Band raising money for California trip Jeep Cherokee or cash up for grabs in raffle By Ashley Reimers

areimers@colorado communitymedia.com When it comes to practice, the Legacy High School band is all business. Once the group of 190 students steps onto the pavement in the school parking lot, not only are they expected to rehearse flawlessly by band director Clay Stansberry, but also by themselves. It’s not uncommon to see a student drop down and do pushups after missing a beat or a step. This hardcore dedication to perfection is part of the band’s preparation for the Rose Parade on Jan. 1, 2015 in Pasadena, California. The band was notified last October of the honor, and ever since then has been busy spending hours practicing and more hours raising money for the trip. It will cost about $1,900 per student to attend. Students have been selling batteries, chocolate bars and peaches and now are in a major push to sell raffle tickets for a 2014 Jeep Cherokee or $20,000, the choice left up to the winner, which will be announced during the Legacy Marching Festival on Sept. 27. The band is hoping to raise $125,000 from the raffle, which is just a portion of the $500,000 needed for all students, staff and equipment to get to California “The raffle is the big one, which will be spread to all the kids, unlike the other fundraisers where what each kid made, went into their personal trip account,” said Lori White,

tkranz@coloradocommunitymedia.com Despite the concerns of the district attorney and the sheriff, the Adams County Board of County Commissioners approved a ballot measure asking voters to authorize a sales tax on recreation marijuana. The 2-1 vote happened during the board’s Sept. 2 regular meeting. Commissioners Charles “Chaz” Tedesco, District 2, and Eva Henry, District 1, voted in favor. District 3 Commissioner Erik Hansen voted against. If approved, a 3 percent sales tax would be applied to recreation marijuana and recreation marijuana products throughout the entire county, even the incorporated cities. This would affect Northglenn, which allows retail sales, and Aurora which will allow it beginning Oct. 1. Hansen, Sheriff Doug Darr and District Dave Young urged the board to consider not the sales tax question, but instead if county residents wanted to allow retail marijuana in unincorporated areas at all.

Right now the county has a moratorium on retail marijuana that expires at the end of this year. “My concern is we haven’t seen in discussions yet when it comes to public safety,” said Darr. “The district attorney’s office, the educational community, the medical community, the substance abuse community — I believe they ought to have the opportunity to weigh in. More importantly the people who live within the communities in the neighborhoods ought to have something to say about it. They need to know what their community will look like.” Young added that his concern was not about the “40-year-olds or the adults who smoke marijuana for recreational purposes. It’s the message we give our kids when we allow marijuana industries to come to Adams County. That it’s OK to have marijuana.” He said the advertising done by retail marijuana stores could prompt teens to smoke it, which makes efforts to reduce truancy and drop-out rates harder to accomplish. The sale of retail marijuana and retail marijuana products is currently taxed by the state of Colorado with a small percentage of the tax being shared back among all of the communities, according to county attorney Heidi Miller. “The current state sales and excise tax structure on retail marijuana and retail marijuana products

is not designed to provide an equitable share back of the tax revenue to the communities from which revenue is derived,” she said. If voters approve the 3 percent sales tax on retail marijuana and retail marijuana products the revenue would pay for educational programs and for direct and indirect costs incurred by the county related to regulating and licensing such establishments, Miller said. Henry and Tedesco stressed that passing the sales tax measure would not mean retail marijuana establishments could operate in unincorporated Adams County — that is a decision the board will have to make by 2015. Tedesco said it was the board’s responsibility to ensure tools were in place in case the current or future boards do decide to allow marijuana retail. Plus, he added, the county needed to address the cities that do allow these establishments — Northglenn and Aurora. Hansen, who voted against placing the tax measure on the ballot, said while he respected the voters’ decision in 2012 to decriminalize recreation marijuana use, he did not think most voters wanted retail establishments in their neighborhoods. According to the ballot language, the county expects to generate $1,260,000 annually in the first fiscal year (2016) if the tax measure passes.

Federal Heights council appoints new member By Ashley Reimers

areimers@coloradocommunitymedia.com John Hamlin is the newest member of the Federal Heights city council. He was sworn in on Sept. 2 after unanimously appointed by his fellow councilors. Hamlin will be serving out the remainder of Tanya Ishikawa’s term, who moved out of the city, representing Ward 1. “We appreciate young people like John stepping forward to serve their city,” said Mayor Joyce Thomas. “It’s a privilege to have John sitting here.” Hamlin moved to Federal Heights in late 2009 after working on Wall Street for a large financial institution handling government retirement plans. He has a Bachelor of Science degree in business

management and is currently working on earning an MBA. Hamlin, who is married to Lisa, is also a new dad to three-month old Emily. He said the move to Federal Heights was an effort to live in a small town but also have easy access to the big city. “In Federal Heights you have that local feel, but you also have everything in the big city close by,” Hamlin said. “I really love the community feel and everything the city does for the community.” About six months ago Hamlin began his involvement with local politics by attending city council meetings and addressing the city council during those meetings. He said the interaction with the council prompted him to apply for the Ward 1 position. Teamwork was also appealing to Hamlin. He said when the council works together

with each other, staff, law enforcement and fire, a lot can get accomplished. But it was the newest member of his family that really pushed him to apply. “My final decision came down to the fact that I want to be a good role model for my daughter,” Hamlin said. “I also want to get the younger folks and the kids in the community involved.” Hamlin is also hoping to grow the business community in Federal Heights and focus on education in the city as a councilman. He said he’s excited to role his sleeves up and get into the “nittygritty.” “I’m excited to express my ideas to the council and work to get the community more involved in our government,” he said.

Opportunities out of the ‘oops’ “This could be the worst disaster NASA’s ever faced.” “With all due respect, sir, I believe this is going to be our finest hour.” I just happened to be flipping through the channels the other day, when this scene from “Apollo 13” jumped off the screen at me. Not only is that scene remarkable for the intensity of its acting, but because that line so effectively expresses something I believe. Maybe that struck me last week because of a new study I read about. Researchers at Northwestern University discovered that the study of music is very effective at closing the achievement gap. That’s right — music, according to this study, has the ability to make minority students perform better at reading and math. Oh, and, um, yeah — those of you who have been reading my columns for a while now? Yeah, this is going to be one of those weird trips through the catacombs of my mind. Okay, so, how do those two things relate? One of my firmest beliefs about music,

and one of the reasons I believe it to be such an important field of study, is that it is not an art of the perfect. That is, music is a live performance art, and, as such, is subject to the vagaries of human execution. So, whether it is your local school band or the New York Philharmonic, every performance will have imperfections. Granted, the mistakes committed by the members of the Philharmonic will be less obvious than the mistakes of your local school band, but, if you ask the members of the Phil after a concert, they would name a dozen different things (none of which you

likely noticed from the audience) that went wrong. On the other hand, what a gift! That means that no two performances are ever exactly alike, which creates an amazing opportunity to make real art. So if it is not an art of the perfect, then what is music? I tell my students that music is an art of recovery: you know things will go wrong, but how you respond — how quickly and how adroitly — dictate how much those mistakes will affect the audience’s experience. Really good musicians make few mistakes to start with, but the ones they do make, they compensate for so quickly that the audience rarely knows they happened at all. Learning, too, is an art of recovery. I know very few students who get everything right the first time. Many students, when faced with that, accept it as part of the process and work their way towards getting things right. Some students, when faced with that, give in to their frustrations and stop moving forward. Does that explain the achievement gap? I don’t know—I don’t even know if that

particular question has ever been studied. Maybe. Turns out, life is an art of recovery, too. As we strive towards higher and greater destinies (like the moon), the opportunity for mistakes expands exponentially. Our ability to adapt and cope when things go wrong goes a long way towards dictating whether we have a chance to realize our dreams, or if they remain just that—dreams. The crew of Apollo 13 and those with them on the ground found a new gear of creativity and execution to bring that ship home safely. And so, sometimes, do we need to, also. So dream big! Strive, struggle, learn to adapt, and move forward—always move forward. Your finest hour is somewhere out there, even with disaster lurking in the shadows. New emergency department facilty to open By Ashley Reimers

areimers@colorado communitymedia.com Residents in Westminster will soon have access to a new freestanding emergency department after the Sept. 15 opening of North Suburban Medical Center’s Northwest ER at 112th Avenue and Sheridan Boulevard. This is the second freestanding emergency department to open, the first being Northeast ER at 128th Avenue and Holly Street in Thornton. The Northwest ER will feature: a dedicated trauma/resuscitation room with advanced emergency medicine technologies, 10 private patent rooms, including two rooms devoted to pediatric care, on-site imaging services, a full-service onsit laboratory staffed with clinical laboratory scientists and a telemedicine camera providing 24/7 patient consultations by physician specialists. “We are really proud of being a community hospital and having what people will tell you a `family feel,’”, said Jennifer Alderfer, North Suburban CEO. “We’re excited to bring that family feel and culture to our neighbors in Westminster by providing convenient, top quality emergency care.” The staff at Northwest ER will also be dedicated to a no-wait

expectation. Bart Davidson, director of Northwest ER, said by being creative with the facility’s space, people will not be stuck in a waiting room, instead they will be quickly addressed by a nurse in a patient room before being addressed by a physician. He said in times of high volume when patient rooms are filled, staff will communicate openly with the patient about the situation. “Nobody is ever going to come in and be ignored. Everybody will be addressed,” Davidson said. “We have an expectation that every patient at our sites will be seen by a doctor in less than 10 minutes. We are able to meet that goal at about five to seven minutes.” To celebrate the opening and welcome future patients, the staff at Northwest ER is hosting a free family festival from 11 a.m. to 2 p.m. on Sept. 13. The event will feature free bike helmets for children, games, activities, health resources, food and free flu shots. “This event is our way of introducing ourselves to the community and provide them with some really solid healthcare education,” Davidson said. “We’ll have physicians on staff doing blood screenings and people can also speak one-on-one with our nursing staff and specialists. We want the community

Applications due for emergency home repair program The City of Westminster provides federal Community Development Block Grant funds for an Emergency and Essential Home Repair Program, which is intended to assist owner-occupied, low-income households in making repairs deemed essential to preserving the health, safety and welfare of the home’s occupants. Up to $5,000 in eligible home repairs can be made free of charge to income-qualified households located within Westminster city limits (within both the Adams County and Jefferson County portions of the city). Funding is limited and applications are only accepted while funds are available. The city’s program is administered by the Jefferson County Housing Authority. Tea social to feature historical instruments By Ashley Reimers

areimers@coloradocommunitymedia.com Glancing around Virgil Hughes’ apartment in Lakewood it’s easy to see the 90-year old World War II veteran is a musician. There are instruments in every corner of the living room, on the floor, in his bedroom, and not to mention in multiple storage units. He guesses he has over 200 instruments, some dating back to the civil war. “I’ve grown up with music, ever since my father said he wanted me to play an instrument when I was in the second grade,” Hughes said. “I also grew up in Oberlin, Kansas, which was a very musical little town. Even today the town still does a lot musically for a town of that size.” Hughes will be sharing his vast knowledge of Civil War brass instruments and presenting his instrument collection, which also includes renaissance trumpets, wind and string instruments and restored hurdy gurdies, during the Westminster Historical Society’s 16th Annual Tea on Sept. 20 at the Westminster Grange, 3935 W. 73rd Ave. The event will be 2-4 p.m., and a light lunch will be served. Historical Society member Mary Lindsey said she was delighted Hughes will be this year’s speaker. She said the society always tries to provide an entertaining program with some history involved for the tea, and Hughes was a perfect choice. “Vigil is a quiet man, but he is pretty sharp for his age,” she said. “He’s very knowledgeable and people will be able to ask him questions about the many instruments he has. It will be a lot of fun.” Hughes spent over 40 years in the army before retiring in 1986. During those years he worked in the disaster control team as an engineer for the U.S. Army and also opened a business called Hughes Dulcimer Company, which made reproductions of antique instruments. The company closed just three years ago after 46 years in business. Nowadays, Hughes spends his time playing in six bands, one called the Friday Afternoon Band, which gets together at his assisted living center every Friday to

play old music on modern instruments. Hughes said the band is pretty exclusive, only open to musicians “who know what they’re doing.” “It’s a silly name for a band, but we enjoy it,” he said. “I stay busy with the bands, but music is way of life for me. It’s fun. I can pick up any instrument and just play,

it comes easy to me.” Tickets to the tea social featuring Hughes are $15 for historical society members and $18 for nonmembers. Senior citizens or groups of four or more are $16 each. Why I can’t unsee what I’ve read about 9/11 I haven’t watched the videos of the recent slayings of American journalists. I’ve read the news accounts and the still photos are horrific enough for me, and I knew that I could never unsee it. But in the theater of my mind, I did see it; in fact, I see it over and over. I see it because I’ve read accounts in the news about what happened, just as I did about the Aurora shootings, and Jessica Ridgeway’s abduction, and the transports and death camps of the Holocaust. I wasn’t a physical witness to any of these, and yet I can see, I can see, I can see these wicked events taking place. Such is the power of words. In September especially, but often throughout the year, my mind returns again and again to the images of the Twin Towers. Like most of us, I watched first in disbelief, then in growing horror, anger, and helplessness. Because of the immediacy, even 13 years ago, of real-time news reporting, I watched September 11, 2001, unfold as I was clustered around a television with dozens of coworkers. The planes, the fires, the collapsing buildings … all seared into our shocked and grieving collective consciousness. I don’t remember if I watched this next part actually taking place, but I’ve seen the photographs of people leaping from

the flaming buildings, caught by the still frames of a camera. And as much as these images haunt me, it’s what I have read that frequents my memory and deepens my sorrow on Sept. 11. I’m referring to a critically acclaimed poem by Brian Doyle, titled “Leap.” Doyle’s opening line, “A couple leaped from the south tower, hand in hand,” sets the scene. If you search the Web for this topic, as I did for this column, you’ll find that some people think the images of a man and a woman holding hands as they fell are a hoax, claiming the pictures are photoshopped. But Doyle relies on eyewitness accounts from people who did the seeing – not just of this couple but also of others, very real people forced to make those harrowing desperate choices. Doyle gives us descriptions from horrified spectators, descriptions made even more chilling in their spare language:

“people ‘leaping as they flew out.’” And “‘falling over themselves’ … ‘too many people falling.’” Doyle also relates the events on the streets below, where pedestrians and a firefighter were killed “by people falling from the sky.” Doyle ends the poem by speculating about the moments leading up to the hand-in-hand plunge. To paraphrase: did they know each other…friends, colleagues? Or were they strangers “thrown together at the window at the lip of hell,” strangers who “held on tight, and leaped….” Through these unblinking words, I make more of a human connection with the victims than I ever could by watching videos or viewing photos. And it’s because I have read “Leap” that I can’t unsee their desperation, the agony in their final acts. But perhaps that’s what needs to happen, so that these victims, too, will never be forgotten, to keep this tragedy in the theaters of our minds. Such is the power of words. Andrea W. Wishing to expand Westminster’s fine arts Recently, my wife Ann, daughter Nicole and I attended a most interesting and inspiring lecture at the Arvada Center for the Arts and Humanities. The speaker was Eva Schloss, who was Anne Frank’s step-sister and had lived across the street from the Franks in Amsterdam at the time German Nazis invaded Holland in World War II. Mrs. Schloss, who is now in her mid-80’s, was a most articulate speaker who could recall details of the Nazis’ atrocities and the fear they brought like it happened yesterday. Eva’s family just like the Franks were Jewish and had to hide to avoid being captured and brutalized by the Nazis. Anne Frank and her mother perished at Auschwitz death camp while Eva’s family was killed as well except for she and her mother. Ultimately, Anne’s father and Eva’s mother married.

Early endeavors

In part, the lecture experience gave me pause about how much I appreciate the Arvada Center and what it has to offer the general public. However, the “bigger takeaway” for me from this outstanding lecture was what Westminster residents could have enjoyed all these years with its own cultural center? Don’t get me wrong; I very much appreciate the Arvada Center and we attend events there from time to time. And I recognize the efforts which the North Metro Arts Alliance (NMAA) does for the Westminster community. The NMAA is the former Westminster Community Artist Series which was started by Wilbur Flachman and four other Westminster Rotary Club members — dentist Dr. Jacob Heil, banker Don Hogoboom, attorney Richard Bauer and myself. I will never forget the very first event the Artist Series sponsored. It was the Denver Symphony Orchestra performing at Ranum High School Auditorium. What a delight! That was back in 1983. The Scientific & Cultural Arts Facilities District played an important role in the Artist Series bringing quality performances and sponsored local artists’ exhibits.

lege Hill Library at FRCC, College President Tom Gonzales and myself embarked upon an effort to bring a performing arts center to FRCC. The Westminster City Council was fully in support of this endeavor and earmarked the city’s portion of funding for the joint venture which was to be sited on the FRCC campus. Gonzales worked hard with the statewide community college system board of directors to garner the necessary approvals and state funding. Approvals were accomplished through the Capital Construction Committee at the Legislature as well as both houses of the Legislature. The final approval needed was the signature of the governor. At the urging of one of the governor’s staff, Gov. Bill Owens line item vetoed the FRCC cultural facilities funding. As it turned out, it was a personal feud between Gonzales and the governor’s staff member which triggered the veto.

What might have been

I occasionally think about what might have been if Owens had approved the funding. Westminster and the College would have had another shining example of intergovernmental cooperation which would have benefited the public, FRCC students and area K-12 schools. Westminster nonprofit organizations like NMAA and others along with local theatre groups, dance groups and artists could have had the use of such a facility and in turn for the enjoyment of different audiences. Just think ... the FRCC/Westminster cultural arts facility could have been host to Eva Schloss’ lecture. It is a darn shame that politics and personal vendettas get in the way of good things. Remember this poem when you next meet an older person who you might brush aside without looking at the young soul within … we will all, one day, be there too! Stay well, stay involved and stay tuned. LETTER TO THE EDITOR I am disappointed, but not surprised with columnist Bill Christopher’s attack on the proposal to grant collective bargaining rights to city firefighters. Christopher’s position is elitist, extreme and unfortunately typical of many local government officials and control soldiers who believe they have the right to interpret the bill of rights as they see fit. I commend the city councilors’ who stood up for the firefighters and the basic principle of freedom of association. Federal law has long established joining a union as a right not a privilege or optional measure that should be subject to a public vote. If Christopher was consistent with his position he would also call for a public vote before municipalities could join the Colorado Municipal League. Workers’ joining a union to protect their interests is not a ballot initiative. Consider the fact that many people have come to believe that local governments have become a bigger threat to individual liberty than the federal government ever was. Corporate influence on government and the

growing economic disparity is a separate, but relevant discussion. My next job will be in your city working in the private sector, but I previously worked twenty five in a federal prison. Joining a union was not about pay or benefits for most. It was about safe working conditions, employee morale, and respect for work. Christopher went out of his way to exaggerate and distort his perceived adverse impacts of collective bargaining and fails to mention that most municipal employees have far fewer employment rights than even the limited rights established for federal employees in every state in the country. Those employment laws serve the public interest by making government more accountable and efficient. More importantly those laws that recognize the democratic principles that define our nation. hen artistic director and choreographer Darren Charles describes “Odysseo by Cavalia” as an “extravaganza” show, he may not be exaggerating. The show has 46 performing artists — riders, acrobats, aerialists, dancers and musicians — 64 horses of 11 different breeds, 350 costumes and 100 pairs of shows (artists may have up to seven different costume changes) and a highdefinition computer graphic images that are shown on a cyclorama the size of three IMAX screens. “It’s a journey, people all over the world have been sucked into this journey and when the show is over they feel like they just come out of a fairy tale,” said Amanda Orlowki, a performance

rider. “Odysseo” makes its premiere under the White Big Top at Pepsi Center in Denver Sept. 17 and runs through Sept. 28. The stage is made up of more than 10,000 tons of stones, dirt and sand, Charles said, “No one knows it’s there so it’s magical to see when we reveal it.” Charles and Orlowki agree that one of the biggest highlights of the show is the descending full-size carousel. “This is a very dynamic part of the show,” Charles said. The carousel has the most horses on stage at one time, which proves to be challenging, said Orlowki. “A lot of the horses are stallions and they can have very strong characters,” she said. “So timing is very important.” There are performances that include aerobatics done with the horses and white silk. “It’s pure horse power pulling the aerialists in the air,” Charles said. The breeds of horses include Appaloosa, Arabian, Canadian, Holsteiner, Lusitano, Oldenburg, Paint Horse, Quarter Horse, Spanish Purebred (P.R.E.),

Warmblood and Lipizzan. All performers, including the horses, get a break between each city they tour. “The horses will go to a farm or range and graze for a couple weeks,” Charles said. “It’s important everyone gets their break, the show is very demanding.” The artists are from around the world including the United States, Canada, Brazil, France, Belgium, Guinea, Russia, Spain, Ukraine, Japan and Poland. If the show seems similar to a Cirque du Soleil performance — there’s a reason. Normand Latourelle is the founder of Cavalia and was a co-founder of Cirque. Cavalia is an entertainment company and made its Denver debut a few years ago with a different show. “When Cavalia was in the city in 2010, we had one of our most successful runs ever,” Latourelle said. “Colorado audiences have a deep appreciation of the artistic spirit and a great connection with our unique art form. The program is called the Second Saturday Series and will touch on a broad range of topics related to writing and publishing with the first program happening on Sept. 13 at Front Range Community College in Westminster. “We always offer a series of programs to our members, but we also want to make them available to the public,” said CAL vice president of programs Denny Dressman. “We’ll have a different topic each month, some lasting half of a day and others taking up the full day.” The first session from 8:30 a.m. to 12:30 p.m. is called “Here Comes the Pitch: How to Succeed as a Freelance Writer.” The session will feature a panel of local writers and authors including Diana Rowe, Rachel Cernansky and Rob Reuteman and editor Jon Rizzi. Dressman said anyone who already works as a freelance writer or would like to pursue freelance writing would benefit from the program.

“The program will be going over tips for getting a piece published, how to pitch a story idea and what to expect from an editor,” he said. “The panelists will also discuss fees and rights, those kinds of things.” Dressman said the programs will be hosted in various areas of metro Denver. Locations for future sessions are still in the works, but final locations can be found at www.coloradoauthors.org. The next session is Oct. 11 and is called “Sizzle! Sizzle! The Creative Side of Selling a Book”. Other sessions include “CAL Craft Fair: Practical Programs on Improving Your Craft” on Jan. 10 and “The Genre Fest: Romance, Mystery, Children’s Stories and More” on April 11. “There really is something for everyone in this series,” Dressman said. “For people who are aspiring to write, or have already been published, there is something of value for all levels.” Cost for the half-day sessions is $20 in advance or $30 at the door for CAL members. Cost for nonmembers is $30 in advance and $40 at the door. Tickets can be purchased online at www.coloradoauthors.org. A one-year CAL membership is also available for $50.

man, to the work is worth it.” As 2014 continues to winds down, the Legacy High School band will be gearing up for their trip to the west coast. Stansberry said he’s proud of the work his students have put in preparing for the parade. “We’re the only high school from the Western United States to be chosen for the parade, so we’re actually rep-

resenting all of Colorado and all of the western part of the country,” he said. “It’s a great accomplishment for the students.”

Lone Tree becomes affiliate member of E-470 The E-470 Public Highway Authority board of directors voted unanimously on August 28 to admit the City of Lone Tree as an affiliate member of the authority.

Affiliate members are non-voting but they are provided a voice at the board table on topics concerning E-470 plans and issues that may affect the affiliate member. Lone Tree joins four other jurisdictions that are affiliate members. The City and County of Broomfield, Weld County and the City of Greeley joined in 1997; the City of Arvada joined in 1998. E-470 is the 75-mph toll road that runs along the eastern perimeter of the Denver metropolitan area. The road is financed, constructed, operated and governed by the E-470 Public Highway Authority, which is composed of eight local governments, each of which has voting authority: Adams, Arapahoe and Douglas counties, and the municipalities of Aurora, Brighton, Commerce City, Parker and Thornton. E-470 is not tax funded and is ineligible to receive tax funding from the state or the authority’s member governments.

Seconds to spare: Horizon earns last minute win By Scott Stocker No team ever wants to give up in the final minutes. And never giving up in those finals moments enabled the Horizon football team to pull off a dramatic, 42-40, victory, last Thursday against visiting Chatfield. Horizon’s Gino Tate pulled in a 10-yard pass from quarterback Ayden Karraker with just 47 seconds left in the game to help garner the win. Yet it was also the last of three touchdowns the Hawks scored after they had fallen behind, 40-28, with 7:07 left in the third quarter. “It was a good one to win and we didn’t give up,” said Karraker, who passed for 162-yards. “We came back hard and we were able to get the win late. We felt confident and I know I did the best I could. We knew they were a top-10 team and we just wanted to play well. “Our key was our offensive line,” Karraker continued. “It was able to help us get at least four-yards per carry on the ground. We got the ball with the short time remaining and were able to drive for the win. It was just a crazy night and finish.” And it certainly was a crazy night for Horizon coach Frank Ybarra as the Hawks improved to 2-0 while Chatfield dropped to 1-1. “The boys wanted to prove that we belonged and that we can be among the best teams this season,” Ybarra said. “Chatfield stuck us hard at first with their speed as well as being more physical than us. It took time to adjust, but late in the third and fourth quarters, the boys really came through. Down the stretch we were really confident and believing in what we could do.” And what a fine night it turned out for Horizon running back Keenan Wilson. He scored four touchdowns — the third on a 3-yard run with 1:52 left in the third quarter and his final on a 16-yard run with 8:50 left in the game. Wilson rushed 18 times for 114-yards and though he didn’t score the eventual game winning touchdown, it was his efforts that helped get Horizon into a winning position as the clock ticked down. After all, any of his four scores can be counted as game winners. “It was just a great game that Keenan was able to come through with four touchdowns,” Ybarra said. “It’s a win like that and efforts that Keenan and all the boys gave, that helps build our confidence in what we can accomplish this season.” Indeed, it was a thrilling victory for Horizon’s defensive standout, Dominick Castiglione. “This game felt to me like we were in a movie,” Castiglione said. “We knew that we were considered the underdog going in and knew that we had to play hard all the way. We got the stop on their team

That’s what we did this week and we all hope we can keep it going.” Putting the clamps on Chatfield quarterback Kyle Winkler and running back Sean O’Dell was difficult through the first three quarters for Horizon. Winkler would finish the game with 246-yards in the air with 25 completions to nine teammates. Over the same course, O’Dell would finish the night with three touchdown receptions, catching 11 for a total of 85 yards and rushing 12 times for 72-yards. Horizon, that opened the season with a 32-18 victory against Prairie View, will travel to play Fairview, September 12. Chatfield defeated Everglades of Miramar, Florida in its opener, 24-14. The Chargers will host Lakewood September 12.

Prep football roundup: Westy wins big By Scott Stocker You might call it a short work night last Thursday during the Westminster-Hinkley football game. Westminster came away with a 40-0 victory with all 40 points accounted for by the end of the third period. For sure, the Wolves of coach Kerry Denison came in hungry. After it was over, they had improved to 1-1 while Hinkley dropped to 0-2. Westminster quarterback, Jake Walklet had a pretty good night passing for 83 yards, although he only completed four-of-nine. But three completions accounted for a trio of touchdowns. Jordan Tafoya caught three passes, two of which went for touchdowns and a cumulative 75-yards. Brandon Dickerson caught the third pass for an 8-yard score. Jesus Manzanares was next in line in receptions with four catches for 30 yards. Nate Howe caught seven, but only totaled 24 yards in the process. Dickerson was also on his game in the rushing department as he carried the ball 22 times, racking up 180 yards in the process.

Eight others would eventually account for Westminster’s 287 yards on the ground. Helping to lead the defensive effort for Westminster was Jeff Kazur, who came through with seven tackles and had a pass interception.

FOUNTAIN-FORT CARSON 20, LEGACY 14

Fountain-Fort Carson came through with a touchdown in overtime to upend home standing Legacy, 20-14. The Trojans improved to 2-1 with the victory while the Lightning dropped to 1-1. Drew Harris led Fountain in rushing with nine carries for 136 yards and a touchdown. Tevein Donnell rushed seven times for only 24 yards, but also scored for the Trojans. Fountain quarterback, Stock Chenault, completed six-of-nine passes for 66 yards and also accounted for a Trojan touchdown. Demario Leonard caught two passes to lead the receivers with 35 yards. The other four completions were on the short end for yardage. Defensively, D.J. Leatimua and Anthony Schmidt came through with 11 tackles apiece

while Elijah Toilolo had 10 stops. And, it certainly wasn’t that great of a night for Legacy, running or passing. Quarterback Matt Lynch completed 10-of22 passes for 60 yards, with Logan Paulson, five for 28 yards, and Jack Ruscher, two-for-2, helping to lead the way. He was also intercepted once. Yet Lynch did have a better time carrying the football as he rushed 19 times for 79 yards. He was joined in the ground attack by Evan Baugh, who had eight carries for 77 yards, and Connor Connolly with 12 carries for a scant 39 yards. Troy Fossett stood out for Legacy this week on defense as he had 10 tackles, which included two sacks. Baugh also came through with eight stops.

Thornton also had a tough night as the Trojans were defeated by visiting Aurora Central, 14-9. The Trojans were offensively held in check. Only two players, Adrian Kois and Juray

Thomas, were able to account for more than 30-yards rushing. Kois picked up 37 while Thomas was held to 30 on the ground. And it wasn’t that much better in the passing department. Quarterback Zane Zuniga only completed four-of-10 passes for 19 yards and was intercepted once. Chris Rojo caught two passes for 13 yards. While the offense could not get on track, the defense, had a fairly good night while holding Aurora Central to two touchdowns. Trenton McCollam led the way with nine tackles, Dimitri Caudillo had seven with Elijah Miscles, Charles Medina and Jacob Bond making six each. Steven Banks and Carlos Estrada each had an intercepted pass.

Jo-Jo a go-go Thornton runner a contender for 5A champ By Scott Stocker Thornton’s Joshua Joseph certainly helped establish himself as a top contender for the Class 5A state cross-country championship last Saturday. Joseph came through with what onlookers might consider an easy victory in last Saturday’s Steve Lohman Invitational at Cherry Creek. He clocked a solid 16-minutes to gain the win, :31-seconds faster than runner-up Daniel Book of Cherry Creek and :32-seconds better than third-place finisher Mason Brevig of Arapahoe. Joseph placed fourth in last year’s state meet in Colorado Springs and said he feels he can come through with a higher finish this time around. Maybe, even win it. As a team, though, it will be somewhat difficult for the Trojans to finish high in the standings. “I just want to get into the low 15-minutes,” Joseph said. “I’m hoping for a PR, bettering my 15:46. I took the lead in the race after one mile and just worked for a larger lead. It was a good win. I’m looking forward to this week’s race at the Liberty Bell where I will be able to run against Zachary Alhamra (Pine Creek).” Alhamra was last year’s state runnerup. He was second this past week at the St. Vrain Invitational in Lyons where he

was beaten by Lyons standout, Paul Roberts. It was an effort at Cherry Creek that also more than pleased Thornton coach Jason O’Shea. “Josh was in second after the first mile, but just took off from there,” O’Shea said. “He was just off the school record. Now, he’s looking forward to the Liberty Bell this week and he should have a great day. The top two in the state in our Class will be there (Alhamra), and it should be a good race.” Thornton finished ninth in the team standings with 218 points. Teammate Jose Garcia placed 15th (17:17) while Jake Keithley (32nd, 18:02), Damian Kifoed (74th, 19:09) and Oscar Delagdo (96th, 20:09) rounded out the days effort for the Trojans. Arapahoe, with three runners in the top-10, won the boys team championship with 51 points while Cherry Creek finished second with 83. Rounding out the top five teams was Fort Collins in third (85 points), Douglas County in fourth (159 points) and Cheyenne Central (Wyoming), fifth (171). Lauren Gregory of Fort Collins won the girls individual title. Again, it seemed to be an easy victory for the victor as she covered the course in 18:23. Cherry Creek’s Devon Peterson finished second with a time of 19 flat. Rounding out the top five was third-place finisher Heather Holt of Fort Collins with a lean at the finish (19:03), Kayli Tabares of Doherty (19:03) in fourth and Lillian Markusch of Cherry Creek (19:28) in fifth.

External auditor to review stormwater program Board wants an outsider to review administration issues By Tammy Kranz

tkranz@coloradocommunitymedia.com An external auditor is being brought in to investigate the Adams County Stormwater Utility program after an annual financial report showed deficiencies in its administration. Meanwhile, a lawsuit is still pending against the county over the fee, which some objectors claim is a tax. The Adams County Board of Commissioners unanimously decided to bring in the external auditor during its Sept. 2 regular meeting. This decision came a week after the board heard from county staff that more than 12,000 businesses and individuals have not paid their 2014 fee, which represents more than $800,000 in uncollected revenue. There have been complaints that the delinquency notices that were sent out had incorrect amounts and account numbers. District 3 Commissioner Erik Hansen and Adams County Treasurer Brigitte Grimm co-authored a letter to Adams County internal auditor John Olenberger asking him to investigate the program. The letter states: “We are concerned that the cost of fixing repeated problems is greater than the revenue generated by the utility. We are also concerned that there is a pattern of missteps that have resulted in a serious erosion of the public trust.” Hansen later said in a phone interview, “There are a lot of issues with just the administration of this program.” He pointed out that the program has had issues since the commissioners approved the fee in 2012 — starting with postcards that were sent out to the affected businesses and residences that had inaccurate information. There were errors on the satellite images used to determine how much a person would be charged for the fee. Hansen voted against the fee in 2012, he said he felt that it was a bad time to add fees to property owners and plus it felt more like a tax to him. The fee was implemented in January 2013 and is charged to property owners in unincorporated Adams County west of Shumaker Road. During the Sept. 2 meeting, District 1 Commissioner Eva Henry suggested bringing in an external auditor instead of the internal auditor. “Since it seems to be the case that the treasurer’s office made many of the mistakes we’re discussing, it is irresponsible to only have the same people look through the data,” she said. She added bringing in the external auditor would ensure complete financial transparency, remove any perceived politics from the equation and would ensure constituents are not being charged unfairly. Hansen made a friendly amendment, which the rest of the board agreed to, to allow the county attorney to review the external auditor’s results first to determine whether or not it will affect the pending lawsuit before the info is released. “We don’t want to put ourselves in a position where anything would affect the outcome of that lawsuit,” he said. Board Chair Charles “Chaz” Tedesco, District 2, encouraged everyone to be patient and said that the audit would be done.

WHEREAS, the Board of County Commissioners (the “Board”) of Adams County, Colorado (the “County”), has determined that constructing, acquiring, equipping, operating, maintaining, and expanding existing and new Adams County Government facilities are priorities to the residents of the County, and it is in the public interest to provide for such improvements to accommodate the continuing growth in population in the County; and, WHEREAS, there are not sufficient funds in the treasury of the County and the Board does not anticipate that existing sources of revenue will be sufficient to generate the moneys necessary for the desired improvements to new and existing Adams County Government facilities; and, WHEREAS, the County is authorized by law to impose a sales tax on the sale of tangible personal property at retail and the furnishing of services, subject to approval by a majority of the registered electors of the County voting thereon; and, WHEREAS, in 1993 the voters of Adams County approved the one-half of one percent (one-half penny per dollar) sales tax for the construction of the Adams County Justice Center, and the voters extended the sales tax in 1997 for the expansion of the Adams County Detention Facility, in 2001 to provide for road and bridge projects, and in 2006 to provide for the additional purpose of constructing, acquiring, equipping, operating, maintaining, and expanding the Adams County Justice Center, a pre-trial holding facility and a centralized government center; and, WHEREAS, the Board has determined that a ballot question authorizing the additional use of the sales tax for constructing, acquiring, equipping, operating, maintaining, and expanding existing and new Adams County Government facilities, in addition to the Adams County Justice Center, a pre-trial holding facility and a centralized government center, with forty percent of the revenues from such tax to continue to be shared among the county and the incorporated cities and towns in the county for improvements to or the building of road and bridge projects, should be submitted by the Board to the eligible electors of the County at the November 4, 2014 General Election; and, WHEREAS, the Board has determined to set the ballot title and ballot text for the ballot question to be submitted at the election called by this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF ADAMS, STATE OF COLORADO: 1. An election shall be held on Tuesday, November 4, 2014, at which there shall be submitted to the eligible electors of the County a ballot issue regarding the imposition of an additional three percent countywide sales tax on the sale of retail marijuana and retail marijuana products in the County. The Ballot Title and Text of the Ballot Issue shall be in substantially the following form: BALLOT TITLE AND TEXT OF BALLOT ISSUE: SHALL ADAMS COUNTY TAXES BE INCREASED BY $1,260,000 ANNUALLY IN THE FIRST FULL FISCAL YEAR (2016) AND BY SUCH ADDITIONAL AMOUNTS AS ARE RAISED ANNUALLY THEREAFTER BY IMPOSING AN ADDITIONAL SALES TAX OF THREE PERCENT (3%) ON THE SALE OF RETAIL MARIJUANA AND RETAIL MARIJUANA PRODUCTS WITHIN THE COUNTY, ALL AS LEGALIZED BY ARTICLE XVIII, SECTION 16 OF THE COLORADO CONSTITUTION, WITH SUCH TAX TO COMMENCE JULY 1, 2015; AND WITH THE REVENUE RECEIVED BY THE COUNTY FROM SUCH ADDITIONAL SALES TAX TO BE USED FOR EDUCATIONAL PROGRAMS IN THE COUNTY, FOR DIRECT AND INDIRECT COSTS INCURRED BY THE COUNTY RELATED TO THE LICENSING AND REGULATION OF THE SALE OF RETAIL MARIJUANA AND RETAIL MARIJUANA PRODUCTS, AND FOR OTHER GENERAL PURPOSES OF THE COUNTY; AND WITH THE REVENUE FROM SUCH TAX AND ANY EARNINGS FROM THE INVESTMENT THEREOF TO BE COLLECTED AND SPENT AS A V O T E R A P P R O V ED R E V E N U E CHANGE UNDER ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION? YES ______

2. The election shall be conducted by the Adams County Clerk and Recorder (“Clerk and Recorder”) in accordance with the Uniform Election Code, C.R.S. § 1-1-101, et. seq., and other laws and regulations of the State of Colorado, including without limitation, the requirements of article X, section 20 of the Colorado Constitution (hereinafter “TABOR”). 3. All acts required or permitted by the Uniform Election Code relevant to conducting this election shall be performed by the Clerk and Recorder. 4. The Clerk and Recorder shall cause all notices of election to be provided in accordance with the laws of the State of Colorado, including but not limited to, the Uniform Election Code and TABOR. 5. Pursuant to C.R.S. § 29-2-104(5), the Clerk and Recorder is directed to publish the text of this Resolution four separate times, a week apart, in the official newspaper of the County and each city and incorporated town within the County. 6. If a majority of the votes cast on the ballot issue regarding the imposition of an additional three percent countywide sales tax on retail marijuana and retail marijuana products shall be in favor of such ballot issue, the sales tax shall be imposed and shall apply to all taxable transactions occurring on or after July 1, 2015, and shall be collected and administered in accordance with this Resolution; the requirements enumerated herein; any applicable Adams County resolution, rule or regulation; the laws of the State of Colorado and any applicable rules and regulations promulgated by the Colorado Department of Revenue. (a) Imposition of the Sales Tax. Upon approval in the November 2014 General Election, there shall be imposed an additional countywide sales tax throughout the incorporated and unincorporated portions of the County of three percent on the gross receipts from the sale of “retail marijuana” and “retail marijuana products” as those terms are defined by C.R.S. §3928.8-101 (the “sales tax”). (b) Adoption of Rules and Regulations. The imposition of this sales tax on the sale of retail marijuana and retail marijuana products shall be in accordance with the rules and regulations of the Colorado Department of Revenue, to the extent they are applicable, and in accordance with any rules and/or regulations of Adams County which may be enacted. (c) Determination of Place at Which Sales are Consummated. For the purpose of this Resolution, all retail sales shall be considered consummated at the place of business of the retailer. (I) To the extent the requirements of C.R.S. § 29-2-105(1)(b) apply to the imposition of a retail sales tax on retail marijuana and retail marijuana products, and to the extent that the following activities are permitted under all applicable rules and regulations relating to the sale of such products, all retail sales shall be considered consummated at the place of business of the retailer unless the tangible personal property sold is delivered by the retailer or its agent to a destination outside the County or to a common carrier for delivery to a destination outside the limits of the County, in such case the gross taxable sales shall include delivery charges, when such charges are subject to the state sales and use tax imposed by article 26 of title 39, C.R.S., regardless of the place to which delivery is made; and, if a retailer has no permanent place of business in the County, or has more than one place of business, the place or places at which the retail sales are consummated for the purpose of this sales tax shall be determined by the provisions of article 26 of title 39, C.R.S., and by the rules and regulations promulgated by the Colorado Department of Revenue. (d) Amounts Excluded. The amounts subject to tax shall not include the amount of any sales or use tax imposed by Article 26 of Title 39, C.R.S.

when such charges are subject to the state sales and use tax imposed by article 26 of title 39, C.R.S., regardless of the place to which delivery is made; and, if a retailer has no permanent place of business in the County, or has more than one place of business, the place or places at which the retail sales are consummated for the purpose of this sales tax shall be determined by the provisions of article 26 of title 39, C.R.S., and by the rules and regulations promulgated by the Colorado Department of Revenue.

(d) Amounts Excluded. The amounts subject to tax shall not include the amount of any sales or use tax imposed by Article 26 of Title 39, C.R.S. (e) Acknowledgement of Statutory Exemptions. As the additional sales tax proposed by the Resolution applies only to retail marijuana and retail marijuana products and applies to no other tangible personal property, the imposition and exemptions of the sales tax for types of tangible personal property other than retail marijuana and retail marijuana products described in C.R.S. § 29-2-105 are not applicable to this additional sales tax proposal. It is specifically acknowledged that none of the tangible personal property covered by exemptions cited in C.R.S. § 29-2-105 shall be taxed by the additional sales tax proposed in this Resolution. (f) Nonresident Exemption (when specific ownership tax has been paid). To the extent the requirements of C.R.S. § 29-2105 (1)(e) apply to the imposition of a retail sales tax on retail marijuana and retail marijuana products, all sales of personal property on which a specific ownership tax has been paid or is payable shall be exempt from the sales tax when such sales meet both of the following conditions: (I) The purchaser is a nonresident of or has his or her principal place of business outside the County; and, (II) Such personal property is registered or required to be registered outside the limits of the County under the laws of Colorado. (g) Collection, Administration and Enforcement. The collection, administration and enforcement of the sales tax on the sales of retail marijuana and retail marijuana products imposed by this Resolution shall be performed by the employees of Adams County pursuant to rules and/or regulations regarding collection, administration and enforcement of this additional sales tax on retail marijuana and retail marijuana products to be adopted by Adams County prior to July 1, 2015, and as may be amended thereafter. (h) Sales Tax License. Any person engaging in the business of selling retail marijuana or retail marijuana products shall annually obtain and hold a State license as required by C.R.S. § 39-26-103, in addition to any local sales tax license that may be required by Adams County. (i) Vendor Fee. As collection agent for Adams County, the vendor shall be entitled to withhold an amount equal to one percent (1%) of the total amount to be remitted by vendor to Adams County each month to cover vendor’s expense in the collection and remittance of said County sales tax on sales of retail marijuana and retail marijuana products. If any vendor is delinquent in remitting said tax, other than in unusual circumstances shown to the satisfaction of the Adams County Finance Director or his/her designee, vendor shall not be allowed to retain any amounts to cover his or her expenses in collecting and remitting said tax. 7. If a majority of the votes cast on the issue of imposing the sales tax shall be in favor of such ballot issue, the Clerk and Recorder is hereby directed to provide a notice of adoption of this Resolution, together with a certified copy of this Resolution, to the Executive Director of the Colorado Department of Revenue at least fortyfive (45) days prior to July 1, 2015. 8. For the purposes of C.R.S. § 1-11203.5, this Resolution shall serve to set the ballot title for the ballot issue set forth herein, and the ballot title for such ballot issue shall be the text of the ballot issue itself. 9. The officers and employees of the County are hereby authorized and directed to take all action necessary or appropriate to effectuate the provisions of this Resolution. 10.All actions not inconsistent with the provisions of this Resolution heretofore taken by the members of the Board and the officers and employees of the County and directed toward holding the election for the purposes stated herein are hereby ratified, approved and confirmed. 11. All prior acts, orders or resolutions, or parts thereof, by the County inconsistent or in conflict with this Resolution are hereby repealed to the extent only of such inconsistency or conflict. 12. If any section, paragraph, clause or provision of this Resolution shall be adjudged to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining sections, paragraphs, clauses or provisions of this Resolution, it being the intention that the various parts hereof are severable. 13. The cost of the election shall be paid from the County’s general fund. 14. This Resolution shall take effect immediately upon its passage. WHEREAS, the Board has determined to submit a ballot issue to the eligible electors of the County at the November 4, 2014 general election to impose an additional countywide sales tax of three percent on sales of retail marijuana and retail marijuana products in the County, in addition to the application of the County’s existing sales taxes; and,

WHEREAS, the Board has determined to set the ballot title and ballot text for the ballot issue to be submitted at the election called by this Resolution.
