The language of the legislation states that it would give those businesses a notice of the offense — rather than an immediate fine, as is now the result of minor violations — and 30 days to correct it before a fine is imposed (not including cases in which agencies are required by state or federal law to assess fines for noncompliance). “When you’re a small business, there are a lot of things you have to do … and sometimes there is confusion about what those things are and how to do them,” Beck said. “This is a less punitive way of getting those businesses to comply.” She said that the Chamber & EDC chose to support SB-1 because of the “collaborative approach” it takes to regulatory compliance, as well as the potential cost savings it creates for small business owners in cities such as Colorado Springs. Per the language of SB-1, state enforcement agencies would also be required to notify offenders of minor violations in writing and include instructions for corrective action. The bill would also allow offenders to request additional time (more than the standard 30 days) to address minor violations related to ad-

Founded in Denver by Bret Fund and Alex Kreilein in 2014, the business has established SecureSet Academy, a comprehensive cybersecurity education program created to grow the local workforce and partner with local businesses to fill open positions in the field. The first round of students at the new Colorado Springs location will begin a CORE Technical Bootcamp, a 36-week program to enhance networking and programming abilities. The bootcamp begins March 14 and participants receive a year’s worth of college credit from Colorado State University-Global Campus and Norwich University. SecureSet Academy currently rents space at New Horizons Computer Learning Centers, but plans to move into a new building to be constructed in downtown Colorado Springs by late spring. Fund said the company is working on final floor plans for its new location. The space will include classrooms, office space and conference rooms. “Colorado Springs has always been a goal and part of our story,” said Fund. “We want to be a part of an ecosystem here to fill this massive job problem that no city is immune from. We’re working with colleges, universities and corporations to do our part in taking in individuals with a technical background and providing them a premier education that sets them up as a cybersecurity professional.” The program is open to a range of applicants including military veterans and professionals in the private sector. In December, the Department of Veterans Affairs added SecureSet to its list of schools that can accept GI Bill funding from eligible veterans. This year SecureSet has secured a new round of financing for its academy and hired staff to bring its program to life in the Pikes Peak region, Fund said. One of its new hires is retired Navy Cmdr. Abe Thompson, a cyber warfare veteran, who took on the role as SecureSet Academy’s director about a month and a half ago. “We want to help people transition to the next phase of their career and build confidence in our graduates

A
bill currently moving through the Colorado Legislature aims to relax the regulatory burden for the more than 500,000 small business owners throughout the state. Since it was introduced to the Colorado General Assembly on Jan. 11, the first day of regular session, Senate Bill 1 has already garnered support from many Colorado Springs business leaders. “It just makes sense to us,” said Rachel Beck, government affairs manager for the Colorado Springs Chamber & EDC. The bill — which passed the Senate Feb. 1 under the sponsorship of Sen. Tim Neville (R-Littleton) and was introduced in the House Feb. 6 by his son, Rep. Patrick Neville (R-Castle Rock) — would enact the “Regulatory Relief Act of 2017,” which is designed to alleviate the fiscal impact of state regulation on small business owners. In essence, it would require state regulatory agencies to give small businesses — defined by the “State Administrative Procedure Act” as those with fewer than 500 employees — the opportunity “to cure a first-time minor violation of a rule instead of enforcing the rule by imposing a fine,” according to the bill.

After a long dry spell, VC finds Springs The issue: Venture capital investors frequently overlook Colorado Springs. What we think: Investors should take another look at the city’s growth in high-tech and cybersecurity.

or nearly 17 years, there’s been only a trickle of venture capital in Colorado Springs. Despite efforts by groups like High Altitude Investors, advice from the Rockies Venture Club in Denver and help from individual investors like Bill Miller — the city’s businesses haven’t realized much in the way of outside venture investment. That changed this week. Cherwell Software (see page 21) received a $50 million investment from the Next Generation Technology Fund of the New York-based private equity firm Kohlberg Kravis Roberts & Co. The company also has received investment capital from Insight Venture Partners. While Colorado ranks sixth in the nation for venture capital, the Springs seldom sees any of that money. According to PricewaterhouseCoopers, the state’s companies raised $138.6 million in the third quarter of 2016, up from $91 million for the same time in 2015. It’s a far cry from the $388 million California companies received in the third quarter of 2016, but it is positive news for the state’s startup companies and tech firms. It’s a sign that Colorado is being taken more seriously by venture capitalists around the globe — and the latest news could be a sign that the Springs is finally on their radar as a place for investment dollars. Colorado Springs and El Paso County are home to a number of startups and technology firms, but few receive the kind of attention that Denver and Boulder companies get from venture capitalists. That in turn creates a kind of catch-22. The
city’s tech sector isn’t as robust as those in other parts of the state — and that’s because it doesn’t have venture capital. But until investment firms get a strong sense that the city’s technology companies are on solid ground, they won’t invest. A year ago, Miller told the CSBJ that the local business climate has “never developed critical mass like some places. There’s just not the vibrancy of those cities. “Not very many people in Colorado Springs made their money in the technology business. They made it elsewhere. It’s not like in Silicon Valley or Boulder or Austin; they have the right critical mass of tech companies that create investments in other tech companies.” But as more Millennials opt to create their own firms, perhaps that equation is changing. Think about fledgling tech companies like Titan Robotics, which entrepreneur Clay Guillory started in his garage. The company’s now in an industrial warehouse and has attracted Silicon Valley’s attention. But Guillory is determined to stay in Colorado Springs. And that determination — along with others also building tech firms — could bring more investment to the Springs. Already, the city and county are reaping benefits from cybersecurity firms, software companies and technology businesses. El Paso County and Colorado Springs have seen wages grow at the fastest rate in 10 years as high-tech jobs bring higher salaries. And firms across the nation are noticing. Just last week, the Colorado Springs Chamber of Commerce & EDC announced a software firm was relocating from Chicago to the Springs, bringing with it the potential for 90 new hightech jobs. Colorado Springs is finally at a real tipping point — and that includes more than just a robust downtown or vibrant housing industry, although both are important. It also means the rest of the nation is paying attention to the city’s reputation as a cybersecurity hub and as a low-cost place to live, work and play. It’s about time that the Springs gets a share of the millions in investment pouring into Colorado. CSBJ n

Deconstructing city a plan worth exploring
I
n case you’ve managed to avoid the latest iteration of the city’s never-ending story of plans, plans and more plans, I give you PlanCOS. Underway for some time, the plan will create a framework for the grand metropolis that some of you will enjoy in 2036. In breathless bureaucratese, “Colorado Springs 2036 is a city that reflects its majestic landscapes and champions its ideals through renowned culture, vibrant neighborhoods, strong connections, unique urban places and a thriving economy.” Here are the “themes,” according to city officials, that will guide the righteous, creative, entrepreneurial, fully employed and bizarrely fit citizens of our fair city in that distant time. 1. Majestic landscapes: Celebrates the city’s location at the base of America’s Mountain and as a gateway to the Rockies, preserves its magnificent views and iconic sites and creates engaging natural areas. 2. Renowned culture: Promotes arts, culture and education as essential parts of life. In founding Colorado Springs, Gen. William Jackson Palmer deliberately envisioned a community where education and the arts are the cornerstones of the city’s sense of place and the creative energy generates new possibilities, interpersonal connections and unprecedented philanthropy. 3. Vibra nt neighborhoods: Forms diverse, safe neighborhoods with quality gathering areas, a variety of employment, a mix of housing types and transportation choices and a shared sense of civic pride. 4. Strong connections: Adapts to how we move by transforming our corridors to support future generations’ health and mobility needs, enhancing economic vibrancy, upgrading infrastructure and regional connectivity. 5. Unique urban places: Centers on a vibrant downtown and is strengthened by reinvesting in walkable, healthy and interesting urban spaces located in new and reinvented areas within the defined city boundary. 6. Thriving economy: Fosters an environment of inclusivity and economic diversity by attracting an innovative and adaptive workforce, investing in quality of life, supporting military and existing, targeted employment sectors. That’s fine, I guess — but before we get all idealistic and high-falutin, it might be useful to take a clear-eyed look at our city. Is there a “Colorado Springs community?” Or are we a polycentric array of commercial/residential centers, chained together by artificially created administrative entities? Rather than make regional plans to increase and strengthen
the chains, shouldn’t we loosen them? I’d argue for the latter. By deconstructing the city, we could allow currently disempowered communities to determine their own fates and have their HAZLEHURST own seats at regional, state and national forums. Here are some potential communities of interest. • Militaria/Fountain Valley. This new city would include much of southeast and east/southeast Colorado Springs, as well as Widefield, Security and Fountain. These generally less-affluent neighborhoods deserve the kind of powerful national voice that incorporation as a new city would instantly provide. • Technoburbia. This includes roads, roofs and shopping, most of the comfortable suburbs of northeast, north and northwestern El Paso County. Anti-tax conservatives will have to step up and pay full price to build, maintain and sustain their sprawling paradises. You’re smart, hardworking and immensely capable — and will probably outgovern the rest of us! • Libertopia. Downtown, the Westside, Manitou, the North End, and east to Academy. OK, you know-it-all liberals, let’s see how well you can run a city. Suggestion: Retain Utilities in the deconstruction, then sell electric generation to Xcel. Goodbye Drake; hello downtown boom. • Anschutzia. Broadmoor, southwest suburbs, Skyway and Gold Camp Road. Enjoy a secure, low-tax, comfortable and tranquil life — and figure out how to keep those scraggly forests from burning. Deconstruction isn’t on the PlanCOS agenda and never will be. Like the 199394 strategic planning process that focused on “the future of the greater Colorado Springs area,” it will end with a hopeful, data-stuffed document that will figuratively molder away in thousands of document files. Packrat that I am, I still have several green-bound volumes of that eight-volume report. They don’t make interesting reading, but there’s a lot of it — more than 1,000 pages. Here are the opportunity-driven economic targets: “Aviation, airport land opportunity, heavy manufacturing, Hanna Ranch land and Fort Carson land opportunity (if base closes).” In retrospect, the planners should have listened to Doris Day. “Que será, será / Whatever will be, will be / The future’s not ours to see / Que será, será.” CSBJ

Brown leaves Westside after 15 years By Bryan Grossman
A
fter overseeing operations at Westside CARES for the past 15 years, Stephen Brown, executive director of the ecumenical and interfaith nonprofit, will step down at the end of June. Brown has been instrumental in the organization’s growth, including its move from a cramped church basement into a building of its own facing a bustling Colorado Avenue. The growth is bittersweet. While resources grow, Brown said, so does the number of the needy in the region, despite the concentration of local nonprofits. Brown spoke to the Business Journal this week about caring for those who cannot care for themselves and leaving the organization he has come to love in the hands of a yet-to-be-determined heir. Where are you from? I’m a preacher’s kid and was born in the Yakima Valley in Washington. I lived in Seattle and Boise and Spokane, which is where I met my wife. We got married and moved to Kentucky, where I went to seminary. I had been a respiratory therapist and had gotten dual bachelor’s degrees in health services management and health education. I thought I’d be going into health care. But instead I went to seminary and afterwards I was a pastor at a church in Idaho. I then moved to Germany with my wife, who had a civilian job with the Army. That job moved us to Fort Carson in 1998. What did you do for work? I drove a food truck for [Colorado Springs School] District 11 my first year here. I also worked as a half-time chaplain at [senior living facility] the Village at Skyline. I came across this position with Westside CARES, which was for 30 hours a week, in 2002.

Talk about the organization. We’re interfaith and that’s a pretty unique marker in this county. … We’ve been in existence since 1983 and were pulled together by a number of churches to provide basic emergency services to people in need on the west side of El Paso County. … We do a lot of help with food. We have six food pantries that, all told, gave about 24,000 people four days of food last year. … The most expensive things we do are around housing — we got a grant from Colorado Springs Utilities and its [Project] COPE program. We’ll spend $170,000 to $180,000 of [CSU’s] money to help people keep their power on. We’ll also spend above $50,000 from other sources in helping with housing and rental assistance. We help up to 12 households a month with not more than $300 towards next month’s rent. Do you provide any other services? We have a nurse from Penrose-St. Francis [Health Services]. They pay for her but she functions as a member of our staff, so we can provide medical assistance like copays on medical visits, prescriptions and referrals to specialists. We do significant work with helping people with clothes. … We get a nice pile of vouchers each month from Discover Goodwill that amounts to about $40,000 [annually]. We also give away about another $40,000 in clothing from in-house donations. What’s your budget? Last year our cash income was about $340,000 including grants. … But an enormous amount of food in our food pantries is donated. And we can’t
monetize it, but we do express a monetary value of volunteer hours. It was about 27,000 hours of volunteer time last year. We have a pretty modest cash budget, but from it we’ve leveraged about $2.5 million in value. Who does Westside CARES target? I’d say, probably 10 or 15 percent of the people who come in here are homeless. The rest are poor, chronically poor and living on the edge of financial viability, or we see a significant amount of people who never thought they’d be in a position like this but are because of job loss or sickness. How has this position changed in 15 years? I didn’t imagine when I started and was working 30 hours a week that we’d be in our own building, that we would have as many paid staff. There are five of us. … I did not start this work with the intent to grow it to this size or position. It’s just kind of moved that way. But I’ve learned to be single-minded in focus on the mission and attentive to how we shape the mission. I’ve learned to claim it and own it and make it memorable and concise and repeatable — and to never waiver from it. With lots of nonprofits, there’s often a shiny thing over here, if they just do ‘this’ program. I consider that to be detrimental to stability and only with stability can organizations grow well. How would you assess the community’s progress in addressing poverty? This is true of Colorado Springs and I believe it to be true of the nation as a whole, and that’s that the middle class has been eroding in the last 30 years. It’s partly why we see folks who never imagined being here having to come in now. Their security has been eroding. As a society we’ve found ways to compensate so we haven’t felt it as much, but that ability to compensate, I think, has hit a limit. In the ’60s, a lot of households had one earner. Then, in the ’70s, ’80s and ’90s families were becoming two-income families and that allowed for stabilization and prevented further erosion. Why is it still an issue? The two sectors in society with the most dramatic cost increases are higher education and health care. … Some of health care has been addressed, although I’d say inadequately and incompletely. … But perhaps the most pressing issue in this town is affordable housing. I just heard we need more than 6,000 housing units … and a lot of the permits being pulled aren’t for affordable housing. We have downward pressure on the affordable housing that is available. We have apartments that are $800, but someone who can afford $1,200 a month might take it. And then what about the person who can only afford $800 a month? And what if that $800 is 60 percent of their household income? Those people are in an untenable and unstable situation. Do you think nonprofits should collaborate to reach the underserved? I think there could be better coordination. I think, informally, we know each other very well. … But coordination could be improved. … One thing that chronically worries funders is a duplication of services. Our answer to that is, if you sum up all of the services in the community, duplication is not the issue. Volume of services provided is the issue. CSBJ n

Bills are first step in affordable housing solution
H
ousing prices have been on the rise for a couple of years now, and while that’s good news for a robust and growing economy, first-time homebuyers are having a harder time finding affordable places to live. But thanks to a couple of Senate bills winding their way through the General Assembly, homebuilders S W E E T and developers might once again consider condominiums — something that isn’t popular in Colorado right now because of the way construction defects are litigated. The threat of lawsuits continually drives up both the cost of building and insurance for the complexes. Two bipartisan construction-defects bills — something that legislators failed to pass last session — seek to solve legal issues that developers claim is hampering their ability to build condominiums in Colorado, frequently the entry point for young couples and new homeowners. Senate Bill 156 requires homeowners first to go through mandatory arbitration and mediation before filing suits based on faulty construction. Mediation would come first, and would be handled by an outside third party. The bill would also require homeowners associations to obtain written consent from a majority of owners in the development in order to pursue litigation— and would allow the association to put in super-majority requirements in their covenants. Senate Bill 45 addresses defense costs of litigation once lawsuits are filed. Essentially, the bill gives courts the ability to evaluate the level of contractors’ responsibility and decide their portion of litigation costs. It

removes requirements for developers to pay for attorneys from the time the suit is filed through the settlement process. This bill has bipartisan support, but must work hand-in-hand with SB 156, developers say, for it to have a lasting impact on the construction industry. The goal is to ease insurance requirements and costs for construction companies. At least four more bills are expected to address the construction-defect issue in the legislature. House Speaker Crisanta Duran told the Denver Post earlier this year that precision bills might be passed more easily than a broad catch-all approach to the legislation. And as more people pour into the state, the legislation is needed to revive affordable housing construction throughout Colorado. Why are these bills necessary? As it stands, a single suit from one homeowner affects every owner in a condominium complex — even buildings without construction issues. Mortgage lenders won’t allow people to buy in the complex until litigation is complete, and that sometimes takes years. As more people opt for renting, it further pushes down the number of buyers available for the condos, because lenders also are hesitant to lend money when there are large numbers of renters in a development. Many affordable housing proponents believe tort reform in the condo market is vital to making sure people can afford their first homes. As housing rates rise — the average price in Colorado Springs is more than $260,000 — condos could be a viable option for people who can’t afford the more
expensive options available right now. More than 17 communities with a combined 2.5 million residents have passed local ordinances promoting owner-occupied condo development. Colorado Springs, Denver, Aurora and Fort Collins are on that list. And while action at the local level is important, the difference in ordinances makes it difficult for builders to ensure they are complying with laws that vary from district to district, town to town. Currently, the only condo construction is in the highend, luxury developments — not in the affordable housing range. These bills could solve a pressing problem in Colorado Springs. Economists forecast that the city needs upwards of 5,000 new homes a year to keep up with growth. According to the 2016 numbers from the Pikes Peak Regional Building Department, there were 3,237 single-family homes, 277 new townhomes, three condominium developments and 50 multi-family developments. There’s room at the lower end of the spectrum for condominiums, which are a way to attract Millennials to the city’s core. These two bills are a way to protect owners while also keeping costs down for builders. And both have passed the first hurdle of the General Assembly. As both are bipartisan efforts, hopes remain high that the legislature will act to address the construction industry’s concerns. While the legislation might not be the perfect solution, it seems to be a viable start to fixing a long-standing problem. CSBJ

A NEIGHBORHOOD FIGHTS BACK “When we got the notice for judicial review, and the request for attorney fees and costs, we were concerned,” said Tom Fellows, who heads the Highway 115 Citizens Advisory Committee. “But we weren’t intimidated. For us, it’s an existential issue.” The present mining plan calls for quarry operations to continue for 50 years, eventually covering more than 400 acres. Neighbors believe that the mine, if eventually approved, will at best radically devalue their properties and at worst render them uninhabitable. “The coolest thing that has come out of this whole process has been that we’ve become a neighborhood,” said Kristan Rigdon. “We really didn’t know each other that well before, but now we have fundraisers, chili cook-offs, summer barbecues — it’s been great getting to know everyone and come together. My husband is an electrician, and when there was a power outage he went through the neighborhood hooking up generators and helping out.” “We’ll see what happens,” said Fellows. “We’re all in on this — we’re not going to back down.” CSBJ

Hall pursues passion for arts By Cameron Moix
M
att Hall has accomplished a great amount in his 29 years: from becoming an artist and model to acting in and producing plays. Among the Washington native’s exploits is the co-founding of Dragon Theatre Productions, a theatrical program of Colorado Springs-based nonprofit Imagination Celebration that inspires people to pursue their passion for the stage regardless of sex, age, race, experience-level or ability. This week, the Business Journal spoke to Hall and his mother, Jane, about his impressions of the local community, his latest projects and proudly pursuing his dreams. Tell us a little bit about yourself and your background. My name is Matt Hall, and I am a 29-year-old young man with Down syndrome who has lived in Colorado Springs for the last 16 years, having moved from Bellevue, Wash., with my mom and dad. I graduated from Cheyenne Mountain High School, having earned both academic letters and a sports letter in swimming. I was on the swim team all four years of high school, swimming in both individual and relay events. I really enjoyed high school here, as the teachers, staff and other students were all very friendly and supportive. I have always enjoyed the performing and creative arts, having started with dance and movement classes when I was 3 years old.

How did you become interested in theater? My involvement in the theater was a natural step after first being involved in dance, and then becoming a model for Nordstrom’s and Lands’ End catalogs. … The modeling led to a walk-on part in the movie “Mad Love” with Drew Barrymore and Chris O’Donnell. Unfortunately, I ended up on the cutting room floor, but got to spend an entire day on the set shooting. I then became involved with the Bellevue City Parks Department youth theater group, and that is where I really caught the bug. ... After graduating from high school, I found there were only limited opportunities for community theater in Colorado Springs, so I joined a theater class at the Club of Arts and met the teacher Cyndi Parr. Cyndi and the Club of Arts were interested in forming a “true community theater group,” which means if you are willing to make the commitment to be in the production, we would make a part for you! Over the years, we have grown into an annual production each summer, and created “Dragon Theatre Productions.” We are a program

With over 100 people involved in the productions each year, I get to work with lots of fun, creative people who come together to make the plays a success for everyone. As co-founder and producer of the group, I get to be involved in every step of the process, from picking the plays, to tweaking the scripts and helping to create the costumes, props, special effects and lots more. I understand that you’re also an artist. Can you tell us a little bit about that? I really love to draw and to create mosaics from glass and tile. I find creating is relaxing and lets me express things I am thinking about. I usually don’t sell my art work, but I have a few times, and donated some to various auctions for fundraisers around town. I create my mosaics in a weekly workshop hosted by Concrete Couch and I really enjoy the creative, fun atmosphere with my fellow artists. Let’s hear more about your modeling work. How did you get into that? My mom leveraged some contacts to get me into the running to be a model for Nordstrom’s. After submitting a headshot and bio, I was selected to come in for a catalog shoot, and the rest is history. What do you think of Colorado Springs as a community for young professionals? I think Colorado Springs is a great place for young professionals as everyone here is so supportive and there are so many activities to be involved in the arts, in government and politics, sports and outdoor activities. I am always meeting new people that want to get involved in Dragon Theatre, or Special Olympics or Colorado Springs Park Department programs. People in Colorado Springs are very energetic and positive. You’re involved with the Special Olympics and the Colorado Springs Down Syndrome Association. Can you tell us about those experiences? Special Olympics and the Colorado Springs Down Syndrome Association have provided a number of opportunities for me to participate in sporting and social events. For me, both of these organizations provide fun and safe environments to enjoy golf, bowling and social events like dances and parties See Theater page 21

ouis Savaglio’s first car was a rust-riddled 1938 Ford, bought for $30 when he was 13. It was also his first business lesson. “I bought it at one of the bodyshops I hung around,” he recalled. “It had surface rust all over, and he had a grinder there but he said, ‘You gotta handsand it!’ He knew I wasn’t going to finish the job, and he’d get the car back for nothing. “I went there and sanded every day for two weeks on that one fender — sanded and sanded until my fingers were raw — before I wised up and realized this ain’t going anywhere. “I said, ‘You know what, this isn’t working out, I’m never going to get further than one fender.’ So I gave him the car back, and he didn’t give me my money back. Learned my first lesson at 13 years old.” Today the ’38 Ford is a collector’s car, and Savaglio has one just like it — minus the rust — among the classic, antique and specialty cars he sells at the Auto Gallery on the edge of downtown Colorado Springs. He hid that first ill-fated deal from his parents —

money, and I don’t have to be a slave to my property,” he said. “That’s why I can come in at 11 o’clock.” Savaglio bought a South Wahsatch Avenue office building one-quarter the size of his Illinois showroom, and spent almost six months on the remodel. Most of his inventory was sold at auction in Spring Grove, but he brought eight beloved antique cars with him and has since rebuilt his stock at auto auctions around the country. Savaglio admits it’s been a big adjustment. He misses the foot traffic he had in Illinois, and the regulars who had come to see him for decades. “I was doing more local business there because after 20 years, people know you’re there,” he said. “And this will happen here — of course I don’t have that same amount of time, I’m 71 years old — but I’m doing what I like, so life is good.” These days, most of Savaglio’s business is online — an interesting turn of events for a man who insists he’s “dangerous with the internet.” “I don’t know anything about it, I don’t want to know, I don’t care,” he said. “I don’t have any smartphones, I wouldn’t know what to do with it — I like dials and knobs better.” Savaglio takes 20-30 detailed photographs of every vehicle for the website and his wife, Patrice, handles the online side of The Auto Gallery. In a small tale of just how much the business has changed, Savaglio said the classic Audi he recently sold and readied to ship from the Springs is going back to Illinois — to one of his old customers — who saw him on television, buying the car at the famed BarrettJackson auction in Scottsdale, Ariz. Every inch of Savaglio’s showroom is packed. There’s the 1953 Porsche Pre-A Series Coupe, 1962 Mercedes

“This car’s worth more than my building now.” Every vehicle has a bulging file. “Paperwork — provenance, they call it — is what sells these old cars,” Savaglio said. “It’s like artwork, you know?” As well as sales, Savaglio offers appraisals, consignment, transport and shipping. He said his move to the Springs has been “like starting all over again, but with a little more experience and a little more capital on hand.” “I just want to keep going,” he said. “I’ll be here every day until I can’t do it anymore.” CSBJ n

Cybersecurity risks for nonprofits W By Amber Baillie
hen it comes to cyber vulnerabilities, no business is exempt. But for nonprofits, the stakes are different. Charitable organizations maintain client records and donor information that, if compromised, could potentially put an end to their mission. So how do nonprofits invest in complete security measures with limited budgets and staff? To give nonprofit professionals more perspective, UCCS’ College of Business hosted a two-day seminar Feb. 15 and 22 about basic cybersecurity terminology, organizational impacts from cyber incidents and methods nonprofits can use to tighten systems to include implementing consistent security policies, password protection and employee training.
RISK MANAGEMENT Bill Ayen, senior instructor of information systems for the College of
Business, hosted the seminar, where he shared tips on protecting sensitive information. Continuing to identify security risks within an organization is essential, he said. Nonprofits should develop checklists or scenarios to identify risks early on. “It’s easy to identify a risk after it happens, but if it’s after the fact, an organization’s options are limited,” Ayen said. “Come up with scenarios and say, ‘What if this happened now? What are some of the current vulnerabilities?’ Sit down with staff to brainstorm what is at risk.” And prioritize risks specific to leadership roles, Ayen said. “The IT guy doesn’t understand from an enterprise standpoint what the biggest impact is for the organization, because he only knows bits and pieces,” he said. “By evolving at the highest levels, you can determine the impact from an entire organizational standpoint.” Risk impacts are considered either qualitative or quantitative, according to Ayen. Quantitative risks use hard data
within an organization to measure an incident’s financial impact, whereas qualitative risks use soft data and scenarios to gauge impact. “And once you’ve identified threats and vulnerabilities and have implemented mitigating controls, an organization will reduce risk, with only residual risk remaining,” he said. “It’s impossible to eliminate all risk, but [these are — Bill Ayen good steps] to becoming more secure.”

A lot of companies don’t have protocols in place, especially nonprofits, when people transition out of the organization. If someone is no longer employed, within two hours, do they still have access to the facility or database?” And volunteers should not be ignored when it comes to security, he added. “The risk could be an insider such as a volunteer, vendor or contractor; some-

DOWNTOWN one who is given inside information,” he said. “Pay attention to their access.” A nonprofit’s reputation is vital as they’re dependent upon the trust of donors. Ayen said if a nonprofit has an incident that erodes trust, the organization could easily go out of business. “It not only hurts them but their clients,” he said. “If clients’ data is compromised — say credit card or personal information — [the nonprofit] will lose clients, which could lead to [not making] payroll next month. They can’t go to their stockholders and get more [money].” Dana Lightsey is the minister of High Plains Church Unitarian Universalist in Colorado Springs. She said the organization consists of four paid staff and relies heavily on its volunteers. “We have about 70 [people] a year who help with everything from working at the soup kitchen [to] helping with finances and building and grounds maintenance,” she said. Lightsey said the UCCS session shed light on needing a systematic approach to security, for both employees and volunteers. “It just seems like security is becoming more of a concern all of the time,” she said. “We need to make sure the right people in the organization know how to access different things for backup. Who does have access to QuickBooks? Do past treasurers still have access? We have to keep track of what is going on with everyone connected to our finances.”
EMERGING THREATS Since the National Cybersecurity Center started operations in November, the nonprofit has supported five organizations following a cyberattack. NCC Chief of Staff Eric Hopfenbeck said a popular attack during tax season includes hackers attempting to obtain sensitive information via email. “They will try to get an employee to send them their W-2 tax form so that they can sell it on the Darknet,” he said. Hopfenbeck said nonprofits can take other basic measures to enhance security, such as educating employees on the danger of clicking on unfamiliar emails or attachments; securing Wi-Fi with complex passwords; encouraging employees to change passwords regularly and using anti-virus software. “This does not mean the organization is fully protected,” he said. “It is simply the first line of defense.” Awareness and training is key, he said, with 70-80 percent of cyberattacks carried out through email, in the form of phishing — where a hacker sends an email and requests sensitive information from the recipient. The NCC provides high-level trainings for C-suite employees and board directors and can assist nonprofits, he said. “Currently we have limited operations to respond to a cyber attack, but we are hoping to build that out over the course of 2017,” Hopfenbeck said, “We will also have an education and training component fully operational later this year.” CSBJ n

The developers of Victory Ridge — a 153-acre, mixed-use development formerly known as Colorado Crossing in northern Colorado Springs — said the project could eventually include more than 500 residential units, more than 400 hotel units, well over 100,000 square feet of retail space and a number of office buildings. The site, located at the southeast corner of Interquest and Voyager parkways, will also serve as the future home of the Scott Hall Field of Dreams sports complex.
Another of the three existing structures at the Victory Ridge site is a partially finished 110,000-square-foot office building with panoramic views in every direction. Developers say the top floor of the four-level structure will feature large western-facing verandas overlooking Pikes Peak, the Air Force Academy and the Front Range. Moore said that work to finish the building should begin in the next six months, with completion coming sometime in 2018. “The office building is still open to the elements but still in remarkably good shape,” Moore said. “I would call it about 50-percent complete. I think that it had gotten to about 65-percent complete and we’ve had to take a few steps back because of that, but that’s still a great head start.” The developers have already undertaken a complete redesign of the building’s exterior in order to modernize its now-dated façade. General contractor GE Johnson will complete the construction of the facility using materials including glass, stone and aluminum.

Moore is a principal of Denver-based company Westside Investment Partners (along with Andy Klein and Kevin Smith), which purchased the property in October for $22.1 million. Moore said the company will finish construction on the site’s three existing structures before moving on to the first phase of new development, and that the theater is likely to be complete within six months.

Moore said his company is currently in the process of selling the movie theater’s operations to Texas-based Icon Cinemas — a deal he expects to be finalized this month. The theater was originally slated to accommodate 2,500 seats, but Moore said he plans to “completely convert them to 100-percent leather recliners with VIP service, wine and beer service and move more toward that bistro concept that we’re starting to see in other areas.” Moore said he isn’t concerned about competition with nearby movie theaters because of what he called a “regional demand” for upscale cinemas and other entertainment destinations. After the existing structures are complete, Moore said he hopes to start the first phase of new construction at the site, which is slated to include the development of up to 90,000 square feet of retail space for shops, restaurants and other businesses. “I think the overall goal for the development is just 24/7 activation,” said Whitney Johnson, one of the CBRE brokers representing Westside Investment Partners in leasing space to future tenants. “With the Field of Dreams and the movie theater and the possibility of having multi-family housing on-site, our goal is just to make sure that it is being used the best way it can every hour of the day.” Moore said he is also in talks with city officials about the possibility of securing tax increment financing for the development. Analysis: Cultural shift part of FAC merger By John Hazlehurst
A
s the four-year process of merging the Colorado Springs Fine Arts Center with Colorado College moves slowly along, it seems a cultural shift is already well underway. That shift has impacted the Fine Arts Center, but a recently created draft statement of a “museum subcommittee” created as part of the strategic planning process predicts cultural ferment, new creativity and institutional change at both CC and the FAC. If one were to ask Erin Hannan, executive director of advancement and external affairs at the FAC, the acquisition couldn’t have happened soon enough. “If the successful and very natural collaborations we’ve already seen out of the gate are any indication of what we can expect for the future of the FAC at CC, I think we’ll look back and ask ourselves why we didn’t do this sooner,” she said.
A LONG PROCESS The 11-member subcommittee includes FAC benefactor Annette Seagraves, Art Bank owner Blake Wilson, FAC Curator Joy Armstrong, Downtown Partnership CEO Susan Edmondson, attorney Bruce Warren, IDEA Space Curator Jessica Hunter-Larsen and five CC professors. The draft defines the museum’s central mission, as well as the fears and aspirations of the diverse communities of interest that either welcome or fear the merger’s consequences. “The aim of the CSFAC at CC will be to explore, challenge and transcend traditional definitions of what a museum can be,” the draft asserts. “The museum will embrace its function as a cultural destination — but it can also be more. Possibilities include a center for interactive and experiential learning, a laboratory for new ideas, a place of solace, a creative nexus for
artists, a hub for the exchange of opinions, a platform for inter-community communication, a destination for fun and enjoyment and more. Ultimately, the new CSFAC at CC museum will celebrate the power of arts to inspire people, spark learning and forge equitable communities ...” The museum’s central mission, according to the draft, is “to present excellent exhibitions that expand awareness of diverse cultures, ideas and modes of artistic expression from across the globe, while also respectfully showcasing the cultures of the Southwest and the Americas that are part of the shared history of our community.” The draft also emphasizes that “renewing our commitment to nurturing relationships with Native communities would not only deepen interpretation for museum audiences but also provide a national model for collaborative care and interpretation of Native objects.” While the dense verbiage of the preliminary drafts seems to reflect — Strategic uncertainty, that may be a byproduct of the whole strategic planning process. “Consistent through the groups and online responses was a desire for the museum to be more relevant and accessible to today’s citizens in Colorado Springs as well as to the campus,” the draft states. “Fears were expressed on two fronts: First, that the CSFAC at CC would become even less accessible due to the CC ‘bubble’ and new academic museum status; and second, that the museum would not embrace the student and faculty perspective.” Going forward, how will the museum deal with these different constituencies?
“Going into the new CC/FAC alliance, the strategic planning process offered us an incredible opportunity to conceive the institution of our dreams,” said FAC Curator Joy Armstrong. “We listened intently to the community, both of the college and Colorado Springs, to hear what people already love about the FAC and what they would like to see transpire with our new partnership.” According to people close to the process, conflicts over the path forward are already being replaced by cross-institutional collaborations. After all, founders Julie Penrose, Elizabeth Sage Hare and Alice Bemis Taylor created an arts center, not just an art museum. They understood the power of the artistic community. Interactions between visual and performing artists, audiences, students, collectors, visitors and city residents were the FAC’s raison d’être. With low muscle tone it is extra work for me to walk around [and] move, and that makes clear verbal communication difficult. Transportation is mostly handled by my mom and dad. I have found people very supportive in working to communicate
with me, as they usually take the time to listen and give me feedback or ask questions to help me communicate my thoughts to them. What advice would you give to other young professionals in Colorado Springs? Find what you love to do and go for it! I love the theater and the entire creative process to produce a play, and have found a very supportive network of other artists that have come together to create this unique and ongoing theater group. Colorado Springs-based tech firm Cherwell Software announced this week that the company has received a $50 million investment to bolster operations and service offerings. The investment came via the “Next Generation Technology Fund” of New York-based private equity firm KKR (Kohlberg Kravis Roberts) & Co. LP, which specializes in leveraged buyouts and invests heavily in the tech industry. Since 2012, a major investor in Cherwell (10125 Federal Drive, Ste. 100) has been New York-based private equity and venture capital firm Insight Venture Partners. According to a release, the company will use the $50 million to “accelerate research and development and make strategic investments aimed at broadening and deepening its portfolio of IT and enterprise service management offerings.” Vini Letteri of KKR will join Cherwell’s board; he is KKR’s director of private equity and TMT (technology, media and telecommunications) growth. “With IT teams’ increasing importance within organizations, ensuring there is no interruption to IT services and that customer satisfaction is high are paramount to any business,” Letteri said in the announcement. “Since its founding, Cherwell has been entirely customer-centric in its focus and is led by a seasoned, passionate, and industry-leading management team. Its platform provides unparalleled value and the ultimate flexibility to its customers to operate in any industry and in any environment — on premises, cloud or hybrid.” According to Cherwell, 2016 was a record-breaking year for the company, as the firm saw its highest number of bookings and new customers. The company also acquired IT consulting firm Advanced Marketplace and formed strategic partnerships with Microsoft, Azure and Amazon Web Services. “KKR’s investment in Cherwell is validation that our core principles and areas of focus will continue to drive phenomenal growth and fulfill our goal of being the best service management solution on the planet,” said Cherwell CEO Craig Harper, who replaced founder Vance Brown as CEO last year. “The Cherwell Service Management platform offers extensive customization coupled with low total cost of ownership. Our codeless platform enables IT teams to configure and extend the platform in virtually limitless ways under a single, all-inclusive concurrent licensing model. We also offer a broad range of deployment and licensing options that empower customers to do business in a manner that suits their needs both from a business and technology perspective.” The International Data Corporation (a market research firm) named Cherwell as one of the fastest-growing vendors in the 2015 edition of its “Worldwide Problem Management Software Market Shares” report. “We have grown 341 percent over the past three years in our core market,” Harper said. “We currently have around 450 employees around the world, about 280 of which are based here in Colorado. I anticipate that we could double the size of our employee base in the next year or two. With the support of KKR’s investment, we will be able to accelerate Cherwell’s R&D efforts and our increase our rate of innovation. Matt Barrett, board chair of the Tri-Lakes Chamber of Commerce, said that the bill is a welcome step toward making Colorado Springs — and the state at large — a more friendly environment for small business. “I’m more optimistic today than I was four years ago,” he said in reference to what he considers a stemming of the regulatory tide. Barrett, who formerly served as CEO and executive director of the Better Business Bureau of Southern Colorado, is also a small business owner. He is a partner in Business Truths Consulting, a firm that specializes in serving small businesses, and said that SB-1 would begin to reform a system that has long been fraught with over-regulation. “I think it’s like most things in life in that it’s the pendulum effect,” Barrett said of the timing of the legislation. “There was a time when there weren’t enough regulations, and businesses ran wild, so the pendulum started to swing the other way. Now, I think we’re at a point when regulations are a little extreme and make it difficult to run a business — especially a small business.” Barrett said that most of the small businesses he works with are run by owners who wear all the hats; making it difficult to keep up with detailed record-keeping and the paperwork it produces. “Most businesses can’t afford an entire department devoted to those things,” he said. “In a small business, the owner is often the one who does everything … and when they are pulled aside to deal with penalties and paperwork, it sucks their time and energy away from making the business better. It dampens their ability
to be successful, profitable, to hire more employees and to help improve the economy.” Although he admits that not all Coloradans operating small businesses deserve breaks — some do set out to break laws, dodge regulatory agencies and seek out loopholes in the system — he said that it’s worth the risk in order to relieve the good actors in the state’s small business scene. “You’re always going to have the bad eggs,” he said. “But I think this is intended to be more along the lines of helping the good eggs become better ones.”

that they have what it takes in the cybersecurity industry,” he said. “We’ve been establishing our company and class schedule in Colorado Springs, and I’m looking forward to developing more relationships and community partners.” Some of its hiring partners include Booz Allen Hamilton, Zayo and TEKsystems. There are currently 15 students enrolled in CORE Technical Bootcamp; ages range from 20-60. Thompson said he hopes to grow the incoming class to 25 students before it begins and added Colorado Springs is poised to be a hub for cybersecurity. “We believe it’s the right place, right time and no question, the right people,” he said. “Certification is not our only end result with our program, also excellence in performance.”

ACCELERATOR Another aspect of SecureSet is an accelerator it plans to bring to Colorado Springs in the near future, growing local cybersecurity startups through funding, partnerships and mentorship. Financing is what’s needed right now to get it going, Fund said. “Both entities have their own growth
trajectory and place in the market,” he said. “Both include broad missions of bringing resources into the company through different processes and operations.” The accelerator will be a 16-week program aimed at helping cybersecurity startups gain traction, enhance products and raise funds, according to the SecureSet website. City could lead in cyber manufacturing
W
hy shouldn’t Colorado Springs lead the nation in cyber manufacturing? Imagine this: an advanced Colorado community that boasts digital connectivity among its manufacturers, similar to Amazon’s own distribution systems. But it is cyber-secure via a Colorado Springs project called COS Cyber FELTMAN Manufacturing Enterprise. This Colorado network will improve security and cultivate new ideas that would foster innovation. The U.S. manufacturing sector is on the brink of reinvention, regaining lost opportunity and opening new frontiers in fresh, innovative businesses. Collaboration and strategic partnerships among federal and state authorities with commercial and industrial businesses will give small- and medium-sized manufacturers the boost required to compete. This renaissance of manufacturing will give Colorado Springs and the United States the leading edge as a result of fluctuations in the economic engine. Traditional, limited-use manufacturing plants require capital-intensive investments (a large physical plant) that can quickly become outdated. To compete, manufacturers need to provide more responsive, less costly processes, which in turn will create opportunities for a more highly trained workforce. This initiative will position Colorado as a leader in the development of a new industry approach to cyber-secure manufacturing in which high-quality products can be customized and delivered locally with the cost structure of a mass-manufactured product. The Cyber Advanced Manufacturing Initiative will transform manufacturing into a “cloud-based service” to produce high-value components by combining cyber and information technology with adaptive manufacturing technologies (for example, 3D printing). The initiative will develop a network of small- and medi-

um-scale businesses spread across the state accessing an intelligent, centralized database of manufacturing “applications.” Similar to how a company’s branch offices electronically access a corporate office document and tailor it to optimize its impact on local customers, this initiative creates a distributed, virtual manufacturing ecosystem with the capability to translate clients’ needs into a product that can be immediately produced locally. To grow this capability, the initiative will also include workforce training and a knowledge development structure for the intelligent applications. This is manufacturing “when you need it, where you need it and how you need it.” Colorado Springs can become the leading community along with more than 170 industry, academic and government partners via the Digital Manufacturing Design Innovation Institute in Goose Island, Chicago — leading the conversation that the Department of Defense should prioritize securing manufacturing’s cyber processes. The growing cyberthreat to industry and public sector organizations requires a sustained and coordinated effort to combat it. Reported cyberattacks have grown by 600 percent since 2010, and in 2014 manufacturing was targeted with the greatest volume of spear-phishing attacks of any sector. Given current trends in advanced manufacturing, no other area of focus could deliver the greatest economic impact for manufacturing or demands such urgent attention as a matter of national security. The cyberthreat is real, and the digital thread magnifies that threat. The digital thread connects sensors, machines and IT systems throughout the value chain to an unprecedented degree, and the resulting aggregation and analysis of data is enabling faster and more efficient manufacturing processes.
The heightened threat of cyberattacks in manufacturing has been reinforced by DMDII’s industry membership base. In April 2015, DMDII industry membership characterized cybersecurity readiness: “On a scale of 1 to 100, we are at a 0.0001.” According to one of DMDII’s Tier 1 industry partners, large original equipment manufacturers are not taking necessary precautions. Even when companies have the resources to address manufacturing cybersecurity, no effective mechanism exists to support the dissemination of information and best practices among groups. Furthermore, organizations often avoid collaboration because they don’t want to lose proprietary data and competitive advantage. If companies of all sizes connect machine tools to the internet to provide supplier transparency and predictive analytics, organizations will have to address cybersecurity in a much deeper and more meaningful way. In 2014, when approximately 2 billion people connected online, the internet contributed about $1.7 trillion to global GDP. The impact when 50 billion smart machines — deployed across factory floors, through supply chains, and in consumers’ hands — can connect with one another, could prove to be even greater. The potential threat and impact of successful security breaches tied to deployment of the digital thread necessitate a proactive approach to ensuring that advances in cybersecurity technology maintain pace. This is something the Springs can lead nationally, a similar mission to the National Cybersecurity Center. Natural resource issues still area of focus
W
e recently held our organizational meeting in the Natural Resources Committee, which gave members an opportunity to discuss their priorities for the next two years and vote on committee rules and procedures. Since arriving in Congress, much of my focus has been on the many natural resources issues that impact the Third Congressional District on a daily basis. Natural Resources Committee Chairman Rob Bishop has a deep understanding of these issues, and I am looking forward to working with him to get some of our district’s priorities over the finish line. These priorities include bills like the Water Rights Protection Act, the Healthy Forest Management and Wildfire Prevention Act and the Planning for American Energy Act, which are all bills I am looking forward to re-introducing in the 115th Congress. Water policy is a critical issue for Colorado. The farming and ranching community, the ski industry and countless others rely on Colorado’s precious water for their livelihoods. In the 114th Congress, I fought the federal government’s attempts to cir-
cumvent state water law with the Water Rights Protection Act. Language from the bill passed the House three times last Congress, and I am hopeful that we’ll see the bill signed into law in the next year. T I P T O N The bark beetle epidemic has destroyed more than 2.9 million acres in Colorado and put our forests at high risk for catastrophic wildfires. We must do more to actively manage and protect our forests. I was pleased that language from my bill, the Healthy Forest Management and Wildfire Prevention Act, passed the House as part of the Resilient Federal Forests Act last Congress. This bill passed the Senate Committee on Agriculture, Nutrition, and Forestry in September 2016, but unfortunately, it was not brought to the Senate floor for a vote before the session ended. I am hopeful we will see this bill signed into law during the 115th Congress, so the state of Colorado will be able to better protect its communities

from devastating wildfires on National Forest System lands. We’re blessed in Colorado to have abundant natural resources, open spaces and scenic beauty. In the Third District, our energy portfolio includes traditional energy resources like natural gas, oil and clean coal, as well as renewable sources like wind, solar, hydropower, and geothermal energy. I firmly believe that we must implement an all-of-the-above energy strategy, which I outlined in the Planning for American Energy Act. This bill has passed the House twice, and I am looking forward to working on policies to advance responsible domestic energy production as a member of the Subcommittee on Mineral and Energy Resources. As Bishop said during our organizational meeting, during the next few months, our focus will be on analyzing
and developing infrastructure proposals that fall within the committee’s jurisdiction and lowering the regulatory burden that so many of our families, small businesses and communities face.
