West Windsor preps for influx of housing Developers currently moving to build more than 1,000 residential units By siDDHARtH MuCCHAl Now that West Windsor has finally resolved its affordable housing plan, officials are gearing up to deal with the next step in the process—the construction of new housing developments. State Superior Court Judge Mary Jacobson in May approved West Windsor’s plan to implement an October settlement with the Fair Share Housing Center of Cherry Hill. The ruling and subsequent agreement came after FSHC sued West Windsor, claiming that the town had not provided for its fair share of affordable housing. In a ruling earlier last year, Jacobson set the township’s obligation at 1,500 units. The township negotiated a settlement last October with FSHC that set out a detailed plan for how the town would provide for that number of units. The settlement satisfies the township’s obligation and protects the township from builder’s remedy lawsuits through 2025. “The board has made some amendments to our land use as part of our master plan,” said West Windsor Planning Board chairman Gene O’ Brien. “The change was to recommend classifying certain parcels of land to be used for mixed use or residential development. These changes were then translated into ordinances that were approved by
the township council.” Now that the council has updated its land use ordinances, the next step is for the developers of the properties to submit land use applications, get approval from the planning board and begin construction. The following update on several of the projects anticipated in the near future is based on interviews with O’Brien, Mayor Hemant Marathe and land use manager Samuel Surtees. AvalonBay Communities is planning a mixed-use development, with 37,000 square feet of commercial/retail space and 800 residential units, of which about 99 will be affordable rentals. The plan also includes a hotel, which is separate from the rest of the commercial space. The project will be built on a 24-plus acre site Station Drive and Washington Road. Currently, the developer is working with the township’s Technical Review Committee to finalize the specifics of its plans before they are submitted to the planning board. AvalonBay must also obtain approvals from N.J. Transit (due to proximity to the Princeton Junction train station), and Mercer County, since this development will impact Route 571, a county road. Another major project in the pipeline is Mack Cali’s 25-acre Roseland site, located on Route 1 north between Carnegie Center Boulevard and Meadow Road. Hero hailed for canal rescue Port Mercer resident pulled motorist from car that sank into water By Justin Feil Quick action by a West Windsor man was instrumental in saving the life of a motorist whose car plunged into the Delaware and Raritan Canal in the late night hours of June 19. Marko Oydanich, 27, of Newark, was driving home from a friend’s house in Princeton on Quaker Road headed towards Route 1, when he failed to navi-
gate the 90-degree turn before the bridge over the canal. The car jumped the guard rail and flipped upside down into the water. Oydanich was trapped inside, gulping what little air was left. Darren and Lauren Geist had just gone to bed shortly before midnight when they heard the loud crash outside their Port Mercer home, which overlooks the canal. The couple went downstairs and looked out their dining room window. “We’ve heard scrapes before. That guardrail gets taken out fairly often,” Lauren said. “We said, ‘That was definitely a crash.’”
They couldn’t see anything due to the darkness. For the first time since they lived there, they decided to go out and investigate an accident. “I don’t know what it was,” Lauren said. “We thought about going back upstairs. I’m a religious person. It had to be the prompting of the Holy Spirit. Your instinct is finely tuned over years, and it felt like something was off.” Lauren said they still couldn’t see anything when they went outside. It wasn’t until Darren walked onto the bridge that he realized the gravity of the situation. See RESCUE, Page 6

coMMuNity foruM Zoning board should reject WWM affordable housing plan On July 25, the West Windsor Zoning Board will be considering an application from developer WWM Properties West for more than 400 affordable housing units on Southfield Road, across Route 571 from the Southfield Shopping Center (See story in June 14 issue of The News). If approved, this development will destroy the neighborhood, add significantly to the traffic, overcrowd our schools and put undue burden on emergency services. West Windsor has been a leader in providing affordable housing not only in Mercer County but in New Jersey overall. Our township’s latest affordable housing plan was just approved in May (see story on Page 1) by Judge Mary Jacobson. In her ruling she praised West Windsor for both the thoroughness and timeliness of its compliance package. The township hasn’t just identified properties to satisfy our affordable housing obligations, it has also approved zoning changes and related ordinances required to build that housing. The approval by Judge Jacobson gives West Windsor immunity from builder’s remedy lawsuits through 2025. West Windsor doesn’t need this particular development to satisfy our affordable housing obligation. Furthermore, our township’s philosophy is to build inclusive affordable housing developments and not segregate people in an all affordable development. Thus this development is completely against that philosophy. Finally the developer is asking for too big of a change to current zoning. A decision for such a drastic change shouldn’t be made by the zoning board, which is an appointed board. The decision belongs to the elected representatives, which is the West Windsor Council. For these reasons I urge the zoning board to reject the application in order to prevent a bad and totally unnecessary development from occurring in West Windsor. In fact, over the past 20 years, various pavement preservation programs have been successfully implemented in our state, county and neighboring township roads (Hopewell Township, Pennington Borough and Plainsboro Township), yielding substantial savings for taxpayers. I have since been advocating this program to our township engineers, department of public works crew, township administration and residents. I’m thrilled to share that, this past June we initiated the pavement preservation effort in West Windsor by microsurfacing Marian Drive and Dinsmore Lane. Microsurfacing is a pavement preservation method that coats the road surface with a layer of asphalt mixed with finely-crushed stones. It extends the roads lifetime for 5-7 years while costing only 10% of later repaving. With these road pavement preservation efforts in place, we now can afford to maintain all of West Windsor’s 124 miles of paved roads every two years. In a few years, we will catch up on our road repair backlog and return to our prior road repair budget of less than $1 million per year (the budget now is $2 million). Furthermore, our residents can begin to save an average potential of $300 per year vehicle repair costs which are caused by poor road conditions. There was very little of the car above the water.” Oydanich was screaming for help and pounding on the windows as the car quickly filled with water. The passenger side of the vehicle—a 2016 Subaru— was pinned against a bridge support and impossible to open. He tried to open the front door, which opened a crack and then slammed shut. That’s when he climbed into the back seat behind the driver’s side. He couldn’t open that door either. Outside, Darren yelled to Lauren to call 911, but he didn’t wait for the police to arrive. “There’s that moment where you’re panicking in your head and think that the police aren’t going to come in time,” he said. “So I had to do something.” Lauren was talking to police dispatch when Darren, the father of their 1- and 2-year-old children, jumped into the water. “Marko would not have survived until the police got there,” Lauren said. “Darren didn’t hesitate to jump in. He couldn’t see him and he couldn’t see into the car, but he knew he’d die if he didn’t jump in.” Darren swung off a pole and into the canal. Just a few years ago, he never would have gone into the water, but in 2010 he overcame his fear of water by taking a SCUBA course.
The situation also fueled his actions. “In that moment, you’re on adrenaline,” Darren said. “Later on, I saw that was 10-feet up and pretty dark. The instincts I got from SCUBA diving might have helped me.” Darren figures adrenaline also helped him pull open the driver’s side door. He reached inside, grabed Oydanich by the arm and pulled him out and up. “It was easier than I expected,” Darren said. “Even after the car pressurizes, it takes time to fully open the door. The only thing I can figure is the car had filled enough to pressurize so it just needed a good tug.” The Lawrence Township Police Department responded to the scene. When they arrived, Darren and Oydanich were on their way out of the canal. Lawrence Police Lt. Joseph Lech said that its often very difficult to get out of a submerged vehicle due to the water pressure pushing on the door. “Then panic sets in on people in the vehicle. It’s very, very difficult.” “I feel lucky we didn’t take longer,” Darren said. “It was a very small window to save him.” Darren’s actions earned him a nomination from the Lawrence Police for its annual Citizen Lifesaving Award. Last year, Lawrence awarded three people

the award, and its next ceremony will be in May. “What Mr. Geist did was very heroic,” Lt. Lech said. “He basically put his own life at risk by jumping into the canal, which was very high because of the heavy rains.” The Lawrenceville Fire Company and Trenton Heavy Rescue Fire Company also answered the 911 call. A heavy duty tow company removed Oydanich’s car from the canal after his rescue. Lauren said she is floored by Darren’s bravery, though he already had quite a track record as a solid citizen. He currently works as an attorney at ColgatePalmolive in anti-corruption and anti-bribery, and his first job was at UNICEF. The 36-year-old Princeton University graduate earned the Spirit of Princeton Award after starting a human rights group for genocide prevention. In law school at New York University, he received its Vanderbilt Medal for starting a similar organization that worked to end human trafficking. “I did know he was an incredible person, that’s why I married him,” Lauren said. “This is not a situation you ever anticipate being in. So many people wonder, ‘What would I do in a situation like that?’ Darren doesn’t have to wonder. He knows now. There’s something comfort-

ing in that you’d make the right choice. I was very impressed. He just took it all in stride.” Darren said he had trouble sleeping in the days that followed, before exhaustion finally caught up with him. He’s been the talk of friends, family and coworkers after word got out about his daring rescue and award nomination. “It’s like a whirlwind,” he said. “It’s humbling to be nominated for anything. You hope you’re not put in that situation and you hope you live up to that. I’m glad I did. People are calling you a hero, but I still don’t think of myself that way. I’m glad I could make my wife and family proud.” Oydanich revisited the Geist family four days after the accident to thank them again. “It’s one of those things where it’s moving, it’s awkward, you don’t know what to say,” Darren said. “You’re both in this incredibly intense experience together. “We were the only people down in that dark hole. I think we were both going through the accident in our head. He was grateful to be alive. He didn’t know the area. It’s pretty much pitch black. He didn’t know if there were any houses nearby, if anyone would be up at that hour, and he was under a bridge.” The Geists were happy to be able to help. They are hoping that life returns to a little more normalcy for all who were involved. “It’s one of those weird things,” Darren said. “After you save his life, you’re connected to him. You hope everything that comes from this is good. Hope-

They’ve since heard plenty of fender benders from cars that don’t negotiate the turn, which they say is poorly marked compared to other nearby canal crossings. “Later on, we realized that people have a tendency to speed,” Darren said. “There’s not enough fines, or speed bumps or lights, and people don’t realize how sharp that turn is. As a result, people are flying around that corner. We hear them get in accidents. I don’t think we’ve ever heard an accident like that, though.” Lauren said that the spot the accident took place is “a strange intersection of West Windsor, Lawrence and Princeton townships, plus the bridge is owned by the state, and Quakerbridge Road is managed by the county. The situation makes it extremely difficult to get anyone to take action to increase safety

along the stretch of road.” For example, the spot where the car went into the canal is in Lawrence Township, but the road Oydanich drove off of in is Princeton. In the wake of the accident, the Geists have increased their efforts to have the road, which changes at the bridge from Quakerbridge Road to Quaker Road, better marked. “This is a motivator for us and hopefully for the towns to do something,” Darren said. “We love being on the canal with the kids. We love being outdoors.” Lauren said they have assurances that from officials that there are plans to improve the area. “It’s a hard area because it’s so many townships combined,” she said. “It seems like collaboration between townships would be needed to get it done. I’d love for a couple speed bumps and the speed limit to be pushed down. I’d love a cross walk there for pedestrians and runners. Maybe some more lights on it.” Exactly two weeks after Oydanich’s accident, the Geists heard the sounds of another accident. They again went out to see if they could help. They didn’t want to ask, “what if.” Fortunately the situation wasn’t as dire as the one they faced on June 19.

The Heritage at West Windsor, which is being developed by American Properties, would be located in the southeast corner of the township near the East Windsor border. The parcel totals roughly 67 acres, although a portion of the site is encumbered by wetlands. It would have frontage on both Old Trenton and Princeton-Hightstown roads. The developer has presented a concept plan for 185 townhouses with at least 25 set-aside for affordable housing. The developer is currently working with the TRC. Also on the site, ARC Mercer has discussed partnering with American Properties on the affordable component of the project. The nonprofit has agreed to construct a group home along Princeton-Hightstown Road. The home is anticipated to contain four bedrooms and would be constructed as part of the inclusionary development phasing schedule. Surtees says that he expects public hearings to take place by the end of the year for the AvalonBay, Roseland and Heritage at West Windsor projects. One project already underway is the Woodstone development on a 54-acre property owned by Princeton Theological Seminary near the intersection of Wheeler Way and Canal Pointe Boulevard. The project was approved by the township last June. A total of 12 residential buildings are to be built, including 89 affordable units. The project is currently being reviewed
for compliance with township zoning ordinances, and construction is expected to start later this year. PTS is also looking to develop a 68-acre property adjacent to Woodstone, which is currently developed with 240 apartments. There is a possibility that PTS might sell or lease the property to a developer. Such a transaction would require that 20 percent of the units (48) to be affordable housing. Garden Homes is proposing a 588-unit rental project, which would include 147 affordable units. It would be located on a 64-acre site that has access to Route 1 north and Meadow Road. The property is south of Route 1 and adjacent to Meadow Lane Apartments and Windsor Woods. It was anticipated that the developer move to develop the site this year, but it has not yet submitted a site plan. The 400 Steps development is currently mired in legal proceedings. The project would be located in back of the Ellsworth Shopping Center on the 3.85-acre site where the partially constructed and abandoned phase two of the shopping center now sits. The project derives its name from the fact that it will be located approximately 400 steps away from the Princeton Junction train station. The property was recently condemned by the township, and the 400 Steps developer is going through the condemnation process in court. According to Marathe, the developer is bearing all the cost of condemnation, “so taxpayers have not paid a penny for the cost of condemnation and for purchasing the land.” Two properties in downtown Prince-

The Sun Bank property at 47 Princeton Hightstown Road and the Dr. Mian property at 55 Princeton-Hightstown Road are both part of the Princeton Junction Redevelopment Area and are included as part of the township’s affordable housing plan. The Sun Bank property received a use variance for a day care center and is now going through the TRC. A total of 10 units could be on the site, which would produce 3 affordable units. Meanwhile, the developer of the Dr. Mian property is expected to appear before the planning board with a concept plan, but no application has been submitted. The tract, which is owned by Princeton 55 Associates NJP, currently contains a two-story office building. The site also has access from Carlton Place. The developer has proposed 18 apartments, of which 4 units would be affordable rentals. Under the agreement with FSHC, the township will provide for 1,125 units of very low-, low- and moderate-income housing, and get 375 bonus credits for rentals (rentals count double towards a town’s affordable housing obligation) for a total of 1,500 credits. There are a total of 883 rental units proposed and 83 agerestricted units.
Under the state’s affordable housing regulations, a municipality is entitled to bonus credits up to 25 percent of its fair share obligation, which is 375 out of 883 in West Windsor’s case. Some rental projects are not eligible for bonuses in this round, because the rental bonuses have been allocated elsewhere. It is possible the 508 unused credits might be applicable in the next round after 2025. In total, the plan would bring about the construction of about 3,000 new housing units in the township, which is far less than the 7,500 units some had estimated following Jacobson’s ruling. In the days since the settlement in October, the township has worked to implement the necessary changes to its development strategy. Now that projects from the township’s affordable housing plan are being developed, there are some concerns of how the increase in housing will impact the community. An ongoing concern has been the increase in school children and the impact on the school district. Marathe said that the township has been working with the school district in order to help plan for the additional students. “The (school district’s) referendum

approved last year (in regard to increasing the capacity of Maurice Hawk, HSS, and CMS) was based on the expected increase from affordable housing,” Marathe said. “We work very closely with (superintendent David) Aderhold and the school staff to keep them updated on how many apartments and houses will be completed.” Another concern is the inevitable increase in traffic. “Currently, our roads are just not numerous enough to serve all the people who are going to live in West Windsor when this is all built,” said council president Alison Miller, who has worked with the township’s affordable housing committee for many years. Overall despite the obstacles in the process, Marathe said he believes West Windsor acted proactively to deal with the affordable housing issue. “I think we did a wonderful job in satisfying our requirement with as little overcrowding and school impact as we possibly could,” he said. “Not only did West Windsor identify the sites, but we have already rezoned the properties and have ordinances to go with it. Judge Jacobson commended us in her ruling, saying that we have gone above and beyond what is required, which is why she approved the plan with complimentary comments.” O’Brien also noted that the affordable housing agreement helped save tax dollars. “West Windsor avoided protracted legal proceedings, which would have cost the township a considerable amount of money,” he said. “By agreeing to the 1,500 units, the mayor and council automatically saved hundreds of thousands of dollars in legal fees.”

A search revealed Nieves to be in possession of under 50 grams of marijuana. He was also wanted on a $500 traffic warrant out of South Brunswick. Shoplifting. William P. Henderson, 49, of Trenton, was arrested June 10 on a shoplifting charge at CVS Pharmacy on Schalks Crossing Road. Officer Nicholas Fazio said he was dispatched to CVS at 1:54 p.m. to investigate a report of shoplifting. The suspect, later identified as Henderson, had fled the scene on foot prior to the arrival of police. Officers located Henderson about 30 minutes later near Scudders Mill Road and Campus Drive. He was found to be in possession of 56 hygiene products totaling $508.

Auto burglar y. A Village Road West resident’s car was burglarized between 10:30 p.m. March 26 and 7:30 a.m. March 27. Officer Ted Hojnacki said someone entered the victim’s unlocked vehicle and stole her wallet, which had been in the center console. The car was parked in the driveway. *** Christopher P. Middleton, 24, of Old Bridge, was arrested at about 8 a.m. on April 6 on a drug possession charge. Officer Walter Silcox said he stopped Middleton on Route 1 at Meadow Road for speeding and tinted front windows. During the stop he was found to be in possession of under 50 grams of marijuana. Wallets stolen. A customer at Chuck E. Cheese on Nassau Park Boulevard was the victim of a wallet theft at about 7:12 p.m. on March 30. Officer Edward McQuade said the victim was paying her bill at the register and removed her wallet from her purse. After paying, she placed her wallet into an open pocket in her purse and positioned the purse behind her back. She said that she believes someone then reached into her purse and stole her wallet while
she was speaking with the cashier. *** A woman shopping in the Nassau Park Shopping Center had her wallet stolen between 2:53 and 4:28 p.m. on April 2. According to Officer Melissa Nagy, the victim had lunch at Panera Bread and then went shopping at Wegmans. When she went to pay for her groceries, she realized her wallet was missing. The victim contacted her credit card companies to cancel her cards and found that over $3,100 in purchases had already been made at Best Buy, Gamestop and Macy’s. Purse theft. Someone stole a purse from a customer in Walmart on Nassau Park Boulevard at about 11:30 a.m. on April 3. Sgt. Lee Brodowski said the victim recalled last using her purse at the self-checkout. A short time after leaving, she realized her purse was missing, and that she either left her it at the selfcheckout or in her shopping cart after she loaded her purchases into her car. She went back to Walmart but her purse was gone. Shoplifting arrests. Christina Mazzilli, 48, of Bordentown was charged with shoplifting for an incident that took place at 11:10 a.m. on March 30 at Target on Nassau Park Boulevard. Officer Melissa Nagy said Mazzilli went to the self-checkout where she scanned and bagged $452.31 worth of store merchandise. She then inserted a Target credit card, which was registered in her name, to pay, but the card was declined. She then left the store with the merchandise. Det. Christopher Van Ness investigated the incident and determined that the shoplifter and Target credit cardholder were the same person. *** Sheena D. Nelson, 28, of Trenton was arrested at 4:28 p.m. April 10 at Target for shoplifting. Officer Dominic Fiore said that Nelson used a bar code label at selfcheckout for an item valued at $2.59 and passed it over the scanner multiple times to pay $36.16 for merchandise valued at over $200. She was apprehended by asset protect and turned over to police.

sports WW-P players help East break losing streak in Sunshine Classic By Justin Feil Jahmiq Johnson prepared all week for his chance to shine against 1-on-1 coverage at the 24th Sunshine Football Classic at Notre Dame High School on July 2. The High School North graduate didn’t have to wait long. On the first drive of the game for the East all-stars, he hauled in a pass from Hightstown quarterback Liam Monahan and went 61 yards to the 5-yard line to set up the East’s first touchdown. “Right before the play, when we broke the huddle, I told the quarterback, ‘It’s trips so look back side,’” Johnson said. “He read the corner was pressed up against me and off the snap he just threw it.” What made Johnson feel even better about the biggest play of the game— which was eventually shortened due to lightning— was that it helped the East to snap a four-game Sunshine losing streak and come out with a 14-7 win. “I think it was pretty big,” said Johnson, who had one other catch and also returned a kick. “Going into the first practice, and the first couple practices, I’d been hearing from our teammates and other people that the West side is good. They put us down as the underdogs.”

Reilly will watch from afar as this year’s program graduates move on to their next steps. Johnson’s Sunshine appearance gave a glimpse of what he is capable of against other premier players. “I think he can help any college program with his abilities,” Reilly said. “I think it’s a good opportunity to give him one more year to display what he has. If it’s a prep, he’s not using a year (of college eligibility). He’ll give it a shot and see how far he goes with it.” Johnson’s dedication over the years helped to earn him a spot in the Sunshine Classic. That too fulfilled a dream that he’d long held. Johnson said he valued the chance to play against some of the top players in the county in his final game in New Jersey. To play one final game representing WW-P was also special. To contribute to the win made it even better. “I feel like even though that wasn’t my last game, I still played it like it was my last,” Johnson said. “There are other kids out in the world or on my team that were never going to play again,” he added. “I took the role seriously. I’m still playing in the future, and I am very appreciative and honored knowing I get to see another day playing football.”
