DA presses for release of grand jury report on CEO By Mary Swint
A panel of 23 DeKalb grand jurors wants the Georgia Supreme Court to review a “politically charged case” in which a DeKalb County judge ordered their unfiled report disclosed to DeKalb CEO Burrell Ellis and politically connected businessman Kevin Ross while withholding it from the public and fellow Superior Court judges. DeKalb District Attorney Robert James filed a petition June 3 on behalf of the 2012 special purpose grand jury asking the state’s highest court to review the Georgia Court of Appeals’ dismissal of its appeal of Judge Mark Anthony Scott’s Feb. 7 order. The petition repeatedly referred to Ellis

Evicted woman ‘reoccupies’ her Lithonia home Occupy activists contact lender, plan next move By Ken Watts
Toni Furman, who says she was illegally evicted, is back in the Lithonia house where she lived for 23 years. Urged on by activists from Occupy Our Homes Atlanta, Furman reoccupied her home on June 10. Flag-waving, banner-bearing activists stood with Furman at the front door of her four-bedroom, two-story house on Stoneleigh Hill Road late Monday. Furman was emotional. “I have been enslaved by Cenlar Mortgage for five years,” she said. “The end of my slavery begins now.” The front door of the wood frame house on the quiet street was unlocked. Furman pushed it open. “I was in disbelief standing there, frozen for a second,” she said. “The group had to remind me to go in.” The house was empty and the utilities cut off after DeKalb sheriff ’s deputies dumped Furman’s furniture and belongings on the front lawn on May 7. “I never thought I would have a chance to return,” she said. Outside, Occupy activists were busy planning their next steps. Veteran civil rights leader Joe Beasley was on the phone leaving a voice mail for Gregory Tornquist, CEO of Cenlar, the Ewing, N.J.-based mortgage company that holds Furman’s mortgage. “I want you to know that we’ve repossessed the property on Stoneleigh Hill Road in Lithonia, Ga.,” Beasley said in his message asking for a return call. “It’s a fact that people are more important than houses and if you had taken over this one, every other house in the neighborhood would be devalued.”

Later, Beasley said housing is a human right. “So it’s not illegal to take back what is yours,” he said. The group left voice mails for the company’s other four senior managers and sent them e-mails and photos of Furman’s house hoping that her possession of the home will pressure the company to make a deal. Rob Call, an Occupy activist, said the telephone calls are just to notify the lender that Furman has reoccupied her house. “We’re here,” he said. “We want to talk with them and we want us to solve this problem of Ms. Furman being homeless and figure out a way for her to stay in her
home.” Occupy organizer Tim Franzen said that placing Furman back in her house was more than a protest. He called it a strategic move. “They say possession is nine-tenths of the law, right? Well, the best way Tim Franzen to fight for your home is to be in it,” Franzen said. Furman, a substitute high school science teacher, fell behind on her mortgage after her 2008 divorce. She said the lender refused to modify her loan and the house
fell into foreclosure. She said her eviction was unlawful because of the way sheriff ’s deputies handled it. “What was illegal was to break in my door and not serve me papers until an hour into the eviction,” Furman said. “And I do have witnesses to that.” Furman said Cenlar also erred by basing the eviction on a deed that had a previous owner’s name on it instead of hers. “In the state of Georgia, if a court finds that there’s been a wrongful eviction, you get your home back, mortgage-free,” Furman said. Veterans, families surprised with mortgage-free homes By Ken Watts

Five Afghanistan and Iraq War veterans, including Army Sgt. Ricardo Bailey from Decatur, got the surprise of their lives in Stone Mountain Park on June 1 – new homes, mortgage-free. The presentations were made with military precision by Operation Homefront, founded in 2002 to provide financial help and housing to post-9/11 service members, their families and wounded warriors. The other recipients are Army Sgt. Joe Wallace, Army Spc. Chris White, Marine Sgt. Corey Bowen and Army Sgt. Michael Vanscoy, Banking giant Wells Fargo and United Rentals are partners in the charity’s program called “Homes on the Homefront.” The veterans and their families are from all over the country but have strong ties to the Atlanta area, including South DeKalb. They thought they had been invited to the weekend cookout to talk informally with United executives about job opportunities. But then Amy Palmer, chief development officer for Operation Homefront, came out on the band stage to make an announcement. “We’ve actually brought you here for another reason,” Palmer said. “And with that, representatives will unveil your new homes!” The crowd of about 200 roared as volunteers uncovered easels holding poster-sized pictures of five beautiful houses that had been discreetly placed near each family. Shock and disbelief quickly morphed into unbridled joy. In the 11 years since its launch, Operation Homefront has provided more than $128 million to help post-9/11 military families in 43 states and has given away 125 homes. The renovated homes given away on June 1 came from Wells Fargo’s metro Atlanta foreclosure property inventory. Brian McCullough, Wells Fargo Military Affairs Program manager, said they have earmarked $30 million to help put veterans in homes and to help stabilize neighborhoods hit hard by foreclosures. “Most of all, we want to show our appreciation for the service that these men and women have given to our nation,” said McCullough, an Air Force veteran. “I’ve been to the Middle East six times since 9/11, so this resonates in a special place in my heart.” Homes on the Homefront is Operation Homefront’s flagship program. Spokesman Nick Kaylor said another 100 homes have been matched with families and are scheduled to be given away as soon as the houses are renovated. He said the program is life-changing. “That’s also why we have such a great amount of support from United Rentals, Wells Fargo and the local community.”

in Decatur since his retirement in 2012. “Oh, my God, it’s awesome!” Bailey said when he caught his breath. “I thank Jesus for giving us the grace to be here, to be alive.” Bailey was born and raised in Trinidad and Tobago and moved to the United States in 1997 at age 27. He lived in the Bronx, N.Y., and witnessed the 9/11 attacks. He enlisted in the Army in 2006 as a fueler. During his six-year career, Bailey deployed once to Afghanistan where he suffered injuries that led to his medical discharge. His wife, Archagul, also served in the Afghan war zone as a civilian working as a barber for U.S. soldiers at military bases. That’s how she and Bailey met. “The house is so beautiful,” she said. “I just thank God for this blessing.” Corey Bowen was born and raised in Atlanta. Bowen enlisted in the Marines shortly after high school. He served for 10 years performing primary scout duties as a rifleman. Bowen deployed twice, once to Iraq and once to Afghanistan. While deployed, he suffered injuries that eventually forced his medical retirement in early June. “It’s just a complete shocker,” he said. “I don’t think it’s completely sunk in yet. I’m sure when it does I’ll probably break down.” The Bowen family has been living in the Operation Homefront Village in Southern California. They’ll soon move into their new mortgage-free home in Lawrenceville and reunite with Atlanta area relatives they haven’t seen in more than a decade. Cenlar spokeswoman Denise Vaccaro told CrossRoadsNews on Wednesday that the company is reviewing Furman’s case but has no further comment at this time. Occupy members are with Furman around the clock. Eager shoppers rush new Walmart after ribbon-cutting By Jennifer Ffrench Parker
Anita Nelson loves fresh foods and vegetables, and she has traveled for years outside of her Stone Mountain neighborhood to find it. Now a new Super Walmart at Memorial Drive and South Hairston Road promises her fresh, even organically grown produce. If the store that opened on June 12 delivers on that promise, Nelson said she will be back often. Right after the 40-minute ribbon-cutting ceremony, Nelson was among the first throngs of shoppers through the door. Her first impressions were positive. “I like quality food and it’s been hard to find in the neighborhood,” Nelson said. “If they maintain a good produce department, they will see me often. If they maintain the quality of their produce, I will be back.” The 152,000-square-foot store opened with associates and guests doing the electric slide in the parking lot, followed by performances by the Redan High Marching Band, speeches from Walmart and elected officials, and store manager Dan Fagan’s announcement of $8,000 in grants to six recipients – the DeKalb Police Alliance, the Tucker Precinct, DeKalb Fire & Rescue, Memorial Drive Presbyterian Community Outreach Program, the YMCA Youth Career Academy, and Redan High. District 4 Commissioner Sharon Barnes Sutton, who represents the area, said the store brings not only convenience and jobs to the corridor, but signals that DeKalb is open for business. “I just can’t wait to get in there and start shopping,” she said. “I can now drive around the corner and come to my own Walmart.” Tyrone Dennis, who lives about half a

He said it was easy to find what he was looking for. “It’s a very nice setup,” he said. “I like the fact that it is here in the neighborhood.” Ann Marie Francis drove all the way from Lithonia to check out the new store. “I came to see if they have anything discounted or free for the grand opening,” she said while picking up fresh blueberries and other fruit. Francis said the store was nice and clean. “It smells fresh for now,” she said. “I hope they keep it up.” Fagan, who began his Walmart career in 1992 as an hourly cart pusher, said associates have been working hard to get the store at 5935 Memorial Drive ready for the community.
Vaughn Irons, chairman of the DeKalb Development Authority, said the opening of the new Walmart on Memorial Drive is the pinnacle of revitalizing the corridor. “This area spends $2 billion a year on retail,” he said. “Another $910 million is spent
elsewhere. With this Walmart, we will start to recapture some of that money.” The Stone Mountain store was one of 17 Walmart stores that opened in communities across the United States on June 12. Two other Walmarts are under construction in South DeKalb. A Super Walmart under construction next to the Stonecrest Sam’s Club in Lithonia is scheduled to open in August, and a neighborhood Walmart under construction in the Covington Square shopping center at Covington Highway and Panola Road, also in Lithonia, is expected to open in the fall. Walmart already operates Super Walmarts in Decatur, Stone Mountain, Atlanta and Lithonia. On June 15, Fagan is hosting “A Big Family Welcome” for the Stone Mountain community from 10 a.m. to 3 p.m. Fun family activities will include face painting, cupcake decorating and free food samples while supplies last. Johnson to live on food-stamp budget for a week For the next seven days, 4th District Rep. Hank Johnson is living on $31.50 worth of food, the average weekly benefit for a food stamp recipient. Johnson, who lives in Lithonia, began the Food Stamp Challenge on June 13 to highlight his opposition to proposed $20 billion cuts to the Supplemental Nutrition Assistance Program, which is part of the fiscal year 2014 Farm Bill that is up for reauthorization this year. With his $31.50, Johnson bought oatmeal, bacon, milk, noodles, hot dogs, bananas, tea, waffles and syrup – and broccoli. His office said he had to put the broccoli back because it put him over the budget. He will eat only from his purchases through June 20. More than 22,000 people in the 4th District – which includes parts of DeKalb, Rockdale, Gwinnett and Newton counties – are enrolled in the food stamp program. Across the district, 19 percent to 21 percent of residents have incomes below the SNAP poverty threshold – $28,668 annual income for a family of four. Johnson calls the proposed cuts to SNAP “harmful and irresponsible” and said that it’s hard to find nutritional food on such a limited budget. “I think a lot of people have a misperception that being on food stamps is somehow a gravy train,”

There are millions of people in the United States who go hungry every day and who rely on food stamps to get by.” Johnson said that taking the challenge will give him a better understanding of the daily reality of millions of Americans. Johnson says the food stamp program was designed as a safety
net for people going through difficult times. Nationally, more than 45 million low-income people purchase food for themselves and their families with the help of the program. More than half of food stamp recipients are children and 8 percent are over 60 years of age. Johnson says the majority of people leave the program within nine months. The 4th District representative
is one of 30 Congress members, almost all Democrats, taking the challenge in hopes of building support for improving benefits and access to the food stamp program. Changes to the food stamp program made during welfare reform legislation in 1996 have eroded the purchasing power of food stamps. So while the price of food has increased, the value of the food stamps has not kept pace, resulting in the current average of about $1.50 per meal. Johnson said it’s important for the public to understand the number of people relying on food stamps and just how limited their nutritional options are.

Sixty-one is one of the lowest scores given by the DeKalb Board of Health to a restaurant. During the four-hour health assessment, inspector Bryan Thomas found problems ranging from deficient employee hygienic practices and contamination prevention to poor condition of food. Thomas’ report cited nine health code violations. He gave

Thomas told on-site managers that they will have a follow-up inspection within 10 days and that failure to achieve at least a 71 percent or “C” will result in closure.

ager, had no legal right to file these motions. The petition said that under state law, Scott was supposed to give the report to Chief Judge Gregory Adams, who would distribute it to all the Superior Court judges so they could vote on whether to continue the special grand jury investigation or to accept its final report and dissolve the grand jury. The grand jury argued that Scott had no jurisdiction over the unfiled report, no authority to redact it, and no authority to even read the final report before recommending
the grand jury be dissolved. The petition noted the law was different for criminal grand juries and the circumstances were different when former DeKalb CEO Vernon Jones was given a copy of an unfiled 2003 criminal grand jury presentment so he could file objections. The district attorney who agreed to that disclosure was J. Tom Morgan, one of the lawyers now representing Ellis. “Petitioner has tried to get answers from the courts but keeps getting turned away,” the petition said. It adds that Scott “ignored” two
motions the grand jurors filed seeking an explanation. The grand jury filed another case that asked the DeKalb Superior Court judges to vote on dissolving the grand jury but “that action was initially dismissed without explanation and then ‘transferred’ to Fulton County.” The new petition said the system appeared to be broken. In the Feb. 7 order, Scott said he was concerned the district attorney was “abusing the grand jury process” and trying to circumvent the rights of Ellis and Ross. In another order on March 28, Scott said the report had not been
released to Ellis and Ross and he would not issue any further decisions until the Court of Appeals ruled on the appeal. “This court does not have a position on the results of the (special purpose grand jury’s) investigation or its findings,” Scott said in his March 28 order. “The court is solely interested in protecting the integrity of the judicial process.” Attorneys for Ellis and Ross have until June 24 to file a response to the petition with the Supreme Court. Tributes honor dads who make a difference in kids’ lives Editor’s note When we invited readers to brag about their dads, entries poured in from across our coverage area, including Decatur, Clarkston, Snellville and Buford. They all celebrated fathers who are or were present in their lives. Our judges picked Capri and her dad, Roderick Smith, a $100 gift card for dinner at Arizona’s at Stonecrest. This Father’s Day and every day, we salute all fathers who are a constant presence in their children’s lives.

I am my father’s daughter – so much of what I am is because of what he told me I was. He told me I was bright and intelligent. He told me I was pretty. He told me I was humorous. He loved truth – I am known in my family and other circles as a truth seeker and speaker. I am a motivational speaker/writer/encourager, and when I do all those things, I see him and I hear him within me; he wasn’t wildly successful on the world’s terms, but of all the things that I remember and value about my father, the fact that he never left his nine children sticks out in my mind. Through financial difficulties and relational issues with my mom and his offspring, he never, ever left us. Not overnight, not for a day. Under the Affordable Care Act, Sebelius said new options will be available for the 23 million men who are eligible.
Dad’s health impacts kids’ well-being A father’s love and full involvement in his children’s lives are crucial to their health, well-being and development. That’s the word from Health and Human Services Secretary Kathleen Sebelius as the nation observes Men’s Health Week and Father’s Day on June 16. She says fathers make a difference. “Fathers influence the physical well-being of their children in a number of ways by being engaged in their lives, supporting a Kathleen Sebelius mother’s health, or by ensuring that children get the preventive services such as vaccinations and well-baby checkups they need to stay healthy.” She said studies have shown a father’s own health makes a difference to their children’s health. Active toddlers, for example, are more likely to have fathers with a lower body mass index than less active children. National Men’s Health Week, which concludes with Father’s Day, is a good time to focus on how men can take care of their own physical and mental health for themselves and for the well-being of their families. That means eating right, being active, and getting health insurance to ensure their families’ security and peace of mind, Sebelius said. Millions of men are uninsured, and an accident or illness could lead to crushing debt devastating to their families’ security. Under the Affordable Care Act,
National Men’s Health Week concludes with Father’s Day, a good time to focus on how men can take care of their health for themselves and for their families.
Sebelius said new options will soon be available for the nearly 23 million men who are eligible. Beginning Oct. 1, individuals and small businesses will be able to visit a Health Insurance Marketplace to compare health coverage options and choose the plan that best fits their needs and wallet. Some will be eligible for free or low-cost plans. Coverage begins as early as Jan. 1 when the health care law goes into effect and no one can be turned away or charged more for coverage because of a pre-existing condition. The Affordable Care Act also requires most private health insurance plans to cover recommended preventive services, such as cholesterol checks, alcohol misuse counseling, depression screening, and help to quit smoking. Sebelius said the Department of Health and Human Services also is helping fathers develop responsible parenting skills and economic stability.
Head Start and Early Head Start programs are bolstering resources and training for creating father-friendly programs to make it easier for men to engage in their children’s lives. The Administration for Families and Children works in partnership with the National Responsible Fatherhood Clearinghouse to support Fatherhood Buzz, an initiative to promote responsible fatherhood and provide community resources through barbershops across the country. The Clearinghouse recently unveiled public service announcements featuring characters from the movie “Despicable Me 2” and focusing on the theme “Take Time to Be a Dad Today.” These programs aim to connect dads to jobs, training and other resources. They also strengthen the bonds between couples with children, reduce domestic violence, and help provide children strong role models of adulthood, Sebelius said.
Free HIV tests, blood pressure screenings Free HIV testing and blood pressure screenings are available on June 22 at the BeFit Women’s Fitness Center in Lithonia. The HIV/AIDS Awareness and Wellness Day event, presented by the 100 Black Women-Decatur, takes place from 9:30 a.m. to 2 p.m. The screenings are part of the group’s “Do You Know Your Status?” campaign, which seeks to dispel myths about HIV/AIDS and encourage residents to find out their status and the status of their partners. Information on HIV/AIDS health and childhood obesity will be offered, and there will be entertainment, giveaways and raffle prizes. Prairie View A&M, which has more than 40,000 alumni nationwide, is a leading historically black college in nursing and engineering and Texas’ second-oldest learning institution. More than 175 alumni are expected for the convention. When Isaiah got to Stephenson in the ninth grade, band director William Oliver encouraged him to join the jazz band. It wasn’t long before Isaiah had formed the Jazz Quartet with classmates Darius Cassey on drums, Siji Mark on bass, and Cameron Dixon on tenor saxophone. On June 8, the group performed at the annual DeKalb Lawyers Association’s annual scholarship breakfast attended by lawyers, judges, elected officials and supporters and got a standing ovation. The association’s past president, Mereda Davis Johnson, said she invited the Jazz Quartet to play after hearing them perform in April at the art competition by her husband, U.S. Rep. Hank Johnson. “He was just magnificent,” she said this week. “When I found out he was in high school, I couldn’t believe it.” After his performance, Davis Johnson passed the hat for donations. “Everybody dug deep and gave,” she said. Isaiah left the breakfast with $982 in donations but is still $2,200 short of his goal. Hill said his family welcomes any help

Safer than skateboarding Isaiah turned to music after his first love, skateboarding, kept sending him to the hospital. After two trips to the emergency room for a broken arm and broken thumb, his father, Derrick Hill, had enough. “I told him he had to do something that’s a little less dangerous,” he said Wednesday. His dad dusted off an old keyboard stored away in their closet. “Isaiah turned on the radio and played exactly what he heard on the radio,” Hill said. He plays R&B, gospel and pop songs by ear. As Isaiah Hill’s fingers glide effortlessly over the keys of his 84-year-old baby grand piano, the soulful chords of “Armando’s Rhumba” fill the air. Hand over hand, up and down the keyboard, they move. His shoulders rise and fall with each rhythmic phrase of the Chick Corea standard, each bursting with harmonic cadences and percussive melodies. In perfect time with each stride of the bass line, his left foot taps instinctively as his right elongates staccatoed overtones with each push of the damper pedal. “When I play, I feel at one with the keyboard,” says the 17-year-old rising senior at Stephenson High in Lithonia. “I feel like I’m the vessel which music travels through. The piano isn’t the instrument – I’m the instrument. The music is inside of me, and I make the music, not the keyboard or the piano that I’m playing.” On Feb. 7, his talent caught the eye of a national operations and outreach director for the prestigious Berklee College of Music while on a trip to Atlanta. A single tickling of the ivories was enough to prompt a rave review to Berklee Executive Director Curtis Warner – and land him a full-tuition scholarship to its comprehensive Five-Week Summer Performance Program in Boston. “When I first heard Isaiah play, my initial thought was that this is a young man with great talent, facility, creativity and clearly knows his instrument,” Warner said. “He demonstrates a maturity in his playing that you don’t come across too often among others of his age group. He has an old spirit.” Isaiah is one of two Georgia students and among 109 accepted in the program, which takes place July 6-Aug. 9. More than 170 students from over 70 countries applied. The tuition scholarship is valued at $4,300 but does not include room and board. Participants must come up with $3,300 to cover the five weeks of the program. Since he got the news on May 10, Isaiah has been raising funds to help cover the cost.

Students, faculty and administrators at Georgia Perimeter College’s Clarkston campus are breathing easier this weekend after the arrest of two suspects in the slaying of 23-year-old Alpha Oumar Diallo of Stone Mountain. An autopsy revealed that Diallo, whose body was found in a wooded Alpha Diallo C. Shepard Constance Mason area on the campus, died as a result of strangulation and blunt force injuries to “kinda creepy.” “There’s public safety all over the place the head. GBI agents backed by DeKalb SWAT all of the time,” she said. Abby Tyson, also a nursing student, said team officers arrested Christopher Shepard, 28, and 44-year-old Constance Mason at it was confusing to see the fire trucks and all their home in Clarkston early Thursday near the commotion. “I saw campus security flying over here,” where Diallo’s body was discovered. DeKalb’s proposed $759 million school budget moved one step closer to final approval on June 9. By a unanimous 7-0 vote, board members gave their preliminary OK for the fiscal year 2014 spending plan. District 2 member Marshall Orson and Vice Chair Jim McMahan, District 4, were absent. The board has to adopt a final budget before fiscal 2014 begins on July 1. Interim Superintendent Michael Thurmond’s plan includes a $27 million surplus that he and his staff discovered in May. Thurmond wants to use that revenue to help ease some of the pain from the FY 2013 budget that imposed $78 million in cuts implemented by his predecessor, Cheryl Atkinson, and the prior School Board, replaced by Gov. Nathan Deal in March. Those cuts increased classes sizes and imposed two additional unpaid furlough days on teachers and cut interpreters, teachers aides, bus mechanics and library workers. Thurmond, who was appointed in

February, wants to spend $500,000 to hire back interpreters and $250,000 to restore four bus mechanic positions. His plan would spend $5.3 million to buy and restore books and $1.5 million to upgrade back office computer systems. Thurmond’s budget also eliminates one furlough day at a cost of $3 million and puts $1 million into an incentive program to encourage attendance by bus drivers and other support workers and $150 per employee for perfect attendance. Thurmond’s enhancements under the 2014 budget total $15.5 million, and he wants to place $12.7 in a reserve fund. Board members asked whether the incentives program could wait or whether the legal budget could be cut further. District 5 board member David Campbell said he’d rather put more money into eliminating additional furlough days “just to send the signal that we’re trying to right this ship as much as we can.” Thurmond defended the ideas, saying the district needs better software to monitor finances and still has to pay lawyers, even though the superintendent has drastically reduced those costs. The board is expected to take its final vote on the budget on June 26.
