Form I-9 Compliance: What’s New in Current Form?
What are Basic Form I-9 Requirements?
All employees hired after November 6, 1986 must have a I-9 form on file
Employers must use the current version of I-9 form issued on 7th May 2013
The I-9 Form contains three sections: ◦ Section 1: Employee Information and Verification ◦ Section 2: Employer Review and Verification ◦ Section 3: Updating and Re-verification
New I-9 Form
Issued on May 7, 2013 New form is longer and more complex than the previous version ◦ Reformatted and expanded to two pages ◦ Six pages of instructions for completing the form
It comes with new rules about documents that may be used to verify employment eligibility of workers There are also new instructions and additional data fields for employees and employers
Section 1 Changes: Employee
Section 1 of the new I-9 form includes optional email address and phone number field
For any employee who selects “Alien authorized to work until (expiration date, if applicable mm/dd/yyyy)” and who was issued an I-94 card, need to list foreign passport number and country of issuance
Section 2 Changes: Employer
Employers need to enter the employee name
Section 2 Changes: Certification Certification Section 2 of the new I-9 form includes:
Numbering certification requirements that HR representative must attest when reviewing the documents
A new field for employers to insert the employee’s first date of work for pay
Section 3 Changes: Re-verification ď ˝ ď ˝
Section 3 of the new form provides clarification that List B identity documents do not require re-verification. It also adds a field for the employer representative to print his/her name.
