Time ticking away on traffic ticket amnesty By Jennifer Ffrench Parker
A big door is about to slam shut on motorists with outstanding traffic tickets and warrants at the DeKalb Recorders Court – but the majority of them are clueless. Starting May 1, the court is going to get real tough. Chief Judge Nelly F. Withers said higher fees will apply and warrants will no longer be reset, except for the reasons listed in the ordinance – incarceration, hospitalization, active military duty, Nelly F. Withers deportation and death. And by September, Withers says she will release the court’s rogues’ gallery of top traffic offenders to the media. Withers said the court’s refusal to reset warrants for any other reason outside of the five listed ones is legal and that no one’s constitutional rights are being abridged. “You won’t be able to come and offer just any excuse,” she said. “We’ve gone back to a warrant policy based on the statute. We can’t be as forgiving or as lax as we were previously.” The tougher stance comes in the wake of years of lax operations at Recorders Court, which processes more than 200,000 citations a year. The volume makes it the state’s largest traffic court. Records show that in 2000, the court was closing more than 94 percent of its citations. By 2008, its closure rate had plummeted to 57 percent, culminating in more than 500,000 open citations and warrants dating beyond 2000. Last summer, a DeKalb grand jury found a crisis of leadership, lack of accountability, and pervasive staffing and physical problems at the court. The court also came under intense scrutiny after more than $20 million in uncollected fines were identified and 11 former employees were indicted in a ticketfixing scheme. Withers said the 500,000 open citations and warrants exist because violators never showed up for arraignment or trial and the court never served warrants on them or reported their license for suspension to the Georgia Department of Driver Services. The bulk of the outstanding citations – 323,699 – came between 2002 and 2008. In addition, the court has a backlog of more than 40,000 new tickets, issued within the past 12 to 18 months, that are awaiting arraignment and trial. Before the rules toughen on May 1, the court is offering six weeks of amnesty through April 30. During that period, people with aging tickets can show up at the court’s Camp Road location in Decatur and pay their fines without fear of retaliation. “Nobody is being arrested downstairs,” Withers said Thursday. Those who retire their tickets by paying the original fines also get a 50 percent discount off the $100 contempt fee. Withers said the court also is waiving the $75 war-

rant fee. “This is the last chance to avoid a warrant or suspension of your license,” she said. Marcus Hubbard of Lawrenceville was waiting in a long winding line Thursday to take advantage of the amnesty. He said he was cited for “no proof of insurance” in 2006 when he lived in Stone Mountain. Until he got a letter in the mail telling him about the amnesty, Hubbard said he thought he had paid the ticket. “I have been down here two or three times since then for other tickets and nobody mentioned it,” he said.
Hubbard said he had his proof of insurance and was hoping to pay $25 instead of the $485. Farther back in the line, Beatrice During of Riverdale was trying to find out her court date for a December 2009 citation for making an illegal right turn on a red light. “Tell about the long lines,” she said to a reporter. “Tell them to open more windows to attend to more people.” The DeKalb Community Service Board employee said she got a ticket on a rainy dark evening and pleaded not guilty on her first appearance because visibility was poor and
the road was unfamiliar. “I didn’t see the ‘No right turn’ sign and the policeman was right there,” she said of her first ticket. She said she was told that they would let her know her court date in April. “I haven’t heard from anyone,” she said. “I couldn’t get it on the website. I couldn’t get it on the telephone. I just want to know what my court date is. They charge you for parking. They make you wait too long. There has to be a better way.” Even though the court is expecting a rush of last-minute amnesty applicants in the last week of the offer, Troy Thompson, the acting court administrator, said the amnesty offer is already making a dent in the outstanding citations. Through April 14, violators had settled 2,816 citations and paid the court about $619,436. Starting May 1, a new fee schedule goes into effect that will double fines in some cases, and the discounts on contempt charges and warrants will no longer be available. Withers said all the old tickets will be subject to the new fee schedules. In addition, she said the court will carefully scrutinize the remaining cases and issue warrants and send license suspension notices to DDS. The amnesty ends promptly at 4:30 p.m. on April 30, even if there are last-minute applicants lined up outside the building. “If you have waited until then you are just going to be expecting a warrant,” Withers said. “Somebody is going to be coming to your house.”

In a few short weeks, 20 students from Destiny Academy of Excellence in Ellenwood will be headed to South Africa – or bust. Seven weeks from their planned departure date on May 27, the group is $33,000 short of the $40,000 needed to fly them to Pietermaritzburg, 60 miles from Durban. The Rev. Byron Johnson, the school’s parent liaison/counselor, said Monday that despite the obvious obstacles they intend to be in Africa until June 9 visiting schools, an AIDS hospice, an orphan- Byron Johnson age and a game reservation and to spend the night in a shantytown. “It’s going to happen,” he said, with the conviction of a man of enormous faith. In the meantime, the students – who have demonstrated academic excellence, social responsibility and leadership abilities – are preparing for the trip. The 12-day trip with the theme “A Journey to a New Beginning” is part of an introduction to the study of South Africa, which spans the students’ high school curriculum. The final piece is the field trip to South Africa. Students have done service projects around the county and walked 10 miles from Decatur to Stone Mountain Park to see what it feels like for African students to walk barefoot for miles to school. On March 27, they volunteered with New Life Baptist Church’s “Meet Me at the Corner” program that feeds the poor. The church donated $4,000 to their trip and will sponsor one student for $2,700. On May 1, they will read to the elderly residents at the UPAC home on Panthersville Road in Decatur and take strolls with those who are able to. Some of the students also will clean up the historic Flat Rock Slave Cemetery in Lithonia. Johnson said the trip to Africa will open the eyes of students to a whole new world beyond the borders of DeKalb County. The students at the “credit recover” charter school have not had an easy time of it. They were considered at-risk students or had dropped out of high school before they won enrollment to Destiny Academy. “The trip is going to open their horizon culturally,” Johnson said. “Their eyes will see the world differently. They will see beyond their situations and to others and they will learn to reach out and help.” Johnson said the school is hoping the students, who are in grades 9 to 12, will create relationships with those who look like them abroad.
While in South Africa, the students will be hosted by Pastor John Vannkerk and the congregation of City Harvest International. Johnson said they will stay in the homes of church members and see how Africans live. This will be the second trip from the school to South Africa. In 2002, the school took 47 students to the continent and raised $100,000 the day before they were to leave when New Birth Men’s Ministry passed the hat. “It floored me, but it happened,” Johnson said. He is hoping for a similar miracle. Destiny Academy is at 3595 Linecrest Road. The trip costs $2,700 per student to cover round-trip airfare, hotel and ground transportation. The South DeKalb Johnsons – Hank and Larry – pushed their re-election campaigns into high gear on April 10. Hank Johnson, the congressman, opened his campaign office at 3054 Panola Road with grilled hotdogs and all the fixings, surrounded by supportive elected officials and some aspiring ones and citizens who just think he has done a good job in Washington for the 4th Congressional District. Johnson, who has been putting on weight since the end of his experimental treatment for hepatitis C in February, told the group that he looks forward to continuing to serve the district. “I am trying mightily to never let you down and to always make you proud,” he said. Johnson, who is completing his second term in office, said he thinks of the people of the 4th District every day when he gets up to go to work in Congress. “I think of you and whether you would be in agreement with me, and after I have had that internal struggle, I cast the best vote I can,” he said. “If you like my decisionmaking, vote for Hank Johnson. Why vote for someone else?” Alluding briefly to last week’s flap over a statement he made in a congressional hearing about Guam toppling over under the weight of a large influx of U.S. troops, Johnson said his constituents know that he has a sense of humor. “All of you know that I can express that sense of humor without smiling,” he said with a broad smile. “I have been running since January 2001 and people are still telling me about jokes I made back then, and I say, ‘Did I say that?’” Cle Monk of Ellenwood said she came to the opening because she admires Johnson and wanted to see him. “This is my first time seeing him in person,” she said, describing herself as a Johnson supporter and a fired-up Democrat. Monk said she likes Johnson’s honesty and his commitment. “He seems very committed and sincere,” she said. “I feel the commitment he has. We need more like him.” Bob Waymer of Decatur called Johnson a good guy and said he likes how he has backed President Obama and is standing up for people who need health care. “That’s a biggie there,” he said, “and he is supporting people who need jobs. He understands his district. He understands the people in his district.”

sented him with a plaque thanking him for his service to the district. Darryl Jennings from the Gresham Park Civic Association said that constituents just have to look around to see Johnson’s work. “The last time no one had the courage to run against him,” he said. “If you want to talk about Larry Johnson, look at Glenwood, look at Memorial Drive, look at Wesley Chapel Road. We didn’t even know what streetscape was – now we are proud to say we have sidewalks.” Brenda Pace, president of the East Lake Terrace Association, said she knew Johnson was the guy
when he first started. “He came right in. He dived in and he always took my calls,” she said. Teresa Agee, president of the Rainbow Creek Homeowners Association, said that Johnson encouraged her to take a leadership role and that because of the connection with their elected officials they have managed to keep the Wesley Chapel/Rainbow area together. “I really want everybody to go out and support Larry as we always do,” she said, “and whosoever trying to run against him – good luck.” When he took the microphone, Johnson touted his accomplish-
ments over his first two terms and said his No. 1 job is to bring jobs to DeKalb County. He said District 3 is going through a renaissance with new sidewalks and streetscape projects but that he knows that there is a lot of unemployment and crime. “A county commissioner cannot do it by himself,” he said. “I need your prayers. I need your support because you all are my bedrock and make it happen for me. And I want to continue to serve.” Johnson asked his supporters to take five people with them to the polls on July 20. “This is an exciting time. I am fired up.”
Activist seeking Super District 7 seat Community leader and grassroots organizer Willie R. Mosley Jr. announced on April 10 that he is running for the DeKalb Board of Commissioners’ Super District 7 seat. He is the second candidate to declare for the seat being vacated by Connie Stokes, who is running for the 4th Congressional Willie R. Mosley District. College professor Kathryn Rice announced her candidacy on April 6. Mosley, a Democrat, has served as president and vice president of community organizations and PTA
vice president; on the DeKalb County Parks and Recreation board; and in little league football and as AAU boys and girls basketball coach. This is his second run for the seat. His 2006 campaign was derailed when he found out on election day that he couldn’t vote for himself because he did not live in the district. Still, he got 20 percent of the vote. He says he will continue to work with communities and neighborhoods to fight for issues and concerns impacting District 7 and the rest of the county. “As a county commissioner I will be the voice of the people in our communities and will be accessible, available and accountable,” he said.

Retailers see sales climb in March Local malls saw huge crowds and the malls and great sales in March, mirroring a national trend. For the third straight month, retail sales rose across the country as better deals and auto incentives spurred greater spending. The U.S. Commerce Department said Wednesday that sales rose 1.6 percent in March, up from a revised 0.5 percent gain in February. Last week, chain retailers and discounters from Macy’s to Target Corp. posted doubledigit increases that bettered the expectations of Wall Street analysts. The increases were across the board, among car dealers, home furnishing stores, building suppliers, clothing retailers and general merchandise stores reported gains. Auto
sales rose 6.7 percent, which the Commerce Department said was the highest increase since October 2009. Automakers said earlier this month that sales increased 24 percent in March over a year ago. The numbers are encouraging. Retailers and consumers, beaten down by the depressed economy over the last two years, are acing for a rebound. Economists watch retail sales for signs that consumer confidence is rebounding but they cautrion that persistent unemployment and stagnant wages could continue to restrain spending. In March, Georgia’s seasonally adjusted rate rose to a record 10.6 percent, up onetenth of a percentage point February’s 10.5 percent.
Board set to pick schools to close DeKalb School Board members were set Friday to pick the four elementary schools that will close to help balance the 2010 budget. Once board members vote on the schools, the board must hold public hearings that are scheduled for May 11 and 13. The board, which must approve its $735 million budget on May 10, plans to hold its final school consolidation vote on May 14. The list of 10 schools being considered
for closing are all located in South DeKalb, where the district says there are 11,000 vacant seats among those schools. Board members voted 5-4 on April 12 to tentatively approve the budget without any tax increase. Instead, they voted to layoff 430 people, and close four elementary at estimated savings of $2.5 million. The jobs include 150 central office workers, 200 paraprofessionals and 59 media and 18 technical specialists.

More than 22 years after she opened DoMaRo Uniforms Services, Rosie Cecil is moving on up. On April 23, she will cut the ribbon on a new catalog business with JC Penney. Her store in the Chapel Square shopping center at the Rosie Cecil corner of Wesley Chapel Road and Flat Shoals Parkway in Decatur will become DeKalb’s first JC Penney Catalog Store. DoMaRo customers and – Cecil is hoping – a host of new customers can order and pick up Internet and catalog purchases, make returns and exchanges, apply for JC Penney credit cards, and pay their Penney’s bill at the store at 4810 Flat Shoals Parkway. Cecil said she hoping the direct merchant partnership with a big national retailer will be a boon for her business, which sells school uniforms and is highly seasonal. “I think it’s going to bring in a bit more consistent traffic into the store,” she said Tuesday. “It will expose our merchandise to more people.” As part of the preparation for the opening of the new jcp.com/catalog center at her store, Cecil was in Eastman, Ga., this week for training with another direct merchant. “I am doing everything here that I will do at my store,” she said. Atlanta retailers to increase access to its merchandise in areas where it doesn’t have nearby department stores. Ann Marie Bishop, a JC Penney spokeswoman, said Wednesday that the company will open eight centers in and around Atlanta in April and May. Centers also are opening inside existing small retailers in Snellville, Sandy Springs, Canton, Cartersville and Cumming. Monroe and Calhoun also are getting centers. Bishop said the national retailer has more than 360 centers nationwide. “These centers provide customers with convenient access to JC Penney merchandise in markets not served by a store.” DoMaRo will serve customers in Decatur, Ellenwood and nearby areas of Henry and Clayton counties if they don’t want to or can’t get to the JC Penney Stonecrest store in Lithonia. “We all lead busy lives,” Cecil said. “It will be nice to have this resource available in the community.”
JC Penney, which had co-anchored the Gallery at South DeKalb on Candler Road with Macy’s for more than 30 years, closed the store in 2001 when it opened a new one at Stonecrest. Cecil, who had been based in Rockbridge Plaza in Stone Mountain for almost 10 years, relocated to the 2,000-square-foot store in Decatur in February 2009. She said that JC Penney found her on a scouting mission in January and invited her to apply for the direct merchant program that it has operated in rural areas since 1966. Cecil says DoMaRo’s primary business will remain school uniforms. She will get a commission from catalog sales made through her store. The jcp.com/ catalog center will open weekdays 10 a.m. to 7 p.m. and Sundays noon to 6. Stimulus money will help fund 20,000 jobs Thousands of teens and adults will be able to find jobs this summer with the help of funding from the American Recovery and Reinvestment Act. The Georgia Department of Human Services said this week that it will use more than $200 million to pay and subsidize the salaries of 15,000 teens and 5,000 adults to help private- and public-sector employers hire 20,000 Georgians this summer. The department will pay the full salary of teens and 80 percent of the adults’ pay. Human Services Commissioner B.J. Walker said it’s a unique opportunity to put Georgians back to work, reinvigoB.J. The noon-to-4 p.m. event will include screenings for blood pressure, diabetes, bone density (osteoporosis) and cholesterol as well as dental, chiropractic and vision acuity screenings. 1,000 needed for March for Babies DeKalb County is recruiting 1,000 walkers for the March of Dimes’ March for Babies on April 24 at the Georgia World Congress Center. The walk begins at 7 a.m. DeKalb has supported the March for Babies for eight years, raising more than $62,416. This year’s slogan is “Save a Baby, Give a Dollar.” With every county employee donating
just $1, the county hopes to raise at least $7,500 and recruit 1,000 walkers to support its fund-raising efforts. Last year, the Department of Sanitation raised $2,372, followed by the Department of Watershed Management, which raised $1,031. Conservation grant to aid indigo snake Georgia is among 25 states sharing nearly $66 million in grants to help protect and conserve the habitat of threatened and endangered species. Secretary of the Interior Ken Salazar announced the grants, awarded through the Cooperative Endangered Species Conservation Fund, on April 12. “These grants are part of our ongoing commitment to work with states and other partners to ensure America’s beautiful land and wildlife are conserved for future generations,” Salazar said. Georgia received a $1.4 million Recovery Land Acquisition Grant for a Canoochee River corridor habitat conservation project in Bryan County that will enable the acquisition of a conservation easement on a large 914-acre tract for the direct benefit of eastern indigo snakes. Junior golf program kicking off its 11th season Sugar Creek Members and alumni of H&J Junior Golf will celebrate the program’s 10th anniversary and kick off the new golf season on April 18. The Stone Mountain-based nonprofit uses golf to teach boys and girls ages 6-16 about respect, honor, integrity, discipline, perseverance and other life lessons. Jerome Brown, the group’s executive director, founded the program with his wife, Helen Brown, in 2000 after he retired from his hospital administrator’s job with the Department of Veterans Affairs. He said they are committed to introducing youth to a game that shares the life skills they need to be successful. “It’s great seeing them develop into beautiful, responsible, self-sufficient young men and women,” he said. H&J Junior Golf ’s home course is Mystery Valley Golf Club in Lithonia. It hosts clinics and special events on third Sundays monthly from April to December. Series honors Nina Simone’s legacy Barancos’ work with youth lauded “The Nina Simone Experience” in Atlanta’s West End is a tribute to the late singersongwriter and civil rights activist.
The music and fashion of Nina Simone will be brought back to life for Atlantans through April 25 at the multi-genre arts series “The Nina Simone Experience” in Atlanta’s West End community. The multifaceted tribute to the American music icon includes a fine art exhibition; a fashion show; interactive panel discussions; and an evening of spoken word poetry, dance and performance art, and of course music. The series also includes a special preview exhibition of student works presented by the Art Institute of Atlanta. Spelman College will be hosting a panel discussion examining Simone’s legacy and black women’s identities. The event will include guided tours offering youth a unique experience of art and history. Nina Simone’s daughter, Simone, will sing a special collection of songs. The other honorees were Harry Coaxum, vice president and general manager of McDonald’s USA; Margaret DeFrancisco, president/CEO of the Georgia Lottery Corp.; and Grammy Award-winning artist and founder of Big Kidz Foundation Antwan “Big Boi” Patton. They were all named 2010 Champions for a Cause by the Chauncey Davis Foundation.
