In the wake of the public quarrel with former Georgia Attorney General Mike Bowers over his DeKalb corruption report, interim CEO Lee May said he considered resigning. “The thing that bothers me the most is that I’ve become the kind of distraction that I was trying to get rid of,” he told more than 200 South DeKalb residents at an Oct. 13 Lee May town hall meeting in his old commission district. But May, who was appointed by Gov. Nathan Deal in July 2013, said he decided instead to wait until he met with Deal who has asked the Georgia Bureau of Investigation to vet the report for criminal wrongdoing. May said no meeting had been scheduled with the governor. Deal tapped May to fill in for suspended CEO Burrell Ellis, who is serving an 18-month prison sentence and appealing his conviction on attempted extortion and perjury. Before the mostly supportive crowd at the Lou Walker Senior Center in Lithonia, May said he’s interested in continuing the progress he’s seen in the county on his watch. Many residents asked him to stay in office and two carried signs that read “We Believe in Lee” and “Stay Strong May.” Others criticized him for spending more than $850,000 for the investigation when there were established arms of government – the GBI, IRS, U.S. attorney – that could have done the probe. He said the county is in good fiscal shape, and police and fire employees got a cost-ofliving wage adjustment in 2015 for the first

time in years and they are hiring more officers and firefighters. “I believe I have something positive to offer the county,” May said. “I believe we’ve been doing some tremendous work over the past two years and, yes, I would like to complete it, but that’s in the governor’s hands and I’ll proceed based on the will of our governor.” Lloyd Aleman of Lithonia, who said he worked with May on community projects for years and found him to be a man of his word, said he had confidence in May’s leadership. thonia resident Faye Coffield, who has called for May’s resignation, took him to task for not finding out whether the high cost of the probe could have been avoided. “Where did the money come from?” she asked him. “Why weren’t the GBI, Internal Revenue Service or FBI used when they volunteered to do it?” May said the GBI and IRS aren’t set up for what he wanted to do. “If given another chance, would I have done it differently? Probably so, but then again we could have gotten the same outcome,” he said. Former state Sen. Steen Miles wanted to know whether May had Steen Miles second thoughts about hiring outside investigators. “Do you feel you were bamboozled?” she asked.

Miles said that money could have been better spent on street sweepers for the county. “Hindsight is 20/20,” May said. “It was my decision. I have to own it.” May hired Bowers and Hyde, fresh from their investigation of the Atlanta Schools cheating scandal, on March 18 to “root out corruption.” May had set no timeline for the completion of the probe nor a ceiling for its total cost. At rates of $150, $320 and $400 an hour through the end of September, the county had paid $673,000 to Bowers’ law firm, Balch & Bingham, and $211,790 is still outstanding. Bowers, who released the report to the media, accused May of obstructing the investigation that he commissioned. depicted in the carving was from Georgia. “Jefferson Davis was born in Kentucky and lived in Mississippi,” he said. “Stonewall Jackson and Robert E. Lee were Virginians. Martin Luther King was a Georgian. So we absolutely reject putting an internationally renowned figure for nonviolence and peace with rogues, traitors and warmongers, which is what Jefferson, Lee and Jackson were.” The 90-foot-by-190-foot Confederate memorial was carved into the granite mountain after the state of Georgia acquired it for just over $1.2 million in 1958 at the urging of Gov. Marvin Griffin. In 1963, sculptor Walker Hancock was hired to complete the carving that sculptor Gutzon Borglum abandoned in 1925 because of a dispute. Borglum took his sketches and models and went on in 1927 to carve the famous Mount Rushmore sculpture in South Dakota, which was completed in 1939. Billed as the “largest high relief sculpture in the world,” the Stone Mountain carving, which spans three-quarters of the mountain’s face, was completed in 1972. It towers 400 feet above the ground and is recessed 42 feet into the mountain. The deepest point of the carving is 12 feet to the mountain surface.

For years, the Stone Mountain monument, located less than 20 miles northeast of the King Historic Site in Atlanta, has been at the center of debate between those who want to honor Confederate history and others who believe the carving and its Confederate flags glorify the state’s racist past and should be removed from state-owned land, just like the Confederate battle emblem was removed from the state flag in 2001. The KKK was reborn near the mountain in 1915 and was the site of Klan rallies and cross burnings for decades. The Venable family, which owned the property until 1916, included KKK sympathizers and at least one leader of the Klan, James Venable. The civil rights leaders say they want to meet with the Stone Mountain Memorial Association as soon as a meeting can be arranged. They say they received no promises from Deal. His office had not commented on the meeting at press time Thursday.

Decatur woman jailed in kickback case Lakeysha Ellis of Decatur has been sentenced to nine months in prison for her role in a corruption scheme involving a former Georgia National Guard employee. Ellis, 37, also was sentenced to three years of supervised release and three months of home confinement and ordered to pay $74,902 in restitution to the Guard and $81,487.88 to Baumueller-Nuermont Corp. Raytosha Elliott, a former contracting official with the Guard, and Ellis and Angela Thicklin, owners of two vendor companies, took part in a scheme in which Elliott awarded contracts to the vendors in exchange for illegal kickbacks. Elliott, 35, of Atlanta was sentenced to two years, 10 months in prison and three years of supervised release and ordered to pay $115,902 in restitution to the Guard and $26,500 to Baumueller-Nuermont by U.S. District Judge Amy Totenberg. Elliott worked with the Guard from May 2007 to April 2012. Court documents showed that under the rules governing the contracting process overseen by Elliott, projects costing less than $5,000 did not need to go through a competitive bidding process, allowing her to award the contracts. Between January 2009 and May 2011, Elliott awarded numerous contracts under $5,000 to vendor companies created by her friends and associates. She certified that the work had been completed and facilitated

payment to the vendors who allegedly completed such projects in return for kickbacks equal to 50 percent of the value of the contracts. Elliott was ordered to pay $20,000 in restitution to WebBank based on a fraudulent loan application she submitted to the bank in September 2013. In that application, Elliott falsely inflated Tech Group Investments’ sales and gross receipts and provided a fraudulent federal tax return in support of those figures to obtain the loan. She also was ordered to perform 60 hours of community service. Ellis and Elliott previously pleaded guilty to two counts of conspiracy. Thicklin, 45, of Atlanta was sentenced to one year, nine months in prison and three years of supervised release and was ordered to pay $78,640 in restitution to the Guard. She previously pleaded guilty to one count of conspiracy. U.S. Attorney John Horn said Elliott took advantage of her position with the Guard and awarded no-bid contracts to her friends in exchange for illegal kickbacks. “She and two of her friends stole over $150,000 in funds that were intended to maintain defense facilities and instead spent the money on themselves,” Horn said in a Sept. 15 statement. State Inspector General Deb Wallace said the sentences may serve as a deterrent to others who “desire to pilfer the state and federal governments’ coffers.”

Judge Seeliger to seek re-election By Jennifer Ffrench Parker

DeKalb Superior Court Judge Clarence Seeliger will seek re-election in 2016. Seeliger, who has been on the DeKalb bench for 35 years, has been in Superior Court since 1985. He was first elected to the State Court bench in 1981. Seeliger says he is in good health, enjoys the work, and wants to continue serving the citizens of DeKalb County. “I’m honored to have served for so long on the DeKalb County Superior Court bench thanks to the generosity of the voters of our county,” he said. “There is much to be done to continue reforming our courts, guaranteeing human rights for

all citizens, and to protect women against domestic violence.” Outside of the courts, Seeliger has chaired the DeKalb Task Force Against Domestic Violence and the State Commission Against Family Violence. Clarence Seeliger The nonprofit Women’s Resource Center, which works with domestic violence victims, named its advocacy award the Clarence Seeliger Justice Award in his honor. In 2013, the DeKalb Bar Association gave him its Pioneer Award for his decades of leadership and service on the bench, bar and public.

[that] are a disgrace to its citizens and an embarrassment to our state.” The report pointed to “a pattern of corrosive and widespread misconduct” that has “destroyed public confidence in the integrity of the governing authority.” It also accused May of accepting an illegal loan from Morris Williams, the DeKalb Board of Commissioners’ former chief of staff and May’s longtime friend, and said May used county money during a trip to Hawaii to purchase spa treatment and an adult movie. May told constituents he never used public funds for the Hawaii trip. He acknowledged buying several movies in his hotel room but said none was inap-

propriate and he paid for all of them with his own money. Bowers and Hyde said May terminated them on Aug. 6, 2015, and their report “is only an overview” of some of their findings to date. May, who scheduled six town hall meetings and canceled the first one at Maloof Auditorium on Oct. 8, has three more coming up. DeKalb District Attorney Robert James says that his office will not open an investigation into allegations against Commissioners Jeff Rader and Kathie Gannon in an anonymous email sent on Oct. 12 to his office, the Board Robert James of Commissioners and the news media. The “Request to Investigate the Illegal Activities of Commissioner Jeff Rader in collusion with his wife Carolyn H. Rader,” from “unhappytaxpayingcitizen@gmail.com,” was attached to retired Leadership DeKalb Director Sara Fountain’s name, but misspelled her first name as “Sarah.” It alleges that Rader, the District 2 commissioner, and Gannon, the Super District 6 commissioner, used their commission offices’ budgets to support nonprofits as documented in the Bowers/Hyde Report for personal and political gains. “I have uncovered additional information that you should be aware of regarding how Commissioner Rader’s payments of county funds to one particular nonprofit, Park Pride Inc., has benefited him personally and it includes collusion with his wife, Carolyn H. Rader,” the writer of the discredited email wrote. Fountain said that she did not write the email and did not send it to the district attorney. “I was Sara Fountain stunned when I learned of it,” she said. “I don’t agree with that email and I am disappointed that it was sent. It brings the level of discourse so low. We don’t need this kind behavior in the county.” James said that when he received the email on Monday, he reached out to Fountain. “She said that someone was impersonating her and had used her name,” he said. “She said that the email address was not hers.” Fountain always signs her emails “Carpe Diem!” and James said

he also noticed that the signature was not on the email. He said it’s a policy of his office not to investigate anonymous tips. Jeff Rader “We sent the author of the email an email asking that they get in touch with us,” he said. “At this point we have not heard from them. We don’t open investigations based on anonymous sources who pretend to be other people, unless it was something that we were already working on. It’s not a good use of our resources.” In an Oct. 12 “Response to Slanderous Email,” sent to James and copied to original recipients of the fictitious email, Fountain said she is “willing to testify under oath that I did not write it nor do I know who did.” “I earnestly request that you research the author of this email who deliberately used my name or tell me what I should do to uncover this injustice,” Fountain said.

Corruption report cited The hoax email quoted the 40-page Bowers/Hyde Corruption Report that identified thousands of dollars of commissioners’ budgets that have been donated to nonprofits as illegal. “However, why did Mr. Rader contribute $20,000 to one organization: Park Pride? Why did Commissioner Kathie Gannon give $6,000 to the same organization at the same time?” the email writer asked. The writer went on to say that Rader’s wife, a former executive director of Park Pride, “is still significantly and personally connected to Park Pride (most probably she is an employee-contractor with that organization)” and that through her job at the Atlanta Regional Commission supports the development of LCIs in her husband’s district that are funded by Park Pride’s matching grant program “(Rader provides the initial Grant to be matched from his County Commission Office slush fund).” The writer alleges that the Park Pride “donations” then go to Friend’s Groups in Commissioner Rader’s district that he has had a hand in forming. “Then Rader (and/or his wife)

provides feebased Planning Services through his Company, Commons Planning Inc. (a shell nonprofit that is just a vehicle for pass-through Kathie Gannon funds in the form of Planning Contracts to Commissioner Rader and his friends). This is collusion and kickback of government funds – both of which are felonies (at State and Federal levels). “Mrs. Rader gives her husband the heads up on many of the Planning contracts available through her department at ARC and because one hand washes the other, Commissioners Rader and Gannon’s Park Pride Investment becomes goodwill that is multiplied throughout the 15 County region with continual financial benefits to the Raders. “This scheme is very lucrative to the Raders while also being a felony and a potential violation of the State Constitution (according to the Bowers Report),” the anonymous writer said. “DeKalb’s ethics laws (Rader should never vote on a matter that involves his wife’s former employer or LCIs under the direction of his wife’s group with her current employer – the Atlanta Regional Commission – at least not without disclosure, and should never vote on monies that go to organizations that he has a financial hand in – so-called ‘Friends’ Groups), as well as State and Federal Law (kickbacks of public funds).” The email alleges that Gannon participates because “in her own words at a recent DeKalb County Commission meeting, ‘Jeff is my “partner in crime.”’ “Rader supports Gannon in her own initiatives to control real estate investment resources and development in North DeKalb County (while, at the same time, they both work hard to prevent development investments in the Southern parts of the County),” the writer said. Before thanking James for “holding these politicians accountable and protecting the people of DeKalb,” the writer urged him to “follow up on this matter quickly which is of much public concern and the source of regional angst against our great County.”

“I fear that their shredders are at work even now destroying evidence as you read this,” said the email signed by “Unhappy Taxpaying Citizen of DeKalb County, GA.”

Fountain ‘simply outraged’ In her “Response to Slanderous Email,” Fountain said she is “simply outraged” that the level of discourse in the county has sunk to this low level. “I have been working hard to stop the cityhood movement in my neighborhood,” she said, “but when the level of discourse drops to this kind of personal attack, it is difficult to carry the banner that we do indeed have a good county and that we don’t need another level of government. My neighbors will surely respond … ‘I told you so!’” She said she has no knowledge about the subject matter contained in the email. “I am disappointed that two of our commissioners are being disparaged in this way,” Fountain wrote. “With these kinds of vile aspersions being cast about, I can’t see how anyone would want to run for public office in DeKalb County.” She said that this type of political malice has alienated so many people and serves as an example of why people want to either move or change the government. “I do hope the author of this malicious assault on two commissioners has second thoughts and realizes that ‘what goes around comes around,’” she wrote. “It’s a rule of quantum physics that this type of negative energy will return to the originator.” The “unhappytaxpayingcitizen@gmail.com” email address is close to the name of Stone Mountain-based Unhappy Voter and Taxpayer Organization, but Viola Davis, a co-founder of that group with her mother Ruby Davis, said they did not send the email. “It’s not us,” she said Tuesday. “We don’t know who did this. We don’t have a clue who this is. We are trying to find out too.” Davis said that when her Unhappy Voter and Taxpayer group sends emails, she always puts its name and telephone number. Ross had filed for divorce earlier that week. “The scary thing is that in cases like mine, the signs are far more insidious and because so many of us think we know better than to

allow an abusive relationship, our denial and avoidance of the signs become the conduit for the abuse to escalate,” Ross said. Boston is collecting used cellphones to donate to HopeLine, a Verizon Wireless program that turns no-longer-used phones into support for victims of domestic violence. Health care enrollment opens again on Nov. 1 About 10.5 million uninsured individuals are eligible for Marketplace coverage as open enrollment in the Health Insurance Marketplace begins its third year on Nov. 1. About one-third of the uninsured who qualify for plans are people of color: about 19 percent are Hispanic, 14 percent are African-American, and 2 percent are Asian-American. 2016 plans and prices will be available by late October – visit www.healthcare. gov. In a preview, Health and Human Services Secretary Sylvia M. Burwell said the upcoming open enrollment will be “tougher” than last year.

“But while those remaining uninsured may be harder to reach, we’re working smarter to reach them,” Burwell said. Between October 2013 and Sept. 12, 2015: 2.6 million African-American adults gained coverage, a 10.3 percent drop; 4 million Latino adults gained coverage, an 11.5 percent drop; and 7.4 million white adults gained coverage, a 6 percent drop. “Five years in, millions of people have new coverage and the percentage of the uninsured has been reduced to the lowest level on record,” Burwell said.

3 indicted in DeKalb, GWCC bribery case 850 part-time warehouse Anthony Lepore, John Rife and Brian Domalik, all former employees of a janitorial services company, have been indicted on charges that they conspired to bribe Patrick Jackson, a public official employed by DeKalb County and the Georgia World Congress Center, in exchange for favorable treatment on contracts between their company and the two government entities. Lepore, 63, of Birmingham; Rife, 65, of Cumming; and Domalik, 47, of Kennesaw were named in a 10-count indictment charging them with conspiracy to commit honest services mail fraud on Oct. 13. U.S. Attorney John Horn said the indictment “reaches to the very top suites of the company, charging complicity in the bribery at the highest levels.” “These defendants are charged with circumventing the government contracting process by bribing a corrupt public official who was willing to put his own interests above those of the taxpayers he served,” he said. According to Horn, the charges and other information presented in court: Lepore was president and CEO of Rite Way Services Inc., an Alabama-based company that sought to do business with DeKalb government and the GWCC. Rife was the regional vice president, and Domalik, who came to work for the company in 2010, was the division

manager, both working out of the Norcross facility. The indictment alleges the defendants through Rite Way conspired to bribe Jackson by facilitating payments to provide Jackson with a furnished luxury apartment in Atlanta. Jackson, 55, of Loganville was simultaneously employed by DeKalb and the GWCC as manager of janitorial services from 2006-2012. He did not disclose to either employer that Rite Way, which obtained contracts with both entities during his employment, was paying for an apartment where he resided. In exchange for the apartment, he used his position to help the company secure contracts with DeKalb and GWCC and to benefit its interests throughout the course of the contracts. Jackson and another former employee of Rite Way, Cecil K. Clark, 55, of Jonesboro, who participated in the scheme have pleaded guilty. Jackson was sentenced on Aug. 12, 2015, by U.S. District Judge William S. Duffey Jr. to four years, three months in federal prison and ordered to pay restitution to DeKalb and GWCC. State seeks input on proposed computer science courses The State Board of Education has posted standards for three new computer science courses for public review and comment. The questionnaire is available for the 60day comment period at http://secc.sedl.org/ ga_pathways. The courses, proposed on Sept. 25, are all part of the Information Technology Career Cluster Pathway. If approved, students in any of the proposed courses – Embedded Computing, Web Development, and Game Design: Animation and Simulation – would be eligible to receive a core math, science, or foreign language credit. In August 2014, Gov. Nathan Deal recommended that the State Board of Education

allow students to take a computer programming course to satisfy one of three core requirements for receiving a high school diploma – math, science, or foreign language. Students already have access to five computer science courses that can replace a fourth math, science or foreign language credit; if approved, the courses currently posted for comment would bring the total to eight. State School Superintendent Richard Woods said computer science and programming are needed in Georgia’s public schools. “Skilled programmers, software developers, and engineers are in demand in Georgia, but without a pipeline of skilled workers to

fill those jobs, businesses will look outside Georgia to find the employees they need,” Woods said. “These computer science courses, which have been developed with involvement from industry representatives in related fields, give Georgia students more chances to develop their knowledge and skills in this fast- Richard Woods growing field.” Each course was developed collaboratively by k-12 teachers, post-secondary educators, and industry representatives.
