Description of Project CREATE. is pleased to provide this introduction package for all your construction needs. No matter what your project necessities are, we tailor our services to best fit your requirements. Our collaborative approach allows us to work with all project stakeholders to help build a well-established intent, finish specification and assemblies to be used in detailed estimates and schedules for your build. We utilize our relationships to leverage buying power and hit schedule milestones. CREATE proudly offers this service with our vendors. CREATE is prepared to start these services upon award and would recommend they be engaged for Construction Management with the intent of facilitating the engineering and pre-construction followed by construction services.
2.0
Scope of Services 2.1
Preconstruction services:
a. Pre-design Construction Management – Review all current documents and provide input on constructability requirements for strategic design input, and schedule requirements for key milestones. Present preliminary budget as design information becomes available (class D or class C budget). Provide input on overall scope and schedule requirements - specifically identifying and ordering long leads known at the time on the current drawing packages. b. Conceptual / Schematic Design - Meet with client and consulting team to go over deliverables and provide recommendations for meeting them. This may include reviewing what items ownership may want to source directly. Input as it relates to: construction budget, project constructability, and overall timelines. Review the plans with project stakeholders, address any apparent areas that may not meet objectives and provide input for corrective measures (if required). This step will result in a Class C budget. i. Early ordering of long leads and mobilization items are contemplated and engaged from this stage forward. c. Design Development - Further work with project stakeholders to provide input on Page 1 of 7

plan evolution including feedback on material and finish selections in regards to cost and schedule. Review/update project information as it relates to: Overall construction budget, division specific budgets, overall project constructability, division specific constructability, overall timelines, and division specific timelines. Ownership will approve plans for the next phase if project objectives have been adequately met. This step results in an updated schedule with more detail and a Class B budget (optional if time permits, otherwise proceed to tender for next costing).
d. Final Design/ Permit Application - Review full package and make recommendations (if required) for: Overall project budget, scope specific budget items, potential lead times, complexity of constructability, potential allowances and contingencies & overall timelines. Upon approval and signoff of plans by ownership, Create can assist with the application to the city for building permit but this proposal assumes this will be done by consulting team. Further provide recommendation on procuring materials at this point if it provides advantages to: schedule, cost or quality. e. Select Sub-contractors/ Tender Call - Prepare invitations for bidding sub-contractors and handle: setting up walk through(s), answering questions, receiving additional information & general administration. Review bids and prepare a bid analysis, provide a recommendation for bidding sub-contractors. Review conditions of engagement and provide recommended contract type and conditions. The result of this is a class A tendered project cost and refined construction schedule. 2.2
Construction services: a. Pre-Site Construction - Review Ownership provided items to ensure full scope delineation is fully understood by all parties. Go over timelines with suppliers and subtrades to prepare a detailed construction schedule that takes into account: long leads, site specific conditions, weather conditions & potential outliers. Review required deposits and based on the schedule milestones, prepare a detailed draw schedule for when payments will be required and their approximate value. Go over site requirements and prepare a detailed safety plan specific to site with considerations for the work required. b. On-Site Construction - Services applied throughout the duration of Construction: Coordinate all on site activities as required. Review draw applications, recommend if/when payments should be made, chair site progress meetings, issue meeting minutes, prepare construction progress reports, review work and correct any deviations from plan. Coordinate inspections with both consultants and jurisdiction having authority. Enforce on site safety (if construction will happen in a live environment and all necessary steps must be taken to ensure the safety of the general public and workers). Monitor project quality. Provide completion meetings and final walkthroughs / project closeout. Page 2 of 7

c. Additional services for commissioning and training of the use of equipment/systems, and/or maintenance of finished space can be provided by CREATE.

Conditions of Services 3.1
As a standard of estimate classification we will reference: AACE International As a standard of estimate classification we will reference: AACE International Recommended Practice No. 18R-97, COST ESTIMATE CLASSIFICATION SYSTEM – AS APPLIED IN ENGINEERING, PROCUREMENT, AND CONSTRUCTION FOR THE PROCESS INDUSTRIES, Table 1 - Cost Estimate Classification Matrix for Process Industries. Our feasibility review will be in accordance with a Class 4 estimate as defined in the above document. Additionally, CIQS Estimate classification “D” will be referenced from if required
3.2
This proposal is intended to be converted into a CCDC 5b Contract for preconstruction and/or construction services upon acceptance and can be converted to a stipulated price contract at time of tender if requested.
3.3
Release, Waiver and Limit of Liability - By accepting the within proposal and authorizing Create to proceed with the Services, the client expressly: a. Waives any rights it may have and expressly releases Create, its employees, directors, officers, and successors for any and all claims or liability howsoever caused, including all actions, causes of action, damages, claims, demands, economic loss, consequential damages, or other liabilities suffered or incurred, whether arising out of negligence, contract, tort, in law or in equity, in relation to the services provided by Create or subsequent purchase and acquisition of the client; and b. Expressly agrees that in any event, any and all claims, loss, costs, damages and expenses (including legal, expert and consultant fees), causes of action, actions, demands, lawsuits or other proceedings, whether in contract or tort which the client has or hereafter may have against Create, its employees, directors, officers, and successors in anyway arising out of or related to the Services, duties and responsibilities Create has pursuant to this Proposal shall be limited to 50% of the fee paid to Create.
Fee Structure 4.1
We like to get ‘CREATive’ and as such fees are negotiable. For example: Fees as they relate to services described within section 2.1- a. through e. will be budgeted below based on assumed hours required for each stage once scope is clearly identified. CREATE would recommend billing on a basis that is inclusive of hours spent directly engaged. This would be in accordance with CREATE’s 2021 Fee Schedule. If costs are approaching budget allowances, the client will be informed and costs will be re-addressed prior to proceeding. Page 3 of 7

Disbursements are expenses made in conjunction with the project and are additional to the consulting fees or hourly rates previously described. Disbursements vary by project and, where requested, a more detail estimate will be provided. For this pre-construction phase of the project disbursements will be charged at a cost plus eight (8%)
4.3
Fees as they relate to construction services (described within section 2.2) CREATE proposes a fixed fee upon the completion of tendering scopes of work (2.1, e.). The fixed fee would be based on a percent markup of construction costs once the scopes are determined and completion of the class ‘A’ estimate. The fixed fee would consist of an overall markup of 10% but this will be evaluated and discussed with the client group once we understand the total scope more completely. CREATE can recommend other fee options upon request.

All hours are tracked daily by employees on time sheets and checked for accuracy by the site supervisor and weekly by management.
Fuel mileage is tracked by kilometer and is charged out at $0.59 per kilometer for deliveries and sourcing. Unless noted elsewhere any disbursements (e.g.: printing costs, long distance calls, shipping, etc.) will be charged at cost plus 10% Method of accounting and audit Create in-house finance department tracks job costs using QuickBooks contractor at a rate of $75.00 per hour to ensure the account of the costs of work are accurate.
