2010 Contract for Musical, Lighting & Video Services
The undersigned Client ________________________ hereby employs RADU CERNAT as Musician(s) for the date(s) specified below. The Following Conditions Are Agreed To By Both Parties To This Contract: A. General Conditions: 1. The total fee for the service rendered shall be paid in full one month (30 days) prior to the event. All music arrangements must be made in advance and cannot be changed past two weeks (14 days) prior to the event. 2. The Musician(s) will wear black/white attire, or formal attire for male performers if requested. 3. Client shall provide a sheltered performance space if the performance is to be outdoors. If the engagement is to be outdoors, notification in advance is necessary for the Musician(s) to prepare instruments. The Musician(s) shall be allowed to take reasonable steps to maintain their valuable instruments outdoors. 4. Should the Client breach the contract, reasonable attorney’s fees and costs to enforce the contract may be recovered.
5. Should the engagement be canceled less than forty-five (45) days prior to the engagement, the full agreed upon fee shall be paid to the Musician(s). 6. Should the Musician(s) not be able to perform the obligation by anything other than a fortuitous circumstance, death or severe illness and fail to acquire a suitable replacement, the amount of the fee for the absent performer may be paid to the client as total liquidated damages, if notice is not given more than 7 days prior to the engagement. 7. There shall be a deposit for each desired service paid in advance to secure the date and time of the engagement. This deposit is non refundable since the Musician will no longer offer that date and time to any other clients. The Deposit is the same as the Setup Fee. The deposit is a payment required to secure the time and date of your engagement from being offered to any other Clients. Performance fees apply when booking other services with the Musician (Cocktail, Dinner Hour, DJ etc). If the wedding Ceremony is the only music service you choose with the Musician, the deposit is also your full payment. The deposit shall be refunded to the client should the musician NOT be able to perform the engagement and NOT acquire a suitable substitute performer. 8. Should the engagement be delayed past the agreed upon time, the Musician(s) have the right to choose to continue and receive compensation at the rate of two hundred dollars ($200.00) per hour each for time past the agreed upon termination time or leave at the time agreed upon in advance without penalty and the full fee paid. 9. A travel allowance shall be made for engagements beyond the Garland Fort Worth - Dallas- McKinney area (East- West-South-North). 10. Travel Fees include: $300 upgrade fee, $200 gasoline and food, round trip airfare (depending on the location), 1-2 night hotel 4 star minimum near the event. The hotel must be approved due to the safety of Musician(s) and equipment. 11. Due to the amount of hours worked at event, the Musician is required a meal to sustain energy. 12. In case of vocal illness, it is agreed by client that the Musician will perform on violin, guitar and piano. 13. All prices/ fees are set, no discount or free music services. 14. Video footage of the wedding/ event can be used for future promotional work and advertising at the Musician’s discretion. 15. The Musician does not take responsibility for interruptions in the video
footage in the event where guests walk in front of the camera or house rules. 16. The Musician has full rights to refuse a Client’s offer, due to hostile or inappropriate behavior from the Client and the full amount will be issued back in exception of non-refundable deposit. 17. The Client assumes all financial responsibility over the Musician’s DJ and Live Music Equipment, Live Instruments (Violins, Guitars, Pianos) in the event that Guests of the wedding/ private event tamper and/or damage any of these items belonging to the Musician.
