Business owners, workers discuss impact of road work

E
very business is affected by traffic, with varying results. But for businesses rendered inaccessible by detours, gravel and clouds of dust, city improvements can hurt the bottom line. Roadwork has become increasingly common in Colorado Springs since John Suthers became the city’s mayor in 2015 and began spearheading a campaign to mend parts of Colorado Springs’ aging infrastructure in desperate need of repair. The city began to undertake large roadwork projects last year thanks to $250 million (over five years) in revenue collected via the voter-approved 2C city sales tax (.62 percent). “With the start of our second year of 2C paving, we are building upon the significant progress made in 2016 with almost 230 lane miles paved,” Suthers said in an April news release. However, while the city has tackled or embarked on
repaving and construction projects in every part of town since the beginning of last year, much of the city remains riddled with potholes and uneven lanes. “We still have much work to do to improve the overall condition of our roads, but the return of cone zones throughout Colorado Springs signals that we are well on that path,” the mayor said. This year, crews are involved in projects affecting several business districts. Near the intersection of Centennial Boulevard and Garden of the Gods Road, traffic is limited to one lane and has interfered with some businesses’ visibility; a portion of West Uintah Street has been closed; projects downtown have limited customer access to businesses. Also, major work on West Colorado/Manitou Avenue (funded by the Pikes Peak Rural Transportation Authority) is disrupting traffic and affecting businesses. The repairs will one day benefit nearby businesses. But for now, some say they offer their fair share of annoyance.

Activist Weise plans to sue city By John Hazlehurst
T
he city of Colorado Springs and Monument resident Leslie Weise are once more engaging in a legal battle. Weise fi led a notice earlier this month to sue the city of Colorado Springs for more than $1 million. The original dispute started nearly two years ago, when Weise sought to force Colorado Springs Utilities to release the results of a study by consultant AECOM that used computer modeling to determine whether sulfur dioxide emissions from the downtown, coal-fi red Martin Drake Power Plant exceeded regulatory standards. Citing attorney-client confidentiality, CSU refused. The ensuing legal struggle continued until CSU and Weise agreed in March to drop lawsuits pending in the Court of Appeals, both of which were then dismissed. Weise had charged CSU and city councilors who serve as its board of directors with deliberately withholding from the public essential information about dangerous pollutants emitted from Drake’s smokestacks, and she dismissed CSU’s claim of attorney-client privilege as a smokescreen. Things came to a head when the court inadvertently sent Weise a copy of the AECOM report, which she said she read, but did not share, copy or retain. She did summarize its contents to a reporter, believing, she said, that she was not legally enjoined from doing so. City attorneys accused her of unethical conduct, noting that as an attorney she should not have revealed any confidential information she had accidentally received from the court.

ov. John Hickenlooper missed an opportunity to address the state’s congested interstate highways when he refused to call a special session to revive the issue of funding for state and local roads. With the start of summer tourism season, Interstate 25 and Interstate 70 will be even more congested — while county roads and city streets will see increased traffic as frustrated drivers seek alternate routes to avoid delays. That additional traffic leads to more maintenance needed at the local level and more costs to local taxpayers. When the latest session of the General Assembly ended in early May, the lawmakers left work unfinished; they neglected to agree on new major funding for transportation. Hickenlooper toyed with the idea of a special session, but ultimately opted not to call the legislators back to Denver. Failing to find a solution — either in regular session or a session called specifically for transportation — leaves a major issue unresolved for at least the rest of the year. There won’t be any discussion of widening Interstate 25 between Monument and Castle Rock, or a solution to finding money to expand the interstate between Denver and Fort Collins or to improve Interstate 70, the state’s main highway to the mountains and winter tourism getaways. The problem is more than mere benign neglect of
the state’s transportation systems; it’s also a failure of leadership. It seems that once it was clear that the General Assembly wasn’t on board for additional sales taxes, as proposed by a coalition of both parties, all other solutions were off the table. That leaves cities and counties along the Front Range responsible for the additional traffic on their roads and bridges, while continuing to let the state off the hook for addressing the roadways it is responsible for updating and maintaining. The special session could have continued a much-needed conversation throughout the state: how to balance the needs of fast-growing Colorado Springs with those of Fort Collins, Boulder and the mountain resorts. Instead, the legislators will spend the next six months listening to complaints from constituents, but without a firm sense of where the state will find the money to expand the highway system while also seeking alternatives such as a light-rail system. The failure to make the hard choices now means more delays in fixing congestion. Interstate 25 needs to be expanded now — not in five years or a decade. Traffic backups occur for miles with even a single minor accident, and tourists won’t enjoy the delay when they make day trips between Denver and Colorado Springs. Commerce is similarly affected. No one wants to sit in traffic for a business trip to and from Denver. And with more people opting for El Paso County’s less expensive real estate, traffic backups for regular commuters are a daily problem, not an occasional issue. The state’s transportation problems will not fix themselves. Colorado Springs has taken steps to address local road issues. It’s up to state leaders to address interstate highways so that if Congress acts to pass transportation legislation, the state is ready with projects that need additional federal dollars. CSBJ n

Careful: Taxes an economic balancing act
B
rowsing national real estate listings for “castles,” I found my dream house. It’s a three-story stone mansion in Albany — New York’s state capital — built in 1892 for local businessman Charles Ledow. It’s in splendid condition, with 11 bedrooms, 2½ baths and 26 total rooms. For a Victorian mansion fanboy HAZLEHURST (that would be me!), it has everything. Picture multiple tile fireplaces, extraordinary oak woodwork, radiant stained glass, spectacular staircases, bay windows and a three-story turret. Imagine 8,500 square feet of splendor set on a 27,000-squarefoot lot with park and water views. True, there are a few negatives: The kitchen needs to be recreated, there’s an attached carport but no garage and the bathrooms are less than baronial. Yet if you want to live in a 19th-century architectural masterpiece, you have to make allowances. And the asking price of $799,000 seems absurdly low. If we sold our present house we might be able to swing it, even though such a move would make little sense and put us deeply in debt. What’s the catch? First, it’s in Albany. “We’re not moving to Albany,” said my wife, Karen. “We’re not even talking about it. It’s really cold and snowy in the winter, hot and humid in the summer. And I know you love that place, but it’s old and spooky — it’d be like living in a horror movie.” I understand. Maybe she’d change her mind if we

looked at the place. But there’s another problem. According to Coldwell Banker, annual estimated property taxes for the house (located, if you want to check it out, at 10 Thurlow Terrace) are $21,278. By contrast, a house with a market value of $799,000 in my present 80904 zip code would have an annual property tax bill of approximately $4,187. With property taxes so high, do Albany residents get a break on sales tax? Nope — with a combined state/ county tax rate of 8 percent, they pay only slightly less than the 8.25 percent rate paid by Springs residents. And New York’s state income taxes are higher than Colorado’s 4.63 percent, leaping quickly up to 6.45 percent on incomes of more than $21,300 and topping out at 8.82 percent. As Taxpayer’s Bill of Rights author Douglas Bruce figured out many years ago, absent external checks, tax rates rise steadily in order to accommodate increased government spending. Much of that spending is necessary and proper, but it’s interesting to note that there was no city sales tax in 1960. Liberals, moderates and even a few conservatives might complain that TABOR unnecessarily restricts our ability to fund local and state governments, but maybe the Dougster had a point. To the extent that wages, salaries and property values rise in tandem with tax increases, everything is rosy. Public employees get generous pensions, public schools and colleges get funded, and transportation needs are met. But what happens to high-tax cities when capitalism’s bounty slows? Tax receipts drop, tax rates
increase, employment shrinks, crime rises and residents flee. Don’t like it? Blame economist Joseph Schumpeter. “The opening up of new markets, foreign or domestic, and the organizational development from the craft shop to such concerns as U.S. Steel illustrate the same process of industrial mutation — if I may use that biological term — that incessantly revolutionizes the economic structure from within, incessantly destroying the old one, incessantly creating a new one,” wrote Schumpeter in 1942. “This process of Creative Destruction is the essential fact about capitalism.” The once-mighty U.S. Steel makes less steel today than it did in 1902 and was kicked off the S&P 500 in 2014. Albany hasn’t taken the kind of hit that other Eastern and Midwestern cities have, thanks to lavish state-funded spending, but the city’s population dropped from 135,000 in 1950 to 98,500 in 2010. So when we consider worthy new taxes, be they for stormwater, parks, state transportation, education or anything else, let’s be careful. Cities, like those who live in them, are mortal. One day we may become the Detroit of the Rockies, undone by military downsizing, climate change, political turmoil or industrial evolution. And high taxes will only hasten the process. Meanwhile, I’d still like to live in a vast stone mansion, firmly anchored in the 19th century, and watch through my stained glass windows as the world flickers by. Maybe buy a lottery ticket? CSBJ

Sutton, Peak Structural sail into summer By Bryan Grossman
P
aul Sutton has a lot to celebrate this summer. The Minnesota native will mark 20 years in Colorado in the coming months. His company, Peak Structural, is fast approaching its 15th anniversary, it’s been nearly two years since he bought his current headquarters in Palmer Lake and, as icing on the cake, Sutton and his team recently earned the Pikes Peak Small Business Administration and Better Business Bureau of Southern Colorado’s Small Business Week awards for Family-Owned Small Business of the Year and Small Business Person of the Year. Still, Sutton found time to speak with the Business Journal this week about reinforcing the structure beneath his team, meeting and exceeding expectations, and living the entrepreneurial dream. Where are you from? I’m originally from Minneapolis, but I’ve been here 20 years this summer, so I’m calling it home. I’m claiming the state. I definitely love it here and have no plans to go anywhere else. I left Minnesota in high school and came to Colorado from Kansas City. My wife [and co-founder Lisa Sutton] and I were ready for a change.
What were you doing in Kansas City? General contracting. The change wasn’t so much vocational as it was about the environment, the climate, the mountains — all the things people love about Colorado. Did you move here to start Peak Structural? That happened a little later. When I first moved here in ’97, I spent the first few years continuing with general contracting work and some new construction — a lot of larger renovation jobs. By the early 2000s, I knew I was looking to specialize in something. I wanted to find a construction-related business that just any Joe with a pickup truck and a contractor’s license couldn’t necessarily get into. Did you start in Palmer Lake? No, I started the business in 2002 out of my home. I had a home office and rented a storage locker with two employees. From there we moved into a rented facility on Fillmore [Street], and from there we bought a small commercial building downtown on Sierra Madre [Street]. We were there for a number of years but had badly outgrown that place. The opportunity came up to buy this building and it seemed like it would be the perfect geography. We do a lot of work in Denver and it’s a great jumping-off point. What inspired this business? As a [general contractor] we had a job that required putting in some foundation piers. It was a large renovation project and we were adding on to this home. … This was 2001 and I contracted with one of the more well-established, credible companies in the foundation marketplace in Colorado Springs. I was so dismayed by the service I received from the subcontractor in terms of poor communication and irresponsible behavior on my job site, which is a reflection on me. ... If that’s how they’re making me feel, how would the average homeowner feel? I researched this niche market of structural repair and reinforcement and found that was pretty typical. There were seven or eight companies in the area and customer service was not a priority. What sets your company apart? The standard here and what I want to train
into everybody ... is to think, ‘How would I want to be treated as the customer?’ It’s easy to flip that around. We’re all somebody’s customer every day. What do we expect when we’re turning over our hard-earned money for a product or service? We want to be treated well. We want the experience of working with that company to be great. ... The community seems to have responded well to this kind of service. Between 2002 and 2012, one by one, pretty much all those other companies have closed their doors. Today, in the Pikes Peak area, we do the overwhelming majority of work — more than 70 percent of the work of this nature. How has the company grown? Like so many classic American entrepreneurial stories, it started as me and a couple guys. ... As recently as 2013 there were 12 or 13 on our team. Today we have about 80. The last four years have seen rapid growth. ... We’re constantly looking for good talent. We even have a full-time recruiter now on staff who does nothing but work to find the best talent we can for each of our departments. You recently won not one, but two, small business awards? We won [the SBDC and BBB’s] Small Family Business of the Year. At Peak, my wife and I are the owners and independent local managers for the company. One of our daughters works here as an accountant. One of our sons works here as needed. Our oldest son is on our board of advisers. ... He lives and works in Denver but is very involved in quarterly board meetings. It’s a lot of fun. As any honest family business owner will tell you, there are challenges mixing work life and home life. And the Small Business Person of the Year award? It’s meaningful. The board that vets that award — there’s a process advancing candidates. When you get to the finalist stage they want financials and all sorts of sensitive information and they dig in and make sure the numbers add up. … I feel humbled and grateful we were selected for those awards. There are a ton of great companies and entrepreneurs. It was a great pleasure and honor. How do you remain an effective leader? Leaders need to reinvent how we engage our staff and how we develop other leaders. I participate in something called the School of Entrepreneurship. I travel out to the East Coast about every six weeks for two days of classes. I also attend a local Vistage [executive coaching] group. It’s the oldest CEO peer group in the United States. We meet monthly and the people in the group are all CEOs or owners of companies. As peers we help each other with case studies — discussing the challenges of growth or the access to personnel, HR stuff, anything. It’s a fertile learning environment and people come from within all industries. There are so many similar challenges regardless of the field you’re in. I’m a firm believer that any organization can only grow to the level and caliber of leadership that ownership is willing to achieve. What’s your favorite thing about this job? Building the team. ... About two hours ago we had a meeting of all our department heads. It was a strategy meeting and we were talking about the next six to 18 months. To see this group of managers develop and become more effective leaders in their respective departments, as well as develop effectiveness in how they connect with peers and get things done — building the team is what I really get excited about. New campus to help vets, manufacturers By Helen Robinson

Colorado Springs campus that trains veterans in manufacturing could soon be in the works, if Blackfox Training Institute sees enough employer interest in its program. The Advanced Manufacturing Program for Military Veterans teaches courses geared toward the requirements of aerospace and defense manufacturing, Blackfox president and CEO Allen Dill said, and aims to boost the available local workforce by training and certifying veterans transitioning out of the military. Dill said the “huge gap” in advanced manufacturing skills is a national problem. “It’s a very limited available workforce that has the skills required for mostly aerospace and defense-type electronic manufacturing,” he said. Veterans are becoming part of the solution. In Colorado, hundreds transition out of the military every month with the majority seeking civilian careers, Dill said, and they are typically “ready for this type of career position: one that requires dedication and a commitment for a longer-term career path.” Blackfox has graduated more than 200 veterans since establishing the program in 2013 in Longmont, where the institute has been headquartered for 21 years. The aim now is to position another campus on or near one of the Springs’ military bases, with teaching to begin late this year. Blackfox will host an event from 8-10 a.m. June 6 at Mt. Carmel Center of Excellence in Colorado Springs, to provide manufacturing employers with information about the program as well as to gauge employer interest and learn about employer needs. Dill said the five-week, 200-hour accredited program operates at no cost to the employer or the veteran.
Funding comes from federal training grants, and Blackfox is eligible for the G.I. Bill. Until now, the distance to Longmont’s campus has been a major deterrent for Springs veterans. “Expecting people from Colorado Springs to commute every day for five weeks is a lot to ask,” Dill said. He emphasized the program is demand driven; Blackfox only starts teaching when there is “at least a verbal commitment from employers to consider hiring our graduates.” “The primary intent for our June 6 meeting is to listen to the employers’ interest and hopefully gather enough support to expedite the move in the area,” he said. In developing the curriculum, Blackfox worked with Colorado employers to understand skill requirements for their businesses. Dill said Lockheed Martin, Cobham, Linear Manufacturing, QCMI, GPS Source Inc., Spectrum Advanced Manufacturing Technologies and Harris Corporation have expressed interest in a Colorado Springs campus. Jay Palace, president of Linear Manufacturing, said finding workers with manufacturing and electronic assembly skills in Colorado Springs is a challenge, and the company usually has to provide training. A program that collaborates with manufacturers and teaches veterans the skills the industry needs could change things, Palace said. “It would certainly put more people in the workforce that know the [skills]. I deal with engineers that don’t even know how to do any type of assembly,” he said. “They can do design, they can do software, but they don’t know how to do the hard manufacturing — actually putting the part on the board and knowing what it’s supposed to look like.” Palace said another challenge is that manufacturers are competing with offshore companies in a tight market, so workers entering the industry “have to

learn a lot more skill sets than [the basics] in order to compete with the other people that want to make a $40,000- or $50,000-a-year salary.” Software skills, manufacturability and IPC-A-610 electronic assembly standards are essential for workers, Palace said. Dill said graduates are prepared for mid-level technical manufacturing jobs and have “huge opportunities” for advancement. “It’s typical for our graduates to be hired ... and before long there’s an opportunity to move up, especially with a lot of the prime manufacturers,” he said. “[We have] retention rates that are almost unheard of for this type of program. We’ve had our employer partners ... experiencing 90-plus percent retention rates beyond the fi rst year.” This is partly attributable to the program’s screening and interviewing processes, Dill said. “All the work on the front end is really setting up the student for success,” Dill said. Dill said everything taught in the program is Class 3 level — the industry’s most stringent quality standard — which is required by many manufacturers. Blackfox worked with the Colorado Department of Labor and Pikes Peak Workforce Center on the program in Longmont, and will continue those partnerships in Colorado Springs. Dill said representatives from Fort Carson, Peterson [Air Force Base], USO Colorado Springs, Mt. Carmel, and Sen. Cory Gardner’s office expressed interest in supporting the program. The Colorado Springs campus will take a new approach, giving soldiers the chance to train, with permission, during their 180-day transition out of the military. “That’s our goal — to make sure by the time they transition out, they have an opportunity to go directly to work,” Dill said. L
ynmar Racquet & Health Club, a former Colorado Springs fitness facility, will soon reopen under a new name, Colorado Springs Coliseum, after a change of ownership in 2008 did not work out in the long run. New owner Daniel Jenkins has been an entrepreneur since high school, where he made $3,000 by selling gummy bears from his locker. He traveled to Europe with the revenue. Jenkins recently purchased the facility, which had been boarded up since 2016, with friend and now co-owner, Theo Digerness. “People called me crazy. At fi rst there were even homeless people living in here,” Jenkins said of the derelict building. “It was pretty nasty when I fi rst walked in.” In 2008, Lynmar was purchased by Lifetime Fitness; eight years later the facility was entirely boarded up. “In the late ’80s and early ’90s it was a very popular tennis club. It had a bar, restaurant, all of that. It was a racquet club and then it was purchased by Lifetime Fitness. Then the Lifetime Fitness owner fi nanced a volleyball organization, and it didn’t work out for them,” Jenkins said.
Jenkins inquired about purchasing the building on 2660 Vickers Drive four years ago when it was still open and his son was taking archery lessons there. After three years of what Jenkins described as a long journey with intensive legal back-and-forths, he signed the papers to gain ownership in March. He then began $1 million in renovations. Half the renovation budget was designated solely for the roof, which had been leaking, and the other half to restoring and updating the interior of the nearly 90,000-square-foot building. “We’re trying to update it to at least the year 2000 because the building was built in 1974,” he said. “The bones are incredible, but it hasn’t been renovated since then.” His goal is to promote three core values in his new business: community, fitness and youth. “I’ve always been an entrepreneur. I used to own a gymnastics facility in town,” Jenkins said. “Then I went into general contracting, so this kind of pulls it all together between the renovations and the sports.” Jenkins will rent the space to local companies that teach youth sports like dance, karate, gymnastics, volleyball and possibly pickleball. There will also be a trampoline space similar to that of SkyZone. He
plans to run the gymnastics and pickleball programs himself. “My passion is youth sports because [children] need not just an education,” he said. “Healthy body, healthy mind.” Renovations are expected to be completed by July 1. Then Jenkins will host a soft opening, but the public grand opening will happen in September. “My goal in the first year is to have 3,000 people to walk through these doors a week,” he said. Jenkins plans to hire 10 employees to maintain the concept of a renter-run facility. So far, he has hired two and is still recruiting renters. The building also features 18 offices, and Jenkins plans to rent those spaces to companies with a presence at the facility. Jenkins is also looking at including co-working rental space for entrepreneurs. “I want to make this a community center. I think it’s the connection between people that needs to be fostered — especially right now,” he said. “Colorado has a huge draw for businesses that are community minded. I think it’s ripe — the beauty, the health. [The city] has decent infrastructure — not the best — but the environment has become increasingly business friendly.” CSBJ n

Seals is the real deal for regional arts By Ashleigh Hollowell
“C
ommunity” and “connection” are two words commonly used by Angela Seals. Hailing from Pittsburgh, Pa., Seals moved with her husband to the Colorado Springs area in 2013. At the time, she was hired by the Cultural Office of the Pikes Peak Region in a part-time position that eventually grew into director of community partnerships. Last week, after four years of advocating for the local arts, writing grants and engaging the community in the arts scene, she was promoted to deputy director. Of growing the impact of and enthusiasm for culture, Seals said, “I’ve always had people in my career ask, ‘What’s next for you?’ or ‘Where are you going next?’ And at some point, there’s a moment where you say, ‘I love where I am and this is where I’m going to make my impact.’ That’s how I feel right now.” Why did you move to the Springs? I’ve been working in arts management for 15 years. It had been about 11 years when I moved here. I’ve worked with all different sizes of organizations, largely with programming and arts education. When I moved to the Pikes Peak region, I was really interested in getting involved in the arts scene here. I love mid-sized cities because they have fight in them. Underdog cities are the best because, especially as a young professional, you have something to cheer for and advocate for and you can be actively building the city you want. I loved that part of Colorado Springs. ... Even in just my four years here we have so much more momentum now than we had before as a creative community. So, I came to join that story of the arts community. I came very consciously wanting to be part of that story. How did you get the job at COPPeR? I was hired by the cultural office in a seasonal position to oversee the Peak Arts Fund, which was just a short-term project. Over four years later, here I am and I’ll be here for a long time. ... I love to surprise people with how much there is to do here, with the quality of the arts that
are here. ... We work a lot with tourists and with residents and sometimes residents are the ones that need the most convincing. Getting people more engaged with arts makes them love where they live even more. What’s COPPeR’s mission? We connect residents and visitors with arts and culture to enrich the region. ... We promote the arts, we advocate for more investment in them and we build more connections between the arts and our region. How do you advocate for art? A lot of that work is done by our executive director. He meets every year, several times a year, with elected officials to help them understand the value of the arts. It’s also sitting on influential boards and committees all over the region to make sure the arts have a seat at the table when we’re talking about our shared challenges. Artists and creatives offer an incredible way of thinking that offers solutions to things you would never think the arts can. For example: transportation. People are speeding through downtown; we know that we can slow them down with public art. There’s all kinds of ways the arts are relevant in the city and in cross-sectors. We also do research into economic impact. On July 12, we will be releasing the results of our newest study. We worked with Americans for the Arts. Every five years the cultural office works with Americans for the Arts to conduct an arts and economic prosperity study. This is the fifth one. What advice would you give to other young professionals? I think it’s very easy to be consumer-minded about where you live and it is very important at some point to make that pivot and say, ‘I’m going to make where I live what I want it to be.’ You’ll hop from city to city looking for the perfect city. At some point you’ll stop and say, ‘Here I’m going to start to make change and I’m going to be a positive agent of change where I am right now.’ I think this is a great city to do that in. ... Local entrepreneurs compete in Singapore startup event By Cameron Moix

wo well-known entrepreneurs in the Colorado Springs startup scene represented the city — and the country — on the global stage last month during the annual Get in the Ring Competition in Singapore. And although Tejon Technologies Inc. co-founders Samuel Elliott and Paul Nielsen flew back from the competition seemingly empty-handed, they would beg to differ. The two entrepreneurs, who run a database startup in downtown Colorado Springs, say they achieved much: They won a stiff local Get in the Ring competition against four fierce startup competitors and went on to be the only U.S. team to compete in the Singapore finals, as well as attend the organization’s 2017 Global Conference. “It seems the point of it was to get to the conference, be part of that global community and meet with venture capitalists,” Nielsen said. “There were amazing companies doing fantastic things that were not chosen to be in the limelight because they couldn’t be explained in 30 seconds — and that’s OK.” Elliott and Nielsen met last year via the Colorado Springs-based nonprofit Peak Startup, an organization for which they both serve as board members. but only from the right partner,” Elliott said in the closing of the pitch. “Most importantly, we are looking for an international corporation to partner with for a single project to prove our technology to the world.” Elliott said there were likely about 40 companies competing for the final two spots. “We felt really, really good in the pitch, but during the nine-minute Q&A session afterwards the judges were the first ones to admit that they did not have much software expertise,” Elliott said. “They asked a lot of questions and were very interested in everything that was going on, but we could just tell that it was a little bit difficult for them to grasp the concept of what we were doing.” The team then stood before a second panel of preliminary judges who Elliot said were nearly as excited as he was about Tejon Tech, but that wasn’t enough to get them one of those two spots in the finals. Having returned to life along the Front Range, Nielsen and Elliott are back to business and plan to launch Tejon Tech’s inaugural database product in September — and they both agree the Get in the Ring experience was well worth their time. “Global exposure would have been extremely beneficial for us,” Elliott said, “but the experience ... we were able to gain from the investors there at the conference was extremely valuable.” CSBJ n

Stockmens Bank grows with opportune merger By Bob Stephens
R
ob Alexander isn’t worried about his legacy, but the Colorado Springs banker has likely enhanced the reputation he’ll eventually leave behind. The 54-year-old chairman and CEO of Stockmens Bank is merging his company with the larger but less successful First Home Bank of Mountain Grove, Mo. “The problem with little banks is they often don’t survive when their owners move on,” Alexander said. “This merger allows Stockmens to survive Rob. It gets us to that level where we’re big enough to survive when I walk away or I’m gone. “I wanted that option for my great employees, for our stockholders and for our customers.” Stockmens has assets of about $120 million, while First Home Bank lists assets of $219 million. “Stockmens has a lot of assets that are off the balance sheet,” Alexander said. “It won’t be immediate, but when those are added, it’ll get us closer to $400 million. Small banks have been in the $200 million or less category, but I believe in the next 10 years they’ll need to be in the half-a-billion range.” This was a transaction forged by two people who were already doing business together. Alexander is on the board of directors of First Bancshares Inc., the parent company of First Home Bank, and has owned stock in FBSI since 2007. Regulatory approval came during the last two weeks, Alexander said. “While it might appear that merger activity is speeding up in Colorado, the pace hasn’t significantly increased,” said Don Childears, president and CEO of the Colorado Bankers Association. “Rather, the activity has begun moving from rural areas closer into the Front Range where it gets more attention.

This capability not only creates jobs, it also expands the menu of products and services that can be offered and sold, both domestically and internationally. In addition, the ability to start and grow new businesses makes the U.S. responsive to changes in technology, consumer preferences and other external factors. New business formation makes us nimble and competitive. The state of Colorado is particularly good at new business formation and small business growth. Consider that in the U.S. from 2014 to 2015, the number of new establishments less than 1 year old increased by 4 percent (Bureau of Labor Statistics). In Colorado, from March 2016 to March 2017, new entities grew by 7.7 percent. In that time span, existing entity renewals increased 6.5 percent (Colorado Secretary of State). This is much of the reason the state of Colorado now has the lowest unemployment rate (2.6 percent) in the U.S.: Entrepreneurship is alive and well, and small businesses are thriving. In the 2016 Kauffman rankings, Colorado ranks No. 1 among the 25 “larger
states” in terms of the adult population owning a business (8.56 percent). Our state ranks No. 4 overall in the “Main Street” ranking, which measures established small businesses fewer than five years old with fewer than 50 employees. What is more, Colorado businesses are spread across many sectors, making us diverse and perhaps more insulated from wide fluctuations in select industries than other states that rely on fewer sectors (e.g., oil and gas). From 2014 to 2015, there were a dozen sectors that hovered around the 4 percent growth rate (see graph). Colorado’s industry diversification and highly educated workforce (among other assets) are bolstered by a relatively friendly business environment. This will be one of the topics of the upcoming State of Small Business event with its panel of content experts (bit. ly/2StateofSB). Locally, the Pikes Peak SBDC plays a key role in these successes as the infographic illustrates. Across the state and locally, we can continue to fuel our own growth by capitalizing on these various assets and capitalizing on the current momentum that has brought us to these enviable heights. SBDC’s State of Small Business event on June 6 celebrates Colorado Springs’ entrepreneurial spirit By Amy Sweet, Editor and COO, Colorado Springs Business Journal
M
y dad’s small business in Memphis put four kids through college and technical school, advanced degrees and business launches. Rice Rehab, an occupational therapy business in Pennsylvania, is putting my sister’s two daughters through nursing school and university educations. And my brother’s construction company in the southeast U.S. takes care of his family and the families of about 50 employees. In my family, entrepreneurism is just part of the culture. My grandfather, uncles and great uncles all owned their own businesses. Other families talk about politics; in mine, the discussions cover taxes, regulations and the increasing cost of labor. My grandfather opened his construction firm just after World War II, when everything seemed possible. At the age of 5, my dad became a regular fixture on the job site, and he spent every summer working on apartment buildings and houses, office spaces and churches. He remembers nailing together a wooden chair on the construction site, and taking it home. He used that same design to make rocking chairs for my daughters several decades later. My dad’s legacy will live on in the buildings he created across the Mid-South. Today, my dad and two uncles are retired from homebuilding, architecture and painting firms that spawned the third generation of builders in our family. It now seems my brother’s children — the oldest a junior in high school — might make it four generations of small-business ownership for our family. But the independence and control that come from owning one’s own company also produce a full share of worries. I remember my dad worrying during every economic downturn, every failed contract bid. He fretted over where our family would have to cut back, but also about what he was going to tell the people who worked for his small subcontracting construction firm. He took few vacations and even fewer holidays, always close to home, so he could return if needed. I know we had a few family vacations where he was present only on the weekends, because he had to spend the week in Memphis or Jackson or Hattiesburg, always chasing the next job.
It worked for him, just like it’s working for my sister and brother. And just like it is working for small businesses here in Colorado Springs and in Colorado. The state’s small businesses are responsible for a total of 1 million jobs and in 2014 alone received $654.3 million in Small Business Administration loans. Across Colorado, about 97.4 percent of companies are classified as small businesses, companies that range from a single employee to fewer than 500. Small businesses make up a wide range of industries, and those firms keep unemployment low in the state and do the lion’s share of work to maintain a robust economy here. The lessons my grandfather passed on to my dad are mirrored in thousands of small businesses throughout the state. He learned to never cut corners, never be afraid to take risks and always treat people fairly. He never hesitated to train people in the craft he loved, and he brought success to many in a challenging industry. Cooperation among small businesses is common — no matter what the industry. Here in Colorado Springs, several organizations have the sole mission of aiding entrepreneurs and small business owners alike. The Pikes Peak Small Business Development Center, the Better Business Bureau of Southern Colorado and the Service Corps of Retired Executives provide certifications, training, advice and other information to fledgling companies. Networking groups, including the TriLakes Chamber of Commerce, the Hispanic Business Council, the Colorado Springs Chamber of Commerce & EDC, and the Black Chamber of Commerce, all exist to help small businesses and find ways to collaborate. The current co-working trend also creates cultures of cooperation and collaboration — something that didn’t exist when my grandfather and my dad launched their businesses. On June 6, the SBDC hosts the second annual “State of Small Business” event, where companies will come together to celebrate success, learn about challenges and work together to create a vibrant economy in Colorado Springs. We’ll unpack what it takes to be successful in a competitive economy and how to grow businesses to create jobs. And we’ll celebrate the same business values that I learned from my father, brother, uncles and grandfather: Always be fair, always treat people well, always do your best. And always, always work hard.

Do you shop local? Have you ever wondered what goes on behind the scenes of your favorite small business? We ask local owners to share their thoughts on running a small business in the Springs — and to provide a bit of the practical wisdom they’ve gained from their experience.

As a retailer, and this is not just Colorado Springs, it’s the fact that so much of the running of a business is turning into a 24/7 operation. Thirty-nine years ago, those kinds of hours weren’t expected. You could close on a holiday or a Sunday and it would be fine. With a small family business, it’s harder to do that. Do you think Colorado Springs is small business-friendly? Yes, I do. The business environment is not too expensive to open or run a business in. There are open spaces you can rent throughout the city that are not killer in cost. That gives more opportunity to smaller businesses looking to start up here. Could the city do more to support small business specifically? I think the city does do a good job overall. They do have to be careful with increases to sales tax. They have competition from other cities and online stores, and customers can be driven to those options by increased costs. Is there a recipe for success in running a small business? Yes. Set your goals and stick to them. You’re going to have your ups and downs, but if you have goals to focus on, you’ll come out all right.

What are some of the challenges in running a small business in Colorado Springs? In the retail industry in particular, it’s constantly rotating new styles and inventory. Everything has to be fresh and new. If you could go back in time, what advice would you give yourself before opening your business? I would give myself more time. We closed on our property on June 10 and we opened August 1. Opening included performing some pretty extensive renovations, so we were up all night before we opened trying to get everything out and looking pretty. Could the city do more to support small business specifically? I think the city could do more to reach out to businesses beyond the downtown area. We’re lucky here in Old Colorado City because we have the Old Colorado City Merchants Association which is really supportive of us here. But there are lots of businesses further out that I think could be better represented. Would you ever consider selling your business or being absorbed into a larger corporation? Not in a million years. I always tell everyone that there are two things that aren’t for sale: the Cadillac and the business … and the cat. The boutique cat is not for sale, either. Is there a recipe for success in running a small business? I think the one recipe that would be consistent in any business, in any industry, would be to gear your service and products toward your customers. You have to constantly evolve to cater to your clientele.

For any business, anywhere, it’s getting started and getting your name out. Getting through that initial start-up phase and making sure you have enough capital to launch the business and keep it running. I take care of 11 employees and their families and I take that responsibility very seriously. If you could go back in time, what advice would you give yourself before starting your business? I started by looking for a traditional source of lending — seeking loans from big banks. Looking back, I wish I would have gone with a local bank. I would seek support from a local partner, someone more invested in the community and helping small businesses grow. Do you think Colorado Springs is small business-friendly? Yes. Over the last several years, I think the climate has changed. You see a lot more focus on buying local, which is important when you are a small business. For my brewery, we rely completely on the support of the local community. And I think the community is very proud of all of its small businesses. Could the city of Colorado Springs do more to support small business specifically? I think the city could create a little more clarity and continuity around the organizations that are in place to support us. Would you ever consider selling your business or being absorbed into a larger corporation? No, not at this time. I’m having way too much fun. I’ve been super lucky to have a great team and a great community that supports our brand and the mission of Red Leg. I really have no idea what I would do if I didn’t do this — it’s a ball.

Litigation: Weise files intent to sue for defamation From page 1
asking for an “accounting of city time and expenses pertaining to Leslie Weise.” She found city attorneys had billed 32 post-dismissal hours on matters pertaining to her. Her CORA request found attorneys representing Colorado Springs Utilities and the city had filed complaints against her in New York and possibly other jurisdictions, apparently seeking to have Weise reprimanded or even barred from practicing law. Weise confirmed that complaint(s) have been filed but, citing the confidentiality of such procedures, refused further comment. Since no legal proceedings are involved, these complaints aren’t subject to CORA requests. Utilities Board Vice-Chairperson Andy Pico, who served as chairperson when the board considered matters pertaining to Weise, refused to comment on the matter.
WEISE COUNTERATTACKS Weise said the complaints were an attempt by CSU and the city to not only deter her from pursuing further legal actions against the city, but as defamatory acts of retaliation. She hired Denver civil rights attorney David Lane, who sent a notice of claim to CSU and the city on May 12.
Lane formally notified them that he will represent her in a lawsuit that will seek monetary damages for defamation under both state and federal statutes in an amount of at least $1.35 million. “Ms. Weise will allege in her federal complaint that the defendants have retaliated against her for having engaged in speech protected under the First Amendment to the United States Constitution,” Lane said. “These statements are violative of the First Amendment to the United States Constitution and are actionable torts for libel, slander and libel per se under Colorado law as well. The defendants have knowingly and recklessly made false, retaliatory and defamatory statements about Ms. Weise, a private person, including those constituting defamation per se, with malice and/ or reckless disregard for the truth of the statements…” The 11-page complaint prepared by Lane cites numerous allegedly defamatory statements by Utilities board members and executives. In a lengthy statement released last week, Weise confirmed that she’s proceeding with the lawsuit. “There is no doubt in anyone’s mind who has studied this matter, that if the Air Quality Study commissioned by Colorado Springs Utilities showed air quality in compliance with state and federal regulations for safe levels

of SO2 pollution, it would already be made public in its entirety,” Weise said in an email. “Instead, the city has chosen to attack my credibility and now continues that attack on my professional livelihood to desperately cover up its misdeeds.” City Council President Richard Skorman, who was elected to council and his leadership position in April, said that he’s “not happy” with the city’s earlier decision to file complaints against Weise. “These decisions were made in closed session before I was on council,” he said. “Apparently, a majority of council supported them.” Skorman would not say whether council might revisit the decision. — Leslie Council President Pro Tem Jill Gaebler, who was a Utilities board member when the matter was considered, refused to comment.

We also want to get that [AECOM] report released.” Lane cited the Pentagon Papers case Weise in support of Weise. In that famous 1971 case, the Supreme Court blocked the government from preventing The New York Times and The Washington Post from publishing a lengthy Department of Defense study of U.S. involvement in Vietnam from 1945-1967. By a 6-3 margin, the court denied prior restraint. “Only a free and unrestrained press can effectively expose deception in government,” wrote Justice Hugo Black at the time. CSBJ

GRIFFIS/BLESSING MAINTENANCE DIVISION ADDS SIX NIEBUR PROPERTIES Colorado Springs-based Griffis/Blessing Inc. has been selected to provide commercial maintenance services for six properties owned by Niebur Development Inc. The properties, located throughout Colorado Springs, total more than 138,000 square feet and consist of both office and medical office buildings. The company’s commercial maintenance division will provide facility maintenance services including aesthetic issues, general lighting and electrical repair, responding to service calls and 24/7 emergency maintenance. Several technicians will be responsible for the various sites.
ATLAS REAL ESTATE GROUP EXPANDS TEAM, OPENS LOCAL OFFICE Denver-based Atlas Real Estate Group, a full-service realty group specializing in real estate investments, brokerage and property management, announced it has hired four new employees and opened a Colorado Springs office. The new office at 422 E. Vermijo
Ave. will be managed by associate broker Rebecca Slaughter. The group has hired one new property manager, Billy Connor, a new marketing manager, Sara Russell, and two new associate brokers, Jordan Terrell and Ryan Balentine. Rebekah Scott recently took on the role of associate broker after working as director of business development for the group’s primary real estate team.
PHYSIOTHERAPY ASSOCIATES BECOMES SELECT PHYSICAL THERAPY Physiotherapy Associates, which has four locations in the Colorado Springs area, is changing its name to Select Physical Therapy. Although the name will change, the same therapists will continue to provide care, and all four locations will continue to accept most major insurance plans. In February 2016, Select Medical Holdings Corp. of Mechanicsburg, Pa., purchased Physiotherapy Associates, a national provider of outpatient physical and occupational rehabilitation and prosthetic and orthotic services with a national footprint of 560 centers in 28 states.

Legislative service has been an honor
I
t was an honor to serve in the 71st General Assembly session, which was one of the most productive in recent memory. Among the bills that made it to the governor were several addressing the seemingly intractable issues of construction defects, the Hospital Provider Fee and transportation funding. We also passed legislation to strengthen family economic L E E security, support K-12 and higher education, support veterans, expand rural broadband and reform the criminal and juvenile justice systems. We passed a balanced budget for 2017-18 with broad support in both chambers. Despite a challenging budget situation, we were able to increase funding for K-12 education by $242 per student and provide more funding for affordable housing and to tackle homelessness. The lack of significant affordable condo construction over the last few years has been attributed to builders’ concerns about lawsuits over defects in construction. This year we unanimously passed a construction defects accord that is hoped will spur construction of affordable condos without compromising Coloradans’ right to protect their most important investment: their homes. Similar bipartisanship resulted in the passage of SB 17-267, which fixes a glitch in our budget known as the Hospital Provider Fee. The bill re-characterizes the fee as an enterprise and saves our hospitals from more than $500 million in budget cuts. The same bill increased the Business Personal Property Tax Credit for small businesses and provides $1.8 billion over the next few years for transportation projects across the state.

We also passed HB 17-1090 to extend the Advanced Industries Investment Tax Credit program, which incentivizes investment in bioscience, aerospace, advanced manufacturing, energy, electronics, engineering and information technology startups. The program has created nearly 700 good-paying jobs at startup companies since 2014. I am gratified to report that 17 of the 19 bills I sponsored this session were passed, all with bipartisan support. I am most excited about my crime prevention justice reinvestment bill. For too long we have spent millions to redress the impact of crime after it has occurred. This bill goes to the source to prevent crime. The pilot program creates savings by reducing prison time for technical parole violations and invests the savings in the crime-impacted communities of north Aurora and southeast Colorado Springs for crime prevention. Local planning groups will assess their communities’ needs and target resources. For example, if job creation needs are identified, they could make small business loans to create good-paying jobs. As in past sessions, I also focused on juvenile justice. The Division of Youth Corrections has been an area of my special scrutiny for the past three years. I have previously sponsored legislation focused on increasing transparency in the division and to restrict the use of solitary confinement for juveniles. This year, moved by the publication of “Bound and Broken,” a report detailing the culture of violence in Colorado’s youth correction facilities, I sponsored HB 17-1329, an omnibus DYC

Ute Pass Regional Ambulance District (Florissant, CO)
reform bill seeking to transform the division to a more effective rehabilitative setting for our youth. It changes the name to Division of Youth Services and redefines the division’s purposes. It calls for a comprehensive assessment of all policies in the division to determine the cause of violence and creates a pilot program based on best juvenile corrections practices around the country. Additionally, I sponsored HB 17-1207, which prohibits the incarceration of 10- to 12-year-old children and requires the Department of Human Services to find community placement for children who commit non-violent offenses. I also passed HB 17-1204, Juvenile Delinquency Records Expungement, which provides for the automatic sealing of most juvenile court records upon the conclusion of a case so that our youth can move on and pursue a career or higher education. Working with Rep. Yeulin Willett from Grand Junction, we passed a bill emphasizing educating kids about the dangers of sexting, the sending of graphic images over the internet. In the coming months, I hope to serve on an interim committee to study how evidence-based and cost-effective sentencing reform could be implemented to ensure the best use of prison resources for the protection of public safety.
