ur reading habits follow trends. After reading a suspense-filled mystery one tends to seek another book of the same genre. Recently, I became enraptured with biographies. The chronicles of the lives of famous people past and present were filled with information about their backgrounds and details of their rise to fame and fortune that informed as well as entertained. The common denominator of all the varied stories was that each of the successful people was blessed with an extraordinary talent that he or she utilized to achieve success. The great composer was born with an ear for melody while the scientist had an uncanny ability to simplify complex mathematical calculations. The inventor was able to see in nature techniques he could employ in the mechanics of his creation that others used daily without noticing a thing. The Torah scholar was gifted with a photographic memory. No matter what the field each was blessed with a Heavenly gift that most people don’t have. Biographies cause one to admire the successful but they also have a danger. One may subconsciously ask: “Why is it that I am not successful?” By attributing achievement to a G-d-given talent one justifies one’s lack of success. “I am not successful because I was not born with a special gift that I can use to succeed!” To be successful, however, one need not be born gifted. Anyone -even one who is 12

ordinary - can rise to the top. One must commit oneself to do even ordinary things in an extraordinary fashion. Housewife, student, carpenter or salesman -- one must push oneself to do whatever he or she does in the best way possible. Touhy in Chicago is selling items from Great Chicago (sandwiches, salads, etc.) to-go and Pizza from Chalavi which can be found in their refrigeration section near the slurpees. As these items share a display case with other non-kosher items the consumer should be diligent that the cRc logo is clearly displayed on the package. Please note that there are times when kashrus agencies take over a kosher supervision but their logo does not appear for some time on the product due to a company’s desire to use up old labels or containers. An example would the Bob’s Red Mill products bearing the underlined K symbol. Rabbi Teichman has been certifying it for over a year as well but the old symbol remains on the product. I have a cherry tree that that is within its first three years of growth. I know that I can’t eat the (arlah) fruit. Can the pits from the current yield be utilized for planting another tree?
A
No. When one plants a fruit tree they need to count three years from the time of planting. It is forbidden to derive benefit from all fruits grown during those years, and the fruit is known as “arlah”. [The fruit of those years remains forbidden forever, even if the tree subsequently “ages-out” of the arlah prohibition.] Arlah is unusual in that not only may one not eat it but it is also assur b’hana’ah, which means that one may not derive any benefit or pleasure from the arlah. One example of the issur hana’ah is that it is forbidden to plant the seeds or nuts of arlah, and therefore the cherry pits cannot be planted. [However, one may replant a branch, tree, or sapling which is within the arlah years, as the tree itself is not forbidden.] Although one should not plant the arlah cherries, if one mistakenly did, the tree that grows is not forbidden, and the fruit that grows on that tree is permitted (after its years of arlah are completed). The reason for this is that the tree that subsequently grew is not a product of arlah fruit alone; rather, other permitted factors (e.g. water, soil, minerals) contributed to the fruit’s growth. This leniency is known as zeh v’zeh gorem and is permitted post-

We planted a cherry tree in our back yard, on the 10th of Av, 5772. The tree was about 6-7 feet tall, and the store staff told me that it “was a couple of years old”. When can we eat the fruit? Does the 3-year arlah count start when the tree was originally planted or when we replanted it?

[The following answer assumes that the questioner lives out of Eretz Yisroel and that the tree was purchased balled, burlapped, or in a pot (i.e. not “bare root”).] Based on your conversation with the store staff that the tree was “a couple of years old” we can assume that the tree was originally planted on or before 10 Av 5771, one year before you purchased it. Therefore the years of arlah for your tree will conclude at the end of 5773. Accordingly, any fruit that began to grow (for simplicity sake) after Rosh Hashanah 5774 can be eaten. If the tree was planted bare root or if the dirt fell off from around the tree when it was planted, arlah would be counted from 10 Av 5772, and any new fruit that grew after Rosh Hashanah 5775 could be eaten.
