This is the contract that outlines the agency relationship between you as a buyer and Cottingham Chalk as your agent. The agreement outlines each parties responsibilies and duties through the buying process. Be sure to review this document in detail and discuss any questions with your agent.
WORKING WITH REAL ESTATE AGENTS
• This is the standard N.C. brochure that explains how a real estate agent works and represents you. The language is very straightforward except for one part, dual agency. Dual agency is when the same firm represents both the buyer and seller.

• In a real estate sales transaction, it is important that you understand whether an agent represents you.

Buyer Agency: If you agree, the agent who gave you this form (and the agent’s firm) would represent you as a buyer agent and be loyal to you. Dual Agency: Dual agency will occur if you purchase a property listed by the firm that represents you. a. Purchase Price - The amount you are under contract for in which your loan, monthly mortgage, and appraisal will be based on
b. Due Diligence Period – The time period to conduct your due diligence; this includes inspections, repair negotiations, and an appraisal ordered by your lender if securing a loan (all of which I will schedule, manage, and negotiate for you)
c. Due Diligence Fee – The fee you are paying the seller to take their home off the market to conduct your due diligence; credited back to you at closing unless you back out of the contract during your due diligence period
d. Earnest Money Deposit – The fee held in the closing attorneys trust account; credited back to you at closing and only forfeited to the seller if you back out of the contract AFTER your due diligence period expires
e. Closing Date – Closing is the day you meet with the closing attorney to sign paperwork and get your keys to your new home
f. Personal Property – Any items that are not fixed to the home that you want to convey in the sale
g. Seller Credit – A negotiated amount that the seller pays and is applied towards buyer closing costs
h. Home Warranty – The ability to request a seller paid one year home warranty of your choosing
