Dear Sir/Madam, Self-Catering Accommodation and Waste I am writing to you as one of the companies that manage or clean large numbers of self-catering accommodation in Cornwall. As you may be aware, there has been some media interest over the past few months regarding waste collection from such properties and the impact this has on the council’s budget, when it is collected as part of the Council’s household service. This correspondence is to advise managers of self-catering accommodation of the responsibilities relating to the waste and recycling produced from these properties, so their clients can ensure that they are compliant with the law. We are aware that there is potential for confusion so it is hoped that this letter will clarify the position. The waste (including recycling) that is produced from self-catering accommodation is classified as ‘commercial’ waste under the Controlled Waste (England and Wales) Regulations 2012. What this means in practical terms is that properties that offer self-catering accommodation are not permitted to use the household service currently provided by the Council through its contract with Biffa. They are also not permitted to use any of the thirteen Household Waste Recycling Centres (HWRCs) in Cornwall to dispose of waste. These services are provided for domestic residents only. We are confident that businesses wish to adhere to the law so this is a reminder for owners and managers of self-catering accommodation properties and other similar properties that they should not be using the kerbside waste and recycling collection service provided for householders, or HWRCs and recycling banks. Whether a property is rated for Council Tax is not relevant to the waste legislation, as it defines ‘household’ and ‘commercial’ waste according to where it has been produced, rather than the tax rating. We want to ensure that a level playing field is created for those businesses which already follow the legislation and manage their waste and recycling legally and appropriately and to ensure that council tax payers are not subsidising commercial activities.
