for insurance companies, so that they spend a certain percentage of each dollar they earn paying out claims. Conway said the requirement could help balance out the models, and make sure insurers don’t o oad all of their risk, in the form of higher bills, onto homeowners.

“A loss-ratio requirement will really spread the risk back, so that the insurance companies are carrying part of that risk,” Conway said.

In 2023, Colorado lawmakers passed the FAIR plan to provide insurance for homeowners and businesses shut out of the regular market. But the coverage is limited, and premiums may still be exorbitant because the plan is not meant to compete directly with the private market.

Still, Conway estimates that tens of thousands of homeowners and businesses are eligible for the plan and may enroll next year.

‘It just feels like a money grab’ When Donahue and Krajniak received their cancellation notice, they said Allstate o ered to help them nd other insurance on the “excess market.” But Allstate, and a broker the couple found through the state, could not nd another option, they said.  State law requires insurance companies to give 60 days notice before cancelling a home policy. e couple feels that Allstate insured them for the minimum time before cancelling — and incentivized them to purchase auto insurance — even as other insurers declined coverage upfront.

“It just feels like a money grab,” Krajniak said.  e couple’s Allstate agent did not return a request for comment about their policy, and Allstate’s corporate o ce did not answer questions about cancelling homeowner policies o ered as part of a policy bundle.

With their deadline extension, the couple no longer have to spend Krajniak’s vacation time raking pine needles buried beneath feet of snow. But they worry about whether they’ll be able to secure insurance in the future, even after they complete mitigation work. Risk seems everywhere – their house in Littleton was technically in a oodplain and required ood insurance.

“ ere’s massive relief that we don’t have this looming deadline,” Krajniak said. “But I am very concerned if Allstate decides to drop us in the future, we’re in the same place. Seniors only condominiums proposed in Westminster

It isn’t every day that you see or read about a proposal to build ownership condominiums in our state. Under Colorado State law, there is an unusually high risk of construction liability to the developer.

Our state legislature has not been able to resolve a more equitable policy to encourage condos. Not only do condos represent home ownership, but they are viewed as an entry point to ownership - depending, of course, on the price range.

However, Westminster City Council very recently reviewed the Concept Plan for such a development proposed at 122nd Avenue and Park Centre Drive.

Known as Northridge at Park Center, the 6.8 acre site would consist of 122 for-sale residential units (83 one bedroom units and 39 two bedroom units) for seniors only.

e three story maximum height involving three separate buildings along with a clubhouse is estimated to cost $55 million. e developer is JAFT Development, Ltd. located in Denver. e current land use designation in the city’s Comprehensive Land Use Plan is Employment-Flex which would require some suggested language changes to allow residential development if the housing development is to progress. e Concept Review provides an initial awareness of the developer’s intent to both the city council and the public.

Je erson Parkway is among the living, again, maybe

I cannot recall a public infrastructure project which has had so many ups and downs over the course of its existence. Back in my day at Westminster, Arvada, Broom eld and Je erson County were “hot to trot” on creating this piece of the outer-belt freeway to avoid slower tra c. Now, it seems that the toll road project could rise from the ashes and possibly get built yet.

When I began teaching freshman English, I knew I faced a challenge. Years of teaching eighth graders had taught me girls would read pretty much whatever I put before them. Boys, though, were a di erent story. By their early teens, they had been conditioned — programmed — to believe reading and writing were for girls and math and science were “masculine.” And if there is one thing most adolescent boys want to prove, it’s that they’re “real men.”

Fortunately for me such a man serendipitously provided the answer: George Lucas. His “Star Wars” trilogy would become my hook. I felt con dent it would work because frosh boys, despite their puerile need to prove their masculinity, had not yet become jaded. at process would begin in a year or two.

With Broom eld’s departure, only the City of Arvada and Je erson County are left as members of the highway authority. is in itself is a step forward for those who want to see the outer belt freeway completed around Denver. e Broomeld governing body also ceded an important segment of rightof-way needed for the road.

However, there are still big hurdles before any excavation is done or concrete is poured. Fundamentally, the highway authority must attract a concessionaire to nance and build the $875 million highway.

en there is the ever-present environmental concerns with possible plutonium in the soil around Rocky Flats. Oh, don’t forget high interest rates which any bond nancing would encounter.

So, while Broom eld’s actions o er some positive news, I doubt that a private national or international entity has an interest in the parkway at this time given the pending hurdles. Having said that, completing an outer belt freeway for the Denver metro area would still be bene cial. While it has evolved over time with somewhat of a “bubblegum and baling wire” approach in piecing it together - except for the northwest component - the need grows each year with more tra c in, through and around the area. It behooves Westminster to keep a vigilant eye on any future actions to move forward on this toll road given the road’s alignment being upstream from Standley Lake. Earthmoving and winds are an ominous combination when plutonium and other exotic substances can get airborne.

When I told them on our rst day that we would watch “Star Wars,” they were elated. But after the cheering subsided, I made it clear: ey would know “Star Wars.” I’d teach it in conjunction with “ e Odyssey, and it would become my vehicle for teaching other literary works and developing concepts like the epic hero. Decades later, I like to think they’re citing Yoda’s maxims such as “Do or do not, there is no try,” “Size matters not,” and “ at is why you fail” to their children or students.

If I had simply tried to impress those notions on my students via lecture, my words would’ve fallen at and gone in one ear and out the other. But Yoda said them, so they listened. Which gets at a fundamental aspect of literature: Even though characters might be ctional, their words can have far more impact and bearing on the human psyche than those coming from the mouths of parents, teachers, or preachers. Wise parents, teachers, and preachers know that. So too do the not-so-wise, and it scares the hell out of them.

In his New York Times essay “ e Plot Escapes Me,” James Collins, the author of “Beginner’s Greek,” explained how the sum of our entire literary experiences remains ever in memory. He described how Professor Maryanne Wolf, a trained neuroscientist, told him they become encoded by creating “pathways in the brain, [thereby] strengthening di erent mental processes.” at poses an interesting equation. For if our intellectual acumen, acquired wisdom, and philosophical outlook are in large part the sum of our reading experiences, logically it must mean the more we read, the greater is that sum. But it also must mean if one’s total of reading is sparse or zilch, the resulting sum is close to

Books, though, are not the only repository of great thoughts. e breadth of quality, worthwhile texts ranges wide, from essays and op-eds to full-blown novels. Yoda’s aphorism aptly states it: “Size matters not.” What matters is utilizing one of your greatest gifts: your ability to read. In the end, reading ought to be about opening and expanding the mind. Unfortunately, many read only texts that rea rm what they already hold to be true and refuse to allow anything that might challenge their worldview to enter — to pollute — their mind. Such readers remind me of those who see education as a process of “drilling and killing.” Drilling a rigidity of thought — an ideology — into the minds of young people with the intent of killing any sense of curiosity and willingness to question.

My goal as an English teacher wasn’t limited to the immediate concerns of my classroom and curriculum. I wanted also to foster a love of reading, of story, and of complex thinking so my students would not just be lifelong readers, but lifelong learners. I encouraged them to revisit in their adult years the novels we read to see if they’d glean more from them given their more mature minds. Like quoting Yoda’s aphorisms in their middle age, I sure hope they do. With regard to my frosh boys, I was delighted to see my strategy working. ey were hooked, so much so that when reading “Romeo and Juliet” and other advanced works they would eagerly volunteer to read challenging roles, ask thoughtful questions, and o er insights that showed indepth, critical thinking. ey had a blast and, most importantly, they learned. Imagine that.

Remembering President Jimmy Carter

With the passing of former President Jimmy Carter, I cannot help but ash back in my memory involving him. In conjunction with a national municipal o cials’ conference in Atlanta, Georgia, we had the opportunity to hear the President speak at the conference.

I recall his sincerity and concern in speaking of human rights and the challenges ahead. is was shortly after he had lost his campaign for a second term when Ronald Reagan defeated him. While in Atlanta, we decided to rent a car and drive to Plains, Georgia to see where President Carter’s homestead/peanut farm was located, his home church and of course hoping to catch Billy Carter at his service station and buy some Billy Beer. (I still have a can in our basement).

While Billy was not to be found on a Sunday, we did run into a boy about eight years old. We asked him what he thought of Mr. Carter being defeated. His direct quote with a heavy Southern accent was “You all are going to get a belly full of Reagan.”

Hmm, I wonder where he picked that up? Surely it was not his Mom and Dad.

Kings Mill residents object to residential development on former Zerger Elementary school site

As previously reported, the Je erson County R-1 School District has closed a number of schools including Zerger Elementary School and Sheridan Green Elementary School. Both schools are within Westminster city boundaries. However, the Sheridan Green site was deeded back to the City per agreement while the Zerger site is being sold by the District. Cardel Homes was the apparent high bidder for the site and previously submitted a preliminary plan to build 40 single family homes on the site.

All seemed well until Kings Mill and Standley Lake Subdivision residents voiced their objection to Cardel’s plans. Letters opposing the development were sent from approximately one hundred residents. Gary Bland, who is leading the charge, plans to meet with Cardel representatives to see if anything can be worked out. ere is thought that perhaps a charter school could go into the defunct building. is situation will be interesting to follow. Stay tuned.

Thornton pursues environmental sustainability task force

Last July, the ornton City Council decided to conduct an environmental policy review and create the Environmental Sustainability Task Force. e

task force would be made up of ornton stakeholders, including some with a business background.

Council’s focus was on reviewing existing policies included water quality, air quality, oil and gas regulations and building construction and sustainability.

Once the task force is formed and meeting regularly, they are to provide progress reports with recommendations to the city council. e task force shall consist of nine members - with at least two but not more than three members from each ward,although city council may appoint members irrespective of this provision.

ey are expected to meet monthly through 2025 to complete their work.

Recruitment of stakeholders has been completed and interviews took place this past week. Now, the council will deliberate and make the necessary appointments.

Council’s directive to appoint such a task force with the mission to review existing environmental policies is commendable. Given our changing environment and climate, it is wise to update policies where appropriate in these arenas. Other area cities would stand to bene t from ornton’s directive.

Guard your wallets and purses

It’s that time of year again when our State Legislature convenes for 120 days. In fact, they began last week on January 8.

ere are lots of new faces with the Democrats still controlling both the House and Senate. So take heed.

With the $670 million gap in the upcoming state scal year starting July 1, the Joint Budget Committee will be looking for ways to both raise revenues and cut expenses.

As we have already mentioned, this is a big challenge since the the budget committee and the Governor also want to protect funding for their favorite state funded services and programs. ey include K-12 funding, higher education, health care, housing and transportation. It seems counter-productive to me with the Governor recently proposing an additional $150 million for K-12. Given the magnitude of current K-12 funding (1/3 of the General Fund), it seems inevitable that it will have to be cut. e same problem exists with MEDICAID. It currently consists of another 1/3 of the General Fund and is almost guaranteed to be impacted negatively.

So, stay alert, be on your guard and watch your wallets and purses!

Icing on the skate

Local outdoor rinks’ unique features, settings o er something for everyone

Winter sports reign supreme along the Front Range. While the mountains and foothills o er plenty of places to ski, snowboard, snowshoe and spike-hike, the Denver metro area has opportunities galore to ice-skate and play hockey.

During the winter holidays, several local cities like Denver and Arvada host outdoor skating rinks in shopping centers or town squares. Some are only open through local schools’ winter break, but others remain open through January or February, depending on conditions.

Hours and prices vary, but most rinks o er rental skates or people can bring their own for lower-priced admission.

Although there are plenty of indoor skating options, many skaters prefer outdoor rinks’ atmospheres and open-air conditions. ey enjoy soaking up the sunshine or embracing the cold, depending on the weather.

Lakewood’s Greg Daniels and his three teenage children said skating outdoors is “more fun, more festive.” Also, indoor rinks tend to host more intense skaters, while outdoor ones like e Rink at Belmar are more casual, they said.

Leesa Stone, a former Parker resident, felt likewise. She liked the atmosphere at Parker’s Ice Trail at Discovery Park, with its holiday lights around the perimeter and its open replaces for people to warm themselves.

Plus, at places like Evergreen Lake, people come just to enjoy the views and skate on a real lake.

“We love the beautiful surroundings, being nestled here in the mountains,” Commerce City’s Michael Scanlon said of Evergreen Lake. “It adds to the ambiance.”

Whether they were experts or new to the sport, the skaters said local rinks o er something for people of all ages and experience levels.

“Everyone should try it,” Denver’s Marie Duran said.

And, as her 7-year-old Charlotte added, even if people don’t like skating, most rinks are in locations where people can easily nd other activities, like walking, sledding or shopping.

The Rink at Belmar

e Durans rst visited e Rink at Belmar last year and had fun. So, when Charlotte started asking to go skating this winter, the family returned to Belmar Jan. 2.

e rink, which is presented by Quantum Fiber and made of real ice, is in the middle of Lakewood’s Belmar Shopping District.

Maddi Harris and Kian Larson, students at Evergreen High School, were visiting Belmar for a date night and decided to rent skates before their movie. e two had also been skating at Evergreen Lake before. While it has its advantages, they liked Belmar’s festive atmosphere with all the holiday lights and the decorated evergreen tree near the rink.

“I prefer the holiday spirit here,” Larson said.

Evergreen Lake

Lara De Beer was visiting the area from Belgium, and for her last day in town, Evergreen’s Colin Saunder decided they should go skating at Evergreen Lake. De Beer had never skated on a lake before, and Saunder hadn’t been out on Evergreen’s in a while, so Jan. 2 seemed like the perfect time to try out the ice. While the lake is several acres in size, skating is only allowed on a portion of it. e maintained section near the Evergreen Lake House has a large perimeter that skaters can take laps around, as well as about a dozen small rinks people can use to play hockey, practice their skating technique and more.

People can buy tickets ahead of time or purchase walk-up tickets on a rstcome, rst-served basis. Private bookings and skating lessons can also be booked online.

Charlotte, who’s a big roller-skating fan, has enjoyed learning to ice skate. Her mom said the smaller rink is ideal for people like Charlotte who are learning to skate.

Duran also felt that e Rink at Belmar was reasonably priced, wellmaintained and “fun for all ages.”

Daniels estimated he and his family have been coming to the Belmar rink for about 10 years. ey tried to go skating before Christmas, but it was very busy. So, they opted to do their annual skating night Jan. 2 instead.

e family frequently shops at Belmar, and liked how close and convenient the rink was for them and other Lakewood residents.

Because it is a lake, the dates and hours it’s open is weather-dependent. It was scheduled to be open through at least Jan. 25, when it would host the Pond Hockey Championships, but anyone wanting to visit should call the hotline at 720-8801391.

De Beer and Saunder both enjoyed the pleasant weather and mountain scenery from the lake, with Saunder describing how unique and special it is compared to other rinks around Denver.

“ ere’s no place like it,” he said.

Small outdoor rinks like the one in downtown Denver tend to be crowded, but Evergreen Lake has plenty of space for everyone, he added.

Michael Scanlon and his children, Alex and Isabel, felt likewise, describing how they’ve been visiting Evergreen Lake annually since the late ‘90s. Michael said they love the excitement and energy that seems to be inherent among outdoor skating rinks.

However, he added, he felt like the lake’s seasons were getting shorter as the lake doesn’t freeze over as early in the winter as it used to. It’s also grown so popular that parking can be di cult, he said.

ICE SKATING

He recommended that anyone wanting to visit Evergreen Lake “should get here right when it opens,” because it’s usually less crowded and the ice is in the best condition.

e Martinez family from Colorado Springs also went skating during a day trip to Evergreen.

Lauren Martinez said she appreciated how the rink had plenty of pushable skating aids for children. Her family also enjoyed the nearby sledding hill. Overall, she said, they would be open to visiting it again.

Parker Ice Trail at Discovery Park

Parker’s Josh Blaha and his family had planned to go skating in Denver during the evening Jan. 2. But that rink closed earlier in the evening, so they opted to visit the Parker Ice Trail at Discovery Park instead. It was right down the street and open later, he described.

“It’s nice to have something like this in our backyard,” he said of the ice trail.

Unlike a traditional rink, the Parker Ice Trail at Discovery Park is an ice-covered loop trail that’s about 450 feet around. It’s also not a perfect oval with some sharper corners to keep skaters on their toes.

In the summer, it’s a concrete walkway; but in the winter, sta members cover it with ice that they maintain with a Zamboni. It’s scheduled to be open for the season through Feb. 28.

While his family has been to other outdoor rinks, Blaha said they’re much farther away. Additionally, he thought the ice trail was a good size and didn’t feel too crowded.

Leesa Stone, who lived in Parker for more than 20 years before moving to Utah, was happy that Parker had an outdoor rink of its own.

She’s been skating before at e Pond Ice Rink at Southlands, saying that while she liked the lights at e Pond Ice Rink better, she overall liked the Parker Ice Trail more. She said it felt bigger and like that it was one-way only. Plus, the open replaces and overhead heater at the admissions booth are nice touches, she added.

Avery Jones and her family said the shape was also unique. ey thought it motivated some people to skate faster than they would at a regular rink, while others might go slower.

Like the Blaha family, Avery and Zach Jones said they appreciated having an outdoor skating feature so close to home. ey added that it was the perfect thing to do over the holidays, as it’s a very approachable activity for families.

So, whether it’s a family outing, date night, a casual jaunt to soak up the sun or a serious training session, skaters agree the Denver area is the place to be.

A comedic ode to Chekhov at Town Hall Center

Even the casual theater fan has probably come up against the name Anton Chekhov a time or two in their lives. He’s right up there with Shakespeare as one of the towering gures in the form.

But his revered status doesn’t mean a little fun can’t be had at his expense.

For their rst production of 2025, Town Hall Center, 2450 Main St. in Littleton, is staging “Vanya and Sonia and Masha and Spike,” an absurdist comedy by Christopher Durang inspired by the works of Chekhov.  But as Matthew Kepler, Town Hall’s artistic director explains, you don’t need to know anything about Chekhov’s works to have a good time.

“You may nd some deeper connection and humor in some of the situations and jokes if you are a Chekhov scholar,” he said. “But it’s certainly not necessary to understand the plot or the jokes.”

“Vanya and Sonia and Masha and Spike,” runs at the center from Friday, Jan. 17 through Sunday, Feb. 9. Most performances are at 7:30 p.m. ursday through Saturday and 2 p.m. on Sunday.

According to the provided information, the show follows Vanya and his adopted sister Sonia, who live a simple life at their childhood home, where they spend their time reminiscing about days gone by and wondering what could’ve been. When their movie star sister, Masha, arrives unannounced and with plans to attend a very elite costume party with her young plaything, Spike, Vanya and Sonia’s

peace is challenged in hilarious ways.

“ e great thing about Durang, and this play in particular, is that the setting is so much in our real world, but the things that happen within that reality are so absurd,” Kepler said. “ e juxtaposition of those two entities colliding keeps you surprised and laughing out loud.”

Comedy is always challenging to get right, but there’s an extra layer to this show because there are some dramatic scenes that collide with the hilarity. But this kind of challenging production is just the thing that drew Kepler and Town Hall to the show.

“ ough we’re mostly known for producing musicals, we do like to do a play for our patrons from time to time as many of our patrons enjoy plays as much as musicals,” he said. “ is play is very popular amongst theatre enthusiasts, so it’s a perfect t. It was the darling of the 2013 awards season on Broadway and won the Tony Award for Best Play.”

As is always the case, the main goal is to entertain audiences, and no matter your familiarity with Russian theatrical legends, you’ll come away with a new perspective on your own family and some laughs to boot.

“Maybe there’s some insight to be had on their own familial relationships.

Maybe any problems they have with their own family members will pale by comparison to what our characters are dealing with,” Kepler said. “And nothing makes us feel better than to laugh — regardless of our personal or societal struggles. It really gives us a vacation from our worries for a couple of hours and allows us to just live in the joy of laughter.”

RoughRiders claim Pee-Wee honors

Boulder Hockey Club 12AA, with players from Boulder, Arvada, south Denver and more, head to Quebec tournament

A ragtag team of 12-year-olds from Boulder and surrounding areas, including Arvada and even south Denver, will be heading to Canada next month to represent the Colorado Avalanche in an international hockey tournament.

After a thrilling come-from-behind victory over the Littleton Hawks (another local powerhouse) in the Avalanche International Quali er in November, the Boulder Hockey Club 12AA (tier two) team punched its ticket to the 65th Quebec International Pee-Wee Hockey Tournament set for Feb. 12-23.   e tournament is dubbed by many as the “Little League World Series of hockey,” and the Boulder RoughRiders team will represent the Junior Avs on the international stage. e Colorado Avalanche will cover the team’s expenses for two weeks.

“I knew we’d be OK at the beginning of the year after tryouts,” said Neil Runbeck, the team’s head coach and Boulder Hockey Club director. “We had some skilled hockey players and I knew we would be a competitive hockey team. As far as … what level, I just wasn’t sure. And Littleton always puts together kind of an all-star team. I think we’ve only lost ve games or something all season, and three of them have been to Littleton.”  e RoughRiders would weather the storm to get revenge in the championship nal of the quali er. It certainly didn’t come easy; Littleton once again brought its A-game.

Team parent Megan Gilhooly was in the nosebleeds but was still locked in on the edge of her seat.

“I watched the game from 30,000 feet, literally,” she said. “I was with my other three kids on a plane to Brazil watching the stream online. I hope I didn’t wake any of the sleeping passengers up as I reacted to the highs and lows of this rollercoaster game … e Quebec Quali er championship game was the pee-wee game of the year in Colorado. More important than Silver Sticks. More important than state. e team gave it everything they had, and it paid o . I’m so proud of this BHC team.”

Overcoming a two-goal de cit twice, the Riders scored two goals in the last 1:53 to tie the game at four and send the match into overtime. At 3:45 of the second overtime, Boulder forward Sieger Gilhooly charged the net and scored the game-winning goal, sealing the victory for Boulder and sending the team to Quebec.

“Coach Neil did a very cool thing,” Megan Gilhooly said. “He had players from the team he coached 10 years ago (who also were underdogs in the championship and won) send videos about what the Quebec experience meant to them. e players who sent videos had gone on to play juniors and/or college hockey. ese videos inspired the team and set

“It meant a ton (to get the win),” Runbeck said. “We had a bunch of kids and coaches and parents that all bought into everything that we’ve been kind of building up to at that point.”

It’s a lot of traveling, ice training, games and practices, he said. It takes a village to keep a club team together and operate at a high level through the ups and downs of a season.

To nally break through and beat their Goliath, it meant the world.

“It was a lot of, you know, validation for the kids and the parents and the other coaches that all that hard work paid o ,” he said. “You don’t know that it’s going to work out, but just hoping it’s developing some good habits with kids, and you just kind of let the chips fall where they may. But yeah, I would say that moment of winning was exhilarating.”

Runbeck credited players Brandon Guyette and Elijah Gold for their defense and tenacity, Josh Rioux for being “a stud” as a leader and understanding the team’s dynamics and Gilhooly for being a “beast” and o ensive anchor for the team, scoring close to four goals per game.  en there are the goalies, Braden Smith and Ben Collins.

“I mean, I’ll tell them sometimes, like, ‘Hey, Ben, you’re starting.’ And he’s like, ‘No, it’s Braden’s turn,’” Runbeck said. “ ey’ve totally taken over the ownership of being the goalies and splitting time and cheering each other on.”

e RoughRiders still have a handful of league games left on their schedule as well as the Rocky Mountain Hockey Federation playo s in early February.

“As a hockey mom, I always want what’s best for my boys, but I also am a big believer in advancing Colorado hockey … is season and last season have shown that more than one team can lead the hockey scene here in Colorado, and that’s good for every player. Having many strong programs in the state raises the bar and encourages better development at all levels.

e key here is that when more than one Colorado team can vie for great opportunities like this, the kids playing hockey in Colorado win.”

National Western Stock Show returns through Jan. 26

Another year of the National Western Stock Show (NWSS) is here and with it comes a variety of rodeos and entertainment.

Taking place through Jan. 26 at the traditional National Western Center, the events draw hundreds of thousands of people to the area.

Paul Andrews, the CEO of the National Western Stock Show, said this is a year of new beginnings.

“We’ve got about maybe a dozen, maybe a little more than that, new vendors in the trade show hall that have some really interesting products that people will enjoy,” Andrews said. “It’s kind of the year of the baby around here. We’ve got lots of baby animals that have been born, and in fact one is the baby Scottish Highland cows that will be here up in our expo hall, and they’re going to be available to take pictures with.”

Andrews said there is also a new baby Clydesdale horse that will be at the stock show. e Clydesdale horses are large creatures who pull the wagons during the rodeos. Andrews said there will be about 130 rodeos throughout the stock show.

So far, Andrews said the early indicators, including ticket sales, show there could be as many as 700,000 people who visit the Stock Show. In addition, there are participants from all 50 states and other countries who will participate in stock show events. is contributes to what the NWSS estimates is a $171-million economic impact in the Metro-Denver area during the 16-day event.

“ at’s only the second time in my tenure that I can say that, and I’ve been here for 15 years,” Andrews said. “Our ticket sales are signi cantly ahead of any other year on this same date. If Mother Nature holds up on the weather for us, and we don’t get some 20-inch snowstorm or something of that, yeah, that will impact ticket sales. We’re feeling very good about (ticket sales).”

e NWSS also redid its menu in the steakhouse this year, including the addi-

tion of a 48-hour braised short rib “that is as big as my arm,” Andrews said.

“Like always, there’s something new at the Stock Show. But there’s also the same great traditional things that people love,” he added.

About 600 temporary workers were hired this year to enhance the events. Many have been on site since December, and some will work into February.

CEO change coming

Andrews has been a stalwart of the NWSS for decades. Having been its CEO for 15 years, he’s nally ready to pass the torch to another person.

However, the NWSS has not named a replacement at this time. e organization is going through a national search to nd someone who can ll Andrews’s boots.

Andrews said he will stay on as the CEO until the NWSS can nd a replacement.

“I’ll be down here all the time at the next year’s show, and the show after that, and the show after that, God willing,” he said.

Andrews has sentimental value in the things he will miss most as CEO of the NWSS.

“Really, it’s been the smiles that I get to see every day in January,” Andrews said. “I so look forward to watching all the families coming through the exhibits that we have here, seeing the animals in the petting farm where the kids are actually in there with animals.

“I’ll also miss the sta ,” Andrews continued. “I’ve become very close to both our sta and our volunteers, and I can tell you that our sta and our volunteers and our committees and our board are some of the best people on planet Earth, and I will miss them.”

e good news, Andrews said, is that he lives in nearby Arvada, so popping over to the NWSS is just a short drive.

National Western Center upgrades

e National Western Center is in the midst of its largest overhaul since the Stock Show came to Denver in 1906. Although no new buildings are open for this year’s events, the Sue Anschutz Rogers Livestock Center will be open for the 2026 National Western Stock Show.

“We are currently working with the (National Western Center Authority board) and a development partner to build out an equestrian center, hotel and parking garage,” said Marcy Loughran, the chief communications o cer for the Denver Mayor’s O ce on the National Western Center. “ e current timeline for that is anticipated for either Stock Show 2028 or 2029.”

ere’s also the land known as the “triangle,” an area that includes the Denver Coliseum and several other buildings.

Discussions with local organizations that want to see the land repurposed for housing and other community uses are ongoing. e GES Coalition, a nonpro t that works with the Globeville, Elyria and Swansea neighborhoods, has been trying for years to make use of the land that would bene t the neighboring communities.

Loughran said the city is planning to meet with the coalition and community members in the near future to determine the best uses of the land.

The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner no less than three (3) days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist a the time of service of this Notice of Default and Foreclosure Sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of certified funds or a cashier’s check payable to the Secretary of HUD, before the public auction of the property is completed.

The amount that must be paid if the mortgage is to be reinstated prior to the scheduled sale is $551,446.67 as of December 16, 2024; plus all other amounts that would be due under the mortgage agreement if payments under the deed of trust had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posing notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out of pocket costs incurred by the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.

What are the allegations?

These machines must be tested every so often to be sure they’re working right — otherwise, the chemist would have no way of knowing if the results they are getting are accurate.

To test the machines, the chemists use a reference sample with a known amount in it of whatever they’re looking for. This same sample can also be used to calibrate the machines.

For the test in question, this quality check is supposed to occur every 10 tests, Calonge said.

The allegations are that at least two chemists cut corners by not running the quality-control tests correctly on the machine used for Method 200.7. At least one chemist is accused of not inputting the actual value produced during the quality-control test into the state’s system, but rather cutting and pasting in a value from a previous test.

Why doesn’t the machine automatically record the test result in the state system?

Because it’s old.

Calonge said the state lab is a mix of old and new machines. The newer machines directly deliver results electronically into the state’s system. Some of the older machines do not.

“So you have to take the data directly from the machine and enter it into a different machine,” Calonge said.

That extra step provided an opportunity for the alleged data manipulation to occur.

Despite not being cutting-edge, Calonge said the machine would have met federal

testing standards had the quality-control tests been run as required.

Were actual water tests affected?

The state is sending samples to outside labs to double-check. But Calonge said there’s no indication so far that people were at risk of drinking toxic water.

“We continue to have no evidence of values that would pose an imminent public health threat to people drinking that water,” he said.

How widespread is the problem?

Calonge said there are about 2,400 water providers in Colorado, and the state lab conducted testing for a minority of systems. Some larger water systems, like Denver Water, conduct their own testing.

Others use third-party labs.

Of those tested at the state lab, Calonge said 69 systems were potentially affected by the quality-assurance issue, and all are smaller municipalities or water suppliers.

“The impact was really in those 69,” he said.

Of those systems, the state has determined that 24 required retesting.

The state has notified those systems. They have also notified well-users who may have been affected, and have sent well samples to another lab for a re-check.

When did the state know about this?

This started last December when a manager in the water chemistry unit of the state lab spotted concerns with the work of one chemist, Calonge said. This manager alerted a supervisor.

In February, after no action had been taken, the manager took the issue to the lab director, who notified CDPHE executive director Jill Hunsaker Ryan, who launched an investigation. The chemist whose work

The investigation continued until April, when CDPHE informed officials with the Environmental Protection Agency, Calonge said. The EPA certifies water-testing labs.

In May, the EPA revoked the state’s certification to do that Method 200.7 test, as well as other tests that the chemist had worked on, such as testing for nitrates or pesticides.

This week, CDPHE uncovered problems with the quality-assurance work of a second chemist. After finding that, the agency made the decision to suspend water testing in the chemistry unit of the state lab while it continues to investigate.

Are other parts of the lab affected?

CDPHE’s lab is divided into six units, working in everything from water quality to disease surveillance to food safety. Calonge said there is no indication so far there are problems with other units within the lab.

“We believe that this issue is isolated in the water chemistry unit,” he said.

Is this related to the allegations about DNA testing in criminal court cases?

No. That is separate and involves a separate lab — the state crime lab, which is run by the Colorado Bureau of Investigation.

Is it related to the allegedly falsified data on toxic substances from oil and gas wells?

No. That data was allegedly submitted to the state by consultants hired by energy companies.

So Colorado has three, simultaneous, ongoing scandals related to data manipulation and lab testing?

Yes, that is correct.

Why would someone do this?

Calonge said the state has not determined a motive for the alleged data manipulation on the water tests. He said it’s possible short-cutting would be done to save time and hassle in doing the quality-assurance work correctly, but that’s speculation.

“The motivation we can only conjecture on,” he said.

What happened to the chemists involved in this issue?

The first chemist whose work was questioned has now retired. The second chemist whose work was flagged this week has been placed on leave.

What is the state doing now?

Calonge said CDPHE is continuing to investigate by diving deeper into previous test results.

“Now we’re at the point where we’re going through something like 550,000 lines of data looking for irregularities in the control values,” he said.

For tests that are EPA certified, like the Method 200.7 test, CDPHE has begun outsourcing that work to commercial, federally accredited labs. Some tests that aren’t EPA-certified have been shifted to other units in the lab. Meanwhile, CDPHE is talking with the EPA about how to get its water-testing program back online.

“We have to fix this,” Calonge said.

“One of the biggest things it impacted was trust in the state laboratory. It was an important and critical lapse in our water quality assurance system.”
