Judge clears way for construction of biomass plant By Ken Watts

Administrative Law Judge Amanda Baxter has cleared the way for Green Energy Partners to build a controversial $60 million biomass facility in Lithonia. The July 31 ruling appears to end a twoyear battle between the Amanda Baxter grass-roots Citizens for a Healthy and Safe Environment and Athens-based Green Energy Partners. The plant is proposed for a 21-acre site at 1744 and 1770 Rogers Lake Road just outside Lithonia’s city limits. Green Energy says the

facility will generate electricity that will be sold to Georgia Power. Baxter dismissed the case after CHASE challenged Green Energy’s application for an air permit from the Georgia Environmental Protection Deborah Jackson Division. She said CHASE’s criticism of the EPD’s decision to issue an air permit to Green Energy despite potential health risks lacked merit and that the group failed to respond in a timely manner to various court orders. Lithonia Mayor Deborah Jackson, a member of CHASE, said Thursday she was disappointed to hear about the decision.

Jackson said the ruling was on procedural matters, not on the merits of the case. “The challenge is that the various agencies that have been involved in reviewing this matter have not addressed the very real health threats from this plant,” Jackson said. Dr. Jewel Crawford, CHASE co-chair, had no comment on the ruling Thursday but said the group didn’t have the legal resources to properly fight the company’s application. “People in public office in a position to weigh in on this case ought to prioritize the health of the people,” Crawford said. “To do otherwise is irresponsible.” Foes say the plant and its truck traffic would generate pollutants that would affect the health of residents for miles as wood chips and other biomass are converted to

electricity. CHASE said that in its application to EPD, Green Energy, calling itself a “minor source” of pollution, underplayed potential contaminants the plant might produce. The agency found deficiencies in the application and asked Green Energy to resubmit it. CHASE said the new application still didn’t meet appropriate standards. DeKalb commissioners approved the plant in June 2011. Eighteen months later in December 2012, the county approved property tax incentives to help Green Energy secure financing for bonds to build the facility. A 17.23-acre site with frontage on Kelley Chapel and Snapfinger roads in Decatur is being eyed for development. The owner, Georgia General Snapfinger Development, is planning a September application to the DeKalb Board of Commissioners to have the property included in the I-20 Overlay District with a land use designation of Town Center. More than 60 residents voiced sharply contrasting opinions about what should be built on the property at a July 29 community meeting at the Wesley Chapel-William C. Brown Library. Attorney Michelle Battle, who hosted the meeting to get neighborhood feedback on the proposed development, said her client is actively seeking a developer for the property with hopes that development will commence in 2014 to 2015 at the very latest. “I know that the I-20 Overlay District corridor is very important to this neighborhood, and we want to get it right,” she said in the invitation to the meeting. Former DeKalb School Board Chairman Eugene “Gene” Walker lost his bid to be reinstated this week. Walker told CrossRoadsNews he was informed on July 31 that Chief State Administrative Law Judge Maxwell Wood has recommended that Gov. Nathan Deal sustain his suspension from the board. Walker said he is disappointed with Wood’s recommendation but not surprised. “The judge based his recommendation on an unconstitutional law, and every step along the way leading up the reinstatement hearing reinforced the unfairness of that statute,” Walker said. Walker is the third of five suspended board members to get a ruling on his case. On July 24, Wood also denied the reinstatement appeals of District 3 board member Sarah Copelin-Wood and District 8 board member Pam Speaks. Districts 5 and 7 board members Jay Cunningham and Donna Edler are awaiting word on their appeals. Deal’s office said this week that it was awaiting the ruling on the final two cases so it could release all three at once. Wood’s reason for denying Walker was not immediately known, but in sustaining the suspensions of Copelin-Wood and Speaks, he said that he was bound by the guidelines of state law O.C.G.A. 20-2-73. local school system to retain or re-attain its accreditation.” Walker’s lawsuit challenging the constitutionality of the law is awaiting a ruling from the Georgia Supreme Court. If the high court rules in Walker’s favor, all of the suspended board members could be restored to their jobs. A ruling is expected in November. Deal suspended six of nine board members on Feb. 25 after the district’s accrediting agency, the Southern Association of Colleges and Schools, put the district on probation over governance issues and the Georgia Board of Education recommended that they be removed. The sixth suspended member, District 1 board member Nancy Jester, said she resigned in April and did not seek reinstatement. Deal removed the members on March 13 and replaced them with his appointees. The county built its 2013 budget on the possibility of a 3 percent decline in the tax digest (value of property). Interim CEO Lee May said the reserve shows that DeKalb is going in the right direction. “I encourage the department heads to continue this kind of focused, hard work in order to keep the county on this positive track,” he said. “Now we have the opportunity to be more creative about what we can put there that would be to the ultimate benefit of the surrounding neighborhood,” she said. “But we have to first get into the overlay district so we can look at other possibilities.” Battle said that right now, the tract is still zoned R-100 for single-family homes. “I’m not here to tell you to build ‘X,’” she said. “I’m here to get your ideas for alternative projects that we can take to the county, get a land use change and put in more desirable development.” Gil Turman, president of the South DeKalb Neighborhoods Coalition, said the property itself is problematic. “What you’re telling us is that we have a bad piece of land and we have to figure out how to transform it,” he said. Battle agreed that it is a challenging piece of property. “But we have to move the process forward,” she said. John Griffin, a resident of King’s Row, wanted to see a broader effort to redevelop the entire area, including the overlay district.

“This neighborhood is unique and a prime location. We’re positioned at I-20 with quick access to I-285. We can be at the airport or practically anywhere else in the Atlanta area in 20 minutes. It’s really a lovely area.” Others responded that the redevelopment effort has to start somewhere and with a clear goal and manageable timetable. Real estate broker Bobbie Sanford of Sanford Realty wanted to know why the developer didn’t come in person and present his own ideas on redeveloping the land rather than waiting for residents to help him get the property into the overlay district. “I would suggest that your developer go back to the county and see if it wants to buy the property and redevelop it,” she said. Though the meeting reached no consensus, residents seemed united in not wanting more single-family homes on the site. Battle said she doesn’t mind lengthening the time frame to reach a decision. “I’m willing to go to the board’s September meeting and ask for a 60-day deferral in requesting a land use change to allow more time for us to work with the community and come up with a project we can all embrace,” she said.

DeKalb interim CEO Lee May told county employees this week that he favors state legislation to reform the cityhood process and ease the economic impact on the county. In his first address to employees since Gov. Nathan Deal appointed him interim CEO on July 16, May told about 200 workers that he is not against incorporation. During the informal hour-long talk, May, armed with a wireless microphone, walked among the audience fielding questions. It was the first of two get-acquainted sessions with employees. The second one took place on July 30 for employees who weren’t able to make the first one. May said that if residents in an area come together and decide they want to become a city, they have a right to do so. “But state law is really bad in terms of how areas incorporate. It allows new cities to cherry-pick all of the most valuable assets of an area, and if they’ve got the political will they can get [the cityhood initiative] on the ballot and they’re a city.” May, the District 5 commissioner, is in his seventh year on the Board of Commissioners and was presiding officer when Deal tapped him to replace CEO Burrell Ellis. He said that he’ll talk with members of the DeKalb House and Senate delegation about developing legislation that would make incorporation a more equitable process. But he said the county has to take a more aggressive role in future public conversations about cityhood.

There are placeholder bills in the Legislature for several more proposed new cities, including Lakeside in the Northlake area and Stonecrest in South DeKalb. On other priorities, May said he wants to include a three- to five-year forecast in the proposed 2014 budget that would project future spending on personnel, technology and capital improvements. May will serve until Ellis’ case is resolved or his term ends, whichever comes first. District Attorney Robert James filed a motion to have the trial start in August. A Superior Court judge set the date as Aug. 19. May had a number of high-profile fights with Ellis over budget issues, but he promised Thursday to put an end to conflict between the board and the CEO’s office. “I’m tired of the conflict, tired of us fighting. I’m tired of us not being able to get along. I’m tired of us not being able to move legislation as quickly as we can because we’ve got all this mess in between us, this big divide. So that’s one of my highest priorities.” Employees seemed pleased with the informal format and the opportunity to engage their boss directly on key issues. Senior planner Melora Furman, who asked the question about cityhood, said she appreciated May taking the initiative to invite the employees to the meeting. “He did answer my question and I appreciated the chance to have that kind of contact with him,” she said. May said he thought the talk went well. “I just really wanted to speak to the employees from my heart,” he said. “They’ve been through a disruptive transition and there’s been a lot of turmoil over the past year. So I wanted them to see me face to face, hear my vision, and know how important they are to the success of this county.”

Activists seek justice in 1946 mass lynching By Jennifer Ffrench Parker

Every July for the past seven or eight years, Jodi Williams of Decatur has made her way to Moore’s Ford Bridge in Monroe. While in Walton County, she also visits the graves of two couples – George and Dorothy Dorsey and Roger and Dorothy Malcom, who was seven months pregnant – who were lynched at the bridge on a quiet rural road. All were in their 20s. Since she was 5 years old, her daughter Sumer has been at her side for what has become an annual pilgrimage. On July 27, when Williams made her way to the bridge with about 80 others for the Georgia Association of Black Elected Officials’ Day of Remembrance for Moore’s Ford Bridge and other lynching victims, Sumer, now 13, was also with her. Williams says she keeps going back because of the caring. “It’s just knowing that people still are concerned about what happened back then,” she said after witnessing a re-enactment by actors of the July 25, 1946, lynching of the Dorseys and the Malcoms by 20 to 25 members of the Ku Klux Klan. The two men and their wives were taken from jail, dragged from the car they were in, and brutally beaten and shot multiple times. The lynching was precipitated when Roger Malcom stabbed a white man who was rumored to be having an affair with his wife. He and the Dorseys were bailed by Loy Harrison, a white farmer they had worked for, and delivered to the KKK lynch mob. The crime, labeled “America’s last mass lynching,” attracted national attention. It is still one of Georgia’s unsolved crimes.

No one was ever charged Despite an FBI investigation ordered by President Harry Truman and several attempts by the FBI and state authorities since then, no one has ever been charged. In 1946, the FBI was met by a wall of silence in the town, and it hasn’t cracked much since. In 2001, Gov. Roy Barnes reopened the investigation with the Georgia Bureau of Investigation, and in 2006 the FBI also re-entered the case. Every year since 2004, state Rep. Tyrone Brooks has been taking people to visit the graves of the victims and to witness a re-enactment of the crime. A few years ago, Brooks said he named the Malcoms’ baby “Justice.” “It just seemed fitting,” he said. Williams credits Brooks for his steadfast drive to keep the spotlight on the crime so that those still living can be prosecuted. She said that even though she had heard about the lynching, the re-enactments have helped her understand what really went on. Now Williams also wants to see justice for the families. “I would like at least a trial,”

Wellness Grants to help fight veterans’ homelessness Veterans will soon get more financial, housing and emotional support from the Decatur Cooperative Ministry Inc. compliments of a $550,000 grant from the Department of Veterans Affairs. The nonprofit is among four metro Atlanta-based groups that will receive more than $4.5 million from the federal government to fight veterans’ homelessness. The others are West End Ministries, Travelers Aid of Met- Hank Johnson ropolitan Atlanta, and the United Way of Metropolitan Atlanta. Fourth District Rep. Hank Johnson, who supported the group’s application and announced the grant July 23, said veterans put their lives on the line for our freedoms. “We must do all we can to help veterans get back on their feet,” Johnson said. More than 390 nonprofits received grants, part of a $300 million nationwide effort targeting 120,000 homeless and atrisk veterans and their families. President Barack Obama pledged to “be relentless” in his pursuit of ending veterans’ homelessness within the decade. As long as a single veteran lives on our streets, we have work to do, said VA Secretary Eric K. Shinseki. “With these grants, we are strengthening our partnership with community nonprofits across the country to provide veterans and their families with hope, a home, and a future,” he said.

West Nile virus found in DeKalb mosquitoes The West Nile virus has been found in DeKalb during a routine collection of mosquitoes in the county, highlighting the need to dump standing water and use mosquito repellent, local health officials say. The DeKalb Board of Health said July 25 that a routine sampling of mosquitoes tested positive for the virus – the first report S. Elizabeth Ford of positive mosquitoes in metro Atlanta this year. The virus is spread by infected mosquitoes. It can cause serious, life-altering and even fatal disease. Although infected people over age 50 are at highest risk for serious illness, individuals of all ages can become ill. Symptoms of West Nile virus include headache, fever, neck discomfort, muscle and joint aches, swollen lymph nodes, and a rash that usually develops three to 15 days after being bitten by an infected mosquito. Some people develop a less severe illness called West Nile fever. This mild illness usually does not require medical treatment and goes away. Most people who are infected with

Do not use DEET products on infants under 2 months old. Do not use oil of lemon eucalyptus products on children under 3 years old. An adult should apply repellent to their hands, then rub them on the child. An adult should not apply repellent to a child’s hands nor allow a child to apply repellent. Keep repellent out of the reach of children. Use mosquito netting over infant carriers and strollers. The Board of Health’s Division of Environmental Health monitors for West Nile virus through mosquito sampling. Since the virus can kill birds, the division also analyzes reports of dead birds. Life is about to get easier for Panola Road drivers entering and exiting the Publix supermarket and the IHOP and Ruby Tuesday’s restaurants in the commercial area between Thompson Mill and Fairington Road. Work crews on July 27 completed installation of a $112,000 span wire traffic signal at the Centre at Panola shopping plaza, which is anchored by a Publix on the busy corridor in Lithonia a block south of I-20. Publix spokeswoman Brenda Reid said the changes will make it easy for shoppers. “Right now, turning left into the plaza coming north on Panola is a problem, and turning left or right exiting the plaza is just as bad.” The new lights will control north- and southbound traffic on Panola while giving supermarket and restaurant customers signals to make safe left or right turns into the plaza or businesses across the street. Publix is sharing the cost of the project with its

landlord, Kite Realty Group, “for the safety and convenience of our customers,” according to an e-mail from the chain’s Southeast regional office in Atlanta. Work crew supervisor Tim Lee said the system is ready to go live but there’s one snag. “The DOT has to put in wheelchair ramps and other improvements to the sidewalks on both sides of Panola, then stripe the crosswalk,” Lee said. “That has to be done before we can activate the traffic signal and put it into operation.” Georgia DOT spokesman Mark McKinnon said on Aug. 1 that Panola is a county road, and the sidewalk improvements are the responsibility of the DeKalb Public Works Department. DeKalb spokesman Burke Brennan said McKinnon’s information is correct. “The Department of Traffic Engineering has to work out a technical issue with the contractor, so it will probably be another two weeks, around Aug. 15, before the lights are activated,” Brennan said.

New grocer for old Kroger space on Rainbow Drive By Ken Watts

DeKalb SuperValu operator Ken Hong says he has leased the former Kroger supermarket space in the Rainbow Village Plaza in Decatur to open a second store. Hong, who became part of the SuperValu chain on June 12 after parting company with Piggly Wiggly at 2112 Candler Road, said on July 31 that he plans to open the second store in about three months. Shoppers were left without a grocery close to home in May when Kroger abruptly closed the store it had operated for 38 years. Hong said he and his family signed a lease with Caldwell Properties in June for the space. He said it will take three months to open because some equipment they purchased from Kroger was damaged when the fixtures were removed and returned to the building. “Now we have to either fix a lot of that stuff or replace it.” He hasn’t decided whether it will carry the SuperValu brand. “We’re still trying to decide all that, but we know it’ll be similar in quality and appearance to Kroger,” he said. He recently spent $120,000 to make improvements at his Candler Road location in wake of demonstrations about poor conditions. He said SuperValu helped pay the cost of extensive upgrades, including installation of new meat display cases and produce coolers.
