C

reating jobs and increasing business opportunities in southeast Colorado Springs is one goal of a bill that is also designed to reduce crime in the area of the city that seems left behind in the current economic renaissance. House Bill 17-1326, which goes into effect Aug. 9, will potentially offer $5.8 million over a threeyear period for small business loans and grants in southeast Colorado Springs and north Aurora near Denver. Money will be divided equally between the two economically challenged areas. “The loans will be for someone who wants to start a new business or has an existing business they want to grow,” said state Sen. Bob Gardner, who represents District 12, which includes southeast Colorado Springs. “A grant would be for a community investment, a nonprofit or government entity that has a vision for creating jobs or improving

conditions in the southeast corridor to help reduce crime.” The bill, named the “Justice Reinvestment Crime Prevention Initiative,” is the brainchild of Christie Donner, who is founder and executive director of the Colorado Criminal Justice Reform Coalition. “I think this model can be incredibly successful,” Donner said. “I’ve talked to business leaders and politicians, and people are jazzed.” Prime sponsors in the Senate were Gardner and Dan Kagan of Aurora while Rep. Pete Lee of Colorado Springs sponsored it in the House. Other legislative sponsors included Sen. Mike Merrifield and Rep. Tony Exum, both of Colorado Springs. The bill allocates $4 million, with another $1.8 million to be added if a review in January determines the program is beneficial. The Colorado Department of Local Affairs will oversee the small business loan program and the crime prevention grant program.

Funding is scheduled for three years, with a sunset review by the legislature in 2020. The money was shifted from the Department of Corrections, as the DOC’s budget was reduced thanks to a series of parole reforms, which included decreasing prison time for technical parole violators from up to 180 days to between 30 and 90 days. Donner said it costs about $35,000 a year to incarcerate one prisoner, roughly $96 a day. “Every bill has a fiscal note, and this one said it will affect approximately 1,200 people a year — all of them from non-violent crimes,” Donner said. The idea, said both Gardner and Donner, is that by providing more jobs and economic opportunity, there will be a reduction in crime. “We’re attacking the problem at the root by going into that community and trying to create thriving small businesses and employment opportunities,” See Southeast page 19

hile Colorado Springs waits for the 29th consecutive year to see what will happen next in the saga of Banning Lewis Ranch, the area surrounding the 20,000-acre parcel owned by Nor’wood Development Group is hopping with homebuilding activity. The building boom is going on around the parcel, and includes a community center operated by the YMCA of the Pikes Peak region and a charter academy, both of which draw new homeowners to the area. Since Banning Lewis Ranch was annexed by the city in 1988, the majority of the sprawling prairie has remained

untouched. That inactivity has been largely attributed to the stringent terms of the annexation agreement, which stipulates that the developer of the land is responsible for assets such as infrastructure and emergency service facilities. But despite the continued stalemate between city and developer — in this case, Nor’wood Development, which purchased 18,500 acres of the former ranch in 2014 from Ultra Petroleum — neighborhoods in the vicinity of BLR continue to grow like a wildfire fanned by an increasingly hot local real estate market. L

ast weekend, the nation was treated to a video tweeted by both the official White House account and Donald Trump’s personal Twitter feed. The subject: a doctored video filmed a decade ago when Trump was a regular on World Wrestling Entertainment. The WWE video originally had him fighting owner Steve McMahon, but was changed to show him taking on CNN. As a free speech exercise, it was demeaning both to the presidency and the national discourse. It’s disturbing to see and hear the negative tone from the White House, the name-calling, the backstabbing, the omnipresent “fake news” accusations every time there’s a news story the president doesn’t like. We just celebrated the nation’s birthday on Tuesday. And we enjoyed backyard barbecues and fireworks shows while one of the nation’s founding pillars is under attack at the highest levels of government. There is fake news out there: InfoWars pushing a story claiming there are pedophile rings on Mars is just the latest — and one of the most ridiculous. (PizzaGate, also propagated by InfoWars, led to a man’s arrest when he drove from North Carolina to Washington, D.C., to break up a child molestation ring operating out of a pizza parlor. The story was false, as are stories about the Sandy Hook shooting

being faked to promote gun control laws.) This dialogue isn’t productive; it’s not good for the country; it dumbs down the presidency and only feeds the national cable news frenzy. And there’s a real danger that this level of negative dialogue and media mistrust can filter down into local politics and those who cover it. If you don’t like the way a story is covered, that doesn’t mean it’s not factual. If a media commentator says or prints something you disagree with, that doesn’t make it fake. The constant undermining of the Fourth Estate weakens democracy. It’s not what we need here in Colorado Springs. We’ve seen what backbiting between mayor and city council does to the economy, business growth, the city’s reputation across the state and the nation. For now, those arguments and disagreements seem to be behind us. Let’s work to keep it that way. If we can find common ground even with people we disagree with, we should find it. And if we can keep the disagreements civil and respectful, then the conversations will be more productive. No matter what the conversation sounds like at the national level, Colorado Springs is better than that. We might have disagreements with friends and neighbors, business contacts and community leaders — and the news media — but there’s more that brings us together than divides us. With major issues still to be resolved, it’s time for a reminder that we want what’s best for the city. The media’s job is to cover those issues and how they are being addressed. Our job is to reflect the community we cover. If you think the news is negative, community leaders, business owners and politicians should work to change the community. Negative conversations, finger-pointing and name-calling — and claiming fake news at every turn — won’t solve problems. Collaboration, honest dialogue and compromise will. CSBJ n

Flemke Center a most appropriate name

O

n July 11, Junior Achievement of Southern Colorado will dedicate its building on West Colorado Avenue, naming it the Karl & Mary Flemke Center for Free Enterprise. The name couldn’t be more appropriate. Karl and Mary were key Colorado Springs community leaders in the last quarter of the 20th century, guiding major private educational nonprofits. Without Karl, Junior Achievement wouldn’t have moved its national headquarters to Colorado Springs in 1987. Without Mary’s leadership in the tumultuous years from 1989-2000, the Colorado Springs School might not have survived and thrived. Born in Connecticut in 1931, Karl joined Junior Achievement in 1958 as executive director in New Bedford, Mass., the same year that he and Mary were wed. His decision-making skills were evident in both choices. Their happy marriage lasted a lifetime, and he stayed with JA for his entire career, becoming national president and CEO in 1982. Karl was responsible for moving Junior Achievement’s national headquarters from Stamford, Conn., to Colorado Springs three decades ago. “I went out to New York to make a presentation,” recalled El Pomar CEO Bill Hybl. “Karl was the decision maker and he was receptive to coming to Colorado Springs, even though he was from the Northeast. Dave Sunderland gave them the site [for their headquarters], Pete Coors was helpful and El Pomar was involved as well.” The move was transformational for Colorado Springs. “It really put Colorado Springs on the map for national nonprofits,” Hybl said. “It brought us to a whole new level. For example, Dinah Shore was on the JA board, and we hosted the Dinah Shore International

Golf Tournament for several years, which brought people here from all over the country.” Founded in 1919 in Springfield, Mass. as the Boys’ and Girls’ Bureau of the Eastern States League, JA’s original purpose was to educate kids moving from the country to the then-booming cities of the industrial Northeast about free enterprise. That model quickly expanded into HAZLEHURST today’s volunteer-driven economic education model, which took root nationwide. Under Karl’s leadership, JA became the largest economic education program in the world, quadrupling in size. Karl initiated then-innovative, K-12, in-school JA programs and oversaw expansion of the organization to 80 countries. JA first came to Colorado Springs in 1954. Its purpose, according to the local organization’s website, “has been to educate and inspire young people to value free enterprise and understand business and economics.” Although Karl’s career required frequent moves, Mary somehow managed to raise three kids, get degrees at three separate colleges and forge a career of her own. She worked as an administrator at an inner-city Los Angeles school and supervised gifted and early childhood special education programs for the Danbury, Conn., school district. Two years after moving to Colorado Springs, Mary took a job as head of the Colorado Springs School, where she would stay until 2000.

“She was so supportive and a great partner,” said daughter Ellen Clark. “She brings out the best in people. She had a great management team, and she wasn’t afraid to make tough decisions. They decided to close the boarding program at the school. “Although it was generating revenue, there were some disciplinary issues, and Mary just thought that it was no longer appropriate. She also added a pre-K program.” In 1994, tragedy struck. On June 22, five days after his 63rd birthday, Karl died of a heart attack. The family was devastated — but Mary carried on. “She didn’t crumble,” said Ellen Clark. “She didn’t let up. ‘I had the best marriage in the world,’ she told me, but she knew that she had to be strong for us.” And that strength extended to the Colorado Springs community. “Mary and Karl were very, very active in the community, and not only for their own nonprofits,” said Hybl. “Particularly Mary, because she came to see me frequently on behalf of other organizations. She was an effective advocate!” Looking at a partial list of the couple’s charitable/ nonprofit involvement is both inspiring and dismaying. Inspiring, because it records lives well spent; dismaying, because few of us have the energy, intelligence and generosity to achieve such goals. But while we may not be able to match their achievements or their energy, we can support their goals to the best of our abilities. CSBJ

Woodland Park must balance growth, resources By Ashleigh Hollowell

E

conomic growth and increased real estate demand have been common themes in Woodland Park for several years, and local officials say they show no signs of slowing down. Although increased economic prosperity has been welcome in the small mountain town, too much growth in the near future could present a problem due to the city’s limited housing inventory and water supply. “Woodland Park does have a finite amount of development that will occur based on our water,” said Sally Riley, the city’s planning director. “We have been — Debbie watching our land use and vacant lot supply. ... Our water supply will accommodate 12,600 people.” Riley, who said Woodland Park, with about 7,200 residents as of 2014, is at about 60 percent build-out, added that the city has options for obtaining additional water if rapid growth continues.

real estate activity and construction of new apartments, like the Trail Ridge development on the south end of town, have been exciting for the community, said Debbie Miller, president of the Woodland Park Chamber of Commerce. “We have certainly seen growth in our sales tax numbers over the last several years,” Miller said. “Most of our other businesses have stayed stable.” A number of new small businesses have popped up around the city in recent years, including the Woodland Butcher Block and Centennial State Paint Center. “It’s a smaller market that is growing, and it’s pretty dynamic. It’s quite affluent,” said Matt Miller Gantner, co-owner of Centennial State Paint Center. “With our business, in larger markets it is difficult for an independent owner to compete with corporate stores. Generally, even if there are corporate stores in smaller markets,[the markets] still tend to be favorable to smaller businesses.” Centennial State Paint Center opened June 26, and Gantner is confident Woodland Park will be a successful place to operate. “For the size of the city, it is growing quite well,” he said. “At this elevation the elements are very hard on people’s homes, so they need to paint them often, and we’re here for that.” The Planning and Building

Department has also seen an increase in requests and questions regarding potential new businesses and projects in the city, Riley said. “We get inquiries quite frequently for new businesses and projects,” she said. “We are processing a couple of projects in Woodland Park and we also have a few projects under construction.” Some projects stand out, Riley said, including an automated car wash to be located adjacent to the Rocky Mountain Dinosaur Resource Center. It will not only bring more business but will improve traffic flow as well, she said. “The owner is also going to complete a small segment of Pikes Peak Avenue which will connect with [U.S.] Highway 24,” Riley said. “It was an opportunity identified in our traffic analysis ... how to disperse traffic within Woodland Park to make it less concentrated on Highway 24.” The other projects are a new 63-room

hotel, a Wyndham project, that would be located north of the Country Lodge, as well as a possible 13,222-square-foot Natural Grocers. Woodland Park is also working on projects to address affordable housing. The Clock Tower Condominiums is a Habitat for Humanity project that will house nine families. The other is a 24unit apartment complex located off Colorado Highway 67, which is subsidized through tax credits. Due to rapid growth, the Woodland Park Chamber of Commerce has offered training to help local businesses succeed in the booming market. “We’re trying to help our current businesses look at different types of training to stay on the cutting edge — like digital marketing, grant writing and across-the-board kinds of training that employers will need to stay on top of their game,” Miller said. “We believe it will be successful.” CSBJ n

Mayors Panel topics: Cooperation, shared issues

olorado Springs has what Mayor John Suthers terms “monumental fi nancial problems,” including finding a way to pay for stormwater infrastructure without affecting city services like police and fire. That’s one reason he says he enjoys participating in the Colorado Springs Business Journal’s annual Mayors Panel, a forum discussion S W E E T with mayors from across the Pikes Peak region. This year, Pueblo City Council President Steve Nawrocki will also be present. Manitou Springs Mayor Nicole Nicoletta says that her city is also struggling with infrastructure. “That’s our main priority now,” she said. “We’re working on bridge repair. Fortunately, we have the money to do almost everything we need to do.” Smaller towns have smaller issues, Suthers said, but that doesn’t mean Colorado Springs should act on its own without regard for its neighbors. “On the other hand, we are a region, economically interlinked,” he said. “I just took a tour of the South Slope of Pikes Peak, which we opened three years ago for recreation. I drove back through Victor, Cripple Creek, Woodland Park. There was so much traffic in Woodland Park, people trying to get to the mountains, stopping to buy doughnuts. We are all in the same boat as far as tourism, as far as promotion. Hughes thrives in hospitality industry By Ashleigh Hollowell

B

eing raised in an Army family has been one of several things that shaped Shanna Hughes’ career in the hospitality industry over the past 20 years. Now, as the director of catering at Cheyenne Mountain Resort, Hughes is grateful for that background, and for a good friend, her mother and her two children who helped her succeed. “My dad was a stickler for detail, which is part of that military background and influence. It is very important to me to ensure I cross the t’s and dot the i’s and make sure my clients know I’m there for them,” she said. “What an honor to serve people.” Hughes was born at Fort Carson and graduated from Widefield High School. After graduation, she married and lived in Greece and England before returning in 2000 to take care of her disabled mother. After a divorce and the end of the deejay business she and her former husband owned, Hughes started working at a local call center and was unsure what direction she wanted to take next. She then received a call from a friend who offered her a position at the DoubleTree by Hilton. Hughes worked at the DoubleTree for 15 years. “I started noticing that I felt like I wasn’t learning anymore because I had been there for so long,” she said. “I just needed to be challenged.” In 2015, Hughes accepted a position at Cheyenne Mountain Resort. It was a step down from her DoubleTree job at the time, but she knew it was the right choice. Hughes turns 50 this month and plans on maintaining the goal of continually learning. What do you like most about your job? I would have to say the ability to continuously learn. It is ever-changing. If you stagnate, you don’t get to stagnate long. There’s always something else or somewhere else you can go. I’ve had a wonderful, very successful career. People don’t realize what an honor it is to work here. It’s a great company and, best of all, I’m learning again. What are you currently working on at Cheyenne Mountain Resort? We’re right in the heart of wedding season, but weddings have been down in Colorado Springs for about two years, so we’re coming up with new strategies for 2018 and starting earlier than we probably normally would. So far, is seems to be paying off. We’re also working on revamping our wedding process and how we can give our brides here a beautiful experience. We’re working on some different things to enhance that. What characteristics of professionalism do you value most? I think the biggest thing is honesty. I truly love very candid people. I feel that you get nowhere sugarcoating things. I understand people don’t want to hurt your feelings, but that doesn’t give you the true picture, and then you don’t know how to fix the problem. You spend more time tiptoeing around something instead of working on it. I value the honesty I share with my team, and the honesty I receive from my team. ... We’re all a work in progress. Has Colorado Springs been a good place to develop your career? Yes, Colorado Springs with the big box houses — that’s what we call the bigger hotels — there are only five or six here, so it is the perfect opportunity to learn. I spent a small part of my career in Dallas, which has hundreds of hotels. It was challenging, but the training I received here allowed me to be successful there. This industry in this town is known for that. What advice would you give to other professionals? Don’t listen to all the white noise. I do sales and that noise can cloud that we have a job to do and goal to reach. Whatever goals you try to reach, push forward with everything you have. Don’t let the noise get in your head. CSBJ

Covington is one of three homebuilders currently working in the current Banning Lewis Ranch development, which is spearheaded by regional developer Oakwood Homes. As demand has grown for housing in the suburban areas of Colorado Springs, Oakwood has maintained a close eye on the market — investing in communities where it sees opportunities. “I have also seen an improvement at Banning just simply for the fact that Oakwood is putting more resources and more effort into the community,” Covington said. There have been 276 permits pulled for new residential construction at the development in the past 12 months, according to records from the Pikes Peak Regional Building Department. That development is symbolic of the more than a thousand homes being built in and around Banning Lewis Ranch. Many of those have been Covington’s. “We’ve always believed in the project and felt that it was a really good project,” said Covington. Lewis is Colorado Springs-based Classic Homes, which started work at the development in May 2007. And company President Joe Loidolt said it has been a good decade. “Since breaking ground in 2007, Classic Homes has built 252 homes in Banning Lewis Ranch and we currently have 18 under construction,” he said. “Banning Lewis Ranch represents 10-11 [percent] of Classic’s total homes built.” Loidolt said the company’s BLR operations have been on a steady increase since the days of the Great Recession. Classic sold 44 homes in the development last year — a 30-percent increase over the 31 it sold in 2015 — and is on pace to complete 45 sales in 2017, according to Loidolt. When Nor’wood finally begins development on its land, Loidolt said it will be a boon for Classic and other homebuilders in line to meet a growing demand for suburban housing in and around Colorado Springs. “We will be interested in building in the Nor’wood-owned portion also,” he said. The exact future of Banning Lewis Ranch is unclear, but the tone of developers and homebuilders has been growing increasingly optimistic. Nor’wood is currently in the midst of master-planning its future housing communities at the site, and the city indicated late last year that there might soon be a modification to the annexation agreement that might incentivize its development. Springs Technology is a family affair By Bryan Grossman

M

ike and Leanne Schmidt’s partnership isn’t limited to business. The young professionals married in 2011 while Mike was working for Microsoft in Leanne’s hometown of Seattle, Wash. Mike was employed in software development, and he and his new bride moved to Austin, Texas, and started a business with Mike’s former boss before making their way to Colorado Springs. Mike had once called the Springs home thanks to his father, who was stationed here while serving in the U.S. Air Force. It was here the two eventually launched Springs Technology, a managed services provider, and welcomed their daughter, Cora. Today, Leanne provides all the administrative services, networking and client relations, while Mike primarily works in the field, keeping networks running. Leanne spoke with the Business Journal this week about her family, her business and how Colorado Springs — and pot roast — have grown on her. What’s your background. I’m from Washington. I met my husband there and we were married in 2011. We promptly agreed we didn’t want to establish ourselves in Seattle because of the weather, the traffic and the cost of living. His boss from his time at Microsoft was working in Austin, and there was an opportunity to do software development as a fulltime job, live near his former boss and see if we could spin up a managed IT services company. … We moved to Austin … and became partners in 2012. There we found a large biopharmaceutical company out of San Francisco looking for a gun for hire. That gave us all the full-time work we needed to be able to leave Austin whenever we wanted. In the summer of 2014 we came here — because there are no mountains in Austin. How has your business grown? We saw the writing on the wall with the biopharmaceutical company. They were taking what we were doing and outsourcing it. We worked on finding more business here, but it was a slow process. By the end of 2015, our partner had his own ideas for growth, and it

was time to separate. There were no delusions. We’d been here a year networking, trying to find business. Nobody was clamoring to sign up for IT services, but we really wanted to continue on our own. In 2016, it was all about us doing this — just the two of us. By the end of 2016 we were profitable and, here we are in 2017, trying to see if we can grow. Do you have a business background? Sort of. I don’t have a business degree or a college degree. My primary training was piano performance and piano education. All through high school I taught piano, played piano — that was my passion. In 2005, I took over a full-time studio with 50 students in a tiny town in eastern Washington. I did that for a couple years and was successful and growing it. But I realized after a year that this was the top of the corporate ladder. So in 2007 I closed shop and found a job doing office management and finance back in Seattle. I also took a retail job at Starbucks and discovered I could be really good at sales, but there was no payout benefit. … I then took a job in commission-only sales selling business training. Do you think of yourself as an entrepreneur? I have an entrepreneurial bug, and I blame my grandparents and my aunt. My grandfather got out of his service after World War II. He took over a cabinet shop that’s now being passed on to his grandson. … My aunt started at a business in Seattle, a direct mail house, where she was just a receptionist. She moved up to own the company. How do you find clients? Everyone wants to know how people find clients so they can duplicate the process, but our process has been really random. A year ago we presented at 1 Million Cups and there happened to be someone in the audience who had an app idea she wanted developed. I’m also part of the [Business Network International]. As networking groups go, one good thing is it fosters really deep relationships. The key is people getting to know and trust you. But for you to try a new IT provider, and let me into your system and passwords and your computers — people stay with bad IT providers for a long time. It’s like a bad dating relationship; at least it’s familiar. Change is so painful. CSBJ n

Changing times mean changing workplace laws By Bryan Grossman

A

new U.S. administration. A Colorado minimum wage hike. Facebook posts. Breastfeeding. Marijuana. Those were a few of the topics discussed last week by Michelle Jacobsen, director of the Mountain States Employers Council’s Colorado Springs office. Jacobsen was a guest speaker at an event sponsored by the Colorado Springs Chamber of Commerce & EDC to discuss rapidly changing — and sometimes obscure — employment law affecting local business owners.

DEPARTMENT OF LABOR CHANGES “With this last election, there is a new administration, and with a new administration we get new interpretations of regulations,” Jacobsen said. One of the new administration’s fi rst actions under Secretary of Labor Alexander Acosta was to withdraw guidance letters about independent contractors and joint employment. In 2015-16 the Department of Labor issued informal guidance letters to give businesses an understanding of how the DOL was going to enforce actions regarding independent contractors and joint employment. Those guidance letters have been withdrawn and left more room for interpretation, Jacobsen said. The DOL has also committed to aggressively confront businesses committing visa program fraud or abuse.

FEDERAL OVERTIME RULES The DOL, under the Obama administration, put in place a plan to change the way businesses compute overtime, raising the exemption level from $23,000 now to about $47,000. The regulation was to go into effect last December. A U.S. District Court judge out of

Texas put an injunction on the overtime rules after 21 states filed a claim against the DOL, she said. The DOL has filed an appeal, asked for an extension and may ask for an additional extension by the end of the summer.

STATE MINIMUM WAGE INCREASE Amendment 70 passed in November, meaning a new minimum wage in Colorado went into effect this year. The minimum wage increased from $8.31 an hour to $9.30 an hour and will go up every year by 90 cents until Jan. 1, 2020, when it will be $12 an hour. The state will continue to adjust the minimum wage annually based on the Consumer Price Index. Tipped employees will make a minimum of $6.28 an hour. “If your employees are covered by the Colorado Minimum Wage Order or if they’re covered by the Fair Labor Standards Act, they get minimum wage. The exceptions are limited,” Jacobsen said. “Agriculture might have employees not covered by the Fair Labor Standards Act.”

MEDICAL ISSUES Due to an executive order filed under the Obama administration, federal contractors receive mandated sick time, and that is still in effect,” Jacobsen said. “Trump hasn’t repealed it, and it doesn’t look like he’s going to,” she said. “And, exciting news — the federal government is considering a proposal that would allow private sector employers to offer comp time.”

Jacobsen said federal law currently only allows public-sector employers to provide compensatory time instead of overtime pay. The proposal is called the Working Families Flexibility Act of 2017 and would allow non-union, private employers to provide comp time in lieu of overtime. The program would be voluntary for the employer, and there would be a maximum accrual of 160 hours per employee. Employers would have to pay cash at end of each year or at the end of employment if comp time is not used. The bill passed the House in May and was sent to the Senate for consideration. “Right now it’s not clear if it will have legs,” Jacobsen said.

FMLA ISSUES Under the Family Medical Leave Act, employees can have up to 12 weeks unpaid leave per year for their own serious health condition or that of a family member. “What often happens is the employee’s condition lasts for more than 12 weeks, but it’s not permanent,” Jacobsen said. “Maybe they can come back, but only part-time, or they can come back in 16 weeks or 18 weeks.” Jacobsen said many employers think they can terminate the employee at the end of the 12 weeks. “That’s actually not the case. … That’s where you cross over into [Americans with Disabilities Act] land, and you want to engage in the interactive process with the employee and figure out if that extension of leave is a reasonable accommodation.” Employee handbook language indicating a hard

There were about 250 claims in 2016 because websites were not ADA accessible, compared to only “a handful” of claims in 2013. Those were typically filed by users with low vision, Jacobsen said. According to the Department of Justice, any website offering goods and services to consumers, even those without a physical location, constitutes places of public accommodation. Jacobsen said, if recruiting online, it could pose a problem with the Equal Opportunity Employment Commission, as well as the ADA.

DRUG TESTING Seven states and Washington, D.C., allow recreational marijuana use and 29 states allow medicinal marijuana. Colorado allows both. “Private employers can still drug test, but our employers are having a harder time finding employees who can actually pass a drug test,” Jacobsen said. “And it’s not just industries people typically think of. “I will tell you that if you’re an employer in, say, manufacturing and you pay $10 or $11 an hour and you want to test, good luck.” Jacobsen said marijuana and drug tests are affecting employees at all levels and across all industries. Companies that conduct drug testing should consider why they are taking on the additional expense. Some companies test because they are a federal contractor, or may have obligations to federal agencies, like the Department of Transportation. Some test because they can get lower premiums on insurance. “But what are you going to do if it’s your favorite employee who fails a drug test?” she said. She said to also consider the method of testing. The Department of Transportation only allows hair follicle or urine tests, while mouth swabs detecting more recent use are becoming more prominent in some workplaces. “The science on those is still somewhat mixed,” she said. When business owners’ beliefs collide with customer rights By Cameron Moix and Amy Gillentine Sweet

W

hile other states still struggle with defining workplace discrimination protections for lesbian, gay, bisexual, transgender and queer or questioning Americans, Colorado’s Legislature settled the issue and made it clear: Gender identification and sexual orientation can’t be considered as reasons to fire — or not hire — Coloradans. But that doesn’t mean all issues surrounding the LGBTQ+ community and businesses are settled. At least one large issue is still in the courts. Can a business turn away customers based on their sexual orientation or gender identity? In a Colorado case that’s going before the Supreme Court, one business owner says it’s his right — based on artistic license and the First Amendment — to turn away clients. The case: The owner of Masterpiece Cakeshop in Lakewood says he shouldn’t have to make a cake for a same-sex wedding. The clients sued and the case has been wending its way through the courts. The Supreme Court has agreed to hear the case, says attorney Eric Kniffin with Colorado Springs law firm Lewis Roca Rothgerber Christie.

“First, what sort of activity is covered by the public accommodation statute? Secondly, are there First Amendment rights at play here? And third, are there religious liberty rights that provide an exemption for a Christian business owner? What does public accommodation law cover? Everyone knows it covers denial of service at a lunch counter, refusal to rent a hotel room to someone,” he said. “No one disputes that.” Kniffin said bakery owner Jack Phillips says it’s a violation of his First Amendment rights to force him to make a cake. “The First Amendment says the government cannot compel us to attend a political parade; it can’t make us make certain statements,” he said. “The question is how far does that reach? And there are exemptions to public accommodation laws for artists. No one can demand an artist paint a picture of someone kicking a dog, for instance. No one can force a writer to put words together to create something that is in opposition to their beliefs. In some professions, you don’t have to take business that goes against your beliefs. And in the case of Masterpiece, Jack Phillips is arguing that he is an artist. He doesn’t churn out cakes. He creates them.” Phillips has done business with LGBTQ clients in the

past, Kniffin said. “There’s also the question of what counts as discrimination,” he added. “Phillips says, ‘I serve gay people all the time. I’m refusing to participate in a ceremony that has religious significance to me.’ Does that count as discrimination?” For instance, the bakery doesn’t make Halloween cakes, won’t make cakes with anti-American themes and won’t do adult-themed cakes for bachelor or bachelorette parties. The unresolved questions lead to conflicts, Kniffin said. “These are big issues,” he said. “There’s a huge conflict between civil rights based on sexual orientation and religious freedom. We’re headed toward a big showdown.” But LGBTQ advocates say there shouldn’t be a conflict — it’s a matter of diversity. “I think there is a trend where even businesses now are saying that [LGBTQ+] folks need protection,” said Daniel Ramos, executive director of LGBTQ advocacy group One Colorado. “Businesses should be focused on a diverse workforce, and the best way to do that is ensure that they live in states where they are protected.”

OTHER STATES The appeals courts in three states — including Colorado — have heard similar cases about businesses denying service to gay couples. All of them involve same-sex marriages. In New Mexico, a photographer refused to take photos at a samesex wedding, and in Washington a florist refused to design the floral arrangements. “In all three cases, the courts pooh-poohed the idea that this was creative expression,” Kniffin said. “It’s just a cake, some pictures, flowers for the wedding. That isn’t artistic expression.” But in Kentucky, the courts ruled differently. In that case, a customer wanted T-shirts with a positive message for the Pride parade. And the court agreed with the business. “I think the difference is that [it] is speech,” he said. “The T-shirt clearly was speech. He has the right, just like I do as a lawyer, to decline to put certain words together. In issues that are clearly speech and words, businesses can’t be compelled to participate under public accommodation law.”

ANTI-DISCRIMINATION The Colorado General Assembly passed four bills during the past decade that work together to prevent discrimination based on sexual orientation and/or gender identity. For a state once known as the “hate state” for a constitutional amendment that prohibited homosexual or bisex-

ual people from claiming minority or protected status, Colorado’s come a long way, according to LGBTQ+ advocates. “In Colorado, we passed Senate Bill 200 back in 2008, which prohibited discrimination in places of public accommodation,” Ramos said. “Those are places like schools and hospitals, and also in terms of employment and in housing. So we were one of the earlier states to pass those laws, because in 28 states it is still legal to be fired from your job for being LGBTQ.”

BUSINESS INCLUSIVITY Businesses interested in diversity shouldn’t wait for a court case to decide how to recreate the company’s culture, Ramos said. “Businesses can put in place their own internal non-discrimination policies,” he said. “They can choose not to discriminate on the basis of gender identification or sexual orientation; they can also update their health insurance plans to ensure same-sex couples and transgender employees have access to the health care they need through their employers.” What it comes down to is “making sure [employers] are treating them like non-LGBTQ employees and that they are offering them the same benefits,” Ramos said. The Denver-based nonprofit that Ramos leads is the state’s largest and most active LGBTQ advo-

cacy organization and focuses on issues related to employment, housing, health care and education. And while he understands the importance of religious freedom under the Constitution, Ramos said that local, state and federal governments should focus on extending protections for the many Americans who need help fighting discrimination. “We believe that religious freedom is important — in fact, it’s already protected by the First Amendment of the Constitution,” he said. “I think a business owner deciding to deny a customer based on who they are is against the law and that people also have their individual freedoms of religion.” Like other states, Colorado has seen its share of proposed bills exempting businesses from anti-discrimination suits based on the owners’ religious beliefs. None have passed. “The thing that is most exciting is that we’ve seen bipartisan opposition to these bills which basically send the message that yes, religious freedom is important but already protected,” Ramos said. “These laws are unnecessary, and they would also open a can of worms in terms of our current non-discrimination laws and lawsuits.” But Kniffin says the Supreme Court might see it differently. “Religion and society have had rules about sexual morality forever,” he said. “I could see the Supreme Court being sympathetic to the argument that this is a different case than one of discriminating in other ways.” CSBJ n

NCC seeks volunteers, donations T By Helen Robinson

he National Cybersecurity Center is tapping into Colorado Springs’ reputation for pitching in, when needed, to push ahead with the building that will be the center’s permanent home. It’s a way of solving a progress-and-funding conundrum, and it takes the collaborative spirit that is the trademark of the city’s cybersecurity industry to a new level. The issue: The pace of buildout work on the 135,000-square-foot former TRW building, which will house the NCC, depends on the flow of donations and in-kind contributions — but the donation rate is unlikely to accelerate further until the NCC is occupying the building. “We have very great partners, fantastic folks who are just waiting to help,” said CEO Ed Rios. “Some of these are Fortune 100 companies that are RIOS sponsoring us because, as a nonprofit, they know we’re trying to do the right thing at the foundational grassroots levels of cybersecurity and so they want to help. But when we’re not in [the building] yet, it’s kind of hard for them to roll in with a commitment.” Rios said he expected funding to “take off in a couple of months” when the NCC has completed plans and bids, and is able

to communicate its progress to potential sponsors. Finishing the first buildout stage and having people working in the building will help significantly, he said. To speed the process, the NCC Volunteer Program was launched in June. Through the program, the NCC seeks to harness “all aspects” of local expertise, Rios said. “You know we’re going into the new facility, so we need interior designers; we need cybersecurity experts; we need architecture and network engineers — basically skill sets in any capacity that you can imagine a large corporation would require,” he said. “... We look for folks who want to provide additional capability to our community and to the NCC.” So far, more than 100 people and companies have signed on. The NCC should have the keys delivered for the initial construction in July, Rios said. The Cyber Research Education and Training Center venue would be the first stage of the buildout, expected to take three months. “Our plan is to build out training venues ... first because that’s what’s needed the most; we can answer the phone calls from anywhere else,” he said. “Then once we receive the resourcing and funding and sponsorship we’ll build the [operations] center, because although we can answer the phone from anywhere, there’s a tremendous increase in efficiency and synergy gained by bringing all that together in one place.” Rios is “pretty confident” the NCC will

have complete funding for the operations center this year, but it may not be fully operational in 2017. “In reality the operations center probably won’t be [open] till next year, and it’s not because we don’t have the need — we clearly have the need — but it’s because we don’t have the resources yet.” The NCC has raised almost $25.9 million so far, from government and private sector donations and grants. This includes: • $7.8 million from the Colorado Legislature (for building renovations only; not buildout); • $6 million from Congress through UCCS to train Army reservists; • $300,000 from philanthropic charitable organizations; • $215,000 from private individuals; • $35,000 from corporate entities; and • $11 million from in-kind contributions, including the UCCS facility. Rios said that much of the dollars are actually in-kind donations or money that went directly to UCCS to refurbish the new NCC home on North Nevada. The NCC’s total grant request to date is about $1.125 million, Rios said. They — Ed Rios expect to acquire a portion of that later this year. The NCC’s new sources of revenue include its events and programs, including training, he said. Additional new revenue will come from the NCC’s subscription model, to be launched late summer. “A philanthropic donation and another corporate donation have recently provided a new influx of cash to help us continue to provide capability while growing,” Rios said in an email. “We are also now approved as an El Paso County Enterprise Zone Contribution Project, which is something we are proud of.” El Paso County provides a 25 percent state income tax credit for contributions to nonprofits that make improvements in its enterprise zones, those areas of the city and county deemed to need both jobs and infrastructure improvements. There is no solid figure for the money

the NCC has in hand for the buildout, Rios said, “because the amount of cash available for buildout depends on timing of our building occupancy. Also, much of the buildout will be done through corporate in-kind equipment donation so money is not exchanged. Instead it’s a donation to our 501(c)3 nonprofit and El Paso Enterprise Zone initiative.” Also unknown is the total cost for all buildout stages, because the NCC is still negotiating tenant improvement contracts and lease terms for the building. “Since a lot of it may be provided in-kind by equipment donation, for our server room or cyber threat information-sharing operations center as examples, it’s hard to know a total amount of funding required,” Rios said in an email. “We should have the cost finalized before the end of this year.” Also in June, the NCC launched a Ph.D.level fellowship program, in which fellows work on protracted research projects to address specific problems. The projects last six to 12 months and are funded by specific research and education grants or corporate grants, Rios said. The NCC has started the fellowship program with three students from UCCS and intends to expand it to other institutions and organizations. Already there is a list of six projects requiring intensive research, in various stages of development. The fellowship program is “exploring many topics, ranging from the cybersecurity of voting machines, to automating processes from a technical sharing standpoint ... down through an automated notification on your smartphone that would say, ‘Hey, you have a cyber problem,’” Rios said. “Those types of things don’t exist yet so they’re very, very hard to do, so we put that into our Ph.D. fellowship programs.” In May, the NCC also launched an internship program. Southeast: State grants could generate job growth From page 1

Gardner said. “We’ll be interested to see if we can make a difference; we believe we can. We know that thriving communities help hold crime at bay.” Taj Stokes, co-founder and executive director of Thrive! Colorado Springs, which promotes and trains entrepreneurs to benefit the southeast sector, called the bill “brilliant and groundbreaking.” “Economic development is a crucial component in reducing recidivism,” said Stokes, who rose from poverty and made positive choices with help from mentors. “I do believe the bill will work.”

SMALL BUSINESS, BIG DREAM Donner asked Stokes to testify before the state House and Senate before legislators voted on the bill. Stokes told them stories that brought a human element to economics and talked about how to change neighborhoods for the better. One of those success stories involves Melissa Chapman, the inaugural winner of the Southeast Business Plan Competition, a project sponsored by the Colorado Springs Business Journal, the Colorado Springs Independent and Thrive! Colorado Springs. She won a $50,000 prize package that enabled her to open Melissa’s Hair Therapy at 1726 S. Academy Blvd. earlier this year.

The competition’s intent was to provide an entrepreneur with resources to start a business, with the stipulation that it be located in the southeast sector of the city. Chapman, a hairdresser for 22 years, said her business is doing well and she’s learning to deal with added responsibility. “I’m steering the ship now,” she said, “and I’m anxious to try new ideas.” She recently hired a new employee, and has another ready to start. She said the southeast area is ripe for new businesses. “We’ve got all this new buildout down here and on the other side of Union [Boulevard],” she said. “We’ve got old meeting new. Little shopping centers like this are going to become a hub for the neighborhoods. It feels like it’s primed for growth — maybe not new, but revitalized.” The southeast sector — especially along South Academy Boulevard — needs a facelift. According to data compiled for the city of Colorado Springs by Turner Commercial Research, vacancy rates in 2016 for shopping center and office space in the Academy corridor (16 percent) were more than twice the rates for the greater metro area (7.6 percent). According to the city’s South Academy Economic Opportunity Zone Action Plan, crime rates (measured on a per capita basis) were 30 to 50 percent higher than the city average.

Stokes, a self-professed “straight-up idealist” who lives in the southeast part of the Springs, thinks the area can improve. “I think this bill will help business tremendously,” Stokes said. “It’s a good connection point for CDFIs [Community Development Financial Institutions] to work with existing businesses, and that could make a huge impact.” Of the initial $2 million targeted by HB-1326 for the southeast, $1.5 million is set aside for grants and $500,000 for small business loans. The loans, maxed at $50,000 with a five-year payback, will offer fixed and reasonable interest rates and no penalty for early payback.

The bill asks for input from the private sector and wants communities to identify priorities and solutions. By Sept. 10, DOLA [Department of Local Affairs] will hire a CDFI to disperse loans and a community foundation to manage grant proposals. A local planning team will determine geographical boundaries affected by the bill. Nonprofits, local governments and schools are eligible to apply for grant funds. “There is a lot of excitement around the country and people are watching to see how this works,” Donner said. “The business development side of this is of particular interest to a lot of folks.” CSBJ n

Financial CHOICE Act could boost economy F inancial laws and regulations may seem too complex and removed to have any impact on everyday life. But every American who has money in a checking or savings account, works for a small business or pays taxes has been affected by the faulty regulations put forward in DoddFrank, a law passed by Congress in the wake of the financial crisis. L A M B O R N The Financial CHOICE Act is a response to Dodd-Frank designed to help boost our economy and protect consumers from future financial meltdowns, and I was very pleased to support this bill. Here are five ways that this new legislation could benefit your life:

• Creating more available capital for small businesses Any startup or small business needs access to capital in order to expand its operations. But the passage of Dodd-Frank made it more difficult and more costly for small banks to give loans. The Financial CHOICE Act removes the expensive mandates from Dodd-Frank, which is predicted to free up more capital for business owners and aspiring entrepreneurs.

• Increasing access to credit cards and checking accounts for individuals and families Under Dodd-Frank, free checking has been reduced by 50 percent. Many people have also lost the option to sign up for a credit card. When these financial options aren’t available, individuals and families have a harder time saving money, which is bad for their budget and bad for the economy as a whole. The Financial CHOICE Act will allow small banks and credit unions to expand access to credit and checking, restoring personal freedom and financial choices back to consumers across the country.

• Blocking taxpayer-funded bailouts The Financial CHOICE Act definitively ends the era of “too big to fail.” Instead of taxpayer-funded bailouts for failing firms, the CHOICE Act gives the American people protection from failing banks without holding them financially responsible. The Financial CHOICE Act is a big win for the American people. This bill brings more accountability and reliability to our financial system, allows for more choice for consumers, helps bring small businesses greater certainty and levels the playing field to help them grow and create jobs, and will help increase transparency at the Federal Reserve. I urge the Senate to quickly pass this bill so that it can have a positive impact on job growth and the economy.

• Protecting consumers — not big banks The Financial CHOICE Act imposes the harshest penalties in history on financial institutions that commit fraud and harm consumers. It also establishes a budget for financial regulations and requires a cost-benefit
