PROPOSITION 26, PROPOSITION 218 AND RATE SETTING FOUNTAIN VALLEY – February 9, 2016 Municipal Water District of Orange County 18700 Ward Street Fountain Valley, CA 92708 On November 2, 1996, the California voters approved Proposition 218, which amended the California Constitution by adding new substantive and procedural requirements for the adoption of taxes, assessments, and property-related fees and charges. On November 2, 2010, the voters approved Proposition 26, a ballot initiative that further restricts the ability of the state and local governments to raise revenues to fund services, facilities, and regulatory programs by reclassifying certain fees and charges as taxes. This workshop provides an update on recent court cases and legislation interpreting and clarifying Proposition 218 and an overview of the provisions of Proposition 26 and the impacts they may have on local governments.
