Reporting Traffic Infractions of Diplomats This Act: • Requires law enforcement officers to record the name, address, vehicle license number, operator license number, and certain other information whenever a driver who displays a driver’s license issued by the U.S. Department of State or who otherwise claims immunities or privileges under present federal law is stopped for a traffic violation or is involved in a motor vehicle accident; • Requires law enforcement officers to forward such information to the state Department of Public Safety and Corrections (DPS&C) within seven calendar days after a traffic stop. However, if the driver is involved in an accident, the law enforcement officer shall forward such information, with a copy of the written accident report, to the DPS&C within 48 hours after completing the accident investigation; • Requires the DPS&C to receive all such information and forward it to the Bureau of Diplomatic Security, Office of Foreign Missions, of the U.S. Department of State within seven calendar days following receipt of such information, and • Prohibits these provisions from being construed to prohibit or limit the application of any motor vehicle or criminal law to an individual who has or claims immunities or privileges under present federal law. Section 1. [Short Title.] This Act may be cited as “An Act to Address Reporting Traffic Infractions of Diplomats.” Section 2. [Reports; Diplomatic Immunities and Privileges; U.S. Department of State; Deadlines.] (A) Whenever any driver who displays a driver’s license issued by the United States Department of State or who otherwise claims immunities or privileges under Title 22, Chapter 6 of the United States Code, is stopped by a law enforcement officer who has probable cause to believe that the driver has committed a violation of any provision [insert citation] or when any such driver has been involved in a motor vehicle accident, the law enforcement officer shall record the driver’s name, address, motor vehicle license number, operator license number, and all other relevant information contained on the driver’s license or identification card issued by the United States Department of State. If the driver has been stopped, the officer shall forward such information, with a copy of the traffic citation, if applicable, to the state [department of public safety and corrections] within [seven (7)] calendar days after the traffic stop. If the driver is involved in a motor vehicle accident, the law enforcement officer shall forward such information with a copy of the written report of the accident investigation to the [department of public safety and corrections] within [forty-eight (48)] hours after completion of the accident investigation. (B) The [department of public safety and corrections] shall receive all information, including copies of citations and accident reports, required under the provisions of this Section and shall forward such information and copies of reports and citations to the Bureau of Diplomatic Security, Office of Foreign Missions, of the United States Department of State within [seven (7)] calendar days following receipt of such information. (C) The provisions of this Section shall not be construed to prohibit or limit the application of any criminal law or motor vehicle regulation to an individual who has or claims immunities or privileges under Title 22, Chapter 6 of the United States Code. 115
