A Chapter 7 bankruptcy allows the debtor to retain certain exempt property, but the debtor’s remaining property is gathered and sold by a trustee from which creditors will receive payment. It may also be used by businesses which wish to terminate their business. A Chapter 13 bankruptcy enables debtors, through court supervision and protection, to propose and carry out a repayment plan under which creditors are paid, in full or in part, in installments over a three-year period. During that time, debtors are prohibited from starting or continuing collection efforts. Court filing says Governor Riley had no power to form gambling task force MONTGOMERY — Attorneys for an electronic bingo facility in Lowndes County argue that Gov. Bob Riley had no authority to appoint a special prosecutor to shut down gaming operations in Alabama. The attorneys for the White Hall Entertainment Center in Lowndes County argued in briefs filed late Friday with the Alabama Supreme Court that the governor overrode the power of local district attorneys when he appointed a task force to investigate and shut down gambling operations in Alabama. The attorneys filed the briefs after the supreme court last week refused to dismiss Riley’s appeal of a judge’s order that said Alabama Attorney General Troy King has authority over the governor’s task force on illegal gambling. Riley’s attorneys have until Friday to file their response. Riley has said he had authority to form the task force. The task force commander, Mobile County District Attorney John Tyson, said King has no authority to take over the task force or stop raids at bingo facilities.
Bessemer man dies Sunday after early morning fight, shooting in Birmingham BIRMINGHAM — A Bessemer man has died after being shot during a fight at a Birmingham bar. The Jefferson County coroner’s office says that 30year-old Angel Munos was shot early Sunday at least once in the abdomen when he tried to break up a fight a Spud’s Club. The Birmingham News reported a cousin of Munoz was also shot and is expected to recover. The cousin’s name was not immediately released.
College student disappears while canoeing on Smith Lake near Jasper JASPER — Rescue workers and law enforcement officers are searching Smith Lake in north Alabama for a college student who disappeared canoeing. The president of the Smith Lake Task Force, J.C. Poe, said Sunday three men were canoeing on the lake Saturday evening when the canoe capsized. He said one of the men, a 21-year-old college student, did not make it out of the water. Poe is also the Walker County coroner. — From wire reports

State revokes B’ham nursing home’s license Associated Press MONTGOMERY — The state has revoked a nursing home’s license after citing the Birmingham facility for neglect, abuse and unsupervised patients — including a woman who tried to get out 40 times in 12 days and succeeded twice. Witnesses told investigators a certified nurse’s assistant at ConsultAmerica Health and Rehabilitation cursed at residents, jerked at one using a walker and pinned a woman’s arms down on a table after the resident hit her. The last time a license was revoked was in 2007. ConsultAmerica found she was “disrespectful and discourteous to residents, not abusive” and only terminated her after the state investigated. The nurse’s assistant “was abusing residents and they pretty much affirmed what she had done but they didn’t realize it was abuse,” Rick Harris, director of the state’s Bureau of Health Provider Standards, said Wednesday. “Those were big issues and they were already on probation. It was really just a string of really bad incidents one after another.” Surveyors also noted a resident whose pressure sore on his wrist went untreated for so long that bone was visible when it was finally caught. ConsultAmerica was placed on probation in January 2009 and lost its license after waiving a March 11 revocation hearing. Now ConsultAmerica has lost its Medicaid and Medicare funding from the government, and administrators have gone from 40 patients to trying to relocate its lone remaining resident. Phone messages left for the home’s owner were not returned and Birmingham attorney Marc Givhan, who is representing ConsultAmerica, said he could not comment on the case without his client’s permission.
